eId="section-1"><num>1</num><heading>Nuclear safeguards</heading><subsection eId="section-1-1"><num>(1)</num><content><p><mod>For section 72 of the Energy Act 2013 substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><section><num>72</num><heading>Nuclear safeguards purposes</heading><intro><p>In this Part, the “<term refersTo="#term-nuclear-safeguards-purposes">nuclear safeguards purposes</term>” means the purposes of—</p></intro><level class="para1"><num>(a)</num><content><p>ensuring compliance with nuclear safeguards regulations (see section 76A),</p></content></level><level class="para1"><num>(b)</num><content><p>ensuring compliance by the United Kingdom or, as the case may be, enabling or facilitating compliance by a Minister of the Crown, with a relevant international agreement, and</p></content></level><level class="para1"><num>(c)</num><content><p>the development of any future obligations relating to nuclear safeguards.</p></content></level></section></quotedStructure></mod></p></content></subsection><subsection eId="section-1-2"><num>(2)</num><content><p><mod>After section 76 of that Act insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><chapter><num>CHAPTER 2A</num><heading>Nuclear safeguards</heading><section><num>76A</num><heading>Nuclear safeguards regulations</heading><subsection><num>(1)</num><intro><p>The Secretary of State may by regulations (“<term refersTo="#term-nuclear-safeguards-regulations">nuclear safeguards regulations</term>”) make provision for the purpose of—</p></intro><level class="para1"><num>(a)</num><content><p>ensuring that qualifying nuclear material, facilities or equipment are only available for use for civil activities (whether in the United Kingdom or elsewhere), or</p></content></level><level class="para1"><num>(b)</num><content><p>giving effect to provisions of a relevant international agreement.</p></content></level></subsection><subsection><num>(2)</num><intro><p>The regulations may, for example, make provision relating to—</p></intro><level class="para1"><num>(a)</num><content><p>record-keeping or accounting;</p></content></level><level class="para1"><num>(b)</num><content><p>the provision or publication of information;</p></content></level><level class="para1"><num>(c)</num><content><p>inspection or monitoring;</p></content></level><level class="para1"><num>(d)</num><content><p>imports or exports;</p></content></level><level class="para1"><num>(e)</num><content><p>the design of qualifying nuclear facilities or equipment;</p></content></level><level class="para1"><num>(f)</num><content><p>the production, processing, use, handling, storage or disposal of qualifying nuclear material or equipment.</p></content></level></subsection><subsection><num>(3)</num><content><p>The following apply in relation to nuclear safeguards regulations as they apply in relation to nuclear regulations—</p><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>section 74(3) to (5) (nuclear regulations),</p></item><item><p>section 75 (offences),</p></item><item><p>section 76 (civil liability), and</p></item><item><p>paragraphs 2 to 16 of Schedule 6 (examples of provision that may be made by nuclear regulations).</p></item></blockList></content></subsection><subsection><num>(4)</num><content><p>Nothing in nuclear safeguards regulations applies in relation to anything done for defence purposes (within the meaning of section 70).</p></content></subsection><subsection><num>(5)</num><content><p>The provision that may be made by nuclear safeguards regulations by virtue of section 113(7) includes provision modifying retained EU law (within the meaning of the European Union (Withdrawal) Act 2018).</p></content></subsection><subsection><num>(6)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><intro><p>“<term refersTo="#term-civil-activities">civil activities</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>production, processing or storage activities which are carried on for peaceful purposes;</p></content></level><level class="para1"><num>(b)</num><content><p>electricity generation carried on for peaceful purposes;</p></content></level><level class="para1"><num>(c)</num><content><p>decommissioning;</p></content></level><level class="para1"><num>(d)</num><content><p>research and development carried on for peaceful purposes;</p></content></level><level class="para1"><num>(e)</num><content><p>any other activity carried on for peaceful purposes;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-equipment">equipment</term>” has the meaning given by section 70(3);</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-qualifying-nuclear-equipment">qualifying nuclear equipment</term>” means equipment designed or adapted for use in connection with qualifying nuclear material or a qualifying nuclear facility;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-qualifying-nuclear-facility">qualifying nuclear facility</term>” means a facility (including associated buildings) in which qualifying nuclear material is produced, processed, used, handled, stored or disposed of;</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-qualifying-nuclear-material">qualifying nuclear material</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>fissionable material specified in regulations under subsection (7),</p></content></level><level class="para1"><num>(b)</num><content><p>source material in the form of—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>uranium metal, alloy or compound, or</p></item><item><num>(ii)</num><p>thorium metal, alloy or compound, or</p></item></blockList></content></level><level class="para1"><num>(c)</num><content><p>ore containing a substance from which a source material falling within paragraph (b) is capable of being derived.</p></content></level></hcontainer></subsection><subsection><num>(7)</num><content><p>The Secretary of State may by regulations specify fissionable material for the purposes of the definition of “qualifying nuclear material”.</p></content></subsection><subsection><num>(8)</num><intro><p>Before making any regulations under this section, the Secretary of State must consult—</p></intro><level class="para1"><num>(a)</num><content><p>the ONR, and</p></content></level><level class="para1"><num>(b)</num><content><p>such other persons (if any) as the Secretary of State considers it appropriate to consult.</p></content></level></subsection><subsection><num>(9)</num><content><p>Subsection (8)(a) does not apply if the regulations give effect, without modification, to proposals submitted by the ONR under section 81(1)(a)(ia).</p></content></subsection></section><section><num>76B</num><heading>Payments in respect of compliance costs</heading><subsection><num>(1)</num><content><p>The Secretary of State may by regulations authorise or require the ONR to make payments towards compliance costs.</p></content></subsection><subsection><num>(2)</num><content><p>“<term refersTo="#term-compliance-costs">Compliance costs</term>” means costs of complying with nuclear safeguards regulations or with specified provisions of nuclear safeguards regulations.</p></content></subsection><subsection><num>(3)</num><content><p>Regulations under subsection (1) may provide that payments are authorised or required to be made only in specified circumstances.</p></content></subsection><subsection><num>(4)</num><content><p>The ONR is responsible for determining the amounts of payments in accordance with any provision made by regulations under subsection (1).</p></content></subsection><subsection><num>(5)</num><content><p>In this section, “<term refersTo="#term-specified">specified</term>” means specified in regulations under subsection (1).</p></content></subsection></section></chapter></quotedStructure></mod></p></content></subsection><subsection eId="section-1-3"><num>(3)</num><intro><p>In section 112 of that Act (interpretation)—</p></intro><level class="para1" eId="section-1-3-a"><num>(a)</num><content><p><mod>in subsection (1), at the appropriate places insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><p>“<term refersTo="#term-nuclear-safeguards-regulations">nuclear safeguards regulations</term>” means regulations under section 76A(1);</p></quotedStructure><inline name="appendText">;</inline></mod></p><p><mod><quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><p>“<term refersTo="#term-relevant-international-agreement">relevant international agreement</term>” has the meaning given by subsection (1A);</p></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="section-1-3-b"><num>(b)</num><content><p><mod>after subsection (1) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection><num>(1A)</num><intro><p>Relevant international agreement” means an agreement (whether or not ratified) to which the United Kingdom is a party and which—</p></intro><level class="para1"><num>(a)</num><content><p>relates to nuclear safeguards, and</p></content></level><level class="para1"><num>(b)</num><content><p>is specified in regulations under subsection (1B),</p></content></level><wrapUp><p>and a reference in this Part to a relevant international agreement is to the agreement as it has effect for the time being.</p></wrapUp></subsection><subsection><num>(1B)</num><content><p>The Secretary of State may by regulations specify agreements for the purposes of subsection (1A)(b).</p></content></subsection><subsection><num>(1C)</num><intro><p>References in subsection (1A) to an agreement to which the United Kingdom is a party include an undertaking given by the United Kingdom which—</p></intro><level class="para1"><num>(a)</num><content><p>relates to guidance or any other document issued by the International Atomic Energy Agency, and</p></content></level><level class="para1"><num>(b)</num><content><p>is notified to the Agency by the United Kingdom,</p></content></level><wrapUp><p>(and the reference in subsection (1B) to an agreement is to be read accordingly).</p></wrapUp></subsection><subsection><num>(1D)</num><intro><p>Before making regulations under subsection (1B), the Secretary of State must consult—</p></intro><level class="para1"><num>(a)</num><content><p>the ONR, and</p></content></level><level class="para1"><num>(b)</num><content><p>such other persons (if any) as the Secretary of State considers it appropriate to consult.</p></content></level></subsection><subsection><num>(1E)</num><content><p>Subsection (1D)(a) does not apply if the regulations give effect, without modification, to proposals submitted by the ONR under section 81(1)(a)(iiia).</p></content></subsection></quotedStructure></mod></p></content></level></subsection><subsection eId="section-1-4"><num>(4)</num><content><p>A consultation requirement imposed by an amendment made by this section may be satisfied by consultation carried out before this Act was passed.</p></content></subsection><subsection eId="section-1-5"><num>(5)</num><content><p>The Schedule contains minor and consequential amendments.</p></content></subsection></section>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" class="para1" eId="section-1-3-b"><num>(b)</num><content><p><mod>after subsection (1) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection><num>(1A)</num><intro><p>Relevant international agreement” means an agreement (whether or not ratified) to which the United Kingdom is a party and which—</p></intro><level class="para1"><num>(a)</num><content><p>relates to nuclear safeguards, and</p></content></level><level class="para1"><num>(b)</num><content><p>is specified in regulations under subsection (1B),</p></content></level><wrapUp><p>and a reference in this Part to a relevant international agreement is to the agreement as it has effect for the time being.</p></wrapUp></subsection><subsection><num>(1B)</num><content><p>The Secretary of State may by regulations specify agreements for the purposes of subsection (1A)(b).</p></content></subsection><subsection><num>(1C)</num><intro><p>References in subsection (1A) to an agreement to which the United Kingdom is a party include an undertaking given by the United Kingdom which—</p></intro><level class="para1"><num>(a)</num><content><p>relates to guidance or any other document issued by the International Atomic Energy Agency, and</p></content></level><level class="para1"><num>(b)</num><content><p>is notified to the Agency by the United Kingdom,</p></content></level><wrapUp><p>(and the reference in subsection (1B) to an agreement is to be read accordingly).</p></wrapUp></subsection><subsection><num>(1D)</num><intro><p>Before making regulations under subsection (1B), the Secretary of State must consult—</p></intro><level class="para1"><num>(a)</num><content><p>the ONR, and</p></content></level><level class="para1"><num>(b)</num><content><p>such other persons (if any) as the Secretary of State considers it appropriate to consult.</p></content></level></subsection><subsection><num>(1E)</num><content><p>Subsection (1D)(a) does not apply if the regulations give effect, without modification, to proposals submitted by the ONR under section 81(1)(a)(iiia).</p></content></subsection></quotedStructure></mod></p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-4"><num>(4)</num><content><p>A consultation requirement imposed by an amendment made by this section may be satisfied by consultation carried out before this Act was passed.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-5"><num>(5)</num><content><p>The Schedule contains minor and consequential amendments.</p></content></subsection>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2"><num>2</num><heading>Power to amend legislation relating to nuclear safeguards</heading><subsection eId="section-2-1"><num>(1)</num><intro><p>The Secretary of State may by regulations amend any of the following in consequence of a relevant safeguards agreement—</p></intro><level class="para1" eId="section-2-1-a"><num>(a)</num><content><p>the Nuclear Safeguards and Electricity (Finance) Act 1978,</p></content></level><level class="para1" eId="section-2-1-b"><num>(b)</num><content><p>the Nuclear Safeguards Act 2000, and</p></content></level><level class="para1" eId="section-2-1-c"><num>(c)</num><content><p>the Nuclear Safeguards (Notification) Regulations 2004 (S.I. 2004/1255).</p></content></level></subsection><subsection eId="section-2-2"><num>(2)</num><content><p>In subsection (1) “<term refersTo="#term-relevant-safeguards-agreement" eId="term-relevant-safeguards-agreement">relevant safeguards agreement</term>” means an agreement (whether or not ratified) relating to nuclear safeguards to which the United Kingdom and the International Atomic Energy Agency are parties.</p></content></subsection><subsection eId="section-2-3"><num>(3)</num><intro><p>Regulations under this section may include—</p></intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content><p>consequential, supplementary or incidental provision;</p></content></level><level class="para1" eId="section-2-3-b"><num>(b)</num><content><p>transitional, transitory or saving provision.</p></content></level></subsection><subsection eId="section-2-4"><num>(4)</num><content><p>The power to make regulations under this section is exercisable by statutory instrument.</p></content></subsection><subsection eId="section-2-5"><num>(5)</num><content><p>An instrument containing (whether alone or with other provision) regulations under this section may not be made unless a draft of the instrument has been laid before and approved by a resolution of each House of Parliament.</p></content></subsection><subsection eId="section-2-6"><num>(6)</num><content><p>No regulations may be made under this section after the end of the period of 5 years beginning with the day on which this section comes into force.</p></content></subsection></section>

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4"><num>4</num><heading>Request for continuation of existing arrangements</heading><subsection eId="section-4-1"><num>(1)</num><content><p>The Secretary of State must make a relevant request to the European Council if neither of conditions 1 and 2 is met at the beginning of the period of 28 days ending with exit day.</p></content></subsection><subsection eId="section-4-2"><num>(2)</num><content><p>Condition 1 is that all of the principal international agreements have been signed.</p></content></subsection><subsection eId="section-4-3"><num>(3)</num><intro><p>Condition 2 is that—</p></intro><level class="para1" eId="section-4-3-a"><num>(a)</num><content><p>one or more of the principal international agreements have not been signed, but</p></content></level><level class="para1" eId="section-4-3-b"><num>(b)</num><intro><p>in respect of each agreement that has not been signed, arrangements for the corresponding Euratom arrangements to have effect in relation to the United Kingdom after exit day—</p></intro><level class="para2" eId="section-4-3-b-i"><num>(i)</num><content><p>have been made, or</p></content></level><level class="para2" eId="section-4-3-b-ii"><num>(ii)</num><content><p>will, in the Secretary of State's opinion, have been made before exit day.</p></content></level></level></subsection><subsection eId="section-4-4"><num>(4)</num><intro><p>A “relevant request” is a request, in relation to each principal international agreement that has not been signed and in respect of which subsection (3)(b) does not apply, for the corresponding Euratom arrangements to continue to have effect in relation to the United Kingdom after exit day until—</p></intro><level class="para1" eId="section-4-4-a"><num>(a)</num><content><p>the principal international agreement comes into force, or</p></content></level><level class="para1" eId="section-4-4-b"><num>(b)</num><content><p>arrangements have been made for the corresponding Euratom arrangements to have effect in relation to the United Kingdom until further notice.</p></content></level></subsection><subsection eId="section-4-5"><num>(5)</num><intro><p>The “principal international agreements” are—</p></intro><level class="para1" eId="section-4-5-a"><num>(a)</num><content><p>agreements relating to nuclear safeguards to which only the United Kingdom and the International Atomic Energy Agency are parties;</p></content></level><level class="para1" eId="section-4-5-b"><num>(b)</num><content><p>agreements relating to nuclear safeguards to which the United Kingdom is a party with, respectively, the governments of Australia, Canada, Japan and the United States of America (and for this purpose “<term refersTo="#term-agreement" eId="term-agreement">agreement</term>” includes an agreement or other arrangement that modifies or supplements an existing agreement).</p></content></level></subsection><subsection eId="section-4-6"><num>(6)</num><intro><p>A reference in this section to “the corresponding Euratom arrangements” is a reference—</p></intro><level class="para1" eId="section-4-6-a"><num>(a)</num><content><p>in the case of an agreement referred to in subsection (5)(a), to whichever of the Safeguards Agreement and the Additional Protocol corresponds to the agreement;</p></content></level><level class="para1" eId="section-4-6-b"><num>(b)</num><content><p>in the case of an agreement referred to in subsection (5)(b), to whichever of the agreements to which Euratom is a party with the government of Australia, Canada, Japan or the United States of America corresponds to the agreement (and for this purpose the reference to an agreement to which Euratom is a party includes any agreement or other arrangement that modifies or supplements the agreement).</p></content></level></subsection><subsection eId="section-4-7"><num>(7)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-exit-day" eId="term-exit-day">exit day</term>” has the same meaning as in the European Union (Withdrawal) Act 2018 (and references to before or after exit day are to be read accordingly);</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-the-safeguards-agreement" eId="term-the-safeguards-agreement">the Safeguards Agreement</term>” and “<term refersTo="#term-the-additional-protocol" eId="term-the-additional-protocol">the Additional Protocol</term>” have the same meaning as in the Nuclear Safeguards Act 2000;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-signed" eId="term-signed">signed</term>”, in relation to a principal international agreement, means signed by both parties to the agreement.</p></content></hcontainer></subsection></section>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-4-3-b-ii"><num>(ii)</num><content><p>will, in the Secretary of State's opinion, have been made before exit day.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-4"><num>(4)</num><intro><p>A “relevant request” is a request, in relation to each principal international agreement that has not been signed and in respect of which subsection (3)(b) does not apply, for the corresponding Euratom arrangements to continue to have effect in relation to the United Kingdom after exit day until—</p></intro><level class="para1" eId="section-4-4-a"><num>(a)</num><content><p>the principal international agreement comes into force, or</p></content></level><level class="para1" eId="section-4-4-b"><num>(b)</num><content><p>arrangements have been made for the corresponding Euratom arrangements to have effect in relation to the United Kingdom until further notice.</p></content></level></subsection>

<paragraph xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="schedule-paragraph-1" class="schProv1"><num>1</num><content><p>Part 3 of the Energy Act 2013 (nuclear regulation) is amended as follows.</p></content></paragraph>
