Declarations made upon ratification:

“1. Pursuant to Articles 70 and 10(1) of the Agreement under the United Nations Convention on the Law of the Sea on the Conservation and Sustainable Use of Marine Biological Diversity of Areas beyond National Jurisdiction, the Hellenic Republic declares the exception of the retroactive effects as set out in the second sentence of Article 10(1). Therefore, the provisions of this Agreement shall apply for the Hellenic Republic only to activities with respect to marine genetic resources and digital sequence information on marine genetic resources of areas beyond national jurisdiction collected or generated after the entry into force of this Agreement for the Hellenic Republic.
2. With reference to article 60, paragraphs 3 and 4 of the Agreement, the Hellenic Republic reaffirms the declarations that it has made pursuant to Articles 287 and 298 of the United Nations Convention on the Law of the Sea on 21 July 1995, upon ratification of the Convention and on 16 January 2015, respectively
3. With regard to the division of the competence of regional economic integration organizations and their member States in respect of the matters governed by this Agreement, the Hellenic Republic refers to the declaration of competence by the European Union in accordance with article 67, paragraph 2, of the Agreement.
4. According to article 70 of the Agreement, no reservations or exceptions may be made to this Agreement, unless expressly permitted by other articles of this Agreement. A declaration or statement made pursuant to article 71 cannot purport to exclude or modify the legal effect of the provisions of the Agreement in their application to the Signatory or Party making such а declaration or statement. Therefore, the Hellenic Republic declares that it shall not take into account or be bound in any way by declarations or statements that have been made or will be made by any Signatory or Party pursuant to article 71, which exclude or modify the effect of the provisions of the Agreement.”

Declaration:

"In accordance with article 23 of the Agreement on the Privileges and Immunities of the International Criminal Court, the Hellenic Republic declares that persons referred to in this Article who are either nationals or permanent residents of the Hellenic Republic shall, in the territory of the Hellenic Republic enjoy only the privileges and immunities referred to in this Article."

Reservation:

“Article 13 of the Protocol Against the Smuggling of Migrants by Land, Sea and Air, without prejudice to Articles 9A of the Constitution, 19(3) of the Constitution, 8(1) of the European Convention on Human Rights, 436-457 of the Code of Criminal Procedure and 352B of the Criminal Code, as added by Article Second (12) of Law 3625/2007 (Government Gazette 290A), Law 2472/1997, as amended by Articles 8 of Law 2819/2000 (Government Gazette 84A), 10 of Law 3090/2002 (Government Gazette 329A) and Eighth of Law 3625/2007, Law 3471/2006 (Government Gazette 133A) and Presidential Decree 47/2005 (Government Gazette 64A).
The Greek State makes use of Article 20(3) of the Protocol against the Smuggling of Migrants by Land, Sea and Air, and declares that it is not bound by para. 2 of this article.”

“The Greek State ratifies Article 13 of the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, ... without prejudice to Articles 9A of the Constitution, 19(3) of the Constitution, 8(1) of the European Convention on Human Rights, 436-457 of the Code of Criminal Procedure and 352B of the Criminal Code, as added by Article Second (12) of Law 3625/2007 (Government Gazette 290A), Law 2472/1997, as amended by Articles 8 of Law 2819/2000 (Government Gazette 84A), 10 of Law 3090/2002 (Government Gazette 329A) and Eighth of Law 3625/2007, Law 3471/2006 (Government Gazette 133A) and Presidential Decree 47/2005 (Government Gazette 64A).”

Reservation:

“Article 16 of the Convention is ratified in its entirety, without prejudice to Article 5 of the Constitution and Article 438 of the Code of Criminal Procedure.
Article 18 of the Convention is ratified without prejudice to Article 458(3) of the Code of Criminal Procedure and the provisions of Law 2472/1997 (Government Gazette 50A) “Protection of Individuals with regard to the Processing of Personal Data”, as currently in force.
The Greek State makes use of Article 35(3) and declares that it is not bound by para. 2 of this article.”

Declaration:

"Pursuant to article 3, paragraph 2 of the Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflicts, Greece declares that the minimum age at which voluntary recruitment in the Greek armed forces is permitted by national law, is 18 years."

"Greece fully subscribes to the principles enshrined within the [Convention] and declares that ratification of this Convention will take place as soon as conditions relating to the implementation of its relevant provisions are fulfilled."

"In this respect, the Government of the Hellenic Republic recalls that as a Member of the European Community, it has transferred competence to the European Community in respect of certain matters governed by the Agreement, which are specified in the Annex to this letter. The Hellenic Republic confirms the declarations made by the European Community upon ratification of the Agreement for the Implementation of the Provisions of the United Nations Convention on the Law of the Sea of 10 December 1982 relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks."

Reservation:

Subject to article 2 for the application of the death penalty in time of war pursuant to a conviction for a most serious crime of a military nature committed during wartime.

Interpretative declaration on the subject of straits made upon signature and confirmed upon ratification:

"The present declaration concerns the provisions of Part III `on straits used for international navigation' and more especially the application in practice of articles 36, 38, 41 and 42 of the Convention on the Law of the Sea.
In areas where there are numerous spread out islands that form a great number of alternative straits which serve in fact one and the same route of international navigation, it is the understanding of Greece, that the coastal state concerned has the responsibility to designate the route or routes, in the said alternative straits, through which ships and aircrafts of third countries could pass under transit passage régime, in such a way as on the one hand the requirements of international navigation and overflight are satisfied, and on the other hand the minimum security requirements of both the ships and aircrafts in transit as well as those of the coastal state are fulfilled."
Upon ratification:

“1. In ratifying the United Nations Convention on the Law of the Sea, Greece secures all the rights and assumes all the obligations deriving from the Convention.
Greece shall determine when and how it shall exercise these rights, according to its national strategy. This shall not imply that Greece renounces these rights in any way.
2. Greece wishes to reiterate the interpretative declaration on straits which it deposited at the time of the Convention's adoption and at the time of its signature. [See “Interpretative declaration made upon signature on the subject of straits and confirmed upon ratification” above.]
3. Pursuant to article 287 of the United Nations Convention on the Law of the Sea, the Government of the Hellenic Republic hereby choose, the International Tribunal for the Law of the Sea established in accordance with annex VI of the Convention as the means for the settlement of diconcerning the interpretation or application of the Convention.
4. Greece, as a State member of the European Union, has given the latter jurisdiction with respect to certain issues relating to the Convention. Following the deposit by the European Union of its instrument of formal confirmation, Greece will make a special declaration specifying in detail the issues dealt with in the Convention for which it has transferred jurisdiction to the European Union.
5. Greece's ratification of the United Nations Convention on the Law of the Sea does not imply that it recognizes the former Yugoslav Republic of Macedonia and does not, therefore, constitute the establishment of treaty relations with the latter."

Declaration under article 298

“Pursuant to article 298, paragraph 1, of the United Nations Convention on the Law of the Sea, the Hellenic Republic declares that it does not accept any of the procedures provided for in Part XV, section 2, with respect to the following disputes:
a)Disputes concerning the interpretation or application of articles 15, 74 and 83 relating to sea boundary delimitations, or those involving historic bays or titles;
b) isputes concerning military activities, including military activities by government vessels and aircraft engaged in non-commercial service, and disputes concerning law enforcement activities in regard to the exercise of sovereign rights or jurisdiction excluded from the jurisdiction of a court or tribunal under article 297, paragraph 2 or 3;
c) isputes in respect of which the Security Council of the United Nations is exercising the functions assigned to it by the Charter of the United Nations, unless the Security Council decides to remove the matter from its agenda or calls upon the parties to settle it by the means provided for in this Convention.”

Declaration:

The Government of Greece shall not be bound by part II, part IV, and annexes C.1, F, G and H of the Protocol.

"With a reservation to article 1 (4) amending the article 2 of the Single Convention."

The present Convention is approved on condition of the two limitations set forth in article I (3) of the Convention.

. . . Pursuant to article 12 of the Convention, the Kingdom of Greece makes a reservation with respect to the system of de-limiting the boundaries of the continental shelf appertaining to States whose coasts are adjacent or opposite each other, provided for in article 6, paragraphs 1 and 2, of the Convention. In such cases, the Kingdom of Greece will apply, in the absence of international agreement, the normal baseline system for the purpose of measuring the breadth of the territorial sea.

“In cases or circumstances which, in its opinion, would justify exceptional procedure for reasons of national security or public order, the Hellenic Government reserves the right to derogate from the obligations imposed by the provisions of article 26.”

"Greece, in re-confirming its acceptance, considers that the aforesaid Organization can play a useful and important role in the field of technical and nautical matters, thus contributing to the development of shipping and seaborne trade throughout the world. In case the Organization extends its activities to matters of commercial and economic nature, the Greek Government may find itself bound to reconsider its acceptance of the Convention and avail itself of its provisions concerning withdrawal as laid down in article 59."

Upon signature:

"Greece declares under article 2, paragraph 2, sub-paragraph c) that it shall, as soon as possible and as a first step, take effective measures to ensure at least that at the latest by the year 1999 its national annual emissions of VOCs do not exceed the 1988 levels."
