<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" eId="section-1"><num>1</num><heading> Adventure activities: licensing.</heading><subsection eId="section-1-1"><num>(1)</num><content><p>The Secretary of State shall by order designate a person (“the licensing authority”) to exercise such functions as may be prescribed by regulations relating to the licensing of persons providing facilities for adventure activities.</p></content></subsection><subsection eId="section-1-2"><num>(2)</num><content><p>The Secretary of State shall not make an order under subsection (1) designating a person other than one nominated by <ins class="substitution first last" ukl:ChangeId="key-1af6f3467f33fb1cd705f4031a7fb226-1444387265367" ukl:CommentaryRef="key-1af6f3467f33fb1cd705f4031a7fb226"><noteRef uk:name="commentary" href="#key-1af6f3467f33fb1cd705f4031a7fb226" class="commentary"/>the Health and Safety Executive</ins>.</p></content></subsection><subsection eId="section-1-2A"><num>(2A)</num><content><p><ins class="first last" ukl:ChangeId="key-f9fb20b8fc53b1269749a7633b619a50-1444387318891" ukl:CommentaryRef="key-f9fb20b8fc53b1269749a7633b619a50"><noteRef uk:name="commentary" href="#key-f9fb20b8fc53b1269749a7633b619a50" class="commentary"/>The Health and Safety Executive may nominate itself under subsection (2)</ins></p></content></subsection><subsection eId="section-1-3"><num>(3)</num><intro><p>In this section “<term refersTo="#term-facilities-for-adventure-activities" eId="term-facilities-for-adventure-activities">facilities for adventure activities</term>” means such facilities, for such sporting, recreational or outdoor activities, as may be prescribed by regulations; but the expression does not include—</p></intro><level class="para1" eId="section-1-3-a"><num>(a)</num><content><p>facilities which are provided exclusively for persons who have attained the age of 18; or</p></content></level><level class="para1" eId="section-1-3-b"><num>(b)</num><content><p>facilities which do not consist of, or include some element of, instruction or leadership.</p></content></level></subsection><subsection eId="section-1-4"><num>(4)</num><intro><p>Regulations may make provision as to—</p></intro><level class="para1" eId="section-1-4-a"><num>(a)</num><content><p>the cases or circumstances in which persons providing facilities for adventure activities are, or are not, required to hold a licence;</p></content></level><level class="para1" eId="section-1-4-b"><num>(b)</num><content><p>any requirements relating to safety (whether applying to facilities for adventure activities or to other facilities) which must be satisfied by an applicant for a licence;</p></content></level><level class="para1" eId="section-1-4-c"><num>(c)</num><content><p>the conditions subject to which licences are granted (which may include conditions relating to inspection by the licensing authority and conditions imposing requirements of the kind referred to in paragraph (b));</p></content></level><level class="para1" eId="section-1-4-d"><num>(d)</num><content><p>the variation of such conditions;</p></content></level><level class="para1" eId="section-1-4-e"><num>(e)</num><content><p>the renewal, variation, transfer and revocation of licences by the licensing authority;</p></content></level><level class="para1" eId="section-1-4-f"><num>(f)</num><content><p>the charging by the licensing authority of such fees in connection with licences as may be specified in the regulations;</p></content></level><level class="para1" eId="section-1-4-g"><num>(g)</num><content><p>the making of payments by the licensing authority into the Consolidated Fund;</p></content></level><level class="para1" eId="section-1-4-h"><num>(h)</num><content><p>the investigation by the licensing authority of complaints concerning licence-holders;</p></content></level><level class="para1" eId="section-1-4-i"><num>(i)</num><content><p>the exercise of functions of the licensing authority by persons authorised by them;</p></content></level><level class="para1" eId="section-1-4-j"><num>(j)</num><content><p>the keeping, and availability for inspection by the public, of a register of licences;</p></content></level><level class="para1" eId="section-1-4-k"><num>(k)</num><content><p>the bringing of appeals to the Secretary of State against such decisions of the licensing authority as may be specified in the regulations; and</p></content></level><level class="para1" eId="section-1-4-l"><num>(l)</num><content><p>the procedure to be followed on, and the orders which may be made on determination of, such appeals.</p></content></level></subsection><subsection eId="section-1-5"><num>(5)</num><content><p>In exercising their functions under regulations made under this section the licensing authority<ins class="first last" ukl:ChangeId="key-6592ce397ced2053ed1d5496add25add-1444387349748" ukl:CommentaryRef="key-6592ce397ced2053ed1d5496add25add"><noteRef uk:name="commentary" href="#key-6592ce397ced2053ed1d5496add25add" class="commentary"/>other than the Health and Safety Executive</ins> shall have regard to any guidance given to them from time to time by <ins class="substitution first last" ukl:ChangeId="key-02ad35dd7dfa5feea52de0e1635dce72-1444387371792" ukl:CommentaryRef="key-02ad35dd7dfa5feea52de0e1635dce72"><noteRef uk:name="commentary" href="#key-02ad35dd7dfa5feea52de0e1635dce72" class="commentary"/>the Health and Safety Executive</ins>; and before giving guidance under this subsection <ins class="substitution first last" ukl:ChangeId="key-02ad35dd7dfa5feea52de0e1635dce72-1444387393118" ukl:CommentaryRef="key-02ad35dd7dfa5feea52de0e1635dce72"><noteRef uk:name="commentary" href="#key-02ad35dd7dfa5feea52de0e1635dce72" class="commentary"/>the Executive</ins> shall consult such persons (if any) as they consider it appropriate to consult.</p></content></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-2"><num>2</num><heading> Offences.</heading><subsection eId="section-2-1"><num>(1)</num><intro><p>Regulations may provide for it to be an offence—</p></intro><level class="para1" eId="section-2-1-a"><num>(a)</num><content><p>to do anything for which a licence is required under the regulations, otherwise than in accordance with a licence; or</p></content></level><level class="para1" eId="section-2-1-b"><num>(b)</num><intro><p>for the purposes of obtaining or holding a licence—</p></intro><level class="para2" eId="section-2-1-b-i"><num>(i)</num><content><p>to make a statement to the licensing authority (or someone acting on their behalf) knowing it to be false in a material particular, or</p></content></level><level class="para2" eId="section-2-1-b-ii"><num>(ii)</num><content><p>recklessly to make a statement to the licensing authority (or someone acting on their behalf) which is false in a material particular.</p></content></level></level></subsection><subsection eId="section-2-2"><num>(2)</num><intro><p>A person convicted of an offence under regulations made under subsection (1) shall be liable—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>on summary conviction, to a fine not exceeding the statutory maximum;</p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><intro><p>on conviction on indictment—</p></intro><level class="para2" eId="section-2-2-b-i"><num>(i)</num><content><p>for an offence under regulations made under subsection (1)(a), to imprisonment for a term not exceeding two years, or a fine, or both;</p></content></level><level class="para2" eId="section-2-2-b-ii"><num>(ii)</num><content><p>for an offence under regulations made under subsection (1)(b), to a fine.</p></content></level></level></subsection><subsection eId="section-2-3"><num>(3)</num><intro><p>Regulations under subsection (1)—</p></intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content><p>may provide defences to be available in proceedings for an offence under the regulations either generally or in specified circumstances;</p></content></level><level class="para1" eId="section-2-3-b"><num>(b)</num><content><p>may make, in relation to provisions of the regulations, provision which applies (with or without modifications), or has a similar purpose to that of, any of the provisions of the <noteRef href="#c830642" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Health and Safety at Work <abbr title="et cetera" xml:lang="la">etc.</abbr> Act 1974 set out in subsection (4).</p></content></level></subsection><subsection eId="section-2-4"><num>(4)</num><intro><p>The provisions mentioned in subsection (3)(b) are:</p></intro><level class="para1" eId="section-2-4-a"><num>(a)</num><content><p>sections 15(7) and 35 (venue);</p></content></level><level class="para1" eId="section-2-4-b"><num>(b)</num><content><p>sections 18 to 20 and 26 (enforcement authorities and inspectors);</p></content></level><level class="para1" eId="section-2-4-c"><num>(c)</num><content><p>sections 21 to 24 (improvement and prohibition notices);</p></content></level><level class="para1" eId="section-2-4-d"><num>(d)</num><content><p>section 25 (power to deal with cause of imminent danger);</p></content></level><level class="para1" eId="section-2-4-e"><num>(e)</num><content><p>sections 27 and 28 (obtaining and disclosure of information);</p></content></level><level class="para1" eId="section-2-4-f"><num>(f)</num><content><p>section 33(1)(e) to (j), (n) and (o)<ins class="substitution first last" ukl:ChangeId="key-e4e95487f7c07b7d7224c1790d033e9f-1444387732133" ukl:CommentaryRef="key-e4e95487f7c07b7d7224c1790d033e9f"><noteRef uk:name="commentary" href="#key-e4e95487f7c07b7d7224c1790d033e9f" class="commentary"/>and (2) (and the related provisions of Schedule 3A)</ins> (ancillary offences);</p></content></level><level class="para1" eId="section-2-4-g"><num>(g)</num><content><p>section 34(2) to (6) (extension of time for bringing summary proceedings);</p></content></level><level class="para1" eId="section-2-4-h"><num>(h)</num><content><p>sections 36(1) and 37 (offences due to fault of other person and offences by bodies corporate);</p></content></level><level class="para1" eId="section-2-4-i"><num>(i)</num><content><p>sections 38 and 39 (prosecutions in England and Wales only by inspectors or by or with the consent of the Director of Public Prosecutions);</p></content></level><level class="para1" eId="section-2-4-j"><num>(j)</num><content><p>sections 40 and 41 (onus of proving limits of what is practicable, and evidence);</p></content></level><level class="para1" eId="section-2-4-k"><num>(k)</num><content><p>section 42 (power of court to order cause of offence to be remedied); and</p></content></level><level class="para1" eId="section-2-4-l"><num>(l)</num><content><p>section 46 (service of notices).</p></content></level></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" eId="section-3"><num>3</num><heading> Supplementary provisions.</heading><subsection eId="section-3-1"><num>(1)</num><content><p>An order under section 1(1) shall be made by statutory instrument; and an order revoking a previous order may include transitional or incidental provision (including provision for the transfer of property, rights and liabilities from the old licensing authority to the new).</p></content></subsection><subsection eId="section-3-2"><num>(2)</num><intro><p>Regulations under section 1 or 2—</p></intro><level class="para1" eId="section-3-2-a"><num>(a)</num><content><p>shall be made by the Secretary of State by statutory instrument;</p></content></level><level class="para1" eId="section-3-2-b"><num>(b)</num><content><p>may make different provision for different cases; and</p></content></level><level class="para1" eId="section-3-2-c"><num>(c)</num><content><p>may include transitional provisions.</p></content></level></subsection><subsection eId="section-3-3"><num>(3)</num><content><p>Before making regulations under section 1 or 2 the Secretary of State shall consult <ins class="substitution first last" ukl:ChangeId="key-169e714243afcacc13a3fbb7b959cbed-1444387519459" ukl:CommentaryRef="key-169e714243afcacc13a3fbb7b959cbed"><noteRef uk:name="commentary" href="#key-169e714243afcacc13a3fbb7b959cbed" class="commentary"/>the Health and Safety Executive</ins> and such other persons (if any) as he considers it appropriate to consult.</p></content></subsection><subsection eId="section-3-4"><num>(4)</num><content><p><ins class="substitution first last" ukl:ChangeId="key-864769ef72317036415df54dfd5f2c9f-1444387537633" ukl:CommentaryRef="key-864769ef72317036415df54dfd5f2c9f"><noteRef uk:name="commentary" href="#key-864769ef72317036415df54dfd5f2c9f" class="commentary"/>The Health and Safety Executive</ins> may from time to time submit to the Secretary of State such proposals as <ins class="substitution first last" ukl:ChangeId="key-864769ef72317036415df54dfd5f2c9f-1444387563092" ukl:CommentaryRef="key-864769ef72317036415df54dfd5f2c9f"><noteRef uk:name="commentary" href="#key-864769ef72317036415df54dfd5f2c9f" class="commentary"/>the Executive</ins> considers appropriate for the making of regulations under section 1 or 2; and where the Secretary of State proposes to make regulations in the form submitted under this subsection, the requirement under subsection (3) to consult <ins class="substitution first last" ukl:ChangeId="key-864769ef72317036415df54dfd5f2c9f-1444387579894" ukl:CommentaryRef="key-864769ef72317036415df54dfd5f2c9f"><noteRef uk:name="commentary" href="#key-864769ef72317036415df54dfd5f2c9f" class="commentary"/>the Executive</ins> shall not apply.</p></content></subsection><subsection eId="section-3-5"><num>(5)</num><content><p>Nothing in, or done by virtue of, this Act or regulations under it shall prejudice any of the relevant statutory provisions (whenever made) as defined in Part I of the <noteRef href="#c830643" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Health and Safety at Work <abbr title="et cetera" xml:lang="la">etc.</abbr> Act 1974 or anything done by virtue of any of those provisions.</p></content></subsection><subsection eId="section-3-6"><num>(6)</num><content><p>A statutory instrument containing an order or regulations under section 1 or 2 shall be subject to annulment in pursuance of a resolution of either House of Parliament.</p></content></subsection><subsection eId="section-3-7"><num>(7)</num><content><p>The Secretary of State may make grants to the licensing authority in respect of such of their expenses under this Act as are not met by fees; and grants under this subsection may be made subject to such conditions, including conditions as to repayment, as the Secretary of State may determine.</p></content></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4"><num>4</num><heading> Expenses.</heading><content><p>There shall be paid out of money provided by Parliament any expenditure incurred by the Secretary of State under or by virtue of this Act.</p></content></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-5"><num>5</num><heading> Commencement.</heading><content><p>This Act shall come into force at the end of the period of two months beginning with the date on which it is passed.</p></content></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-6"><num>6</num><heading> Short title and extent.</heading><subsection eId="section-6-1"><num>(1)</num><content><p>This Act may be cited as the Activity Centres (Young Persons’ Safety) Act 1995.</p></content></subsection><subsection eId="section-6-2"><num>(2)</num><content><p>This Act shall not extend to Northern Ireland.</p></content></subsection></section>
