<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1"><num>1</num><heading>Payment of maternity allowance: Ministerial office</heading><subsection eId="section-1-1"><num>(1)</num><content>A mother or expectant mother designated as a Minister on Leave under this section

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-1"><num>(1)</num><content>A mother or expectant mother designated as a Minister on Leave under this section is to be paid an allowance in accordance with section 2.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-2"><num>(2)</num><intro>The Prime Minister may designate a mother or expectant mother as a Minister on Leave if—</intro><level class="para1" eId="section-1-2-a"><num>(a)</num><content>the mother or expectan

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-2-a"><num>(a)</num><content>the mother or expectant mother appears to the Prime Minister to satisfy either of the conditions in subsection (3), and</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-3"><num>(3)</num><intro>The conditions in this subsection are that—</intro><level class="para1" eId="section-1-3-a"><num>(a)</num><content>the expectant mother is within 12 weeks before the expected week of

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-3-a"><num>(a)</num><content>the expectant mother is within 12 weeks before the expected week of childbirth;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-3-b"><num>(b)</num><content>the mother has given birth to a child within the previous 4 weeks.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-4"><num>(4)</num><content>In subsection (3)(b) “<term refersTo="#term-child" eId="term-child">child</term>” includes a still-born child within the meaning of the Births and Deaths Registration Act 1953 (see secti

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-5"><num>(5)</num><intro>In this Act “<term refersTo="#term-ministerial-office" eId="term-ministerial-office">ministerial office</term>” means—</intro><level class="para1" eId="section-1-5-a"><num>(a)</num><co

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-5-a"><num>(a)</num><content>an office specified in any of Parts 1 to 4 of Schedule 1 to the Ministerial and other Salaries Act 1975;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-5-b"><num>(b)</num><content>the office of Lord Chancellor.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-6"><num>(6)</num><intro>A designation under this section ends—</intro><level class="para1" eId="section-1-6-a"><num>(a)</num><content>at the end of the period of 6 months beginning with the day on which the

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-6-a"><num>(a)</num><content>at the end of the period of 6 months beginning with the day on which the designation takes effect, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-6-b"><num>(b)</num><content>if earlier, when the mother or expectant mother designated ceases to hold the designated ministerial office.</content></level>

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2"><num>2</num><heading>Ministerial leave: amount and payment of allowance</heading><subsection eId="section-2-1"><num>(1)</num><intro>The allowance payable by virtue of section 1(1)—</intro><level class="para1" eI

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-1"><num>(1)</num><intro>The allowance payable by virtue of section 1(1)—</intro><level class="para1" eId="section-2-1-a"><num>(a)</num><content>is an amount equivalent to 6 times the monthly amount of the s

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-1-a"><num>(a)</num><content>is an amount equivalent to 6 times the monthly amount of the salary which was being paid to the mother or expectant mother in respect of the first ministerial office, and</

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-1-b"><num>(b)</num><content>is to be paid in 6 monthly instalments.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-2"><num>(2)</num><content>If no salary was being paid in respect of that office, no allowance is payable.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-3"><num>(3)</num><content>Where the mother or expectant mother ceases to hold the designated ministerial office at a time before the allowance has been paid in full, the amount of the allowance outstanding is to b

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-4"><num>(4)</num><intro>But if the mother or expectant mother ceases to hold the designated ministerial office because they are appointed to another ministerial office or die—</intro><level class="para1" eId="

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-4-a"><num>(a)</num><content>the allowance payable is reduced by a pro rata amount for each day of the 6-month period remaining, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-4-b"><num>(b)</num><content>any overpayment of the allowance may be recouped.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-5"><num>(5)</num><content>In subsection (4) the “<term refersTo="#term-6-month-period" eId="term-6-month-period">6-month period</term>” means the period of 6 months beginning with the day on which the designation

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-3"><num>(3)</num><content>No salary under the Ministerial and other Salaries Act 1975 may be paid in respect of the designated ministerial office.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-2"><num>(2)</num><intro>An “<term refersTo="#term-opposition-office" eId="term-opposition-office">opposition office</term>” means—</intro><level class="para1" eId="section-4-2-a"><num>(a)</num><content>in
