<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-1"><num>1</num><heading>Extension of period for making Ministerial appointments</heading><subsection eId="section-1-1"><num>(1)</num><content><p>The Northern Ireland (Executive Formation etc) Act 2022 is amended as follows.</p></content></subsection><subsection eId="section-1-2"><num>(2)</num><intro><p>In section 1—</p></intro><level class="para1" eId="section-1-2-a"><num>(a)</num><content><p>in the title, omit “by six weeks”;</p></content></level><level class="para1" eId="section-1-2-b"><num>(b)</num><content><p><mod>for “<term refersTo="#term-19-january-2023" eId="term-19-january-2023">19 January 2023</term>” (as inserted by the Northern Ireland (Extension of Period for Making Ministerial Appointments) Regulations 2022 (<ref eId="c00001" href="http://www.legislation.gov.uk/id/uksi/2022/1296">S.I. 2022/1296</ref>)) substitute <quotedText>“18 January 2024”</quotedText>.</mod></p></content></level></subsection><subsection eId="section-1-3"><num>(3)</num><content><p><mod>After section 1 insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section><num>1A</num><heading>Power to propose date for a poll</heading><subsection><num>(1)</num><intro><p>The Northern Ireland Act 1998 has effect as if, during the current post-election period, section 32 (extraordinary elections) were amended as follows—</p></intro><level class="para1"><num>(a)</num><content><p><mod>after subsection (3A), insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(3AA)</num><content><p>At any time before the end of the period mentioned in section 16A(3), the Secretary of State may, if the offices mentioned there have not yet been filled, propose a date for the poll for the election of the next Assembly.</p></content></subsection></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1"><num>(b)</num><content><p>in subsection (3B), omit “16A(3) or”;</p></content></level><level class="para1"><num>(c)</num><content><p><mod>in subsection (3D)(b), after “(3)” insert <quotedText>“, (3AA)”</quotedText>;</mod></p></content></level><level class="para1"><num>(d)</num><content><p><mod>in subsection (3E)(b), after “subsection” insert <quotedText>“(3AA) or”</quotedText>;</mod></p></content></level><level class="para1"><num>(e)</num><content><p><mod>in subsection (3F), in the words before paragraph (a), after “subsection” insert <quotedText>“(3AA) or”</quotedText>;</mod></p></content></level><level class="para1"><num>(f)</num><intro><p>in subsection (3G)—</p></intro><level class="para2"><num>(i)</num><content><p><mod>in the words before paragraph (a), after “(3)” insert <quotedText>“, (3AA)”</quotedText>;</mod></p></content></level><level class="para2"><num>(ii)</num><content><p><mod>after paragraph (a), insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><level class="para1"><num>(aa)</num><content><p>in the case of a date proposed under subsection (3AA), withdraw the proposal before the end of the period referred to in section 16A(3), or</p></content></level></quotedStructure><inline name="appendText">;</inline></mod></p></content></level></level><level class="para1"><num>(g)</num><content><p><mod>in subsection (4), in the words before paragraph (a), after “(3)” insert <quotedText>“, (3AA)”</quotedText>.</mod></p></content></level></subsection><subsection><num>(2)</num><content><p>In this section, “<term refersTo="#term-the-current-post-election-period">the current post-election period</term>” has the meaning given in section 1.</p></content></subsection></section></quotedStructure></mod></p></content></subsection><subsection eId="section-1-4"><num>(4)</num><content><p>Omit section 2.</p></content></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2"><num>2</num><heading>Organ and tissue donation in Northern Ireland: procedure for regulations defining permitted material</heading><subsection eId="section-2-1"><num>(1)</num><content><p>Section 52(4B) of the Human Tissue Act 2004 (draft affirmative procedure for regulations defining permitted material for the purposes of deemed consent to transplantation of human tissue in Northern Ireland) does not apply during the relevant period.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><content><p>Regulations made under section 3(9A) of that Act during the relevant period are subject to negative resolution within the meaning given by section 41(6) of the Interpretation Act (Northern Ireland) <ref eId="c00002" href="http://www.legislation.gov.uk/id/apni/1954/33">1954 (c. 33 (N.I.))</ref>.</p></content></subsection><subsection eId="section-2-3"><num>(3)</num><intro><p>In this section, the “<term refersTo="#term-relevant-period" eId="term-relevant-period">relevant period</term>” means the period—</p></intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content><p>beginning when this Act is passed, and</p></content></level><level class="para1" eId="section-2-3-b"><num>(b)</num><content><p>ending with the next day on which the Presiding Officer and deputies are in post having been elected under section 39(1) of the Northern Ireland Act 1998.</p></content></level></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3"><num>3</num><heading>Extent, commencement and short title</heading><subsection eId="section-3-1"><num>(1)</num><content><p>Section 1 and this section extend to England and Wales, Scotland and Northern Ireland.</p></content></subsection><subsection eId="section-3-2"><num>(2)</num><content><p>Section 2 extends to Northern Ireland only.</p></content></subsection><subsection eId="section-3-3"><num>(3)</num><content><p>This Act comes into force on the day on which it is passed.</p></content></subsection><subsection eId="section-3-4"><num>(4)</num><content><p>This Act may be cited as the Northern Ireland (Executive Formation and Organ and Tissue Donation) Act 2023.</p></content></subsection></section>
