“The Government of the Islamic Republic of Pakistan declares that, pursuant to Article 66, Paragraph 3 of the Convention, it does not consider itself bound by the provisions of paragraph 2 of this Article."

Reservation:

“1. In accordance with paragraph 3 of Article 15, the Government of Islamic Republic of Pakistan declares that it does not considers itself bound by the obligation set forth in paragraph 2 of Article 15.
2. The Government of Islamic Republic of Pakistan hereby declares that nothing in the Protocol shall be seen to be imposing obligations on Pakistan to admit or retain within its borders persons in respect of whom Pakistan would not otherwise have an obligation to admit or retain within its borders.”

“Article 35 (2)
The Government of the Islamic Republic of Pakistan does not consider itself bound by paragraph 2 of article 35 of the Convention.”

Declaration under article 3 (2):

“The Islamic Republic of Pakistan, pursuant to article 3 (2) of the Optional Protocol to the Convention on the Rights of the Child on the Involvement of Children in Armed Conflict, declares that:
i. The minimum age of recruitment of personnel into the armed forces of Pakistan is 16 years.
ii. The armed forces personnel are sent to combatant areas only after they attain eighteen years of age.
iii. The recruitment into the armed forces of Pakistan is purely voluntary, and made through open competition on merit without any force or coercion.
iv. The recruit is required to present B-Form issued by the National Database and Registration Authority as a token of proof of having attained minimum age prescribed under the law for recruitment."

“Article 11
The Government of the Islamic Republic of Pakistan declares that pursuant to Article 11 paragraph 2, of the Convention, it does not take this Convention as the legal basis for cooperation on extradition with other States Parties.
Article 14
Extradition to other countries shall be subject to the domestic laws of Pakistan.
Article 24
The Government of the Islamic Republic of Pakistan does not consider itself bound by Article 24, Paragraph 1 of the International Convention for the Suppression of the Financing of Terrorism. The Government of Islamic Republic of Pakistan hereby declares that, for a dispute to be referred to the International Court of Justice, the agreement of all parties shall in every case be required.”

Declaration:

"The Government of the Islamic Republic of Pakistan declares that nothing in this Convention shall be applicable to struggles, including armed struggle, for the realization of right of self-determination launched against any alien or foreign occupation or domination, in accordance with the rules of international law. This interpretation is consistent with Article 53 of the Vienna Convention on the Law of Treaties 1969 which provides that an agreement or treaty concluded in conflict with an existing jus cogen or preemptory norm of international law is void and, the right of self-determination is universally recognized as a jus cogen ."

Declaration:

"1. Pakistan has consistently stood for the complete prohibition and thorough destruction of all chemical weapons and their production facilities. The Convention constitutes an international legal framework for the realization of this goal. Pakistan, therefore, supports the objectives and purposes of the Convention.
2. The objectives and purposes of the Convention must be strictly adhered to by all states. The relevant provisions on Challenge Inspections must not be abused to the detriment of the economic and security interests of the States Parties unrelated to chemical weapons. Otherwise, the universality and effectiveness of the Convention is bound to be jeopardized.
3. Abuse of the verification provisions of the Convention, for purposes unrelated to the Convention, will not be acceptable. Pakistan will never allow its sovereignty and national security to be compromised.
4. The Convention should effectively facilitate trade, scientific and technological exchanges and co-operation in the field of chemistry for peaceful purposes. All export control regimes inconsistent with the Convention must be abolished."

“Article 8
‘The Government of the Islamic Republic of Pakistan declares that pursuant to Article 8, paragraph 2, of the Convention, it does not take this Convention as the legal basis for cooperation on extradition with other States Parties’.
Article 28
‘In accordance with Article 28, paragraph 1, of the Convention, the Government of the Islamic Republic of Pakistan hereby declares that it does not recognize the competence of the Committee provided for in Article 20’.
Article 30
‘The Government of the Islamic Republic of Pakistan does not consider itself bound by Article 30, Paragraph 1 of the Convention’.”

Declarations:

" i) The Government of the Islamic Republic of Pakistan shall, at an appropriate time, make declarations provided for in articles 287 and 298 relating to the settlement of disputes.
ii) The Law of the Sea Convention, while dealing with transit through the territory of the transit State, fully safeguards the sovereignty of the transit State. Consequently, in accordance with article 125 of the rights and facilities of transit to the land locked State ensures that it shall not in any way infringe upon the sovereignty and the legitimate interest of the transit State. The precise content of the freedom of transit consequently, in each case, has to be agreed upon by the transit State and the land locked State concerned. In the absence of such an agreement concerning the terms and modalities for exercising the right of transit, through the territory of the Islamic Republic of Pakistan shall be regulated only by national laws of Pakistan.
iii) It is the understanding of the Government of the Islamic Republic of Pakistan that the provisions of the Convention on the Law of the Sea do not in any way authorize the carrying out in the Exclusive Economic Zone and in the Continental Shelf of any coastal State military exercises or manoeuvres by other States, in particular where the use of weapons or explosives are involved, without the consent of the coastal State concerned."

Declaration:

"The accession by [the] Government of the Islamic Republic of Pakistan to the [said Convention] is subject to the provisions of the Constitution of the Islamic Republic of Pakistan."

"(i) The quasi-medical use of opium;
"(ii) The use of cannabis, cannabis resin, extracts and tinctures of cannabis for non-medical purposes, and
"(iii) The production and manufacture of and trade in the drugs referred to under (i) and (ii) above."

"The Islamic Republic of Pakistan will apply the Convention to the recognition and enforcement of awards made only in the territory of [a] Contracting State."

"The Government of Pakistan will permit for a period of fifteen years after the coming into effect of the said Protocol: (i) the use of opium for quasi-medical purposes; and (ii) the production of opium and/or import thereof from India or Iran for such purposes."

"Article III of the Convention shall have no application as regards recruitment to and conditions of services charged with the maintenance of public order or unsuited to women because of the hazards involved."

"In accordance with paragraph 4 of the Schedule to the Indian Independence Order, 1947 , Pakistan considers herself a party to the International Convention for the Suppression of the Traffic in Women and Children concluded at Geneva on 30 September 1921 by the fact that India became a party to the above-mentioned Convention before 15 August 1947."

Interpretative declaration made upon signature:

a) The provisions of the Agreement under the United Nations Convention on the Law of the Sea on the Conservation and Sustainable Use of Marine Biological Diversity of Areas beyond National Jurisdiction shall be applied and interpreted in accordance with the provisions of the United Nations Convention on the Law of the Sea of 1982. Therefore, the Islamic Republic of Pakistan understands that the Agreement is without prejudice to the sovereign rights, jurisdiction and powers of coastal States under the Convention.
b) For the purposes of the Agreement, the Islamic Republic of Pakistan reaffirms the declaration it made upon [signing] the United Nations Convention on the Law of the Sea of 1982 with regard to part XV of the Convention, on the settlement of disputes. The Islamic Republic of Pakistan states that:
The Government of the Islamic Republic of Pakistan shall, at an appropriate time, make declarations provided for in articles 287 and 298 relating to the settlement of disputes.
c) The Islamic Republic of Pakistan understands that the principle of the common heritage of humankind, as specified in Article 7, Paragraph (b) of the Agreement, applies to both the geographical spaces and the resources covered under the scope of this Agreement. The scope and legal effects of the freedom of marine scientific research outlined in Article 7, Paragraph (c) of this Agreement should be interpreted in accordance with the United Nations Convention on the Law of the Sea (UNCLOS). The Islamic Republic of Pakistan believes that Article 241 of UNCLOS is crucial for this interpretation and that marine scientific research cannot be used to justify claims of ownership or proprietary rights over any part of the marine environment or its resources.

“HEREBY DECLARE that the Government of the Islamic Republic of Pakistan makes the following reservations in relation to Article 8(1)(a) and 8(1)(b) of the United Nations Convention on International Settlement Agreements Resulting from Mediation:
I. The Islamic Republic of Pakistan, in accordance with Article 8, paragraph No. 1(a) of the Convention, declares that it will not apply the Convention to settlement agreements to which it is a party, or to which any governmental agencies or any person acting on behalf of a governmental agency is a party.
II. In accordance with Article 8, paragraph No. 1(b) of the Convention, the Islamic Republic of Pakistan shall apply this Convention only to the extent that the parties to the settlement agreement have agreed to the application of the Convention.”
