eId="section-1"><num>1</num><heading> Possession or supply of anything for fraudulent purpose in connection with use of telecommunication system.</heading><content><p/><p><mod><del class="first" ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921"><noteRef uk:name="commentary" href="#c20999921" class="commentary"/>In the 1984 Act, after section 42 there shall be inserted—</del><quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><section><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">42A</del></num><heading><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921"> Possession or supply of anything for fraudulent purpose in connection with use of telecommunication system.</del></heading><subsection><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(1)</del></num><content><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">Subsection (2) below applies if a person has in his custody or under his control anything which may be used for the purpose of obtaining, or for a purpose connected with the obtaining of, a service to which section 42(1) above applies.</del></p></content></subsection><subsection><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(2)</del></num><intro><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">If the person intends—</del></p></intro><level class="para1"><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(a)</del></num><intro><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">to use the thing—</del></p></intro><level class="para2"><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(i)</del></num><content><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">to obtain such a service dishonestly, or</del></p></content></level><level class="para2"><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(ii)</del></num><content><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">for a purpose connected with the dishonest obtaining of such a service,</del></p></content></level></level><level class="para1"><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(b)</del></num><content><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">dishonestly to allow the thing to be used to obtain such a service, or</del></p></content></level><level class="para1"><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(c)</del></num><content><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">to allow the thing to be used for a purpose connected with the dishonest obtaining of such a service,</del></p></content></level><wrapUp><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">he shall be guilty of an offence.</del></p></wrapUp></subsection><subsection><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(3)</del></num><content><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">Subsection (4) below applies if a person supplies or offers to supply anything which may be used for the purpose of obtaining, or for a purpose connected with the obtaining of, a service to which section 42(1) above applies.</del></p></content></subsection><subsection><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(4)</del></num><intro><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">If the person supplying or offering to supply the thing knows or believes that the person to whom it is supplied or offered intends or intends if it is supplied to him—</del></p></intro><level class="para1"><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(a)</del></num><intro><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">to use it—</del></p></intro><level class="para2"><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(i)</del></num><content><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">to obtain such a service dishonestly, or</del></p></content></level><level class="para2"><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(ii)</del></num><content><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">for a purpose connected with the dishonest obtaining of such a service,</del></p></content></level></level><level class="para1"><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(b)</del></num><content><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">dishonestly to allow it to be used to obtain such a service, or</del></p></content></level><level class="para1"><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(c)</del></num><content><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">to allow it to be used for a purpose connected with the dishonest obtaining of such a service,</del></p></content></level><wrapUp><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">he shall be guilty of an offence.</del></p></wrapUp></subsection><subsection><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(5)</del></num><intro><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">A person guilty of an offence under this section shall be liable—</del></p></intro><level class="para1"><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(a)</del></num><content><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">on summary conviction, to imprisonment for a term not exceeding six months or to a fine not exceeding the statutory maximum or to both, and</del></p></content></level><level class="para1"><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(b)</del></num><content><p><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">on conviction on indictment, to imprisonment for a term not exceeding five years or to a fine or to both.</del></p></content></level></subsection><subsection><num><del ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">(6)</del></num><content><p><del class="last" ukl:ChangeId="d29p56" ukl:CommentaryRef="c20999921">In this section, references to use of a thing include, in the case of a thing which is used to record any data, use of any of the
