worker’s employer for a change in terms and conditions of employment if—</p></intro><level class="para1"><num>(a)</num><content><p>there is a lack of predictability, in relation to the work that the worker does for the employer, as regards any part of the worker’s work pattern,</p></content></level><level class="para1" eId="d25e202"><num>(b)</num><content><p>the change relates to the worker’s work pattern, and</p></content></level><level class="para1" eId="d25e208"><num>(c)</num><content><p>the worker’s purpose in applying for the change is to get a more predictable work pattern.</p></content></level><wrapUp><p>(But see section <ref href="#d25e315">80IB</ref> concerning restrictions on the making of an application.)</p></wrapUp></subsection><subsection eId="d25e220"><num>(2)</num><intro><p>The work pattern of a worker is made up of—</p></intro><level class="para1"><num>(a)</num><content><p>the number of hours that the worker works,</p></content></level><level class="para1"><num>(b)</num><content><p>the days of the week on which, and the times on those days when, the worker works,</p></content></level><level class="para1"><num>(c)</num><content><p>the period for which the worker is contracted to work, and</p></content></level><level class="para1"><num>(d)</num><content><p>such other aspects of the worker’s terms and conditions of employment as the Secretary of State may specify by regulations.</p></content></level></subsection><subsection><num>(3)</num><intro><p>If a worker works under a worker’s contract with a fixed term of 12 months or less—</p></intro><level class="para1"><num>(a)</num><content><p>there is to be regarded as being a lack of predictability as regards the period for which the worker is contracted to work, and</p></content></level><level class="para1"><num>(b)</num><content><p>the worker’s purpose in applying for a change to the duration of the contract is to be regarded as being to get a more predictable work pattern if the change would result in a longer fixed term or the removal of the provision in the worker’s contract restricting its duration.</p></content></level></subsection><subsection><num>(4)</num><intro><p>An application under this section must—</p></intro><level class="para1"><num>(a)</num><content><p>state that it is such an application, and</p></content></level><level class="para1"><num>(b)</num><content><p>specify the change applied for and the date on which it is proposed the change should become effective.</p></content></level></subsection><subsection><num>(5)</num><intro><p>The Secretary of State may by regulations make provision about—</p></intro><level class="para1"><num>(a)</num><content><p>the form of applications under this section, and</p></content></level><level class="para1"><num>(b)</num><content><p>when such an application is to be taken to be made.</p></content></level></subsection><subsection><num>(6)</num><content><p>Regulations under this section may make different provision for different cases.</p></content></subsection></section><section eId="d25e315"><num>80IB</num><heading>Restrictions on the making of an application under section <ref href="#d25e186">80IA</ref></heading><subsection><num>(1)</num><content><p>An agency worker may not make an application under section <ref href="#d25e186">80IA</ref> (see instead Chapter 2 of this Part).</p></content></subsection><subsection><num>(2)</num><content><p>“Agency worker” has the same meaning in this section as in the Agency Workers Regulations 2010 (<ref eId="c00001" href="http://www.legislation.gov.uk/id/uksi/2010/93">S.I. 2010/93</ref>) (see regulation 3 of the Regulations).</p></content></subsection><subsection><num>(3)</num><content><p>A worker may only make an application under section <ref href="#d25e186">80IA</ref> to the worker’s employer if the worker was employed by the same employer (whether or not under the same worker’s contract) at some point during the month immediately preceding such period, ending with the making of the application, as is specified in regulations made by the Secretary of State.</p></content></subsection><subsection><num>(4)</num><content><p>Section <ref href="#d25e186">80IA</ref> is subject to section <ref href="#d25e2147">80IM</ref> (which restricts the right to make multiple applications under this Part).</p></content></subsection><subsection><num>(5)</num><content><p>Regulations under this section may make different provision for different cases.</p></content></subsection><subsection><num>(6)</num><content><p>“Work pattern” has the same meaning in this section as in section <ref href="#d25e186">80IA</ref> (see section <ref href="#d25e186">80IA</ref><ref href="#d25e220">(2)</ref>).</p></content></subsection></section><section eId="d25e383"><num>80IC</num><heading>Employer’s duties in relation to an application under section <ref href="#d25e186">80IA</ref></heading><subsection eId="d25e387"><num>(1)</num><intro><p>An employer to whom an application under section <ref href="#d25e186">80IA</ref> is made—</p></intro><level class="para1"><num>(a)</num><content><p>must deal with the application in a reasonable manner,</p></content></level><level class="para1" eId="d25e402"><num>(b)</num><content><p>must notify the worker of the decision on the application within the decision period, and</p></content></level><level class="para1" eId="d25e408"><num>(c)</num><intro><p>may only reject the application because the employer considers that one or more of the following grounds applies—</p></intro><level class="para2"><num>(i)</num><content><p>the burden of additional costs,</p></content></level><level class="para2"><num>(ii)</num><content><p>detrimental effect on ability to meet customer demand,</p></content></level><level class="para2"><num>(iii)</num><content><p>detrimental impact on the recruitment of staff,</p></content></level><level class="para2"><num>(iv)</num><content><p>detrimental impact on other aspects of the employer’s business,</p></content></level><level class="para2"><num>(v)</num><content><p>insufficiency of work during the periods the worker proposes to work,</p></content></level><level class="para2"><num>(vi)</num><content><p>planned structural changes, and</p></content></level><level class="para2" eId="d25e450"><num>(vii)</num><content><p>such other grounds as the Secretary of State may specify by regulations.</p></content></level></level></subsection><subsection eId="d25e456"><num>(2)</num><content><p>Subsection <ref href="#d25e387">(1)</ref> applies even if the worker ceases to be employed by the employer during the decision period.</p></content></subsection><subsection eId="d25e465"><num>(3)</num><intro><p>In such a case—</p></intro><level class="para1" eId="d25e471"><num>(a)</num><intro><p>the employer may also reject the application on the ground that—</p></intro><level class="para2"><num>(i)</num><content><p>the worker terminated the worker’s contract (with or without notice) other than in circumstances in which the worker was entitled to terminate it without notice by reason of the employer’s conduct;</p></content></level><level class="para2" eId="d25e483"><num>(ii)</num><content><p>the employer terminated the worker’s contract (with or without notice) and the employer’s reason for doing so (or, if more than one, the employer’s principal reason for doing so) is a qualifying reason and in the circumstances (including the size and administrative resources of the employer’s undertaking) the employer acted reasonably in treating the reason (or the principal reason) as a sufficient reason for terminating the contract, and</p></content></level></level><level class="para1" eId="d25e489"><num>(b)</num><intro><p>if the employer grants the application, the employer must, before the end of the offer period, offer the worker a new worker’s contract with terms and conditions that—</p></intro><level class="para2"><num>(i)</num><content><p>taken as a whole, are not less favourable than the terms and conditions of the worker’s contract at the time the application was made, and</p></content></level><level class="para2"><num>(ii)</num><content><p>reflect the change relating to the worker’s work pattern that was applied for.</p></content></level></level></subsection><subsection><num>(4)</num><intro><p>In subsection <ref href="#d25e483">(3)(a)(ii)</ref> “<term refersTo="#term-qualifying-reason">qualifying reason</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>a reason that fulfils the requirement in section 98(1)(b), or</p></content></level><level class="para1"><num>(b)</num><content><p>in relation to a worker who was not an employee immediately before ceasing to be employed, a reason that would fulfil the requirement in section 98(1)(b) if references in that provision and in section 98(2) and (3) to an employee were references to a worker.</p></content></level></subsection><subsection eId="d25e531"><num>(5)</num><content><p>Regulations under subsection <ref href="#d25e450">(1)(c)(vii)</ref> may provide for a modified version of a specified ground to apply in cases where the worker ceases to be employed by an employer.</p></content></subsection><subsection><num>(6)</num><intro><p>If an employer allows a worker to appeal a decision to reject an application, the reference in subsection <ref href="#d25e402">(1)(b)</ref> to the decision on the application is a reference to—</p></intro><level class="para1"><num>(a)</num><content><p>the decision on the appeal, or</p></content></level><level class="para1"><num>(b)</num><content><p>if more than one appeal is allowed, the decision on the final appeal.</p></content></level></subsection><subsection eId="d25e561"><num>(7)</num><content><p>For the purposes of subsections <ref href="#d25e402">(1)(b)</ref>, <ref href="#d25e456">(2)</ref> and <ref href="#d25e531">(5)</ref> the decision period applicable to a worker’s application under section <ref href="#d25e186">80IA</ref> is the period of one month beginning with the date on which the application is made.</p></content></subsection><subsection eId="d25e579"><num>(8)</num><content><p>For the purposes of subsection <ref href="#d25e489">(3)(b)</ref> the offer period applicable to a worker’s application under section <ref href="#d25e186">80IA</ref> is the period of two weeks beginning with date on which the employer grants the application.</p></content></subsection><subsection eId="d25e591"><num>(9)</num><intro><p>An application under section <ref href="#d25e186">80IA</ref> is to be treated as having been withdrawn by the worker if—</p></intro><level class="para1" eId="d25e600"><num>(a)</num><content><p>the worker without good reason has failed to attend both the first meeting arranged by the employer to discuss the application and the next meeting arranged for that purpose, or</p></content></level><level class="para1" eId="d25e606"><num>(b)</num><content><p>where the employer allows the worker to appeal a decision to reject an application or to make a further appeal, the worker without good reason has failed to attend both the first meeting arranged by the employer to discuss the appeal and the next meeting arranged for that purpose,</p></content></level><wrapUp><p>and the employer has notified the worker that the employer has decided to treat that conduct of the worker as a withdrawal of the application.</p></wrapUp></subsection><subsection><num>(10)</num><content><p>“Work pattern” has the same meaning in this section as in section <ref href="#d25e186">80IA</ref> (see section <ref href="#d25e186">80IA</ref><ref href="#d25e220">(2)</ref>).</p></content></subsection></section><section eId="d25e631"><num>80ID</num><heading>Complaints to employment tribunals</heading><subsection><num>(1)</num><intro><p>A worker who makes an application under section <ref href="#d25e186">80IA</ref> may present a complaint to an employment tribunal—</p></intro><level class="para1" eId="d25e644"><num>(a)</num><content><p>that the worker’s employer has failed in relation to the application to comply with section <ref href="#d25e383">80IC</ref><ref href="#d25e387">(1)</ref> (as read, where applicable, with section <ref href="#d25e383">80IC</ref><ref href="#d25e471">(3)(a)</ref>),</p></content></level><level class="para1" eId="d25e660"><num>(b)</num><content><p>that the worker’s employer has failed, having granted the application, to comply with section <ref href="#d25e383">80IC</ref><ref href="#d25e489">(3)(b)</ref>,</p></content></level><level class="para1" eId="d25e671"><num>(c)</num><content><p>that a decision by the employer to reject the application was based on incorrect facts, or</p></content></level><level class="para1" eId="d25e677"><num>(d)</num><content><p>that the employer’s notification under section <ref href="#d25e383">80IC</ref><ref href="#d25e591">(9)</ref> was given in circumstances that did not satisfy one of the requirements in section <ref href="#d25e383">80IC</ref><ref href="#d25e600">(9)(a)</ref> and <ref href="#d25e606">(b)</ref>.</p></content></level></subsection><subsection><num>(2)</num><content><p>No complaint under subsection <ref href="#d25e644">(1)(a)</ref>, <ref href="#d25e660">(b)</ref> or <ref href="#d25e671">(c)</ref> may be made in respect of an application which has been disposed of by agreement or withdrawn.</p></content></subsection><subsection eId="d25e711"><num>(3)</num><intro><p>In the case of an application which has not been disposed of by agreement or withdrawn—</p></intro><level class="para1" eId="d25e717"><num>(a)</num><intro><p>no complaint under subsection <ref href="#d25e644">(1)(a)</ref> or <ref href="#d25e671">(c)</ref> may be made until—</p></intro><level class="para2"><num>(i)</num><content><p>the employer notifies the worker of the employer’s decision on the application, or</p></content></level><level class="para2"><num>(ii)</num><content><p>if the decision period applicable to the application (see section <ref href="#d25e383">80IC</ref><ref href="#d25e561">(7)</ref>) comes to an end without the employer notifying the worker of the employer’s decision on the application, the end of the decision period;</p></content></level></level><level class="para1"><num>(b)</num><intro><p>no complaint under subsection <ref href="#d25e660">(1)(b)</ref> may be made until—</p></intro><level class="para2"><num>(i)</num><content><p>the employer offers the worker a new worker’s contract, or</p></content></level><level class="para2"><num>(ii)</num><content><p>if the offer period applicable to the application (see section <ref href="#d25e383">80IC</ref><ref href="#d25e579">(8)</ref>) comes to an end without the employer offering the worker a new worker’s contract, the end of the offer period.</p></content></level></level></subsection><subsection><num>(4)</num><content><p>If an employer allows a worker to appeal a decision to reject an application, subsection <ref href="#d25e717">(3)(a)</ref> applies as if the references to the employer notifying the worker of the employer’s decision on the application were references to the employer notifying the worker of the employer’s decision on the appeal or, if more than one appeal is allowed, the decision on the final appeal.</p></content></subsection><subsection><num>(5)</num><content><p>A complaint under subsection <ref href="#d25e677">(1)(d)</ref> may be made as soon as the notification under section <ref href="#d25e383">80IC</ref><ref href="#d25e591">(9)</ref> complained of is given to the worker.</p></content></subsection><subsection><num>(6)</num><intro><p>An employment tribunal may not consider a complaint under this section unless it is presented—</p></intro><level class="para1" eId="d25e801"><num>(a)</num><content><p>before the end of the period of three months beginning with the relevant date, or</p></content></level><level class="para1"><num>(b)</num><content><p>within such further period as the tribunal considers reasonable in a case where it is satisfied that it was not reasonably practicable for the complaint to be presented before the end of that period of three months.</p></content></level></subsection><subsection><num>(7)</num><content><p>In subsection <ref href="#d25e801">(6)(a)</ref>, the reference to the relevant date is a reference to the first date on which the worker may make a complaint under subsection <ref href="#d25e644">(1)(a)</ref>, <ref href="#d25e660">(b)</ref>, <ref href="#d25e671">(c)</ref> or <ref href="#d25e677">(d)</ref> (as the case may be).</p></content></subsection><subsection><num>(8)</num><content><p>Section 207A(3) and section 207B (extension of time limits in certain circumstances) apply for the purposes of subsection <ref href="#d25e801">(6)(a)</ref>.</p></content></subsection></section><section eId="d25e846"><num>80IE</num><heading>Remedies</heading><subsection><num>(1)</num><intro><p>Where an employment tribunal finds a complaint under section <ref href="#d25e631">80ID</ref> well-founded it must make a declaration to that effect and may—</p></intro><level class="para1" eId="d25e859"><num>(a)</num><content><p>make an order for reconsideration of the application, and</p></content></level><level class="para1" eId="d25e865"><num>(b)</num><content><p>make an award of compensation to be paid by the employer to the worker.</p></content></level></subsection><subsection><num>(2)</num><content><p>Where an employment tribunal makes an order under subsection <ref href="#d25e859">(1)(a)</ref>, section <ref href="#d25e383">80IC</ref> is to apply as if the application had been made on the date of the order.</p></content></subsection><subsection eId="d25e883"><num>(3)</num><content><p>The amount of compensation under subsection <ref href="#d25e865">(1)(b)</ref> is to be such amount, not exceeding the permitted maximum, as the tribunal considers just and equitable in all the circumstances.</p></content></subsection><subsection><num>(4)</num><content><p>For the purposes of subsection <ref href="#d25e883">(3)</ref>, the permitted maximum is such number of weeks’ pay as the Secretary of State may specify by regulations.</p></content></subsection><subsection><num>(5)</num><intro><p>In calculating a week’s pay for the purposes of determining the permitted maximum for an award of compensation to a worker who is not an employee, Chapter 2 of Part 14 is to apply as if—</p></intro><level class="para1"><num>(a)</num><content><p>references in that Chapter and in section 234 (normal working hours) to an employee were references to a worker;</p></content></level><level class="para1"><num>(b)</num><content><p>references in that Chapter and in section 234 to a contract of employment were references to a worker’s contract;</p></content></level><level class="para1"><num>(c)</num><intro><p>“week” meant—</p></intro><level class="para2"><num>(i)</num><content><p>in relation to a worker whose remuneration is calculated weekly by a week ending with a day other than a Saturday, a week ending with that other day, and</p></content></level><level class="para2"><num>(ii)</num><content><p>in relation to any other worker, a week ending with Saturday.</p></content></level></level></subsection></section></chapter></quotedStructure></mod></p></content></subsection>

period</heading><subsection><num>(1)</num><content><p>This section limits the number of statutory applications to vary terms and conditions that may be made by one person (W) to another person (E) during any period of 12 months.</p></content></subsection><subsection eId="d25e2157"><num>(2)</num><intro><p>During any period of 12 months—</p></intro><level class="para1" eId="d25e2163"><num>(a)</num><content><p>a maximum of two statutory applications to vary terms and conditions may be made by W to E for the purpose of improving predictability, and</p></content></level><level class="para1" eId="d25e2169"><num>(b)</num><content><p>a maximum of two applications under section 80F may made by W to E otherwise than for the purpose of improving predictability.</p></content></level></subsection><subsection><num>(3)</num><intro><p>For the purposes of this section and section <ref href="#d25e2284">80IN</ref>, each of the following is a statutory application to vary terms and conditions made by W to E—</p></intro><level class="para1"><num>(a)</num><content><p>an application made under section 80F by W (as the qualifying employee) to E (as the employer);</p></content></level><level class="para1"><num>(b)</num><content><p>an application made under section <ref href="#d25e186">80IA</ref> by W (as the worker) to E (as the worker’s employer);</p></content></level><level class="para1"><num>(c)</num><content><p>an application made under section <ref href="#d25e965">80IF</ref><ref href="#d25e969">(1)</ref> by W (as the agency worker) to E (as the temporary work agency);</p></content></level><level class="para1"><num>(d)</num><content><p>an application made under section <ref href="#d25e965">80IF</ref><ref href="#d25e999">(2)</ref> by W (as the agency worker) to E (as the hirer).</p></content></level></subsection><subsection><num>(4)</num><intro><p>For the purposes of this section a statutory application to vary terms and conditions is made for the purpose of improving predictability if it is—</p></intro><level class="para1"><num>(a)</num><intro><p>an application made under section 80F where—</p></intro><level class="para2"><num>(i)</num><content><p>the change applied for related to W’s work pattern, and</p></content></level><level class="para2"><num>(ii)</num><content><p>the change had, or would have had (if it had been made), the effect of making W’s work pattern more predictable, or</p></content></level></level><level class="para1"><num>(b)</num><content><p>an application made under section <ref href="#d25e186">80IA</ref>, <ref href="#d25e965">80IF</ref><ref href="#d25e969">(1)</ref> or <ref href="#d25e965">80IF</ref><ref href="#d25e999">(2)</ref>.</p></content></level></subsection><subsection><num>(5)</num><content><p>In this section “<term refersTo="#term-work-pattern">work pattern</term>” has the same meaning as in to vary terms and conditions to a particular person (E) if another statutory application to vary terms and conditions to E is
