General 1.1 Project summarization 1 ) Site selection and nature of the project Guangzhou Solid Waste Disposal Center is a sub-item of Guangzhou Urban Environment Project. According to the layout, this project is to be localized in Liangtian Village of Liangtian Town in the northern of Baiyun District of Guangzhou City, with controlled land area being 500 Mu (with range extending to Jingzhu Freeway in the east, the old Guangcong Highway in the west, Zhongluotan Town of Baiyun District in the north and Qianjiawei Brick Field of Liangtian Town in the south, adjacent to the north foot of Baiyun Mountain). This project is to provide comprehensive facility for the final treatment & disposal of hazardous waste of public institutions of Guangzhou City, so as to, instead of all enterprises and institutions, safely and effectively dispose the various hazardous and harmful waste material that is difficult to utilize or unable to be disposed. 2) Construction content and scale of the project (1) Construction content: The construction content of Guangzhou Solid Waste Disposal Center mainly includes: Waste Allocation and Switching Central, Physico-chemical Treatment Workshop, Stabilization/solidification Workshop and Safe Filling Ground, etc. (2) Construction scale: * Quantity of affected land: The area of affected land for the initial stage of this project is about 200,000square meters (300.4Mu). * Construction scale: In accordance with the generation amount and predicted amount of the hazardous waste to be land filled in Guangzhou City, the construction scale for the safety landfill of this project is 850,000cubic meters (the capacity of land filled waste substance after being compacted is generally 1.2T/m3 -1.6T/ m3), of which: The construction scale for phase I is 150,000 m3; 3 The construction scale for phase II is300, 000 m3 3 The construction scale for phase HII is 400,000 min 3) Schedule of project construction Schedule of project construction Work description Scheduled time Construction ___________________________________ ~period_(days) 1. Acceptance of completed project April 20, 2005 April 30, (including planned environment 10 protection items and labor protections) 2005 1.2 Waste substance pollution status in the project area An investigation of annual enterprise waste and its disposition, which was performed by Guangzhou Solid Waste Control Center in 2001, revealed that enterprises and institutions annually produce 263,570.97 tons of hazardous waste. However, because of low level of comprehensive utilization and treatment technology as well as small scale, the actually comprehensive utilization amount and treatment capacity are only 121,351.21 tons'and 138,221.33 tons respectively; the comprehensive utilization rate and treatment rate are only 46.04% and 52.44% respectively, which has not reached environmental protection requirement. Ltd., GZ Huali Pigment & Chemistry Co. Ltd., GZ Zhujiang Iron & Steel Co. Ltd., GZ A~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Implementation Planning of Guangzhou Solid Waste Disposal Center Shenli Electron Science & Technology Co. Ltd., GZ Flashlight Co. No. Workshop, GZ Iron & Steel Corporation and GZ Power Plant etc. The transportation route of the solid wastes produced by these enterprises to the site selected for this project - Liangtian Village, Liangtian Town north in Baiyun District of Guangzhou will pass through areas with high dense of population and several sensitivity spots such as GZ Yanggang Mental Hospital, GZ No. 15 High School, GZ Youth Cadre Institute, GZ Sanjiu Brain Hospital, GZ South hospital, No. 1 Military Medical College, GZ Economics & Trade Institute, GD Xinan Institute, GZ Transportation Technical School, GZ Goodwill Hospital, GZ No. 87 High School and Huangpu District Hospital etc. 1. Above mentioned units are not only at least 10 km away from the selected site for the Solid Waste Treatment Center but also have a certain distance away from the transportation route of the solid wastes. The one has the shortest distance from the transportation route is GZ Yanggang Mental hospital. However, the shortest distance between the building and Taihe Road is more than 150m. The shortest distance between schools such as GZ No. 15 High School, No. 1 Military Medical College, GZ Economics & Trade Institute, GD Xinan Institute, GZ Transportation Technical School and GZ No. 87 High School etc. and the transportation route is more than 200m. All these schools have enclosing walls around to protect themselves from the noise impact outside. 2.The working units to be surveyed are not willing to accept further survey since they do not believe that there will really be any harmful effect caused. On the one hand they believe that there is certain distance away from the transportation route of the solid wastes, on the other hand they believe that vehicles will drive very fast during the transportation and with necessary security measures there will not be any harm caused. 3. The transportation process will be strictly controlled based on the principle of "classified packing and safe handling". Transportation of hazardous wastes is required to be done with covers and are only allowed to conduct after 9:00pm so as to minimize the impacts on the surrounding environment. Therefore, neither the transportation nor the centralized processing of the solid wastes will bring any major impacts on the units along the route. 1. 4 Analysis of the economic situation in the project area According to the survey, the major economic status of Liangtian village, Liangtian Town north to Baiyun District where the project will be implemented is as follows: A. Others 951 The above survey data show that the population in Liangtian Village, Liangtian Town north to Baiyun District is mainly agricultural population accounting for 84.85% of the total population. Among the people employed the farn employment accounts for 75.75%. The cultivated area per capita is only 0.56mu and the annual income per capita is only 20690 yuan. Therefore, the proportion of the agricultural population in Liangtian Village is big and the non-agricultural industries in the village are not well developed. 2. Status of the PAPs and the resettlement, compensation and rehabilitation plans for them 2.1 Status of the PAPs whose land is affected and the resettlement, compensation and rehabilitation plans for them 2.1.1 Type and quantity of affected land The project is to requisition the farmland for 300.4 Mu in Liangtian Village of Baiyun District of Guangzhou, of which: Infield: 42.89 Mu, accounting for 14.28% of the area of affected land Woodland: 113.84 Mu, accounting for 37.90% of the area of affected land Garden land: 139.3Mu, accounting for 46.37% of the area of affected land Pound: 2.013Mu, accounting for 0.67% of the area of affected land Other agricultural land: 2.36Mu, accounting for 0.79% of the area of affected land. 2.1.2 Status of the labor force whose property is affected Q Implementation Planning of Guangzhou Solid Waste Disposal Center There are not any census data at moment. The reason is that all the nature villages in Guangzhou have transferred into the neighborhood committees. The system of production contracted to the household was not executed any more as early as in the year of 2000. Therefore, the impact of the land requisition is only on the village collectives but not the individual peasant household. In addition, according to the land requisition procedure in Guangzhou the potentially affected villages will hold the meeting with all villages to discuss about the issue only after the land requisition procedure starts. Those specifically affected villagers will then become surplus labors, namely the PAPs. At present the concrete number of the PAPs caused by land requisition is not able to be determined. (In the light of China policy, for the rural area where land adjustment is unable to conduct, the agricultural population shall be converted into nonagricultural population. In general condition, the original ratio between agricultural population and infield shall remain unchanged, according to which the per capita infield is 1.2 Mu, affected land is 300.4 Mu, and the affected agricultural population is 253 in Liangtian Village.) 2.1.3 Resettlement, compensation and rehabilitation measures 1) The affected rural people shall obtain compensation according to Resettlement Policy, and the compensation fund shall be paid in a time manner. 2) When conducting land requisition, the affected structures shall be restored in a timely manner if they are non-independent structures (which are connected to other structures having not been removed); care shall be taken to reduce the impact on the integral function of buildings. 3) The governmental expenses of taxation related to the affected land of that year shall be deducted in the expenses of taxation of the next year. 4) During the construction of the solid waste disposal center, if temporary labor force is needed, the young adults from the rural PAPs shall be given priority. 5) After the establishment of the solid waste disposal center, appropriate personnel from the rural PAPs will be arranged to deal with work that requires less technology or the work that can be done after training, such as handling, entrance guard, transportation driver and cleanness keeper, etc. 6) The Project will contact with labor employment training authorities in providing necessary psychological assistance and skill training for the rural PAPs, so as to allow them to go over the rehabilitation period and to obtain new skill. 7) The Project shall negotiate with the real property companies of resettlement sites to provide job posts, such as security and house keeper. 8) The Project will contact with the real property companies of resettlement sites and street housekeeping service points to provide job posts, e.g., cleanness keeper and housekeeping service, for the young and middle-aged women of rural PAPs. 9) The Project will retain experts to give counsel for the use and investment of rural compensation A Implementation Planning of Guangzhou Solid Waste Disposal Center fun, for, example, investing in the Liangtian Village Industry Park being built, so as to speed up the construction of industry park and supporting facilities, to increase the attraction to foreign investment, and to allow the investment of compensation fund to gain better earnings ratio, thus promoting the development of local economy. By carrying out such measures, the Project hopes to provide employment opportunities for farmers as well as to benefit from the shares. In this way, a good circulation of economic development is formed, and the living standard of the rural PAPs can be continually improved. 10) The Project will negotiate well with the affected farmers, the chances shall be, as practical as possible, given to the young adults who have certain skill. 2.2 Resettlement, compensation and rehabilitation method, procedure and schedule The Resettlement Implementation Plans have listed the PAPs by category (so as to prepare different policy and standard for different resettlement catego ry). However, there are generalities in terms of the resettlement work and approaches. Therefore, the generalities are included in the Resettlement Policy while the different contents are described in the relevant chapters of each Resettlement Implementation Plan. 2.2.1 Resettlement, compensation and rehabilitation method and procedure (1) The implementing agency of the project resettlement prepares the resettlement notification (land requisition notice, moving notice and tomb moving notice etc.) according to the permit of land-use provided by the project owner and issue the notices on newspaper and within the area covered by the project. (2)The resettlement implementing agency of the project will organize the court, the resettlement management office, the project owner, the exterior monitoring unit, the internal monitoring unit, the neighborhood committees and the evaluators to participate the resettlement consultation and mobilization meetings and distribute the Resettlement Information Manual (see Section 10.2.2 of the Resettlement Policy for the detail) and provide consultation. (3)The resettlement staff will check the census data door to door, collect the missing data of the different kinds of properties and disseminate and explain to the PAPs face to face the Resettlement Information Manual, familiarize themselves with the willing of the PAPs and negotiate about the issues relating to the relocation. (4)If the PAPs choose the compensation in cash the resettlement staff will negotiate with the PAPs according to the compensation rates of the property with detailed items and that for stop-loss and for (temporary) moving. If the PAPs accept the compensation rate then goes to Item 9. If the PAPs do not agree with the project compensation rate then goes to Item 7. If the PAPs have chosen resettlement with houses they will have following chooses: House: not less than 10 resettlement areas with totally 1000 apartments; Shops: not less than 5 resettlement areas with totally 100 buildings Offices: not less than 5 resettlement areas with totally 200 buildings Factory buildings and warehouses: not less than 3 resettlement areas with totally 50 buildings. If the PAP agree to choose one of the houses mentioned above, goes to Item 9; I~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ . Implementation Planning of Guangzhou Solid Waste Disposal Center If the PAPs do not accept any more chooses will be provided for them according to their requirement. (6)The PAPs can change their decision of the choice before they sign the compensation agreement. That means they can change their idea from resettlement with housing into compensation in cash and then change again back to resettlement with housings. Note: according to previous statistics, 40 % of the PAPs changed their decisions during the negotiation. One person shifted between compensation in cash or with housings and changed his idea for as many as 6 times while another made his choice among 26 apartments in 7 resettlement areas. (7) Evaluation procedure The implementing agency will negotiate with the PAPs whether they need to choose an agreed evaluation institution for the housing evaluation. If the agreement cannot be reached the both sides can then entrust different evaluation institutions at the same time to carry out the evaluation. The both sides will negotiate again based on the results of the evaluations and if the agreement is reached goes to Item 9. If there is still big variance in prices the case can be handed over to the Appraisers Association for arbitration. (8) If the PAP will neither agree on the compensation rate and scheme provided by the project nor entrust the evaluation, or after the arbitration of the Appraisers Association the PAP still does not agree with the arbitration result then the case will be put into a legal procedure. The inferior court will conduct the mediation between the resettlement implementing agency and the PAP. First instance adjudicate will be proceeded if the mediation fails. If the PAP refuses to move after the adjudicate of the first instance the resettlement implementing agency can then apply to the court for compulsory execution. If one of the parties does not agree with the adjudicate of the first instance they can then appeal to a higher court. The intermediate people's court will conduct the mediation between the resettlement implementing agency and the PAP again. If the mediation fails the intermediate people's court will carry out the final judgment and the both sides shall execute the final judgment. (9) The resettlement implementing agency will sign the resettlement compensation agreement with the PAPs on behalf of the project owner. (10) The disbursement agency authorized by the project will conduct the payment according to the resettlement compensation agreement or provide the resettlement housings (or housing for temporary moving). (11) The PAPs will move by themselves or with the help of the project (with half-month decoration period or preparation period). ) (12) Demolition order will be issued after the whole building is empty (buildings that have not reached agreement on or have not complete the legal procedure for compulsory execution shall not be demolished). Partially demolished buildings will be restored by the resettlement implementing agency or by the PAPs themselves. After the restoration the PAPs will then be informed to move back (the project may provide the assistance). ) Temporarily demolished buildings will be rebuilt by the resettlement implementing agency or 11 Implementation Planning of Guangzhou Solid Waste Disposal Center by the PAPs themselves. After the rebuilt the PAPs will then be informed to move back. 2.2.2 Resettlement, compensation and rehabilitation schedule ( 13 ) .Resettlement quantity and implementation schedule Usually, the resettlement will be completed after 6 months of the notification. However, there are differences between the number of the PAPs covered by the notification and the deadline of the resettlement implementation and according to the previous experience the relation of the resettlement quantity and the time consumed is as follows: Less than 50 units - 3 months 50 - 100 units - 4 months 100 - 200 units - 5 months 200 - 400 units - 6 months 400 - 800 units - 8 months More than 800 units - 10 months Note: a) the resettlement notification is implemented in stages and it is not possible to complete the implementation of the whole urban environment project as Phase I work. The resettlement work will be divided into several stages and implemented in parallel and crosswise. b) .Completion of the resettlement work will be symbolized as the handover of the construction sites the project needs. This does not include the post-project work, the restoration, reconstruction and moving back of the PAPs to the original residential areas. ( 14) Resettlement schedule Since it is not yet the stage to determine the implementation schedule for each sewage pipe network, and the work scope to be covered by each resettlement notice has not been determined the schedule arranged here is for a normal condition, say, a 6 months implementation period. This schedule will be adjusted during the implementation based on the verified resettlement data. These people are non-native residents who rent the land of Liangtian Village for dealing with fish breeding and poultry rising. 2.3.3 Resettlement, compensation and rehabilitation measures 1) Since the layout management for this area is not strict, these houses will be compensated according to replacement price. 2) The affected people will be compensated with house-moving fee. 3) Relevant structures will be compensated as per replacement price. 4) The two families of non-native personnel will be assured to rent basically identical land from Liangtian Village (or neighbor villages) for fish breeding and poultry rising. I A Implementation Planning of Guangzhou Solid Waste Disposal Center 3.Status of the affected and the resettlement, compensation and rehabilitation plans for them 3.1 Basic situation of the affected Disadvantageous groups is not a really affected kind by project, it is a group of people needed special attention among all affected kinds. According to the scope definition about disadvantageous groups in 4.3.3 of "Resettlement Policy", the general conditions of the sub-item disadvantageous are groups as follow: According to the survey, there are 13 persons of 2 households to be affected and none of them belongs to the vulnerable group. The rest of the affected persons are all farmers in the villages where land is requested. However, all the nature villages in Guangzhou have transferred into the neighborhood committees. The system of production contracted to the household was not executed any more from as early as 2000. Therefore, the impact of the land requisition is only on the village collectives but not the individual peasant household. In addition, according to the land requisition procedure in Guangzhou the potentially affected villages will hold the meeting with all villagers to discuss about the issue only after the land requisition procedure starts. Therefore, at moment, it is not possible to find out whether there are any affected farmers belonging to the vulnerable group. 3.2 Resettlement, compensation and rehabilitation plans for the affected The Project will give the following helps to the affecteds besides the resettlement and compensation specified in the Resettlement Policy: 1) After the establishment of the solid waste disposal center, they will be, in a priority manner, arranged to deal with work that requires less technology or the work that can be done after training, such as handling, entrance guard, transportation driver and cleanness keeper, etc. 2) The Project will negotiate with villagers' committee to provide a certain job posts of the constructing industry park to the affected affecteds. 3) At the PAP's willing, the Project will help them to find proper jobs in the resettlement sites of sub-items, and will contact with the social labor authorities to provide appropriate community training, allowing them to deal with housekeeping, cleanness keeping and keeper. 4) The Project will pay attention to the affected(the elder who has no grown-up children to accompany, widow, single-parent family, the handicapped, chronic patient and poverty family), and will periodically pay a return visit to them and provide help for special difficulties after the project has been established. Implementation Planning of Guangzhou Solid Waste Disposal Center 4.Explanation on preparation of Resettlement and Compensation Standard for Guangzhou Urban Environmental Project 4.1 Compensation standard for land 4.1.1 Compensation standard for land requisition (please see Annexed Table 13.1.1) 1) Reference to compilation of compensation standard Reference to compilation of the standard: * Article 47 in Land Administration Law of the People's Republic of China; * Article 30 in Enforcement Method of Guangdong Province for Land Administration Law of the People's Republic of China; * Provisional Regulations on Compensation and Resettlement of Peasant Collective-owned Land Affected for Construction Land in Guangzhou (Opinion Requisition Version). 2) Determination of compensation base number According to the above regulations, the compensation base number is the average annual output of the requisition land in the previous three years. Due to the large range of the wastewater project which covers several villages in different districts, and presently, the district statistic bureaus can only provide the statistics data of partial villages, this compensation standard list only shows the compensation base numbers for the villages for which the statistics data have been provided. For the other villages, the base number for the adjacent village will be referred to for the base number determination (criteria has been provided in the list). 3) Land compensation fund * Calculation formula Land compensation fund=compensation base number X compensation times * Determination of compensation times For the reason that the wastewater project belongs to municipal project, the compensation fund may be on the low side. Thus, in this project, the method in "Provisional Regulations on Compensation and Resettlement of Peasant Collective-owned Land Affected for Construction Land in Guangzhou (Exposure Draft )" has been referred to so as to work out the resettlement allowance based on times. In this criteria, the compensation times is determined referring to the related regulation in "Provisional Regulations on Compensation and Resettlement of Peasant Collective-owned Land Affected for Construction Land in Guangzhou (Exposure Draft )" and is adjusted based on the following circumstances. * Resettlement allowance for plowland. Due to the large area, Baiyun District is subdivided. For Songzhoujie near to the urban district, 12-time will be adopted and 5-time for Taihe Town and Renhe Town far away from the urban district. 5-time is given for Liwan District in the original regulation, and 13-time is adopted in this project considering balancing it to that for the other old urban district. * Resettlement allowance for other agricultural land except plow land. 5-time is given as the calculation times for other agricultural land except, however, 3-5 times is provided in the provincial regulation. Institutional structure of the resettlement and the ability building 5.1 Arrangement of Resettlement organization The concrete arrangement of the resettlement organization of this sub-item is as follows: 1) Overall coordination unit of the PAP: Guangzhou Solid Waste Disposal Center 2) Internal monitor unit: Guangzhou Solid Waste Disposal Center 3) Independent surveillance unit: (to be determined) 4) Physical quantity investigation and social economy investigation unit: GZ Road Engineering and Expansion Office 5) Resettlement implementation unit: (to be finally determined) 6) Other relevant units: Guangzhou Urban Layout Bureau Guangzhou Land & House Administration Bureau Guangzhou Urban House Demolition Management Office Guangzhou People's Court Guangzhou Labor Bureau Town governments and villager's committees with the subitem-related resettlement area 5.2 Responsibilities of Resettlement Organization For the responsibilities of various resettlement organizations, see chapter 6 of Resettlement Policy. 5.3 Capability construction of resettlement organizations In order to allow resettlement organizations to be appropriately adjusted and strengthened according to the characteristics of Guangzhou Solid Waste Disposal Center, it is vital importance to further perfect and embody the capability construction of resettlement organizations. 5.3.1 Strengthening of Resettlement Organization 1) Retaining resettlement experts and advisors Being insufficient experience in resettlement, Guangzhou Solid Waste Disposal Center, which is the coordination unit of resettlement, will strengthen the resettlement management training as well as retain resettlement experts and advisors for identifying and solving any issue occurred. 2) Carrying out unified payment of compensation fund In order to allow the compensation fund to be timely and safely paid to Liangtian Village, the resettlement implementation unit is only responsible for the negotiation and subscription of the Compensation Agreement. And after the Compensation Agreement is signed, Guangzhou Solid Waste Disposal Center will directly pay the compensation fund to Liangtian Village. 3) Checking the operation of the compensation fund Because the compensation fund is directly paid to the Villager's Committee, the independent q I~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Implementation Planning of Guangzhou Solid Waste Disposal Center surveillance unit will check the utilization and effect of the compensation fund so as to ensure that the use of compensation fund is in favor of the improvement of the villager living standard or at least restoring to the standard prior to the land requisition. 4) Special project resettlement office Guangzhou Solid Waste Disposal Center will establish the Special Project Resettlement Office under its control. In addition to the daily resettlement coordination, this Office will focus on: * Helping the affected of the PAPs to contact relevant social security and aid agencies. * Contacting and introducing part of the villagers for work in the established Industry Park. * Responding to the grievances/appeal accepted by the Appeal Acceptance Group and making disposal. 5.3.2 Training plan for resettlement work personnel In order to allow the resettlement work of Guangzhou Solid Waste Disposal Center to better integrate with the requirement of the World Bank resettlement work, Guangzhou Solid Waste Disposal Center and the resettlement implementation units will make concrete training plans for the resettlement management personnel and implementation personnel by way of combining the characteristics of the sub-item. 1) Training plan for resettlement management personnel: * Resettlement laws and codes * Management theory and practice of resettlement project * Specific seminar on rural resettlement characteristics and key control points * Rural construction planning * Theory and method for rural resettlement surveillance and assessment (including the basic analysis technique for statistics data) * Planning and organization of the public participation, consultation and investigation * Reviewing succeeded rural resettlement projects 2) Training plan for resettlement implementation personnel: * Education on rural resettlement laws and codes * Education on World Bank OP/BP4.12 Guideline * Filling and input of standardized resettlement work statistics * Principle and technique for the public participation and consultation * Case analysis and simulation training for rural resettlement * Field training 3) Notices for the implementation of training plan: Although the resettlements work of this sub-item and the resettlement work of other three sewage treatment sub-items are under the management of the owners from different items, both of them belong to the sub-item of environment project. As the Owner of the project, Guangzhou Solid Waste Disposal Center will coordinate with Guangzhou Tunnel Development Co., Ltd to adopt the same training organization and experts as far as possible. 5.3.3 Resettlement work mode Implementation Planning of Guangzhou Solid Waste Disposal Center According to the comparison and analysis of economic contract and responsibility contract that is conducted in Resettlement Policy, the economic contract would possibly cause the Owner and the contractor to scrabble for interest, thus causing harm to the PAP's interest. The responsibility contract would make the both parties to focus their work on solving the problems encountered during resettlement, thus forming resultant force to promote the development of resettlement work. Particularly in this sub-item, Liangtian Village is in Baiyun District of Guangzhou city, far away from the downtown area, and so the quality of farmers is relatively low, and the knowledge of law is less, thus the farmers are easily satisfied. In this condition, the Owner of the project will adopt the work mode of responsibility contract so as to enforce the monitoring of the resettlement implementation unit and to ensure the farmers' interest. Implementation Planning of Guangzhou Solid Waste Disposal Center 6. Information disclosure plan 6.1 Information disclosure already unfolded The resettlement range of Guangzhou Solid Waste Disposal Center is relative concentrated compared to other three sewage sub-items. Therefore, the information disclosure activity is combined with the public participation. From August to September 2003 when the environment assessment of this project was conducted, the Owner and the environment assessment group stated the overview and significance of this project to the Villager's Committee and villagers of Liangtian Village while taking counsel with Liangtian Village. Meanwhile, the Owner of the project distributed Announcement for Collecting the Comments on Environmental Impact for the Project-Guangzhou Solid Waste Disposal Center to be Constructed, and post the relevant information on its website for the PAPs and other non-resettlement public to access. In October 2003, GZ Road Engineering and Expansion Office performed a social & economic situation investigation for the Liangtian Village where the land is to be affected, they brought this village with rural resettlement policy, laws and possible resettlement period while they were preliminarily understood the social & economic situation of this village. 6.2 Information disclosure plan in the next stage With the actual development of the resettlement work, the information disclosure activity will become more frequent and purposeful so as to match with the progress of the entire resettlement work. Meanwhile, the information disclosure often inosculates or crosses the public participation and consultation, therefore, for the next schedule of this work, see table 8-1 "Period Planning table of Information disclosure, Public Participation ( Consultation) and Monitoring & Assessment". Implementation Planning of Guangzhou Solid Waste Disposal Center 7. Public participation and consultation During the identification and preparation periods of the sub-item of Guangzhou Solid Waste Disposal Center, the design and environment protection departments visited the villagers of Liangtian Village and some of the units within the project-affected area, introduced the vision of the sub-item and widely collected and heard the comments of the affected people. After having compared the optional sites Xingfeng Village, Shantian Village and Liangtian Village, Liangtian Village of Baiyun District was finally determined to be the site in which the project is to be constructed on the base of full public participation and consultation. After the determination of the site, GZ Road Engineering and Expansion Office immediately performed an investigat ion to Liangtian Village, and heard the comment of the village cadres and villagers to the land requisition. Meanwhile, GZ Road Engineering and Expansion Office interviewed some of the large-scaled enterprises along the waste transportation line and heard the comments of the indirectly affected people, so as to give a consideration when preparing Resettlement Action Plan. 7.1 Public participation and consultation activities already unfolded 1) The public participation in siting: Environmental Protection Bureau in Baiyun District of Guangzhou performed a comment survey to Xingfeng site in the form of symposia on January 10, 2003. The participants of the symposium include: the government of Taihe Town, Environmental Protection Bureau, Land administration Bureau, Environmental Hygiene Bureau, layout Sub-bureau and the resident representatives of Xingfeng Village and Huifeng Village. The project environment assessment group of Guangzhou Environment Protection Scientific Research Institute held a small symposium in Liangtian Town on September 23, 2003, in which the public comment on the site to be selected (Liangtian Site) and the optional site (Shatian Site) was surveyed. The participants of the symposia include: the resident representatives of Shatian Village and Liangtian Village, and the rele.vant personnel of Liangtian Town. Through the symposium, the investigation comment on the construction project was obtained. 2) Participation of other public: in order to obtain the recommendation of other citizen to this project, the Owner of the project distributed Announcement for Collecting the Comments on Environmental Impact for the Project-Guangzhou Solid Waste Disposal Center to be Constructed, and post this announcement on its website for the public to access and to express opinions, so as to realize the participation of other public. 3) After Liangtian Town of Baiyun District was determined to be the site of the project, GZ Road Engineering and Expansion Office performed an investigation to Liangtian Village in October, 2003, and got to know the social & economic situation of this village, the impact of the land requisition on the production and life of the villagers, and the comment and suggestions of the villagers to the resettlement compensation. 4) Participation of the units along the solid waste transportation line: GZ Road Engineering and Implementation Planning of Guangzhou Solid Waste Disposal Center Expansion Office interviewed some of the units along the solid waste transportation line in October, 2003, and heard the comment of the indirectly affected people to the possibly potential impact, so as to realize the full participation of indirectly affected people. Xingfeng site is in Taihe Town. According to Guangzhou North Priority Strategy and Taihe Planning and Development, the green scientific & technological gallery to be constructed in this area would play inestimable adjustment role for Guangzhou atmosphere. After the establishment of the solid waste disposal center, the released waste gas and the to-and-fro waste transportation trucks would cause all-round negative impact to this area. There has been constructed a domestic waste landfill yard in Xingfeng. Because of large flow of garbage trucks, the wastewater flowing out of the garbage trucks and the dropped garbage make the road to become black and odorous and to emit repulsive odor, for which the local residents have bad opinions. Therefore, for the solution of construction of solid waste disposal center, the local villagers take issue with it. To sum up the above comments, Environment Protection Bureau of Baiyun District recommended that the solid waste disposal center be localized in another place. Comments about the Shatian Village site: Shatian Village has more than 9000 Mu of mountainous area, and its geographical environment is suitable for constructing landfill yard. The Villager's Committee of Shatian Village held a meeting for discussion and put this matter to the vote, and the passed by a unanimous vote. This indicated that the villagers are very pleased for the construction of the disposal center. Although the siting of Shatian Village obtained the support of local government and villagers, Guangzhou Urban Layout Bureau verified (Huigui[2003]401) that the siting was inconsistent with the overall urban layout, and this siting shall not be determined and constructed until professional department have dernonstrated and justified and adjusted according to legal procedures. Comments about the Liangtian Village: Liangtian Village has plenty of hill area and land, with population being above ten thousands. Since the 'I 7 Implementation Planning of Guangzhou Solid Waste Disposal Center income in this village is low, the villagers believe that the development of this area can promote the economic development; therefore, they support the construction of the disposal center in this village. With respect to the environment pollution after the establishment of the project, the villagers of Liangtian Village think there may be certain pollution, but if the construction and management of this project are strictly according to national standard, the environment pollution can be minimized, thus this village would be less affected. After site comparison and having fully taken counsel with the affected people, Liangtian Village of Baiyun District was finally determined to be the site for the project. 2) Determining the focus of the resettlement work within this project area After the social & economic investigation of the resettlement of Liangtian Village, the focus of the future resettlement work is determined: Most of the land to be affected this time is woodland, and only small part of it is infield, and so the land requisition does not involve the villager's houses, and impacts less on the production and life of the affected people. The villagers' income is a little low. According to the information supplied by the Villager's Committee, the per capita annual income was 6301yuan RMB (525yuan RMB/month) in 2002, slightly higher than the minimum living security line (422yuan RMB/month) of laid-off employee of Guangzhou city. Therefore, the villagers hope to build the road through this project and to obtain certain job opportunities after this project has been constructed. At present, an industry park is being constructed in Liangtian Village of Baiyun District. Therefore, the villagers hope to use the land compensation fund of this project to invest in the construction of this industry park, so as to promote the village's economic development. The villagers of this village are little educated and have weak legal consciousness. Therefore, the Villager's Conumittee hopes to be given more explanation and instructions on resettlement laws and policy in the next PAP participation activity. Also, the Villager's Committee hopes that the representatives of villagers can participate in various decision-making meetings of the project and understand the project schedule and work method so as to carry out surveillance to this project. 3) Collecting the comments of the affected people along the solid waste transportation line (1) The transportation trucks and technology used for the project shall meet relevant national regulations and technical standards, risk management system shall be established for responding to any unexpected accident along the line, relevant measures and systems shall be opened to the public and be supervised by the public. (2) For the greatly affected units along the line, after review and verification, the concerning departments shall take resettlement measures. 7.3 Public participation and consultation plan in the next stage Based on the above-mentioned public participation and consultation results, Guangzhou Solid Waste Implementation Planning of Guangzhou Solid Waste Disposal Center Disposal Center, the resettlement implementation units and independent surveillance organizations carried out purposeful public participation and consultation activities respectively so as to help the project management to continually improve resettlement plan and resettlement work, allowing the PAP's living standard to improve or to at least restore to the former standard prior to the construction of this project, these activities include: 1) Giving explanation to the villagers of Liangtian Village on Resettlement Policy, laws & codes and appeal procedure of this project so as to assure the lawful rights and interests of the villagers during resettlement. 2) As for arranging the villagers to work in the established Guangzhou Solid Waste Disposal Center, employment symposium shall be held to make the public know the possible employment posts and concrete post requirements, and relevant matter shall be discussed as well. 3) After the project has been established, the units along the solid waste transportation line shall be interviewed to hear the comments, and the consideration if a subsequent resettlement is needed shall be taken. Monitoring and evaluation 8.1 Internal monitoring The resettlement work of "Guangzhou Solid Waste Disposal Center" project has been received the internal monitoring from Guangzhou Solid Waste Disposal Center since the project was determined. In fact, Guangzhou Solid Waste Disposal Center has not only monitored all the first-phase preparations of resettlement work of the project, but also coordinated the work relation and content of relevant units. In addition, Guangzhou Solid Waste Disposal Center has actively participated in various concrete work related to the resettlement, including the preparing Resettlement Policy of the overall project and Resettlement Action Plan of the sub-item, as well as solving the problems encountered during the preparation of these reports. In the next stage, Guangzhou Solid Waste Disposal Center will continually carry out internal monitoring for the Liangtian Village resettlement work conducted by the resettlement implementation units, according to the arrangement of "Period Planning table of Information Disclosure, Public Participation (Consultation) and Monitoring & Assessment" and the specification, format and requirement specified in Resettlement Policy; and submit internal monitoring report to the World Bank according to the relevant specifications in Resettlement Policy. 8.2 Independent supervision At present, the candidates for the independent organizations initially determined by the general project are as follows: *The resettlement bureau of the yellow river conservancy committee Guangdong provincial social science academy *The Chinese race group study center of Zhongshan University The project employer will choose one of the above organizations as the independent supervision organization of the general project and the sub-item, after the confirmation and putting on the record of the World Bank. The independent supervision organization selected will do its work of independent supervision and evaluation according to the time planning table of " the opening of the information, public participation and consultation and the supervision and evaluation". Among which the main attentions are as follows: 1) Monitoring the use of the land compensation fund, namely, whether a democratic mode is adopted to determine the use of the compensation fund and whether there is any evidence of appropriation. 2) Monitoring the investment results of the land compensation fund and identifying whether the use of the compensation fund is in favor of the improvement of the villagers living standard. 3) Monitoring the pollution extent of the project to the surrounding environment after the project Implementation Planning of Guangzhou Solid Waste Disposal Center has been established and whether the health of the PAPs is affected. 8.3 Schedule of the information publishing, public participation and consultation and supervision and evaluation In the whole process of resettlement work, the activities of the opening of information, the public participation and consultation and the supervision and evaluation are done in interlude each other and the activities of opening information and public participation and consultation is the major measure of the supervision and evaluation. Therefore, the both can not be completely separated. The work content described in "information disclosure" and "public participation and consultation" is also the important content of "monitoring and assessment". For the overall arrangement of the next step, see table 8-1 "Period Planning table of Information Disclosure, Public Participation (Consultation) and Monitoring & Assessment". During the in-service use of table 8-1, the following items shall be paid with attention: 1) This period planning table will be appropriately adjusted according to the engineering schedule of Guangzhou Solid Waste Disposal Center sewage project. 2) The frequency and content of various work tasks listed in this table may be increased as required. 3) The independent surveillance organizations shall make annually detailed work plan by using this table as program. !~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Implementation Planning of Guangzhou Solid Waste Disposal Center 9. Cost estimate and fund plan of the project 9.1 Description of project estimate 1) The explanation of the land requisition and demolition budget (1) The problems of regions. The budget is established according to the price in the regions where the sub-item is dominantly located so as to avoid the complexity of data. The future compensation will also follow the practical standard. (2) The problems of depreciation. As the detailed investigation to find out the real intention has not been completed, the present cursory inspection showed that the fixed number of years of depreciation of the demolition houses is centered in the period of 5-20 years. (3) Houses with a record of use history and the temporary demolish compensation standard. The compensation standard of the house with a record of use history would be divided according to their floors and structures. The difference of floors leading to large difference of price therefore, the 3-5 floors price calculation is adapted. The temporary demolition is a kind of could -be built demolition so, the compensation standard is the repeat establishment price of construction. That is to say, it is the same as the houses with a record of use history compensation standard. The future compensation will also follow the practical standard. (4) The expense of knock down. The knock down expense criteria is divided according to the floors and structures. The difference of floors leading to large difference of price therefore, the 3-5 floors price calculation is adapted. The future compensation will also follow the practical standard. (5) The problems of temporary demolition expense. For the partially demolished houses, their temporary demolition square meters will be determined according the real conditions. If the budget could not be determined, it can be estimated according to 1.5 times by experience. (6) The problems of the time of temporary demolition. The temporary resettlement period for the partial demolished houses is set in half a year. The temporary resettlement period of the temporary requisition houses which will be rebuilt is set in one year. The temporary resettlement period of land, including the period of construction and rebuilding is set in half a year together. (9) The unpredictable expense: The unpredictable expense of pipeline transfer is calculated by 10%; the unpredictable expenses of demolition by 5%; and no unpredictable expenses for land requisition. (10) Fund planning: It includes the mature temporary building areas and the peccancy building areas, which will not get the compensation. (11) The problems of land compensation standard. Because the village boundary is not clear, the compensation standard is set according to the average value of the same kind of land in the same district. The compensation will be given according to the practical criteria after the village boundary is clear by the further inspection. (12) The problems of capital apportion. The capital is planned to be shared equally every month. At present, the construction schedule of each pipeline could not be determined for lacking of detailed material descriptions. Therefore, the time limit of demolition is temporarily set at half a year before the construction schedule to the start of construction. In Implementation Planning of Guangzhou Solid Waste Disposal Center (1) The project amount is estimated by the stat data of the pipeline electronic map of the planning bureau and the integrated unit price of the project is estimated by the Budget Estimate Indices for Demolition and Relocation Of Pipeline in Municipal Engineering of GZ Road Engineering and Expansion Office. (2) Because the data of the pipe line electronic map of the planning bureau is not full, much pipe line materials can not be known correctly, such as: the types of pipe channel, the number of pipe holes, the models of electric (light) cable, the installations in the transformer substation, the thickness of pipe wall, etc., all of them can not be known clearly. Then these data can only be estimated by the normal standard and the practical work experience in many years. (3) The estimated pipeline distance is mostly the direct distance of the would-be-transferred pipeline between the two pipe wells. In general cases, the length of the transferred pipeline is 1.2-1.35 times of direct distance. Considering that the pipe line transfer caused by the project is a zonal sewage pipe network, the transfer amount of the existing pipe line could be reduced by the optimization of design and the technical measure of engineering during the implementation of the sub-item. Therefore, the estimation of the project does not take the transfer as multiple. (4) Because of the reason above, the estimation of pipeline transfer is not accurate. Once it is examined and approved, it should not be adjusted at random.
