Fourth meeting of Committee B

Chair: Item 6 Item 6.5

Reporting, implementation assistance and international cooperation Promoting South–South cooperation for implementation of the Convention The Chairman opened this subitem and invited the Committee to consider document FCTC/COP/4/18 and the draft decision submitted by Palau contained in document FCTC/COP/4/B/Conf.Paper No.3. The Convention Secretariat and WHO TFI gave clarifications to points raised. There were several interventions from the floor in support of the draft decision. The item was suspended.

Budgetary and institutional matters Proposed workplan and budget for the financial period 2012–2013 The Chairman opened the debate on this item and invited Brazil to report on the discussion of the contact group. A general debate followed with interventions from the Secretariat to provide clarifications on questions raised. The Chairman then invited the European Union to introduce the draft resolutions contained in documents FCTC/COP/4/B/Conf.Paper No.4 and FCTC/COP/4/B/Conf.Paper No.5. An extensive debate took place after which the meeting was suspended.

In the chair: Mr Thamsanqa Dennis Mseleku President of the Conference of the Parties Budgetary and institutional matters Process related to the renewal of the contract (or otherwise) of the current Head of the Convention Secretariat and to future appointments and renewals The President informed the Conference that decision FCTC/COP/4/6, discussed during a restricted session of the plenary, has been adopted by the Conference of the Parties and requested that regional coordinators submit the names of candidates for the evaluation panel.

Progress reports of Committees A and B The President called upon the Chairpersons of Committees A and B who reported on progress made by each Committee.

Review of the role of the Bureau of the Conference of the Parties The President invited the Conference to consider the decision contained in documents FCTC/COP/4/26 and FCTC/COP/4/Conf.Paper No.2. The decision was adopted as amended.

Item 7.6

Date and venue of the fifth session of the Conference of the Parties The President informed the Conference that the Secretariat had received expression of interest from the Republic of Korea to host the fifth session of the Conference of the Parties. The delegate of the Republic of Korea was invited to speak. The President said that there was no objection in principle to holding COP4 in the Republic of Korea. The Conference would decide on that, and on the date, at the next plenary meeting.

Reporting, implementation assistance and international cooperation The Chairman resumed discussion of this subitem. As there were no comments from the floor, the decision was adopted as amended.

Item 6.3 (continued) Financial resources and mechanisms of assistance The Committee was invited to consider the draft document FCTC/COP/4/B/Conf.Paper No.2 Rev.1 submitted by the working group. The decision was adopted as amended. Item 7 Budgetary and institutional matters The Chairman invited the Committee to consider the decision entitled: “Arrears in the payment of financial contributions” contained in document FCTC/COP/4/B/Conf.Paper No.5. The decision was adopted as amended. The debate resumed with consideration of document FCTC/COP/4/Conf.Paper No.4 entitled: “Harmonization of travel support available to Parties to the WHO Framework Convention on Tobacco Control in line with current World Health Organization administrative policies for travel support”. Discussion on this subitem was suspended to allow consultation among regions and Parties. The meeting was adjourned. Sixth meeting of Committee B

Item 6.4 (continued) Cooperation with international organizations and bodies for strengthening implementation of the Convention The delegate of Canada was invited to report on discussion with other delegations. The decision was adopted without amendments. Item 7 Item 7.9 Budgetary and institutional matters Coordination between WHO’s Tobacco Free Initiative and the Convention Secretariat The Chairman gave the floor to the Legal Counsel who read out the statement of the WHO Director-General. Item 7.3 (continued) Proposed workplan and budget for the financial period 2012–2013 The Secretariat was requested to submit a draft resolution on this item for consideration at the next meeting of Committee B. Treaty instruments and technical matters Guidelines for implementation of Articles 9 and 10 of the Convention: “Regulation of the contents of tobacco products” and “Regulation of tobacco product disclosures” New Zealand, as Chair of the open-ended working group, was invited to report to Committee A. The Chairperson detailed the six proposals contained in document FCTC/COP/4/A/Conf.Paper No.7 after which.she opened the floor for debate. Because of the different views on this issue, it has been decided to break for a few minutes in order for delegations to reach a consensus. When the meeting resumed, a group of delegations came up with a concrete proposal and the draft decision was adopted as amended.

Technical report on price and tax policies (in relation to Article 6 of the Convention) Discussions on document FCTC/COP/4/A/Conf.Paper No.5 resumed and after a short debate the draft decision was adopted as amended.

Item 5.8

Control and prevention of smokeless tobacco products and electronic cigarettes The Secretariat made a brief presentation on this topic contained in document FCTC/COP/4/12 and the floor was opened on the draft decision shown on screen. The Secretariat was invited to produce a paper to be presented to the next plenary meeting after which the item was suspended.

Item 5.9

Implementation of Article 19 of the Convention: “Liability” The Chairperson called upon Palau to present the agenda item contained in document FCTC/COP/4/13 after which a short discussion followed. It was decided that the Secretariat prepare a draft decision to be discussed at the next plenary meeting.

Item 6.2

Standardization and harmonization of data and data collection initiatives The Secretariat made a presentation on the report contained in document FCTC/COP/4/15. A short discussion started on the draft decision contained in document FCTC/COP/4/A/Conf.Paper No.6.
