Appendix .................................................. 72 I 'Preface As one section of the national highway artery between Tongjiang in Heilongjiang Province and Sanya in Hainan Province approved by the State Council, Zhangzhou-Zhao'an Expressway, located in Fujian Province, is not only one of the key highway construction projects planned by the Ministry of Communications of China but one of the key highway construction projects of Fujian Provice in the Ninth- Five years. Baishui Large Bridge in Longhai City is under the Zhangzhou-Zhao'an expressway project. It is planned to be open to traffic in 2001. Baishui Large Bridge in Longhai City Passes through 2 towns,Its completion will no doubt play a great role in promoting the socio- economic development, accelerating the circulation of goods and materials and expanding the exchanges between different areas in Longhai City and even Zhangzhou City. This RAP is prepared according to the Land Administration Law of the People's Republic of China, local laws and regulations of Fujian Province and China Highway Project Resettlement Model Plan (draft) of the WB. This RAP is a carefully prepared detailed plan, which aims to appropriately resettle those affected by the project and have them benefit from the project, improving or at least maintaining their living standards as before the project construction. During the data collection and preparation of the RAP, we get much help from Fujian Provincial Traffic Planning and Design Institute the traffic bureaus and land administration bureaus of Longhai City and resettlement offices of the two towns in Longhai City.Please let us to express our sincere thanks to them. Objectives of the RAP and the Definition of Resettlement Terminology. This Resettlement Action Plan (RAP) is prepared according to the Laws and Regulations of PRC, and Fujian Province as well as the Guidelines of the World Bank (Operational Directive for Involuntary Resettlement OD 4.30). The purpose of this document is to set out an Action plan for the Resettlement and Rehabilitation of the Project Affected Peisons (PAPs) to ensure that they will benefit from the project and their standards of living will improve or at least be restored after the project impact. Acquisition of land and other assets for the project will adversely affect the livelihood of persons who live, work or earn their living on the land that will be acquired for the project. PAPs are defined as those persons whose income or livelihoods will be adversely affected by land acquisition for the project. PAPs include the following categories: a)persons who have a title, right, interest, in structures (houses, enterprises, shelters, or public buildings), land (including residential, agricultural, and grazing land) or any other asset acquired or possessed, in full or in part, permanently or temporarily; b)persons who use the structures, land or assets described above; or persons whose business, occupation, work, place of residence or habitat adversely affected; or c)persons-whose standard of living is adversely affected as a consequence of land acquisition. A definition of PAPs is given below: Definition of the PAPs: "Affected Persons" means persons who on account of the execution of the project had or would have their: a) standard of living adversely affected; or b) right, title or interest in any house, land (including premises, agricultural and grazing land) or any other fixed or movable asset acquired or possessed, temporarily or permanently; or c) business, occupation. work or place of residence or habitat adversely affected, and "affected Person," means individually all those who qualify as "Affected persons." PAPs may be individuals or legal persons such as a company, a public institution. Definition of PAPs is not limited to their legal registration or permission to live or conduct business in the affected location, or their title to property Thus, it includes: a)all those affected by the project regardless of their legal rights or absence therecf.et the assetFl being taken; and b) persons without residential permit to live in a certain area. Therefore, all such persons who are affected will need to considered and recorded as PAPs, regardless of their legal connection to assets land or location. If there are more than one person, family or household using or holding a title to the same land or property that is acquired. they uill be compensated and rehabilitated according to the loss they suffer, their rights, and the impact on their living standards. The definition of PAPs is linked directly to the adverse effect of the project, regardless of legal rights title or interest. All PAPs are entitled to the improvement or at least restoration of their standards of living, and compensation for the material losses they suffer. Compensation for assets will cover replacement cost. No deductions or discounts will be applied to the compensation amount for depreciation or other reasons. All PAPs deriving an economic benefit from the affected land and property are entitled to receive rehabilitation benefits in addition to the compensation for their assets lost. Those PAPs without title, authorization or legal permission to reside, conduct business, cultivate land or construct structures are eligible for rehabilitation of their livelihoods and compensation for their assets on an equal footing with those with forrnal legal title, authorization or permissions to the assets. The term RESETTLEMENT includes: a) the relocation of living quarters; b) finding acceptable new employment for those whose jobs are affected; c) restoration (or compensation) of affected productive resources such as land, work- places, trees and infrastructure; d) restoration of other adverse effect on PAPs' living standards (quality of life) through land acquisition (such as the adverse effects of pollution); e) restoration of or compensation for affected private and public enterprises; and f) restoration of adversely affected on cultural or common property. Rehabilitation means: the restoration of the PAPs' resource capacity to continue with productive activities or lifestyles at a level higher or at least equal to that before the project. The objective of this RAP is to provide a plan for the resettlement and rehabilitation of the PAPs so that their losses will be compensated and their standards of living will be improved or at least restored to the pre-project levels. To achieve these objectives the plan provides for rehabilitation measures so that the income earning potential of individuals are restored to sustain their livelihoods. Affected productive resources of businesses (enterprises including shops) and public property. Infrastructure and cultural property will also be improved or at least restored to their pre-project levels. General description of the Baishui Large Bridge in Longhai City The project is under Zhangzhou-Zhao'an expressway project, The construction of Baishui Large Bridge will further perfect the regional highway network and promote development of regional economv, It plays an important role in development of national economy. The project is planned to commence in October 1999 and be finished in September 2001. The starting mark of the Baishui Large Bridge is in the south of Baishui Town, about 500 meters up Baishui secondary school,200 meters below.Xinxu Extra Large Bridge on the proposed ZhangZhao Expressway. The starting-point of bridge approach links with Nanxi Line 6K+800, and the terminal point links with Houxin Line 5K+920. The total length of the bridge and bridge approach is 1,800 meters, the length of the bridge 487 meters, and the -length of bridge approach 1,313 meters. The width of bridge surface is 12 meters.The highway engineering and technical standard is based on the standard of the ordinary Class-2 road in plain and rolling terrain.The width of subgrade of link road is same as that of the bridge, and the width of road pavement is 9 meters.Design speed is 80 km/h.The main engineering quantity shows on Table 1-1. The impact and benefited areas of this project ZhangZhao Expressway of Fujian Province passes through Dongyuan Town and Baishui Town in Longhai City. Meanwhile an interchange is built in Dongyuan Town. The construction of Baishui Large Bridge will enable vehicles of neighboring area to drive into the expressway through the interchange, which makes things convenient for people of Dongyuan Town and Baishui Town and brings about a great advance in national economy. With the construction of Baishui Large Bridge, vehicles need not either detour Huxi Town of Zhangpu County into the expressway by the interchange or pass Fugong and No. 13-210 Provincial Highway into the expressway through Dongyuan -2- interchange. It greatly shortens the distance. Dongyuan Town and Baishui Town are the direct influence region of the project.Besides Dongyuan Town and Baishui Town, it also plays a direct or indirect role in the economic development of the neighboring towns including Dongsi Town, Fugong Town, Gangwei Town and other towns. The construction of this project will further perfect the regional highway network and improve the traffic conditions there, meanwhile it'll take up traffic and transportation in blossom. It also facilitates the development of the industrial and agricultural production and of township enterprises as well as the people's life. There is no doubt that construction of Baishui Large Bridge will change the present unfavorable condition of communications. It will connect towns on both sides of Nanxi river and provincial, county, town highways in the neighborhood. In this way, the convenient communications will promote development of national economic and foreign trade, so this project acts an important role. 3. The social economic condition of the influence region of the project Longhai City lies in the east of Zhangzhou City, or the lower reached of Jiulong River. The city consists of fourteen towns and two villages with the area of 1,238 square kilometers and population of 765,600 at the end of 1997. Longhai City is located in the sunken area of Jiulong River, high in the south and the north, low in the middle. The middle part lies in the east of Zhangzhou Plain and Jiulong River Delta.Longhai and Xiamen form a curling coast. Thus, Jiulong River becomes the shore of the delta at the mouth of the river. The percentage of forest cover in the city amounts to 31.3 percent.Longhai Mangrove Natural Preservation Zone has a timberland of over 3,000 Mu, which is situated at the shore of Jiaomei Town, Zini Town, Fugong Town and Gangwei Town.Theoretically,the potential waterpower reaches 35,900 kilowatts. Main mineral resources are granite, freshwater grit, brisk earth,sedimentary carbon,hot spring and so on. The coast-line is 103.3 kilometers in Longhai City, and the aquicultural area is 79,800 Mu. Great achievements have been made in national economy and social progress in Longhai City during the"Eighth-Five-Year". GNP amounted to 3,172 billion yuan in 1995,which was 2.56 times of 1980. And the annual growth rate was 21.5 percent in this period.This was a period when economy developed in the fastest pace since the founding of China.Per capita GNP was 3690 yuan,which was 1.54 times of 1990, or 2.26 times of 1980. The ratio of structure of three productions in 1990 was 47.1:23.3:29.7, which was readjusted to 27: 46:27 in 1995. GNP reached 4,838 billion yuan, which was 52.52 percent increase of 1995; per capita GNP was 6,319 yuan, which was 71.25 percent increase of 1995. The proposed bridge is located in Baishui Town of Longhai City, with an area of 80.4 square kilometers and the population of 45,000 at the end of 1997.Baishui Town is rich in mineral resources,fruits orchards,forests and tourism.It has a promising future for economic development. It is also known as an agricultural town of high production and good quality. GNP of Baishui Town amounted to 0.213 billion yuan in 1997, which was 37 percent increase of 1996. The total output value of industry and agriculture reached 0.46 billion yuan,with an increase of 24.5 percent. Per capita net earning of farmers was 3,159 yuan, with an increase of 14.2 percent. The survey results show, that in the towns affected by the project the per-capita filoor space occupation reaches 37-59m2, the per-capita cultivated land occupation 0.4-1.4 mu and the average per-mu yield of rice in rainy seasons 500-6SOkg.The towns along the expressway are mainly engaged in agricultural production. The major -4- crops include rice,tuber crops,beans,oil crops and fruit trees,etc. There are also a few township and private enterprises engaged in building materials, building construction, non-metallic products, small-sized machiney and equipment, handicrafts, transportation by land and water,etc. The project passes through the comparatively economically developed area of Zhangzhou City. In 1997 Longhai City ranks on or above the average in Fujian Province in per-capita GDP, structural proportion among the three industries, economic growth rate and improvement of people's living standards. The completion of this project will no doubt accelerate the socio-economic development in this area and even the surrounding areas. Measures to minimize resettlement It is unavoidable that highway construction will involve occupation of land, demolition of houses and removal of infra- structure and other structures, which will influence the production activities, life and employment of the local residents. To minimize the influence and resettlement, during selecting bridge site of the Baishui Large Bridge, We compare by means of qulitative analysis according to terran, landforms and geology on both sides of Nanxi -5- of Jiulong River,the viewpoint of General Headquaters of Expressway Construction in ZhangZhou City, the suggestions of Burean of Communications in Longhai City and the concerning departments of Baishui Town and Dongyuan Town. During discussion of the schemes, Fujian Provincial Traffic Planning and Design Institute, resettlement offices and environmental specialists worked closely, making reconnaissance and consulting widely with local governments and public for opinions so as to finally determine the best scheme. There is no demolition of Buildings in both two bridge sites. In order to let most of the land loser regain the land and continue to use their production techniques and tools,not necessary to leave their hometown for training, we have taken land adjustment as the key measure supported by another measure of resettlement in township enterprises to minimize the resettlement and influence. As the preliminary design and final design go on, the alignment will be bettered to ensure the best scheme. At the same time, the quantities of land acquisition and resettlement will be reduced to the smallest possible. 5. Technological and economic feasibility study The engineering feasibility study report of this project was prepared by Fujian Provincial Traffic Planning and Design Institute, which started in December 1998 and ended in February 1999. 6. Preliminary design and construction drawings design Fujian Provincial Traffic Planning and Design Institute will be responsible for the surve.y and design of this project. The preliminary design will start in March 1999 and end in May 1999. Design of the construction drawings will start in June 1999 and is expected to end in September 1999. 7.Employer of the project and its organization The Employer for the Baishui Large Bridge project is Zhangzhou Municipal Zhangzhou-Zhao'an Expressway Co. ,Ltd of Fujian Province. -6- In order to do the land acquisition and resetlement well, Zhangzhou City and Longhai City have established the Zhangzhao Expressway Construction Leading Group, under which the CIRO, CORO, TRO and VRO are set up--Each of them has its own account number-specially responsible for coordination and execution of the resettlement activities. S.Social survey (1) Socio-economic survey The socio-economic survey for the Baishui Large Bridge project was initiated by Fujian Provincial Traffic Planning and Design Institute in December 1998. In January 1999 the Expressway Resettlement Office of Zhangzhou City , together with Fujian Provincial Traffic Planning and Design Institute and the resettlement office of Longhai City and concerning towns and villages , conducted the survey. The survey last for 10 days and attended by 20 persons,collecting 480 sheets of information. - Scope and object of the survev Scope: Longhai City, involving Baishui Town,Dongyuan Town,three villages in Baishui Town and one village in Dongyuan Town. Object:Land,structures,facilities and all the affected people. *Subject of the survey Number and classification of the affected collectives and individuals; state of impact on buildings,land and other properties as well as relevant information about income and living standard; opinions of the affected; comparison information between the affected and unaffected in a same area. *Way of survey For the survey,we prepared and distributed the Resettlement and Socio-Economic Survey Form for the Baishui Large Bridge project so that the drawings, objects and data in the survey forms are corresponding with each other. -7- *Procedure of survey a. Survey training On January 19-20 1999 the resettlement office of Zhangzhou City presided over Resettlement Data Collecting Working Conference in Zhangzhou City with over 20 attendants from the Resettlement Office of Zhangzhou City, Fujian Provincial Traffic Planning and Design Institute, the Resettlement Office of Longhai City, traffic bureaus of Longhai City and concerning departments of Baishui Town and Dongyuan Town. Subject of the conference 0define the tasks, do the overall mobilization for resettle- ment and distribute the resettlement training textbooks; Otrain the vocational key members about the subjects in the way required by the WB, having them familiar with the survey requirements and techniques. b. training by levels and survey 0As required by the Resettlement Office of Zhangzhou City, the Resettlement Office of Longhai City called on the investigators in counties and towns and the staff of the town-level land administration offices for training. Examples were given in the course; (DAfter the training course for cities and counties was over, the professionals from the Resettlement Office of Zhangzhou City and Fujian Provincial Traffic Planning and Design Institute, together with the Resettlement Office of Longhai City, traffic bureaus, land administration bureaus,land administration offices of Baishui Town and Dongyuan Town, town/village cadres, jointly conducted the on-the-spot survey and calculation; CDWith the support and cooperation of the towns, villages and the affected along the expressway, the survey went on successfully. Complete data and information have been collected. (2) Polls The Resettlement Office of Zhangzhou City and Fujian Provincial Traffic Planning and Design Institute are responsible for the polls for the project, which were conducted in January 1999. The polling forms are distributed to: all -the resettled households and the directly affected(not less than 30 households each town).The survey objects include village committee members,women representatives,and the fragile community,responsible persons of industrial enterprises, democratics and VIPs.The survey was conducted with questionnaire.It was finished in February 1998. The results are shown in the following table. Preparatory work for the RAP . The Resettlement Office of Zhangzhou City for Fujian Provincial Zhangzhou-Zhao'an expressway project is responsible for organizing the preparation of the RAP. The Resettlement Office of Zhangzhou City entrusted the polling work for the Baishui Large Bridge project to Fujian Provincial Traffic Plannning and Design Institute. The resettlement offices of Zhangzhou City and Longhai City,traffic bureaus,land administration bureaus of the cities and counties along the expressway and township governments took part. Village committees, the affected people and responsible persons of township enterprises actively cooperated by providing relevant data. The maps for design use, computer softwares and survey data processing were completed independently by Fujian Provincial Traffic Planning and Design Institute. The Resettlement Office of Zhangzhou City jointly completed the preparation of the RAP with Fujian Provincial Traffic Planning and Design Institute. 10 Schedule of the preparation and execution of the project Preparation of the RAP for the Baishui Large Bridge project started in 1998. February 1999 saw the completion of the survey on resettlement. March 1999 saw the completion of preparation of the RAP for the project. In August 1999 it is planned to start the overall land -10- acquisition and resettlement. In October 1999 construction of the project is starting. In September 2001 the project will be completed and open to traffic. 11.Permission of land occupation,resettlement and construction The Baishui Large Bridge project needs to occupy 59.4 mu land and temporarily lease 17 mu. It is planned to carry out the overall land acquisition and resettlement and provide access to the construction sites between August and September 1999. After the preliminary design is approved, the Resettlement Office of Longhai City should obtain the Construction Land Use Permit according to the procedures stipulated in the National Land Administration Law, then the Resettlement Office of Zhangzhou City should carry out the land acquisition and resettlement according to the RAP of this project and finish it before September 1999. Construction of the project should be started in October 1999. 12. Compensation criteria Fujian Provincial People's Government and the municipal and county-level people's governments have not set compensation criteria particularly for this project. All the compensation should follow the national, provincial and municipal unified regulations and the WB's relevant regulations. It is verified that the income from agricultural production represents 88%/ of the total income of those households who will lose their agricultural land and need to be resettled. C. In view of the preparation work for the Baishui bridge project, the 4 cities and counties involved in the expressway have decided not to adjust the land along the expressway until the work about the land acquisition has been finished. D. Land in 4 villages along the expressway will be adjusted for land to the affected people. E. For more details,refer to Appendix A-2-1. 2.
