Preface 1.1 Survey of project land requisition The project construction contents of western poverty reduction project financed by the world bank includes six sub-projects: crops & animal husbandry development, infrastructure, rural enterprise, labor mobility, education & health, institution development & project management. The project land requisition is limited to 6 counties in the 12 project counties of Gansu province. The contents and scale of the project land utilization are strictly restricted to the content stipulated in the report on feasibility study and appraisal. The newly added land availability from the agriculture development sub-project such as terracing, according to the relevant state regulations, will be allocated to the project households for utilization or contracted management. This newly added land is not included in the area of land requisition for the project. The government will ensure that project households may use the waste land reclaimed by themselves under the project, as well as other land on which perennial plants grow, for at least 50 years. In addition, they may use the newly-built basic farming field at least 30 years. In the project, two components, that is, the rural enterprises and infrastructure construction, need to require land. On the basis of Article 37 regarding the category stipulation of Land Management Law of the P. R. .of China, there are two purposive categories of land use. One is for national construction, and the other for rural township and village construction. The land use for township or village construction mainly means those for housing of rural residents, for rural enterprise and facilities, as well as for public welfare construction. Therefore, the land to be used for the project construction can be classified into the category of land use for rural township or village construction. 1.2 Land requisition quantity, impact & time arrangement The PMOs at county level have taken the responsibilities to organize and carry out the investigation for project land requisition. The PMO staff (cooperated with local township and village cadres) have investigated the households one by one in the planned affected 3 areas, and reported the detailed situation of land requisition in a down-to-the-earth manner. All these lay a good foundation for the smooth implementation of the project land acquisition. Within a period of 6 years of the project construction, land to be required for all kinds of construction is estimated as follows: a total of 1256.18 mu for the 6 years, including 953.8 mu of waste land and 302.38 mu of dry land (i.e. non- irrigated farm land, see table 1). The annual arrangement of the project land requisition includes 651.28 mu for the first year, 359 mu for the second, 179.4 mu for the third, 3 mu for the fourth, 60.5 mu for the fifth, and 3 mu for the sixth year. A total of 9552 people in 1931 households in the project areas will be affected by the land requisition, accounting for 2.44% of the total population within the townships where the land acquisition will take place. The households affected by the land requisition will be reasonably compensated and settled on the basis of the relevant laws. The project will not cause any removing of houses/buildings, nor population relocation as a result of land acquisition . Most stock-sharing enterprises or farmer individual business in the rural enterprise sub- project mainly take the form of rebuilding.. They will only take up some odd pieces of land, with fairly small area, of which most are waste land. Most individual private enterprises will occupy land by reforrning the owner-possessed houses, thus there is no problem of occupying new land. Even if fruit cellars of some households may utilize small amount of land, they will be all built on the contracted land of the households' own. In addition, through storage, the fruits will be sold quite profitably in the slack season, and the increment benefit from the prices will be some ten times the original orchard benefit, which is of great advantage to the households. On the whole, the rural enterprises under the project will bring about little impact on farm household. As for those households to be affected by any components of the project, including road construction or even the said rural enterprises, worker recruitment, land relocation, financial compensation, and other measures will be adopted to ensure improving or at least restoring the affected households' livelihoods reasonably. There is no problem of borrowing land for the infrastructure construction project, such as rural roads. The reasons are that the implementation areas selected for the public roads sub-project are all around the project villages which are relatively near the main roads. The tasks for the road construction are mainly to rebuild the existing shortcuts, most of which are wasteland as well. In order to fully find out the impact brought about by the project land requisition on local households, since March 1998, the PMO in each county has made a thorough and careful investigation into the social and economic situations of the villages and households to be affected by the land requisition during the first year of the project implementation; and 4 they thus have got more detailed information on both the baseline data and household impact which are critical for adopting appropriate mitigation measures in the project design and implementation (see table 2). The project design and implementation is expected to be able to coordinate all of its components in a well-interlocked development order, including exploration of agricultural resources, protection of environment, and development of rural socio-economies. All these components will not entail any kinds of population resettlement, neither involuntary not voluntary. 2.The purpose and principle of land acquisition 2.1 The purpose of land acquisition Land acquisition under the project is mainly for construction of rural enterprises and rural roads. The rural enterprise and road construction, serving for local agricultural comprehensive development, may at the same time create new job opportunities and income sources for the households in the project area. Based on local conditions, diversified productive patters and improved rural infrastructure prove to be among the highest priority pursued by local people in poverty reduction. 2.2 The principle of land acquisition The project will strictly abide by the lawful principles of land acquisition of China and the OD.4.30 for involuntary resettlement of the World Bank. The project will rigidly stick to the basic principles of " Fully treasure and reasonably utilize every inch of land, and firmly protect cultivated land". It will certainly struggle for minimizing the negative impact caused by the land acquisition and will make sure to rationally use land for the project purpose. The households to be affected will be fully compensated for their loss and appropriately arranged for their income earning, so as to enable the affected households to improve, or at least restore, their original living standards and production level; and in the meantime, their proper rights will be surely guaranteed. 3.Laws and regulations 3.1 Domestic laws and regulations The project land requisition will firmly obey the laws and regulations such as "Land Management law of P. R. China", "the Implementation Regulations Regarding the Land Arrangement Law of P.R. China", and " The Method of Enforcing the Land Management Law in Gansu Province". The land utilization units for project construction will have to apply for obtaining the rights to use the land through the local Land Management Bureau, going through all the designated procedures of examination/verification for approval. 5 In accordance with " Land Management Law of P.R.China", our country fulfill the state- owned land system and collective ownership of people. Land acquisition must go with compensation. The land utilization units for the project construction will have to apply for the rights to use land through the legal procedures designated in Article 59 of "Land Management Law of P.R.China" and Article 40,46 of Management methods of carrying out the law in Gansu Province". The application will be examined, approved and supervised by the Land Management Bureau at provincial, prefecture and county level. Besides, they will be submitted to the People's government at county level or above for approval according to the sizes/scopes of the land requisitioned. As for the land requisition of rural enterprises, the Land Bureau should examine the application carefully and consult with the Environment Departments about the enterprises' locations and designs. Article 59 of "Land Management Law" says: the township or village construction such as township enterprises, township or village public facilities, public welfare , rural residents, housing construction should absence village and market township plan, distribute rationally, develop comprehensively and form a complete set in construction, land for construction must comply with the overall program of the township land utilization and annual plan for land utilization, and go through the ratification procedure on the basis of Article 44,60,61 and 62 of the same law. Article 44 of "land management law" says: land used construction involving the change from farming land to constructive one should go through the ratification procedure for farmning land transformation". "Within the scope of city, village and township construction land designated by the overall program for land utilization, if farming land is transferred into construction land, the change must be confirmed by the original administrative departments which approve the overall program for the land utilization by batches on the basis of annual plan for land utilization. Within the changing scope of farming land already approved, land used for concrete construction items can be ratified by prefecture or county level government. Land used for project construction excluding section 2 and 3 of the article, involving a shift from farming to construction, should be authorized by the government of province, autonomous regions or municipalities." Article 60 of "land management law" says: rural collective economic organization using construction land determined by the village land utilization overall program establish enterprise or start enterprises cooperatively together with other units, individuals in the form of shareholders of land utilization or joint operations must hold relative ratified documents to make applications to the land administrative authorities at or above county 6 level. In line with ratifying power limit stipulated by the province, autonomous prefectures and municipalities, the application must be approved by the local government at or above county level; in particular, those application concerning the occupation of farming land, must go through ratification procedure stipulated by Article 44 of the law." The construction land to set up enterprise according to pre-article stipulations, must be strictly controlled. Province, autonomous prefectures and municipalities must determine the criteria of land utilization in accordance with different lines and business scope of township enterprise. Article 61 of "Land management law" says: "The land used for township & village public facilities and public welfare cause construction should be examined, then raise application to the land administrative departments at or above county level, within authorized power limits by province, autonomous region and municipality directly under the Central Government the local Government at or above county level will approve it; out of which, concerned farm land will be examined & approved according to Article 44 of "Land management law". The compensation expense for township or village construction include land compensation expense, green plants, ground accessory and settlement compensation expense. The specific norms will be performed according to Article 47 of "Land management law" and Article 46,31 of "Methods of carrying out the land management law in Gansu province". Article 47 of "land management law" say: These people whose land is taken over for use should be compensated according to its original use of the ;and requisition. The compensation expense for the required cultivated land include land compensation, settlement compensation, as well as the compensation for ground accessory and plants . The land compensation for cultivated land requisition is 6 to 10 times of the average annual output value of 3 years before the land is required. The settlement compensation expense for cultivated land requisition will be accounted by agricultural populations needing settlement. The agricultural population needing settlement will be accounted according to pre-requisition cultivated land divided by the amount occupied by each person averse in the units whose land is required before requisition. The criteria of settlement compensation for agriculture citizen who need be arranged, is 4 to 6 times of 3 year annual average output value before the cultivated land is required. But regard to the settlement compensation for each hectare of cultivated land requisition the maximum account can not be higher than 15 times of annual average output value of 3 years before land requisition. The criteria of land & settlement compensation for other land requisition will be determined by the province, autonomous prefectures and municipalities referring to land compensation as well as settlement compensation for cultivated land requisition. 7 The compensation criteria for the ground accessory and green plants of the required land will be determined by the province, autonomous prefecture and municipalities." Article 31 of "methods of implementing land management law in Gansu province" (1) land compensation No compensation is given to the fruitless land which has never been cultivated. (2) Green plants compensation Green plants compensation The compensation criteria of green plants on required the land is intended for the output of present season, if there are no green plants, the compensation should be given according to the real input of present season." (3) The compensation for ground accessory: The compensation criteria for the trees, buildings, and structures on the required land will be stipulated by government at or above county level and then report to the province government for the record. From the day when the land is required by consultation, no compensation will be given to the trees, buildings and structures being hasty built." (4) Settlement compensation No compensation will be given to the requisition of residential area, free land, abandoned cultivated land as well as wasteland and hillsides." With regard to the compensation criteria for non-cultivated land (namely wasteland) , it will be given 100-200 yuan per mu as compensation after the consultation with county." Article 31 of "Land Management Law": The state protects cultivated land, strictly control the transforming of cultivated land into non-cultivated land. The state practices compensation system for occupation of cultivated land. The units occupying the cultivated land approved to use for non-agricultural construction, in line with the principle of " open up the same amount of land as you have taken up," should be responsible for reclaiming the equivalent amount and technology to what they have covered; when the conditions for reclamation do not exist or the land reclaimed is not consistent with the respective requirements, on the basis of the stipulations of province, autonomous prefecture, and municipality, fees for cultivated land reclamation should be submitted. And the special funds should be used to open up new cultivated land. Document No. 61(1998) issued by Gansu land management bureau "Circular on collecting land-building fees for cultivated land, repeated reclaiming fees for land exploitation and fees for land going out of cultivation" stipulates: The land-making fees for other cultivated land beyond basic agricultural fields will be collected by the norm of 2-10 yuan per square meter. 8 The administrative fee should be conducted in accordance with article 39 of "Methods of implementing land management law in Gansu province". Article 39 says: the state construction land must integrally required by the land located county (municipality, district) level government after ratification. The units using land will have to pay 3-4% of the total land requisition expense (land compensation, green plants, settlement, accessory, development construction fund for new vegetable field etc.) to the land management authority at county (municipality, district) level; those units using land such as waste land, waste hillside, flood land, gobi, etc. will have to pay 40- 100 yuan per mu land management expense." 3.2 The World Bank OD. 4.30 for involuntary resettlement In compliance with the World Bank OD.4.30, the project management and PMOs will pay full attention to providing the affected farm households with adequate funds and beneficial opportunities from the project. The project will compensate the village communities for their land loss with the lawful prices (as indicated in the laws and regulations, and as detailed below). In actuality, all the household will be reallocated same amount and quality of land for their contracted land to be requisitioned. The project will also compensate any loss of crops and the attachments to the land for individuals based on local market prices and replacement costs. In case some unexpected relocation occurs during project implementation, resettlers and affected people will receive sufficient support and assistance during their physical moving and the whole transition period in the resettlement new sites. Above all, as mentioned before, the project will ensure that the affected people's living standards, income earning capacities, and production levels will be improved, or at least, restored as they had before. In terms of the project support, special attention should be drawn for the needs of the extremely poor households among people affected. In addition, local people will be encouraged to participate in planning of the land acquisition and population relocation (if any), and in designing of the land compensation and reallocation. Their participation will be organized in the appropriate social forms, and it is even better to be able to support their own social and cultural organizations in mobilizing the movement. The project will ensure that all kinds of people, including farmers, ethnic minorities, and herdsmen, who are affected by the project adversely, will be supported to gain land, housing, infrastructure, and other compensation properly. They have the traditional using rights for the farmland to be requisitioned and they are entitled to share other local resources, and so they have to be compensated for all of these. In addition, those among the affected people who do not have lawful entitlement for the land also should not be kept from compensation. 9 4. Social and economical investigation All of the 12 project counties in Gansu province are the key poverty-stricken counties designated within "The State 8-7 Poverty Alleviation Campaign," accounting for 22.64% of 53 poor counties in the whole province. The average per capita net income of farmers in the 12 project counties is 748 yuan (present price), accounting for 68% of the net income of per farmer in Gansu province (1100 yuan in 1997). On the average, each person possesses 240 kg grains in the 12 counties, accounting for 59.4 1% of 404 kg per capita in the whole province; The poor population takes 28.96% of the total population in the project counties, that is 1.5 times the percentage the poor population holds in the whole province. The project involves 185 townships, accounting for 57.59% of 316 townships in the 12 project counties. The net income of per farmers in the project townships is 615 yuan, about 82.22% of the average level of the project counties. On the average, each person processes 200 kg of grain in the townships, accounting for 83.3% of the average level of the project counties. The poor population accounts for 46.34% of the total population in the townships, which is 1.6 times that of the whole project counties. 2234 villages are involved in the project, accounting for 43.74% of 5108 villages in 12 project counties. The net income of per farmers in the project villages is 506 yuan, accounting for 67.65% of the average income in the project counties. On the average, each person processes 215 kg of grains, that is 89.58% of the average level in the whole project counties. The poor population accounts for 58.49% of the total population in these villages, which is 2.02 times that of the project counties. Land requisition will take place in 28 townships. The total land area in the 28 townships is 3385450.5 mu, of which day land (non-irrigated farmland) is 699441.4 mu, paddy land is 4632 mu, waste land (non-cultivated land) is 2282533.5 mu. The total land acquisition by the project will be 1256.18 mu, including 953.8 mu of waste land and 302.38 mu of dry land. The total population in the 28 township is 373523 people, among them, 9552 people in 1931 households will be affected by the land acquisition. For the first project year, there will be 1255 of the 9552 people be affected, among whom, the net annual income per capita is 480 yuan, and the person-possessed grain is 210 kg on the average. 5. The affected range and compensation criteria 5.1 The affected range The project land acquisition is planned within 28 townships which unevenly spread in 6 project counties (see table 4). The required land for the project is 1256.18 mu as a total. 10 For the first year, the project plans to have 651.28 mu of land acquisition, of which, 532.1 mu are waste land and 119.18 mu are dry land. Total 9552 people inl931 households will be affected by the land acquisition for six years during the whole project implementation, among them, 1255 people of 278 households will be affected in the first year. 5.2 Compensation criteria. In accordance with clearly-defined provisions of relevant laws and regulations quoted in the previous pages, as well as through consultation with the land administrative bureaus at all levels in view of local realistic situations, the compensations for land and crops/attachments are determined as follows. (1) Compensation rate for cultivated land acquisition is counted at 6 times the average annual output value of the last 3 years. (2) The settlement compensation expenses for cultivated land acquisition are that each agriculture-registered population affected is counted for the cost at 4 times the average annual output value of the last 3 years. (3) The compensation for green crops: if there are green plants, the compensation will be counted according to the crop output at market value of this year; if there are not, the compensation will be given according to the real input of the crops. (4) The compensation for ground accessory (attachment to the land): the compensation payments will be calculated on the basis of the replacement costs. (5) Land-making expenses: it will be collected at 2 yuan for each square meter (i.e. 1333.4 yuan per mu), in accordance with the new Land Administration Law effective as of 1999. (6) The compensation for non-cultivated land: non-cultivated land will be compensated for 100-200 yuan per mu. (7) Land management expense: if cultivated land (farmland) is required, 4% of the total expenses for cultivated land acquisition will be collected as land management fees; if waste land (non-cultivated land) is required, 50 yuan per mu will be collected as land management fees. 6. Measures for restoration of people's living and production levels As required in the World Bank OD.4.30 document, the purpose to formulate the project 11 land requisition policy and plan is to enable the households affected by land requisition to improve or at least restore their previous living standard, income capacity and production level, and assure the affected households of their proper rights and interests. The land acquisition in the project is mainly for reconstruction of some rural enterprises and rural roads. The characteristics of the land use for this purpose are that the land occupation will be in small and scattered areas, and mostly on the waste land. As a result, there may be a comparatively large number of households to be affected, but each of them will be required for only quite small piece of land. For these households who lose land, villages will reallocate land for them by means of readjusting the village public land. Meanwhile, the land compensation payments may also be arranged by the village communities to help these affected people find some remunerative job opportunities, so as to increase their economic incomes and living standards. From the townships in which the land requisition will take place, the required land only accounts for 0.31% of the existing land area, and the required cultivated land (dry land only) accounts for 0.53% of those currently cultivated. For per capita landholding, the cultivated land before land acquisition is 1.87255 mu; and after that, the area will become 1.87174 mu. So, only 0.000812 mu will be reduced for each person. Therefore, there will no problem for the villages to reallocate necessary land for the affected households. There may be several steps for restoring/improving the households' livelihoods: (1) Cash compensation payments for green crops and attachments to the land will be directly disbursed to the affected households. (2) Land reallocation to the affected households will be conducted by the village communities for the purpose of exchanging land for land. The production capacity of the exchanging land should be equal to or higher than that of the required land.(see table 4). Land compensation to the villages will be used for water conservancy construction, amelioration of soil, development of diversified business, and reclamation of wasteland. (3) Worker recruitment will be carried out in the cases of land acquisition for rural enterprise construction. Eligible family members of the affected households may be recruited as workers into the enterprises which acquired land from the households. They may work for the enterprises while still living in the villages. 7. Budgets and financial management 7.1 Budgets: According to section 5, each relevant county has make a detailed budgetary estimation 12 for land acquisition. The summary of the land acquisition budgets for all the sub-projects is made below. The total budgets for the project land acquisition is 2505728 yuan, which consists of 7 parts as follows: (1) Compensation for land, 1014691.96 yuan; (2) Compensation for green crops, 132529.9 yuan; (3) Compensation for ground accessory (attachments to the land), 47830 yuan; (4) Settlement subsidy 586272.8 yuan; (5) Rebuilding of farmland for the lost, 403193.5 yuan; (6) Contingency fees (counted at 10% of the compensation for farmland), 207112.52 yuan; (7) Land management fees, 114097.36 yuan (see table 3). Among the 7 parts of the budgets, expenses in parts (1),(2),(3),(5) have been calculated in detail as shown in table 5; while expenses in parts (4),(6),(7) are respectively calculated as follows: As for the (4): Settlement subsidy Step one: The area of cultivated land acquisition in each relevant county is: Wudu county:77 mu; Tanchang county: 34.7 mu; Wenxian county:10 mu; Zhangjiachuan county: 87 mu; Minxian county: 63.08 mu. Step two: According to table 5, the average annual output value of previous three years in each respective county is: Wudu: 326.7 yuan/mu; Tanchang: 240 yuan/mu; Wenxian: 600 yuan/mu; Kangxian: 637.5 yuan/mu; Zhangjiachuan: 635.4 yuan/mu; Minxian: 512 yuan/mu. Step three: 4 times the average annual output value of the last three years in each relevant county is: Wudu 1306.8 yuan; Tanchang 960 yuan; Wenxian 24500 yuan; Kangxian 2550 yuan; Zhangjiachuan 2541.6 yuan; Minxian 2048 yuan. Step four: the settlement expenses which each county needs is as follows (as the area of cultivated land acquisition multiplied by 4 times of the average annual output value): Wudu: 77 x 1306.8=100623.6 yuan; Tanchang: 34.7 x 960=33312 yuan Wenxian: 10 x 2400=24000 yuan; Kangxian: 30.6 x 2550=78030 yuan Zhangjiachuan: 87 x 2541.6=221119.2 yuan; Minxian: 63.08 x 2048=129187.84 yuan Total: 586272.8 yuan (6) Contingency fees According to the Land Administrative Bureau, contingency fees should be calculated at 10% of the total costs of farmland compensation (The total farmland compensation is compensations for farmland and settlement subsidy, plus compensations for green crops 13 and ground accessories). According to table 5, the compensation for farmland in each relevant county is: Wudu: 375775.4 yuan, Tanchang: 137877 yuan, Wenxian: 92133.1 yuan, Kangxian: 294904.1 yuan, Zhangjiachuan: 743168.4 yuan, Minxian: 427266.07 yuan. Therefore, the contingency fees for each county is: Wudu 375775.4 x 10%=37577.54 yuan, Tanchang 137877 x 10%5=13787.7 yuan, Wenxian 92133.1 x 10%=9213.31 yuan, Kangxian 294904.1 x 10%=29490.41 yuan, Zhangjiachuan 743168.4 x 10%=74316.84 yuan, Minxian 427266.1 x 10%=42726.61 yuan; and the total hence is 207112.52 yuan. (7) Land management fees Management fees for cultivated land acquisition are the total compensation for farmland multiplied by 4%. Management fees for waste land are calculated through area multiplied by 50 yuan/mu. Therefore the management fees for farmland acquisition in each county is: Wudu: 375775.4 x 4%=15031.02 yuan, Tanchang: 137877 x 4%=5515.08 yuan Wenxian: 92133.1 x 4%=3685.32 yuan, Kangxian: 294904.lx 4%= 11796.16 Zhangjiachuan: 743168.4 x 4%=29726.74 yuan, Minxian: 427266.1 x 4%=17090.64 yuan; and the total is 66407.36 Yuan. Management fees for waste land are 953.8x50= 47690 Yuan Therefore, the total management fees are 114097.36 Yuan 7.2Fund Management 7.2.1 The Sources Of Compensation Funds The governmental fiscal funds & the land acquisition units' self-collected funds are the main source for land compensation costs. The World Bank loan can not be used to pay for the land acquisition and the related expenses. The land acquisition units must submit land requisition fumds to the land administrative bureaus, and the latter will disburse the land compensation to the land owners. The compensation funds for land to be used for infrastructure construction such as rural roads will be provided to the land administrative bureau by the county road management bureau through the financial department. 7.2.2 The Utilization Scope Of Compensation Funds: 14 Compensation for green crops & accessories will be directly paid to the households whose land is required .The land compensation is generally used by village communities for the purpose of productive development. It may also be used for rearrangement of the surplus laborers caused by the land acquisition, and for some unemployed people as living allowance. Meanwhile, the settlement subsidies are used mostly also for the reemployment of the surplus laborers and unemployed people who are negatively affected by the land acquisition. 8. Participation of Local People The land acquisition & compensation of the project will strictly obey the laws , respect the wills of the land-required households, put the functions of the village communities in full play, actively carry out propaganda and mobilization among the households related to the sub-projects. In addition, grievance channel for the land acquisition should also set up, so as to ensure that the land-required households have ways to protect their own proper rights and interests. In the project preparation, the PMO staff at all levels have gone to village & townships to propagandize the project and mobilize the households. The following tasks have especially been fulfilled: One : During the project planning stage, the PMO staff have mobilized poor households together with the project planners to conduct analysis of poverty-causing factors, the favorable & unfavorable conditions for the project implementation, the benefits & disadvantageous influence on the households while the project is implemented, and hence laid solid foundation for the project planning and decisions-making. Two: They have arouse households to put forward the program according to their own reality, mapped out the project draft in light of resource status as well as the project requirements, collected the plan drafts from the participating households, finally worked out the village level project plan based on the practice conditions and farmers' needs. Three: They have organized the households to be affected by land requisition, in coordinate with the planners, to design the implementation scheme of the project, negotiating the compensation criteria and settlement methods (including also the proper locations and quantities of the required land), based on the rights and obligations of the two sides. By all the careful preparation, final agreement has been reached by all parties. 15 During the whole process of land requisition, households and village communities are fully consulted with, and their informed participation in preparative procedures for land acquisition is obviously reflected in the following steps: * Project information dissemination; * Filling in the households investigation forms; * Collecting the village data through household interviews; * Typical households and farmer representatives meetings; * Village conferences for open discussion of the project investigation; * Summary at the village level on the basis of farmers' feedback; * Producing plan for land acquisition with technical planners; * Households confirmation of the plan - including identification of the households to be affected by the land acquisition, the quantity and types of land requisitioned, compensation criteria and settlement methods). * Verification and Approval of the land acquisition program by the project authorities. 9.The Grievance Mechanism The PMO will be responsible for explaining to the land-required households their rights and channels for appeal.(see the appeal diagram). If the land required households are not satisfactory with settlement methods, they may report to the village committee, the committee may either solve the problem by consulting with project construction units or appeal to the PMO orally or in written form. After the PMO receive the appeal, they will keep the record, together with the village committee, ask the project construction units to settle the problem within 7 days. If some conflicts or disputes can not be solved, the village committee may apply to the administrative authority for reconsideration or to take a legal process to the people's court, in accordance with the National Land Management Bureau's official document (1994) No.20, "A written reply to whether people may apply for administrative reconsideration after government settled a case of land ownership". Or "Regulations regarding administrative reconsideration". These two channels form an organic management system. The PMO at all levels are responsible for the project plan and implementation, and also responsible for urging the land requisition units to raise on time the land utilization application to the land management authority, including the required land quantity, time, location, etc. After the land acquisition application being approved, the PMO at all levels will coordinate with the land management department to prepare for land acquisition, supervise the land acquisition implementation, and solve problems occurring at different stages in the whole process. In doing so, it is also responsible for land compensation disbursement and settlement of the affected households. According to the state's relative land management stipulations , the land administrative bureaus on all levels are responsible for land management for construction use, in line with their authorization to their corresponding levels. The land administrative bureaus have responsibility to examine the required land, keep the records, inspect on the spot, handle land acquisition formalities, and supervise the compensation measures to be undertaken properly. 17 As for the concrete undertakings in the land acquisition process, there are different tasks for the project operators at different levels. The Planning and Monitoring Division in the provincial PMO takes charge of the overall planning and management of the province- wide land acquisition. 2-3 specialists in that division have concentrated their work on the land acquisition, helping the provincial PMO to sum up, coordinate, verify, and approve local land utilization plans and budgets, and to guide and supervise land acquisition implementation. The PMOs at county and township levels are responsible for implementation in their own territories, from disseminating project information and consulting local people, investigating and checking land and asset inventory, and putting land acquisition and compensation into effect, to coordinating with the land administrative bureaus in supervision over all the formalities of land acquisition. On the village level, there also are the project implementation groups in charge of farmer mobilization and participation, as well as land readjustment and production development in conjunction with the land acquisition and compensation. Chart of the Management System Village Executing Group Hlouseholds 11.The implementation procedures and schedule 11.1 The implementation procedures: Step 1 : Land using units should apply to the land requisition management authority (the 1 8 Land Administrative Bureau) for land acquisition for new usage. The content includes: A: land type and quantity. B: the current status of land utilization and the usage of land requisition. C: Project investment plan. D: the budget for land requisition capital and corresponding cost. E. the opinion of choosing location from the construction and environment protection department. F. land requisition charts and graphs. G. ratified project proposal and the report on feasibility study. Step 2: The land management authority examine and verify the application, and stipulate the compensation criteria (multi-times method) according to the land type on the basis of crop market price and yearly average output value estimation of 3 years put out by the statistics department. Step 3: land utilization and compensation measures will be cooperatively examined by the PMO and land management department to ensure that the living standard of the land- required households will not decrease owing to land requisition. Step 4: Land management department extensively solicit the opinion of rural collective economic organization and households about compensation plan, invite households to participate in the decision-making process, and, on this basis, revise the compensation methods so as to finally reach an all-side agreement. Step 5: After the compensation methods are defined, the land acquisition agreement should be sighed. The agreement content includes: required land location, type, requisition time and compensation methods. The land administrative bureau (or unit), rural collective economic organization, land-required households, and the land using unit must sign and also affix a stamp on the agreement document. Step 6: Within 15 days after the land using unit sign on the land requisition agreement, it should pay the land compensation payments to the rural collective economic organization (the village), as well as the green crops and ground accessory compensation to the land- required households. Step 7: The land using unit must go through the procedures of land utilization, with the relevant documents and papers defined in step 1, according to the laws. Step 8: After the required land is ratified by laws, the land transformation form will be determined in relation to the nature of the project land utilization. 11.2 Implementation Schedule The project land acquisition spreads among 7 counties in which 29 townships and a large 19 number of villages are related. All the related county and township government authorities will closely coordinate to ensure the progress in the land acquisition process. In the first year, the land acquisition will take place in 6 counties. These required land will be mainly used for some rural roads and rural enterprise construction. Because the pilot projects are planned to start in March-April, all the land acquisition should be completed before that time (See table 6 for the detailed working schedule). Between the second to the sixth year of the project implementation, over 9 sub-projects in 6 counties need to require land. Their concrete implementation schedules will be made in line with the progress of the whole project, and may be readjusted according to the actual situation in the related counties. The land requisition in each of the years will be planned and scheduled in detail as in the first year. After the annual plan for each county is determined, the land using units for the project construction will have to make an application for the land acquisition to the county-level PMO (with necessary data like the land locations, types and quantity. The PMO will organize and carry out the detailed investigation, checking the locations, types and quantity of the land in current use. Based on further local social and economic investigation and village/farmer consultation, the annual plan of land requisition and compensation for the current year should be decided. After this, the PMO will give an official reply to the application of the land using units. After the ratification, the PMO and the land using units may make an application for land utilization to the land administrative bureau. After the land bureau approves the application, the PMO, land bureau, land using units as well as land-required units jointly verify the land requisition quantity and compensation criteria. Then land using units and land-required units will sigh an agreement, based on which, the land bureau will handle the land acquisition procedures for the land using units. The land using units will have to pay the compensation for land acquisition to the land bureau, and the land bureau will have to allocate land compensation payments to the land-required units. After the compensation payments are acquired, the land-required units must transfer land using rights to the land bureau within 15 days, and the land bureau then issues land using rights to the land using unit. The land-required units will timely invest the land compensation for production development. In short, before the project is implemented, the land using units will conduct and complete the land acquisition procedures as well as compensation settlement by strictly following the relevant regulations. (At present stage, the land requisition, investment cost and land readjustment arrangement are listed in table 3). 12. Monitoring, evaluation and report A special group will be responsible for the project monitoring in each PMO at provincial, county, and township levels, forming a monitoring network for project implementation including land acquisition and compensation of the project. This is a powerful 20 organization aiming to guarantee for a better job of project implementation. In terms of land acquisition, this network functions as an internal monitoring mechanism in the project management. The monitoring network will conduct quarterly check per year and irregular inspection constantly so as to find out and solve problems occurring in implementation. The concrete monitoring indicators to be used by the network include the following aspects: * Whether the project brings about voluntary or involuntary migration of population. * Approval timing of the land management authorities. * Signing time of land acquisition agreement * The disbursement time of the compensation payment * The amount of the compensation payments * The utilization of land compensation payments * The types, quantities and locations of the readjusted land * Whether the affected households get sufficient compensation (for green crops and ground accessory, for instance) * Whether the affected households get appropriate settlement and entitlement * Economical condition changes of the affected households * Utilization of the required land In addition, while the project is implemented, there will be 2 times of the project overall monitoring/inspection activities per year, including the component of land acquisition and compensation. This will also provide a double-check in protecting the proper rights and interests of the households and villages affected. There should be a section about land acquisition in the monitoring report, in order to make sure what happen in practice is just like what is planned by the PMO. In order to further strengthen the monitoring of land acquisition, land management experts are invited by PPMO to join in the consultant panel for environment evaluation, so as to enable the panel to function also as an independent monitoring of land acquisition and compensation, in cooperation with the land administrative bureaus. The land management experts in the panel will conduct two times of field investigation on land acquisition and compensation as well as settlement per year, and also check utilization of the required land and of the land compensation payments.
