PREFERENTIAL POLICIES .............................................87................ 87 PREFACE The draft Resettlement Action Plan (RAP) for Zhuzhou Navigation and Hydropower Project of Hunan Xiangjiang Navigation Co.nstruction and Development (hereinafter referred to as Project) was prepared by Mid-South Design & Research Institute for Hydroelectric Projects (MSDI) in August 2000. Mr. Zhang Chaohua, a social scientist, on behalf of the World Bank, reviewed the RAP and discussed the RAP with the members of the Xiangjiang Navigation Construction & Development Corporation (hereinafter referred to as Xiangjiang Corporation), Hunan Provincial Reservoir Resettlement Development Bureau (HPRRDB) and MSDI during his mission in Hunan Province to review the preparation progress of the proposed Third Inland Waterway Project between September 22-26, 2000. Mr. Zhang Chaohua has submitted a Mission Aide Memoir for the preparation progress (social aspects) of the proposed Third Inland Waterway Project. Based on the issues and suggestions put forward by Mr. Zhang in the Aide Memoir, MSDI and the Xiangjiang Corporation have made some supplements to related work, revised the draft RAP, and then prepared this revised edition of RAR This RAP was prepared in accordance with relevant laws and regulations of Hunan Province and China and the World Bank OD 4.30 on Involuntary Resettement The overall target of the resettlement is to make the production, living standards and infrastructure conditions of the resettlers gradually restore to or exceed the original level before move with a developing potential, achieving synchronous economic growth in both resettlers host area and non-resettlers area, promoting the socioeconomic and ecologic environment in the reservoir area going into a sound cycle, and making the people in the reservoir area live and work in peace. Definitions of the Project affected persons (PAP) and resettlement in the RAP are as below. 1. Definition of Project Affected Persons (PAPs) The PAPs in the RAP refer to the persons who have been or will be subject to the following impacts as a result of the Project construction: a) adverse impacts on livelihoods; b) temporary or permanent acquisition or occupation of housing, land (including house plot, farmland and livestock farm), and other movable and fixed properties, of which they are entitled to enjoy ownership, right of use, equity or economic benefits; c) adverse impacts on business, job posts, and living conditions. The PAP maybe is either a natural person, or a legal person such as a corporation and a public agency. The PAP shall not be limited to legal registration, permits to work or live in the project affected area, or ownership of assets, land and housing. The PAPs are divided into three categories as follows: a) Displaced persons: refers to those who need to move their houses due to the construction of the Project, such as family members and workers serving in govemmental offices, enterprises and companies, including both registered persons and unregistered children, students who will serve their homeland after graduating from colleges, teachers paid by the local people, compulsory servicemen, middle and primary school students, temporary I workers, contract workers, and persons sentenced to reform and reeducate through labor. The displaced persons are also divided into the following groups: 1) persons whose houses are under the reservoir inundation line, except for those in the area of the protective works; 2) persons whose houses are within the potential landslide, landfall and submersion area as well as isolated islets; 3) persons who will lose farmland only (their houses are above the reservoir inundation line, but they can not find any exploitable land nearby after reservoir inundation); and persons whose production and living are not convenient after the reservoir impoundment; 4) persons whose houses are above the reservoir inundation line, but they have to move as a result of the relocation of towns and villages they live in; 5) persons originally within the new host area and the area occupied by protctive works; 6) persons wifthin the damsite area and Hengshan Port b) Production resettlement population: refers to the population losing means of production and object (land) of laboring due to the Project construction and needing production resettlement. c) Populabtion whose infrastructure and public facilifies will be affected: refers to the population whose infrastructure and public facilities such as water conservancy, electric power, communication and transportation, telecommunication, culture, education, and public health will be affected by the Project construction, and have to be reconstructed or rehabilitated. 2. DeflnItion of Resettlement The resettlement in the RAP refers to the following: a) Arranging host area and supplying infrastructure and public facilities such as water, electric power, roads, culture, education and public health in the new host area in order to make the housing conditions and living environment of the relocatees reach or exceed that before move. b) Supplying appropriate means of production and object of laboring for the population losing their jobs only so as to make the income level of the affected population reach or exceed that before move. c) Taking protective mneasures for the affected farmland and houses. d) Rehabilitation and compensation for the affected private- and public-owned enterprises. e) Rehabilitation and reconstruction of the affected special facilities such as water conservancy, electric power, communication and transportation, and telecommunication in principles of following the original standard, scale and functions. f) Rehabilitation or compensation for other private or public assets affected by the Project in order to eliminate the adverse impacts to the local residents. 2 1. GENERAL 1.1 Description of the Project The Project, as one of Lot IlIl Projects of China inland waterway development loaned by the World Bank, comprises the Zhuzhou Navigation and Hydropower Complex (hereinafter referred to as the 'Complex"), Hengshan Kilo-tonnage Wharf and Zhuzhou-Xiangtan Kilo-tonnage Navigation Course Improvement Works. The total investment for the Project is 1799.44 million yuan, of which US$100 million (equivalent to 830 million RMB yuan) will be loaned by the World Bank, and 969.44 million yuan will be partly appropriated by the State and partly financed by Hunan Province. The Complex, on the middle lower reaches of the Xiangjiang River, is located at Kongzhou islet, 6 km upstream of the Lukou Town, county seat of Zhuzhou, Hunan Province. The dam site is 158 km and 96 km downstream of Hengyang City and Dayuandu Junction respectively, and 24 km upstream of Zhuzhou City. The Complex, consisting of a dam, a shiplock, a powerhouse and an access bridge on the dam crest, is developed mainly for navigation, concurrently with multipurpose benefits such as power generation, irrigation, water supply, aquaculture and recreation. The catchment area upstream of the dam site is 65,200 kM2, and the mean annual flow at the dam site is 1,680 m3/s. At the NPL 40.5m, the reservoir has a backwater length of 96 km, a surface area of 58.9 kM2, and a total storage of 0.47 billion m3. The hydropower station will house 5 turbo- generator units with a total installed capacity of 140 MW and an annual output of 640 GWh. Construction of the Complex is scheduled to commence in 2001, and the construction period will be 5 years. Construction of the Hengshan Kilo-tonnage Wharf, located within Jinfeng Village, Chengguan Town, Hengshan County, is scheduled to commence in 2003 and will be completed simultaneously with the Complex. 1.2 Design Process of ReseKtlement Plan The pre-feasibility study for the Project was completed in March 1999, and the Pre-feasibility Study Report was approved by Hunan Provincial Planning Commission and Hunan Provincial Communications Department in April 1999. The Prcject Proposal was submitted to the State Development Planning Commission for approval by Hunan Provincial Planning Commission in Document No. [1999J079. In July 1999, the Pre-feasibility Study Report was approved by the Ministry of Communications. The Prcject Proposal was appraised in September 1999 by China Intemational Engineering Consultants Company on behalf of the State Development Planning Commission, and the Appraisal Report was submitted to the State Development Planning Commission in December 1999. In August 2000, the Prcject Proposal was approved by the State Development Planning Commission in Document (Infrastructure) No.[2000]1093. Simultaneously with the arrangement for going through the related approval formalities for approval of the Project, the 'Xiangjiang Corporabon entrusted MSDI to carry out investigation and design works for the reservoir area. From May to the first ten days of September 1999, MSDI technical personnel surveyed the reservoir areas below EI.42m for a 1:2000 topographic and land classification map. In July to the first ten days of October 1999, an overall survey for the 3 tangible material indices affected by reservoir inundation was carried out by a joint survey team from MSDI, the Xiangjiang Corporation, and concemed departments and townships in Zhuzhou, Hengdong, Hengshan and Xiangtan counties and Liling City, with the participation of concemed villager group leaders and displaced households. In the middle ten days of November 1999, MSDI, together with the Xiangjiang Corporation, assigned personnel to visit the related counties and cities in the reservoir area to inform the survey findings of tangible material indices to the local govemments. All the tangible material indices were acceptable to the local govemments. From October 1999 to March 2000, MSDI, together with the concemed departments of local govemments, carried out the preliminary planning design work for the resettlement, protection works and special facilities rehabilitation in the reservoir area. Based on the collected data, field survey, analysis and comprehensive balance, the preliminary plan for the resettlement of the displaced persons and the production resetement channels was proposed, the preliminary plan for protection works and special facilities rehabiliation was prepared, and consequently, the compensatory investment for reservoir inundation handling was proposed. From July 1999 to January 2000, MSDI, together with local govemments, carried out a survey on the tangible material indices in the permanent project areas according to the 1:2000 and 1:10000 topographic maps and the 1:5000 general construction layout of the Complex, and canied out the preliminary resettement plan work. In July 2000, MSDI, together with the Xiangijang Corporation and concemed local departments, caried out a survey on the tangible material indices to be affected by the Hengshan Kilo-tonnage Wharf according to the 1:500 topographic map and 1:1000 general layout, and worked out the compensatory investment. 1.3 Principal Plan Design Achievements 1.3.1 Principal Tangible Material Indices a) Reservoir area Based on the NPL 40.5 scheme, the reservoir inundation will cover some units and .538 villager groups in 90 villages in 14 townships in Zhuzhou, Hengdong, Hengshan and Xiangtan counties and Liling City. The principal tangible material indices affected by the reservoir inundation are as below: 1,165 displaced persons, 68,737 m2 of housing area; 20,124 mu (1 ha. = 15 mu) of farmland, 99.9 mu of forest land, 886 mu of fish ponds; 2.4 km of Grade IV highway, 223 drainage culverts and sluices, 246 pump stations, 17.15 km of transmission lines at 10 kV or more, and 6.2 km of telecommunication lines. About 95% of the affected farmlands are within Zhuzhou County, and the affected farmiand at EI.38.5m or higher accounts for 83% of the total affected farmland. The affected farmland is relatively concentrated with minor submergence depth. Most of the affected farmland may be protected from inundation by taking appropriate measures. About 99.5% of the affected housing are in Zhuzhou County, and 62% of the affected housing is of brick-concrete structure. Most of the affected housing may be protected by taking consolidation measures as only the ground floor is affected. b) Dam area 4 Due to the dam construction, 385 persons and 21,000 m2 of housing have to be displaced. 727.5 mu of farmland, of which 577.2 mu is paddy field, will be occupied for the dam construction. c) Hengshan wharf The total land area of the Hengshan wharf is 26 mu. 58 persons in 13 households and 4,121 m2 of housing have to be displaced. 19 mu of orchards and 2 mu of fishponds will be occupied for the wharf construction. 1.3.2 Resettlement Plan a) Reservoir area Production resettlement channels: The protected farmland area is 17,339 mu. The actual farmland area to be compensated is 2,785 mu. The production resettlement population in the target year 2003 is 2,189. In order to achieve comprehensive resettlement, 1094.5 mu of paddy field will be adjusted, 363.8 mu of fishponds will be improved, and 1825.2 mu of fishponds will be newly established. Resettlement for affected persons: In the planned target year, 1,205 persons will be affected, of which 925 will be within protected area, 156 will be provided with housing consolidation or heightening at the ground floor, and 124 will be moved nearby. Special facilities rehabilitation and protection works: Based on the plan design, 34 bridges capable of passing farming machines will be reconstructed, 175 drainage culverts and sluices and 204 pump stations will be improved or extended, 24.2 km of reservoir shore will be protected, 8.06 km of telecommunication lines and 20.3 km of transmission lines at 10 kV or higher will be reconstructed, and 3.32 km of railway side slopes and 17,339 mu of farmland will be protected. b) Dam area The 385 displaced persons in the dam area are relatively dispersed. The move- back resettlement option will be employed, and the affected persons will be moved out of the construction redline and resettled in different areas. About 457 persons need production resettlement. It is planned to return 200 mu of construction site to paddy field, and to adjust 324 mu of paddy field for vegetable plantation. c) Hengshan wharf The affected 58 persons in 13 households will be moved backward to resettle in the area with the elevation above the Hengshan-Xuanzhou highway. 1.3.3 Resettlement Compensatory Investment Calculated based on the 1999 price level, the total resettlement compensatory investment of the Project is 304.4138 million yuan, of which: a) Reservoir area: Based on the NPL 40.5 m scheme, the static investment for the reservoir inundation handling is 271.6599 million yuan. 5 b) Dam area: The static investment is 30.6852 million yuan (including 10 million yuan for the Kongzhou islet). c) Hengshan wharf: The static investment is 2.0687 million yuan. 2. PRESENT SOCIOECONOMIC SITUATION IN RESERVOIR AREA 2.1 Contents, Methods and Organization of Socioeconomic survey 2.1.1 Contents The socioeconomic survey aimed to understand the socioeconormic environment in the reservoir area so as to identify the vulnerable groups that are facing higher risk of impoverishment and the preference of affected populaffon. The contents of socioeconomic survey covered the constitution of population and nationality, land use situation, land ownership and tenure, cropping structure, employment patterns, farmers' income structure, village level institutional setup and deliberation procedures. 2.1.2 Methods and organization The survey was carried out by a joint survey team of the Xiangjiang Corporation, MSDI and the related city and county resettiement offices. The Xiangjiang Corporation was responsible for the organization, expenses and coordination of relations among various parties during the survey. MSDI was responsible for survey implementation such as design of the contents, methods and registering forms of the survey, selection of sample households, arranging personnel to make field survey, reviewing the survey information, recording the information into computer, and then analyzing and sorting out the infornpation. The related city and county resetUement offices, as the coordination agencies in their respective administrafive regions, was responsible for liaising the persons and units to be surveyed, and assisting MSDI in the survey. The main approaches of the socioeconomic survey were as follows: distributing registering forms to village cadres and resetters, interviewing the affected households and filling the forms, collectng the existing statistics from govemmental departments, and holding meetings to discuss issues with local cadres and resettlers. 2.2 Present Situation in Reservoir Area 2.2.1 Geographic Features The reservoir area, located in the middle part of the Changsha-Hengyang hilly area and basin, is mainly of plains, downlands, hills and mountains. The landform is high in the southeast, low in the northwest, and surrounded with hills and streams. The Zhuzhou, Zhaoling and Majiayan redbed basins constitute the typical features of the reservoir area. The Xiangjiang River reaches in the reservoir area, 93 km long, snakes all the way with beaches and islets developed. The mountains on both banks of the reservoir range I OOr-250m in elevation. 6 The reservoir area, located in the middle subtropical wet climate zone, has clear four seasons with the mean annual ambient temperature of 170C, yearly frost- free period of 281 days, and annual precipitation of 1,389 mm. The water and land transportation is convenient in the reservoir area. The Beijing-Guangzhou railway, the National Road No.107 and the Xiangjiang River all run through the reservoir area. 2.2.2 Population and Land Based on the NPL El.40.5m scheme, the reservoir inundation covers 14 townships and towns (farm) in Zhuzhou, Hengshan, Hengdong and Xiangtan counties and Liling City. A total number of 296.5 thousand persons (based on 1998 agricultural population) and a total land area of 915.96 km2 will be affected. The population density is 324 personsikMm2. The residents in the reservoir area are all Han nationality, and no ethnic minority communities live here. The total farmland area in the affected 14 townships and towns (farm) is 368.7 thousand mu with the per capita farmland area of 1.24 mu. The maximum per capita farrnland area among the townships reaches 1.38 mu, and the minimum is 1.04 mu. Farmland close to the river in the reservoir area can normally grow one crop per annum and is called by the local people as 'paddy field liable to flooding "due to frequent inundation by flood. As for land utilization, the farmland and forest land account for 26.83% and 43.71 % of the total land respectively. See Table 2.2.2-1 in detail. 2.2.3 Cropping structure The main crops in the reservoir area are paddy rice, green manure, vegetabies, rape seed, etc. The cropping index of the farmland is 2.53. The agricultural food products are primarily of paddy rice and potatoes, and the cash crops are mainly of rape seed and peanut. The per capita grain output in 1998 was 839 kg. 2.2.4 Economic structure and farmer's income The economy in the reservoir area is relatively developed. The main trades include agriculture, industry, building services and animal husbandry. Main income sources of the farmers in the reservoir area are nonland-based occupations that account for 58% of the gross income of these farmers as well as the income from cropping accounts for 26%. See Table 2.2.4-1 in detail. The per capita net income of farmers was 2,461 yuan in 1998. 2.2.5 Employment Structure Labor forces in the reservoir area focus on the land-based occupations, of which labor forces engaging in farming, forestry, animal husbandry and fishery account for 66% of the total labor forces, the remaining engage in building, or are migratory workers. See Table 2.2.5-1 in detail. 2.2.6 Village level institutional setup and deliberation procedures 7 The administrative setup and legislature in China comprises five levels as Natuional, provincial (municipal, autonomous region), municipal (prefecture, league), county (city, banner), and township (town). The people's congress standing committee, people's govemment, and political consulting standing committee have been set up for each level. The villagers' committees and villagers' groups have been established in each township (town). The Law on Organization of Villagers' Committee of the People's Republic of China states as below. Villagers' committee is a grassroot massive autonomous organization of villagers to realize self-administration, self-education, self-service, democratic election, democratic decsion-making, democratic management, and democratic supervision. Villagers' committee deals with the public affairs and public welfare of the village, mediates civil disputes, assists to retain social public secunrty, and reflects opinions and demands of villagers to the people's govemment as well as recommends suggestions. Villagers' committee shall be staffed with 3 to 7 persons including the chief, deputy chief and members. Among the members of the villagers' committee, women shall take some seats. The members of the villagers' commnittee shaD not be divorced from production. The chief, deputy chief and members of the villagers' committee shall be directly elected by villagers. No organization or individual is entitled to nominate, assign or replace the members of villagers' committee. The term of office of the members of villagers' committee shall be 3 years. The villagers' committee may divide the village into several groups according to the living condifions of the villagers, with the villagers' group leader elected at the villagers' group congress. The villagers' committee is responsible for reporfing work to the villagers' congress. The villagers' congress shall comprise all the villagers at 18 or above in this village. The villagers' congress shall be attended by more than a half of the total number of the villagers at 18 or above, or representatives of more than two-thirds of the households in the village. The resolutions shall be valid only with more than a half of the votes of the attendants in favor. The villagers' congress shall be convened by the villagers' commfttee. In case that one-tenth of the villagers propose to convene a meeting, the villagers' congress shall be convened. At the villagers' congress, the articles of self-autonomy, village regulations and agreements may be formulated and revised. The following events related to the villagers' interests may be arranged by the villagers' committee only with the approval of the villagers' congress. a) Collection method of the township pool, and collection and use of the withdrawal and retention by the village; b) The number of persons entitled to share the work delay allowance in the village and the allowance standard; c) Use of the income from the collecfively-owned projects of the village; d) Financing option for the cause of public welfare such as village- run schools and roads; e) Approval and contracting scheme of the collectively-owned projects, and 8 contracting scheme for the cause of public welfare run by the village; f) Contract and operation scheme for villagers; g) Scheme of use of houseplot; h) Other matters related to the villager's interest that should be deliberated and determined at the villagers' congress as recommended by the villagers' congress. 2.2.7 Ownership and right of use of land The Law of Land Administration of the People's Republic of China states as below. Land in the urban districts shall be owned by the State. Land in the rural areas and suburban areas, except otherwise stipulated by laws as owned by the State, shall be collectively owned by peasants, including land for building houses, and land and hills allowed to be retained by peasants. Land owned by the State and land collectively owned by peasants may be allocated to be used by units or individuals according to law. Land collectively owned by peasants shall be contracted out to members of the collective economic organizations for use in crop farming, forestry, animal husbandry and fisheries production under a term of 30 years. Within the validity term of a contract, the adjustment of land contracted by individual contractors shall get the consent from over two-thirds majority votes of the villagers' congress or over two-thirds of villagers' representatives and then be submitted to land administrative departments of the township (town) people's govemment and county level people's govemment for approval. The farmland area contracted by peasants should generally be allocated averagely to the members of each family as a whole. Meanwhile, considerations should be given to both high-quality and low-quality farmland during the allocation. Thanks to the relatively developed non-land based industries in the reservoir area, the peasants depend little on the land. Most of the peasants in the reservoir area are willing to adjust the farmland they contracted. 9 Table2.2.2-1 Statistics on Basic Information of Reservoir Area In 1998 County Agr. Auxiliary facilities of housing include enclosures, sunning grounds, ponds, gateways, manually-operated pump wells, methane tanks, scattered fruit trees, etc. c) Land: including farmland, orchards, forest land, grass land, etc. d) Special facilities: including water conservancy facilities, sideline production facilities, traffic facilities, power facilities, telecommunication facilities, etc. Water conservancy facilities: including the projects of mini-hydropower stations, pump stations, culverts/sluices, pools, water-diversion dams, main and branch canals, water-conveyance conduit, waterwheels, wells, etc. Sideline production facilities: including oil press houses, small coal pits, simple lime kilns, brick and tile kilns, etc. Traffic facilities: including railways, highways, tractor roads, ferries, wharves, etc. Power facilities: including transmission lines, transformers, etc. Telecommunication facilities: including such facilities as telecommunication, radio broadcast, cable TV, etc. e) Industrial and commercial enterprises: including companies, factories, shops, 13 mines, etc. f) Mineral resources, cultural relics and historc sites, etc. 3.1.2 Scope of Survey for Tangible Material Indices The scope of survey for tangible material indices affected by the Project included reservoir area, dam area and Hengshan wharf. The contents of survey for reservoir inundation indices covered population, houses, land, special fadlities, etc. Reservoir areas: cover both inundated and affected areas. According to the relevant stipulations in DLrT5O64-1996 Specifications for Planning and Design of Reservoir Submergence Treatment for Hydroelectric Engineering, and based on the NPL 40.5m scheme, the reservoir backwater of a 2, 5, 10, 20 or 50-year flood (considering a 10-year siltation after reservoir formation) will be tapered out in front of the dam. Based on the above mentioned, the scope of survey in inundated reservoir areas is defined as: the investigation line for the affected population, houses and special facilities was I.Orm above the normal pool level, and that for farmiand and orchards was 0.5m above the normal pool level. The reservoir-affected area refers to the area above the reservoir line where landslide and bank slump may occur due to reservoir inundation, as well as the islet surrounded by water. Dam area: refers to the permanent land occupation area of the Project, including the area for the structures, construction production and living facilifties, aggregate exploration and processing as well as construction roads. Hengshan Wharf refers to the affected area of the Hengshan kilo-tonnage wharf, including such production and living area as warehouse, stack yard, comprehensive building, parking area, access to the wharf. 3.1.3 Method of Survey for Tangible Material Indices The survey methods for the tangible material indices were as follows: The population was catalogued as agricultural and non-agricultural with the name, age, occupation and education level registered. The houses were catalogued as brick-concrete, brick-wood and earth-wood structures and miscellaneous. The houses were measured household by household and building by building. Each building's usage, structure, story and size were registered in cards by households and units. Photographs were taken 14 for the inundated houses. The grades and inundated quantities of special facilities, such as traffic, telecommunication, power, etc., were investigated and verified on the spot based on the data supplied by the concemed departments. The land was registered as farmland, orchard, forestland and grassland. During the survey, the surveyors, firstly, verified the land classification on the spot based on the 1:2000 topographic and land classffication map, delineated the land use right, and inspected the farmland ridge coefficient by random samples, then scanned the drawing into a computer to measure the area of each pattem, and finally conducted statistics on the inundated land area by elevations, land classification and administrative units. Meanwhile, the tangible material indices affected by the potential landslides and landfall in the reservoir area were investigated. 3.1.4 Organizational form of investigation of inventory of assets Investigation of inventory of assets was carried out by the joint survey team comprising MSDI, Xiangjiang Corporation, and local govemments. The joint survey team was directed by MSDI, who was responsible for statistics and collection of the data. The field survey works involved 3 groups as land, population and housing, as well as special facilities, which was divided into 5 subgroups. The joint survey team comprised members from MSDI, Xiangjiang Corporation, county resettlement agencies, county communications bureaus, county water conservancy bureaus, county land administrations, county real estate bureaus, county auditing bureaus, county statistics bureaus, and related townships. The responsible persons of the related villagers groups and organizations and relocatees' households involved in the reservoir inundation participated the survey work. 3.1.5 Cut-off time for investigation of inventory of assets The cut-off time for survey of the inundation indexes in this phase was September 1999, that for survey of the damsite construction affected inventory was January 2000, and that fQr survey of Hengshan Wharf affected inventory was July 2000. The preliminary design for the Project is expected to be completed in the period of December 2000 to April 2001. After its completion, the local govemments will issue orders on stopping any construction in the Project-affected area including l5 reservoir inundation area, dam site and Hengshan wharf area. The Project- affected inventory of assets existing prior to the order issuance will be entitled to obtain compensation, and the inventory of assets moving into the Project- affected area after the order issuance will not be compensated in principle, unless otherwise specified by related laws and regulations. 3.2 Tangible Material Indices Affected by Reservoir Inundation Based on the NPL 40.5m scheme, the reservoir inundaton involves some units and 538 villager groups in 90 villages of 14 towns and townships in Zhuzhou, Hengdong, Hengshan and Xiangtan counties and Uling City. The major tangible material indices affected by reservoir inundabion are as follows: A total of 1,165 persons below reservoir inundation line and affected by potential landslides or landfalls, 68,737m2 of floor area of housing; 20,124mu of farmland, 99.9mu of forest land and 886mu of fish pond; 2.4km of Grade IV highway, 223 drainage culverts and sluices, 246 pump stations, 17.15km of transmission lines at 10kV or above, and 6.2km of telecommunicabon lines. There are no ethnic minority communities. Up to present, no cultural relics and historic sites have been found yet within the Project- affected areas. The details are shown in Tables 3.2-1, 3.2-2 and 3.2-3. 3.3 Tangible Material Indices of Dam Area The land requisition for the dam area consists of permanent works area, construction and living facilities, aggregate quarry area and processing area, and construction roads. The land acquisition involves three towns and townships in Zhuzhou County, na0mely Sanmen and Leidashi towns on the left bank, and Zhouping township on the right bank. The Kongzhou islet, a public place for tourist and entertainment under Shennong Corporation will also be requisitioned. About 385 persons and 21,000m2 of housing will be relocated, and 727.5mu of farmland, of which, 577.2mu are paddy field, will be requisitioned. The tangible material indices above mentioned excludes those in the Kongzhou islet and dump area. The details are shown in Tables 3.3-1 and 3.3-2. 3.4 Tangible Material Indices of Hengshan Kilo-tonnage Wharf Area The total land area of the Hengshan wharf is 26mu. The land acquisition involves 2 groups in Jinfeng Village, Chengguan Town, Hengshan County. About 58 persons of 13 households will be relocated, and 4,121 m2 of housing area will be 16 displaced. About 1 9mu of orchards and 2mu of fishponds will be requisitioned. 3.5 Impacts on livelihoods of Project-affected population 3.5.1 Characteristics of reservoir inundation affects The characteristics of reservoir inundation affects are as follows: a) The main inundation-affected object is farmland. The inundation-affected object mainly involves farm land, which is mostly paddy field with a little dry land. The population and special facilities affected are relatively few. Of the special facilities, most are water conservancy facilities such as culverts and/or sluices, and pump stations with a few high ways, electric power transmission lines and telecommunication lines. b) Inundation region is mostly within the Zhuzhou County. Although the reservoir inundation will cover five counties and/or cities, most of the affected regions are within Zhuzhou County. Ninety-nine percent (99%) of the affected population and housing are in Zhuzhou County. No population and housing will be affected in Hengdong County, Liling city and Hengshan county. Only one household with 6 people will be affected in Xiangtan County. The affected farmland in Zhuzhou County accounts for 95% of the total farmland affected by the reservoir, and the remaining 5% is in Liling City and Hengdong County. No farmland will be affected, and only a few special facilities will be affected in Hengshan County. c) The affected farmland is concentrated with minor submerging depth and it posses good conditions to be protected from inundation. For instance, in Sanmen Town of Zhuzhou County, the farmland area below the inundation line is 5,973mu, which can be protected merely with construction of a canal to divert the water in the 2 tributaries to the downstream of the dam of the Project. Besides, in the reservoir area, the inundated farmland area above El. 38.5m is 11,366 mu (exclusive of Sanmen Town) with an inundation depth of 2m to 3m.These farmlands can also be protected by proper engineering measures. Analyses and calculations show that the protectable farmiand in the whole reservoir area is 17,339mu. So the actual number of farmland area to be requisitioned is only 2785mu accounting for only 14% of the total affected farmland area. 17 d) The affected housing in the reservoir area is of brick-concrete structure and for most of them only the ground floor will be affected. The affected housing in the reservoir area is mainly of brick-concrete structure, which makes up more than 60% of the total, and is mostly with 2 floors or more. For most of the affected housing, only the ground floor will be affected and these houses can be protected with certain consolidation measures taken. Hence, most of the affected housing will not be displaced. e) The current flood control standards of the affected farmland and housing are low. The farmland within the reservoir inundation region is called ' paddy field liable to flooding'. This kind of farmland adjoins to the river, and they are frequently affected by floods. Only one crop per annum is possible with low yield. All the affected housings are located in the low-lying land with low flood control standards. Even if no project is built, the ground floor of the housing is often inundated by flood, the local people don't take the ground floor as living rooms and just use it as lumber rooms. 3.5.2 Impacts on livelihoods of affected population a) Impacts on land structure There is 20,124 mu of farmland under the reservoir inundation line. Although 86% of the farmland may be protected from inundation, 2785 mu farmland will still be affected. The per capita farmland area will be slightly reduced, and the water area will be greaty increased. After the land requisition from part of the farmers, some adjustments of the contracted farmland should be made. Furthermore, the quality of the farmnland protective works project will become one of the key factors for the resettlement b) Impacts on industrial structure After construction of the reservoir, the industrial structure of the local farmers will have great changes. The income from cropping will be decreased, and the income from fishery, the second and third industries will be increased. For some affected farmers, they may not adapt to the new producfion skill, and technical training is necessary for them. c) Impacts on the housing conditions of displaced population 18 The current flood control standard for the affected housing is not high. The housing is lack of integral plan, with incomplete supporting facilities such as water, electricity, road, culture, education and health. During the relocation, the new inhabited area will be integrally planned, and infrastructures such as the fundamental facilities for the water, electricity, road, culture, education and health will be properly supported. Therefore, the housing conditions of the resettlers will be greatly improved after the displacement. d) Impacts on special facilities such as transportation, power and telecommunication Only a few special facilities will be affected, with local sections affected. The whole network will not be changed, so they will be easy to renovate. Besides, as a combined project with functions of navigation and power generation, after it's construction, it will greatly improve the conditions of the local transportation, power and telecommunication. e) Impacts on social structure As all the displaced people can be resettled in their own village, the negative impacts of displacement on the local social structure and traditional culture will be reduced to the minimum. f) Impacts on income of displaced population Although the construction of the Zhuzhou Project will inundate some farmland in the reservoir area, it will not bring risks of impoverishment to the affected people after they have been relocated. First, the non-agricultural industries in the reservoir area is relatively developed, and the income from cropping only accounts for 26% of the total income of the farmers. The farmers don't depend strongly on the farmland. Second, the affected farmland is poor in quality, and low in yield and retum. Third, most of the farmland under the inundation line may be protected. A piece of farmland which can support the displaced people with basic food, will be ensured for the resettlers by means of adjusting some farmland. The general laws and regulations mainly include the Constitution of the People's Republic of China, Land Administration Law of the People's Republic of China, Land Administration Enforcement Regulations of Hunan Province, the World Bank Operational Manual for Involuntary Resettlement (OD4.30), etc. The special resettlement laws and regulations mainly include: a. Regulations of Resettlement and Compensation for Land Acquisition Due to Construction of Large- and Medium-Scale Water Conservancy and Hydroelectric Prcjects (Decree No. 74 issued by the State Council on May 1, 1991, hereinafter referred to as 'Reseftlement Regulations"); b. Specifications for Planning and Design of Reservoir Submergence Treatment of Hydroelectric Engineering (hereinafter referred to as 'Reservoir Specifications"); c. Regulations on Management of Compensation Funds for Reservoir Resefflement (trial) (Document (Comprehensive) No. [1998] 90 issued by Ministry of Electric Power Industry)}. d. Regulations on Supervision of Reservoir Resettlement for Hydroelectric Prcjects {Document (Comprehensive) No. [1998] 251 issued by Ministry of Electric Power Industry}. e. Regulations on Management of Resettlement Funds of Hunan Province. f. the World Barik Operational Directives for Involuntary Resettlement (OD4.30). 4.2 Major Resettlement Policy Framework The major resettlement policies in China are as follows: 25 a. The development-oriented resettlement is encouraged and supported in China. The measures of providing compensation and subsidy in the earlier stage and production support in the later stage should be adopted (Article 3 of Resefflement Regulations). b. A proper balance in the relationship between the State, the collective and the individual should be maintained. The overall interests of the State should be given top priority in the resettlement arrangement (Article 4 of Resettlement Regulations). c. The resettlement works should be combined with the construction, resources exploitation, water and soil conservation and economic development in the reservoir area so as to enable the relocatees' livelihood to progressively come up to or surpass the pre-displacement level (Artide 4 of Resettlement Regulations). d. The principles of the resettlement should be overall planning, rational use of resources in the reservoir area and move-back relocation based on the local conditions. For those without move-back relocation condifion, the resettlement pattem of reclaiming wasteland and intertidal zone, redistributing land and displacing to another place may apply provided that relevant laws and regulations are obeyed (Article 4 of Resettlement Regulations). e. In the project preparation stage, the unit undertaking the Project should, together with the local govemments prepare the Resettlement Plan in conformance with the relational and economic principle in accordance with the natural and economic conditions in the resettlement area. The Resettlement Plan should, together with the Design Assignment (Feasibility Study Report) and the preliminary design documents, be submitted to the competent department for approval. Without the Resettlement Plan, the design documents of a project should not be approved, the formalities for land acquisition should not be gone through, and the construction of the project should not commence (Article 10 of Resettlerent Regulations). f. The local govemment at county level or above should be responsible for implementing the approved Resettlement Plan, organizing displacement according to the construction progress, and making appropriate arrangements for production and living of relocatees. After the project completed, the responsible department of the project should, together with the local govemment at county level or above in the resettlement area, carry out examinafion and acceptance for the resettlement works (Arficle 10 of Resettlement Regulations). 26 g. Economizing on land is a basic national policy in China. For the construction of hydroelectric projects, the principles of reducing inundated land and displaced population should be considered as fully as possible in light of the actual situation of a large population with relatively little land in China. The reservoir inundation loss is an important factor to determine the design scheme of a project. Hence, profound and careful study on the project should be conducted (Article 1.0.3 of Reservoir Specifications). h. As for the investment for reservoir resettlement, special facilities rehabilitation and protection works, only the investment for restoration and reconstruction to the original scale and original standard should be listed into the compensatory investment. Any investment for raising the specified scale and standard should be solved by the local govemment or relevant units (Article 16 of Resettlement Regulations, and Article 10.0.1 of Reservoir Specifications). i. Compensation of affected assets shall be made at their replacement cost in accordance with The World Bank Operational Directives for Involuntary Resettlement (OD4.30) PRELIMINARY RESETTLEMENT PLAN 5.1 Planning of Production Resettlement for Rural Relocatees 5.1 .1 Principles The planning of production resettlement for rural relocatees shall be in line with the principles listed below: Adaptation to local condition. Due consideration shall be given to the local natural resources and social economic condition in a manner to make best use of the advantages and bypass the disadvantages and to integrate the resettlement plan with the local ninth five-year plan and tenth five-year plan. Depending on land resources. The large agriculture shall be kept in the dominant position, based on the land resources and various favorable conditions shall be sufficiently utilized to recover possibly more cultivated land and guarantee basic farmland for the rural resettlement. Cost-effectiveness.Priority shall be given to development of any sub-projects with less investment and quick benefit. 27 Comprehensive resettlement Reliable foundation shall be established for resettlement with focal attention to agriculture in addition to diversified farming. Environmental protection. Resettlement production shall be so developed as to highlight water and soil conservancy, protect ecological environment and prevent water and soil losses. Target year. Construction of the hydropower station is planned to commence in 2001, and the first unit is to be in service in December 2003, so the target year for resettlement is 2003. 5.1.2 Objectives for production resettlement planning Overall objectives for resettlement To make the relocatees' production and livelihood as well as infrastructures gradually reach or exceed the pre- displacement level with room for further development, materialize simultaneous economic increase in both resettiement and non-resettlement areas, promote sound circulation of social economic and ecological environment in the reservoir area, and enable the local people to be settled in comfortable jobs and lasting good order. Objectives for production resettlement planning. Based on the current net income per capita in the reservoir area and with consideration of the pertinent requirements in the ninth five-year plan and tenth five-year plan for national economic and social development in the locality, the target per capita net income in year 2003 in the reservoir area is proposed to be 2600 Yuan, of which the net income from agricutural development scheme makes up 40%. Wdh consideration of the output levels of various farming actvities in the reservoir area, the physical standard of producton resettlement for each rural relocatee is 0.5 mu paddy field plus I mu fish pond. 5.1.3 Production Resetilement Population in the Reservoir Area The production resettlement population refers to the rural population that loses its main means of production and farmland and is subject to re-arrangement of production. In calculation, first of all, the affected frmiand area outside the protection scope and the current per capita land holding in each villager group were worked out, and then the current production resettement population for each group was worked out, finally, with an assumed annual population growth rate of 8Xo, the total production population needing production resettlement in December 2003 was estimated. In accordance with the calculation, the total population needing production 28 resettlement in December 2003 in the reservoir area is 2189, of which, 2169 are in Zhuzhou County, 15 in Hengdong County, 2 in Liling City, and 3 in Xiangtan County. For production resettlement population in each village in the reservoir area, refer to Table 5.1-1. 5.1.4 Environmental Capacity Analysis for Reservoir Area Resettlement The Project lies in an area with relatively developed economy, high development and utilization rate of the land, few barren mountains and wasteland. However, the remaining per capita farmland in most villager groups is above 0.5 mu, the relocatees in the reservoir area can basically be all resettled in their own villager group or village by means of protecting the affected farmland, adjusting part of the paddy field, and developing fishpond aquaculture in an adequate manner. First of all, the reservoir area boasts a large area that can be protected, hence production resettlement is a slight task. 86% of affected farmland in the reservoir area has good protection condition. The protectable farmland in the whole reservoir area is 17,339 mu, so the actual number of farmland area needing compensation is only 2,785 mu, and the population needing production resettlement is 2,189. Secondly, the reservoir area has much remaining farmland. Provided with engineering protection measures, about 200 villager groups are still subject to production resettlement, among which, 52 villager groups have remaining per capita paddy field of more than 1 mu after inundation, making up 26 % of the total, 111 villager groups have remaining per capita paddy field of more than 0.5 mu-1 mu, making up 56% of the total, and only 37 villager groups have remaining per capita paddy field of less than 0.5 mu (including 21 villager groups that have per capita paddy field of less than 0.5 mu even before inundation). However, the per capita remaining paddy field in the villages where these 37 villager groups locate all exceeds 0.5 mu. Therefore, a per capita basic farmland of 0.5 mu can be guaranteed for the relocatees through adjustment in part of the paddy field within the same villager group or village. Thirdly, the reservoir area boasts sound condition for fishpond culture. The area of water ponds and fishponds to be inundated amounts to 1293 mu, which can be reutilized with provision of slight renovation; In addition, in the reservoir area, as 2,785 mu of farmland lies below EL. 38.5m, the farmland can be developed into fishpond in combination with farmland protection. Furthermore, because the reservoir area is adjacent to the large cities as Zhuzhou, Xiangtan, Hengyang and Changsha, etc., it enjoys convenient transportation access both in highway and waterway with favorable marketing conditions. Apart from the aforesaid, the local farmers have gotten into fishpond culture with corresponding technique long ago. Consequently, it is highly desirable to resettle the relocatees by means 29 of fishpond culture. 5.1.5 Preliminary Plan for Production Resettlement In the light of the guidelines and principles in planning of production resettlement for rural relocatees and with respect to the actual situation and analysis results of environmental capacity in the reservoir area, and based on the production resettlement standards of 0.5 mu basic farmland plus 1 mu fish pond, the preliminary plan for production resettlement at this stage is put forward after analysis and calculation for each village, with the results indicated as below. Paddy field adjustment 1094.5 mu, including 1084.5 mu in Zhuzhou County, 7.5 mu in Hengdong County, 1 mu in Uling City and 1.5 mu in Xingtan County; Fish pond renovation: 363.8 mu, including 355.5 mu in Zhuzhou County, 6.3 mu in Hengdong County, 2 mu in Xiangtan County, New fish pond construction: 1825.2 mu, including 1813.5 mu in Zhuzhou County, 8.7 mu in Hengdong County, 2 mu in Uling City and I mu in Xiangtan County. The balance analysis of investment shows that the land compensation cost calculated according to the Land Law updated in 1999 can fully meet the requirements of production requirements. Land compensation cost minus 19449.9 production development investment 5.2 Housing Relocation 5.2.1 Present Status for the Affected Housing According to the survey results, the inundation covers 41 villager groups in 16 villages of 7 townships, and 4 units and 6 residents committees in Zhuzhou and Xiangtan counties. The affected population and housing area are 1,165 of 246 households and 68,737 m2respectively. The present status of the housing is as below: Housing structure: The affected housing in the reservoir area is mainly of brick-concrete structure, which makes up 62% of the total, and is mostly with 2 floors or more. For most part of the affected housing, only the ground floor will be affected and these houses can be protected with certain consolidation measures taken. Most of the housing needn't be relocated. Water and electricity supply: The current water supply for the local people comes from tap water and hand-operated pump well. Electricity is available for each household, and highway for each village. Telecommunication & TV and broadcasting: Telephone line has reached each village and most part of the households has been connected with the cable TV service network. 37 5.2.2 Principles and Requirements for Housing Relocation The overall principle is that the housing relocation shall be carried out as to promote production, facilitate livelihood, save land and ensure safety. The main requirements are the following: The new housing site shall have sound geological condition, avoiding any zone with poor geologic condition vulnerable to mud flood, landslide, bank collapse and settlement, etc. Any area with valuable underground mining resources worthwhile exploitation or having been mined below shall also be avoided. The new site shall be dose to the production development area, and the production radius shall be controlled with in 2km. It shall be near the power source with easy access to the outside and be possibly close to highway or wharf. The elevation of housing building shall be at least 2m higher than the relocatees' relocation line. Possibly few or no farmland shall be occupied. If environmental capacity permits, the housing resettlement shall possibly adopt the means of "move-back or engineering protective measures. 5.2.3 Displaced Population in Target Year As shown in the survey in 1999, the total affected population is 1165, with the growth rate of 8%e assumed, the affected population up to December 2003 is estimated to be 1205. 5.2.4 Displaced Population Arrangement In line with the guidelines and principles in planning for resettlement and with respect to the preliminary plan of production resettlement for rural relocatees, the displaced population arrangement at this stage is put forward as the folowing: The affected population in the target is 1,205, of which, 925 will be within the protection scope, 156 will be protected by taking consolidation or heightening measures for the ground floors of their houses, and 124 will be relocated to nearby area. Such people are scattered. On the basis of the opinions and the customs of the local displaced people, a scaftered on-site move-back scheme has been planned, that is to say, the people is to be resetfled by moving to the area outside the red-lined construction area. The detailed location is to be determined by discussion of the displaced household with the township, village and residents of the host area. 5.3.2 Producton Resettlement According to the computation, the population that demands production resettlement due to the Project constructon is 457. With consideration of the output levels of agricultural items in the reservoir area, the tangible material criteria for production resettlement of each displaced person engaged in farming is 0.5 mu padqy fieldplus 1 mu fish pond, which is equal to 1.5 mu paddy fieldplus 1.0 mu vegetable land for per person. Plan for production resettlement of the displaced people in dam area: As the Project is located in an area with relatively developed economy, where the development and utilization rate of land is relatively high and there is few resources of barren mountains and uncultivated land, although the construction area is to occupy some farmland, the per capita residual farmland of most villages is more than 0.5 mu. Therefore, provided measures are taken, the displaced people can be resettled in their own village by means of adjusfing some farmland and property developing plantafion and husbandfy. As the construction area is cose to an urban area, marketing of agricultural products such as vegetables will be relatively easy. It is planned that 324 mu paddy field in three townships neighbouring the construction area is to be adjusted for vegetabie plantation which can resettfe 324 people. In addition, among the paddy field occupied for construction, 200 mu can be retumed to farm which can provide production resettlement for 133 people after the completion of the construction. During the construction, the livelihood,of such people can be resolved by operating building, transportation or stores in the vicinity of the construction area. 40 5.4 Resettlement Plan for Hengshan Wharf 5.4.1 Baseline Information The Hengshan wharf is located in Jinfeng village, Chengguan Town of Hengshan County. In 1999, this village had a population of 1250 in 160 households, an annually reported farmland area of 176.41 mu, of which 46.8 mu was paddy fieldand 129.6 mu was dry land. The per capita net income of the farners was about 2000 Yuan. The main sources for the farmers' income were transportation and building. The income structure is detailed in Table 5.4-1. In 1999, these two groups had a population of 218 in 58 households, with only 8.97 mu dry land and no paddy land. The agricultural income only accounted 3.9% of the total income. Ninety percent of the farmers income came from the second and third industries. The transportation is the dominant industry. Completion of the Hengshan wharf is to be more helpful to development of this dominant industry. Therefore, although the Hengshan wharf needs to occupy 19 mu orchard, 2 mu fish pond, the construction of the Hengshan wharf will not reduce the income of the local farmer, however, it is to increase employment opportunities for the farmers. Consequently, no specific agricultural development program is planned in this design. After the completion of the Hengshan wharf, the compensatory cost for the land can be invested into the second and third industries that the local farmers are accustomed to. 41 6. SPECIAL FACILITIES REHABILITATION PLAN 6.1 Transportation Facilities The transportation facilities to be immersed by the Project make up a relatively small quantity and mainly consist of tractor roads and docks, concurrently with some railway subgrade. In accordance with the plan design for the inundation handling for the reservoir area, at this stage, the rehabilitation of the transportation facilities is as follows. 6.1.1 Railway On the basis of engineering geological survey made in the reservoir area, 16 sections of sub-grade of the Beijing-Guangzhou railway in Zhuzhou County, totaling 7.77km long, of which the subgrade side slopes of 7 sections, 3.32km long, are not supported, are to be locally immersed by the reservoir. At this stage, protection measures are considered to be taken for the subgrade side slopes of the railway. On the basis of the support type being used for the side slopes of the same railway, grouted rubble is to be used for protection of the railway subgrade side slopes, with a top elevation of the protected side slope equal to the normal storage water level of the reservoir plus 1 m. 6.1.2 Grade IV Highway On section of Grade IV highway to be immersed is located in the Sanmen Protected Farmland Area in Zhuzhou County. After the completion of the protection work of the Sanmen farmland area, it is no necessary to rehabilitate this section. In addition, the Grade IV highway at the Tangshi Cement Mill section in Zhuzhou County also serves as dike. The reservoir bank protection works is designed by cutting the slope and the highway dike is to be moved inward. The subgrade is to be counted in the reservoir bank protection works and the pavement is to be counted in the transportation rehabilitation works. On the basis of the exisfing asphalt pavement, the dike highway pavement works here is counted as I km-ong Grade IV pavement works. 6.1.3 Tractor Road The tractor roads are generally located in the protected or heightened farmiand areas. At this stage, the tractor roads are planned in combination with the farmland heightening, so no separate rehabilitation is necessary. At this stage, except for those located in the protection works area, 34 bridges on the tractor roads will be reconstructed. The details are shown in Table 6.1-1. 42 6.1.4 Docks About 108 mini-docks are to be immersed in the reservoir area, and they are to be compensated in accordance with the degrees of loss resulted from the inundation. The details are shown in Table 5.1-1. 6.2 Power and Telecommunication Facilities The reservoir is to immerse 15.5km of 1 OkV transmission lines, 1.65km of 35kV transmission lines and 6.2km of telecommunication lines. The transmission lines and the telecommunication lines to be immersed are all in Zhuzhou County, with shallow immersion, which will bring about minor impacts on the electric and telecommunication networks in the reservoir area. They are to be rehabilitated by means of on-the-spot consolidation or heightening. Farmland Protection mu 16389 372 96 1 482 17339 6.3 Water Conservancy Facilities 6.3.1 General Description After impoundment of the reservoir, some water conservancy facilities along both banks and on tributaries of the Xiangjiang River in such counties and city as Zhuzhou, Xiangtan, Hengshan, Hengdong and Uling, are to be impacted by immersion in various degrees. Such water conservancy facilities mainly involve drainage culverts/sluices, pump stabons, mini-hydropower stations and mini- turbine pump stations. The Survey Report on Immersed Tangible Material Indices of Feasibility Study Report for Zhuzhou Navigation and Hydropower Prcject on the Xiangiang River in Hunan Province indicates that 223 drainage culverts/sluices, 246 pump stations and 3 mini-hydropower stations with a total capacity of 250kW are to be immersed. 6.3.2 Impact Assessment on Existing Water Conservancy Facilities 6.3.2.1 Drainage culverts/sluices After impoundment of the reservoir, due to the raise of water level in the extemal river (the Xiangjiang River), the flow capacity of the drainage culvert/sluice is to be reduced which will increase the waterlogging loss in the drainage area. In 44 addition, before construction of the reservoir, the culverts/sluices are only temporarily immersed, however, after construction of the reservoir, the culverts/sluices are to be permnanently immersed which will make the maintenance of the culverts/sluices difficult. Meanwhile, the long-term water pressure and immersion, besides sedimentation and rusting, will accelerate the deterioration of the culverts and sluices, thus increasing the maintenance costs. 6.3.2.2 Impacts on pump station The pump stations (including mini-turbine pump station) to be immersed are mainly for irrigation, floodwater drainage and logging drainage. The impoundment of the reservoir will have impacts on the maintenance of the motor floor, the pumps and the water intakes of such pump stations in various degrees. In addition, the operation condifions of the pumps will be changed and the efficiencies decreased, and some pump stations will not be capable of carrying out normal operation. 6.3.2.3 Impacts on Other Water conservancy facilities As the existing hydropower stations and mini-diversion dams in the reservoir area are to be impacted by the normal storage level, their design water heads will be decreased or even vanish, which will result in engineering benefits decreasing, or even being out of ser.ice. 6.3.3 Design Criteria and Handling Principles In accordance with Specifications for Planning and Design of Reservoir Submergence Treatment for Hydroelectric Engineering (DUT5064-1996), The State policy framework in force, and regulations in the relevant industries, the rehabilitation plan for the water conservancy facilities is designed in principle of rehabilitating to the existing size, the existing standard, and the existing functions Handling criteria: If the culvert/sluice has an immersed depth larger than or equal to lm, it is generally to be handled as reconstruction/expansion; if it has an immersed depth less than lm, it is generally to be handled in a principle of appropriate compensation. Criteria for rehabilitation of large- and medium-sized drainage culverts/sluices: The culverts/sluices are designed with a flow capacity of a 5-year storm lasting for 24 hours. 6.3.4 Design for Handling of Water conservancy facilities Water conservancy facilities to be impacted shall be handled in the following 45 categories: 1) in case the existing facility can meet the operation requirements after renovation, it is to be newly constructed; 2) in case renovation to the exisfing facility is not possible and the facility is actually necessary to be rehabilitated, it is to be rehabilitated by new construction; 3) in case the existing facility is to lose its functions and it's not necessary to rehabilitate such functions, it will be compensated at an amount of depreciation cost. The details for handling the water conservancy facilities are as follows: 6.3.4.1 Drainage Culverts/sluices First, based on the natural normal water level of the extemal river (the Xiangjiang River), the discharge capacity of the existing culverts/sluices (free flow) was rechecked by means of flood routing, and the maximum operational water level of the inlet of the existing culverts/sluices was determined. Then, on the basis of the normal pool level 40.5m for the extemal river and the maximum operational water level of the inlet of the existing culverts/sluices or 41.0m (whichever is larger) for the intemal river, the cross section of the culverts/sluices to be added was determined by means of flood routing in considerafion of the changed storage volume of the protected farmiand areas resulted from taking engineering measures, and the renovation scheme for the culverts/sluices was determined. The details are as follows: the culverts/sluices with low bottom elevation and renovation difficulties will be newly constructed; the culverts/sluices with insufficient flow capacity and gate maintenance difficuffies will be handled by taking renovation/expansion measures which include gate renovation, adding some maintenance measures and so on; the culverts/sluices meefing simple maintenance for the gate are handled as compensation. In accordance with these principles, after deducting the culverts/sluices which are located in the scope of any protction works, it is planned that 16 culverts/sluices are to be newly constructed, 28 culverts/sluices are to be renovated/expanded, 86 culverts/sluices are to be reconstructed, and 45 culverts/sluices are to be compensated. 6.3.4.2 Pump stations As of pump stations in which only the bases are to be immersed, compensation is to be made on the basis of the relocated bases. There are 75 pump stations of this kind with a total installed capacity of 4058kW. As of the pump stations in which only maintenance of the water intakes is to be impacted, at this stage, they are to be rehabilitated by means of heightening the elevations of the water intakes. There are 9 such kind of pump stations with a total installed capacity of 1404kW. As of movable pump stations, the compensation is to be made for maintenance. 46 There are 40 such pump stations with a total installed capacity of 587kW. As of pump stabons in which the pumping room, or the motor floor is to be immersed or the pump station is not able to work under the normal operation conditions, they are to be rebuilt or displaced on the basis of the situation of the beneficiary area of such pump station. The rebuilt pump stations should make use of the existing equipment as far as possible. There are 80 such pump stations with a total installed capacity of 2898kW. As of the pump stations to be immersed in the scope of the protection works, no consideration is taken for handling. There are 39 such pump stations with a total installed capacity of 609kW. 6.3.4.3 Other Water conservancy facilities At this design stage, the three mini-hydropower stations to be immersed are to be handled as compensation, and the canals and small water diversion dams are to be rehabilitated in the farmland irrigation and drainage system projects. 7. PLANNING OF PROTECTION WORKS 7.1 Planning of Reservoir Bank Protection 7.1.1 Present Situation of Reservoir Banks In the reservoir area, several steps of terraces are developed along the Xiangjiang River and the Mishui River - one of the main tributaries of the Xiangjiang River. Terrace I and Terrace II are well developed, Terrace IlIl and Terrace IV are partially developed, Terrace V scatters only at the top of the hills along the banks. According to the investigation and statistic results, the banks of the reservoir amount to 185.4 km long, of which hilly banks account for 17 per cent of the total, and terrace banks 83 per cent. 7.1.2 Impact of Reservoir Impoundment on Reservoir Banks When the Project is completed and the reservoir is impounded, in flood season the river will be restored to natural flood flowing condition with little difference from the situation before the establishment of the reservoir. Therefore, the impact of reservoir impoundment on the banks will be mainly caused by the raise of the normal pool level (NPL). 47 7.1.2.1 Hilly reservoir banks Hilly reservoir banks consist mainly of sandy shale, slate and limestone. The bank slope normally takes a shape of convex bank beside the riverbed and has a high scour resistance, so reservoir impoundment will bring minor influence on the stability of this kind of bank slope. As a result of joint fissure cut and weathering, small landslide may occur on part of the side slope, but it will not influence the normal operation of the reservoir. Therefore, this kind of reservoir banks usually does not require protection. 7.1.2.2 Terrace reservoir banks The terrace reservoir bank slope consists mainly of loose accumulaffve formaton of the Quatemary system. serves as the forward part of Terrace I and Terrace II at an elevation of 39.Om to 46.Om and features in two-dimensional structure. In addition to the wave erosion effect on the slope, the slope is composed of loose soil only and the mechanical indices of the soil would be reduced due to the immersion throughout the year, therefore, the possibility of bank collapse will increase and may endanger the dykes and the houses of residential quarters wherever there are. As a result, protction measures should be taken for this kind of reservoir banks. 7.1.3 Design Criteria and Principles Design high water level of reservoir bank protection works: NPL 40.5 m Design low water level of reservoir bank protection works: dead level of the reservoir 38.8 m Crest elevation of slope protection: 41.5 m (design high level 40.5 m plus 1.0 m of wave run-up and a safety heightening) Base elevation of slope protection: 38.8 m in principal and to be determined according to the actual terrain 7.1.4 Design of Reservoir Bank Protection Works In accordance with GB50286-98, the Design Codes for Dykes, GB50201-94, the Standards of Flood Control, as well as the type of reservoir banks to be protected, two engineering measures are proposed for reservoir bank protection, i.e., slope- type bank protection and wall-type bank protection. 7.1.4.1 Slope-type bank protection 48 Slope-type bank protection is proposed for the reservoir banks with wide terrace and gentle side slope. The detailed procedure is: cut off or fill the existing slope at a slope ratio of 1:2, level the slope surface, then perform the slope and its base protection. The slope surface is to be laid with pre-cast concrete blocks, and the slope base be built by cement-rubble masonry. The statistics show that the reservoir banks suitable for this measure are 19.3 km long in total. For the dyke section influenced by the slope cutting, it will be widened and reinforced at the inner side besides slope protection, so as to maintain the integral stability of the dyke or fulfill the original transportation demands on the dyke. 7.1.4.2 Wall-type bank protection Wall-type bank protection is proposed for the reservoir bank that has steep slope and the dyke itself directly retains water. A means called wall-type bank protection is to be employed, that is, slope protection for the upper part of the bank and building an upward earth-retaining wall for the lower part. The detailed procedure is: regulate the slope surface, protect the slope, lay precast concrete blocks on its surface, build an earth-retaining wall on the slope base and connect it with the slope protection, then reinforce the dyke body. The earth-retaining wall will be built by cement-rubble masonry, with the base elevation to be defined by the actual terrain, stability of bank slope and scouring depth. The section without conditions for slope cutting will be treated in a way of height adjustment of the earth-retaining wall together with slope filling. The statistics show that the reservoir banks suitable for this measure are 4.94 km long in total. 7.1.4.3 Statistics on reservoir bank protection works According to the forecast of reservoir bank collapse and the importance of the object to be impacted, it is defined preliminarily that 37 sections of reservoir banks distributing mainly in Zhuzhou County require to be protected, totaling 24.24 km long, of which 28 sections totaling 19.3 km long are of slope-type bank protection, and 7 sections totaling 4.94 km long are of wall-type one. 7.1.4.4 Quantities of main works For the quantities of main reservoir bank protection works, see Table 7.1-1. 49 Table 7.1-1 Quantities of Main Works Item Unit Quantity Precast block of concrete C15 103m3 37.4 Sand-gravel cushion of 200mm thick 103m3 74.8 M7.5 cement-rubble masonry 103m3 16.6 Slope-cutting earthwork 103m3 216.0 _ _ Earth backfill 103m3 180.0 7.2 Planning of Farmland Protection 7.2.1 General Description of Inundated Farmland The total farmiand area to be inundated by the Reservoir is 20,124 mu (including 429 mu of dry land), of which there are five stretches of farmland more than 1000 mu each, totaling 13,516 mu, i.e., Sanmen Town, Longchuangang, Zhaoling, Gantian and Zhuting; eight stretches of farmiand of 200 mu to 1000 mu each, totaling 2,634 mu; and forty-six stretches of farmland less than 200 mu each, totaling 3,974 mu. According to the statistics, 95 per cent of the inundated farmland is in Zhuzhou County; the farmland above elevation 38.5 m (including 38.5 m) amounts to 17,284 mu, accounting for 83 per cent of the total. Generally speaking, the farmiand inundated is relatively concentrated and the inundation is not quite deep, so most of the farmaind might be protected so long as suitable measures are taken. 7.2.2 Design Criteria and Principles 7.2.2.1 Design criteria For flood-diversion canal (or river regulation): a 5-year (or 10-year) stormn peak flow with duration of one day For waterlogging drainage: to drain a 5-year storm with duration of three days to a crop tolerance depth in three days 7.2.2.2 Principles for farmland heightening a. After heightened, the elevation of farmland surface shall be 41.0m, that is, NPL plus immersion effect of 0.5 m high. b. Protection measures wont be taken for the farmland below El. 38.5 m, which shall be treated as inundation compensation. The farmland can be employed as soil source and as aquaculture area after earth borrowed. c. For farmland heightening, the cultivated soil in the farmland shall be 50 excavated and placed aside first and then be backfilled when the farmland is heightened to a certain elevation in order to reduce the fertility loss as far as possible. d. Farmland heightening shall be conducted together with the alignment of the tractor road (including bridge), the restoration of the irrigation and drainage canal system as well as the stream and brook regulation, and be suitable for counties or townships to delimit rationally land boundary. e. Farmland that has an inundated area of less than 200 mu but in stretches shall be treated according to the heightening option. 7.2.3 Design of Farmland Protection Works 7.2.3.1 Sanmen farmland protection works a. Protection option The Sanmen River is a primary tributary on the left bank side of the Xiangjiang River, 5 km away from the dam site. The Sanmen sluice has a catchment area of 140 km2. A farmland area of 5,973 mu under NPL is to be inundated, involving 14 villages of the town. The design is focused on the option of complete protection for the farmland inundated in Sanmen. A comparison is conducted between two altematives on the alignment of the Sanmen flood-drainage canal, which is a major engineering measure of the option. The difference of the two alternatives is the canal is to be arranged along the foot of the Sanmen dyke or along the mountain foot. The altemative of arranging the canal along the mountain foot is recommended through comparison. b. Engineering measures and arrangement Based on the geographic position and topographical condition of the farmland inundated in Sanmen area, following measures will be taken: Plug two existing drain sluices at Sanmen and Hutian which drain water directly to the Xiangjiang River; Establish Hutian drain canal at Jiapochong to discharge the water from Hutian to the Sanmen River; Build the Sanmen drain canal along the foot of Baisheng dyke which will start from the junction of Madao village, Gaofeng village and Fanjiazhou village and carry water from the Sanmen drain area to the Xiangjiang River via the left abutment of the Project; Heighten the streams and brooks and low-lying lands to an elevation of 41.0 m, which lie from the intake of Hutian drain canal to the existing Hutian sluice and from the intake of Sanmen drain canal to the existing Sanmen sluice; Build a large-sized drain sluice at the 51 outlet of Sanmen drain canal. When the works are put into effect, the original drainage function of Hutian and Sanmen will be maintained basically, but the works will connect Sanmen town into an integral one, increase the land area for township development, protect a housing area of 26,871.1 m2 from inundation in Sanmen town, bring a new development opportunity to Sanmen town, and promote significantly the economic development in the reservoir area. The implementation of the above-mentioned engineering measures will protect 5,358 mu of farmland and 26,871.1 m2 of housing area. Meanwhile, 5.82 km of flood-drainage canals at Hutian and Sanmen will be set up, 1km-long section of the Sanmen River will be regulated, a large-sized drain sluice, a Grade-IV highway bridge, 11 simple highway bridges and 8 culverts will be established, and 147 mu of famliand will be added due to stream and brook heightening. To construct the works requires acquiring 542 mu of lands and relocating a housing area of 4,530.8 m2 of 18 households. 7.2.3.2 Longchuangang farmland protection works a. Protection option The Longchuangang stream is the primary tributary on the left bank side of the Xiangjiang River, 21 km away from the dam site. The Longchuangang sluice has a catchment area of 50 km2. A farmiand area of 1,385 mu under NPL will be inundated, conceming 6 villages of 2 townships. In the design, two options of heightening and pumping drainage for the farmland inundated at Longchuangang have been compared. The heightening option is to heighten the farmland above El. 38.5 m to the design elevation, and regulate the streams and brooks and reconstruct the drain sluice meanwhile. The pumping drainage option is to build dyk.es along the streams and brooks, and drain the waterlogging and seeping water by pump stations. As a result of the comparison, the heightening option is recommended. b. Engineering measures and arrangement Based on the principle of farmland heightening, following measures will be taken: Heighten the farmland at elevations from 38.5 m to 41.0 m (exclusive of 41.0 m); Restore rationally the original roads (including bridges) as well as the drainage and irrigation canal system; Cut off and canalize the original streams and brooks along with the farmiand heightening; Reconstruct Longchuangang drainage sluice in line with the guideline of not increasing the inundation losses after reservoir establishment in order to maintain the original drainage system. Flood is to be collected by the streams and brooks regulated and then be drained to the Xiangjiang River through the Longchuangang sluice reconstructed. 52 The implementation of the above-mentioned engineering measures will protect 1290 mu of farmland, increase 255 mu of aquaculture area, regulate 2.2km long of the Longchuangang stream and 2km-long of brooks. 7.2.3.3 Farmland protection works in Zhuting region a) Scheme The Zhuting stream, a primary tributary of the Xiangjiang River, lies on the right bank of the river, about 38km away from the dam site. The Zhuting sluice has a catchment area of 389km2. Based on the NPL 40.5m scheme, the reservoir inundation will affect 2,066 mu of farmland in 4 villages of 2 townships. The design herein is conducted based on the comparison and selection between such two altematives as heightening and pump draining plus heightening. The heightening altemative is to heighten the farmland above EI.38.5m to the design elevation, to improve the streams and brooks, and to reconstruct the Zhuting sluice. The pump draining plus heightening altemative is that, considering present situation of farmland to be inundated in the Zhuting region, the large part to be inundated within the protected scope of the existing dyke is to be treated by means of pump draining in combination with streams and brooks improvement, and the remainder above El.38.5rT, is to be heightened to the design elevation, furthermore, the Zhuting stream is to be improved. Based on comparison, the pump draining plus heightening altemative is established as recommended scheme herein. b) Engineering measures and arrangement First, the streams and brooks will be realigned within the protected scope of the existing dykes. Dykes will be reconstructed and newly established along the streams and brooks adjacent to the pump draining area. Pump stations and cut- off ditches will be constructed in the protected region to drain out the seepage and water log. The existing dyke will also be consolidated. Then following the principle of farmland heightening, the remainder farmland with elevations varying from EI.38.5m to El.41.0m (exclusive of El.41.0m) will be heightened to EI.41.0m, and the existing roads (including bridges) and the canal network for irrigation and drainage will be restored adequately. In farmland region to be heightened, the bank slopes of the Zhuting stream will be protected and consolidated, the streams and brooks therein will be canalized, and the Zhuting sluice will be reconstructed, so that the existing drain system can be maintained. The flood will flow into improved streams and brooks and be drained into the Xiangjiang River through the reconstructed Zhuting sluice. 53 With the aforesaid provisions, in total, 1,634 mu of farmland will be protected, 386 mu of aquaculture area will be newly increased, 1km of drain canal will be built up, 1 water-logging pump station will be set up with an installed capacity of 100kW, 4.53km of streams and brooks will be realigned, and 1.25km of dykes will be consolidated. 7.2.3.4 Fanmland protection works in Gantian region a) Scheme The Gantian stream, a primary tributary of the Xiangjiang wiver, lies on the right bank of the river, about 19km away from the dam site. Gantian sluice has a catchment area of 117km2. Based on the NPL 40.5m scheme, the reservoir inundation will affect 1,872 mu of farmiand in 3 villages of I township. The existing dyke system of the Gantian stream is complete relatively. The farmnland to be inundated lies on the left bank mostly. The design herein is conducted for the farmland to be inundated in Gantian region based on the comparison and selection between such two altematives as heightenig and pump draining plus heightening. The heightening altemative is to heighten the farmland above EI.38.5m to the design elevation, to improve the streams and brooks, and to reconstruct the Gantian sluice. The pump draining plus heightening altemative is that the existing dyke wiR be consolidated, seepage and water log therein will be drained out by pump stations, meanwhile, partial existing farmland with fairly high elevation will be heightened. Based on comparison, the pump draining plus heightening altemative is established as recommended scheme herein. b) Engineering Measures and Arrangement A drain canal will be established around the protected farmland region on the left bank of the Gantian stream to discharge mountain floods converging into the protected region, furthermore, pump stations and cut-off ditches will be provided to drain out the seepage and water log. The existing dykes will also be consolidated as well. In addition, following the principle of famliand heightening, the existing farmland with fairly high elevation on the right bank of the Gantian stream will be heightened. With the aforesaid provisions, in total, 1,619 mu of farmland will be protected, 3km of drain canal will be built up, 1 water-logging pump station will be set up with an installed capacity of 240kW, and 2.23km of dykes will be consolidated. 7.2.3.5 Farmland protection works in Zhaoling region 54 a) Scheme The Zhaoling stream, a primary tributary of the Xiangjiang River, lies on the right bank of the river, about 12km away from the dam site. The Zhaoling sluice has a catchment area of 205km2. Based on the NPL 40.5m scheme, the reservoir inundation will affect 2,220 mu of farmland in 5 villages of 2 townships of 2 counties. As the farmland along the Zhaoling stream has been mostly protected by dykes, it has possessed a strong protection ability as whole. The design is conducted for the farmland to be inundated in Zhaoling region based on the comparison and selection between such two alternatives as heightening and pump draining plus heightening. The heightening altemative is to heighten the farmland above El.38.5m to the design elevation, to improve the streams and brooks, and to reconstruct the Zhaoling sluice. The pump draining plus heightening altemative is that the existing dykes will be consolidated, seepage and water log will be drained out by pump stations, furthermore, partial existing farmland without the protection of dykes but with fairly high elevation will be heightened. Based on comparison, pump draining plus heightening altemative is established as the recommended scheme. b) Engineering measures and arrangement For the farrnland with relatively complete existing dyke system and pump draining ability, in this design, a drain canal will be established around the protected farmland region to discharge mountain floods converging into the protected region, furthermore, pump stations and cut-off ditches will be constructed to drain out the seepage and water log, and the existing dykes will be slope protected and consolidated as well. In addition, following the principle of farmland heightening, the existing farmland without the protection of dykes but with fairly high elevation will be heightened. Wth the aforesaid provisions, in total, 2,095 mu of farmland will be protected, 300 mu of aquaculture area will be newly increased, 5.5km of drain canal will be built up, 4 water-logging pump stations will be set up with a total installed capacity of 235kW, and 4.14km of dykes will be consolidated. 7.2.3.6 Miscellaneous farmland protection works The reservoir inundation will affect 54 stretches of farmland with an area less than 1000 mu each, totaling 6,608 mu. As the farmland comprises a considerable number of stretches, of which most have comparatively small area to be inundated and are relatively concentrated, it is favorable for planning and treatment. Therefore, except that the farmland to be inundated in Huangzhu 55 region will be provided with pump draining measures, all the rest will be heightened, i.e. the farmland above El.38.5m will be heightened to El.41.0m. With the aforesaid provisions, 5,343 mu of farmland will be protected, of which the treatment for the farmland with area between 200 mu and 1000 mu is shown in Table 7.2-1. 7.2.3.7 Quantities of main items To sum up the aforesaid, in total, 17,339 mu of farmnland will be protected, and 941 mu of aquaculture area will be increased in the reservoir area. Main items and quantities of farmnland protection works are listed in Table 7.2-2. Machine Unit Shift Cost in Construction of Hydroelectric Prcjects, issued by the 57 Ministry of Water Resources and Ministry of Energy in 1991, is applied, of which the sub-total of the first class costs is multiplied by an adjusting factor of 1.7432. 8.2 Tangible Material Quantities Included in Compensation Cost Estimation for Reservoir Inundation handling 8.2.1 Displaced population The investigation performed in 1999 indicates that the reservoir inundation will affect 1,165 people, of which 894 are within the planned protected scope. Inferred from an annual population growth rate of 8%o, the affected population up to December of the target year 2003, will reach 1,205, of which 925 are within the planned protected scope. The population included in compensation cost esfimation is 280. See Table 5.2-1. 8.2.2 Housing and appurtenant facilities Housing and appurtenant facilities in the target year 2003, necessary for inclusion in cost estimation, comprise of two parts as follows: a) housing and appurtenant facilities to be inundated directly or to be affected indirectly (surveyed in 1999), deducting those within the scope of protecfion works; b) housing and appurtenant facilities increased due to the population increase from September of 1999, the baseline survey year for tangible material indices, to December of the target year 2003, of which the ones for the population increased from September of the baseline survey year 1999 to the commencement of main works in 2001 is counted based on the number of people increased multiplied by a per capita quantity of the item corresponding, and the quantifies for the population increased from the commencement in 2001 to December of the target year 2003 is counted as one-third the number of increased people multiplied by a per capita quantity of the corresponding item. In accordance with the calculafions in the foregoing principles, the total housing area included in the cost esfimation is 16,362m2. 8.2.3 Land a) Farmland. The farmland included in compensation cost esfimation is 2,785 mu, which is the area to be affected by reservoir inundation after deducting the areas covered by planned protection works. 58 b) Others. Included in accordance with quantities to be inundated. 8.2.4 Special facilities and protection works The works comprise slope protection for 3.32km of railway road bed, rehabilitation of 34 bridges capable of passing farming machines and 108 small docks in reservoir area, reconstruction or expansion of 175 culverts and sluices, 204 pump stations, and 3 mini-hydropower plants with a total installed capacity of 250kW; protection of 24.2km of reservoir banks and 17,339 mu farmland. 8.2.5 Miscellaneous items Other items are considered in accordance with the survey for tangible material indices and the tangible material quantities determined in the resettlement plan. 8.3 Unit Prices for Compensation of Main Items 8.3.1 Unit Prices for Land Compensation a) Paddy land In accordance with relafive regulations outlined in State Land Administration Law, promulgated and enforced in 1999, the land compensation cost and allowance shall be 6 and 4 times respectively of the output value of each mu of farmland for the reservoir relocatees who possess more than one mu of farmland (standard mu) per capita. The annual output value of one mu of paddy field was calculated according to reaping one rice and one vegetable in a year. The average annual yields were 495kg/mu for rice and 980kg/mu for vegetable in the 3 years from 1996 tol 998 in the reservoir townships, so the annual output value of each mu of paddy field is 1,231yuan according to the unit prices of 1.1yuan /kg for rice and 0.7yuan/kg for vegetable. The unit price for paddy field compensation shall be 12,310 yuan/mu. b) Dry land The annual output value of one mu of dry land was computed based on reaping one sweet potato and one vegetable in a year. The average annual yields were 382kg/mu (converted into rice) for sweet potato and 600kg/mu for vegetable in the 3 years from 1996 to 1998 in the reservoir townships. Therefore, according to the unit prices of 1.lyuan/kg for rice and 0.7yuan/kg for vegetable the annual output value of each mu of dry land is 840 yuan. The unit price for dry land compensation shall be 8,400 yuan/mu on the basis of that the compensation 59 criteria for dry land is 10 times of the annual output value. c) Orchards, forest land, fishpond and other land The compensation and allowance cost for orchards, forestland, fish- pond and other land shall be determined in accordance with the characteristics of the reservoir area and with the reference to the unNt price for compensaffon of the proximate projects. The unit prices for forestland compensation shall include compensation costs for forestland and woods and vegetation restoration. 8.3.2 Unit Prices for Housing Compensation Based on Budget Prices for Building Materials of Zhuzhou City (1999), special effort was made to analyze and calculate the replacement costs of two kinds of housing structures as brick-concrete and brick-wood. Through calculation, the compensation unit price is 348yuan /m2 for the brick- concrete housing and 209yuanIm2 for the brick-wood housing. The unit prices for compensation for housing with other structure are determined to be 130 yuan/M2 for earth-wood structure housing and 117 yuan/M2 for miscellaneous housing based on the comprehensive analysis and with the reference to the unit prices for the above-mentioned housing compensation and the unit prices for housings compensation of the proximity projects. 8.3.3 Special Facilities and Protection Works The price for labor force is 20.46 yuan/day. The budget prices for materials are determined according to the current market prices of the county and city. A total capacity of 675kW of waterlog pump stations will be constructed in the farmland protection areas such as Zhaoling, Gantfan, Zhutifng, etc. The investment is estimated on a basis of 2500 yuan/kW. The increased annual operation cost for drainage of waterlog in the above mentioned farmland areas is estimated to be 168.8 thousand yuan based on 10% of the construction and installation cost of the pump stabons. The annual operation cost will not be included in the total investment. For drainage culverts/sluices that only need addition of maintenance and dredging, the compensation cost shall be 1,000 yuan for each one. The compensation cost for other drainage culverts/sluices shall be calculated 60 according to the design results. For the mobile pump stations, the maintenance compensation is estimated on a basis of 40 yuan/kW. For the fixed pump stations, the compensation for displacement is estimated on a basis of 100 yuan/kW. For the pump stations with the water inlet needing additional maintenance, the maintenance compensation cost is estimated on a basis of 800 yuan/kW. For the pump stations needing to be reconstructed, the reconstruction investment is estimated on a basis of 1 500yuan/kW. The compensation cost for the 3 mini-hydropower plants to be inundated shall be based on 4,000 yuan/kW. The rehabilitation compensation for the tractor bridges shall be based on 1500 yuan/M2. The organizational costs of the administrative agency shall be estimated according to 10 staff. The running expenses of the administrative agency shall be estfmated according to 3 years. The investigation and design expenses shall be estimated according to relevant regulations. 8.3.4 Other items The compensation cost for other items shall be determined through comprehensive analysis in accordance with the actual conditions in the reservoir area and with the reference to the compensation costs for the proximate projects which are completed or under construction. 8.4 Other Expenses and Rates Costs for investigation, planning and design: 2% of the total compensation investments. Expenses for implementation management: 3% of the total compensation investment for resettlement work and 1% of the total investment for the special facilities and protection works. Technical training cost: 0.5% of the resettlement compensation cost. Supervision expense: 1.2% of the total compensation investment. 61 Physical contingency: 10% of the total compensation investment for the resettlement work and 5% of the total compensation cost for the special facilities and protection works. Price contingency: zero. 8.6 Compensation Investment for Reservoir Inundation Treatment 8.5.1 Compensation Investment for Reservoir Inundation Treatment The static compensatory investment for the reservoir inundation treatment is 271.6599 million yuan, of which, 58.672 million yuan is for resettlement work, 19.2131 million yuan for rehabilitation of the special facilities, 165.9932 million yuan for the protction works, 79.2 thousand yuan for the reservoir clearance, 15.9896 million yuan for physical contingency, and 11.7128 million yuan for other costs. The compensatory investment for the counties are as follows: 253.2398 yuan for Zhuzhou County, 7.2172 million yuan for Hengdong County, 1.1723 million yuan for Liling County, 1.9639 million yuan for Hengshan County, 8.0667 million yuan for Xiangtan County. The details are shown in Table 8.5-1. 8.5.2 Investment Plan by Years The construction of the Complex is scheduled to commence in the year of 2001, the first unit will be put into operation in December, 2003, and the whole complex will be completed in 2005. In order to meet the construction schedule of the main works, the tasks of relocatees displacement, production development, the construction of special facilities and protection works must go ahead. The details of the execution schedule are as follows: Relocatees displacement Housing protection and heightening works for 1,081 people will be completed by 2002 and 124 people will move out by October 2003. Production development: 363.8 mu of fishponds will be renovated, and 500 mu of fishponds will be newly built by 2002. 1325.2 mu of fishponds wiil be renovated by 2003. 1094.5 mu of paddy field will be adjusted by 2004. Special facilities: the railway subgrade protection works, renovation and extention of the drainage culverts and sluices and reconstruction of pump stations will be completed by 2002. Rebuilding of the drainage culverts and sluices, liffing of pump station inlets and reconstruction of the tractor bridges will be finished by the year of 2003. Protecton works: 40 % of the reservoir bank protection works within Zhuzhou 62 County will be completed and the construction of Sanmen farmiand protection works will be commenced by the year of 2001. An other 40 % of the reservoir bank protection works within Zhuzhou County will be completed, the construction of Zhaoling and Gantian farmland protection works will be started in 2002. The reservoir banks protection works within other counties and the left part of reservoir bank protection works within Zhuzhou County will be completed in 2003. The Sanmen farmland protection works will be finished, the construction of Longchuangang and Zhuting farmland protection works and small farmland protection works will be started by the year of 2003. All farmland protection works will be fulfilled by 2004. Reservoir clearance: it will be completed before the end of October 2003. The rest of works will be finished by 2005. Sixty percent (60%) of the unit price for compensatory of the permanent occupied land (namely 6155 yuan/mu) has been adopted for the temporarily occupied land which will be returned to paddy fields after the completion of the project construction. The land acquisition compensation for Kongzhou Islet is 10 million yuan for the present. 8.6.3 Dam Area Resettlement Compensatory Investment It is calculated that the total compensatory investment for dam area resettlement is 30.6852 million Yuan. Their agricultural income mainly comes from citrus and the 19 mu citrus orchard to be occupied is in full fruitful period with high quality at the present. Hence a compensatory standard for the paddy field in the reservoir area (namely 8617Yuan/miL) has been adopted as the compensatory unit price for the citrus orchard. Compensatory unit price standards for the reservoir area have been adopted as the compensatory unit price standards for other items. 8.7.3 Compensatory Investment for Land Acquisition for Hengshan Wharf 71 It is calculated that the total compensatory investment for land acquisition for Hengshan wharf is 2,068,700 yuan, and for the details see Table 8.7-1. RESETTLEMENT AUTHORITIES AND THEIR RESPONSIBILITIES 9.1 Xiangjiang Corporation The Xiangjiang Corporation has set up a Resettlement Department with the staff number of 3 at present. The main responsibilities of Xiangjiang Corporation are as follows: a) Go through formalities for land acquisition. The Xiangjiang Corporation shall, together with concemed cities and counties, carry out in-situ laying-out and demarcate the land scope according to the approved land acquisition scope. b) The Xiangjiang corporation shall, on behalf of the unit undertaking the Project, draw up an agreement on land acquisition and resettlement with the local govemment through consultation, undertake the agreement, and check the implementation of the agreement c) Examine and approve the annual resettlement implementation plan and annual fund utilization plan, raise money for the resettlement work, allocate fund to the resettlement offices of the cities and counties timely and supervise the utilization of the resettlement fund. d) Entrust the design institute to carry out the resettlement planning work and any related design work. e) Entrust qualified units to carry out the resettlement supervision or resettlement monitoring and evaluation. f) According to the requirements of the procedure for capital construction project, once the altemative of the resettlement plan is changed to a great extent and the resettlement compensatory investment is needed to be adjusted, the Xiangjiang Corporation shall organize related units to work out a special topic report which will be submitted to the same approving authority for approval without delay. g) Participate in the bidding for the important resettlement projects. h) Participate in the check and acceptance for the resettlement work; provide help to the concemed departments in the auditing for the resettlement fund utilization. i) Keep the copies of the land property documents of the project and the wharf. 73 9.2 Hunan Provincial ReseKtlement Development Bureau (HPRDB) Hunan Provincial Resettlement Development Bureau (HPRDB) is the administrative authority under the Hunan Provincial Govemment. Its main responsibilities in the resettlement for the Project are as follows: a) working out the administrative framework for resettlement implementation and the management methods of the resettlement fund in accordance with the relevant laws and regulations of China and Hunan Province as well as the local situation of the Project-impacted area; b) raising the proposal for the setup and main executives of the municipal and county resettlement authorites, and training cadres for the resetUement, c) directing, inspecting, supervising and coordinating the resettlement work; d) submitting to the Owner the summarized yearly resettlement fund using program, breaking down the resettlement investment in accordance with the approved yearly resettlement fund using program, inspecting the use of resettlement fund, and taking part in the audit of the resettlement fund as well; e) hosting, together with the relevant departments, the bidding work of any important or major resettlement item; f hosting or taking part in review of the resettlement planning and design of major resettlement works, and taking part in the completion acoeptance of any resettlement works; g) handling, on behalf of the provincial govemment, properly and timely any problem and contradiction appearing in the resettlement implementation work to maintain the social stability in the reservoir area; h) performing other duties stipulated by laws and regulations. 9.3 Zhuzhou city and Hengyang city In order to meet the requirements of the resettlement work for the Dayuandu Project, the Resettlement Development Bureau was set up in Hengyang City 6 staff at the present. Resettlement developing authority has not been set up yet in Zhuzhou City. After the approval and commencement of the project, a corresponding resettlement authority will be set up with a certain number of staff in Zhuzhou City and the resettlement organization in Hengyang City will also be 74 strengthened. The main responsibilities of the resettlement authorities at municipal level are to provide directions, coordination, supervision and examination for the relocation and resettlement in Hengshan and Hengdong counties. 9.4 Zhuzhou, Xiangtan, Liling, Hengdong and Hengshan Counties. In order to meet the requirements of Dayuandu resettlement activities, resettlement organizations have been set up in Hengdong county and Hengshan county and 4 staff are provided for each. The resettlement authorities has not set up yet in Zhuzhou county, Xiangtan county and Liling county. After the Project is approved and commenced, the resettlement authorities will be set up in these three counties (city) and an appropriate number of staff will be provided in accordance with the actual conditions of the resettlement work.The staff of the resettlement organization in Hengdong and Hengshan counties will also be strengthened with a certain number of staff to meet the requirements of the resettlement activities. The county resettlement authority will be responsible for the implementation of the resettlement plan under the leadership of the higher-level resettlement authority and the govemment of the county. And the main responsibilities of the county resettlement authority are as follows: a) Carry out the State resettlement policies conscientiously and do well resettlement work within the administrative area according to laws and regulations. b) Represent the county govemment to sign agreements on resettlement work and investment lump sum contracting with Xiangjiang Corporation. c) Be responsible for working out the county resettlement planning and resettlement implementation plan together with the design institute. d) Be responsible for drawing up the annual resettlement implementation plan and the annual fund utilization plan of the county. e) Be responsible for finishing the task of the resettlement implementation according to the approved annual resettlement implementation plan. f) Be responsible for distribution, management, cashing in and setting accounts of the resettlement fund for the local county. g) Be in charge of the Bidding work for the important resettlement projects together with relevant department. 75 h) Do well the management work for the resettlement project within project administrative power extent. i) Carry out strict financial management, manage and utilize the resettlement fund appropriately, which will subject to checking and auditing from relevant authority. j) Provide help to receive resettlement supervision and monitoring assessment. k) Be responsible for publicizing the state's general and specific resettlemnent polices, and resolve the problems and contradictories occurred in the resettlement acfivities so as to keep the reservoir area in a stable social environment i) Be responsible for check and acceptance for the county resettlement project, drawing up and submitting acceptance report. m) Provide help for Xiangjiang Corporaffon in going through formalifies of the land acquisition. n) Finish other work assigned by the higher-level resettlement authority. 9.5 Townships and Town Concemed After the commencement of the Project, in township which have heavy resetflement work to be done, a resettlement office will be set up and staffed with some full-time resetflement working staff members. The township resettement authority is a kind of executive body being responsible for resettlement work and Ws main responsibilities are to organize and carry out the land acquisiftion, relocation and resettlement in the township according to the contract of land acquisition and resettlement as well as relevant laws. 10. RELOCATEES' PARTICIPATION AND CONSULTATION 10.1 Project Information Disclosure Disclosure of project information is an important step to ensure public participation in resettlement planning and implementation. Project information as 76 well as resettlement information should be provided to the relocatees and local people at all phases of resettlement planning and implementation so that their feedback could be incorporated in the resettlement planning and design. Methods to disseminate the information include TV and broadcast, newspapers and periodicals, public posters, special columns, relocatee meetings and villager meetings, as well as resettlement information booklets distributed to every relocatee household etc. Once the RAP is approved by the State and the World Bank, the full RAP should be placed in the resettlement office of each township accessible to the relocatees. At all phases of the project preparation and implementation, the project information and resettlement information disclosed so far or to be disclosed to the relocatees and local people are given in Table 10.1-1. Consultation with the relocatees and the lotzal people must be carried out and their concems and suggestions must be fully taken into consideration in the project preparation and implementation process. The contents of public participation and consultation at each stage are listed below. 77 a) Listening to the public opinions on project scale, construction site, normal pool level scheme, etc.; b) Participation of relocatees in socioeconomic survey and inventory of affected assets; c) Participation of relocatees in formulafing the RAP; Consultation with the relocatees on house relocation, site for productive development, land reallocation means, project for producfive development scheme for infrastructure rehabilitation, etc.; d) Listening to the relocatees' opinion on compensation rates; e) Consultation with relocatees on the utilization program on public property compensation; f) Consultation with relocatees on relocation schedule; g) Other issues related to relocatees' interests. 10.3 Arrangement of Public Participation and Consultation In Resettlement Work The major methods for public participation and consultation are: regularly or irregularly consultative conference of relocatees or relocatees' representatives; participation of relocatees' representafives in the survey team and planning team; relocatees' involvement in the complete process of private property survey and signing off of survey findings; distribution of questionnaire to relocatees; and interview of the vulnerable households. In the project preparation and implementation process, the acfivities for public participation and consultation arranged already or to be arranged are as follows: Before the inventory of affected assets, meetings of local leaders and relocatees' representatives were held to consult on the scope, methodology, standards and organization for the inventory. During the process of inventory, the township, village and villager group concemed were all involved in the survey work, particularly for the private property such as the house, all the household heads took part in the survey and signed the survey registers. As far as the property owned by the collective like the land is concemed, the village chief, village committee secretary, director of women's federation, the villager group chief and the reputed representafive of local people were involved in the survey work. After count-up and collection of affected assets, group discussions participated by the local leaders and relocatees' representatives were held. The inventory of affected assets has been approved by the county govemment The resettlement plan at this stage was prepared by asking the opinions of the leaders at levels of county, township and village as well as the village secretaries, directors of women's federation and relocatees. 78 The plan for resettlement implementation after the commencement of the project will be jointly prepared by MSDI and the county govemment with participation of the local leaders at levels of township, village and villager group concemed, meanwhile, the opinions of relocatees will also be taken into account by listening to their opinions through group discussions and distribution of questionnaire. During the implementation of resettlement work, the compensation items, standards, quantities and investment will be posted for public attention by the resettlement authority, and an individual compensation handbook will be prepared and distributed to the relocatees to receive their monitoring. Moreover, various means will be employed to discuss and consult with relocatees for their concems. 10.4 Impacts of Resettlement on the Host Communities Displaced persons caused by the Project will be all moved back to resettle at the higher elevation place in their original village, without any moving-out resettler. Therefore, there is no problem of the impact of resettlers moving on the host community. 11 PAPS' RIGHTS AND GRIEVANCE MECHANISM 11.1 PAPs' Rights In addition to the rights and duties given by the current Constitutions and Laws of the P.R.C., the displaced person shall also enjoy the rights as follows: a) to gain the rational compensation for the impacted assets of which the PAP is entitled to any interest; b) to be well resettled in respects of production, livelihood etc.; c) to get the information on resettlement; d) to take part in the consultation on resettlement; e) to appeal grievance; f) other rights given to the PAPs by resettlement laws and regulations. 79 11.2 Channels for PAP's Grievance Redress As the resettlement work involves many respects and is crucial to the close interests of the PAPs. Unavoidably, the PAPs will have some complaints for the resettement and compensation. In order to ensure that the problems complained by the PAPs can be resolved impartially and reasonably, it is necessary to establish simple, open and impartial grievance channels and grievance procedures to safeguard the legal interests of the PAPs against infringement. In case that any legal interest of any PAP is infringed, the PAP shall be entitled to appeal and take legal proceeding until he gains the interest he is entitled to. The PAPs' complaints can be divided into such types as psychology and social culture, body and mind as well as economy. The major channels for the displaced person to make complaints are as follows: a) The villager group and village committee; b) Resettlement authorities at all levels; c) Govemment departments to receive letters and visitors at levels of township, county, municipality and province where the resettlement is occurred; d) Representatives of the People's Congress, representatives of the People's Political Consultative Conference (CPPCC), the Women's Federation and the press at all levels; e) At levels of county, municipality, province and State, Departments of Administration Supervision, Auditing, Discipline Inspection, Judicature and Prosecution all take up cases regarding violating law and breaking the discipline in resettlement. 11.3 Grievance Procedures The Water Law of P.R.C, the ResetUlement Regulations and other relative laws and regulations have stipulated that 'Where the resettlement is needed due to requirement of construction of the water resources and hydropower projects, the local govemment is responsible for arranging the local displaced persons' livelihoods and production. The cost incurred in the resettlement shall be added to the investment plan for the project construction". The Project is one of the key navigation projects in Hunan Province, therefore the resettlement of the Project shall be under the responsibility of the local govemment. When the displaced person lodges an appeal to protect his lawful rights and interests, which is related to the local govemment and departments concemed, the Administrative so Litigation Law of P.R.C. should be followed. If the resettler refuses to accept the administration reconsideration, he can take administration action to court according to the Administration Litigation Law of PR.C. The procedures are as follows: a) If any PAP has any disaffection on the resettlement and rehabilitation plan, or thinks that any resettlement decision made by any administrative authority and any of its agencies infringes any of his interests, he may raise an oral or writen grievance to the village committee or the town/township resettlement office within 60 days. In case of an oral grievance, the grievance receiving institution shall record on the spot the general information of the declarant, the main grievance facts, the reasons and the time as well the problems required for resolution. The village committee or the town/township resettlement office must make his reply whether he accepts or does not accept the case within 5 days. For the grievance in his acceptance scope, he shall make the directive within 15 days, and for the grievance out of his acceptance scope, he shall transfer the grievance to the relevant administrative authority within 7 days after he receives the grievance and notify the declarant. b) In case that the PAP is discontented with the directive of the village committee or the town/township resettlement office, he may appeal to the County Resettlement Office within 30 days after he receives the directive, and the County Resettlement Office must make his directive within 30 days. c) In case that the PAP is discontented with the directive of the county reseKtlement office, he may appeal to the Municipal Resettlement Development Bureau within 30 days after he receives the directive, and the Municipal Resettlement Development Bureau must make his directive within 60 days. d) In case that the PAP is discontented with the directive made by the municipal resettlement bureau, he may appeal to the Provincial Resettlement Bureau within 30 days after he receives the directive, and the Provincial ReseKtlement Development Bureau must make his directive within 60 days. e) In case that the PAP is still discontented with the directive made by the Provincial Resettlement Development Bureau, he may institute a proceeding to the court within 15 days after he receives the directive. 11.4 Assistance to Vulnerable Families 81 The vulnerable families among the project-impacted-population comprise the families of a lonely old person, the families of orphan(s), the families consisting of any disabled person(s), single-female-parent families, families lacking of labour force and other families needing assistance. Besides all the interest as stipulated in Safeguard Law on Interests of Disabled Persons of PR.China, Safeguard Law on Interests of Women of PR.China, Safeguard Law on Interests of Elderly Persons of PR.China, Protection Law on Interests of Minors of P.R.China, during the resettlement the vulnerable groups among the project-impacted population will also enjoy the following assistance as: a) prionty to select the position of houseplot; b) priority to select the position of the reallocated farmland or any other business place; c) subsidy for difficuflties, given by the village and/or villager group, during the housing relocation; d) labor assistance provided by the village and/or villager group, during the housing relocation; e) facilifies for taking part in the negotiation for resettlement, such as regular interview to vulnerable families etc. f) free legal assistance in case of any infringement of their interests; g) other services and assistance necessary for the vulnerable groups. 12. RESETTLEMENT MONITORING AND EVALUATION 12.1 Purpose of Resettlement Monitoring and Evaluation Based on the performance and findings of the resettiement management agencies, the resettlement monitoring and evaluation is to be carried out during and after the process of resettlers' relocaton and resettlement, by means of intensive collection, analysis, collation and utilization of data and information related to resettlers' property, financial status, equity and resettlement implementation progress, aimed to reflect, in a realistic manner, the actual situation of the resettlers before and after the resettement, to assess whether the resettlement has achieved the anticipated target, whether the resettlers are satisfied with the resettlement, and in particular, whether the livelihood and living 82 standard of the resettlers has been recovered or upgraded, to evaluate the efficiency, effect, impact and stability of resettlement arrangement, to sort out experiences and lessons leamt during the process of resettlement, to provide regularly or irregularly to the World Bank, the Client and any related departments with suggestions and mitigative measures for solution of any existing problems, and to obtain good experience and guidance for future undertaking of resettlement arrangement. 12.2 Work Bases of Resettlement Monitoring and Evaluation Policy and Legal Framework for Resettement of Hunan Province and the People's Republic of China; Guideline for Involuntary Resettlement of the World Bank (OD4.30); Guideline for Resettlement Monitoring and Evaluation of the World Bank (OD10.70); Resettlement Action Plan; Monitoring and Evaluation Work Outlines to be approved by the World Bank and the Client; Comments and Suggestions Proposed by the World Bank and the Client for Resettlement Monitoring and Evaluation. 12.3 Contents of Monitoring and Evaluation The items and contents of monitoring and evaluation include: a) adaptability and implementation performance of the resettlement arrangement plan; b) public participation; c) use of compensation investment for improvement of resettlers' living and production level; d) land improvement for agricultural resettlers, and construction of infrastructures in the villages; e) means of resettlement, production (operation), the progress, th4p income sources, as well as the living level recovery ability and extend, of the resettlers being engaged in agricultural activity, working in factories and 83 finding their own means of livelihood; f) survey and estimate of resettlers' annual living expenses and corresponding bearing capacity; g) sources for cost of living, and the availability of special insurance informatbon and fund for the old and retired resettlers; h) adaptability to infrastructures and various service facilities in the host area; i) setup and staffing of resetfeement management agencies and the corresponding service procedures and methodologies; j) adaptability of the resettlers' grievance redress procedures; k) means and accuracy for information reaching the resettlers; I) rehabilitation of the woman resettlers, the changes in their incomes and social environment; m) public health; n) allocafton and use of the resettlement compensation fund; o) evaluation of resettlement arrangement in association with the World Bank p) other items recommended by the World Bank and the Client for monitoring and evaluation. 12.4 Methods of Monitoring and Evaluation The monitoring and evaluation is to be carried out with combination of data collection, investigation and interview, overall investigation and layer-by-layer survey, resettlement expert effort and local resettlement cadres! cooperation, and with consideration of mathematical statistics and comparative analysis. 12.4.1 Overall investigation The overall investigation is to be proceeded by means of data collection from departments concemed or through in-situ visit to get to know the overall circumstances of resettlement arrangement, with the major contents for investigation listed as below: a) collecton of data from resettlement implementation agencies and other 84 related institutions for resettlers' livelihood, living environment and level, infrastructures as well as information about service facilities such as culture, education, public health and commerce before the resettlement; b) collection of resettlement arrangement planning report, drawings, and information about allocation and use of resettlement compensation fund, from the Client or the resettlement implementation agencies; c) collection of data from resettlement implementation agencies for information about the construction schedule and quality of, and the amount and timing of resettlement compensation fund used by public facilities of water conservancy, power, traffic and postal telecommunication as well as service facilities of culture, educabon, public health and commerce in the host area; d) collection of data from resettlement implementation agencies and other related institutions for basic information about resettlers' population, housing, quantity and quality of land resources, fruit trees and cash crops, major side-product production, economic income, etc.; e) collection of data from resettlement implementation agencies and other related institutions for informabion about non-resettlers' livelihood, living level and environment, infrastructures as well as service facilities of culture, education, public health and commerce in the host area before and after the resettlement; f) collection of other supplementary information The collected information shall be analyzed and collated. In case of errors or mistakes, they will be fed back timely to the parties concemed or corrected in the site. 12.4.2 Typical sample survey In terms of resettlement arrangement means, there are four layers of resettlers, i.e. (a) the resettlers being engaged in agricuftural activities; (b) the resettlers working in factories; (c) the resettlers finding their own means of livelihood; (d) the old and retired resettlers staying at home. In typical sample survey, the technology of sample survey layer-by-layer will be adopted, and with the consideration of the difference in education level, the distribution of children under 16, as well as the small amount of total resettlers, about 15%-30% resettlers will be randomly taken out respectively from the four different layers as samples for fix-point trace survey. The contents of survey shall include the basic situation of the sample resettlers before and after the relocation, the extent of recovery or improvement of production and living. The major items of survey 85 include: family member and structure, living environment and housing, land resources and production (working) condition, living level, woman's role, the social security for the old and retired, the resettlers' education, culture, public health, and children's health in particular. 12.4.3 Analysis and evaluation Based on mathematical statistics of the infomation obtained in overall investigation and typical sample survey, the method of comparative analysis will be adopted to assess the living, production, income level, social network, women's role, public health of the resettlers before and after the relocation, to evaluate the construction of infrastructures and service facilities, to analyze and sort out the experiences in success and the lessons in failure, the defects and existing problems in resettlement, to provide feasible measures and reasonable suggestions to the World Bank, the Client and the resettlement implementation agencies for future improvement. 12.5 Independent Monitoring and Evaluation Unit The Xiangjiang Corporation has tentatively selected the Navigation Engineering Investigation and Design Insfitute No.2 of the Ministry of Communications as the independent resetUement monitoring and evaluation unit for the Project. After the preliminary review on the qualifications, experiences and competence of the independent monitoring and evaluation unit and personnel is carried out and approved by the World Bank, the independent monitoring and evaluation unit vill prepare the resettlement monitoring and evaluation program, detailing the monitoring and evaluation schedule. 13. TRAINING After the reservoir filling, some land resources, especially farmland, will be inundated, the rural industrial structure will be considerably adjusted, and tremendous changes will take place in the employment channels of resetUers. Some resettUers will not engage in the accustomed farm production, and will engage in other trades, such as gardening, aquaculture, second and trtiary industries, which are not familiar to them and need high technology. The resetUers' cultural quality and production skills can hardly meet the requirements of new industries. In order to ensure the successful implementation of resettlement plan, technical training must be provided for the resettlers. Meanwhile, the resettlement activities have characteristics of strong policy, scientific and social nature, scientific and correct organization and leading is one of the key factors which decide the success or failure of the resetflement work. 86 For most of the resettlement cadres, resettlement work is a complete new work, therefore the resettlement cadres must be trained. The target of training includes resettlement cadres and affected population. The contents of training include policy and legal framework for resetLement of China, Hunan Province and the World Bank, the professional knowledge about resettlement plan preparation, implementation and management as well as use of funds, training for production technique and skills, grievance procedures as well as methods and measures of handling contradictions. The ways of training include holding short- and medium-term off-the-job training, establishing resettlers' night school to give lectures on production technique, and selecting resettlement cadres, resettlers and their children to study in universities, colleges and special schools, etc. An investment of 390,200 yuan, accounting for 0.5% of the compensatory investment for rural displaced persons, is provided for the technical training of the resettlers, of which293,300 yuan is for displaced people in the reServoir area, 88,100 yuan is for displaced people in the dam construction area, and 8,800 yuan for those in the Hengshan Wharf. The content of the training course and the number of the trainees shall be planned in the resettlement implementation plan. The training shall be arranged by the resettlement agencies in the related counties, which includes selection of trainees and the training unit as well as the training way. 14. Preferential policies The major preferential policies mentioned in the Resettlement Regulations and other relative laws and regulations are as follows: a) Establish Reservoir Area Construction Funds. The Clause 17 in the Resettlement Regulations stipulates that: Reservoir Area Construction Funds shall be established to maintain and support the production development of the displaced persons in the reservoir area of Large- and Medium-Scale Water Resources and Hydropower Projects. The method of withdrawal, management and use of the new Reservoir Area Construction Funds shall be jointly decided by the Ministry of Water Resources, Ministry of Finance and the formner Ministry of Energy. b) Preferential conditions shall be provided for the resettlers' using electridity to make production. The Clause 18 in the Resettlement Regulations stipulates that: after completion of construction of the hydropower project, the state departments concemed should ensure that the displaced persons have enough electricity which has been checked to use in their livelihood and production. The resettlers shall pay for the amount they have used. 87 Preferential prices shall be applied to the checked electricity used for high lift pumping irrigation and drainage for the polders. The water surface area and drawdown area formed after the completion of the project should be tapped and utilized under the unified management of the project management unit. Priority should be given to the displaced persons to tap and utilize the above-menfioned water areas and drawdown areas with the precondition of following unified reservoir operation plan and guaranteeing the safety of the project. c) Certain considerations shall be given to the resettlement area when the State plans the construction funds. The Clause 19 of the Resettlement Regulations stipulates that when the State makes budget plan for supporting agriculture, poverty relieving, transportation, culture, education and public health, certain considerations should be given to the resettlement area to support the resettlers' livelihoods and production development. Any production and construction project arranged by the govemment in the resettlement areas or benefited areas of the Project should be designed with combination of the resettlement d) Support should be given to the resettlers in their later resettlement stage for five to ten years. The Clause 19 of the Resettlement Regulations stipulates that the time period for the state to support the displaced persons shall last five to ten years, which will start from the date of completion of the resettlement implementation plan. For those who are resettled in batches and in stages, the above-mentioned date shall start from the date of completion of each batch resettlement The Hunan provincial document No.37 of Circular on Establishment of the Later Stage Support Funds for the ResetUlers in the Reservoir Areas of the Hydropower Prcjects and Reservoir Prcject? issued in 1996 stipulates that the collection rate for the later stage support funds for the reservoir area is 0.005 yuan/kW.h, which shall last for ten years. 88
