Resettlement Terminolog' This Resettlement Action Plan (RAP) is prepared according to the Laws and Regulations of PRC, and Zhejiang Province as well as the Guidelines of the World Bank (Operational Directive for Involuntary Resettlement OP 4.12). The purpose of this document is to set out an Action plan for the Resettlement and Rehabilitation of the Project Affected Persons (PAPs) to ensure that they will benefit from the project and their standards of living will improve or at least be restored after the project impact. Acquisition of land and other assets for the project will adversely affect the livelihood of persons who live, work or earn their living on the land that will be acquired for the project. PAPs are defined as those persons whose income or livelihoods will be adversely affected by land acquisition for the project. PAPs include the following categories: 1) Persons who have a title, right, interest, in structures (houses, enterprises, shelters, or public buildings), land (including residential, agricultural, and grazing land) or any other asset acquired or possessed, in full or in part, permanently or temporarily; 2) Persons who use the structures, land or assets described above; or persons whose business, occupation, work, place of residence or habitat adversely affected; or 3) Persons whose standard of living is adversely affected as a consequence of land acquisition. A definition of PAPs is given below: Definition of the PAPs: "Affected Persons" means persons who on account of the execution of the project had or would have their: a) standard of living adversely affected; or b) right, title or interest in any house, land (including premises, agricultural and grazing land) or any other fixed or movable asset acquired or possessed, temporarily or permanently; or c) business, occupation, work or place of residence or habitat adversely affected. PAPs may be individuals or legal persons such as a company, a public institution. Definition of PAPs is not to set a limit to their legal registration or permission to live or conduct business in the affected location, or to the compersation of their property. Thus, it includes: 1) All those affected by the project regardless of their legal rights or absence thereof to the assets being taken; and 2) Persons without residential permit to live in a certEain area. Therefore all such persons who are affected will be considered and recorded as PAPs, regardless of their legal connection to assets land or location. If there are more than one person, family or household using or holding a title to the same land or property that is acquired, they will be compensated and rehabilitated according to the loss they suffer, their rights, and the impact on their living standards. The definition of PAPs is linked directly to the adverse effect of the project, regardless of legal rights title or interest. All PAPs are entitled to the improvement or at least restoration of their standards of living, and compensation for the material losses ,hey suffer. Compensation for assets will cover replacement cost. No deductions or discounts will be applied to the compensation amount for depreciation or other reasons. All :'APs deriving an economic benefit from the affected land and property are entitled to receive rehabilitation benefits in addition to the compensation for their assets lost. Those PAPs without title, authorization or legal permission to reside, conduct business, cultivate land or construct structures are eligible for rehabilitation of their livelihoods and compensation for their assets on an equal footing with those with formal legal title, authorization or permissions to the assets. 2 Definition of "RESETTLEMENT' The term RESETTLEMENT refers to make an arrangement to people's production and living that are affected in order to make them benefit from the project. It includes: 1) the relocation of living quarters; 2) finding acceptable new employment for those whose jobs are affected; 3) restoration (or compensation) of affected productive resources such as land, workplaces, trees and infrastructure; 4) restoration of other adverse effect on PAPs' living standards (quality of life) through land acquisition (such as the adverse effects of pollution); 5) restoration of or compensation for affected private and public enterprises; 6) restoration of adversely affected on cultural or common property. Definition of "Rehabilitation" Rehabilitation means: the restoration of the PAPs' resource capacity to continue with productive activities or lifestyles at a level higher or at least equal to that before the project. The objective of this RAP is to provide a plan for the resettlement and rehabilitation of the PAPs so that their losses will be compensated and their standards of living will be improved or at least restored to the pre-project levels. To achieve these objectives the plan provides for rehabilitation measures so that the income earning potential of individuals are restored to sustain their livelihoods. Affected productive resources of 3 businesses (enterprises including shops) and public property. Infrastructure and cultural property will also be improved or at least restored to their pre-project levels. 4 1 Basic Situations of the Project 1.1 Brief Introduction of the Project In order to improve ecological environment and appearance of the ancient city and to raise the taste of the city according to "Shaoxing Urban General Planning (2002-2020) " and "Shaoxing History &Culture Protection Planning", Shaoxing plans to carry out an urban infrastructure reconstruction financed by World Bank for Zhejiang urban construction environment protection project . The project includes: the inner river course environment renovation and reconstruction of infrastructure in history blocks. There are 5 blocks: Yuezicheng historical block (east, west sections), Baziqiao historical block (Baziqiao water street), Luxun Road historical block (local conditions and customs written by Luxun), West little river historical block (east, west sections, water town scenery of west little river), Jishan historical block. 1.1.1 Inner River Course Environment Renovation in Ancient City There are still 17 inner rivers in Shaoxing with 20.2km long altogether. The ring river is the backbone water system in the city, which is West little road river-Around Mountain River-Guanxiang River-Luxun Road River-Jishan River-Jishan River-Xiao Mountain Street River-Shangda Road River. The water city layout, which is one river one road, one river two roads, and river with no road, is the most marked characteristic distinguishing from other city. But the elevation of the riverbed in the old city proper is higher than that in the suburbs because they deposit heavily for a long time. Water in the upper reaches does not go into the city easily and self-cleaning ability of the river course is bad resulting in heavy pollution, especially blackening and stinking. It affects the beauty and renovation of the river extremely. The inner river course reconstruction works includes river dredging, riverbank masonry on both sides, riverbed paving, water-cleaning facilities construction, such as sluice and pump station, protecting, reinforcing and maintaining the 22 old stone bridges, improving environment on both sides of the rivers. In the mean while, in order to connect the ring river inside the city and develop tourism trade, recligging the Guanxiang River is necessary. Dredge Luomen Port, South Ring inner river, and connect the east half and west half. Form ring river tourism line in order to keep the existing river, road, bridge pattern as the special beauty of water town. In order to carry out "blue water" project, upgrade thE quality of water from below standard V up to . The following 8 measures will be taken, that is "Sewage interception, dredging, riverbank masonry, river valley paving, water diversion, tree planting, preservation and management": 1 Sewage interception : to improve the sewage interception within an area of 8.32km2 m the old city proper, to solve the pollution problem thoroughly. 2 Dredging: to dredge all the existing rnvers. Dig Guanxiang River with 370m long, 5-7m wide. Connect east half ring river and west half ring river course. Dredge Luomen Port and South Ring internal River with 300m and 210m long, 5m and 6m widths respectively. Widen the river course, such as Luxun River, from 3.5-7m at present to 6-7m, and Xianhuan River and Fu River. Connect the rivers as a net to form aquatic tourism line. 3 bridges will be newly built because of the digging of the Guangang River. They are located in Jiefang Road, Hongqi Road and Dachengnong respectively. 3 River bank masonry: to repair the riverbank masonry. Because they have not been repaired for a long time, at some place, they are sericusly weathered, it has to be rebuilt. 4 Riverbed paving: to unify valley elevation of 17 rivers, to make overall paving to facilitate the mechanical dredging in the future. 5 Water diversion: flowing water from city-protecting] river which located outside the city will be diverted to the inner river in order to make the water inside the city movable and clear by way of flushing twice a day at least. Tiere are built 3 water pump stations with 8 sluices at present. It is planned to construct another water pump station with 6 sluices and renovate the exciting pump station and sluices. Rebuild original pump station to higher the water level to satisfy the requirements for traveling of tourists' boats. 6 Tree-planting: renovate the environment on both sides in order to protect the river course. Plant vegetation to shelter the unsightly build from view with high arbor. Such as: river in front of Jingang temple, Toulao river, Luomen River, South Ring 2 internal river. 7 Preservation: to preserve and repair the existing 22 ancient bridges built in historical dynasty. Protect historical relics and site. Make use of ancient water conservancy facilities for current purpose. 8 Management: to establish regulation for river system preservation. Strengthen propaganda so that all the citizen take care to and cherish river courses. Strengthen daily management at the same time, local environment and hygienic departments dredge up drifting matters; the municipal administration department takes responsibility for management of riverbanks; and local neighborhood committee shall participate in routine management of river courses actively. Teach target of clear water, solid bank, ancient view of the bridges, and scenic beauty by treatment of the water environment. Also, improve surroundings, so tourist can appreciate the wonderful sight fully. According to preliminary layout, Shangda road river, Xiaoshan avenue river, Jishan river, Jishan river, around mountain river, West little river, Tishan river and Toulao river in the 17 rivers, their project just include cleaning deposit, layouting the riverbeds, and rebuild the riverbank. The project requires more and more land, but no demolition affect on the residents on 2 sides. For the rest 7 rivers, Xianhuan River, Luxun Road River, Fu River and Jingang Temple River, their projects involve in river widening. For Luomengang, it needs not only dredging by 210m, but also part of original river widening. Guangang River is a newly built river with 370m long. Its overall layout has been formed in Song dynasty. The current existed Yuezichen in Shaoxing City was the Yue small town constructed by Minister Fanli authorized by Emperor Goujian of Yue kingdom during the Spring and Autumn Warring States period, about 2,500 years ago. There are still relics and historic sites such as Wenzhong Tomb, Mo Cliff from Tang and dynasties as the witness of Yue culture although it experienced lots of tribulation and destroy. Yuezi City preservation area starts from Well Alley in the east, to South Fu mountain road in the west (including Panggong pond). It's bounded on the south by Renmin road, in front of Siyushi. It's to rounding mountain river in the north. Its total area is 68.28ha. There are still integrated traditional residential houses in store in Rounding Mountain River and Red flag road in the east of Yuezi city. The two sides of rounding Mountain River conserve the characteristic of "river without road". Atmosphere of "Little bridge, running water, households", pattern of street in front and river in the rear of houses, pink wall and dark green tile is embodied here fully. The renovation and repair of Yuezi City can prolong the civilized history of Shaoxing for thousands years in our heart objectively. Reconstruction of Infrastructure in Yuezi City contents is as follows: (1) adjusting the function of used land and improving living environment The status of used land in Preservation area is jumbled. Factory and some residential houses which don't match the general function must be demolished. According to the project, green square of Renmin road will be built after the Shaoxing Silk-knitting is removed. To make green patches, as transitional area to Fu Mountain. To restore Xi garden, Fire Pearl temple, gate tower and city wall so natural landscape is harmonized with humanity landscape organically. 6 (2) Repairing the residential houses built in Ming anci Qing dynasty Repair the residential houses built in Ming and Cing dynasty in preservation area with around 156107m2. (3) Strengthening the reconstruction of infrastructure Strengthen the existing piping line relaying, it's mainly electricity, telecommunication, raining water, the supply cf water, cable TV, road lamp and as well as to add drainage piping and gas tube. 1.1.2.2 Reconstruction of Infrastructure in Bazicliao Bridge Baziqiao Bridge historical block is located at the east side of Zhongxing road. It has the best qualifications of a representative of water street and is kept much better than others. Protection area starts from the edge of Nine Section Bridge river in the south, to New 3 Wealth Palace in the north. It begins west periphery wall of east bus station and east double bridge sub-district in the east, to Shao troupe in the west. It's total area is 1 9.66ha with Baziqiao bridge (Soig dynasty), Guangning bridge(Ming dynasty), East double bridge(the Republic of China) in it. Residents on the east and west sides of the water street shows various special features. Baziqiao bridge is one of key historical relic preservation unit in national level. It's a beam type stone bridge erected over the crossing point of 3 rivers anci 4 road, so it's called the oldest flyover bridge and the most famous old dridge in Shaoxing. This particular model is also seldom throughout the country. Baziqiao bridge connects river, street, bridge together, residents on 2 sides keep feature of water town purely. Space structure of streets is very clear. It can be the outstanding reiresentation of "one river two roads". At present, residents are still keep a lot of habt of living by water side. Connotation of folk custom of Yue Culture is contained in the 2 sides of the water street. It shows vivid picture of water town. The purpose of the reconstruction of Baziqiao bridge is to add serving institutions of tour, restore history sites and build new by the way of dispersing residents, updating planning composition, improving traffic condition, infrastructure and quality of houses so that the feature of residents, Watertown and regional culture can be continued. The reconstruction utilize linear space of water street and the linking points landscape in centre of bridge to lay down the general layout of three joints and two lines. Take Baziqiao bridge traditional water street, Guangnig bridge new water street as two lines, and take Baziqiao bridge, Guangning bridge and East double bridge as three linking points. Details are indicated as below: (1) Baziqiao bridge traditional water street: it's the focal point of all this protection & development district. Emphasis will be given to exposition of traditional space structure of Shaoxing's waterside street, specific features of the civil houses and the life flavor of the waterside street habitants. The renovation will be focused on preservation, supplemented by treatment and repair. This repair work for civil houses of Ming and Qing dynasties covers a construction area of 57,314 m2. (2) Guangning bridge new water street: Long bridge straight street is the best location connecting this water street with others. Then we can plan it as the water street which give priority to serving institutions of tour and as the continuity and complement of the Baziqiao bridge traditional water street in layout and function . (3) Three linking points: exhibition hall of bridge culture at the linking point of Baziqiao bridge, tearoom at the linking point of Guangning bridge are set up mainly. Parking place and dock for pleasure-boat set up in East Double Bridge joint to solve traffic problem. (4) Strengthen the existing piping line relaying, it's mainly electricity 8 telecommunication, raining water, waler supply, cable TV, road lamp. Supplement sewage drainage piping and gas supply pipelines. 1.1.2.3 Reconstruction of Infrastructure in Luxun Road Luxun Road History Block is located irn heartland of Shaoxing, the important part of the famous history and culture city. Protection area starts from 50m south away from Luxun road river on the south, to Ruoyexi Children Art school and West Xianhuan river in the north. It borders on Zhonxing Road in the east and Jiefang Road in the west. It's total area is 15.25ha, enclosed by Luxun Road, Zhongxing Road, Edge of East Xianhuan river, South Xinjian Road, Ruoye stream and Kwan-yin Nong. Luxun has lived in this block in his early years. Luxun former residence, Three-interest Bookroom, Baicao Garden, and Old gate of Zhou's family are 4 key items for preservation in the area, so is the atmosphere which is impartible to these ruins. Contents of infrastructure reconstruction of Luxun History Elock are as follows: (1) Laying of underground piping line Electricity, telecommunication and cable TV to be rerouted underground. Add gas and sewage piping. To drain the rain water and to dizspose sewage separately. Reconstruct supply piping and road lamp. (2) Improving organization of communication, expand the width of roads On the east of Luxun Square, 2 parking place will be opened up, currently occupied by Cold-food Factory and Force Arm department, and southwest of the crossing of Zhongxing Road and Luxun Road. Motor-driven vehicle shall not enter Luxun Road(Zhongxing Road-Jiefang Road). (3) Improving living environment, opening up small street greenery patches Open up a small square at the front entrance of Baicao Garden, and several small green area, such as at the east side of Zhou family's old stair gate and at the west side of Luxun kindergarten with a total increased greerery patches floor area of 5700m 2.Enrich space variety of street and improve the quality of environment at the same time. 9 (4) Renovate residential houses of 43600 m 2constructing area built in Mina and Qing dynasty (5) Preserve and restore amorous feelings and objects written by Luxun As regarded to units, which belong to historical relics for preservation, a mode of "both internal and external preservation" shall be adopted. They are Luxun Former Residence, Three-interest Bookroom, Baicao Garden, Zhou family's old Stairs gate. For the focal protected residential houses, take the way of 'internal repair and external preservation". They are Tugu temple, Changqing temple , Cheng Family's stairs gate, Yu Family's Garden. In addition, renovate some historic sites as Henji pawnshop. 1.1.2.4 Reconstruction of Infrastructure West Little River West Little River history block is one of intact traditional block, which is still existing. It's located in the middle by northwest of the old city proper. This preservation area starts from Shenli Road in the south to Xiada Road in the north. It's limited by Temple Nong in the west and Tiejia Camp, Overseas Chinese Restaurant in the east. It requires 22.94ha of land. In the middle part of this block both West Little River and West Little Road pass through. The middle of West Little River is connected with New River, thus both south and north ends of it could be integrated into the river network of the city. Feature of this block is very clear and lots of cultural relics and historic site in it. West Little Road is the typical water town pattern of river paralleling with road. Residential houses are built beside river. Lots of traditional "water intimating" livings are still kept. Residential houses in its block are of Taiment style mainly. Stage gate buildings are mostly used for residential houses in this area. It's using courtyard and laneway to organize space, with comfortable measure, various type, and infiltration enriched in. Water piers, stone revetments, green-stone alley, green tile, whitewashed wall built by green bricks and a leaf of small boat gliding occasionally can be seen everywhere. It reveals intelligence of water town. Contents of reconstruction of infrastructure in West Little River History Block are 10 mainly as follows: (1) Reconstruct the municipal infrastructure. Electricity, telecommunication and cable TV to be rerouted underground. Add gas supply and sewage disposal piping line. Open up mainly road, alley between temple and bridge which parallel to West Little Road in south-north way with width of 6-8m. (2) Keep traditional pattern, traditional streets and alleies and buildings of portal style. Renovate residential houses built in Ming and Qing dynasty of constructing area 49389 m 2. (3) Preserve and develop further cultural relics, such as Lu Mansion, Wangming Former Residence, Liuzongzhou Former Residence etc. to promote the development of tour function. Exploit their further connotation of hislorical culture in the mean while. 1.1.2.5 Reconstruction of Infrastructure in Jishan This history block is situated in the north of old city proper. It starts from Zhongxing Road in the east to the Ju Alley in the west. It's bounded on the south by Xiao Mountain Street River to North Ring Road in the north. It requires 35.51 ha of land. The renown of the block is mainly attributed to the great sage of calligraphy Wangxizi in the North-south Dynasty of Wei and Jin. Numerous cultural relics, historical sites is relevant to him in this history bilock, such as Bifei Alley, Bijia Bridge Duopo Alley etc. The contents of infrastructure reconstrLiction in this block are as follows: (1) Improving Infrastructure Remove obstacles from streets, such as VVest Street, Jishan Straight Street, Xieqiao Alley and etc. Improve piping line in this project. ILay sewage disposal and gas supply. Re other existing piping network. (2) Regulating of function pattern of land utilization Use the part of the land of original Shaoxing Ceramic Factory as extension land of Jishan Garden and part as residential land. Move Jishan Central Primary School to 11 the location where Porcelain Factory is originally nearby. (3) Highlight Function with Priority to Culture Set up memorial archway to the entrance. Open up parking place. Renovate Wang Xizhi Former Residence, Cai Yuanpei Former Residence and etc. all-round. Tap connotation of historical culture, such as Bifei Alley, Bijia Bridge, Duopo Allery, Fragrance Bridge, Plum Garden Alley, Tishan Bridge etc. Build institution related to culture, such as picture gallery, exhibition hall for painting and calligraphy etc. (4) Renovate residential houses built in Ming and Oing dynasty. Its constructing are is 147635m2. 1.2 Area Affected and Served by Project 1.2.1 Ares Served by Project Shaoxing is in subtropical and monsoon climate zone, with distinct 4 seasons. It is warm and humid, a municipality under the jurisdiction of Zhejiang provincial government, one of the fourteen cities of the Changjiang River delta. It's situated in the northeast coastal area of Zhejiang province. In the east, it's connected with Ning Bo city. Neighborhood Jinhua City in the south. In the west, it adjoins Hang Zhou. In the north, it faces Hang Zhou Bay. Shaoxing is one of birthplaces of the Chinese nation, the center of Yue culture. Shaoxing is a famous tourist city both at home and abroad featured by historical culture and water town sight. It's one of 24 famous nationwide historical and cultural cities published by State Council at the first time. In 1998, Shaoxing was listed as China excellent tourism city. From of old, Shaoxing Urban is a galaxy of talents and culture with beautiful land, well-known, and is a typical water town in south of China. "Excellence of human culture & sentiment for homeland of rivers & lakes" is the feature of Shaoxing as an ancient city. 12 In recent years, with economic development and population growth, the original infrastructure in the city, especially in the old city proper, lags far behind the development of the city. (1) The scale of existing sewage! interception system is too small. The rate of production and domestic sewage-cutting is not high. A rnajority of domestic sewage is drainaged to river directly after septic tank resulting in the worsening of water quality. Additionally the elevation of the riverbed in the oli city proper is higher than that in the suburbs because they deposit heavily for a long time. Water in the upper reaches does not go into the city easily and self cleaning ability of the river course is bad, which results in heavy pollution, especially blackenin(g and stinking. (2) The history block is densely populated. More arid more temporary building are put up. Infrastructure is not perfect and can not keep up with the development of the day in scale and criterion. These residential districts are fallen into dangerous and shabby house district gradually, which brings residence lots of inconvenience. (3) The old city proper was not planned comprehensively during its development. Workshop and dilapidated warehouse are mixec up with residential house. It is lack of public green lands and open spaces with poor living condition in it. It disbenefits residence in physical and mental health on one hand and restricts the tourism development in Shaoxing on the other hand. For the above mentioned factors, which have affected traditional features of "Excellence of human culture & sentiment for homeland of rivers & lakes " in Shaoxing, comprehensive reconstruction and maintenance of infrastructure and cultural relic and history site in old city proper is necessary in order to keep and encourage Shaoxing urban feature and expedite national economy in stable way. With completion of the project, on one hand, it will change the old, dilapidated status of infrastructure in Shaoxing old city proper thoroughly, improve the quality of living 13 environment greatly and the circumstance of tourism and investment, give an impetuous to the development of secondary industry and tertiary industry(especially the tertiary industry), promote economic prosperity in the city and even Zhejiang province. On the other hand, it can keep and develop Shaoxing urban traditional cultural feature. From perspective of human cultural heritage protection, from Shaoxing , Zhejiang to China and even all the world, the performance of the project play a positive role. 1.2.2 Ares Affected by Project The land use of the project involves Yuecheng district in Shaoxing. The project required 157 residential houses to be demolished which is 8588.7 m2 . Among the demolished houses, 7209.95m2 are brick-concrete houses, 886.53 m2 are brick-timber houses, and 492.22 m2 are simply built houses. The project will affect 15 enterprises. The survey shows that , most part of the affected enterprises went bankruptcy or moved to other area several years ago except a few are still in production. Only vacant building are left for demolishing. The project requires 114546.59m2 enterprise houses to be demolished . Among the demolished houses, 398m2 are reinforced-concrete houses, 103395.88 m2 are brick-concrete houses, 6396.8m2 are brick-timber houses, and 4355.91 m2 are simply built houses. 6 institutions will be affected. Totally, 13485.09m2 of enterprise and institution houses will be demolished. Among that, 695.81 m2 are reinforced-concrete houses, 6771.65m2 are brick-concrete houses, 1077.5m2 are brick-timber houses, and 4940.13 m2 are simply built houses. 5 shop structures affected are all located in Luxun history block with area of 248m2, which are all brick-concrete houses. 3540 people are impacted directly for above reason. Among that, 368 are for demolishment of residential houses; 2143 are employees in enterprises or institutions; 1008 are students; 21 are employees in shops. In addition, the project plans to repair residential houses in several history blocks. Residence in these areas are temporary transitioned in other areas by stages and in batches. They can move back to former 14 location after reparation. Or, with the government as agency, they can sell their houses to their neighbor who are willing to buy on a v:luntary basis. This kind of PAPs can enjoy policy for involuntary PAP or they can choose resettlement house provided by government or purchase commercial houses. 8485 households are affected by the project in short time with 26488 pe'ople. Renovating area of residential houses are 454045m2 . Average transitional tine of residence is 6 months. Around 2357 households in 8485 are willing to move with 7034 voluntary PAPs according to investigation and calculation. 4 categories of ground attachments and public services will be affected additionally. 1.3 Social and Economic Background in the Project Area The project area lies in Yuecheng district in Shaoxing. 1.3.1 Social and Economic Background in Siaoxing Shaoxing is a municipality under the jurisdiction of Zhejiang provincial government, one of the fourteen cities of the Changjiang River delta. It's situated in the northeast coastal area of Zhejiang province. In the east, it's connected with Ning Bo city. It's bounded on the south by Jin Hua Urban. In the west, it adjoins Hang Zhou Urban. In the north, it is close to Hang Zhou Bay. Under its jurisdiction, there are one district (Yuecheng District) and two counties: Shaoxing County and Xinchang County, and three other cities: Zhuji city, Shangyu city anc' Shengzhou city are also under tentative jurisdiction trust of Shaoxing City. The City has a total area of the 8,256 square kilometers, in which 337 km2 is of city proper and 54.67 km2 is of completed urban area. Recently, local economy cf Shaoxing develops quickly, which has become a regional central city in south of Yangtze Delta, famous with vintage, electronic and light industry of textile. As one of earliest opened and developed city in China's coastal area, Shaoxing was awarded of one of the first 40 outstanding cities 15 for investment environment in China in 1992. It was also twice granted of national level sanitary city during the "Eight Five Year Plan" period. In 1998, it was listed as the China's outstanding tourism city. By the end of 2001, the total population of the City has reached 4.3327 million, density of population is 525 persons/kM2; natural population growth rate is 3.04 . In 2001, GDP of the City is 822.54 billion RMB( among which primary industry takes up 9.8%, secondary industry 58.1% and tertiary industry 32.1%), in the fourth place in whole province; average GDP per person is 18,997RMB, per capita disposable income of urban households is 10,668 RMB, and per capita annual net income of rural households is 5,343 RMB. "Economy Developed and Population Denseness" is obvious feature of Shaoxing City, especially for city proper. There are 6 neighborhood committees, 7 town under the jurisdiction of Shaoxing city proper, location of the Project. By the end of 2001, the population of the city proper has reached 599.2 thousand, among which agricultural population is 288,236 persons, and non-agricultural population is 311,013 persons. In 2001, GDP of the city proper is 127.73 billion RMB, among which primary industry takes up 5.7%, secondary industry 42.9% and tertiary industry 51.4%, average GDP per person of the city proper is 21,466 RMB. B.C:.490, king of Yue Goujian moved the capital here and establish the city. Huiji county was established in Qing dynasty and Yue state was in Tang dynasty, they become the temporary capital in South Song dynasty. It is one of the earliest original places of Chinese nation and the most developed place for early Yue culture with centuries-old history and abundant historical cultural resource. Shaoxing was liberated in My, 1949, thus established Shaoxing City( at county level), followed by Shaoxing county, Shaoxing District, where the administrative government offices is situated. In July, 1 983, Shaoxing removed from here and thus Yuecheng District was founded. Yecheng District is the locus of Shaoxing municipal Party committee and the People's Government. and the central area of politics, economy and culture in Shaoxing city. In June, 2000, Gaobu, Dongpu, Jianghu etc. five small towns were turned over to and dominated by Yuec:heng District. 17 At present, Yuecheng District have jurisdiction over 10 towns, streets, 235 administrative villages, 59 community neighborhood committee with total area of 246,000m2 and total population of 471 thousand, including agricultural population of 271 thousand. In 2001, industrial and agricultural production is 10265 million RMB, increased by 6.2 than 2000. Agricultural production is 820 million RMB, increased by 7.3 than 2000. Industrial production is 9450 million RMB, increased by 6.1 than 2000. Industrial sales is 9230 million RMB, increased by 7.6 %than 2000. Industrial profits is 390 million RMB, increased by 4.8 than 2000. Three-production sales is 5440 million RMB, and profits is 110 million RMB, increased by 30.3 13.6 than 2000 respectively. Per capita disposable income of town households per person is 10669RMB, increased by 13.5 %than 2000. Per capita disposable income of rural households per person is 6209RMB, increased by 4.0 % than 2000.----Agriculture is aimed at developing modern urban agriculture, arounding increased efficiency of agriculture, increased income of rural people tightly. Quicken steps of structure adjusting. Come to a new benefit agricultural pattern giving priority to special marine lives, vegetable plantation, animal raising. Turtle farm with annual production of 1000 thousand, vegetable production base with annual production of 1000 thousand Dan and Tingshan animal raising base with 1000 thousand have begun to take shape, and become to the primary non-staple foodstuffs production base in Shaoxing city proper. Industry has come to the situation, which taking the person state sector of the economy as principal part, featuring textile, painting and dyeing, clothing and family property. In the recent years, Yuecheng District take increasing technique transforming as the breach for industrial structure adjusting. Technical innovation, increasing investment turn to the theme of industrial development. Technical innovation and investment make a new record repeatedly. Orient Homestead Furniture Market, Zhongxing Road Employment Market and Tashan Bamboo and Timber Exchange Market passed the verification of 1Three-star, Double-star and one-star level of whole province respectively, Whole community service net have begun to take system. More than 1400 community service center and station are established in succession by District, street and neighborhood committee, and service center such as "Fine Neighbor" and other brand enterprises of community service are emerged. 1.4 Project Design Procedure In 1998, Beijing Colored Metallurgy Design Institution was entrusted to carry out pre-feasibility study. The compilation was finished in March 2000 of Pre-Feasibility Study Report on Shaoxing Urban Infrastructure Reconstruction . The compilation of feasibility study report of this project has been finished in September, 2002. Shaoxing Environmental Protection Science Research and Design Institute is entrusted by the owner-Shaoxing Urban Infrastructure Developing Office to compile the environmental protection design and Evaluation Report on Environmental Effect. It's has been finished in April, 2002. The compilation of feasibility study of the project will be finished in September 2002. 19 1.5 Total Investment and Capital Source The project is urban infrastructure construction project, and Peoples' Government of Shaoxing is responsible for it. The funds can be divided into two parts. One is domestic funds, and the other is the World Bank Loan. Altogether, the project will need 1050.7406 million RMB, including 575.1804 million RMB as construction cost, and 475.5602 million RMB as other cost including circulating fund 1.33 million RMB. Capital source: 39.3001 million US$ will be from World Bank, which is amounting to 325.80 million RMB ,exchange rate is 1:8.29. 100.00 million RMB will be from domestic bank. The rest 624.94 million RMB will be raised from financial budget annually. 1.6 Measures for Reducing Project Influences 1.6.1 Plan and Design Stage of the Project During the plan and design stage, the design unit and project owner have adopted some effective measures to reduce project impact on local social economy. The main measures is shown as below: A, In the project planning stage, project impact on the local social economy should be taken into account as much as possible and as the key factor in choosing the scheme; B, Sewage pipes and rain pipes to be laid in the edge of or in the middle of the road to avoid house demolishment; 20 C, During the positioning process of routes of urban roads and rivers, the design unit make a reasonable analysis of it to reduce the house demolishment as much as they can; D, Optimize design, arrange the overall layoul in preservation area, and reduce house demolishment as much as they can. 1.6.2 Construction Stage of the Project A Reducing the Influences on Urban Transportation Laying and construction of pipes are usually in the center or along one side of the road. The exaction of roads will seriously iinfluenice the traffic of that area, which should be taken into consideration by the project developers. For the roads with busy traffic, they will set up temporary convenient access, arrange traffic policemen to maintain the normal order and try to avoid the rush hours for construction, such as constructing at night to ensure the smooth traffic in day time; as far as construction methods are concerned, they will construct section by section. Moreover, they try to finish the excavation, pipe laying, land filling in the shortest time as possible as they can. B Measures to Reduce the Dust Soil excavated from the trenches is laid beside the roads. Wind in the dry season and machines raising the soil will cause the dust flying, nearby residents and factories will be influenced. In order to reduce the adverse effects on the environment, abandoned soil should be sprayed water on the surface if several days of fine weather and wind blowing are encountered in the process of 21 construction. Units of construction should treat the abandoned soil promptly and in the loading and carrying process, try not to overload the soil to prevent the falling of soil on the roads. Wheels of the vehicles should be cleaned by compressed water before the vehicles begin to work to keep the environment clean. Meanwhile, construction units should clean the roads in time if there is abandoned soil. C Control the Noise from Construction Noise of construction comes from laying the pipes, excavating trenches, blowing of horns, mixing noise of concrete and noise of earth cover road roller. In order to control the noise, the construction in the area of 200 meters around the residences is prohibited from 11 o'clock at night to 6 o'clock next morning. And construction units should choose suitable construction facilities and methods, use machinery with low noise. And if sometimes, construction during the night is needed and residents nearby will be influenced, construction machinery should be equipped with noise elimination devices. Meanwhile, temporary noise interception devices should be set up around the building site or around the residences to keep the noise environment of residences. D Treatment of Waste Materials in the Site of Construction Project developers and construction units should contact the local environment hygienic department to clean the domestic waste materials on the site of construction promptly to keep it clean. 1.6.3 Preparation of RAP & Implement Stage of the Project When resettlement is inevitable, following measures will be adopted for decreasing the local impact caused by the construction. 22 A, Enhance basic data acquisition, analyses on local socio-economic status and development in the future, and formulate practicable action plans with due consideration of actual situation, thus ensuring that the people affected by the project will not suffer loss. B, Actively encourage the public participation in the resettlement works, and accept supervision of the public. C, Strengthen internal and external independent mcnitoring activities, establish highly efficient and smooth channel for information feedback, reduce information processing period, thus ensuring that problems can be resolved timely. 23 2 Project Impacts In order to find out the impacts of this project, PMO organized specical investigating group to investigate the affected family, enterprises and institutions and shops in affected area by this project comprehensively in August and September, 2002 according to W.B.'s requirements. The mode of combination of investigating households one by one and interview are adopted. It involves all 157 households whose houses need to be demolished, 21 enterprise and institution units and 5 shops which will be demolished and moved. PAPs took part in investigation work. Investigating group heard opinions on land requisition, demolition and resettlement from residences, enterprises and institutions and shops and discussed with them widely. The project impacts involve Yuecheng district in Shaoxing City. The project required 157 residential houses to be demolished which of area is 8588.7 m2 . Among the demolished houses, 7209.95m2 are brick-concrete houses, 886.53 m2 are brick-timber houses, and 492.22 m2 are simply built houses. During this survey, the self-build house without permission has not been found. The project will affect 15 enterprises. Also, they can choose resettlement houses provicled by government or buy commercial houses by themselves. 8485 households are affected by the project in short time with 26488 people. Renovating area of residential houses are 454045m2. Average transitional time of residence is 6 months. There are around 2357 household are willing to move in 8485 with 7034 voluntary PAPs according to investigation and calculation. 4 categories of ground attachments and public services will be affected additionally. 2.1 Residential Houses Affected by the Project The project required 157 residential houses to be demolished with area of 8588.7 m2 and 368 affected people. Among the demolished houses, 7209.95m2 are brick-concrete houses, 886.53 m2 are brick-tirnber houses, and 492.22 m2 are 25 simply built houses. In addition, the project affects some ground attachments. See table2.1 for detail. The survey shows that, most part of the affected enterprises went bankruptcy or moved to other place several years ago except a few are still in production. If demolition is inevitable, they will be compensated for the loss of suspense of business and production. What's more, they will be resettled properly and get help to restore the business or production as earlier as possible. * To encourage PAPs to take part in compilation of RAP and resettlement. The way that PAPs choose to be resettled should be respected fully. * To improve PAPs living standards or at least restore their former living standards. 32 4 Socioeconomic Sampling Survey of People and Units Affected In order to find out socio-economic status of affected area and basic situation of PAPs further, PMO conducted a preliminary socio-econornic survey of affected area in April 2002, according to requirements of WORLD BANK, which provides basic information for project analysis. In September 2C02, PMO conducted a socialeconomic sampling survey on PAPs, enterprises, institutions and shops when investigating, adopting the methods of combination of questionnaire and interview. The questionnaire involves in 40 affected households,(amounting to 25% of total affected households), 20 enterprises and institutions(aniounting to 100% of total affected enterprises), 5 shops(amounting to 100% of total affected shops). 4.1 Survey Results of Affected Family Basic S'ituation 4.1.1 Family Population This survey covered 40 households, with 118 persons which includes 118 non-agricultural people, accounting for 100%. There are 32 females, accounting for 52.5% of total population. 58 city labours, accounting for 49.2% of total population. 16 students, accounting for 13.6% of total population. 4.1.2 Age Distribution Among 40 households with 118 people which have been nvestigated, 9 people are under 8 years old, accounting for 82% of total population; 14 are under 8 18 years old, accounting for 12% of total population; 72 are under 19 60 years old, accounting for 61% of total population; 23 are above 61 years old, accounting for 19% of total population. 33 4.1.3 Education Distribution Among 40 households with 118 people which have been investigated, 2 people are illiterate, accounting for 2% of total population; 29 people have finished elementary school, accounting for 25% of total population; 70 people have finished middle school, accounting for 59% of total population; 17 people have finished got three-year college or above, accounting for 14% of total population. 4.1.4 Labor Employment Among 40 households with 118 people which have been investigated, 58 people are city labors. Among them, 49 people are in enterprises or institutions, accounting for 84.5%; 7 people are out for work, accounting for 12.1%; 2 people are engaging in individual business, accounting 3.4% of total population. 4.1.5 House Construction Area Among 40 households which have been investigated, house construction area is 2473.7m2. Average area for each household is 52.6m2. Most residential house are storied building. 4.1.6 Family Annual Income and Expenditure According to the statistics of 40 households, total family annual income is 1732000yuan, among which annual wage is 882000yuan, accounting for 51 % of total family annual income; income from working out is 42000yuan, accounting for 2%; other income is 808000yuan, accounting for 47% of total family annual income. See Table 4.2 for Income structure. 34 Expenditure. Total family annul expenditure is 1333360yuan, among which charges for electricity is 38160 yuan, accounting for 3% of total family annual expenditure; cost of domestic water is 14400yuan, accounting for 1% of total family annual expenditure; cost of communication is 72000yuan, accounting for 5% of total family annual expenditure; cost of children education is 1 00000yuan, accounting for 7% of total family annual expenditure; cost cf medical treatment is 108000yuan, accounting for 8% of total family annual expenditure; cost of fuel is 19200yuan, accounting for 1% of total family annual expenditure; cost of non-staple food is 576000yuan, accounting for 43% of total family annual expenditure; cost of cost of domestic electrical appliance and furniture etc. is 160000yuan, accounting for 12% of total family annual expenditure. Article 58 Under any of the following circumstances, the administration department of the people's government concerned may, with the approval of the people's government that has originally approved the use of land or that possesses the approval authority, take back the right or the use of the State-owned land: (1)The land is needed for the benefits of the publics; (2) The use of the land needs to be readjusted for renovating the old urban area according to urban planning. Article 47 Land requisitioned shall be compensated for on the basis of its original purpose of use. Main provisions of "P.R.C. Urban Estate Administration" are as follows: Article 22 Allocation of land use right means that approved by the government over country level, after the land users have paid compensation, relocation costs etc., they can use the land, or they can get the land use right free of charge. Article 23 If the land use of the following land for construction is really necessary, it can be approved and allocated by the government over country level: land for urban infrastructure and public utilities, land for energy, transport, water conservancy etc., project which are the state key project. Relevant provisions of Zhejiang Province Enforcement Methods of Land 40 Administrative Law of R R. China Article19 Where land for agriculture is to be used for construction purposes, the formalities of examination and approval shall be gone through for the conversion of use. Where land for agriculture is to be converted to land for construction of projects within the limits of the amount of land fixed in the plan for the construction of cities, villages or towns, the following terms shiould be met (1) in conformity with the overall plan of land using; (2) in conformity with urban overall plan or village and town plan; (3) obtaining year quota of land for agriculture conversion; (4) measures for complementary cultivable land are fixed in advance. For which can not satisfy the above mentioned terms, land for agriculture is to be converted to land for construction can not be approved. Article22 The unit who requisition the land, should pay land compensation, resettlement subsidy and compensation for standing crops and ground attachments fully in three months from getting approval of plan for compensation for land acquisition and resettlement. 5.2.1.2 Limits of Demolition Houses and Nature of Compensation Urban House Demolition Regulations stipulate: Article 6 The unit who demolish the houses can not carry out the demolition until getting house demolition license. Article 22 The unit who demolish the houses should compensate the unit whose houses are demolished in accordance with the regulations. Relevant provisions of Zhejiang Province urban House Demolition Administration Detailed Enforcement Regulations 41 Article 8 The unit who demolish the houses can not carry out the demolition until getting house demolition permission license. Shaoxing Urban House Demolition Administration Enforcement Methods stipulate Article 6 Units and individuals that need to demolish houses shall have documents of plan of construction investment approved by the City Planning Department, permission for land for planning and fixed-point map approved by the planning department, documents proving that land administration department agreed to transfer or allocate land, demolition plan and demolition resettlement compensation scheme apply for demolition to Demolition Department who is responsible to . If it is approved, the units and individuals can start to demolish with a demolition permission license. 5.2.2 Laws and Administration Procedures Land Administration Law of the P.R.C. Article 46 Where land is to be requisitioned by the State, the requisition shall, after approval is obtained through legal procedure, be announced by people's governments at or above the country level, which shall help execute the requisition. Units and individuals that own or have the right to the use of the land under requisition shall, within the time limit fixed in the announcement, register for compensation with the land administration department of the local people's government by presenting their certificates of land ownership or land-use right. Urban House Demolition Administration Regulations Article 8 As the house demolition permission license was given, the department in charge of house demolition shall propagate the demolition unit, the demolition scope, 42 the deadline of demolition and other items in the form of house demolition notice at the same time, the department of in charge of house demolition and the unit who demolished the houses shall in time propagate and explain the policies to the persons whose houses are to be demolished. Shaoxing Urban House Demolition Adrninistration Enforcement Methods stipulate Article 6 Units and individuals that need to demnolish houses shall have documents of plan of construction investment approved by the City Planning Department, permission for land for planning and fixed-point rnap approved by the planning department, documents proving that land administration department agreed to transfer or allocate land, demolition plan and demolition resettlement compensation scheme apply for demolition to Demolition Department who is responsible to . If it is approved, the units and individuals can start to demolish with a demolition permission license. Construction units must get land-use right legally before demolition if they will resettle the people whose houses are demolished on original location. Unified demolition is carried out in city proper in principle. Demolition mode can be divided into demolishing by demolition units and entrusting demolition. Demolition project will not involve other people's civil rights and interests, demolition units can demolish by themselves after approval. Demolition project will involve other people's civil rights and interests, entrusted demolition should be taken. Entrusted units must keep house demolition permission license. Department who is in charge of houses demolition can not accept demolition entrusting. Article 7 The approved demolition project, the departrnent in charge of house demolition shall propagate the demolition unit, the demolition scope, the deadline of demolition and other items in the form of house demoliticn notice or in other ways 43 within 15 days since demolition permission license is approved. The units or responsible department of whose houses are demolished shall assist in propagate and explain the demolition. Article 8 Houses demolition should be in the approved demolition scope and time limit. At the same time with demolition approved, department in charge of houses demolition should inform relevant unit to stop permanent residence registered, dividing registered permanent residence, alteration and bestowal of ownership, lease, industrial and commercial license in written form. Because of birth, army man demobilized, transferred, retired and marriage, it is firmly needed register permanent residence, dividing registered permanent residence or alteration of ownership, it can not go through formality until approved by public security bureau and department in charge of houses demolition, and adjust demolition resettlement scheme in time. Units who will demolish houses should sign written form agreement with units whose houses will be demolished on deadline of demolition about compensating and resettlement etc. Demolition compensation resettlement agreement can be notarized by public security or signed by department in charge of demolition. 5.2.3 Compensation Provisions Urban House Demolition Administration Regulations Article 23 House demolition can be compensated in the way of exchanging ownership, or in cash. Article 24 Amount of money for compensation is determined by evaluation price in real estate market considering location , function and construction area etc. of demolished house, and is paid at. Detailed measures are formulated by Peoples' Government of Province, Municipal 44 Shaoxing Urban House Demolition Administration Enforcement Methods Article 13 Unit who will demolish houses should compensate unit whose houses will be demolished according to stipulations. House demolition can be compensated in the way of exchanging ownership, or in cash, or in the weay of exchanging ownership combined with cash. Article 14 To demolish houses and attachments for teaching, medical treatment, home for destitute old people, kindergarten, public toilet etc. social public welfare business, the unit who demolishes the house shall rebuild them as per their original function and scale. Or build as per overall urtian planniig. Or compensate as per replacement cost. The compensated money shall be still used for public welfare construction. If the demolition for urban infrastructure construction involves the above mentioned house and attachments of public welfare, unit who demolishes house shall build them as per overall urban planning or give lump-suim compensation as per replacement cost. Article 15 The construction area of the non-residential house to be compensated in the way of exchanging ownership shall be same as original construction area. The price deference shall be settled as per replacement cost. The extra area of compensated house beyond the original house will be charged at market price. For the part that the resettlement area is less than the original one, they can get compensation at the cost price of the new resettlement house. Nonresidential house that do not need resettlement, they can get compensation at the cost price of the new resettlement house. Article 17 If the demolished residential house administrated directly by House Management department and administrated by administration department and 45 sum, balance, budget institution needs to be replaced with ownership exchanged, the original construction area shall be compensated. The part of extra area of compensated house beyond the original house within the maximum resettlement standard will be charged at replacement price. The part of extra area of compensated house beyond the original house and the maximum resettlement standard will be charged at market price. For the part that the resettlement area is less than the original one, they can get compensation at the cost price of the new resettlement house. In order to speed up housing modification, 2 quality of ownership for one set of house is permitted. When the public house user ask to increase living area, the user keep the ownership of the added part if it's approved by department in charge of house demolition and purchased at market price. Article 18 For the demolished leased residential house belong to unit or person, exchanging ownership is adopted usually . The rent can be continued with the contract revised by the two parts. If the owner do not want to continue the rent or ask to abandon ownership during moving, the original house can be compensated in cash. The original user shall be resettled by the unit who demolished house as per stipulation. Article 19 For the house with mortgage, and ownership problem to be demolished, and the units whose houses will be demolished can not make an agreement on it, all the evidence of the house should be kept completely, and the unit who demolished house shall provide the compensation house resource and corresponding capital in advance. When the department in charge of demolition certificates and resettle the house user. The house can be demolished by the unit who demolishes house. Article 20 the original ownership of public facilities, pipelines, tree and attachments in demolition area shall be compensated properly by unit who demolishes houses. Compensation rate shall be stipulated by urban pricing bureau with cities and 46 countryside construction committee. 5.2.4 Responsibilities Land Administration Law of the People's Republic of China Article 66 Land Administration departrnent of the people's government at or above the county level shall supervise over and inspect violations of laws and regulations governing land administration. Supervisors over and inspectors of land administration shall be familiar with the laws and regulations governing land administration and they shall be devoted to their duties and enforce laws impartially. Article 70 Where, in the course of supervision and inspection, land administration departments of the people's government at cr above lhe county level find any violations by State functionaries and believe that adminisitrative sanctions need be given to such functionaries, they shall deal with such violation in accordance with law; if they have no right to do so, they shall propose in writing to the administrative supervision departments of the people's governments at the corresponding or a higher level that administrative sections be given to the functionaries, and the administrative supervision departments concerned shall deal with the violations in accordance with law. Article 79 Whoever embezzles or misappropriates thEc compensation or other relevant charges paid to a unit whose land is requisitioned, if the violation constitutes a crime, shall be investigated for criminal responsibility in accordance with law; if the violation is not serious enough to constitLute a crime, he shall be given administrative sanctions in accordance with law. * Urban House Demolition Regulation 47 Article 5 The unit who demolishes the house shall, in accordance with this regulation, compensate and replace the people whose houses are demolished. And the people should submit themselves to the need of the city construction and move out with the given period. Article 6 The Real Estate Administration Department of the State council is in charge of the national urban house demolition. The Real Estate Administration Departments of the people's government at or above the county level or the departments authorized by the government are in charge of the urban house demolition in their own regions. Article 7 The people's governments at or above the county level should strengthen their leadership on the urban house demolition. Shaoxing Urban House Demolition Administration Enforcement Methods Article 4 House demolition shall accord with the urban overall planning, facilitate old city reconstruction, and improve city construction. The unit who demolishes the house shall, in accordance with this methods regulation, compensate and replace the people whose houses are demolished. And the people should submit themselves to the need of the city construction and move out with the given period. The unit of or department in charge of the people whose houses are demolished shall assist with the unit who demolishes house in mobilization work. Article 5 Cities and countryside construction committee of the city is the department in charge of house demolition, and is responsible for the review and approval, direction, coordination and decision of urban house demolition. Departments and street offices of Public security, judicature, land administration, industry and commerce, price, finance and tax, communication, telecommunication, and power 48 etc. should undertake respective responsibilities ard cooperate with house demolition administrative departments to do it well. 5.3 Resettlement Policies of the Project All the resettlement policies carried out in this project are under resettlement policies of P.R.C, of Zhejiang People's Government, of Shaoxing People's Government and of the World Bank. 5.3.1 Resettlement Policies on Demolishingc Residential Houses Resettlement in cash, providing resettlement houses and cheap-rent houses for poverty household are adopted for the compensation and resettlement policies on demolishing residential houses of this project. Provided by more choices, PAPs can choose different resettlement mode according to their own economic condition and individual demand. 5.3.1.1 Evaluation emolished houses should be evaluated by real-estate institutes with legal qualified certification according to replacemeni. price.The amount of compensation fees for the demolition shall be decided according to the Market Price on the basis of official price for compensation cash at the time when the demolition and resettlement license is issued(see chapter 6 for detail), as well as considering its location, structure, area, condition, floor and decoration. Real-estate institutes should hear opinions from people whose house are demolished when they decide the real-estate market appraisal price. 49 5.3.1.2 Resettlement Policies 1. Private Residential House There are 3 choices for people whose house are demolished when they got compensation fee: purchase commercial house, purchase resettlement house or rent cheap-rent houses provided by government. (1)Those who are rather rich, in order to satisfy their individual demand, can purchase commercial house in Shao Xing city proper according to their own willing or purchase villa in suburb. Of course, they can purchase house in other area and leave Shao Xing. Project will not interfere with these PAPs. People whose house are demolished or lessee are free from tax cooresponding to compensation fee for demolition if they choose to be compensated in case and purchase commercial house in Shao Xing. (2) People can purchase resettlement house provided by government, and they can get same area as their demolished house with compensation fee because the price of resettlement house is lowered than house price in demolition area. People whose house is demolished are entitled to ask demolishing unit to provide resettlement house, which its construction area is, not less than original area. The area that is beyond demolition house area, is balanced by cost price of the new house if it's in one suit of house or by commercial price if it's beyond one suit of house. (3) For people who are poor and only have one residential house with the total construction area less than 36m2 for each household and select ownership exchange, the demolishing unit shall provide a house with the construction area not less than 36m2. And there is no balance between the original and new resettled house. Government will provide cheap-rent houses for PAPs who are powless to purchase commercial houses and resettlement house when they get compensation fee. 50 2. Residential house administrated directly by House Management Department or Unit 1 Lessee have right to purchase house as per house reform policies. Lessee get the ownership when they purchase the house as per house reform policies. Demolishing unit will compensate and resettle them as per their house are private house. 2 When the house owner get resettlement house, it will be rented by the original lessee who do not purchase house as per house reform policies and do not agree on unchaining lease contract with house owner, and they will renew lease contract. 3 If lessee do not select the above mentioned 2 types of compensation and resettlement, the demolishing unit will compensate the house owner in cash, and lessee will be resettled by owner with house which its area is not less than the original area. 5.3.1.3 Subsidy Policies in Movement: As for the movement of facilities equipped with telephone and cable T.V. etc., the demolished households get compensation at actual stanclard of related departments Temporary resettlement subsidy: the demolished party (or tenant) who will resolve the turnover house by themselves will lbe paid temporary resettlement subsidies for 4 months from they start moving until resettled by demolishing unit. Subsidy shall be calculated by the demolished area. For residential house, the rate is 8yuan/month/m2. Movement subsidy: the demolishing unit shall pay the actual user of residential house subsidy for movement. Subsidy shall not be lower than 600yuan/household. The part of demolished houses which is larger than 60 m2 shall 51 be paid by 5yuan/m2 5.3.1.4 Other Policies (1) PAPs is free of any kind of tax during movement and recovery period. (2) Demolishing unit should help PAPs to go through formality for registered resident change and children transfer. (3) Provide help for vulnerable people. See 5.3.1.2 for detail. (4) During this survey, the self-build house without permission has not been found. If the self-build houses without permission are demolished by the project during its implementation, the project will deliver the compensation to the demolished self-build houses at replace price. However, the compensation will not include the land value. The detailed compensation rates see table 6.2. 5.3.2 Resettlement Policies for Enterprises and Institutions 5.3.2.1 Evaluation emolished houses and facilities should be evaluated by real-estate institutes with legal qualified certification according to replacement price.The amount of compensation fees for the demolition shall be decided according to the Market Price on the basis of official price for compensation cash at the time when the demolition and resettlement license is issued(see chapter 6 for detail), as well as considering its location, structure, area, condition, floor and decoration. Real-estate institutes should hear opinions from people whose house are demolished when they decide the real-estate market appraisal price. 52 5.3.2.2 Resettlement Policies (1) To demolish houses and attachments for teaching, medical treatment, house for destitute old people, kindergarten, public toilet etc. social public welfare business, the unit who demolishes the house shall coimpensate as per replacement price arranged and built as per overall urban planning. (2) Each resettlement scheme for the enterprises demolished was analyzed technically and economically comprehensively.The enterprises affected by the project will try their best to rebuild the enterprises and restore their production at their original sites if the demands of production can be met.lf their former production scale can not be restored in original sites, the enterprises can only rebuild houses at a different place. The enterprises should try their best to demnolish and build the houses by themselves and avoid or reduce the loss caused by cessation of production. PMO and City Plan Department will supply proper inclustrial park for enterprises to move to. Resettlement place should be discussed by PMO and affected enterprises and comform to city planning. To make an arrangement for enterprises resettled in other places as early as possible and rebuild activities should be started in advance. Enterprises who are need to be rebuilt can apply for reducing of city necessary facilities fee and be allocated the same area of larid by government through administration transfer in industrial park sub-district for rebuilding. 5.3.2.3 Subsidy Policies in Movemenl: 1 Rate for movement and installation is 45 yuan/M2 of demolished construction area. 2 Economical loss due to cessation of business and production resulted from demolition, the demolishing party pay the demolished party lump-sum subsidy of 50yuan/m2 for construction area. 3 Transitional subsidy is 40 yuan/rmonth* M2 tor construction area. 53 5.3.2.4 Other Policies (1) The entitlement of the employers will not be affected during the enterprises rehabilitation, including their salary, medical and social insurance, the interest and bonus.; (2) Empolyees in enterprises and institutions can not be unemployed because of movement. 5.3.3 Resettlement Policies for Shops 5.3.3.1 Evaluation Demolished shops should be evaluated by real-estate institutes with legal qualified certification according to replacement price.The amount of compensation fees for the demolition shall be decided according to the Market Price on the basis of official price for compensation cash at the time when the demolition and resettlement license is issued(see chapter 6 for detail), as well as considering its location, structure, area, condition, floor and decoration. Real-estate institutes should hear opinions from people whose house are demolished when they decide the real-estate market appraisal price. 5.3.3.2 Resettlement Policies (1)The demolishing party supply shop information for shopkeeper to choose and is responsible for all the necessary formality for the shops to be opened in the new location. (3) this kind of shops will be reopened in new sites and the original employees shall work there, too. 54 5.3.3.3 Subsidy Policies in Movement 1 Rate for movement and installation is 45yuan/m2 of demolished construction area. 2 Economical loss due to cessation of business anJ production resulted from demolition, the demolishing party pay the demolished party lump-sum subsidy of 70yuan/m2 for construction area. (3) Transitional subsidy is 50yuan/month* m2 for construc:ion area. 5.3.3.4 Other Policies (1) The entitlement of the employers will not be affected during the shops rehabilitation, including their salary, medical and social insurance, the interest and bonus.; (2) Empolyees in shops can not be unernployed because of movement. 5.3.4 Resettlement Policies for Affected People in Short Time The project plans to repair residential houses in several history blocks. Residence in these areas are temporary transitioned in other areas by stages and in batches. Residence can get moving allowance of 600yiuan/household (twice) and temporary transitional fee of 8yuan/month*m2. Average transitional time of residence is 6 months. Each household can get transitional fee of 400yuan/month as per 50m2 of each household. The survey shows that 43
