Status of collection of assessed contributions, including Member States in arrears in the payment of their contributions to an extent that would justify invoking Article 7 of the Constitution and Special arrangements for settlement of arrears: Ukraine Fifth report of the Programme, Budget and Administration Committee of the Executive Board to the Sixty-fourth World Health Assembly 1. The fourteenth meeting of the Programme, Budget and Administration Committee of the Executive Board was held in Geneva on 12 and 13 May 2011 under the chairmanship of Dr Ali Jaffer Mohamed (Oman).1 2. The Committee considered the status of collection of assessed contributions, including Member States in arrears in the payment of their contributions to an extent that would justify invoking Article 7 of the Constitution; and the special arrangements for settlement of arrears: Ukraine. 3. It was noted that the rate of collection of assessed contributions for 2010 was 93%.
4. The Committee also noted that Palau will now be able to vote in the upcoming Sixty-fourth World Health Assembly, as a result of its recent payments. In addition, payments by Belarus, Ghana, Kiribati and Peru meant that Article 7 of the Constitution need no longer be invoked with regard to those Member States. Accordingly, it was found that the relevant paragraphs of the resolution proposed in document A64/31 in respect of Article 7 of the Constitution should be amended. 5. In addition, it was noted that Ukraine has sought to reschedule the remaining balance of its rescheduled arrears, amounting to US$ 26 395 036, over a ten-year period, so that the final payment will be made in 2022 rather than 2018.

RECOMMENDATION TO THE HEALTH ASSEMBLY 6. The Committee recommended, on behalf of the Executive Board, that the World Health Assembly adopt the following amended draft resolution: The Sixty-fourth World Health Assembly, Having considered the fifth report of the Programme, Budget and Administration Committee of the Executive Board to the Sixty-fourth World Health Assembly on the Status of collection of assessed contributions, including Member States in arrears in the payment of their contributions to an extent that would justify invoking Article 7 of the Constitution;1 Noting that, at the time of opening of the Sixty-fourth World Health Assembly, the voting rights of Central African Republic, Comoros, Dominica, Guinea-Bissau, Somalia and Tajikistan were suspended, and such suspension was to continue until the arrears of the Member States concerned had been reduced, at the present or future Health Assemblies, to a level below the amount that would justify invoking Article 7 of the Constitution; Noting that Afghanistan, Grenada, Guinea and Kyrgyzstan were in arrears at the time of the opening of the Sixty-fourth World Health Assembly to such an extent that it was necessary for the Health Assembly to consider, in accordance with Article 7 of the Constitution, whether or not the voting privileges of those countries should be suspended, for Afghanistan and Kyrgyzstan at the opening of the Sixty-fourth World Health Assembly, and for the remaining two Member States at the opening of the Sixty-fifth World Health Assembly, DECIDES: (1) that in accordance with the statement of principles set out in resolution WHA41.7 if, by the time of the opening of the Sixty-fifth World Health Assembly, Grenada and Guinea were still to be in arrears in the payment of their contributions to an extent that would justify invoking Article 7 of the Constitution, their voting privileges shall be suspended as from the said opening; and in accordance with resolutions WHA59.6 and WHA61.8 if, by the time of the opening of the Sixty-fourth World Health Assembly, Afghanistan and Kyrgyzstan, respectively, were still to be in arrears in the payment of their rescheduled assessments, their voting privileges shall be suspended automatically; (2) that any suspension that takes effect as set out in paragraph (1) above shall continue at the Sixty-sixth World Health Assembly and subsequent Health Assemblies, until the arrears of Afghanistan, Grenada, Guinea and Kyrgyzstan have been reduced to a level below the amount that would justify invoking Article 7 of the Constitution; (3) that this decision shall be without prejudice to the right of any Member to request restoration of its voting privileges in accordance with Article 7 of the Constitution.

7. The Committee also recommended, on behalf of the Executive Board, that the World Health Assembly adopt the draft resolution contained in document A64/32, concerning special arrangements for settlement of arrears: Ukraine.
