<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-1"><num>(1)</num><content>The Secretary of State may by regulations make provision to restrict the sale of specified equipment where a specified requirement is not met.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-2"><num>(2)</num><intro>Regulations under subsection <ref href="#section-1-1">(1)</ref> may specify equipment of a kind falling within the following descriptions—</intro><level class="para1" eId="section-1-2-a

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-2-a"><num>(a)</num><intro>mechanically propelled vehicles that—</intro><level class="para2" eId="section-1-2-a-i"><num>(i)</num><content>are designed or adapted primarily for use other than on a ro

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-1-2-a-i"><num>(i)</num><content>are designed or adapted primarily for use other than on a road,</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-1-2-a-ii"><num>(ii)</num><content>have an engine capacity of at least 250 cubic centimeters or two kilowatts, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-1-2-a-iii"><num>(iii)</num><content>travel on more than two wheels or on tracks;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-2-b"><num>(b)</num><content>other equipment designed or adapted primarily for use in agricultural or commercial activities.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-3"><num>(3)</num><intro>Regulations under subsection <ref href="#section-1-1">(1)</ref> may specify a requirement of a kind falling within the following descriptions—</intro><level class="para1" eId="section-1

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-3-a"><num>(a)</num><content>a requirement that the equipment is fitted with a device designed, or adapted, to be fitted for the purposes of preventing the equipment from being driven or otherwise put in m

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-3-b"><num>(b)</num><intro>a requirement that the equipment is marked with—</intro><level class="para2" eId="section-1-3-b-i"><num>(i)</num><content>a unique identifier, and</content></level><le

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-1-3-b-i"><num>(i)</num><content>a unique identifier, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-1-3-b-ii"><num>(ii)</num><content>a visible indication that it is marked with a unique identifier.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-4"><num>(4)</num><intro>Regulations under subsection <ref href="#section-1-1">(1)</ref> may not restrict the sale of equipment if—</intro><level class="para1" eId="section-1-4-a"><num>(a)</num><content>the

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-4-a"><num>(a)</num><content>the sale is solely for the purposes of onward sale by the buyer, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-4-b"><num>(b)</num><content>the equipment has previously been used for the purpose for which it was primarily designed or adapted.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-5"><num>(5)</num><intro>In this Act—</intro><level class="para1" eId="section-1-5-a"><num>(a)</num><content>“<term refersTo="#term-equipment" eId="term-equipment">equipment</term>” includes a vehicle;</

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-5-a"><num>(a)</num><content>“<term refersTo="#term-equipment" eId="term-equipment">equipment</term>” includes a vehicle;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-5-b"><num>(b)</num><intro>equipment is not “used for the purpose for which it was primarily designed or adapted” solely by virtue of being used—</intro><level class="para2" eId="section-1-5-b-i"><num>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-1-5-b-i"><num>(i)</num><content>in order to demonstrate its features to a potential buyer of the equipment or other equipment of the same or a similar kind, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-1-5-b-ii"><num>(ii)</num><content>in preparation for such a demonstration.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-2"><num>(2)</num><intro>The information may include, for example—</intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content>a name, address or telephone number, or other contact details, of the

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-a"><num>(a)</num><content>a name, address or telephone number, or other contact details, of the buyer,</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-b"><num>(b)</num><content>the make, model or colour of the equipment,</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-c"><num>(c)</num><intro>if the equipment is marked with a unique identifier of a kind specified in regulations under section <ref href="#section-1">1</ref><ref href="#section-1-1">(1)</ref>—</intro>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-2-2-c-ii"><num>(ii)</num><content>the method or location of the marking, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-d"><num>(d)</num><content>the date on which the contract of sale was entered into.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-3"><num>(3)</num><intro>Regulations under subsection <ref href="#section-2-1">(1)</ref> may make provision about—</intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content>when the information

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-a"><num>(a)</num><content>when the information must be recorded;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-b"><num>(b)</num><content>for how long the information must be kept;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-c"><num>(c)</num><content>the form in which the information must be kept (including, for example, in an online system of a particular kind).</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-4"><num>(4)</num><intro>Regulations under subsection <ref href="#section-2-1">(1)</ref> may not require a person selling equipment to record information if—</intro><level class="para1" eId="section-2-4-a"><num

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-1"><num>(1)</num><intro>A person commits an offence if the person—</intro><level class="para1" eId="section-3-1-a"><num>(a)</num><content>sells equipment in breach of regulations under section <ref href="#s

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-a"><num>(a)</num><content>sells equipment in breach of regulations under section <ref href="#section-1">1</ref>, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-b"><num>(b)</num><content>fails to record or keep information in accordance with regulations under section <ref href="#section-2">2</ref>.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-2"><num>(2)</num><content>A person that commits an offence under subsection <ref href="#section-3-1">(1)</ref> is liable on summary conviction to a fine.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-3"><num>(3)</num><content>An enforcement authority may enforce regulations under section <ref href="#section-1">1</ref> or <ref href="#section-2">2</ref> in their area.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-4"><num>(4)</num><content>For the powers available to an enforcement authority for the purposes of enforcing regulations under section <ref href="#section-1">1</ref> or <ref href="#section-2">2</ref>, see Schedule

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-5"><num>(5)</num><intro>“<term refersTo="#term-enforcement-authority" eId="term-enforcement-authority">Enforcement authority</term>” means—</intro><level class="para1" eId="section-3-5-a"><num>(a)</num><conten

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-2"><num>(2)</num><content>Regulations under this Act are to be made by statutory instrument.</content></subsection>
