Rating (Coronavirus) and Directors Disqualification (Dissolved Companies) Act 2021

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1"><num>1</num><heading>Determinations in respect of certain non-domestic rating lists</heading><subsection eId="section-1-1"><num>(1)</num><content><p>This section applies to the making of a relevant determination in relation to a rating list.</p></content></subsection><subsection eId="section-1-2"><num>(2)</num><intro><p>The following are relevant determinations for the purposes of this section—</p></intro><level class="para1" eId="section-1-2-a"><num>(a)</num><content><p>a determination, for the purposes of compiling or maintaining a rating list (whether or not it is still in force), as to whether a hereditament ought or ought not to be shown in the list;</p></content></level><level class="para1" eId="section-1-2-b"><num>(b)</num><content><p>a determination, for the purposes of maintaining a rating list compiled on 1 April 2017 (whether or not it is still in force), as to the rateable value of a hereditament.</p></content></level></subsection><subsection eId="section-1-3"><num>(3)</num><intro><p>A determination is not a relevant determination for the purposes of this section to the extent that it concerns whether a hereditament or some part of a hereditament—</p></intro><level class="para1" eId="section-1-3-a"><num>(a)</num><content><p>is or is not domestic property, or</p></content></level><level class="para1" eId="section-1-3-b"><num>(b)</num><content><p>is or is not exempt from non-domestic rating under Schedule 5 to the LGFA 1988.</p></content></level></subsection><subsection eId="section-1-4"><num>(4)</num><content><p>In making a relevant determination, no account is to be taken of any matter (whether arising before or after the passing of this Act) that is directly or indirectly attributable to coronavirus.</p></content></subsection><subsection eId="section-1-5"><num>(5)</num><intro><p>But subsection <ref href="#section-1-4">(4)</ref> does not apply to any of the following matters (which, accordingly, may be taken into account in making a relevant determination, whether or not the matter is attributable to coronavirus)—</p></intro><level class="para1" eId="section-1-5-a"><num>(a)</num><content><p>the physical state of the hereditament in respect of which the determination is made, including whether that state affects the mode or category of occupation of the hereditament;</p></content></level><level class="para1" eId="section-1-5-b"><num>(b)</num><content><p>the quantity of minerals or other substances in or extracted from the hereditament in respect of which the determination is made;</p></content></level><level class="para1" eId="section-1-5-c"><num>(c)</num><content><p>the quantity of refuse or waste material which is brought onto and permanently deposited on the hereditament in respect of which the determination is made.</p></content></level></subsection><subsection eId="section-1-6"><num>(6)</num><intro><p>For the purposes of this section, matters attributable to coronavirus include (but are not limited to) anything done by any person—</p></intro><level class="para1" eId="section-1-6-a"><num>(a)</num><content><p>with a view to compliance with any legislation which concerns the incidence or spread of coronavirus,</p></content></level><level class="para1" eId="section-1-6-b"><num>(b)</num><content><p>with a view to compliance with any other legislation for reasons relating to the incidence or spread of coronavirus, or</p></content></level><level class="para1" eId="section-1-6-c"><num>(c)</num><content><p>in response to, or otherwise in consequence of, any advice or guidance given by a public authority relating to the incidence or spread of coronavirus.</p></content></level></subsection><subsection eId="section-1-7"><num>(7)</num><content><p>This section applies to a determination made by reference to a day, or a matter as it is assumed to be on a day, which falls before, as well as on or after, the day on which this Act is passed.</p></content></subsection><subsection eId="section-1-8"><num>(8)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-coronavirus" eId="term-coronavirus">coronavirus</term>” means severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2);</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-domestic-property" eId="term-domestic-property">domestic property</term>” has the meaning given by section 66 of the LGFA 1988;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-hereditament" eId="term-hereditament">hereditament</term>” has the meaning given by section 64 of the LGFA 1988, and the reference in subsection <ref href="#section-1-2-a">(2)(a)</ref> to a determination as to whether a hereditament ought or ought not to be shown in a list includes a determination as to whether something is or is not a hereditament;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-the-lgfa-1988" eId="term-the-lgfa-1988">the LGFA 1988</term>” means the Local Government Finance Act 1988;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-rating-list" eId="term-rating-list">rating list</term>” means a local non-domestic rating list or central non-domestic rating list under Part 3 of the LGFA 1988.</p></content></hcontainer></subsection><subsection eId="section-1-9"><num>(9)</num><content><p>The Valuation for Rating (Coronavirus) (England) Regulations 2021 (<ref eId="c00001" href="http://www.legislation.gov.uk/id/uksi/2021/398">S.I. 2021/398</ref>) (which are superseded by the provision made by this section) are revoked.</p></content></subsection></section>

eId="section-2"><num>2</num><heading>Unfit directors of dissolved companies: Great Britain</heading><subsection eId="section-2-1"><num>(1)</num><content><p>The Company Directors Disqualification Act 1986 is amended as follows.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><intro><p>In section 6 (duty of court to disqualify unfit directors of insolvent companies)—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>in the heading, omit “of insolvent companies”;</p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><intro><p>in subsection (1)—</p></intro><level class="para2" eId="section-2-2-b-i"><num>(i)</num><content><p>omit “, it is satisfied”;</p></content></level><level class="para2" eId="section-2-2-b-ii"><num>(ii)</num><content><p><mod>for paragraphs (a) and (b) substitute—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><level class="para1"><num>(a)</num><intro><p>the court is satisfied—</p></intro><level class="para2"><num>(i)</num><content><p>that the person is or has been a director of a company which has at any time become insolvent (whether while the person was a director or subsequently), or</p></content></level><level class="para2" eId="d25e309"><num>(ii)</num><content><p>that the person has been a director of a company which has at any time been dissolved without becoming insolvent (whether while the person was a director or subsequently), and</p></content></level></level><level class="para1"><num>(b)</num><content><p>the court is satisfied that the person’s conduct as a director of that company (either taken alone or taken together with the person’s conduct as a director of one or more other companies or overseas companies) makes the person unfit to be concerned in the management of a company.</p></content></level></quotedStructure><inline name="appendText">;</inline></mod></p></content></level></level><level class="para1" (Northern Ireland) Order 2002 (<ref eId="c00002" href="http://www.legislation.gov.uk/id/nisi/2002/3150">S.I. 2002/3150 (N.I. 4)</ref>) is amended as follows.</p></content></subsection><subsection eId="section-3-2"><num>(2)</num><intro><p>In Article 9 (duty of High Court to disqualify unfit directors of insolvent companies)—</p></intro><level class="para1"
