Report of meetings of Monday 15 November 2010 First plenary meeting
In the chair: Mr Thamsanqa Dennis Mseleku President of the Conference of the Parties Item 1 Opening of the session The President opened the Conference and welcomed delegations to the fourth session of the Conference of the Parties. The President also welcomed His Excellency Don José Alberto Mujica Cordano, President of Uruguay, His Excellency, Luis Almagro, Minister of Foreign Affairs of Uruguay and Mr Daniel Olesker, Minister of Health of Uruguay. His Excellency Don José Alberto Mujica Cordano, President of Uruguay, addressed the Conference. The President then invited the Conference to watch a video message from Dr Margaret Chan, Director-General of the World Health Organization, who was unable to attend. The President gave the floor to Mr Daniel Olesker, Minister of Health of Uruguay, who delivered a speech, after which the President addressed the Conference. Item 1.1 Adoption of the agenda and organization of work The President invited the participants to approve the provisional agenda contained in documents FCTC/COP/4/1 Rev.1 and FCTC/COP/4/1 Rev.1 (annotated). The following amendments were proposed and agreed upon: Additional item for discussion in the plenary: - Review of the role of the Bureau of the Conference of the Parties - Commercial interests related to the implementation of the WHO FCTC - Matters related to the contract of the Head of the Secretariat. Additional items for discussion in Committee B: - Collaboration between the WHO Tobacco Free Initiative and the Convention Secretariat These changes will be reflected in document FCTC/COP/4/1 Rev.2. The President then introduced the organization of work proposed by the Secretariat. It was agreed that, following previous practice, Committee A would be entrusted with work on treaty instruments and technical matters on the agenda, and Committee B would focus on implementation, international cooperation and on budgetary and institutional matters. The President acknowledged the proposal to discuss, in plenary, Item 5.1 Protocol to eliminate illicit trade in tobacco products prior to its consideration by Committee A. There were no objections from the floor. The President informed the Conference that, in accordance with Rule 28.1 of the Rules of Procedure of the Conference of the Parties, the Committees should elect their own officers, unless the Conference decided otherwise. Nominations for the offices of Chairs and Vice-Chairs of Committees A and B are still being reviewed by regional groups, and consideration of this matter will resume at the next plenary meeting.

Credentials of participants The President reported that, in accordance with Rule 19 of the Rules of Procedure of the Conference of the Parties, the Bureau will examine the credentials of the Parties participating in this session and report in writing to a subsequent plenary meeting.

Application for observer status to the Conference of the Parties to the WHO Framework Convention on Tobacco Control The President informed the Conference that six applications have been submitted to the Secretariat under Rule 31.2 of the Rules of Procedures of the Conference of the Parties. In accordance with decision FCTC/COP/2(6), the Bureau examined all six applications and recommended to the Conference of the Parties - to grant observer status to the European Network for Smoking and Tobacco Prevention and to the International Network of Women Against Tobacco whose aims and goals are in conformity with those of the WHO Framework Convention on Tobacco Control. - that consideration of the application of the Human Rights and Tobacco Control Network be deferred until this organization has fully established itself and conducted relevant activities that would support its application. - to reject the applications of the Global Acetate Manufacturers Association and the International Tobacco Growers Association as information available on these two organizations showed that their activities may not be in line with the aims and spirit of the Convention, in particular with regard to Article 5.3 of the Convention. - to reject the application of the Liga Italiana Anti Fumo which did not submit the required documentation to enable a detailed review. However, a preliminary review showed that the organization’s activities are predominantly national and therefore this organization may not fulfill the criteria set out in the Rule 31 of the Rules of Procedure and in decision FCTC/COP/2(6). The Conference of the Parties adopted the recommendations of the Bureau. There was a request from the floor that in future information on organizations applying for observer status be made available to the Conference of the Parties.

Invited speaker The President welcomed, on behalf of the Conference of the Parties, His Excellency Tabaré Vázquez, Former President of Uruguay, who addressed the Conference. President Tabaré Vázquez is a physician and holds a degree in oncology and radiology. He held office as President of Uruguay from 2004 until 2010 and played a special role in leading the national policy and legislation for tobacco control in Uruguay.

Report of the Convention Secretariat The President opened the debate on item 4 and invited Dr Haik Nikogosian, Head of the Convention Secretariat, to present the report. The floor was given to the delegate of Bhutan, followed by the delegate of the Former Yugoslav Republic of Macedonia and the delegate of Belgium, who spoke on behalf of the European Union. The meeting was adjourned.

General debate on Item 4 (continued) The President reopened this item by inviting regional statements and gave the floor to the delegates of Peru (who spoke on behalf of the Region of the Americas), Norway (who spoke on behalf of the European Region), Nigeria (who spoke on behalf of the African Region) and Tunisia (who spoke on behalf of the Eastern Mediterranean Region). The delegates of Canada, Brazil, Russian Federation, Honduras and Turkey were invited to speak after which the general debate on Item 4 was suspended.

Debate on the role of the United Nations Development Assistance Framework in promoting the implementation of the Convention. The President introduced the panelists – Mr Courad, Secretaire d’Etat à l’intégration et à la lutte contre la pauvreté in Belgium; Mr Mettle-Nunoo, Deputy Minister of Health of Ghana; Dr Kuantei, Minister of Health of Palau; Ambassador Martabit, First President of the Conference of the Parties and Mr Nikhil Seth, Director of ECOSOC Support and Coordination Office at the United Nations Department of Economic and Social Affairs – and invited the panelists to the rostrum. The floor was open for debate followed by interventions from nongovernmental organizations. The panelists were invited to make final statements. The President informed the Conference that nominations for the offices of Chair and Vice-Chair of Committees A and B are still being reviewed by regional groups, and consideration of this matter will resume at the next plenary meeting. The President informed the Conference of a request from the regions to change the seating assignment from the current alphabetical order to a seating that would allow countries to be grouped by regions to facilitate consultations. There were no objections from the floor. The meeting was adjourned.
