This Resettlement Action Plan (RAP) is prepared according to the Laws and Regulations of PRC, and local area as well as the Guidelines of the World Bank (Operational Directive for Involuntary Resettlement OD 4.30). The purpose of this document is to set out an Action plan for the Resettlement and Rehabilitation of the Project Affected Persons (PAPs) to ensure that they will benefit from the project and their standards of living will improve or at least be restored after the project impact. Acquisition of land and other assets for the proj ect will adversely affect the livelihood of persons who live, work or earn their living on the land that will be acquired for the project. PAPs are defined as those persons whose income or livelihoods will be adversely affected by land acquisition for the project. PAPs include the following categories: a) persons who have a title, right, interest, in structures (houses. enterprises, shelters, or public buildings), land (including residential, agricultural, and grazing land) or any other asset acquired or possessed, in full or in part, permanently or temporarily; b) persons who use the structures, land or assets described above; or persons whose business, occupation, work, place of residence or habitat adversely affected; or c) persons whose standard of living is adversely affected as a consequence of land acquisition. A definition of PAPs is given below: Definition of the PAPs: "Affected Persons" means persons who on account of the execution of the project had or would have their: a) standard of living adversely affected; or b) right. title or interest in any house, land (including premises, agricultural and grazing land) or any other fixed or movable asset acquired or possessed, temporarily or permanently; or c) business, occupation, work or place of residence or habitat adversely affected, and "affected Person" means individually all those who qualify as "Affected persons." PAPs may be individuals or legal persons such as a company, a public institution. Definition of PAPs is not limited to their legal registration or pennission to live or conduct business in the affected location, or their title to property. Thus it includes: a) all those affected by the project regardless of their legal righlts or absence thereof to the assets being taken; and b) persons without residential pernit to live in a certain area. Therefore all such persons who are affected will need to considered and recorded as PAPs, regardless of their legal connection to assets land or location. If there are more than one person, family or household using or holding a title to the same land or property that is acquired, they will be compensated and rehabilitated according to the loss they suffer, their rights, and the impact on their living standards. The definition of PAPs is linked directly to the adverse effect of the project, regardless of legal rights title or interest. All PAPs are entitled to the improvement or at least restoration of their standards of living, and compensation for the material losses they suffer. Compensation for assets will cover I RESETTLEMENT ACTION PLAN replacement cost. No deductions or discounts will be applied to the compensation amount for depreciation or other reasons. All PAPs deriving an economic benefit from the affected land and property are entitled to receive rehabilitation benefits in addition to the compensation for their assets lost. Those PAPs without title, authorization or legal permission to reside, conduct business, cultivate land or construct structures are eligible for rehabilitation of their livelihoods and compensation for their assets on an equal footing with those with forrmal legal title, authorization or perrnissions to the assets. The term RESETTLEMENT includes: a) the relocation of living quarters; b) finding acceptable new employment for those whose jobs are affected; c) restoration (or compensation) of affected productive resources such as land, workplaces, trees and infrastructure; d) restoration of other adverse effect on PAPs' living standards (quality of life) through land acquisition (such as the adverse effects of pollution); e) restoration of or compensation for affected private and public enterprises; f) restoration of adversely affected on cultural or common property. - Rehabilitation means: the restoration of the PAPs' resource capacity to continue with productive activities or lifestyles at a level higher or at least equal to that before the project. The objective of this RAP is to provide a plan for the resettlement and rehabilitation of the PAPs so that their losses will be compensated and their standards of living will be improved or at least restored to the pre-project levels. To achieve these objectives the plan provides for rehabilitation measures so that the income earning potential of individuals are restored to sustain their livelihoods. Affected productive resources of businesses (enterprises including shops) and public property. Infrastructure and cultural property will also be improved or at least restored to their pre-project levels. RESETTLEMENT ACTION PLAN l OGenerals 1.1 nlProject Background En-shi Canton Power Grid has presently had an elementary scale, which has an installed capacity of 307.6MW (including hydropower 287.6MW). However, power supply composing of power grid is not reasonable, and its peak regulation capacity is seriously short. Both of them have restricted the economic development of En-shi Canton. En-shi Tujia and Miao Nationalities Autonomic Canton sits in subtropical region, where rainfall is rich and water energy resource is abundant. There are 349 myrial KW power to be developed overall the canton, 9% of which have been developed. Most hydropower stations having been built are runoff style stations, except that Longdong Station has incomplete annual regulation ability. As a result, the peak regulation of power grid is seriously short, and it will be the same after some medium-sized stations having been built by the end of 2005. Dongping Water Conservancy and Hydropower Project is the third step of Zhongjianhe River Valley Development Planning having been approved, with a storage capacity of over 2 billion cubic meters, which has an annual regulation ability. This station is under 40km to the load center of En-shi Canton, and it can undertake the roles of peak regulation, frequency regulation and standby for accidents. Meanwhile, it may allay the contradiction in power supply and demand in southwestern region of Hubei Province, and it can bring many benefits to the Shuibuya Hydropower Station to be built in the Qinjiang River, thus as regulating water capacity, minifying flood peak, intercepting sand, adding power energy. As a result, Shuibuya Station can add power supply of 468 myrial KWh, guarantee power of 3.6MW, reducing sand inside reservoir of 10%E Xuan-en County is located in the southwestern mountainous region of Hubei Province, where infrastructures and economic development are behindhand and transportation is inconvenience. It is a nation-leveled poverty county with agricultural production as the main. Dongping Hydropower Station planned by Xuan-en County is a key project which has the roles of developing waterpower resource of Zhongjianhe River reasonably, promoting economic development of mountainous areas and helping the people become rich from poverty. Thus, construction of Dongping Water Conservancy and Hydropower Project will bring great benefits to peak regulation of canton power grid and regional economic development. It is very essential of preparationg Dongping Hydropower Station actively. 1.2-.Project Description Being the last step of Zhongjianhe River Valley three-steped development, Dongping Water Conservancy and Hydropower Project lies downstream Zhongjianhe River which sits on the west and is the largest branch of Qinjiang River, and is 31.65km away from Xuan-en County. Upstream dam site, controlled valley area is 1420.5km2, accounting to 85.5% of Zhongjianhe River Valley area. The perennial average flow, runoff and rainfall depth is respectively 46.5m3/s, 14.71 billion m3 and 1091mm. This project construction will concentrate on power supply, meanwhile, it will has synthetical benefits of flood protection, irrigation, fishery, shipping and tourism. RESETTLEMENT ACTION PLAN Dongping Water Conservancy and Hydropower Project is mainly composed of water intercept darn (concrete arched dam), water lead system for electricity production, power house and transformer substation etc., with dam top level being 494m, highest dam height being 134m, arc length of dam top being 268.257m, normal water level being 490m (from the Yellow Sea Level), reservoir area being 8.12km2, total reservoir storage capacity being 3.4 billion m3, reservoir storage capacity for regulation being 2.06 billion m3, reservoir capacity coefficient P3 being 0.141, designed installed capacity being 11.0 myrial kw ( 2x5.5), annual used hours being 2834h, perennial average power supply 3.12 billion kw-h. Dongping Reservoir construction is water energy recycle of Longdong Hydropower Station at the upper branches of Zhongjianhe River ( finished in June, 1993), and it will provide favorable conditions on peak regulation, sand intercept and power supply increase for Shuibuya and Geheyan Hydropower Station in the mainstream of Qinjiang River. 1.30DProject Impact and Service Scope A! Project Impact Project impact of Dongping Water Conservancy and Hydropower Project includes three parts of countryside, market town and special items. The countryside part is involved in 38 villager groups in 17 administration villages in 7 town(ship)s and seedling planting station directly under County Speciality Bureau (as attachment C), with 9940.6mu land requisitioned (including permanent requisition 9879.6mu and temporary occupied for construction 61mu) and 37167.9m2 house dismantled (including privated house 36412.6m2and collective house 755.3m2). There are 1059 resettlers in 256 households for house dismantled (being 1092 persons when calculating up to planned level year). The actual resettles of land requisition is 1988 persons in 534 households, and according to the present land law, the agricultural population needing allocation is 1663 pesons (being 1703 persons when calculating to the planned level year and the agricultural population actually allocated being 1715persons). Meanwhile, project impact also relates to some production and living facilities as ferries, convenient bridges and pumping stations, which is detailed in Table 1-1; The market town part (Zhongjianhe Town) is involved in 22 departments and enterprises, with impact people being 261 (including sibs of employees), number of employees being 195, residents being 26 persons in 5 households, self-employees being 18 persons in 18 households and house area to be dismantled being 16840.1m. The impact objective indexes of market town is shown detailedly in Tablel-2; The impact of Dongping Water Conservancy and Hydropower Project is also involved in part of special items, including a four-leveled highway of 102 km, 4 bridges of lOlm, various wiring for electricity transmit or change of 56.8 role km, wiring for post or broadcasting of 15.7 role km, and 2 small hydropower development stations with installed capacity being 558kw. The impact special facilities is shown detailedly as Tablw 1-3. So project service scope is overall En-shi Canton, even whole middle China region and this project will bring many benefits of flood protection, irrigation, living water downstream Zhongjianhe River and of flood peak regulation of Shuibuya Hydropower Station. 1.40]Project Schedule Dongping Water Conservancy and Hydropower Project will be started in July 2001 schedully. In April 2006 the first unit will put into production to get benefits and in December 2006 the whole construction will be finished. Its construction period is 5.5 years. Along with the overall planning schedule of project construction, presently preparation works of resettlement have been finished, and edition of the RAP is running according to the WB's request, which will be pri-evaluated by the WB at the bottom of July 2000. The implementation of resettlement will be started in March, 2001. Continuously, the procedures of land requisition and of houses dismantled and resettlement works will be carried out. After the resettlement works are finished in June,2003, the monitoring and evaluation to allocation conditions will be runned according to the WB's request. 1.5 EMeasures for Reducing Project Impact 1.5.1lOProject Planning and Design Stages During the project planning and design stages, the Design Unit and the Project Owner have adopted some effective measures to reduce project impact on local social economy. The main mesures is shown as below. A. In the project planning stage, they take project impact on the local social economy into consideration and regard it as the key factor in choosing the scheme; B1Arrange the dam site possibly in narrow and steep slope with no trance of human inhabitation in order to avoid house removal and cultivated land requisition; select reasonable dam height and various water level to reduce project impact; C3On the basis of considering economic benefits, switchyard, power workshop and press regulation well should be built on waste land to decrease the amount of house removal, land requisition and land temporarily occupied; D Optimize construction design, reduce construction period, arrange housing removal and construction in reasonable period such as during farm slack season, so as to decrease the project impact on local production. 1.5.20ZProject Construction Stage AOEnhancing Public Participating RESETTLEMENT ACTION PLAN Before project construction, starting time and construction schedule should be posted as the form of notice in project impact areas and resettlement areas. Meanwhile, the compensation policies of land requisition, house removal and resettles relocation will be published, which are monitored by resettles and original inhabitants; During construction, use of local materials will be given priority as well as local transportation means and labor forces, thus affected people can obtain benefits from the project. B OMeasures to Reduce the Dust In order to give construction groud clean and comfortable circumstances and to reduce the bad effects on the environment, abandoned soil should be sprayed water on the surface if several days of fine weather and wind blowing being encountered in the process of construction. Construction units should replan the way of soil and stone transportation in time and in the loading and carrying process, try not to overload the soil to prevent the falling of soil on the roads. CETreatment of Waste Materials in Construction sites There are many living waste materials and rejectamentas in construction sites dairly because of the long project construction period and large employees. Project developers and construction units should adopt to the request of local environmental and hygienic departments to clean the domestic waste materials in the site of construction promptly , to keep it clean and to prevent propagate of epidemics. RESETTLEMENT ACTION PLAN 1.5.3EPreparation of RAP and Project Implementation Stage When land requisition and resettlement is inevitable, following measures will be adopted to decrease the local impact caused by the construction: A-lEnhance basic data acquisition procedures, analyze on local socio-economic status, and formulate practicable action plans with due consideration of actual situation, thus ensuring that the standards of living of the resettlers will not be decreased; BEIAdopt technological measures possibly to reduce project impact, such as planning to build a dam at reservoir end to protect some paddy land which is submergent when large flood comes, so as to reduce land requisition. There are 125mu various land protected by this project and 15.4mu land developed newly; C0Strengthen internal and xternal independent monitoring activities, establish highly efficient and smooth channel for information feedback, reduce information processing period, thus ensuring that problems can be resolved timely; DE7The project construction will be reasonably arranged during farm slack season rotate clearance, so as to decreasce the project impact on local production. 1.6E]Project Design and Review The Project is designed by Hubei Provincial Water Conservancy and Hydropower Investigation & Design Institute. In project pre-feasibility study stage, the design unit envisaged several alternative schemes of dam site along with deep-going techno- economic study, and conducted alternative comparison in terms of the project impact on local social economy, land requisition and removal, geological structure, hydrology and meteorology, topography and geomorphology, transportation for large equipment, maintenance of the facilities, and project economic justification, and finally decided the project commended blueprint. The pre-feasibility study report was reviewed by Hubei Provincial Water Conservancy Hall in March, 1996, and as a result, it passed the examination. Whereafter, it passed the review of feasibility study. The project owner should arrange a preliminary review for this project and run construction design promptly. The evaluation of environmental impact was undertaked by Hubei Provincial Environmental Protection Institute. This institute got the main environmental problems and their solution measures during construction period and after project is finished, after collecting local socio-economic indexes sufficiently and taking samples on field sites. Presently, the evaluation report of environmental impact of this project has passed the review of Hubei Provincial Environmental protection Bureau. Along with the principle of limitation planning, the resettlement plan was on the basis of project impact objective indexes, and was organized by Xuan-en County People's Government, imputed by the project owner, Zhongjianhe River Valley Development Company, and conducted by the resettlement consultation unit, ECIDI. This plan was compiled according to the fore outlook planning of 2010 of Xuan-en County. Meanwhile, all Q RESETTLEMENT ACTION PLAN of the affected objective indexes had been approved by their owner, the selection of allocation sites and methods considered the ideas and requests of resettles sufficiently, and the resettlement planning report had got the approval of Xuan-en County People's Government. The RAP of this project will be compiled on the basis of the resettlement planning report along with the WB's request. 1.7[1 Preparation of Resettlement AD]Project Impact Suvey From April 1 to 20, 2000, led by County Committee and County Government, the work groups were set up by the project ower, Zhongjianhe River Valley Development Company, with relevant departments of the county, resettlement consultation unit and local relevant units being participant. Conducted by the resettlement consultation unit, ECIDI of SPC, the work groups had surveyed the objective indexes one by one for 20 days, which was greatly helped by local governments, village committees of various levels and resettles. On the basis of the difference of target affected by project, project impact survey included land requisition, houses and its auxiliary facilities removal, scattered fruiters and trees lopped, self-employees, rural production and living facilities, units and enterprises, market town rebuilt, special items rebuilt and population survey affected by the project for land requisition and houses removal. All of the survey results were approved by resettles and affected units. B3Socio-economic Survey In order to analyze the project impact and draw up feasible RAP, the project owner, Zhongjianhe River Valley Development Company surveyed socio-economic conditions detailedly of town(ship)s, villages, villager groups and resettles in project impact areas and resettlement areas, with relevant departments participant. The survey adopted the methods of collecting present statistic datas and surveying samples on field sites. According to the suvey result, local socio-economic and inhabitants' actual production and living conditios were analyzed carefully. C]Resettlement Plan In order to run the resettlement works better, at the same time of carrying on objective indexes suvey, the work group surveyed the remaining land resource around reservoir detailedly from every villager group and determined the remaining environmental capacity for resettlement around reservoir. Furthermore, along with the rural socio-economic development plan of whole county, the work group concentrated on the production resettlement items of the second and third industries, inquiried the willings and requests of resettlers, and then made it certain of resettlement way and planning scheme; In the outside resettlement areas, county committee, county government, project owner unit and resettlement consultation unit researched the conditions preliminarily of land resource, development outlook, special economy, income, composing of minorities etc. Then the resettles were organized to have a look on field sites, and the outside resettlement areas were determined on the basis of asking for resettles and original inhabitants in the resettlement areas sufficiently. The resettlement of market town was based on the former plan. After the work group analyzed its development outlook and scale farther and consulted with the town leaders carefully, it was determined; The rebuilding and restoration plan of special items were determined by the unit responsible RESETTLEMENT ACTION PLAN for them according to the impact conditions. Meanwhile, in April 6, 2000, Xuan-en County Committee organized the project resettlement lead group of Xuan-en Cuonty, with subprefect, Huangshuli being the leader, as the document, No. [2000] 11 of Xuan-en County Committee Office, "Notice of Establishing the Resettlement Lead Group of Dongping Hydropower Project of Xuan-en County (detailed in attachment 0). 1.8[EPreparation for Resettlement and M&E Works The Project Owner have entrusted M&E works of the Project to ECIDI. Under the technical direction of ECIDI, preparation of the RAP was organized by the Project Owner, Zhongjianhe River Valley Development Company of Xuan-en County, with participation of the design unit, M&E unit and local government at various levels. And the impact scope of the project was determined on field site by the design unit, then local government at various levels was responsible for drawing up resettlement plans. Since March, 2000, the work has been completed including establishment of resettlement affairs offices, determination of project impact scope, compilation of the work outline of the RAP, social economic survey and inventory of project affected loss, relocation and resettlement, policies research, drawing-up of resettlement plans and compensation cost estimation, etc., by which the RAP hereof is compiled. I ,) RESETTLEMENT ACTION PLAN 3EResettlement plan should be based on the affectted property indexes and compensation standards to improve, and at least to restore the original living standard of resettlers. 40Promoting developmental resettlement. Resettlement of rural part should be based on the land, and supported on advanced local second and third industries to seek more employment. 5 0Encouraging resettlement and original residents in the resettlement area to take part in the resettlement plan. 60Resettlement will be first settled in the original communities 7GResettlement and original residents in the resettlement area will benefit for the project. .1. RESETTLEMENT ACTION PLAN 2. General Information on Nature and Social Economy of the Area Affected by the Project 2.1 Nature and Geography of the Area Affected by the Project 2.1.1 Nature and Geography of Xuan'en County Xuan'en County is situated in the south of Enshi Tujia and Miao Autonomous Region Hubei Province. As a county nearest to the capital city of Enshi Autonomous Region, it is 45 kilometers from the capital city of Enshi on the north, 100 kilometers from Hefeng County on the east, 46 kilometers from Xianfeng County on the west and 83 kilometers from Laifeng County on the south. It covers an area of 2,740 square kilometers with 71.5 kilometers across from east to west and 73.9 kilometers from north to south. Zhushan Town is 694 kilometers from the provincial capital of Wuhan. No. 209 National Highway passes through the county with a transit length of 98.4 kilometers. Two provincial roads of Jiaoshi Highway and Yalai Highway pass through the county with transit lengths of 38 and 37.23 kilometers respectively. At present, country roads connect the whole county. 83.3 percent of villages in the county are connected with roads. The total length of the roads in the county has amounted to 899 kilometers. Xuan'en is situated on the stretching part of Yungui Plateau, bounded by Wuling Mountain and Qiyue Mountain. Mountain ranges running from northeast to southwest are located on the southeastern, mid and northwestern parts of the county. They have formed lots of terraces, downlands, small basins, flat-slab deck dams, transverse slopes, valleys and canyons. Generally speaking, the county appears to be high in the northeast and low in the southwest. The climate in the county belongs to Central Asia tropical monsoon humid mountainous climate. It varies vertically with the changes in the altitude. In the alpine zone below an altitude of 800 meters, four seasons are distinct. It is warm in winter and cool in summer, rain comes with heat, and light and temperature supplement for each other. In the secondary alpine zone at altitude between 800 to 1200 meters, spring comes late while fall comes early. It has plenty of rainfall and is humid, but has insufficient light. In the alpine zone above an altitude of 1200 meters, the climate is cold, and winter is long and summer is short. And it is much more often to be flooded than to be dry. The county has an annual average temperature of 15.7
