The Chair drew the Committee’s attention to the relevant documents FCTC/COP/8/A/Conf.Paper No. 9, and three white papers. Item 6 (continued) Treaty instruments and technical matters Item 6.4 (continued) Progress report on technical matters related to Articles 4.2.d (gender issues) 5.3 (tobacco industry interference), 17 and 18 (alternative livelihoods and protection of the environment) and 19 (liability) The Chair recalled that the Committee suspended discussion of the draft decision on Article 5.3 as contained in document FCTC/COP/8/A/Conf.Paper No. 2 to allow the Secretariat to produce a white paper for the consideration. The Chair invited Iran, as a participant of the drafting group, to report on the progress that had been made on the proposed draft decision. Comments were then invited from the floor on the text of the white paper, as produced for consideration in the Committee session. The Head of the Secretariat responded to questions raised. The Secretariat, followed by the Legal Counsel, provided a point of clarification regarding FENSA. The Chair proposed the establishment of an informal drafting group, but this proposal was rejected by the Committee. Further comments were invited from the floor and the Parties agreed on the text as proposed in FCTC/COP/8/A/Conf.Paper No. 2. The draft decision was approved as amended. The Committee was invited to consider the draft decision contained in document FCTC/COP/8/A/Conf.Paper No. 4. At the request of the Chair, Brazil provided the committee with an update on the informal meeting which took place. The floor was opened for comments and in response to a comment from the floor, the Secretariat responded to a question raised concerning the budget. In the absence of further comments, the draft decision was approved as amended. Item 6.3 (continued) Progress report on technical matters related to Articles 9 and 10 (Regulation of contents and disclosure of tobacco products, including waterpipe, smokeless tobacco and heated tobacco products): report by WHO The agenda item was reopened. The Chair informed the Committee that a drafting group would convene under the leadership of the Vice-Chair, Dr Sungkyu Lee (Republic of Korea) that morning to discuss the draft decision in document FCTC/COP/8/A/Conf.Paper No. 1. The Committee was asked to consider the draft decision in document FCTC/COP/8/A/Conf.Paper No. 3. An informal drafting group met under the leadership of the European Union and was Chaired by the United Kingdom. A white paper was made available detailing the outcome of the drafting group’s discussions. In the absence of a representative of the drafting group, it was announced that consideration of the draft decision would be postponed until the next meeting of the Committee when the Party was available to report back to the Committee. Comments were invited from the floor and the Secretariat responded to issues raised. Conference of the Parties to the WHO Framework Convention on Tobacco Control • Eighth session – Geneva, Switzerland, 1–6 October 2018 Journal N° 6 • Saturday 6 October 2018 • Page 5 At the invitation of the Chair, the European Union provided an update on discussions concerning FCTC/COP/8/A/Conf.Paper No. 3. The Committee was informed that the informal drafting group was still meeting, but the Party would report back to the Committee concerning the current progress of the drafting group. The Chair of the drafting group (Canada) reported on the outcome of the morning drafting group meeting. It was noted that good progress had been made and a text would be made available to Committee members in the afternoon session. The meeting was adjourned. Seventh meeting of Committee B In the chair: Dr Nuntavarn Vichit-Vadakan (Thailand) Item 8 (continued) Budgetary and institutional matters Item 8.11 (continued) Procedure for the selection and evaluation of the new Head of the Convention Secretariat (restricted session) The Chair reopened this item requesting the Committee to discuss the amendments incorporated by the informal working group to the draft decision proposed by Canada and presented as a white paper to the Conference. The Chair invited New Zealand as the chair of the informal drafting group to introduce the white paper entitled Appointment of the Head of the Convention Secretariat and renewal of the term of office. Comments were invited from the floor and the Legal Officer responded to a point of order. At the request of the Chair, New Zealand (Chair of the informal drafting group) reported that the text of the draft decision would be submitted to the Bureau(s) of the COP and MOP. Consideration for the upgrade of the position would be deferred to COP9. After extensive discussions the Committee was invited to consider the debated text and the Legal Officer provided additional information. The Committee was invited to comment on each preambular and operative paragraph, as well as the Annex. The Legal Officer provided information on a procedural matter. One Party requested to suspend consideration of the draft decision, pending the outcome of a bilateral consultation. The Chair suspended the discussion and invited the Parties to endorse the draft decision on Expression of Appreciation, declaring Dr Haik Nikogosian as Head of the Convention Secretariat Emeritus. The decision was adopted. The Chair announced the order of discussion of items in the afternoon. The Committee would start with item 8.2 (consulted in working group), followed by item 8.4 (arrears), item 8.3 (workplan and budget); Item 8.8 and then item 8.12 The Philippines, also as a point of order and with reference to the issue of submission of their credentials requested the Convention Secretariat for a letter of apology. The Chair promised to take action on this. The meeting was adjourned. In response to a question from the floor, the Chair explained that consideration of item 6.3 would be deferred to allow for the preparation of a white paper to facilitate the drafting group’s deliberations on the draft decision as contained in FCTC/COP/8/A/Conf.Paper No. 1. Item 7 (continued) Reporting, implementation assistance and international cooperation Item 7.3 (continued) Tobacco control in emergency situations (item proposed by a Party) The Chair invited the Chair of the informal draft group, Vice-Chair Dr E. Alalawi (Bahrain), to report back to the Committee on the group’s progress and introduced the proposed text. In response to a comment from the floor, the Chair requested the Legal Counsel to provide clarification on the use of specific terminology and proposed some appropriate text concerning the phrase “declaration of a complex emergency”. This proposal was accepted by the Committee. The draft decision, as prepared by the drafting group was approved as amended by consensus. The agenda item was closed. Item 7.2 (continued) Progress report implementation assistance and international cooperation The Chair reopened the agenda item and invited Ecuador, as sponsor of this draft decision, to report on the progress made by the informal drafting group. A new document, FCTC/COP/8/A/Conf.Paper No. 9, taking into account the amendment proposed by Parties, was presented to the Committee. The Chair invited Ecuador to report on the progress made and comments were invited from the floor. In the absence of a consensus, the Chair commented on the need for an informal drafting group. The Secretariat announced that the drafting group could convene immediately in Room 15 with a view to reporting back to the Committee later in the session. The agenda item remained open. Item 6 (continued) Treaty instruments and technical matters Item 6.3 (continued) Progress report on technical matters related to Articles 9 and 10 (Related At the invitation of the Chair, the Vice-Chair Dr Sungkyu Lee (Republic of Korea) provided an update on the status of the drafting group to discuss the draft decision as contained in document FCTC/COP/8/A/Conf.Paper No. 1. The Vice-Chair read out the draft decision, as presented in the group’s white paper, which was approved by consensus. At the invitation of the Chair, the European Union (as co-sponsor of the draft decision) reported back on deliberations. In response to a point of order, the Secretariat responded to issues raised concerning the availability of translated documents. The floor was then opened for comments. The draft decision was approved as amended by consensus. The meeting was adjourned. The Committee was asked to consider the revised document Proposed workplan and budget for the financial period 2020–2021 As requested by the Chair in the previous meeting, the Secretariat presented the proposed workplan and budget. The Parties welcomed the report and the Chair opened the floor for comments. The Chair responded to a question from the floor concerning how the Medium- Term Strategic Framework (MTSF), adopted in Committee A, would be financed. The Chair invited the Head of the Secretariat to respond to a question concerning funding and sharing of costs of the Convention Secretariat staff and staff sharing between the COP and MOP. The Chair announced that discussion of this draft decision would continue during the next session of Committee B. Item 8.2 (continued) Maximizing transparency of delegations from Parties and observers to the Conference of the Parties, its subsidiary bodies and other WHO FCTC meetings The Chair drew the Committee’s attention to the new draft decision contained in document FCTC/COP/8/B/Conf.Paper No.2 (Rev.2), as proposed by Maldives and Myanmar. Comments were invited from the floor. At the invitation of the Chair, the Maldives, one of the proponents of the decision. took the floor to respond to issues raised on declarations of interest and submission of résumés. One Party suggested that COP should consider looking at the form to remain vigilant about tobacco industry strategies. In response to a query about whether a representative of an intergovernmental organizations (IGOs) should sign a declaration on behalf of the IGOs or himself, the Chair confirmed that a declaration is signed by a representative as an individual. The Chair announced that due to time constraints, the consideration of the item would resume at the next meeting of the Committee. The meeting was adjourned. The draft decision was adopted, as amended, thus closing the agenda item. Item 8.2 (continued) Maximizing transparency of delegations from Parties and observers to the Conference of the Parties, its subsidiary bodies and other WHO FCTC meetings The Chair reopened this agenda item and asked the Committee to consider the revised version of the draft decision contained in document FCTC/COP/8/B/Conf.Paper No. 2 (Rev. 2). In response to a question from the floor, the Legal Officer provided some explanatory remarks on compliance and domestic legislation. In the absence of a consensus, the Chair proposed that interested Parties get together in the room for an informal exchange to resolve the issue and agree on appropriate wording. Discussion on this item was suspended pending receipt of the outcome of this working group. Item 8.3 (continued) Proposed workplan and budget for the financial period 2020–2021 The Committee was invited to consider the white paper on item 8.3 containing the updated version of the draft decision. The changes introduced by a few Parties were considered, and then accepted and the draft decision was adopted, as amended. The agenda item was closed. Item 8.8 (continued) Possible amendments to the Rules of Procedure of the Conference of the Parties The Chair drew the Committee’s attention to the two draft decisions under this item, one from the Convention Secretariat, as agreed by the Bureau, and another, proposed by Canada, contained in document FCTC/COP/8/B Conf.Paper No. 3. The representative from Canada, invited to introduce the draft decision, highlighted the differences between his country’s proposed decision and those proposed by the Bureau. It has been agreed to use the Canada proposal as basis for negotiation. Comments were invited from the floor and the Legal Officer responded to issues raised and clarified and rule of procedure. After a lengthy discussion the draft decision was adopted, as amended. The outstanding issue was sorted out and the draft decision was adopted, as amended. Item 8.1 (continued) Performance and Progress reports a. done earlier b. done earlier c. Progress report on hosting terms between the Convention Secretariat and WHO The Chair reopened this item with consideration of the white paper containing the draft decision proposed by Maldives on Hosting arrangements between the Convention Secretariat and WHO. At the invitation of the Chair, Australia, that has submitted amendments to the original text proposed by the Maldives, introduced the proposed changes. Some Parties supported the changes proposed by Australia. The draft decision, was adopted as amended and the item closed. It gives quick access to the official documents, basic documents and all the practical information that participants need for taking part in COP8. Social Media Accounts Delegates are encouraged to raise awareness about COP8 as well as the WHO FCTC including the importance of its implementation through social media. The Bureau of the COP decided to suspend the accreditation of two journalists after some elements were brought to the attention of the Bureau in relation to the veracity of the information provided by the journalists in their « Declaration of Interest » form that they were required to fill when registering to obtain their accreditation to the eighth session of the Conference of the Parties to the WHO Framework Convention on Tobacco Control. The only distribution of documents considered official is the distribution of documents through the documentation desk of the WHO FCTC Secretariat. The WHO FCTC Secretariat regrets that it cannot dispatch documents home on behalf of participants at the conclusion of the session. Payment of per diem (for countries who have not received per diem by bank transaction) Delegates entitled to payment of a per diem in connection with their participation in COP8 (one delegate from each least developed country), and whose travel has been arranged by the WHO FCTC Secretariat, should contact the per diem office no. 222 on the second floor of the Conference Centre.
