<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-2"><num>(2)</num><content>In sub-paragraph (1) of paragraph 5 (licence to remain in force for a year or shorter specified period unless cancelled or revoked under paragraph 12(4)), for “12(4)” substitute “11A or 12(4) or (5)”.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-1-3"><num>(3)</num><content><mod>After paragraph 6 insert—<quotedStructure startQuote="“" endQuote="”" uk:context="schedule" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="schedule" ukl:Format="default"><paragraph class="schProv1"><num>6A</num><subparagraph><num>(1)</num><intro>This paragraph applies where the authority by whom an entertainments licence was granted under paragraph 1 above in respect of a place receive a report from the chief officer of police—</intro><level class="para1"><num>(a)</num><content>stating that there is a serious problem relating to the supply or use of controlled drugs at the place or at any place nearby which is controlled by the holder of the licence; and</content></level><level class="para1"><num>(b)</num><content>giving reasons for his view that there is such a problem.</content></level></subparagraph><subparagraph><num>(2)</num><content>An application for the renewal or transfer of the licence may be refused by the authority on the ground that they are satisfied that not renewing or transferring it will significantly assist in dealing with the problem.</content></subparagraph><subparagraph><num>(3)</num><intro>The authority shall give the reasons for their refusal of the application to—</intro><level class="para1"><num>(a)</num><content>the holder of the licence; and</content></level><level class="para1"><num>(b)</num><content>in the case of an application for the transfer of the licence, the person to whom the licence would have been transferred if the application had been granted.</content></level></subparagraph><subparagraph><num>(4)</num><content>A person to whom reasons are given may make representations to the authority; and the authority shall consider any representations within the period of 21 days beginning with the day on which they receive them.</content></subparagraph><subparagraph><num>(5)</num><intro>After considering any representations, the authority shall (unless the date of expiry of the licence has passed) either—</intro><level class="para1"><num>(a)</num><content>confirm the refusal of the application; or</content></level><level class="para1"><num>(b)</num><content>grant the application.</content></level></subparagraph><subparagraph><num>(6)</num><content>The authority shall have regard in exercising their functions under this paragraph to such guidance as may be issued by the Secretary of State.</content></subparagraph></paragraph></quotedStructure></mod></content></subsection>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-6-a"><num>(a)</num><content>in sub-paragraph (1)(d) (appeal against revocation under paragraph 12(4)), before “12(4)” insert “11A or”;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" class="para1" eId="section-1-6-e"><num>(e)</num><content><mod>after that sub-paragraph insert—<quotedStructure startQuote="“" endQuote="”" uk:context="schedule" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="schedule" ukl:Format="default"><subparagraph><num>(7A)</num><intro>A court which revokes an entertainments licence under paragraph 12(5) above may, if in the particular circumstances it would be unfair not to do so, order that the licence shall remain in force—</intro><level class="para1"><num>(a)</num><content>until the time for bringing an appeal against the revocation has expired; and</content></level><level class="para1"><num>(b)</num><content>if such an appeal is duly brought, until the determination or abandonment of the appeal.</content></level></subparagraph></quotedStructure></mod></content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-2"><num>(2)</num><content>In sub-paragraph (3) of paragraph 1 (licence to remain in force for a year or shorter specified period unless cancelled or revoked under paragraph 10(4)), for “10(4)” substitute “9A or 10(4) or (4A)”.</content></subsection>
