<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-1"><num>(1)</num><intro>The Secretary of State may provide financial assistance to the Organising Committee—</intro><level class="para1" eId="section-1-1-a"><num>(a)</num><content>for the purpose of deliver

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-a"><num>(a)</num><content>for the purpose of delivering the Games, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-b"><num>(b)</num><content>for any other purpose connected to, or arising from, the Games.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-2"><num>(2)</num><intro>Financial assistance under subsection (1)—</intro><level class="para1" eId="section-1-2-a"><num>(a)</num><content>may take the form of grants, loans, guarantees or indemnities, and</

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-2-a"><num>(a)</num><content>may take the form of grants, loans, guarantees or indemnities, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-2-b"><num>(b)</num><content>may be given subject to conditions (which may include conditions about repayment with or without interest).</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-1-3"><num>(3)</num><content>In this Act—<blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item>the “Games” are

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><content>“<term refersTo="#term-relevant-public-place" eId="term-relevant-public-place">relevant public place</term>” has the meaning given by subsection (8);</content></hcontainer>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-5-2"><num>(2)</num><intro>Section 3(1) is not breached by the use of a representation in any manner by a person acting in the course of a business if—</intro><level class="para1" eId="section-5-2-a"><num>(a)</nu

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-5-2-a"><num>(a)</num><content>immediately before 21 December 2017, the representation was used in that manner for the purpose of activities constituting the business, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-5-2-b"><num>(b)</num><content>the representation has continued to be used in that manner for that purpose since that day.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-5-9"><num>(9)</num><content>Schedule 1 contains exceptions relevant to providers of information society services.</content></subsection>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1"><num>(a)</num><content>a county council,</content></level>

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><content>“<term refersTo="#term-officer" eId="term-officer">officer</term>”, in relation to a relevant authority, is to be read in accordance with paragraph 7(1) and (2) of Schedule 5 to the 2015 Act, but as if

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><content>“<term refersTo="#term-established" eId="term-established">established</term>”, in relation to a service provider, is to be read in accordance with paragraph 6;</content></hcontainer>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1"><num>(a)</num><content>has the meaning given in Article 2(a) of the E-Commerce Directive (which refers to Article 1(2) of Directive <ref eId="c00003" href="http://www.legislation.gov.uk/european/directive/1998/0034">98/

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-b"><num>(b)</num><content>details of what the Organising Committee has done to ensure that its delivery of the Games promotes the values of the Commonwealth Games Federation;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-c"><num>(c)</num><content>details of what the Organising Committee has done to ensure that Games events are accessible to disabled people;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-d"><num>(d)</num><content>details of what the Organising Committee has done to promote sustainability in its delivery of the Games;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-e"><num>(e)</num><content>details of what the Organising Committee has done to maximise the benefits to be derived from the Games.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-3"><num>(3)</num><content>The reference in subsection (2) (b) to the values of the Commonwealth Games Federation is a reference to the values expressed in the constitution of the Commonwealth Games Federation, as

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-4"><num>(4)</num><content>The Secretary of State must lay before Parliament a copy of each report received by the Secretary of State under this section.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-5"><num>(5)</num><intro>In this section “<term refersTo="#term-reporting-period" eId="term-reporting-period">reporting period</term>” means—</intro><level class="para1" eId="section-2-5-a"><num>(a)</num><cont

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3"><num>3</num><heading>Unauthorised association with the Games</heading><subsection eId="section-3-1"><num>(1)</num><intro>A person acting in the course of a business may not use any representation (of any kind) in a

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-1"><num>(1)</num><intro>A person acting in the course of a business may not use any representation (of any kind) in a manner likely to suggest to the public that there is an association between the Games and—<

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-a"><num>(a)</num><content>goods or services, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-b"><num>(b)</num><content>a person providing goods or services.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-2"><num>(2)</num><intro>The following are examples of an association between the Games and a person providing goods or services—</intro><level class="para1" eId="section-3-2-a"><num>(a)</num><content>a cont

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-a"><num>(a)</num><content>a contractual relationship;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-b"><num>(b)</num><content>a commercial relationship;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-c"><num>(c)</num><content>a corporate or structural connection;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-d"><num>(d)</num><content>the provision of financial or other assistance.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-3"><num>(3)</num><intro>“Use” of a representation includes, among other things—</intro><level class="para1" eId="section-3-3-a"><num>(a)</num><content>applying a representation to goods or documents;</c

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-a"><num>(a)</num><content>applying a representation to goods or documents;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-b"><num>(b)</num><content>selling, offering, or exposing for sale goods that bear a representation;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-c"><num>(c)</num><content>importing or exporting goods that bear a representation;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-d"><num>(d)</num><content>providing or offering services by reference to a representation;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-e"><num>(e)</num><content>promoting goods or services by reference to a representation.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-4"><num>(4)</num><content>A breach of subsection (1) is to be treated as though it were an infringement of an exclusive right of the Organising Committee to use any representation (of any kind) in the manner descr

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-5"><num>(5)</num><content>In an action for breach of subsection (1), the court may grant any relief that is available in respect of the infringement of a property right (whether by way of damages, injunction, acco

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-6"><num>(6)</num><intro>In subsection (5), “<term refersTo="#term-court" eId="term-court">court</term>” means—</intro><level class="para1" eId="section-3-6-a"><num>(a)</num><content>in England and Wales, t

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-6-a"><num>(a)</num><content>in England and Wales, the High Court,</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-6-b"><num>(b)</num><content>in Scotland, the Court of Session or the sheriff, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-6-c"><num>(c)</num><content>in Northern Ireland, the High Court or the county court.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-7"><num>(7)</num><intro>Subsection (1) is—</intro><level class="para1" eId="section-3-7-a"><num>(a)</num><content>subject to sections 4 and 5 (authorised association and other exceptions), and</content>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-7-a"><num>(a)</num><content>subject to sections 4 and 5 (authorised association and other exceptions), and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-7-b"><num>(b)</num><content>enforceable only by the Organising Committee in accordance with subsections (4) and (5) and sections 6 and 7.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-1"><num>(1)</num><content>Section 3(1) is not breached by the use of a representation in accordance with an authorisation granted by the Organising Committee.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-2"><num>(2)</num><intro>An authorisation granted under this section may—</intro><level class="para1" eId="section-4-2-a"><num>(a)</num><content>be granted in respect of a person or a description of person;<

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-4-2-c"><num>(c)</num><content>be subject to conditions;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-4-2-d"><num>(d)</num><content>be revoked.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-4"><num>(4)</num><content>An authorisation granted under this section must be in writing.</content></subsection>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-5-7-c"><num>(c)</num><content>the current use is in accordance with that authorisation.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-6-1"><num>(1)</num><content>A court may make any order falling within subsection (3) in respect of infringing goods or documents held by any person in the course of a business.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-6-2"><num>(2)</num><intro>“<term refersTo="#term-infringing-goods-or-documents" eId="term-infringing-goods-or-documents">Infringing goods or documents</term>” means—</intro><level class="para1" eId="section-6-2-

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-6-2-a"><num>(a)</num><content>goods or documents that bear a representation in breach of section 3(1), or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-6-2-b"><num>(b)</num><content>things that have been specifically designed or adapted to produce such goods or documents.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-6-3"><num>(3)</num><intro>The orders falling within this subsection are—</intro><level class="para1" eId="section-6-3-a"><num>(a)</num><intro>an order that the infringing goods or documents be delivered up to

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-6-3-a-i"><num>(i)</num><content>the Organising Committee, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-6-3-a-ii"><num>(ii)</num><content>such other person as the court may direct;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-6-3-b"><num>(b)</num><content>an order that the representation be erased, removed or obliterated from the infringing goods or documents;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-6-3-c"><num>(c)</num><intro>an order that the infringing goods or documents be returned to—</intro><level class="para2" eId="section-6-3-c-i"><num>(i)</num><content>the person from whom they were del

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-6-3-c-ii"><num>(ii)</num><content>any other person having an interest in them;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-6-3-d"><num>(d)</num><intro>an order that the infringing goods or documents be forfeited to—</intro><level class="para2" eId="section-6-3-d-i"><num>(i)</num><content>the Organising Committee, or<

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-6-3-d-i"><num>(i)</num><content>the Organising Committee, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-6-3-d-ii"><num>(ii)</num><content>such other person as the court may direct;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-6-3-e"><num>(e)</num><content>an order that the infringing goods or documents be destroyed.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-6-5"><num>(5)</num><content>In this section, “<term refersTo="#term-court" eId="term-court">court</term>” has the meaning given by section 3(6).</content></subsection>

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-7"><num>7</num><heading>Protections for persons with an interest in goods or documents</heading><subsection eId="section-7-1"><num>(1)</num><intro>If the Organising Committee applies for an order under section 6—</

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-7-1-b-ii"><num>(ii)</num><content>to appeal against any order made in respect of the infringing goods or documents (whether or not the person appeared in the proceedings in which the order was made).</c

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-10-3-c"><num>(c)</num><content>exposing a Games ticket for sale;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-10-3-d"><num>(d)</num><content>advertising that a Games ticket is available for purchase (but see subsection (4)).</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-10-4"><num>(4)</num><content>It is not an offence for a person (“A”) to advertise that a Games ticket is available for purchase from another person (“B”) unless A knows, or ought to know, that B is touting a Games t

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-10-5"><num>(5)</num><content>In this section, a reference to the sale of a Games ticket includes a reference to the giving of a Games ticket to a person who pays, or agrees to pay, for other goods or services; and a

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-13-3"><num>(3)</num><intro>Any period specified for the purposes of this section must—</intro><level class="para1" eId="section-13-3-a"><num>(a)</num><content>begin no earlier than the beginning of the period

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-14-3-d"><num>(d)</num><content>require a person in respect of whom authorisation is granted to produce evidence of the authorisation on request;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-14-3-e"><num>(e)</num><content>be inconsistent with, or more onerous than, the conditions of any other advertising licence (whether granted under this section or otherwise).</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-17-3-e"><num>(e)</num><content>be inconsistent with, or more onerous than, the conditions of any other trading licence (whether granted under this section or otherwise).</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-17-4"><num>(4)</num><intro>In considering whether or not to grant an authorisation under this section, the Organising Committee may have regard to, among other things—</intro><level class="para1" eId="section-17

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-17-4-a"><num>(a)</num><content>any agreements entered into (whether by the Secretary of State or otherwise) for the purposes of the Games;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-17-4-b"><num>(b)</num><content>any existing trading licences (whether granted under this section or otherwise).</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-25-1"><num>(1)</num><content>The Secretary of State may direct a local authority in England or a combined authority to prepare a Games transport plan.</content></subsection>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-25-3-c"><num>(c)</num><content>if the authority consider it appropriate, revise the plan;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-25-3-d"><num>(d)</num><content>except in so far as the authority consider it undesirable for reasons of security, publish the plan and any revision.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-25-4"><num>(4)</num><content>Before preparing or revising the plan, the authority directed under subsection (1) must consult the persons referred to in subsection (5).</content></subsection>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-25-5-c-i"><num>(i)</num><content>the local traffic authority for the road, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-25-5-c-ii"><num>(ii)</num><content>if different, the local authority in whose area the road is situated;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-25-5-d"><num>(d)</num><content>any chief officer of police whom the authority directed under subsection (1) consider it appropriate to consult;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-25-5-e"><num>(e)</num><content>any transport operator which the authority directed under subsection (1) consider it appropriate to consult;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-25-5-f"><num>(f)</num><content>any other person whom the Secretary of State or the authority directed under subsection (1) consider it appropriate to consult.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-25-6"><num>(6)</num><content>Each local traffic authority for a road affected by the plan must exercise their functions with a view to securing the implementation of the plan.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-25-7"><num>(7)</num><content>The requirement in subsection (4) may be satisfied by consultation undertaken before the coming into force of this section.</content></subsection>

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-26"><num>26</num><heading>Temporary prohibition or restriction on roads</heading><subsection eId="section-26-1"><num>(1)</num><intro>Section 14 of the RTRA 1984 has effect in relation to a traffic authority for a road

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-26-1"><num>(1)</num><intro>Section 14 of the RTRA 1984 has effect in relation to a traffic authority for a road in England as if subsection (1)(c) of that section included the following purposes—</intro><level c

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-26-1-b"><num>(b)</num><content>facilitating transport services in connection with the Games, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-26-1-c"><num>(c)</num><content>facilitating travel by any person for a purpose connected to the Games.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-26-2"><num>(2)</num><intro>The following do not apply in relation to an order made or notice issued by virtue of this section—</intro><level class="para1" eId="section-26-2-a"><num>(a)</num><content>section 1

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-26-4"><num>(4)</num><content>An order made by virtue of this section must cease to have effect no later than the end of the period of 5 days beginning with the day after the day on which the Games end.</content>
