<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2"><num>2</num><heading>“Rent” and “business tenancy”</heading><subsection eId="section-2-1"><num>(1)</num><intro><p>“<term refersTo="#term-rent" eId="term-rent">Rent</term>”, in relation to a business tenancy, means an a
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-1"><num>(1)</num><intro><p>“<term refersTo="#term-rent" eId="term-rent">Rent</term>”, in relation to a business tenancy, means an amount consisting of one or more of the following—</p></intro><level class="para1" eId
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-1-a"><num>(a)</num><content><p>an amount payable by the tenant to the landlord under the tenancy for possession and use of the premises comprised in the tenancy (whether described as rent or otherwise);</p><
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-1-b"><num>(b)</num><content><p>an amount payable by the tenant to the landlord under the tenancy as a service charge;</p></content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-c"><num>(c)</num><intro><p>“<term refersTo="#term-service-charge" eId="term-service-charge">service charge</term>” means an amount—</p></intro><level class="para2" eId="section-2-2-c-i"><num>(i)</num><cont
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-2-2-c-i"><num>(i)</num><content><p>which is payable (directly or indirectly) for services, repairs, maintenance, improvements, insurance costs or the landlord’s management costs (including management costs of
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-2-2-c-ii"><num>(ii)</num><content><p>which is a fixed amount or an amount that varies or may vary according to the relevant costs (or a combination of the two).</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-3"><num>(3)</num><intro><p>In subsection <ref href="#section-2-2-c">(2)(c)</ref>—</p></intro><level class="para1" eId="section-2-3-a"><num>(a)</num><intro><p>“<term refersTo="#term-insurance-costs" eId="term-insuranc

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-b"><num>(b)</num><intro><p>“<term refersTo="#term-the-relevant-costs" eId="term-the-relevant-costs">the relevant costs</term>” means the costs or estimated costs incurred or to be incurred by or on behalf
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-2-3-b-i"><num>(i)</num><content><p>“<term refersTo="#term-costs" eId="term-costs">costs</term>” includes overheads, and</p></content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-4"><num>(4)</num><content><p>An amount drawn down by the landlord from a tenancy deposit to meet the whole or part of a rent debt is to be treated as unpaid rent due from the tenant to the landlord (and such rent is
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-5"><num>(5)</num><content><p>“<term refersTo="#term-business-tenancy" eId="term-business-tenancy">Business tenancy</term>” means a tenancy to which Part 2 of the Landlord and Tenant Act 1954 applies.</p></content></s

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-b"><num>(b)</num><content><p>the rent is attributable to a period of occupation by the tenant for, or for a period within, the protected period applying to the tenancy (see section 5).</p></content></level
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-3"><num>(3)</num><content><p>Rent consisting of interest on an unpaid amount within section 2<ref href="#section-2-1-a">(1)(a)</ref> or <ref href="#section-2-1-b">(b)</ref> is to be regarded for the purposes of subse

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-6"><num>6</num><heading>“The matter of relief from payment”</heading><subsection eId="section-6-1"><num>(1)</num><intro><p>References to the matter of relief from payment of a protected rent debt are to all issues relatin

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-6-1-a"><num>(a)</num><content><p>whether there is a protected rent debt of any amount, and</p></content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-6-2"><num>(2)</num><intro><p>“<term refersTo="#term-relief-from-payment" eId="term-relief-from-payment">Relief from payment</term>”, in relation to a protected rent debt, means any one or more of the following—</p></in

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-6-2-b"><num>(b)</num><content><p>giving time to pay the whole or any part of the debt, including by allowing the whole or any part of the debt to be paid by instalments;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-6-2-c"><num>(c)</num><content><p>reducing (including to zero) any interest otherwise payable by the tenant under the terms of the tenancy in relation to the whole or any part of the debt.</p></content></level>
