<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-a"><num>(a)</num><content>botulinum toxin, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-b"><num>(b)</num><content>a subcutaneous, submucous or intradermal injection of a filler for a cosmetic purpose,</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-2"><num>(2)</num><content>A “filler” is any substance used for dermal or mucous membrane filling (whether or not designed to be so used).</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-3"><num>(3)</num><intro>For the purposes of subsection (1)(b), an injection of a filler is, in particular, to be taken to be for a cosmetic purpose if—</intro><level class="para1" eId="section-1-3-a"><num>(a)<

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-3-a"><num>(a)</num><content>the filler is generally used for such a purpose, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-3-b"><num>(b)</num><content>the likely effect of the injection is to alter the appearance of the person injected.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-4"><num>(4)</num><intro>It is a defence for a person charged with an offence under subsection (1) to show that at the time of the alleged offence—</intro><level class="para1" eId="section-1-4-a"><num>(a)</num>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-4-a"><num>(a)</num><content>the defendant was a registered medical practitioner,</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-4-c"><num>(c)</num><intro>the defendant—</intro><level class="para2" eId="section-1-4-c-i"><num>(i)</num><content>had taken reasonable steps to establish A's age, and</content></level><level cl

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-1-4-c-i"><num>(i)</num><content>had taken reasonable steps to establish A's age, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-1-4-c-ii"><num>(ii)</num><content>reasonably believed that A was aged 18 or over.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-5"><num>(5)</num><intro>A person is taken to have shown a matter mentioned in subsection (4) if—</intro><level class="para1" eId="section-1-5-a"><num>(a)</num><content>sufficient evidence of the matter is a

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-5-a"><num>(a)</num><content>sufficient evidence of the matter is adduced to raise an issue with respect to it, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-5-b"><num>(b)</num><content>the contrary is not proved beyond reasonable doubt.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-6"><num>(6)</num><content>A person who commits an offence under subsection (1) is liable on summary conviction to a fine.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-7"><num>(7)</num><intro>In this section “<term refersTo="#term-regulated-health-professional" eId="term-regulated-health-professional">regulated health professional</term>” means—</intro><level class="para1"

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-7-a"><num>(a)</num><content>a registered nurse;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-7-b"><num>(b)</num><content>a registered dentist within the meaning of the Dentists Act 1984 (see section 53 of that Act);</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-7-c"><num>(c)</num><content>a registered pharmacist within the meaning of the Pharmacy Order 2010 (S.I. 2010/231) (see article 3 of that Order);</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-7-d"><num>(d)</num><content>a registered person within the meaning of the Pharmacy (Northern Ireland) Order 1976 (S.I. 1976/1213 (N.I. 22)) (see Article 2 of that Order).</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-2-1-b-ii"><num>(ii)</num><content>a subcutaneous, submucous or intradermal injection of a filler for a cosmetic purpose,</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-2"><num>(2)</num><intro>For the purposes of subsection (1), an injection of a filler is, in particular, to be taken to be for a cosmetic purpose if—</intro><level class="para1" eId="section-2-2-a"><num>(a)</nu

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-a"><num>(a)</num><content>the filler injected, or arranged to be injected, is generally used for such a purpose, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-b"><num>(b)</num><content>the likely effect of the injection is, or would be, to alter the appearance of the person injected.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-3"><num>(3)</num><content>A person who commits an offence under subsection (1) is liable on summary conviction to a fine.</content></subsection>

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3"><num>3</num><heading>Offences by bodies corporate</heading><subsection eId="section-3-1"><num>(1)</num><content>This section applies where an offence under section 2 is committed by a body corporate.</content></

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-2"><num>(2)</num><intro>If the offence is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of—</intro><level class="para1" eId="section-3-2-a"><

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-a"><num>(a)</num><content>any director, manager or secretary of the body corporate, or</content></level>
