North Korea

Reservations:

1. In accordance with paragraph 3 of Article 35 of the Convention, the Government of the Democratic People`s Republic of Korea declares that it does not consider itself bound by paragraph 2 of Article 35.2. With regard to Article 10 of the Convention, the Government of the Democratic People’s Republic of Korea declares that it does not consider itself bound, in part of Article 10, since the liability of legal person is not established in DPRK Criminal Law.

Upon signature:

Reservations:
1. The Democratic People's Republic of Korea does not consider itself bound by the provisions of article 2, paragraph 1, sub-paragraph (a) of the Convention.
2. The Democratic People's Republic of Korea does not consider itself bound by the provisions of article 14 of the Convention.
3. The Democratic People's Republic of Korea does not consider itself bound by the provisions of article 24, paragraph 1 of the Convention.
Upon Ratification:

Reservations:
1. The reservation relating to Article 2, paragraph 1, sub-paragraph (a) of the Convention shall be amended to read as ‘The Democratic People’s Republic of Korea does not consider itself bound by the treaties to which it is not a party among the treaties listed in the Annex of the Convention.’
2. The reservation relating to Article 14 of the Convention shall be withdrawn.
3. The reservation relating to Article 24, paragraph 1 of the Convention shall remain valid.

Reservation:

"The Government of the Democratic People's Republic of Korea does not consider itself bound by all of paragraph 1 of Article 22 of the Convention on the Safety of United Nations and Associated Personnel."

Reservation:

“The Democratic People’s Republic of Korea declares, in accordance with Article 96 of the United Nations Convention on Contracts for the International Sale of Goods, that any provision of Articles 11 and 29 of the Convention that allows a contract of sale or its modification or termination by agreement to be made in any form other than in writing, will not apply where any party has its place of business in DPRK’s territory.”

Reservations:

On 23 November 2015, the Government of the Democratic People’s Republic of Korea notified the Secretary-General of its decision to withdraw the reservations to paragraph (f) of article 2 and paragraph 2 of article 9 of the Convention. The remaining reservation reads as follows: “The Government of the Democratic People’s Republic of Korea does not consider itself bound by the provisions article 29 of [the Convention].”

Reservations:

1. The Democratic People's Republic of Korea does not consider itself bound by the provisions of article 16, paragraph 1 of the Convention.
2. The Democratic People's Republic of Korea does not consider itself bound by the provisions of article 5, paragraph 3 of the Convention.

Reservation:

The Government of the Democratic People's Republic of Korea does not consider itself bound by the provisions of article 13, paragraph 1, of the Convention, recognizing that any dispute between two or more States Parties concerning the interpretation or application of the Convention should not, without consent of both parties, be submitted to international arbitration and to the International Court of Justice.
