Matters identified in decisions taken by the Conference of the Parties that call for action in the period between its first and second sessions Reporting and exchange of information1 1. The Conference of the Parties, at its first session in February 2006, decided to adopt provisionally the format for the submission of national reports as set out in the reporting instrument of the Annex to decision FCTC/COP1(14), pending further consideration at its next session. 2. This Annex outlines a proposed approach to reporting by the Parties and gives details of the three groups of questions in the reporting instrument. Group 1 covers core areas including legislation, taxation and funding for implementation activities; Groups 2 and 3 contain more complex or detailed questions. Each Party is required to report on all core Group 1 questions within two years of entry into force of the Convention for that Party; on all Group 2 questions within five years of entry into force; and on Group 3 questions within eight years of entry into force of the Convention for that Party. 3. In order to facilitate the reporting process, the first session of the Conference of the Parties nominated two Parties, Australia and Canada, to facilitate completion of the reporting instrument. To that end they have prepared, in consultation with the Convention Secretariat, a set of instructions which are included as annotations in a column on the right-hand side of the pages of the reporting instrument. The tables and questions in the reporting instrument remain exactly as adopted in decision FCTC/COP1(14). The reporting instrument, its objectives, and instructions in its use are set out in Annex I of this document. 4. As indicated in the Annex to decision FCTC/COP1(14), it is expected that the Convention Secretariat will provide an analysis of the progress being made internationally in implementation of the Convention. This summary should be provided annually as from 2007 and should seek to reflect international and regional progress; highlight significant achievements; and reflect the spirit of shared learning. Progress will be assessed by the Conference of the Parties regionally and globally on the basis of reports received. 5. In accordance with Rule 8 of the Rules of Procedure of the Conference of the Parties, the provisional agenda for each regular session, together with other conference documents, must be distributed in the official languages, by the Convention Secretariat to the Parties and to observers 1

invited to attend the session in accordance with Rules 29, 30 and 31, at least 60 days before the opening day of the session. The second session of the Conference of the Parties will open on 30 June 2007; all conference documents must therefore be distributed by 1 May 2007. In view of the time needed to prepare documentation, the deadline for submission of reports by parties is 27 February 2007. Reports received by the Convention Secretariat after that date will not be included in its report to the second session. They will, however, be available for review at the second session in English, if possible, otherwise in the language in which they are submitted. Annex 2 to this document lists the 40 Parties required to report by 27 February 2007. Annex 3 lists the 21 Parties required to report after that deadline but before the opening of the second session. 6. In preparing their reports, Parties should be mindful of the opportunities for shared learning and, where appropriate, should include examples of best practice or e-mail contact details of someone who would be able to provide further information on particular aspects of implementation. 7. In filling out the reporting instrument, Parties should provide information in the requisite format for the sake of consistency and ease of data processing and analysis. Electronic versions of the instrument and instructions1 will be available online as a web-based interface, and in a downloadable format, in advance of the 27 February 2007 deadline. In keeping with the decision of the Conference of the Parties, the Convention Secretariat encourages all Parties to use the electronic format rather than completing the form by hand.

ANNEX 1 PROGRESS REPORT FOR THE CONFERENCE OF THE PARTIES TO THE WHO FRAMEWORK CONVENTION ON TOBACCO CONTROL Reporting Instrument as adopted by decision FCTC/COP1(14) and instructions The Progress Report for the Conference of the Parties provides information on how Parties to the WHO Framework Convention on Tobacco Control are progressing in implementing the Convention. Completion of the progress reports is required under Article 21 – Reporting and Exchange of Information.
OBJECTIVE OF THE PROGRESS REPORT FOR THE CONFERENCE OF THE PARTIES To understand and learn from each other’s experiences in implementing the WHO Framework Convention on Tobacco Control through the submission of national reports from each member country.
FREQUENCY AND TIMING OF THE REPORTS As agreed at the first session of the Conference of the Parties (6 – 17 February 2006) a graduated reporting system will be implemented. As such, reports will be separated into three (3) Groups. Group 1 (for which questions have been developed) – relates to core data items including legislation, taxation and funding for implementation activities.
Group 1
Parties are to report against all Group 1 core questions within two years of entry into force of the Convention for that Party. This is the minimum reporting requirement. Parties may also choose to report against selected optional questions, as indicated.
Group 2 and Group 3 (questions will be developed at the second session of the Conference of the Parties) – and will expand on Group 1 questions.
Group 2
Parties are to report against all Group 2 core questions within five years of entry into force of the Convention for that Party. This is the minimum reporting requirement at that time. Parties may also choose to report against selected optional questions as will be indicated when the Group 2 reporting questions are provided. Parties are to report against Group 3 core questions within eight years of entry into force of the Convention for that Party.

All reports are to be submitted to the Convention Secretariat.

This process allows reports to be staggered in their submission to the Convention Secretariat, rather than all Parties’ reports being due at the same time. When preparing reports, Parties should be mindful of the opportunities for shared learning and are required to submit examples of best practice and/or contact details for further information.
SUBMISSION OF THE REPORT Parties will provide reports in one of the six official languages of the Conference of the Parties,1 and shall not expect the Convention Secretariat to provide translations. However, it is expected that the Convention Secretariat, in considering the reports, will make available summaries or analyses of reports which focus on significant achievements or areas where information sharing could be valuable. These summaries will be provided in the six official languages.
ASSISTANCE TO DEVELOPING ECONOMY COUNTRIES AND COUNTRIES WITH ECONOMIES IN TRANSITION (SECTION 7: TECHNICAL AND FINANCIAL ASSISTANCE) In this section of the report, Parties should report on: • their ability to provide assistance, both financial and technical, in the case of development partners, as well as assistance already provided; or • their assessed areas of need and the extent to which these are being met (or otherwise), and estimates of assistance, both technical and financial required to enable them to move to the next reporting group, in the case of developing economies and economies in transition. This could also include relevant information about any constraints or barriers to implementation as well as the assistance already received/provided. In addition, the Convention Secretariat will operate as a clearinghouse seeking to facilitate coordination of available skills and resources with identified needs. In the first instance, the Convention Secretariat will manage this process within regions, to allow more efficient operation and greater understanding within regions.
FEEDBACK ARRANGEMENTS To facilitate access to examples of best practice in specific areas of tobacco control, all Parties’ reports are to be available on a web site and arranged under the headings – Two Year Reports, Five Year Reports and Eight Year Reports to enable Parties to understand the progress being made internationally in implementing the WHO Framework Convention on Tobacco Control. This web site will allow access by

non-ratifying countries which may be seeking information to allow them to take effective steps in tobacco control. This is consistent with the objective to learn from each other’s experience. The Convention Secretariat will provide feedback to each reporting Party. The Secretariat will also provide an analysis of the progress being made internationally in implementation of the Convention. Such a summary should be provided annually commencing in 2007 and should seek to: • reflect international and regional progress; • highlight significant achievements; and • reflect the spirit of shared learning. It is further suggested that existing WHO regional group meetings provide an opportunity to share learning and obtain feedback from other Parties on their progress in implementing the WHO Framework Convention on Tobacco Control. Progress will be assessed by the Conference of the Parties regionally and globally based on reports received and analysed by the Secretariat. It should be noted that the items identified in the Annex are not exhaustive, but reflect the spirit and intent of the Convention. 4. (a)
Taxation Please provide your rates of taxation for tobacco products for all levels of government, and be as specific as possible (specify the type of tax: excise, VAT or sales, import duties) (ref. Article 6.3).
The Taxation section refers to: Article 6.3: The Parties shall provide rates of taxation for tobacco products and trends in tobacco consumption in their periodic reports to the Conference of the Parties, in accordance with Article 21. Article 6.2: Without prejudice to the sovereign right of the Parties to determine and establish their taxation policies, each Party should take account of its national health objectives concerning tobacco control and adopt or maintain, as appropriate, measures which may include: (a) implementing tax policies and, where appropriate, price policies, on tobacco products so as to contribute to the health objectives aimed at reducing tobacco consumption. Question 4 is mandatory (a) It is important that you are as specific as possible.
