<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-1"><num>(1)</num><intro><p>The Secretary of State may provide financial assistance to the Organising Committee—</p></intro><level class="para1" eId="section-1-1-a"><num>(a)</num><content><p>for the purpose of deliver
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-a"><num>(a)</num><content><p>for the purpose of delivering the Games, or</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-b"><num>(b)</num><content><p>for any other purpose connected to, or arising from, the Games.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-2"><num>(2)</num><intro><p>Financial assistance under subsection (1)—</p></intro><level class="para1" eId="section-1-2-a"><num>(a)</num><content><p>may take the form of grants, loans, guarantees or indemnities, and</

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-5-9"><num>(9)</num><content><p>Schedule 1 contains exceptions relevant to providers of information society services.</p></content></subsection>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-b"><num>(b)</num><content><p>details of what the Organising Committee has done to ensure that its delivery of the Games promotes the values of the Commonwealth Games Federation;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-c"><num>(c)</num><content><p>details of what the Organising Committee has done to ensure that Games events are accessible to disabled people;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-d"><num>(d)</num><content><p>details of what the Organising Committee has done to promote sustainability in its delivery of the Games;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-e"><num>(e)</num><content><p>details of what the Organising Committee has done to maximise the benefits to be derived from the Games.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-3"><num>(3)</num><content><p>The reference in subsection (2)
(b) to the values of the Commonwealth Games Federation is a reference to the values expressed in the constitution of the Commonwealth Games Federation, as
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-4"><num>(4)</num><content><p>The Secretary of State must lay before Parliament a copy of each report received by the Secretary of State under this section.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-5"><num>(5)</num><intro><p>In this section “<term refersTo="#term-reporting-period" eId="term-reporting-period">reporting period</term>” means—</p></intro><level class="para1" eId="section-2-5-a"><num>(a)</num><cont

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3"><num>3</num><heading>Unauthorised association with the Games</heading><subsection eId="section-3-1"><num>(1)</num><intro><p>A person acting in the course of a business may not use any representation (of any kind) in a
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-1"><num>(1)</num><intro><p>A person acting in the course of a business may not use any representation (of any kind) in a manner likely to suggest to the public that there is an association between the Games and—</p><
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-a"><num>(a)</num><content><p>goods or services, or</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-b"><num>(b)</num><content><p>a person providing goods or services.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-2"><num>(2)</num><intro><p>The following are examples of an association between the Games and a person providing goods or services—</p></intro><level class="para1" eId="section-3-2-a"><num>(a)</num><content><p>a cont
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-a"><num>(a)</num><content><p>a contractual relationship;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-b"><num>(b)</num><content><p>a commercial relationship;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-c"><num>(c)</num><content><p>a corporate or structural connection;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-d"><num>(d)</num><content><p>the provision of financial or other assistance.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-3"><num>(3)</num><intro><p>“Use” of a representation includes, among other things—</p></intro><level class="para1" eId="section-3-3-a"><num>(a)</num><content><p>applying a representation to goods or documents;</p></c
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-a"><num>(a)</num><content><p>applying a representation to goods or documents;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-b"><num>(b)</num><content><p>selling, offering, or exposing for sale goods that bear a representation;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-c"><num>(c)</num><content><p>importing or exporting goods that bear a representation;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-d"><num>(d)</num><content><p>providing or offering services by reference to a representation;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-e"><num>(e)</num><content><p>promoting goods or services by reference to a representation.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-4"><num>(4)</num><content><p>A breach of subsection (1) is to be treated as though it were an infringement of an exclusive right of the Organising Committee to use any representation (of any kind) in the manner descr
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-5"><num>(5)</num><content><p>In an action for breach of subsection (1), the court may grant any relief that is available in respect of the infringement of a property right (whether by way of damages, injunction, acco
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-6"><num>(6)</num><intro><p>In subsection (5), “<term refersTo="#term-court" eId="term-court">court</term>” means—</p></intro><level class="para1" eId="section-3-6-a"><num>(a)</num><content><p>in England and Wales, t

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-6-c"><num>(c)</num><content><p>in Northern Ireland, the High Court or the county court.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-7"><num>(7)</num><intro><p>Subsection (1) is—</p></intro><level class="para1" eId="section-3-7-a"><num>(a)</num><content><p>subject to sections 4 and 5 (authorised association and other exceptions), and</p></content>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-4-2-d"><num>(d)</num><content><p>be revoked.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-3"><num>(3)</num><content><p>In considering whether or not to grant an authorisation under this section, the Organising Committee may have regard to, among other things, any agreements entered into (whether by the Se
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-4"><num>(4)</num><content><p>An authorisation granted under this section must be in writing.</p></content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-6-2"><num>(2)</num><intro><p>“<term refersTo="#term-infringing-goods-or-documents" eId="term-infringing-goods-or-documents">Infringing goods or documents</term>” means—</p></intro><level class="para1" eId="section-6-2-

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-6-3-d"><num>(d)</num><intro><p>an order that the infringing goods or documents be forfeited to—</p></intro><level class="para2" eId="section-6-3-d-i"><num>(i)</num><content><p>the Organising Committee, or</p><
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-6-3-d-i"><num>(i)</num><content><p>the Organising Committee, or</p></content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-14-3-d"><num>(d)</num><content><p>require a person in respect of whom authorisation is granted to produce evidence of the authorisation on request;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-14-3-e"><num>(e)</num><content><p>be inconsistent with, or more onerous than, the conditions of any other advertising licence (whether granted under this section or otherwise).</p></content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-17-3-c-ii"><num>(ii)</num><content><p>preventing or reducing congestion, litter or noise;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-17-3-d"><num>(d)</num><content><p>require a person in respect of whom authorisation is granted to produce evidence of the authorisation on request;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-17-3-e"><num>(e)</num><content><p>be inconsistent with, or more onerous than, the conditions of any other trading licence (whether granted under this section or otherwise).</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-17-4"><num>(4)</num><intro><p>In considering whether or not to grant an authorisation under this section, the Organising Committee may have regard to, among other things—</p></intro><level class="para1" eId="section-17
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-17-4-a"><num>(a)</num><content><p>any agreements entered into (whether by the Secretary of State or otherwise) for the purposes of the Games;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-17-4-b"><num>(b)</num><content><p>any existing trading licences (whether granted under this section or otherwise).</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-17-5"><num>(5)</num><content><p>An authorisation granted under this section must be in writing.</p></content></subsection>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-25-5-f"><num>(f)</num><content><p>any other person whom the Secretary of State or the authority directed under subsection (1) consider it appropriate to consult.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-25-6"><num>(6)</num><content><p>Each local traffic authority for a road affected by the plan must exercise their functions with a view to securing the implementation of the plan.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-25-7"><num>(7)</num><content><p>The requirement in subsection (4) may be satisfied by consultation undertaken before the coming into force of this section.</p></content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-26-2"><num>(2)</num><intro><p>The following do not apply in relation to an order made or notice issued by virtue of this section—</p></intro><level class="para1" eId="section-26-2-a"><num>(a)</num><content><p>section 1
