Rules of procedure 5 Preamble These Rules of Procedure are adopted under the authority of Chapter XI of the Constitution of the World Health Organization. I. Membership and attendance Rule 1 The Regional Committee (hereinafter referred to as “the Committee”) shall consist of representatives (hereinafter referred to as “the representatives”), one each from the Member States forming the Eastern Mediterranean Region (hereinafter referred to as “the Region”) of the World Health Organization (hereinafter referred to as “the Organization”). The representatives may be accompanied by alternates and advisers. Rule 2 Subject to the terms of any existing agreements, the Committee may arrange for consultation outside the Organization with the respective regional bodies of the United Nations and with those of other specialized agencies and with other international regional organizations having interests in common with the World Health Organization and for their participation, without vote, in its discussions. The Regional Director, in consultation with the Regional Committee, may invite States not members of the Committee to participate without vote in the sessions of the Committee. Non-State actors admitted into official relations with the World Health Organization pursuant to the Framework of Engagement with Non-State Actors are invited to participate in the sessions of the Regional Committee, as provided for in paragraph 55 of the Framework. The Regional Committee may also adopt a procedure granting accreditation to other international, regional and national non-State actors not in official relations with the World Health Organization to participate in its meetings, provided that the procedure is managed in accordance with the relevant provisions of the Framework of Engagement. 6Regional Committee for the Eastern Mediterranean II. Credentials Rule 3 The Member States shall communicate to the Regional Director, not less than fifteen days before the date fixed for the opening of the session of the Committee, the name of their representatives, including all alternates and advisers. Similarly, the organizations and States referred to in Rule 2 invited to be represented at the session shall communicate the names of the persons by whom they will be represented. The credentials of representatives and names of alternates, advisers and observers shall be submitted to the Regional Director if possible not less than two days before the opening of the session of the Regional Committee. Such credentials shall be issued by the Head of State or Government, the Minister for Foreign Affairs, the Minister of Health or any other competent authority. Rule 3 bis The officers of the Regional Committee shall examine the credentials of representatives and report thereon to the Regional Committee. Any representative to whose admission a Member has made objection shall be seated provisionally with the same rights as other representatives, until the officers have reported and the Regional Committee has given its decision. Rules of procedure 7 III. Sessions Rule 4 The Committee shall meet in regular annual session. It shall determine at each regular session the date and place of the next session. Notices convening the Committee shall be sent by the Regional Director at least six weeks before the commencement of the session to the Member States, to the Director-General of the Organization (hereinafter referred to as “the Director-General”), and to the organizations referred to in Rule 2 invited to be represented at the session. Rule 5 The Committee may meet in such special sessions as may be necessary. The Regional Director, in consultation with the Chairperson of the Committee (hereinafter referred to as “the Chair”) shall also convene the Committee in special session following a decision of the Committee or at the joint request of any five Member States, addressed to him or her in writing and stating the reason for the request. In this case, the Committee shall be convened within thirty days following receipt of the request, and the session shall be held at the Regional Office unless the Regional Director, in consultation with the Chair, determines otherwise. The agenda of such a special session shall be limited to the questions having necessitated that session. Rule 6 The meetings of the Committee shall be held in public, unless the Committee decides otherwise. 8Regional Committee for the Eastern Mediterranean IV. Agenda Rule 7 The provisional agenda of each regular session shall be drawn up by the Regional Director in consultation with the Chair. It shall be dispatched by the Regional Director to the Member States and the Director-General at least six weeks before the commencement of the session together with the notice of convocation. Rule 8 The provisional agenda of each regular session of the Committee shall include, inter alia: a) all items the inclusion of which has been prescribed by the World Health Assembly (hereinafter referred to as “the Health Assembly”); b) all items the inclusion of which has been prescribed by the Executive Board of the Organization; c) all items the inclusion of which has been prescribed by the Committee; d) any item proposed by the Director-General or Regional Director; e) any item proposed by a Member State in the Region. Proposals under item (e) above should be received by the Regional Director at least eight weeks prior to the commencement of the session. Rule 9 Subject to the provisions of Rule 5, the Regional Director may, in consultation with the Chair include any question suitable for the agenda which may arise between the dispatch of the provisional agenda and the opening day of the session in supplementary agenda, which the Committee shall examine together with the provisional agenda. Rules of procedure 9 V. Officers of the committee Rule 10 The Committee shall elect its officers, a Chair and two Vice-Chairs from among the representatives each year at its first session held during that year. The officers shall hold office until their successors are elected. The Chair shall not become eligible for re-election as Chair until two years have elapsed since he or she ceased to hold office. Rule 11 In addition to exercising the powers which are conferred upon him or her elsewhere by these Rules, the Chair shall declare the opening and closing of each meeting of the Committee, shall direct the discussions, ensure observance of these Rules, accord the right to speak, put questions and announce decisions. He or she shall rule on points of order and, subject to these Rules, shall control the proceedings at any meeting and shall maintain order thereat. Rule 12 If the Chair is absent from a session or a meeting or any part thereof he or she shall designate one of the Vice-Chairs to preside. If the Chair is unable to make this designation, the Committee shall appoint one of the Vice-Chairs to preside during the session or meeting. If neither the Chair nor the Vice-Chairs are available to preside at a session or a meeting, the Committee shall have the power to elect a Deputy-Chairperson to preside for such portion as is necessary. Rule 13 If the Chair for any reason is unable to complete his or her term of office, one of the Vice-Chairs shall act in his or her place. The order in which the Vice-Chairs shall be requested to serve shall be determined by lot at the session at which the election takes place. Rule 14 The Chair or Vice-Chair acting as Chair, shall not vote but may, if necessary, appoint an alternate from his or her delegation to act as representative of his or her government. 10 Regional Committee for the Eastern Mediterranean VI. Reports of sessions Rule 15 The drafting committee, supported by the Secretariat, shall prepare a draft report of the Committee for consideration and adoption before the end of each session. The final report of each session in the working languages, including resolutions, recommendations and other important decisions, with details of voting, if any, shall be communicated by the Regional Director to the Member States and to the Director-General. Rules of procedure 11 VII. Subcommittees of the committee Rule 16 The Committee may establish such subcommittees as it may deem necessary for the study of, and to report on, any item on its agenda. The Committee shall review from time to time, and in any case at its regular session, the need to maintain any subcommittees established under its authority. 12 Regional Committee for the Eastern Mediterranean VIII. Secretariat Rule 17 The Regional Director, by virtue of the authority delegated to him or her by the Director-General pursuant to Article 32 of the Constitution, shall act as the Secretary of the Committee and of any committees or subcommittees thereof. The Regional Director may delegate these functions. Rule 18 The Regional Director shall report to the Committee on the technical, administrative and financial implications, if any, of all agenda items submitted to the Committee. Rule 19 The Director-General or the Regional Director, or a member of the Secretariat designated by either of them as his or her representative, may at any time make either oral or written statements concerning any question under consideration. Rule 20 The Secretariat shall furnish support to the Committee by providing information, text processing and secretarial services as may be required for the work of the Committee. Rules of procedure 13 IX. Languages Rule 21 Arabic, English and French shall be official and working languages. Rule 22 Speeches made in one of the official languages shall be interpreted into the other official languages unless, in consultation with the Chair, all Member States agree otherwise in advance of the session. Rule 23 Any representative may speak in a language other than an official language. In this case he or she shall provide for interpretation into one of the official languages, from which the interpretation into the other official languages may be derived. Rule 24 All resolutions, recommendations and other important decisions of the Committee shall be drawn up in the working languages. 14 Regional Committee for the Eastern Mediterranean X. Conduct of business Rule 25 A majority of the Member States represented at any session shall constitute a quorum for the conduct of business at meetings of the Committee. Rule 26 No representative may address the Committee without having previously obtained the permission of the Chair. The Chair shall call upon speakers in the order in which they signify their desire to speak. The Chair may call a speaker to order if the speaker’s remarks are not relevant to the subject under discussion. Rule 27 Any representative may at any time request his or her alternate designated in accordance with Rule 3 to speak and vote on his or her behalf on any question. Moreover, upon the request of the representative or his or her alternate, the Chair may allow an adviser to speak on any particular point without the right to vote. Rule 28 During the discussion of any matter a representative may rise to a point of order and the point of order shall be decided by the Chair before continuing with the other business of the session. A representative may appeal against the ruling of the Chair in which case the appeal shall immediately be put to the vote. A representative rising to a point of order may not speak on the substance of the matter under discussion but on the point of order only. Rule 29 During the course of discussion of any item, the Chair may propose to the Committee a limitation of the time allowed to each speaker. The Chair may announce a list of speakers and, with the consent of the Committee, declare the list closed. He or she may, however, accord the right of reply to any representative if in the Chair’s opinion a speech delivered after the Chair has declared the list closed makes a reply desirable. Rules of procedure 15 Rule 30 During the discussion of any matter, a representative may move the suspension or the adjournment of the meeting. Such motions shall not be debated but shall immediately be put to the vote. For the purpose of these Rules “suspension of the meeting” means the temporary postponement of the business of the meeting and “adjournment of the meeting” the termination of all business until another meeting is called. Rule 31 During the discussion of any matter, a representative may move the adjournment of the debate on the item under discussion. In addition to the proposer of the motion, one speaker may speak in favour of, and one against, the motion, after which the motion to adjourn debate shall immediately be put to the vote. Rule 32 A representative may at any time move the closure of the debate on the item under discussion whether or not any other representative had signified his or her wish to speak. If a request is made for permission to speak against closure, it may be accorded to not more than one representative, after which the motion shall immediately be put to the vote. If the Committee is in favour of the motion, the Chair shall declare the closure of the debate. The Committee shall thereafter vote only on the one or more proposals moved before the closure. Rule 33 The following motions shall have precedence in the following order over all other proposals or motions before the meeting, except a point of order: a) to suspend the meeting; b) to adjourn the meeting; c) to adjourn the debate on the item under discussion; and d) for the closure of the debate on the item under discussion. 16 Regional Committee for the Eastern Mediterranean Rule 34 Subject to Rule 33, any motion calling for a decision on the competence of the Committee to adopt a proposal submitted to it shall be put to the vote before a vote is taken on the proposal in question. Rule 35 A representative may move that parts of a proposal or of an amendment shall be voted on separately. If objection is made to the request for division the motion for division shall be voted upon. Permission to speak on the motion for division shall be given only to two speakers in favour and two speakers against. If the motion for division is carried, those parts of the proposal or of the amendment which are subsequently approved shall be put to the vote as a whole. If all operative parts of the proposal or the amendment have been rejected, the proposal or the amendment shall be considered to have been rejected as a whole. Rule 36 When an amendment to a proposal is moved, the amendment shall be voted on first. When two or more amendments to a proposal are moved the Committee shall first vote on the amendment deemed by the Chair to be the furthest removed in substance from the original proposal and then on the amendment next removed therefrom, and so on, until all the amendments have been put to the vote. Where, however, the adoption of one amendment necessarily implies the rejection of another amendment, the latter amendment shall not be put to the vote. If one or more amendments are adopted, the amended proposal shall then be voted upon. If an amendment to a proposal has been accepted by the original proposer, such an amendment shall be deemed to be an integral part of the original proposal and no separate vote shall be required thereon. A motion is considered an amendment to a proposal if it merely adds to, deletes from, or revises part of that proposal. A motion which constitutes a substitution for a proposal shall be considered as a proposal. Rules of procedure 17 Rule 37 If two or more proposals are moved, the Committee shall, unless it decides otherwise, vote on the proposals in the order in which they have been circulated to all Member States, unless the result of a vote on a proposal makes unnecessary any other voting on the proposal or proposals still outstanding. Rule 38 A motion may be withdrawn by its proposer at any time before voting on it has commenced, provided that the motion has not been amended or, if amended, that the proposer of the amendment agrees to the withdrawal. A motion thus withdrawn may be reintroduced by any representative. Rule 39 When a proposal has been adopted or rejected it may not be reconsidered at the same session of the Committee unless the Committee, by a two- thirds majority of the representatives present and voting, so decides. Permission to speak on a motion to reconsider shall be accorded only to two speakers opposing the motion, after which it shall immediately be put to the vote. Rule 40 The Chair may at any time require any proposal, motion, resolution or amendment to be seconded. 18 Regional Committee for the Eastern Mediterranean XI. Voting Rule 41 Each representative entitled to vote shall have one vote. For the purpose of these Rules, the phrase “representatives present and voting” means representatives casting an affirmative or negative vote. Representatives abstaining from voting are considered as not voting. Rule 42 Except as otherwise provided by the Constitution of the Organization or by these Rules, or as decided by the Health Assembly, the decisions of the Committee shall be made by a majority of the representatives present and voting. Rule 43 If the votes are equally divided on a matter other than an election, the proposal shall be regarded as not adopted. Rule 44 The Committee shall normally vote by show of hands, unless a representative requests a roll-call vote, or a decision is taken to vote by secret ballot. Rule 45 A roll-call vote shall be taken in the English alphabetical order of the names of the Member States. The name of the Member State to vote first shall be determined by lot. The vote or abstention of each representative participating in any roll-call shall be inserted in the records. Rule 46 After the Chair has announced the beginning of voting, no representative shall interrupt the voting except on a point of order in connection with the actual conduct of voting. Rule 47 In addition to the cases provided for elsewhere by these Rules, the Committee may, upon the motion of a representative, vote by secret ballot Rules of procedure 19 on any matter except a budgetary question, provided (a) it has previously so decided by the majority of the representatives present and voting, and (b) this decision was taken only by a show of hands. A motion for a secret ballot takes precedence over other motions for a vote. Rule 48 Elections shall normally be held by secret ballot. However, except as concerns the nomination of the Regional Director, if the number of candidates for elective office does not exceed the number of the offices to be filled, no ballot shall be required and such candidates shall be declared elected. Where ballots are required, two tellers appointed by the Chair from among the representatives shall assist in the counting of votes. Only ballot papers on which there are the same number if names as there are elective places to be filled shall be considered as valid votes. The nomination of the Regional Director shall be decided by secret ballot in accordance with these rules. Rule 49 Except as concerns the vote required for the nomination of the Regional Director, when only one elective place is to be filled and no candidate obtains in the first ballot a majority of votes cast by those entitled to vote, a second ballot shall be taken which shall be restricted to the two candidates obtaining the largest number of votes; if in the second ballot the votes are equally divided, the Chair shall decide between the candidates by drawing lots. Rule 50 When two or more elective places are to be filled at one time under the same conditions, those candidates obtaining in the first ballot a majority of votes cast by those entitled to vote shall be elected. If the number of candidates obtaining such majority is less than the number of places to be filled there shall be as many additional ballots as are necessary to fill the remaining places, the ballots being restricted to the candidates obtaining the greatest number of votes in the previous ballot to a number not more than twice the places remaining to be filled. 20 Regional Committee for the Eastern Mediterranean Rule 51 a) Not less than six months before the date fixed for the opening of a session of the Committee at which a person is due to be nominated as Regional Director, the Director General shall inform each Member State of the Region that he or she will receive proposals of names of candidates for nomination by the Committee as Regional Director. b) Any Member State of the Region may propose the name of one or more persons from within the Region who has indicated willingness to act as Regional Director, submitting with the proposal particulars of the person’s qualifications and experience. Member States shall be mindful of the Code of Conduct adopted by the Regional Committee and shall bring it to the attention of such persons. Such proposals shall be sent to the Director-General so as to reach him or her not less than twelve weeks before the date fixed for the opening of the session. c) A person holding office as Regional Director for the Region shall be a candidate for nomination without being proposed under the preceding paragraph if he or she has indicated to the Director-General a willingness to be nominated. d) The Director-General shall, not less than ten weeks before the date fixed for the opening of the session, cause copies of all proposals for nomination as Regional Director (with particulars of qualifications and experience) received by him or her within the period specified to be sent to each Member State whether or not the person holding the office is a candidate for nomination. e) If no proposals have been received by the Director-General in time for transmission to Member State in accordance with this Rule, they shall be informed accordingly not less than ten weeks before the opening of the session of the Committee. The Committee shall itself establish a list of candidates composed of the names proposed in secret by the representatives present and entitled to vote. f) If the Regional Director is unable to perform the functions of his or her office or if his or her office becomes vacant before his or her term of office is completed, the Committee shall nominate a person for the post of Regional Director at its next session, provided that the Rules of procedure 21 other provisions of this Rule are met. If the other provisions of this Rule cannot be met, the Committee shall take a decision at its next session or in a special session with a view to nominating a person and submitting his or her name to the Executive Board as soon as possible. In the interim, the Director-General shall designate an acting Regional Director until the appointment of the new incumbent. f bis) If the Director-General receives more than five proposals within the period specified in paragraph (b) of this Rule, the Committee shall draw up a shortlist of five candidates at a private meeting at the commencement of its session. For this purpose, the Committee shall hold a secret ballot, and the five candidates obtaining the highest number of votes shall make up the shortlist. In the event of a tie between two or more candidates such that there are more than five candidates identified for inclusion on the shortlist, there shall be additional ballots between the candidates receiving the tie votes, with those receiving the highest number of votes filling the remaining place or places on the shortlist. f ter) The persons proposed in accordance with paragraph (b) of this Rule, or – in case of the preceding paragraph (f bis) being applicable – those persons on the shortlist, shall be interviewed by the Committee as soon as possible at a private meeting. The interview shall consist of a presentation by each candidate in addition to answers to questions from members. The Committee shall determine, as appropriate, modalities for the interviews. g) The nomination of the Regional Director shall take place at a private meeting of the Committee. The Committee shall make a selection from among the persons who are candidates under this Rule. The nomination of the Regional Director shall be decided by secret ballot. h) For this purpose each representative entitled to vote shall write on his or her ballot paper the name of a single candidate chosen from the above-mentioned list. If no candidate obtains the majority required, the candidate who obtains the least number of votes shall be eliminated at each ballot. If the number of the candidates is reduced to two, there shall be not more than three further ballots. In the event of a tie after the third such ballot, the whole voting procedure 22 Regional Committee for the Eastern Mediterranean established by this Rule shall be recommenced based on the shortlist of candidates. i) The name of the person so nominated shall be announced at a public meeting of the Regional Committee and submitted to the Executive Board. j) The appointment of the Regional Director shall be for five years and he or she shall be eligible for reappointment once only. Rules of procedure 23 XII. Suspension and amendment of rules of procedure Rule 52 Subject to the provisions of the Constitution of the Organization, any of these Rules may be suspended by the Committee provided that at least forty-eight hours’ notice of the proposal for such suspension has been given to the Chair and communicated by him or her to the representatives twenty four hours before the meeting at which the proposal is to be submitted. If, however, on the advice of the Chair, and after twelve hours notice, the Committee is unanimously in favour of a proposal, it may implement it immediately. Rule 53 Amendment of, or addition to, these Rules may be adopted by the Committee by a two-thirds majority, provided that the Committee had received and considered a report thereon by the Regional Director or an appropriate subcommittee. Rule 54 Notwithstanding the above, the Committee may at its discretion apply such Rules of Procedure of the Health Assembly or of the Executive Board of the Organization as it may deem appropriate to particular circumstances.

Règlement intérieur 5 Préambule Le présent Règlement intérieur est adopté conformément aux dispositions du chapitre XI de la Constitution de l’Organisation mondiale de la Santé. I. Composition et participation Article 1 Le Comité régional (ci‑après dénommé « le Comité ») est composé de représentants (ci‑après dénommés « les représentants »), à raison d’un représentant pour chacun des États Membres constituant la Région de la Méditerranée orientale (ci‑après dénommée « la Région ») de l’Organisation mondiale de la Santé (ci‑après dénommée « l’Organisation »). Ces représentants peuvent être accompagnés de suppléants et de conseillers. Article 2 Sous réserve des conditions de tout accord existant, le Comité peut prendre des dispositions permettant de consulter en dehors de l’Organisation les organes régionaux respectifs des Nations Unies et ceux d’autres institutions spécialisées ainsi que d’autres organisations internationales de la Région ayant avec l’Organisation mondiale de la Santé des intérêts communs, et permettant ainsi leur participation, sans droit de vote aux délibérations dudit Comité. Le Directeur régional, en consultation avec le Comité régional, peut inviter des États qui n’en sont pas membres à participer, sans droit de vote, aux sessions du Comité. Les acteurs non étatiques admis à des relations officielles avec l’Organisation mondiale de la Santé en vertu du Cadre de collaboration avec les acteurs non étatiques sont invités à participer aux sessions du Comité régional comme prévu au paragraphe 55 dudit Cadre. Le Comité régional peut également adopter une procédure permettant d’accorder une accréditation à d’autres acteurs non étatiques internationaux, régionaux et nationaux qui n’entretiennent pas de relations officielles avec l’Organisation mondiale de la Santé afin de participer à ses réunions, pour autant que cette procédure soit gérée conformément aux dispositions du Cadre de collaboration y afférentes. 6Comité régional de la Méditerranée orientale II. Pouvoirs Article 3 Les États Membres communiquent au Directeur régional, quinze jours au moins avant la date fixée pour l’ouverture de la session du Comité, les noms de leurs représentants ainsi que ceux de tous les suppléants et conseillers. De même, les organisations et États visés à l’article 2, invités à se faire représenter à la session, communiquent les noms des personnes qui les représenteront. Les pouvoirs des représentants et les noms des suppléants, conseillers et observateurs sont remis au Directeur régional si possible deux jours au moins avant l’ouverture de la session du Comité régional. Ces pouvoirs seront préparés par le Chef d’État ou de Gouvernement, le Ministre des Affaires étrangères, le Ministre de la Santé ou toute autre autorité équivalente. Article 3 bis Les membres du Bureau du Comité régional examinent les pouvoirs des représentants et font rapport au Comité régional à ce sujet. Tout représentant à l’admission duquel un membre fait objection siège provisoirement avec les mêmes droits que les autres représentants jusqu’à ce que les membres du Bureau aient présenté leur rapport et que le Comité régional ait statué. Règlement intérieur 7 III. Sessions Article 4 Le Comité tient une session ordinaire par an. Il fixe, à chaque session ordinaire, la date et le lieu de la session suivante. Les convocations sont adressées par le Directeur régional six semaines au moins avant l’ouverture de la session, aux États Membres, au Directeur général de l’Organisation (ci‑après dénommé « le Directeur général ») ainsi qu’aux organisations visées à l’article 2 invitées à se faire représenter à la session. Article 5 S’il y a lieu, le Comité peut tenir des sessions extraordinaires. Le Directeur régional, en consultation avec le Président du Comité (ci‑après dénommé « le Président »), convoque également le Comité en session extraordinaire, à la suite d’une décision du Comité, ou sur la demande conjointe de cinq États Membres, demande qui lui sera adressée par écrit en indiquant les raisons qui la motivent. En ce cas, le Comité est convoqué dans les trente jours suivant la réception de la demande et la session a lieu au siège régional, à moins que le Directeur régional, en consultation avec le Président, n’en décide autrement. L’ordre du jour de cette session extraordinaire est limité aux questions l’ayant motivée. Article 6 Les réunions du Comité sont publiques, sauf décision contraire du Comité. 8Comité régional de la Méditerranée orientale IV. Ordre du jour Article 7 L’ordre du jour provisoire de chaque session ordinaire est établi par le Directeur régional après consultation du Président. Il est expédié par le Directeur régional, aux États Membres et au Directeur général, en même temps que la convocation, six semaines au moins avant l’ouverture de la session. Article 8 L’ordre du jour provisoire de chaque session ordinaire du Comité comprend notamment : a) tous les points dont l’inscription a été demandée par l’Assemblée mondiale de la Santé (ci‑après dénommée « l’Assemblée de la Santé ») ; b) tous les points dont l’inscription a été demandée par le Conseil exécutif de l’Organisation ; c) tous les points proposés par le Comité ; d) tout point proposé par le Directeur général ou le Directeur régional ; e) tout point proposé par un État Membre de la Région. Les propositions visées à l’alinéa e) doivent parvenir au Directeur régional huit semaines au moins avant l’ouverture de la session. Article 9 Sous réserve des dispositions de l’article 5, le Directeur régional peut, après consultation du Président, faire figurer dans un ordre du jour supplémentaire que le Comité examine en même temps que l’ordre du jour provisoire toute question susceptible d’être inscrite à l’ordre du jour qui viendrait à surgir entre l’envoi de l’ordre du jour provisoire et le jour d’ouverture de la session. Règlement intérieur 9 V. Bureau du comité Article 10 Le Comité élit, parmi les représentants, son Bureau, à savoir un Président et deux vice‑présidents ; cette élection a lieu chaque année à la première session tenue au cours de ladite année. Les membres du Bureau exercent leurs fonctions jusqu’à ce que leurs successeurs soient élus. Le Président n’est pas rééligible avant l’expiration d’un délai de deux ans à dater du moment où il ou elle cesse d’exercer ses fonctions. Article 11 Sans préjudice des pouvoirs qui lui sont conférés par d’autres dispositions du présent Règlement, le Président prononce l’ouverture et la clôture de chaque séance du Comité, dirige les discussions, assure l’application du présent Règlement, donne la parole, met les questions aux voix et proclame les décisions. Il ou elle statue sur les motions d’ordre et, sous réserve des dispositions du présent Règlement, règle les débats à chaque séance et y assure le maintien de l’ordre. Article 12 Si le Président est absent d’une session ou d’une séance ou d’une partie de session ou de séance, il délègue la présidence à l’un des vice‑présidents. Si le Président n’est pas en mesure de procéder à cette désignation, le Comité désigne un des vice‑présidents pour présider la session ou la séance. Si ni le Président, ni les vice‑présidents ne sont à même d’assurer la présidence d’une session ou d’une séance, le Comité désignera un vice‑président pour assurer l’intérim. Article 13 Si, pour une raison quelconque, le Président n’est pas en mesure de remplir son mandat jusqu’à son terme, l’un des vice‑présidents l’exerce à sa place. L’ordre dans lequel il sera fait appel aux vice‑présidents est fixé par tirage au sort à la session où l’élection a eu lieu. Article 14 Le Président, ou un vice‑président agissant en qualité de Président, ne prend pas part au scrutin mais, si nécessaire, il ou elle peut charger un suppléant de sa délégation d’agir en qualité de représentant de son gouvernement. 10 Comité régional de la Méditerranée orientale VI. Rapports des sessions Article 15 Le comité de rédaction, soutenu par le Secrétariat, prépare un projet de rapport du Comité en vue d’examen et d’adoption avant la fin de chaque session. Le rapport définitif de chaque session établi dans les langues officielles de travail, comprenant les résolutions, recommandations et autres décisions importantes, et comportant éventuellement le détail du scrutin, le cas échéant, est communiqué par le Directeur régional aux États Membres, ainsi qu’au Directeur général. Règlement intérieur 11 VII. Sous-comités du comité Article 16 Le Comité peut créer tels sous‑comités qu’il juge nécessaire pour étude et rapport de toute question qui figure à son ordre du jour. Il examine de temps à autre, et en tout cas durant sa session ordinaire, s’il convient de maintenir tout sous‑comité établi en vertu de ses pouvoirs. 12 Comité régional de la Méditerranée orientale VIII. Secrétariat Article 17 Le Directeur régional, en vertu des pouvoirs qui lui sont délégués par le Directeur général conformément à l’article 32 de la Constitution, est secrétaire du Comité et de tout Comité ou sous‑comité. Le Directeur régional peut déléguer ces fonctions. Article 18 Le Directeur régional fait rapport au Comité sur les répercussions éventuelles d’ordre technique, administratif et financier de toutes les questions à l’ordre du jour du Comité. Article 19 Le Directeur général ou le Directeur régional, ou un membre du Secrétariat désigné par l’un d’eux pour le représenter, peut en tout temps présenter des exposés soit oraux soit écrits concernant toute question à l’étude. Article 20 Le Secrétariat prête son concours au Comité en fournissant les renseignements, les traitements de textes et les services de secrétariat nécessaires aux travaux du comité. Règlement intérieur 13 IX. Langues Article 21 L’anglais, l’arabe et le français sont les langues officielles et les langues de travail. Article 22 Les discours prononcés dans l’une des langues officielles sont interprétés dans les autres langues officielles, à moins que tous les États Membres, après consultation du Président, ne s’entendent autrement avant la session. Article 23 Tout représentant peut prendre la parole en une langue autre qu’une des langues officielles. Dans ce cas, il ou elle est tenu(e) de permettre l’interprétation dans l’une des langues officielles, à partir de laquelle l’interprétation dans les autres langues officielles peut être effectuée. Article 24 Toutes les résolutions, recommandations et autres décisions importantes du Comité sont établies dans les langues officielles de travail. 14 Comité régional de la Méditerranée orientale X. Conduite des débats Article 25 Pour la conduite des débats aux séances du Comité, le quorum est constitué par la majorité des États Membres représentés à toute session. Article 26 Aucun représentant ne peut prendre la parole devant le Comité sans avoir au préalable obtenu l’autorisation du Président. Le Président donne la parole aux orateurs dans l’ordre où ils l’ont demandée. Le Président peut rappeler à l’ordre un orateur dont les remarques n’ont pas trait au sujet en discussion. Article 27 Tout représentant peut à tout moment demander à son suppléant, désigné conformément à l’article 3, de prendre la parole et de voter en son nom sur toute question. En outre, le Président peut, à la demande d’un représentant ou de son suppléant, donner la parole à un conseiller sur un point particulier, sans que ce dernier n’ait droit de vote. Article 28 Au cours de la discussion de toute question, un représentant peut soulever une motion d’ordre à l’endroit de laquelle le Président prend une décision avant de poursuivre les débats de la session. Un représentant peut faire appel de la décision prise par le président dans ce cas, l’appel interjeté est aussitôt mis aux voix. Un représentant qui soulève un point d’ordre ne peut aborder le fond de la question en discussion, mais doit s’en tenir au point d’ordre. Article 29 Au cours de la discussion de toute question, le Président peut proposer au Comité la limitation du temps de parole de chaque orateur. Le Président peut donner connaissance de la liste des orateurs inscrits et, avec le consentement du Comité, la déclarer close. Il ou elle peut toutefois autoriser tout représentant à répliquer si un exposé fait après la déclaration de clôture de la liste devait, de l’avis du Président, rendre cette réplique désirable. Règlement intérieur 15 Article 30 Au cours de la discussion de toute question, un représentant peut demander la suspension ou l’ajournement de la séance. Ces motions ne sont pas discutées, mais sont immédiatement mises aux voix. Aux fins du présent Règlement, l’expression « suspension de la séance » signifie la remise temporaire à plus tard du travail de ladite séance ; l’expression « ajournement de la séance » signifie la cessation de tout travail jusqu’à ce qu’une nouvelle séance soit convoquée. Article 31 Au cours de la discussion de toute question, un représentant peut demander l’ajournement du débat concernant le point de l’ordre du jour discuté. Outre l’auteur de la proposition, un orateur peut parler en faveur de la proposition et un autre contre celle‑ci ; la motion d’ajournement du débat est ensuite mise aux voix immédiatement. Article 32 Un représentant peut, à tout instant, demander la clôture du débat sur le point de l’ordre du jour en discussion même si d’autres représentants ont manifesté le désir de prendre la parole. Si la parole est demandée pour s’opposer à la clôture, elle ne peut être accordée qu’à un seul représentant ; la motion est ensuite mise aux voix immédiatement. Si le Comité se prononce en faveur de la motion, le Président déclare le débat clos. Le Comité vote alors uniquement sur la ou les propositions introduites avant ladite clôture. Article 33 À l’exception des motions d’ordre, les motions ci‑dessous mentionnées auront le pas, dans l’ordre ci‑après établi, sur toutes autres propositions ou motions présentées au cours d’une séance : a) celles tendant à la suspension de la séance ; b) celles tendant à l’ajournement de la séance ; c) celles tendant à l’ajournement du débat sur le point de l’ordre du jour en discussion ; et d) celles tendant à la clôture du débat sur le point de l’ordre du jour en discussion. 16 Comité régional de la Méditerranée orientale Article 34 Sous réserve des dispositions de l’article 33, toute motion tendant à ce qu’il soit statué sur la compétence du Comité à adopter une proposition qui lui est présentée est mise aux voix avant le vote sur la proposition en cause. Article 35 Tout représentant peut demander que des parties d’une proposition ou d’un amendement soient mises aux voix séparément. S’il est fait objection à la demande de division, la motion de division est mise aux voix. L’autorisation de prendre la parole au sujet de la motion de division n’est accordée qu’a deux orateurs pour et deux orateurs contre. Si la motion de division est acceptée, les parties de la proposition ou de l’amendement adoptées sont mises aux voix en bloc. Si toutes les parties du dispositif d’une proposition ou d’un amendement ont été repoussées, la proposition ou l’amendement est considéré comme repoussé dans son ensemble. Article 36 Lorsqu’un amendement à une proposition est présenté, le vote a lieu d’abord sur l’amendement. Lorsque deux ou plusieurs amendements à une proposition sont en présence, le Comité vote d’abord celui que le Président estime s’éloigner le plus, quant au fond, de la proposition initiale. Il vote ensuite sur l’amendement qui, après celui‑ci, s’éloigne le plus de ladite proposition et ainsi de suite jusqu’à ce que tous les amendements aient été mis aux voix. Lorsque l’adoption d’un amendement implique nécessairement le rejet d’un autre amendement, ce dernier n’est pas mis aux voix. Si un ou plusieurs amendements sont adoptés, la proposition amendée est alors mise aux voix. Si un amendement à une proposition a été accepté par l’auteur de la proposition initiale, cet amendement est considéré comme faisant partie intégrante de ladite proposition initiale et ne fait pas l’objet d’un vote distinct. Une motion est considérée comme un amendement à une proposition si elle constitue simplement une adjonction, une suppression ou une révision d’une partie de la proposition. Une motion qui comporte un texte à substituer à une proposition constitue elle‑même une proposition. Règlement intérieur 17 Article 37 Sauf décision contraire, lorsque deux ou plusieurs propositions sont en présence, le Comité vote sur les propositions selon l’ordre dans lequel elles ont été communiquées aux États Membres, à moins que l’un des votes déjà acquis ne rende inutile tout autre scrutin sur la ou les propositions encore pendantes. Article 38 Avant le commencement d’un vote la concernant, une motion peut être, à tout moment, retirée par son auteur, à la condition que la motion n’ait pas été amendée, ou, si amendée, que l’auteur de l’amendement en accepte lui‑même le retrait. Une motion ainsi retirée peut‑être présentée à nouveau par tout représentant. Article 39 Une proposition adoptée ou repoussée ne peut pas être réexaminée au cours de la même session, à moins que le Comité n’en décide ainsi à la majorité des deux tiers des représentants présents et votants. L’autorisation de prendre la parole sur une motion de réexamen ne sera accordée qu’a deux orateurs qui la combattent ; après quoi, la motion sera immédiatement mise aux voix. Article 40 La Président peut, à tout moment, demander qu’une proposition, une motion, une résolution ou un amendement soit appuyé(e). 18 Comité régional de la Méditerranée orientale XI. Vote Article 41 Chaque représentant habilité à voter dispose d’une voix. Aux fins du présent Règlement, l’expression « représentants présents et votants » s’entend des représentants votant pour ou contre. Les représentants qui s’abstiennent de voter sont considérés comme non votants. Article 42 Sauf stipulation contraire de la Constitution de l’Organisation ou du présent Règlement, ou convention adoptée par l’Assemblée de la Santé, les décisions du Comité sont prises à la majorité des représentants présents et votants. Article 43 Lorsque les voix sont également partagées sur une question autre qu’une élection, la proposition relative à cette question est considérée comme n’ayant pas été adoptée. Article 44 Le Comité vote, normalement, à main levée, à moins qu’un représentant ne demande le vote par appel nominal, ou qu’une décision ne soit prise pour le vote par scrutin secret. Article 45 Le scrutin par appel nominal a lieu dans l’ordre alphabétique anglais des noms des États Membres. Le nom de l’État Membre qui vote le premier est choisi par tirage au sort. Le vote ou l’abstention de chaque représentant prenant part à un appel nominal est consigné au procès‑verbal. Article 46 À partir du moment où le Président a annoncé que le scrutin commence, aucun représentant ne peut interrompre le scrutin, sauf s’il s’agit d’une motion d’ordre ayant trait à la manière dont s’effectue le scrutin en question. Règlement intérieur 19 Article 47 Outre les cas prévus par d’autres dispositions du présent Règlement, le Comité peut, sur la motion d’un représentant, voter au scrutin secret sur toute question, exception faite des questions budgétaires, à condition a) qu’il en décide ainsi au préalable, à la majorité des représentants présents et votants et b) que la décision soit prise à main levée seulement. Une motion sur un scrutin secret a priorité sur d’autres motions mises aux voix. Article 48 Les élections ont normalement lieu au scrutin secret. Toutefois, sauf en ce qui concerne la désignation du Directeur régional, si le nombre de candidats aux postes électifs n’excède pas le nombre de postes à pourvoir, aucun scrutin ne sera nécessaire et ces candidats seront déclarés élus. Lorsqu’un vote est nécessaire, deux scrutateurs choisis par le Président parmi les représentants participent au dépouillement du scrutin. Seuls les bulletins sur lesquels figurent autant de noms qu’il y a de personnes à élire sont considérés comme valables. Conformément aux dispositions du Règlement intérieur, la désignation du Directeur régional se fait au scrutin secret. Article 49 Sauf en ce qui concerne le vote requis pour la désignation du Directeur régional, lorsqu’il y a lieu de pourvoir à la vacance d’un seul poste par voie d’élection et qu’aucun des candidats ne recueille au premier tour la majorité des votes émis par ceux qui ont droit de vote, il est procédé à un second tour de scrutin, mais le vote ne porte plus que sur les deux candidats ayant obtenu le plus grand nombre de voix ; si les deux candidats recueillent le même nombre de voix à ce second tour, le Président décide entre les candidats en tirant au sort. 20 Comité régional de la Méditerranée orientale Article 50 Quand deux ou plusieurs postes vacants doivent être pourvus par voie d’élection à un même moment et dans les mêmes conditions, les candidats qui, au premier tour, obtiennent la majorité des votes émis par ceux qui ont le droit de vote, sont élus. Si le nombre de candidats obtenant cette majorité est inférieur au nombre des postes qui doivent être pourvus, il est procédé à de nouveaux tours de scrutins afin de pourvoir les postes encore vacants, le vote ne portant que sur les candidats ayant obtenu le plus grand nombre de suffrages au scrutin précédent et qui ne doivent pas être en nombre supérieur au double de celui des postes qui restent à pourvoir. Article 51 a) Six mois au moins avant la date fixée pour l’ouverture d’une session du Comité au cours de laquelle doit être désigné le Directeur régional, le Directeur général informe chaque État Membre de la Région qu’il ou elle recevra les noms des personnes proposées en vue de la désignation au poste de Directeur régional par le Comité. b) Tout État Membre de la Région peut proposer pour le poste de Directeur régional une ou plusieurs personnes, citoyens d’un État Membre de la Région, qui ont exprimé leur souhait de servir en qualité de Directeur régional et dont il communique le curriculum vitae. Les États Membres seront attentifs au Code de conduite adopté par le Comité régional et attireront l’attention de ces personnes sur ce code. Ces propositions sont adressées au Directeur général de façon à lui parvenir douze semaines au moins avant la date fixée pour l’ouverture de la session. c) La personne exerçant les fonctions de Directeur régional est candidate au poste sans être proposée selon les dispositions du paragraphe précédent, si elle a fait connaître au Directeur général son souhait d’être désignée. d) Dix semaines au moins avant la date fixée pour l’ouverture de la session du Comité, le Directeur général fait parvenir à chacun des États Membres un exemplaire de toutes les propositions soumises en vue de la désignation du Directeur régional qu’il ou elle a reçues dans leurs délais spéciaux (avec le curriculum vitae des intéressés). Le Directeur Règlement intérieur 21 général fait aussi savoir à chacun des États Membres si la personne en fonction est candidate au poste ou non. e) Si le Directeur général n’a reçu aucune proposition suffisamment à temps pour la transmettre aux États Membres conformément aux dispositions du présent article, ils en sont informés dix semaines au moins avant l’ouverture de la session du Comité. Le Comité établit lui‑même une liste des candidats, comprenant les noms des personnes proposées secrètement par les représentants présents et habilités à voter. f) En cas d’incapacité du Directeur régional à remplir les fonctions de son poste ou si son poste devient vacant avant l’arrivée à terme de son mandat, le Comité désignera une autre personne au poste de Directeur régional à sa prochaine session, à condition que les autres dispositions de cet article soient respectées. Si les autres dispositions de cet article ne peuvent être respectées, le Comité doit prendre une décision lors de sa prochaine session ou au cours d’une session extraordinaire en vue de désigner une personne et de soumettre son nom au Conseil exécutif dans les plus brefs délais. Entre temps, le Directeur général désignera un Directeur régional par intérim jusqu’à la nomination d’un nouveau titulaire. f bis) Si le Directeur général reçoit plus de cinq propositions au cours de la période mentionnée au paragraphe b) du présent article, le Comité devra dresser une liste restreinte de cinq candidats lors d’une séance privée, au début de sa session. À cet égard, le Comité procèdera à un scrutin secret. Les cinq candidats ayant obtenu le plus grand nombre de voix constitueront la liste restreinte. En cas d’égalité de voix entre deux candidats et que le nombre de candidats identifiés pour figurer sur la liste restreinte est ainsi supérieur à cinq, d’autres scrutins seront organisés entre les candidats ayant un nombre égal de voix et à l’issue desquels les candidats ayant reçu le plus grand nombre de voix complèteront la place ou les places restantes sur la liste restreinte. f ter) Les personnes proposées conformément au paragraphe b) du présent article, ou – si le paragraphe f bis) est applicable – les personnes figurant sur la liste restreinte devront passer une entrevue avec le Comité dès que possible lors d’une séance privée. L’entrevue consistera 22 Comité régional de la Méditerranée orientale en un exposé effectué par chaque candidat et comprendra les réponses aux questions posées par les membres. Le Comité déterminera, le cas échéant, les modalités des entrevues. g) La désignation du Directeur régional a lieu au cours d’une séance privée du Comité. Le Comité effectue une élection parmi les personnes dont la candidature est soumise conformément au présent article. La désignation du Directeur régional se fait au scrutin secret. h) Chacun des représentants habilités à voter inscrit sur son bulletin de vote le nom d’un seul candidat choisi parmi ceux figurant sur la liste susmentionnée. Si aucun candidat n’obtient la majorité requise, le candidat qui recueille le plus petit nombre de voix est éliminé à chaque tour de scrutin. Lorsque le nombre de candidats en présence est ramené à deux, il ne peut y avoir que trois autres tours de scrutin. Dans l’éventualité où ces deux candidats resteraient à égalité de voix après le troisième tour de scrutin, la procédure établie par le présent article sera reprise. i) Le nom de la personne ainsi désignée est annoncé lors d’une réunion publique du Comité régional et soumis au Conseil exécutif. j) La nomination du Directeur régional sera pour un mandat de cinq ans qui ne pourra être reconduit qu’une seule fois. Règlement intérieur 23 XII. Suspension et amendement du règlement intérieur Article 52 Sous réserve des dispositions de la Constitution de l’Organisation, tout article du présent Règlement peut être suspendu par le Comité, à condition que la proposition de suspension ait été remise au Président au moins quarante‑huit heures avant l’ouverture de la séance au cours de laquelle cette proposition doit être présentée, et communiquée par ses soins aux représentants vingt‑quatre heures avant ladite séance. Toutefois, si, sur avis du Président et après douze heures d’avis, le Comité est unanimement an faveur de la proposition présentée, celle‑ci peut être alors adoptée immédiatement. Article 53 Tous amendements ou toutes additions au présent Règlement peuvent être adopté(e)s par le Comité à la majorité des deux tiers des représentants à condition que celui‑ci ait été saisi, par un sous‑comité compétent ou par le Directeur régional, d’un rapport les concernant et après examen de ce rapport. Article 54 Par dérogation aux dispositions ci‑dessus, le Comité peut, à sa discrétion, appliquer tout article du Règlement intérieur de l’Assemblée de la Santé ou du Conseil exécutif de l’Organisation qui lui paraît répondre à des circonstances particulières.

5النظام الداخلي ديباجة تم إقرار هذا النظام الداخلي استنادًا إلى أحكام الفصل الحادي عشر من دستور منظمة الصحة العالمية. أولا:ً العضوية والحضور المادة 1 تتألَّف اللجنة الإقليمية (المشار إليها فيما يلي باسم «اللجنة») من ممثلين (يشار إليهم فيما يلي باسم «الممثلين»)، ممّثل واحد من كل دولة من الدول الأعضاء التي يتألف منها إقليم شرق المتوسط (المشار إليه فيما يلي باسم «الإقليم») التابع لمنظمة الصحة العالمية (المشار إليها فيما يلي باسم «المنظمة»). ويمكن أن يصحب الممثلين مناوبون ومستشارون. المادة 2 يجوز لّلجنة الإقليمية، مع مراعاة شروط أي اتفاقات قائمة، أن ترتب لعقد مشاورات مع اللجان الإقليمية ذات الصلة في الأمم المتحدة، ومع لجان الوكالات المتخصصة الأخرى، ومع المنظمات الدولية الإقليمية الأخرى ذات الاهتمامات المشتركة مع منظمة الصحة العالمية، من أجل دعوتها للمشاركة في مناقشاتها، دون أن يكون لها حق التصويت. ويجوز للمدير الإقليمي، بالتشاور مع اللجنة الإقليمية، أن يدعو دولا ًغير الدول الأعضاء في اللجنة الإقليمية، للمشاركة في دورات اللجنة، دون أن يكون لها حق التصويت. وُتدَعى الجهات الفاعلة غير الدول التي تربطها علاقات رسمية بمنظمة الصحة العالمية طبقًا لإطار المشاركة مع الجهات الفاعلة غير الدول إلى المشاركة في دورات اللجنة الإقليمية، على النحو المنصوص عليه في الفقرة 55 من الإطار. ويجوز أيضًا للجنة الإقليمية أن تعتمد إجراًء لمنح الاعتماد لجهات فاعلة دولية وإقليمية ووطنية أخرى غير الدول ليست لها علاقات رسمية مع منظمة الصحة العالمية، للمشاركة في اجتماعات اللجنة الإقليمية، بشرط أن يخضع هذا الإجراء للأحكام المعنية الواردة في إطار المشاركة. 6اللجنة الإقليمية لشرق المتوسط ثانيًا: وثائق التفويض المادة 3 توافي الدول الأعضاء المدير الإقليمي قبل الموعد المحدد لافتتاح دورة اللجنة الإقليمية بخمسة عشر يومًا على الأقل، بأسماء ممثليها، بمن فيهم جميع المناوبين والمستشارين. وعلى المنظمات والدول المشار إليها في المادة 2، والمدعوة إلى إيفاد ممثلين عنها للمشاركة في الدورة، أيضًا أن ترِسل أسماء الأشخاص الذين يمّثلونها. وينبغي أن تقدِّ م وثائق تفويض جميع الممثلين وأسماء المناوبين والمشاورين والمراقبين إلى المدير الإقليمي قبل موعد افتتاح دورة اللجنة الإقليمية بيوَمْين على الأقل إن أمكن. ويتعينَّ أن تكون وثائق التفويض هذه صادرة عن رئيس الدولة أو الحكومة، أو وزير الخارجية، أو وزير الصحة، أو عن أي سلطة أخرى مكافئة. المادة 3 مكرر يقوم مكتب اللجنة الإقليمية بفحص وثائق التفويض التي تخص الممثلين، وتقديم تقريرًا بشأن ذلك إلى اللجنة الإقليمية. ويجب منح أي ممثل اعترضت إحدى الدول الأعضاء على طلب مشاركته في اللجنة الإقليمية حق المشاركة، بصفة مؤقتة، مع تمتعه بالحقوق ذاتها التي يتمتع بها الممثلون الآخرون، حتى ُتِعد هيئة المكتب تقريرها، وتّتخذ اللجنة الإقليمية قرارها في هذا الشأن. 7النظام الداخلي ثالثًا: الدورات المادة 4 تجتمع اللجنة سنويًا في دورة عادية. وتقرِّ ر في كل دورة عادية موعد ومكان انعقاد الدورة التالية. ويقوم المدير الإقليمي بإرسال إشعارات الدعوة لاجتماع اللجنة قبل ستة أسابيع على الأقل من موعد افتتاح اللجنة إلى الدول الأعضاء وإلى المدير العام للمنظمة (المشار إليه فيما يلي باسم «المدير العام»)، وإلى المنظمات المشار إليها في المادة 2، المدعوة إلى إيفاد ممثلين عنها إلى الدورة. المادة 5 لّلجنة أن تجتمع في دورات استثنائية بحسب ما يلزم. ويقوم المدير الإقليمي، بعد مشاورة رئيس اللجنة (المشار إليه فيما يلي باسم «الرئيس») بدعوة اللجنة إلى الاجتماع في دورة استثنائية بناًء على قرار الّلجنة أو بناًء على طلب تشترك فيه أي خمس من الدول الأعضاء توجهه إليه خطيًا موضحة فيه سبب الطلب. وفي هذه الحالة تدعى اللجنة إلى الاجتماع في ظرف ثلاثين يومًا من تلقِّ ي الطلب، وُيعقد الاجتماع في المكتب الإقليمي ما لم يقرِّ ر المدير الإقليمي خلاف ذلك، بالتشاور مع رئيس اللجنة. ويقتصر جدول أعمال تلك الدورة الاستثنائية على المسائل التي استدَعت عقد الدورة. المادة 6 ُتعَقد اجتماعات اللجنة علنية، ما لم تقرِّ ر اللجنة خلاف ذلك. 8اللجنة الإقليمية لشرق المتوسط رابعًا: جدول الأعمال المادة 7 ُيِعدُّ المدير الإقليمي، بالتشاور مع الرئيس، جدول الأعمال المبدئي لكل دورة عادية ويرسله مشفوعًا بإشعار الدعوة لعقد الدورة إلى الدول الأعضاء والمدير العام قبل موعد افتتاح الدورة بستة أسابيع على الأقل. المادة 8 يتضمن جدول الأعمال المبدئي لكل دورة عادية لّلجنة، فيما يتضمن: كل البنود التي قرَّ رت إدراجها جمعية الصحة العالمية (المشار إليها فيما يلي باسم «جمعية أ) الصحة»)؛ كل البنود التي قرَّ ر إدراجها المجلس التنفيذي للمنظمة؛ ) كل البنود التي قرَّ رت إدراجها اللجنة؛ ) أي بند يقترحه المدير العام أو المدير الإقليمي؛د) هـ) أي بند تقترحه دولة عضو بالإقليم. وينبغي للاقتراحات التي تقدَّ م في إطار البند (هـ) أعلاه أن َتِرد إلى المدير الإقليمي قبل موعد افتتاح الدورة بثمانية أسابيع على الأقل. المادة 9 مع مراعاة أحكام المادة 5، يجوز للمدير الإقليمي أن يدرج، بالتشاور مع الرئيس، أي مسألة مناسبة لجدول الأعمال قد تنشأ في الفترة بين إرسال جدول الأعمال المبدئي وموعد افتتاح الدورة، على أن يتم إدراجها في جدول أعمال تكميلي تبحثه اللجنة مع جدول الأعمال المبدئي. 9النظام الداخلي خامسًا: مكتب اللجنة المادة 01 تنتخب اللجنة مكتبها، المؤلف من رئيس للمكتب ونائبين له، من بين الممثلين كل سنة في أول دورة تعقدها اللجنة أثناء السنة. ويحتفظ أعضاء المكتب بمناصبهم إلى حين انتخاب خلفائهم. ولا يجوز إعادة انتخاب الرئيس لرياسة المكتب قبل مّضي سنتين على انتهاء توليه منصب الرياسة. المادة 11 للرئيس، بالإضافة إلى ممارسته السلطات المخّولة له في موضع آخر من هذا النظام الداخلي، أن يعلن افتتاح واختتام كل اجتماع من اجتماعات اللجنة، ويدير المناقشات، ويضمن الالتزام بهذا النظام، ويعطي الحق في الكلام، ويوّجه الأسئلة، وُيعِلن القرارات، ويبت في نقاط النظام، ويوجِّ ه، مع مراعاة هذا النظام، أعمال أي اجتماع ويحافظ على النظام فيه. المادة 21 إذا تغيَّب الرئيس عن جلسة أو اجتماع أو أي جزء من أيهما، عينَّ أحد نائبيه لتولي منصب الرياسة محله. وإذا تعذَّ ر على الرئيس إجراء هذا التعيين، قامت اللجنة بتعيين أحد نائبي الرئيس لتولي الرياسة أثناء الجلسة أو الاجتماع. وإذا لم يكن الرئيس أو نائباه حاضرين كي يتولى أي منهم الرياسة في جلسة أو اجتماع، حق لّلجنة انتخاب نائب للرئيس يتولى الرياسة للفترة اللازمة. المادة 31 إذا تعذَّ ر، لأي سبب، على الرئيس أن يتم مدة رياسته، حل محله أحد نائبيه. أما الترتيب الذي يطلب بمقتضاه إلى نائبي الرئيس تولي الرياسة فيتقرَّ ر بالقرعة في الدورة التي يتم فيها الانتخاب. المادة 41 لا يحق للرئيس أو نائبه الذي يحل محله أن يصوِّ ت، ولكن يجوز له، عند الاقتضاء، أن يعينِّ مناوبًا من وفده يتولى مهمة تمثيل حكومته. 01 اللجنة الإقليمية لشرق المتوسط سادسًا: تقارير الدورات المادة 51 ُتِعدُّ لجنة الصياغة، وتدعمها الأمانة، مسّودة تقرير اللجنة لبحثها وإقرارها قبل نهاية كل دورة. ويرسل المدير الإقليمي إلى الدول الأعضاء وإلى المدير العام التقرير النهائي لكل دورة بلغات العمل الرسمية، بما في ذلك القرارات والتوصيات وغيرها من المقرَّ رات الهامة، مع تفاصيل التصويت، إن ُوجد. 11 النظام الداخلي سابعًا: اللجان الفرعية التابعة للجنة المادة 61 لّلجنة أن تنشئ ما تراه ضروريًا من لجان فرعية لدراسة أي بند من بنود جدول أعمالها وتقديم تقرير عنه. وَتدرس اللجنة من حين لآخر، وفي دورتها العادية على أي حال، الحاجة إلى الإبقاء على أي لجان فرعية ُتنشأ بتفويض منها. 21 اللجنة الإقليمية لشرق المتوسط ثامنًا: الأمانة المادة 71 يتولى المدير الإقليمي، بموجب السلطة المفوَّ ضة إليه من المدير العام، وفقًا للمادة 23 من الدستور، مهام أمين اللجنة وأي لجان أو لجان فرعية تابعة لها. وللمدير الإقليمي أن يفوِّ ض هذه المهام إلى غيره. المادة 81 يقدِّ م المدير الإقليمي إلى اللجنة تقارير بشأن الآثار التقنية والإدارية والمالية، إن وجدت، لكل بنود جدول الأعمال المقدَّ مة إلى اللجنة. المادة 91 للمدير العام أو المدير الإقليمي أو عضو من أعضاء الأمانة يعّينه أي منهما ممثًلا له، أن يقدِّ م في أي وقت بيانات شفوية أو خطية بشأن أي مسألة من المسائل التي هي قيد البحث. المادة 02 تقدِّ م الأمانة الدعم إلى اللجنة بتوفيرها ما يلزم لعمل اللجنة من معلومات وتجهيز للنصوص وخدمات السكرتارية. 31 النظام الداخلي تاسعًا: اللغات المادة 12 تكون العربية والإنكليزية والفرنسية اللغات الرسمية ولغات العمل. المادة 22 ُتترَجم شفويًا الكلمات الملقاة بإحدى اللغات الرسمية إلى اللغَتْين الرسميَتْين الأخرَيْين، ما لم تتفق على خلاف ذلك جميع الدول الأعضاء، بالتشاور مع الرئيس، قبل الدورة. المادة 32 يجوز لأي ممثل أن يتكلم بلغة غير إحدى اللغات الرسمية، على أن يقوم بنفسه في هذه الحالة بتقديم الترجمة الشفوية بإحدى اللغات الرسمية ومن هذه الترجمة تتم الترجمة الشفوية إلى اللغَتْين الرسميَتْين الأخرَيْين. المادة 42 ُتَعدُّ جميع القرارات والتوصيات وغيرها من المقرَّ رات الهامة لّلجنة بلغات العمل الرسمية. 41 اللجنة الإقليمية لشرق المتوسط عاشرًا: تصريف الأعمال المادة 52 تمثِّل أغلبية الدول الأعضاء الممثَّلة في أي دورة نصابًا قانونيًا لتصريف الأعمال في اجتماعات اللجنة. المادة 62 لا يجوز لأي ممثِّل أن يتكلم أمام اللجنة دون الحصول مسبقًا على إذن من الرئيس. ويدعو الرئيس المتكلمين إلى إلقاء كلماتهم بحسب ترتيب إبدائهم الرغبة في الكلام. وللرئيس أن ينّبه المتكلم إلى مراعاة النظام إذا خرجت أقواله عن الموضوع قيد المناقشة. المادة 72 لأي ممثِّل أن يطلب في أي وقت إلى مناوبه اُلمَعينَّ وفقًا للمادة 3 أن يتكلم ويصّوت نيابًة عنه بشأن أي مسألة. هذا، وللرئيس، بناًء على طلب الممثِّل أو مناوبه، أن يسَمح لمستشار أن يتكلم بشأن أي نقطة معيَّنة من دون أن يكون له حق التصويت. المادة 82 لأي ممثِّل أن يثير، أثناء مناقشة أي مسألة، نقطة نظام، ويبت الرئيس في نقطة النظام قبل مواصلة الأعمال الأخرى للجلسة. وللممثِّل أن يطعن في قرار الرئيس، فُيطرح الطعن للتصويت فورًا. ولا يجوز للممثِّل الذي يثير نقطة نظامية أن يتكلم في مضمون المسألة قيد المناقشة، وإنما يقصر كلامه على النقطة النظامية. المادة 92 للرئيس، أثناء مناقشة أي بند، أن يقترح تحديد الوقت الذي ُيسَمح به لكل متكلم. وله أن يعلن قائمة المتكلمين كما يجوز له، بموافقة اللجنة، أن يعلن إقفال القائمة. َبْيد أن للرئيس أن يعطي حق الرد لأي ممثل إذا رأى وجهًا لذلك إثر كلمة ُألقَيت بعد إعلانه إقفال القائمة. المادة 03 لأي ممثِّل، أثناء مناقشة أي مسألة، أن يقِترح تعليق الجلسة أو رفعها. ولا يكون مثل هذا الاقتراح محل مناقشة، بل يطَرح للتصويت على الفور. وفي اصطلاح هذا النظام، يقَصد بعبارة «تعليق الجلسة» تأجيل أعمال الجلسة مؤقتًا، وبعبارة «رفع الجلسة» إنهاء كل أعمالها إلى أن يتم عقد جلسة أخرى. 51 النظام الداخلي المادة 13 لأي ممثِّل، أثناء مناقشة أي مسألة، أن يقترح تأجيل مناقشة البند قيد البحث. ويجوز لمتكلم واحد، بالإضافة إلى مقدِّ م الاقتراح، أن يتكلم مؤّيدًا الاقتراح، ولمتكلم واحد آخر أن يتكلم معارضًا له، ثم يطرح الاقتراح بتأجيل المناقشة فورًا للتصويت. المادة 23 لأي ممثِّل أن يقترح، في أي وقت، إقفال باب مناقشة البند قيد البحث سواء أبَدى ممثِّل آخر رغبته في الكلام أو لم ُيبدها. وإذا ُطلب الإذن بالكلام لمعارضة إقفال باب المناقشة، جاز إعطاؤه لممثِّل واحد فقط، ثم ُيطرح الاقتراح فورًا للتصويت. فإذا أيّدت اللجنة الاقتراح، أعلن الرئيس إقفال باب المناقشة. ولا تصّوت اللجنة بعد ذلك إلا على الاقتراح أو الاقتراحات التي ُقدِّ مت قبل إقفال باب المناقشة. المادة 33 ُتعَطى للاقتراحات المبيَّنة أدناه أسبقية على جميع الاقتراحات الأخرى، ماعدا نقطة نظامية، وذلك بحسب الترتيب التالي: اقتراح تعليق الجلسة؛أ) اقتراح رفع الجلسة؛ ) اقتراح تأجيل مناقشة البند قيد البحث؛ ) اقتراح إقفال باب مناقشة البند قيد البحث.د) المادة 43 مع مراعاة المادة 33، ُيطرح للتصويت أي اقتراح بطلب البت في اختصاص اللجنة بإقرار اقتراح مقدَّ م إليها، وذلك قبل التصويت على هذا الاقتراح الأخير. المادة 53 للممثِّل أن يقترح التصويت على أي اقتراح أو تعديل جزءًا جزءًا. فإذا اعُترض على طلب التجزئة هذا ُطرح اقتراح التجزئة للتصويت. ولا يؤَذن بالكلام حول اقتراح التجزئة إلا لمتكلَمْين اثنَْين يؤّيدانه وآَخَرْين يعارضانه. فإذا ووفق على اقتراح التجزئة، طرحت أجزاء الاقتراح أو التعديل التي تمت الموافقة عليها منفصلة للتصويت عليها بعد ذلك برّمتها. أما إذا ُرفضت جميع أجزاء منطوق الاقتراح أو التعديل، اعُتبر الاقتراح أو التعديل مرفوضًا برّمته. 61 اللجنة الإقليمية لشرق المتوسط المادة 63 عند اقتراح تعديل على اقتراح ما، يتّم التصويت على التعديل أولا.ً وإذا اقُترح تعديلان أو أكثر على اقتراح ما، قامت اللجنة بالتصويت أولا ًعلى التعديل الذي يرى الرئيس أنه الأبعد من حيث المضمون عن الاقتراح الأصلي، ثم على التعديل الأقل منه بعدًا، وهكذا دواليك حتى تطرح جميع التعديلات للتصويت. َبْيد أنه حيثما يكون إقرار تعديل ما منطويًا بالضرورة على رفض تعديل آخر، فإن هذا التعديل الأخير لا ُيطرح للتصويت. وإذا ُأقّر تعديل واحد أو أكثر، ُطرح الاقتراح بصيغته المعّدلة للتصويت. وإذا َقبِل مقّدم الاقتراح الأصلي تعديل اقتراحه، اعُتبر هذا التعديل جزءًا لا يتجزأ من الاقتراح الأصلي ولا يلزم إجراء تصويت منفصل عليه. ويعتبر أي اقتراح تعديًلا لاقتراح آخر إذا اقتصر على إضافٍة إلى هذا الاقتراح الآخر أو حذٍف منه أو على تنقيح جزء منه. والاقتراح الذي يمّثل بديًلا لاقتراح ما ُيعدُّ اقتراحًا. المادة 73 إذا ُقدِّ م مقترحان أو أكثر، تصّوت اللجنة على تلك المقترحات ما لم تقّرر خلاف ذلك، مبتدئة بأقدمها عهدًا من حيث تعميمه على جميع الدول الأعضاء، إلا إذا كانت نتيجة التصويت على أحد المقترحات ُتغني عن أي تصويت آخر على المقَترح أو المقَترحات التي مازالت معلقة. المادة 83 لصاحب الاقتراح أن يسحب اقتراحه في أي وقت قبل بدء التصويت عليه، شريطة أن لا يكون اقتراحه قد ُعّدل، أو أن يقبل ُمْقَترِ ُح التعديل سحبه، إذا كان الاقتراح قد ُعّدل. ولأي ممثل آخر أن يعيد تقديم الاقتراح الذي يتم سحبه على هذا النحو. المادة 93 إذا ما تم إقرار أو رفض اقتراح ما، لم يجز إعادة النظر فيه في نفس دورة اللجنة، ما لم تقرِّ ر اللجنة ذلك بأغلبية ثلثي الممثِّلين الحاضرين المصوتين. ولا يؤذن بالكلام في اقتراح إعادة النظر إلا لمتكلَمْين اثنَْين يعارضانه، ثم ُيطرح الاقتراح فورًا للتصويت. المادة 04 للرئيس في أي وقت أن يطلب التثنية على الاقتراح، أو قرار، أو تعديل. 71 النظام الداخلي حادي عشر: التصويت المادة 14 لكل ممثِّل ممن له الحق في التصويت، صوت واحد. وفي اصطلاح هذا النظام ُيقصد بعبارة «الممّثلين الحاضرين المصوِّ تين» الممّثلون الذين يدلون بأصواتهم إيجابًا أو سلبًا. أما الممّثلون الذين يمتنعون عن التصويت فيعتبرون غير مصوِّ تين. المادة 24 بخلاف ما ينص عليه دستور المنظمة أو هذا النظام أو ما تقرِّ ره جمعية الصحة، تتخذ اللجنة قراراتها بأغلبية الممّثلين الحاضرين المصوِّ تين. المادة 34 إذا انقسَمت الأصوات بالتساوي على مسألة غير انتخابية، اعُتبر الاقتراح غير معتمد. المادة 44 تصوِّ ت اللجنة عادًة برفع الأيدي، ما لم يطُلب أحد الممّثلين التصويت بنداء الأسماء، أو ُيّتخذ قرار بالتصويت بالاقتراع الّسري. المادة 54 ُيجَرى التصويت بنداء الأسماء بحسب الترتيب الألفبائي لأسماء الدول الأعضاء باللغة الإنكليزية. ويتقرَّ ر بالقرعة اسم الدولة العضو التي تصّوت أولا.ً وُيثبت في المحاضر تصويت كل ممثِّل مشِترك في التصويت بنداء الأسماء أو امتناعه عن التصويت. المادة 64 بعد أن يعلن الرئيس بدء التصويت، لا يجوز لأي ممثِّل أن يقطع التصويت إلا لإثارة نقطة نظام تتعلق بطريقة إجراء التصويت. المادة 74 بالإضافة إلى الحالات المنصوص عليها في موضع آخر من هذا النظام، يجوز لّلجنة، بناًء على اقتراح أحد الممّثلين، أن تصّوت بالاقتراع الّسري على أي مسألة، باستثناء المسائل الخاصة بالميزانية، شريطة (أ) أن يكون قد سبق تقرير ذلك من ِقَبل أغلبية الممّثلين الحاضرين المصوِّ تين (ب) وأن لا 81 اللجنة الإقليمية لشرق المتوسط يتخذ هذا القرار إلا برفع الأيدي. ويكون لاقتراح الاقتراع الّسري أرجحية على سائر اقتراحات التصويت. المادة 84 ُتجَرى الانتخابات عادًة بالاقتراع الّسري. غير أنه في ماعدا ما يتعلق بترشيح المدير الإقليمي، وعندما لا يتجاوز عدد المرشَّ حين للانتخاب في المناصب الشاغرة عدد تلك المناصب، فإّن الحاجة لا تدعو لإجراء اقتراع، ويتم الإعلان عن انتخاب هؤلاء المرشَّ حين. وفي الحالات التي تتطلب الاقتراع، ُيعّين رئيس الجلسة اثنين من بين الممّثلين للمساعدة في إحصاء الأصوات. وأوراق الاقتراع التي يتساوى فيها عدد الأسماء مع عدد المناصب الانتخابية المطلوب شغلها هي وحدها التي تعتبر أصواتًا صحيحة. ويتقّرر ترشيح المدير الإقليمي بالاقتراع السري وفقًا لهذا النظام. المادة 94 باستثناء ما يختص بالتصويت اللازم لترشيح المدير الإقليمي، فإنه عندما يراد شغل منصب انتخابي واحد ولا يحصل أي مرشَّ ح في الاقتراع الأول على أغلبية الأصوات التي يدلي بها من لهم حق التصويت، ُيجَرى اقتراع ثان ُيقَصر على المرشَّ َحْين الحاِصَلْين على أكبر عدد من الأصوات؛ فإذا جاءت الأصوات في الاقتراع الثاني منقسمة بالتساوي بين المرشَّ َحْين، قرَّ ر الرئيس بالقرعة أيهما الفائز. المادة 05 إذا أريد شغل منصَبْين أو أكثر من المناصب الانتخابية في وقٍت واحٍد وبشروط واحدة، انُتخب المرشَّ حون الذين حصلوا في الاقتراع الأول على أغلبية الأصوات التي أدلى بها من لهم حق التصويت. فإذا كان عدد المرشَّ حين الحاصلين على هذه الأغلبية أقل من عدد المناصب المطلوب شغلها، ُأجري ما يلزم من اقتراعات إضافية لشغل المناصب المتبقية، مع قصر الاقتراعات على المرشحين الذين حصلوا على أكبر عدد من الأصوات في الاقتراع السابق لا يزيد على ضعف عدد المناصب المتبقية المطلوب شغلها. المادة 15 ُيبلِّغ المدير العام كل دولة من الدول الأعضاء بالإقليم بأنه سيتلقَّ ى مقترحات بأسماء أشخاص أ) ُترّشحهم اللجنة لمنصب المدير الإقليمي، وذلك قبل ستة أشهر على الأقل من الموعد المحّدد لافتتاح دورة اللجنة التي من المقرَّ ر تسمية شخص فيها لمنصب المدير الإقليمي. لأي دولة عضو بالإقليم أن ُترشِّ ح شخصًا واحدًا أو أكثر من الإقليم يكون قد أبدى ) استعداده للعمل مديرًا إقليميًا، على أن تقّدم مع الترشيح معلومات عن مؤهلات ذلك 91 النظام الداخلي الشخص وخبرته. وتأخذ الدول الأعضاء في اعتبارها مدّونة قواعد السلوك التي اعتمدتها اللجنة الإقليمية وتوجِّ ه إليها نظر هؤلاء الأشخاص. وُترسل هذه الترشيحات إلى المدير العام على أن تصله قبل الموعد المحدَّ د لافتتاح الدورة بما لا يقل عن اثنى عشر أسبوعًا. يعتبر الشخص الشاغل لمنصب المدير الإقليمي للإقليم مرشحًا للمنصب من دون ترشيحه ) له بمقتضى الفقرة السابقة، إذا هو أبدى للمدير العام استعداده للترشُّ ح. يتخذ المدير العام، قبل الموعد المحدَّ د لافتتاح الدورة بعشرة أسابيع على الأقل، الإجراءات د) الكفيلة بأن تصله نسخ من جميع الترشيحات لمنصب المدير الإقليمي (مع معلومات عن مؤهلات المرشحين وخبراتهم) في غضون المدة المحددة لإرسالها إلى كل دولة من الدول الأعضاء بالإقليم. كما يوضِّ ح المدير العام لكل دولة عضو ما إذا كان الشخص الشاغل لمنصب المدير الإقليمي مرشحًا للمنصب أم لا. هـ) إذا لم يتلّق المدير العام ترشيحات في الموعد المقرَّ ر لإرسالها إلى الدول الأعضاء وفقًا لهذه المادة، ُأبلغت الدول الأعضاء بذلك قبل موعد افتتاح دورة اللجنة بعشرة أسابيع على الأقل. وتضع اللجنة قائمة بالمرشحين مؤلفة من أسماء مقَترحة سرًا من ِقَبل الممثلين الحاضرين الذين لهم حق التصويت. إذا لم َيُعد المدير الإقليمي قادرًا على النهوض بأعباء وظيفته أو إذا شغر منصبه قبل انتهاء و) مدة ولايته، تسمِّ ي اللجنة الإقليمية شخصًا لشغل منصب المدير الإقليمي في دورتها التالية، وذلك شريطة التقيُّد بالأحكام الأخرى الواردة في هذه المادة، أما إذا تعذَّر التقيُّد بالأحكام الأخرى، تتخذ اللجنة قرارًا في دورتها التالية أو في دورة خاصة ُبغية تسمية شخص، وتقديم اسمه إلى المجلس التنفيذي في أقرب فرصة ممكنة. وفي أثناء ذلك، يعينِّ المدير العام مديرًا إقليميًا بالإنابة إلى حين تعيِّين شخص جديد لشغل المنصب. (مكرر) إذا تلقَّ ى المدير العام أكثر من خمسة مقترحات في غضون المدة المحّددة في الفقرة (ب) و) من هذه المادة، ُتِعّد اللجنة الإقليمية قائمة مختصرة لا تتجاوز خمسة مرشحين، وذلك في اجتماع مغلق ُيعقد في بداية دورتها. ولتحقيق ذلك تجري اللجنة الإقليمية اقتراعًا سريًا، ونتيجة له ُتعد القائمة المختصرة من المرشَّ حين الخمسة الذين يحصلون على أكبر عدد من الأصوات. وفي حالة تساوي عدد الأصوات بين مرشَّ َحْين أو أكثر بحيث يزيد عدد المرشَّ حين الذين يراد إدراجهم ضمن القائمة المختصرة على الخمسة، ُيجَرى اقتراع آخر بين المرشَّ حين الذين تساوت الأصوات التي حصلوا عليها، ليؤخذ من حصل منهم على أعلى عدد من الأصوات لملء المكان الشاغر في القائمة المختصرة. (مكرر 2) تجري اللجنة مقابلات مع الأشخاص الذين ُتقَترح أسماؤهم ضمن القائمة و) المختصرة، وفقًا للفقرة (ب) من هذه المادة، أو وفقًا للفقرة السابقة (و-مكرر) إذا كانت تنطبق على حالتهم، وذلك في أسرع وقت ممكن، وفي اجتماع مغلق. على أن تتضمن المقابلة 02 اللجنة الإقليمية لشرق المتوسط عرضًا يقدِّ مه كل مرشح، بالإضافة إلى تقديم إجابات عن الأسئلة التي يطرحها الأعضاء. وتحدِّ د اللجنة الطرق التي تتبعها في المقابلات، وفق ما تراه مناسبًا. يتم ترشيح المدير الإقليمي في اجتماع مغلق لّلجنة. وتتولى اللجنة انتقاءه من بين الأشخاص ) المرشحين للمنصب وفقًا لهذه المادة. ويتقرَّ ر ترشيح المدير الإقليمي بالاقتراع السري. لهذا الغرض، يكتب كل ممثِّل له حق التصويت على ورقة الاقتراع الخاصة به اسم مرشَّ ح ح) واحد يختاره من القائمة المذكورة أعلاه. فإذا لم يحصل أي مرشح على الأغلبية المطلوبة، اسُتبعد المرشَّ ح الذي يحصل على أقل عدد من الأصوات في كل اقتراع. فإذا انخفض عدد المرشَّ حين إلى اثنين لم ُيجر أكثر من ثلاثة اقتراعات أخرى. فإن تساوت الأصوات التي يحصل عليها المرشحان بعد الاقتراع الثالث، ُيعاد بالكامل إجراءات التصويت المنصوص عليها في هذه المادة، بناًء على القائمة المختصرة للمرشَّ حين. ويعلن اسم الشخص اُلمسمَّ ى على هذا النحو في جلسة علنية لّلجنة الإقليمية وُيرَفع إلى ) المجلس التنفيذي. ُيعينَّ المدير الإقليمي لمدة خمس سنوات ويجوز إعادة تعيِّينه مرة واحدة فقط.ي) 12 النظام الداخلي ثاني عشر: تعليق النظام الداخلي وتعديله المادة 25 مع مراعاة أحكام دستور المنظمة، يجوز للجنة أن تعّلق العمل بأي من مواد هذا النظام بشرط إشعار الرئيس باقتراح التعليق قبل ثمان وأربعين ساعة وقيام الرئيس بإبلاغه إلى الممّثلين قبل أربع وعشرين ساعة من موعد الجلسة التي يقدَّ م إليها الاقتراح. غير أنه يجوز، بناء على مشورة الرئيس، وبعد إشعار مدته اثنتا عشرة ساعة، أن تقوم اللجنة على الفور بتنفيذ أي اقتراح تؤّيده بالإجماع. المادة 35 يجوز لّلجنة أن تقّر بأغلبية الثلثين إجراء تعديلات أو إضافات لهذا النظام، شريطة أن تكون اللجنة قد تلقَّ ت تقريرًا بشأنها من المدير الإقليمي أو من أي لجنة فرعية مختصَّ ة، وأن تكون قد نظرت في هذا التقرير. المادة 45 يجوز لّلجنة، مع ما تقدَّ م، أن ُتطبِّق من مواد النظام الداخلي لجمعية الصحة العالمية أو المجلس التنفيذي للمنظمة ما ترى، في تقديرها، ملاءمته لظروف معّينة.

Rules of procedure 5 Preamble These Rules of Procedure are adopted under the authority of Chapter XI of the Constitution of the World Health Organization. I. Membership and attendance Rule 1 The Regional Committee (hereinafter referred to as “the Committee”) shall consist of representatives (hereinafter referred to as “the representatives”), one each from the Member States forming the Eastern Mediterranean Region (hereinafter referred to as “the Region”) of the World Health Organization (hereinafter referred to as “the Organization”). The representatives may be accompanied by alternates and advisers. Rule 2 Subject to the terms of any existing agreements, the Committee may arrange for consultation outside the Organization with the respective regional bodies of the United Nations and with those of other specialized agencies and with other international regional organizations having interests in common with the World Health Organization and for their participation, without vote, in its discussions. The Regional Director, in consultation with the Regional Committee, may invite States not members of the Committee to participate without vote in the sessions of the Committee. Non-State actors admitted into official relations with the World Health Organization pursuant to the Framework of Engagement with Non-State Actors are invited to participate in the sessions of the Regional Committee, as provided for in paragraph 55 of the Framework. The Regional Committee may also adopt a procedure granting accreditation to other international, regional and national non-State actors not in official relations with the World Health Organization to participate in its meetings, provided that the procedure is managed in accordance with the relevant provisions of the Framework of Engagement. 6Regional Committee for the Eastern Mediterranean II. Credentials Rule 3 The Member States shall communicate to the Regional Director, not less than fifteen days before the date fixed for the opening of the session of the Committee, the name of their representatives, including all alternates and advisers. Similarly, the organizations and States referred to in Rule 2 invited to be represented at the session shall communicate the names of the persons by whom they will be represented. The credentials of representatives and names of alternates, advisers and observers shall be submitted to the Regional Director if possible not less than two days before the opening of the session of the Regional Committee. Such credentials shall be issued by the Head of State or Government, the Minister for Foreign Affairs, the Minister of Health or any other competent authority. Rule 3 bis The officers of the Regional Committee shall examine the credentials of representatives and report thereon to the Regional Committee. Any representative to whose admission a Member has made objection shall be seated provisionally with the same rights as other representatives, until the officers have reported and the Regional Committee has given its decision. Rules of procedure 7 III. Sessions Rule 4 The Committee shall meet in regular annual session. It shall determine at each regular session the date and place of the next session. Notices convening the Committee shall be sent by the Regional Director at least six weeks before the commencement of the session to the Member States, to the Director-General of the Organization (hereinafter referred to as “the Director-General”), and to the organizations referred to in Rule 2 invited to be represented at the session. Rule 5 The Committee may meet in such special sessions as may be necessary. The Regional Director, in consultation with the Chairperson of the Committee (hereinafter referred to as “the Chair”) shall also convene the Committee in special session following a decision of the Committee or at the joint request of any five Member States, addressed to him or her in writing and stating the reason for the request. In this case, the Committee shall be convened within thirty days following receipt of the request, and the session shall be held at the Regional Office unless the Regional Director, in consultation with the Chair, determines otherwise. The agenda of such a special session shall be limited to the questions having necessitated that session. Rule 6 The meetings of the Committee shall be held in public, unless the Committee decides otherwise. 8Regional Committee for the Eastern Mediterranean IV. Agenda Rule 7 The provisional agenda of each regular session shall be drawn up by the Regional Director in consultation with the Chair. It shall be dispatched by the Regional Director to the Member States and the Director-General at least six weeks before the commencement of the session together with the notice of convocation. Rule 8 The provisional agenda of each regular session of the Committee shall include, inter alia: a) all items the inclusion of which has been prescribed by the World Health Assembly (hereinafter referred to as “the Health Assembly”); b) all items the inclusion of which has been prescribed by the Executive Board of the Organization; c) all items the inclusion of which has been prescribed by the Committee; d) any item proposed by the Director-General or Regional Director; e) any item proposed by a Member State in the Region. Proposals under item (e) above should be received by the Regional Director at least eight weeks prior to the commencement of the session. Rule 9 Subject to the provisions of Rule 5, the Regional Director may, in consultation with the Chair include any question suitable for the agenda which may arise between the dispatch of the provisional agenda and the opening day of the session in supplementary agenda, which the Committee shall examine together with the provisional agenda. Rules of procedure 9 V. Officers of the committee Rule 10 The Committee shall elect its officers, a Chair and two Vice-Chairs from among the representatives each year at its first session held during that year. The officers shall hold office until their successors are elected. The Chair shall not become eligible for re-election as Chair until two years have elapsed since he or she ceased to hold office. Rule 11 In addition to exercising the powers which are conferred upon him or her elsewhere by these Rules, the Chair shall declare the opening and closing of each meeting of the Committee, shall direct the discussions, ensure observance of these Rules, accord the right to speak, put questions and announce decisions. He or she shall rule on points of order and, subject to these Rules, shall control the proceedings at any meeting and shall maintain order thereat. Rule 12 If the Chair is absent from a session or a meeting or any part thereof he or she shall designate one of the Vice-Chairs to preside. If the Chair is unable to make this designation, the Committee shall appoint one of the Vice-Chairs to preside during the session or meeting. If neither the Chair nor the Vice-Chairs are available to preside at a session or a meeting, the Committee shall have the power to elect a Deputy-Chairperson to preside for such portion as is necessary. Rule 13 If the Chair for any reason is unable to complete his or her term of office, one of the Vice-Chairs shall act in his or her place. The order in which the Vice-Chairs shall be requested to serve shall be determined by lot at the session at which the election takes place. Rule 14 The Chair or Vice-Chair acting as Chair, shall not vote but may, if necessary, appoint an alternate from his or her delegation to act as representative of his or her government. 10 Regional Committee for the Eastern Mediterranean VI. Reports of sessions Rule 15 The drafting committee, supported by the Secretariat, shall prepare a draft report of the Committee for consideration and adoption before the end of each session. The final report of each session in the working languages, including resolutions, recommendations and other important decisions, with details of voting, if any, shall be communicated by the Regional Director to the Member States and to the Director-General. Rules of procedure 11 VII. Subcommittees of the committee Rule 16 The Committee may establish such subcommittees as it may deem necessary for the study of, and to report on, any item on its agenda. The Committee shall review from time to time, and in any case at its regular session, the need to maintain any subcommittees established under its authority. 12 Regional Committee for the Eastern Mediterranean VIII. Secretariat Rule 17 The Regional Director, by virtue of the authority delegated to him or her by the Director-General pursuant to Article 32 of the Constitution, shall act as the Secretary of the Committee and of any committees or subcommittees thereof. The Regional Director may delegate these functions. Rule 18 The Regional Director shall report to the Committee on the technical, administrative and financial implications, if any, of all agenda items submitted to the Committee. Rule 19 The Director-General or the Regional Director, or a member of the Secretariat designated by either of them as his or her representative, may at any time make either oral or written statements concerning any question under consideration. Rule 20 The Secretariat shall furnish support to the Committee by providing information, text processing and secretarial services as may be required for the work of the Committee. Rules of procedure 13 IX. Languages Rule 21 Arabic, English and French shall be official and working languages. Rule 22 Speeches made in one of the official languages shall be interpreted into the other official languages unless, in consultation with the Chair, all Member States agree otherwise in advance of the session. Rule 23 Any representative may speak in a language other than an official language. In this case he or she shall provide for interpretation into one of the official languages, from which the interpretation into the other official languages may be derived. Rule 24 All resolutions, recommendations and other important decisions of the Committee shall be drawn up in the working languages. 14 Regional Committee for the Eastern Mediterranean X. Conduct of business Rule 25 A majority of the Member States represented at any session shall constitute a quorum for the conduct of business at meetings of the Committee. Rule 26 No representative may address the Committee without having previously obtained the permission of the Chair. The Chair shall call upon speakers in the order in which they signify their desire to speak. The Chair may call a speaker to order if the speaker’s remarks are not relevant to the subject under discussion. Rule 27 Any representative may at any time request his or her alternate designated in accordance with Rule 3 to speak and vote on his or her behalf on any question. Moreover, upon the request of the representative or his or her alternate, the Chair may allow an adviser to speak on any particular point without the right to vote. Rule 28 During the discussion of any matter a representative may rise to a point of order and the point of order shall be decided by the Chair before continuing with the other business of the session. A representative may appeal against the ruling of the Chair in which case the appeal shall immediately be put to the vote. A representative rising to a point of order may not speak on the substance of the matter under discussion but on the point of order only. Rule 29 During the course of discussion of any item, the Chair may propose to the Committee a limitation of the time allowed to each speaker. The Chair may announce a list of speakers and, with the consent of the Committee, declare the list closed. He or she may, however, accord the right of reply to any representative if in the Chair’s opinion a speech delivered after the Chair has declared the list closed makes a reply desirable. Rules of procedure 15 Rule 30 During the discussion of any matter, a representative may move the suspension or the adjournment of the meeting. Such motions shall not be debated but shall immediately be put to the vote. For the purpose of these Rules “suspension of the meeting” means the temporary postponement of the business of the meeting and “adjournment of the meeting” the termination of all business until another meeting is called. Rule 31 During the discussion of any matter, a representative may move the adjournment of the debate on the item under discussion. In addition to the proposer of the motion, one speaker may speak in favour of, and one against, the motion, after which the motion to adjourn debate shall immediately be put to the vote. Rule 32 A representative may at any time move the closure of the debate on the item under discussion whether or not any other representative had signified his or her wish to speak. If a request is made for permission to speak against closure, it may be accorded to not more than one representative, after which the motion shall immediately be put to the vote. If the Committee is in favour of the motion, the Chair shall declare the closure of the debate. The Committee shall thereafter vote only on the one or more proposals moved before the closure. Rule 33 The following motions shall have precedence in the following order over all other proposals or motions before the meeting, except a point of order: a) to suspend the meeting; b) to adjourn the meeting; c) to adjourn the debate on the item under discussion; and d) for the closure of the debate on the item under discussion. 16 Regional Committee for the Eastern Mediterranean Rule 34 Subject to Rule 33, any motion calling for a decision on the competence of the Committee to adopt a proposal submitted to it shall be put to the vote before a vote is taken on the proposal in question. Rule 35 A representative may move that parts of a proposal or of an amendment shall be voted on separately. If objection is made to the request for division the motion for division shall be voted upon. Permission to speak on the motion for division shall be given only to two speakers in favour and two speakers against. If the motion for division is carried, those parts of the proposal or of the amendment which are subsequently approved shall be put to the vote as a whole. If all operative parts of the proposal or the amendment have been rejected, the proposal or the amendment shall be considered to have been rejected as a whole. Rule 36 When an amendment to a proposal is moved, the amendment shall be voted on first. When two or more amendments to a proposal are moved the Committee shall first vote on the amendment deemed by the Chair to be the furthest removed in substance from the original proposal and then on the amendment next removed therefrom, and so on, until all the amendments have been put to the vote. Where, however, the adoption of one amendment necessarily implies the rejection of another amendment, the latter amendment shall not be put to the vote. If one or more amendments are adopted, the amended proposal shall then be voted upon. If an amendment to a proposal has been accepted by the original proposer, such an amendment shall be deemed to be an integral part of the original proposal and no separate vote shall be required thereon. A motion is considered an amendment to a proposal if it merely adds to, deletes from, or revises part of that proposal. A motion which constitutes a substitution for a proposal shall be considered as a proposal. Rules of procedure 17 Rule 37 If two or more proposals are moved, the Committee shall, unless it decides otherwise, vote on the proposals in the order in which they have been circulated to all Member States, unless the result of a vote on a proposal makes unnecessary any other voting on the proposal or proposals still outstanding. Rule 38 A motion may be withdrawn by its proposer at any time before voting on it has commenced, provided that the motion has not been amended or, if amended, that the proposer of the amendment agrees to the withdrawal. A motion thus withdrawn may be reintroduced by any representative. Rule 39 When a proposal has been adopted or rejected it may not be reconsidered at the same session of the Committee unless the Committee, by a two- thirds majority of the representatives present and voting, so decides. Permission to speak on a motion to reconsider shall be accorded only to two speakers opposing the motion, after which it shall immediately be put to the vote. Rule 40 The Chair may at any time require any proposal, motion, resolution or amendment to be seconded. 18 Regional Committee for the Eastern Mediterranean XI. Voting Rule 41 Each representative entitled to vote shall have one vote. For the purpose of these Rules, the phrase “representatives present and voting” means representatives casting an affirmative or negative vote. Representatives abstaining from voting are considered as not voting. Rule 42 Except as otherwise provided by the Constitution of the Organization or by these Rules, or as decided by the Health Assembly, the decisions of the Committee shall be made by a majority of the representatives present and voting. Rule 43 If the votes are equally divided on a matter other than an election, the proposal shall be regarded as not adopted. Rule 44 The Committee shall normally vote by show of hands, unless a representative requests a roll-call vote, or a decision is taken to vote by secret ballot. Rule 45 A roll-call vote shall be taken in the English alphabetical order of the names of the Member States. The name of the Member State to vote first shall be determined by lot. The vote or abstention of each representative participating in any roll-call shall be inserted in the records. Rule 46 After the Chair has announced the beginning of voting, no representative shall interrupt the voting except on a point of order in connection with the actual conduct of voting. Rule 47 In addition to the cases provided for elsewhere by these Rules, the Committee may, upon the motion of a representative, vote by secret ballot Rules of procedure 19 on any matter except a budgetary question, provided (a) it has previously so decided by the majority of the representatives present and voting, and (b) this decision was taken only by a show of hands. A motion for a secret ballot takes precedence over other motions for a vote. Rule 48 Elections shall normally be held by secret ballot. However, except as concerns the nomination of the Regional Director, if the number of candidates for elective office does not exceed the number of the offices to be filled, no ballot shall be required and such candidates shall be declared elected. Where ballots are required, two tellers appointed by the Chair from among the representatives shall assist in the counting of votes. Only ballot papers on which there are the same number if names as there are elective places to be filled shall be considered as valid votes. The nomination of the Regional Director shall be decided by secret ballot in accordance with these rules. Rule 49 Except as concerns the vote required for the nomination of the Regional Director, when only one elective place is to be filled and no candidate obtains in the first ballot a majority of votes cast by those entitled to vote, a second ballot shall be taken which shall be restricted to the two candidates obtaining the largest number of votes; if in the second ballot the votes are equally divided, the Chair shall decide between the candidates by drawing lots. Rule 50 When two or more elective places are to be filled at one time under the same conditions, those candidates obtaining in the first ballot a majority of votes cast by those entitled to vote shall be elected. If the number of candidates obtaining such majority is less than the number of places to be filled there shall be as many additional ballots as are necessary to fill the remaining places, the ballots being restricted to the candidates obtaining the greatest number of votes in the previous ballot to a number not more than twice the places remaining to be filled. 20 Regional Committee for the Eastern Mediterranean Rule 51 a) Not less than six months before the date fixed for the opening of a session of the Committee at which a person is due to be nominated as Regional Director, the Director General shall inform each Member State of the Region that he or she will receive proposals of names of candidates for nomination by the Committee as Regional Director. b) Any Member State of the Region may propose the name of one or more persons from within the Region who has indicated willingness to act as Regional Director, submitting with the proposal particulars of the person’s qualifications and experience. Member States shall be mindful of the Code of Conduct adopted by the Regional Committee and shall bring it to the attention of such persons. Such proposals shall be sent to the Director-General so as to reach him or her not less than twelve weeks before the date fixed for the opening of the session. c) A person holding office as Regional Director for the Region shall be a candidate for nomination without being proposed under the preceding paragraph if he or she has indicated to the Director-General a willingness to be nominated. d) The Director-General shall, not less than ten weeks before the date fixed for the opening of the session, cause copies of all proposals for nomination as Regional Director (with particulars of qualifications and experience) received by him or her within the period specified to be sent to each Member State whether or not the person holding the office is a candidate for nomination. e) If no proposals have been received by the Director-General in time for transmission to Member State in accordance with this Rule, they shall be informed accordingly not less than ten weeks before the opening of the session of the Committee. The Committee shall itself establish a list of candidates composed of the names proposed in secret by the representatives present and entitled to vote. f) If the Regional Director is unable to perform the functions of his or her office or if his or her office becomes vacant before his or her term of office is completed, the Committee shall nominate a person for the post of Regional Director at its next session, provided that the Rules of procedure 21 other provisions of this Rule are met. If the other provisions of this Rule cannot be met, the Committee shall take a decision at its next session or in a special session with a view to nominating a person and submitting his or her name to the Executive Board as soon as possible. In the interim, the Director-General shall designate an acting Regional Director until the appointment of the new incumbent. f bis) If the Director-General receives more than five proposals within the period specified in paragraph (b) of this Rule, the Committee shall draw up a shortlist of five candidates at a private meeting at the commencement of its session. For this purpose, the Committee shall hold a secret ballot, and the five candidates obtaining the highest number of votes shall make up the shortlist. In the event of a tie between two or more candidates such that there are more than five candidates identified for inclusion on the shortlist, there shall be additional ballots between the candidates receiving the tie votes, with those receiving the highest number of votes filling the remaining place or places on the shortlist. f ter) The persons proposed in accordance with paragraph (b) of this Rule, or – in case of the preceding paragraph (f bis) being applicable – those persons on the shortlist, shall be interviewed by the Committee as soon as possible at a private meeting. The interview shall consist of a presentation by each candidate in addition to answers to questions from members. The Committee shall determine, as appropriate, modalities for the interviews. g) The nomination of the Regional Director shall take place at a private meeting of the Committee. The Committee shall make a selection from among the persons who are candidates under this Rule. The nomination of the Regional Director shall be decided by secret ballot. h) For this purpose each representative entitled to vote shall write on his or her ballot paper the name of a single candidate chosen from the above-mentioned list. If no candidate obtains the majority required, the candidate who obtains the least number of votes shall be eliminated at each ballot. If the number of the candidates is reduced to two, there shall be not more than three further ballots. In the event of a tie after the third such ballot, the whole voting procedure 22 Regional Committee for the Eastern Mediterranean established by this Rule shall be recommenced based on the shortlist of candidates. i) The name of the person so nominated shall be announced at a public meeting of the Regional Committee and submitted to the Executive Board. j) The appointment of the Regional Director shall be for five years and he or she shall be eligible for reappointment once only. Rules of procedure 23 XII. Suspension and amendment of rules of procedure Rule 52 Subject to the provisions of the Constitution of the Organization, any of these Rules may be suspended by the Committee provided that at least forty-eight hours’ notice of the proposal for such suspension has been given to the Chair and communicated by him or her to the representatives twenty four hours before the meeting at which the proposal is to be submitted. If, however, on the advice of the Chair, and after twelve hours notice, the Committee is unanimously in favour of a proposal, it may implement it immediately. Rule 53 Amendment of, or addition to, these Rules may be adopted by the Committee by a two-thirds majority, provided that the Committee had received and considered a report thereon by the Regional Director or an appropriate subcommittee. Rule 54 Notwithstanding the above, the Committee may at its discretion apply such Rules of Procedure of the Health Assembly or of the Executive Board of the Organization as it may deem appropriate to particular circumstances. 24 Regional Committee for the Eastern Mediterranean
