Всемирная организация здравоохранения ИСПОЛНИТЕЛЬНЫЙ КОМИТЕТ Сто сорок вторая сессия EB142/38 Пункт 5.10 предварительной повестки дня 2 января 2018 г. Поправки к Положениям о персонале и Правилам о персонале Доклад Генерального директора 1. Поправки к Правилам о персонале, внесенные Генеральным директором, представляются на утверждение Исполнительного комитета в соответствии с пунктом 12.2 Положений о персонале1. 2. В соответствии с пунктом 12.1 Положений о персонале предлагаемые поправки к Положениям о персонале представляются Исполнительному комитету с просьбой рекомендовать их для принятия на Семьдесят первой сессии Всемирной ассамблеи здравоохранения. 3. Поправки, изложенные в разделе I настоящего документа, обусловлены решениями, которые, как ожидается, должны быть приняты Генеральной Ассамблеей Организации Объединенных Наций на ее семьдесят второй сессии2, на основе рекомендаций, сделанных Комиссией по международной гражданской службе в ее ежегодном докладе за 2017 год. Если Генеральная Ассамблея Организации Объединенных Наций не утвердит рекомендации Комиссии, то в этом случае к настоящему докладу будет издано соответствующее добавление. 4. Финансовые последствия данных поправок для двухгодичного периода 2018- 2019 гг. повлекут соответствующие дополнительные расходы по линии Программного бюджета на 2018-2019 годы. Они излагаются в докладе о финансовых и административных последствиях для Секретариата принятия Исполнительным комитетом или Ассамблеей здравоохранения предлагаемых резолюций наряду с финансовыми последствиями на период после двухгодичного периода 2018-2019 гг.3, а также в нижеследующих пунктах. 5. ПОПРАВКИ, СОЧТЕННЫЕ НЕОБХОДИМЫМИ В СВЕТЕ РЕШЕНИЙ, КОТОРЫЕ, КАК ОЖИДАЕТСЯ, БУДУТ ПРИНЯТЫ НА СЕМЬДЕСЯТ ВТОРОЙ СЕССИИ ГЕНЕРАЛЬНОЙ АССАМБЛЕИ ОРГАНИЗАЦИИ ОБЪЕДИНЕННЫХ НАЦИЙ НА ОСНОВЕ РЕКОМЕНДАЦИЙ КОМИССИИ ПО МЕЖДУНАРОДНОЙ ГРАЖДАНСКОЙ СЛУЖБЕ Вознаграждение сотрудников категории специалистов и выше 6. В своем докладе за 2017 г. Комиссия рекомендовала Генеральной Ассамблее Организации Объединенных Наций увеличить начиная с 1 января 2018 г. на 0,97% ставки по единой шкале базовых/минимальных окладов сотрудников категории специалистов и выше и соответствующих окладов, введенных для сохранения размеров вознаграждения, путем применения обычного метода консолидации, который заключается в увеличении базового оклада и соразмерном уменьшении множителя корректива по месту службы, в результате чего величина чистого получаемого на руки вознаграждения остается без изменений. 7. Поправки к Добавлению 1 к Правилам о персонале были разработаны в соответствии с этим предложением и приводятся в Приложении 2 к настоящему документу. Вознаграждение сотрудников на неклассифицируемых должностях и Генерального директора 8. С учетом решения Генеральной Ассамблеи Организации Объединенных Наций в связи с рекомендацией, содержащейся в пункте 6 выше, Генеральный директор предлагает Исполнительному комитету, в соответствии со Статьей 3.1 Положений о персонале, рекомендовать Семьдесят первой сессии Всемирной ассамблеи здравоохранения внести соответствующие изменения в шкалу окладов помощников Генерального директора и региональных директоров. Таким образом, с 1 января 2018 г. валовый оклад помощников Генерального директора и региональных директоров будет составлять 176 292 долл. США, а чистый оклад – 131 853 долл. США в год. 9. На основе поправок к окладам, изложенным выше, измененный валовый оклад заместителей Генерального директора, который представляется на утверждение Ассамблеей здравоохранения, с 1 января 2018 г. будет составлять 194 329 долл. США, а соответствующий чистый оклад – 143 757 долл. США в год. 10. Указанные выше корректировки к окладам повлекут за собой аналогичные изменения в окладе Генерального директора. Предлагаемый на утверждение Ассамблеей здравоохранения валовый оклад с 1 января 2018 г. будет составлять 239 755 долл. США, а чистый оклад – 173 738 долл. США в год. EB142/38 3 II. ПОПРАВКИ, СОЧТЕННЫЕ НЕОБХОДИМЫМИ С УЧЕТОМ ОПЫТА И В ИНТЕРЕСАХ ЭФФЕКТИВНОГО РУКОВОДСТВА КАДРОВЫМИ РЕСУРСАМИ Предлагаемые поправки к Положениям о персонале Статьи I, III и IV 11. Предлагаемые поправки к пунктам 1.11, 3.1 и 4.5 Положений о персонале отражают нынешнюю структуру Организации. Поправки к правилам о персонале Определения 12. В Статью 310 Правил о персонале вносится поправка в целях отражения рекомендаций, предложенных в 2015 г. в докладе Комиссии по международной гражданской службе о надбавке на супруга: «(b) при определении того, находится ли супруг на иждивении, следует исходить из всего дохода супруга, включая пенсии и другие доходы, связанные с выходом на пенсию» 1. Субсидия на образование 13. В Статью 350 Правил о персонале вносится поправка для правильного указания на то, что полномочия по определению понятия «ребенок» находятся в ведении Генерального директора. Субсидия на обустройство 14. В Статью 365 Правил о персонале вносится поправка, позволяющая в порядке исключения взыскивать с члена персонала часть субсидии на обустройство, полученную им или ей в виде паушальной суммы, в случае увольнения за должностной проступок или увольнения без объяснений за серьезный должностной проступок в течение одного года после его или ее назначения или переназначения на место несения службы. Субсидия на репатриацию 15. В Статью 370 Правил о персонале вносится поправка, согласно которой накопленная сумма субсидии на репатриацию может быть сокращена исходя из продолжительности проживания в признанном месте проживания до увольнения со службы, а не, как это указано в текущей редакции, исходя из общего количества лет службы за границей. 1 См. https://icsc.un.org/resources/pdfs/ar/AR2015_R.pdf?d=121220179:19:52AM, раздел VII, A (по состоянию на 23 ноября 2017 г.). EB142/38 4 Мобильность 16. В Статью 515 Правил о персонале вносится поправка для приведения ее в соответствие с текстом Статьи 1050.5.2 Правил о персонале, где говорится, что членам персонала в период переназначения будет отдаваться «должное» предпочтение при выборе кандидатов на вакантные должности в контексте Статьи 1050.4 Правил о персонале. Специальный отпуск 17. В Статью 650 Правил о персонале о специальном отпуске вносится поправка путем объединения ее со Статьей 655 Правил о персонале о неоплачиваемом отпуске. Таким образом, устраняется двойственность и неопределенность относительно того, какую из двух статей следует применять в том или ином случае. Неоплачиваемый отпуск 18. Статья 655 Правил о персонале упраздняется вследствие ее объединения со статьей 650 о специальном отпуске (см. выше). Увольнение по собственному желанию 19. В Статью 1010 Правил о персонале вносится поправка для дополнения текста статьи отсутствующим в нем положением о том, что для членов персонала, находящихся на испытательном сроке, срок подачи уведомления об увольнении по собственному желанию составляет один месяц. Рассмотрение в административном порядке 20. В Статью 1225 Правил о персонале вносится поправка с учетом опыта первого года функционирования новой системы внутреннего правосудия. Данная поправка позволяет Генеральному директору определять, какие категории окончательных управленческих решений не подлежат рассмотрению в административном порядке (то есть в соответствующих случаях член персонала может обращаться непосредственно к Глобальному апелляционному совету). Глобальный апелляционный совет 21. В Статью 1230 Правил о персонале вносится поправка для приведения текста статьи в соответствие с поправками к Статье 1225, описанной выше. EB142/38 5 ДЕЙСТВИЯ ИСПОЛНИТЕЛЬНОГО КОМИТЕТА 22. С учетом указанных выше поправок, Исполнительный комитет может пожелать рассмотреть следующие проекты резолюций1. Проект резолюции 1 (Заработная плата сотрудников, определения, субсидии на образование, субсидии на обустройство, субсидии на репатриацию, мобильность, специальный отпуск, неоплачиваемый отпуск, увольнение по собственному желанию, рассмотрение в административном порядке и Глобальный апелляционный совет) Исполнительный комитет, рассмотрев доклад о поправках к Положениям о персонале и Правилам о персонале2, 1. ПОДТВЕРЖДАЕТ, в соответствии с Положением о персонале 12.2, поправки к Правилам о персонале, которые были внесены Генеральным директором, с вступлением их в силу с 1 января 2018 г. в части вознаграждения сотрудников категории специалистов и выше; 2. ТАКЖЕ ПОДТВЕРЖДАЕТ, в соответствии с Положением о персонале 12.2, поправки к Правилам о персонале, которые были внесены Генеральным директором, с вступлением их в силу с 1 февраля 2018 г. в части определений, субсидий на образование, субсидий на обустройство, субсидий на репатриацию, мобильности, специального отпуска, неоплачиваемого отпуска, увольнения по собственному желанию, рассмотрения в административном порядке и Глобального апелляционного совета. Проект резолюции 2 (Заместители Генерального директора) Исполнительный комитет, рассмотрев доклад о поправках к Положениям о персонале и Правилам о персонале2, РЕКОМЕНДУЕТ, в соответствии с пунктом 12.1 Положений о персонале, Семьдесят первой сессии Всемирной ассамблеи здравоохранения принять следующую резолюцию: Семьдесят первая сессия Всемирной ассамблеи здравоохранения, 1 Финансовые и административные последствия для Секретариата резолюций см. в документе EB142/38 Add.1. 2 Документ EB142/38. EB142/38 6 принимая к сведению рекомендации Исполнительного комитета в отношении Статей I, III и IV Положений о персонале, 1. УТВЕРЖДАЕТ предложенную поправку к пунктам 11.1, 3.1 и 4.5 Положений о персонале; 2. ПОСТАНОВЛЯЕТ, что эти поправки вступят в силу с 1 января 2018 г. Проект резолюции 3 (Вознаграждение сотрудников на неклассифицируемых должностях и Генерального директора) Исполнительный комитет, рассмотрев доклад о поправках к Положениям о персонале и Правилам о персонале1, РЕКОМЕНДУЕТ Семьдесят первой сессии Всемирной ассамблеи здравоохранения принять следующую резолюцию: Семьдесят первая сессия Всемирной ассамблеи здравоохранения, принимая к сведению рекомендации Исполнительного комитета в отношении вознаграждения сотрудников на неклассифицируемых должностях и Генерального директора, 1. УСТАНАВЛИВАЕТ годовой оклад помощников Генерального директора и региональных директоров на уровне 176 292 долл. США брутто и 131 853 долл. США нетто; 2. DEFINITIONS ... 310.5 “Dependants” for the purposes of determining entitlements under the Rules, except as otherwise specified, are defined as: 310.5.1 a staff member’s spouse whose gross occupational earnings, from the exercise of trade, profession, business or other regular employment do not exceed during any calendar year: 310. EDUCATION GRANT 350.1 Internationally recruited staff members shall be entitled to an education grant, except as indicated in Rule 350.3, under the conditions which follow: 350.1.1 the grant is payable for each child as defined under Staff Rule 310.5.2 up to the end of the school year in which the child reaches the age of 25, completes four years of post-secondary studies or attains a first post-secondary degree, whichever is earlier; 350. EDUCATION GRANT 350.1 Internationally recruited staff members shall be entitled to an education grant, except as indicated in Rule 350.3, under the conditions which follow: 350.1.1 the grant is payable for each child as defined under Staff Rule 310.5.2 by the Director-General up to the end of the school year in which the child reaches the age of 25, completes four years of post-secondary studies or attains a first post-secondary degree, whichever is earlier; 365. SETTLING-IN GRANT ... 365.5 If a staff member resigns from the Organization within one year of the date of his or her appointment or reassignment to a duty station, the lump sum portion of the settling-in grant paid under Staff Rule 365.3 is recoverable proportionately under conditions established by the Director-General. 365. SETTLING-IN GRANT ... 365.5 If a staff member resigns from the Organization or is dismissed for misconduct or is summarily dismissed for serious misconduct within one year of the date of his or her appointment or reassignment to a duty station, the lump-sum portion of the settling-in grant paid under Staff Rule 365.3 is recoverable proportionately under conditions established by the Director- General. 370. REPATRIATION GRANT ... 370.4 The grant shall not be payable to a staff member assigned to, or residing in, the country of his recognized place of residence at the time of separation provided that the grant may be paid on a full or reduced basis to a staff member transferred to duty in the country of his recognized place of residence prior to termination, the amount of the grant being reduced in proportion to the duration of his residence in that country. In such a case, the evidence of relocation referred to in Rule 370.1 shall not be required. 370. REPATRIATION GRANT ... 370.4 The grant shall not be payable to a staff member assigned to, or residing in, the country of his or her recognized place of residence at the time of separation provided that the grant may be paid on a full or reduced basis to. However, when a staff member is transferred or reassigned to duty in the country of his or her recognized place of residence prior to termination, separation, the grant may be paid at a full or reduced rate, with the total accrued amount of the grant being reduced in proportion to based on criteria established by the duration of his residence in that country Director-General. MOBILITY ... 515.2 Staff members whose posts have been abolished and who are eligible to participate in a reassignment process pursuant to Staff Rule 1050 shall be given preference for vacancies during the mobility exercise. 515. SPECIAL LEAVE Special leave with full, partial or no pay may be granted at the request of a staff member for such period and under such conditions as the Director- General may prescribe. This special leave may be granted for training or research in the interest of the Organization or for other important reasons, including but not limited to child care, serious illness of a family member, or death of an immediate family member. The Director-General may, at his or her initiative, place a staff member on special leave with full pay if he or she considers such leave to be in the interest of the Organization. Normally, such leave shall not be granted until all accrued annual leave has been exhausted, except in the cases of special leave to care for a child, serious illness of a family member or death of an immediate family member. Continuity of service shall not be broken during periods of special leave, which shall be credited for all purposes except as otherwise specified in the Rules. 650. SPECIAL LEAVE 650.1 Special leave with full, partial or no pay may be granted at the request of a staff member for such period and under such conditions as the Director- General may prescribe for training or research in the interest of the Organization or for other important reasons, including family, health, or personal matters. This special leave may be granted for training or research in the interest of the Organization or for other important reasons, including but not limited to child care, serious illness of a family member, or death of an immediate family member. 650.2 The Director-General may, at his or her initiative, place a staff member on special leave with full pay, or exceptionally with partial or no pay, if he or she considers such leave to be in the interest of the Organization. 650.3 Special leave is normally granted without pay, for a period not exceeding one year. 650.4 Normally, such special leave shall not be is granted until when all accrued annual leave has been exhausted., except in the cases of special leave to care for a child, serious illness of a family member or death of an immediate family member. 650.5 Continuity of service shall not be broken during periods of special leave, which shall be credited for all purposes except as otherwise specified in these Staff Rules. 650.6. Service credits accrue in the same proportion as the rate of partial pay during special leave with partial pay of more than 30 days. 650.7 Service credits shall not accrue towards sick, annual or home leave, salary increment, termination indemnity or repatriation grant during periods of special leave without pay of more than 30 days. П р и л о ж ен и е 1 E B 1 4 2 /3 8 1 1 Former text New text 650.8 During special leave with full or partial pay the staff member and the Organization continue to contribute at the full rate to the United Nations Joint Staff Pension Fund, the Staff Health Insurance and the Accident and Illness Insurance. 650.9 During any special leave without pay the following conditions shall apply: 650.9.1 cover under any insurance provided by these Staff Rules shall cease unless the staff member pays both his or her own and the Organization’s contributions under the appropriate insurance plans; and 650.9.2 no contributory service shall accrue for pension purposes unless the staff member pays both his or her own and the Organization’s contributions to the United Nations Joint Staff Pension Fund. 650.10 Other conditions for special leave may be established by the Director- General. 655. LEAVE WITHOUT PAY 655.1 Leave without pay may be granted, for a period normally not in excess of one year, except as indicated in Staff Rule 655.4, for purposes normally covered by sick or annual leave when that leave has been exhausted. 655.2 During any leave without pay under Staff Rule 655.1 the following conditions shall apply: ... 655.2.2 no credit shall accrue for purposes of pensionable service time unless the staff member pays both his or her own and the Organization’s contributions to the United Nations Joint Staff Pension Fund; 655.2.3 subject to Staff Rule 655.2.4, service credit shall accrue for all purposes during periods of leave without pay of 30 calendar days or less; 655.2.4 service credit shall cease to accrue for all purposes from the start date of periods of leave without pay of more than 30 calendar days. 655.
