ЕВРОПЕЙСКАЯ КОНВЕНЦИЯ

об общей эквивалентности периодов университетского обучения

Государства - члены Совета Европы и другие государства - участники Европейской культурной конвенции, подписавшие настоящую Конвенцию, учитывая, что целью Совета Европы является достижение большего единства между его членами, принимая во внимание открытую для подписания 15 декабря 1956 года в Париже Европейскую конвенцию об эквивалентности периодов университетского обучения, которая применяется к области современных языков, будучи убеждены, что в дело углубления взаимопонимания в Европе был бы внесен важный вклад, если больше студентов, изучающих любые дисциплины, могли бы в течение определенного времени обучаться за границей и если сданные такими студентами экзамены и пройденные ими в течение этих периодов обучения курсы признавались бы учебными заведениями первоначального обучения, исполненные решимости установить с этой целью принцип общей эквивалентности периодов университетского обучения, договорились о нижеследующем:

Статья 1

Для целей настоящей Конвенции термин "высшие учебные заведения" означает: а) университеты; b) другие высшие учебные заведения, признанные для целей настоящей Конвенции компетентными органами стороны, на территории которой они находятся.

Статья 2

1. Если государство является компетентным органом в данном вопросе на их территории, стороны признают любой период обучения, проведенный студентом в высшем учебном заведении другой стороны, в качестве эквивалентного аналогичному периоду, проведенному в его или ее учебном заведении первоначального обучения, при условии: - что между высшим учебным заведением первоначального обучения или компетентным органом стороны, в которой такое учебное заведение расположено, с одной стороны, и высшим учебным заведением или компетентным органом стороны, на территории которой проходил период обучения, с другой стороны, имеется предварительное соглашение; - что администрация высшего учебного заведения, в котором проходило обучение, выдала студенту справку о том, что он или она успешно прошли курс обучения указанной продолжительности.

2. Продолжительность периода обучения, упомянутого в предыдущем пункте, определяется компетентными органами стороны, на территории которой расположено высшее учебное заведение первоначального обучения.

Статья 3

Если высшие учебные заведения сами являются компетентным органом в данном вопросе на их территории, стороны направляют текст настоящей Конвенции администрации этих учебных заведений и поощряют положительное рассмотрение и применение ими принципов, упомянутых в статье 2.

Статья 4

Положения настоящей Конвенции не затрагивают положений Европейской конвенции об эквивалентности периодов университетского обучения, открытой для подписания 15 декабря 1956 года в Париже.

Статья 5

1. Настоящая Конвенция открывается для подписания государствами - членами Совета Европы и другими государствами - участниками Европейской культурной конвенции, которые могут выразить согласие выполнять обязательства, вытекающие из: а) подписания без оговорок в отношении ратификации, принятия или одобрения; b) подписания при условии ратификации, принятия или одобрения с последующей ратификацией, принятием или одобрением.

2. Ратификационные грамоты и документы о принятии или одобрении сдаются на хранение Генеральному секретарю Совета Европы.

Статья 6

1. Настоящая Конвенция вступает в силу в первый день месяца, следующего за окончанием месячного периода с того дня, когда два государства - члена Совета Европы выразят свое согласие нести обязательства по Конвенции в соответствии с положениями статьи 5.

2. В отношении любого государства-члена, которое в дальнейшем выразит согласие нести обязательства по Конвенции, Конвенция вступает в силу в первый день месяца, следующего за окончанием месячного периода со дня подписания или сдачи на хранение ратификационной грамоты, документа о принятии или одобрении*.

Статья 7

1. После вступления в силу настоящей Конвенции Комитет министров Совета Европы может предложить любому государству, не являющемуся членом Совета, и Европейскому экономическому сообществу присоединиться к настоящей Конвенции на основании решения, принятого предусмотренным в статье 20 d Устава Совета Европы большинством голосов, и единогласного решения представителей Договаривающихся Государств, имеющих право быть представленными в Комитете.

2. В отношении любого присоединяющегося государства или Европейского экономического сообщества, в случае его присоединения, Конвенция вступает в силу в первый день месяца, следующего за окончанием месячного периода со дня сдачи на хранение документа о присоединении Генеральному секретарю Совета Европы.

Статья 8

1. Любое государство может в момент подписания или при сдаче на хранение своей ратификационной грамоты, документа о принятии, одобрении или присоединении указать территорию или территории, на которые будет распространяться действие настоящей Конвенции.

2. Любое государство может в любой более поздний срок путем направления заявления на имя Генерального секретаря Совета Европы распространить действие настоящей Конвенции на любую другую территорию, указанную в заявлении. В отношении такой территории Конвенция вступает в силу в первый день месяца, следующего за окончанием месячного периода со дня получения такого заявления Генеральным секретарем.

3. Любое заявление, сделанное в соответствии с двумя предыдущими пунктами, может в отношении любой территории, указанной в таком заявлении, быть отозвано путем направления уведомления на имя Генерального секретаря. Отзыв вступает в силу в первый день месяца, следующего за окончанием месячного периода со дня получения такого уведомления Генеральным секретарем.

Статья 9

1. Любая сторона может в любое время денонсировать настоящую Конвенцию путем направления уведомления на имя Генерального секретаря Совета Европы.

2. Такая денонсация вступает в силу в первый день месяца, следующего за окончанием шестимесячного периода со дня получения уведомления Генеральным секретарем.

Статья 10

Генеральный секретарь Совета Европы уведомляет государства - члены Совета, других участников Европейской культурной конвенции, любое присоединившееся государство и Европейское экономическое сообщество, если оно присоединится к настоящей Конвенции, о: а) любом подписании; b) сдаче на хранение ратификационной грамоты, документов о принятии, одобрении или присоединении; c) любой дате вступления в силу настоящей Конвенции в соответствии со статьями 6 и 7; d) любом другом акте, уведомлении или сообщении, касающемся настоящей Конвенции. В удостоверение чего нижеподписавшиеся, надлежащим образом уполномоченные своими правительствами, подписали настоящий Протокол.

Совершено в Риме шестого ноября одна тысяча девятьсот девяностого года на английском и французском языках, причем оба текста имеют одинаковую силу, в единственном экземпляре, который будет сдан на хранение в архив Совета Европы. Генеральный секретарь Совета Европы направит заверенные копии каждому государству - члену Совета Европы. ____________ * Конвенция вступила в силу для Российской Федерации 1 января 1997 г.

EUROPEAN CONVENTION ON THE GENERAL EQUIVALENCE OF PERIODS OF UNIVERSITY STUDY

The member States of the Council of Europe and the other States party to the European Cultural Convention, signatory hereto, Considering that the aim of the Council of Europe is to achieve a greater unity between its members; Having regard to the European Convention on the Equivalence of Periods of University Study, opened for signature in Paris on 15 December 1956, which applies to the field of modern languages; Convinced that an important contribution would be made to European understanding if a larger number of students in all disciplines could spend periods of study abroad and if examinations passed and courses taken by such students during these periods of study could be recognised by their institution of origin; Being resolved to establish, for this purpose, the principle of the general equivalence of periods of university study, Have agreed as follows:

Article 1

For the purpose of the present Convention, the term "institutions of higher education" shall denote: a. universities; b. other institutions of higher education recognised for the purpose of this Convention by the competent authorities of the Party in whose territory they are situated.

Article 2

1. Parties shall, to the extent that the State is the competent authority in the matter in their territory, recognise any period of study spent by a student in an institution of higher education of another Party as equivalent to a similar period spent in his or her institution of origin, provided: - that there has been a previous agreement between, on the one hand, the institution of higher education of origin or the competent authority of the Party where this institution is situated and, on the other hand, the institution of higher education or the competent authority of the Party on the territory of which the period of study has taken place; - that the authorities of the institution of higher education where the period of study has taken place have issued to the student a certificate attesting that he or she has completed the said period of study to their satisfaction.

2. The length of the period of study referred to in the previous paragraph shall be determined by the competent authorities of the Party on the territory of which the institution of higher education of origin is situated.

Article 3

To the extent that the institutions of higher education are themselves the competent authority in the matter on their territory, Parties shall transmit the text of the present Convention to the authorities of these institutions and shall encourage the favourable consideration and application by them of the principles mentioned in Article 2.

Article 4

The provisions of this Convention shall not affect those of the European Convention on the Equivalence of Periods of University Study, opened for signature in Paris on 15 December 1956.

Article 5

1. This Convention shall be open for signature by the member States of the Council of Europe and the other States Parties to the European Cultural Convention, which may express their consent to be bound by: a. signature without reservation as to ratification, acceptance or approval; or b. signature, subject to ratification, acceptance or approval, followed by ratification, acceptance or approval.

2. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

Article 6

1. This Convention shall enter into force on the first day of the month following the expiration of a period of one month after the date on which two member States of the Council of Europe have expressed their consent to be bound by the Convention in accordance with the provisions of Article 5.

2. In respect of any member State which subsequently expresses its consent to be bound by it, the Convention shall enter into force on the first day of the month following the expiration of a period of one month after the date of signature or the deposit of the instrument of ratification, acceptance or approval.

Article 7

l. After the entry into force of this Convention, the Committee of Ministers of the Council of Europe may invite any State not a member of the Council and the European Economic Community to accede to this Convention, by a decision taken by the majority provided for in Article 20.d of the Statute of the Council of Europe and by the unanimous vote of the representatives of the Contracting States entitled to sit on the Committee.

2. In respect of any acceding State or, should it accede, the European Economic Community, the Convention shall enter into force on the first day of the month following the expiration of a period of one month after the date of deposit of the instrument of accession with the Secretary General of the Council of Europe.

Article 8

l. Any State may, at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession, specify the territory or territories to which this Convention shall apply.

2. Any State may, at any later date, by a declaration addressed to the Secretary General of the Council of Europe, extend the application of this Convention to any other territory specified in the declaration. In respect of such territory the Convention shall enter into force on the first day of the month following the expiration of a period of one month after the date of receipt of such declaration by the Secretary General.

3. Any declaration made under the two preceding paragraphs may, in respect of any territory specified in such declaration, be withdrawn by a notification addressed to the Secretary General. The withdrawal shall become effective on the first day of the month following the expiration of a period of one month after the date of receipt of such notification by the Secretary General.

Article 9

l. Any Party may, at any time, denounce this Convention by means of a notification addressed to the Secretary General of the Council of Europe.

2. Such denunciation shall become effective on the first day of the month following the expiration of a period of six months after the date of receipt of the notification by the Secretary General.

Article 10

The Secretary General of the Council of Europe shall notify the member States of the Council, the other Parties to the European Cultural Convention, any State which has acceded and the European Economic Community, if it has acceded to this Convention, of: a. any signature; b. the deposit of any instrument of ratification, acceptance, approval or accession; c. any date of entry into force of this Convention in accordance with Articles 6 and 7; d. any other act, notification or communication relating to this Convention. In witness whereof the undersigned, being duly authorised thereto, have signed this Protocol.

Done at Rome, this 6th day of November 1990, in English and French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each member State of the Council of Europe.

Article 1

Aux fins de la prщsente Convention, le terme лщtablissements d'enseignement supщrieur+ dщsigne: a. les universitщs; b. les autres щtablissements d'enseignement supщrieur officiellement reconnus aux fins de la prщsente Convention par les autoritщs compщtentes de la Partie sur le territoire de laquelle ils sont situщs.

Article 2

1. Les Parties, dans la mesure o· sur leur territoire l'Etat constitue l'autoritщ compщtente en la matiшre, reconnaissent toute pщriode d'щtudes passщe par un щtudiant dans un щtablissement d'enseignement supщrieur d'une autre Partie comme щquivalente р une pщriode similaire passщe dans son щtablissement d'origine, р condition: - qu'un accord prщalable ait щtщ conclu entre, d'une part, l'щtablissement d'enseignement supщrieur d'origine ou l'autoritщ compщtente de la Partie o· cet щtablissement est situщ et, d'autre part, l'щtablissement d'enseignement supщrieur ou l'autorit compщtente de la Partie sur le territoire de laquelle la pщriode d'щtudes s'est effectuщe; - que les autoritщs de l'щtablissement d'enseignement supщrieur o· la pщriode d'щtudes s'est effectuщe aient dщlivrщ р l'щtudiant un certificat attestant qu'il a accompli ladite pщriode d'щtudes р leur satisfaction.

2. La durщe de la pщriode d'щtudes visщe au paragraphe prщcщdent est dщterminщe par les autoritщs compщtentes de la Partie sur le territoire de laquelle se trouve l'щtablissement d'enseignement supщrieur d'origine.

Article 3

Les Parties, dans la mesure o· sur leur territoire les щtablissements d'enseignement supщrieur constituent l'autoritщ compщtente en la matiшre, transmettront le texte de la prщsente Convention aux autoritщs des щtablissements en question situщs sur l ur territoire et les encourageront р examiner avec bienveillance et р appliquer les principes щnoncщs р l'articleа2.

Article 4

Les dispositions de la prщsente Convention n'affectent pas celles de la Convention europщenne sur l'щquivalence des pщriodes d'щtudes universitaires, ouverte р la signature, р Paris, le 15 dщcembre 1956.

Article 5

1. La prщsente Convention est ouverte р la signature des Etats membres du Conseil de l'Europe et des autres Etats parties р la Convention culturelle europщenne, qui peuvent exprimer leur consentement р ъtre liщs par: a. signature sans rщserve de ratification, d'acceptation ou d'approbation; ou b. signature, sous rщserve de ratification, d'acceptation ou d'approbation, suivie de ratification, d'acceptation ou d'approbation.

2. Les instruments de ratification, d'acceptation ou d'approbation seront dщposщs prшs le Secrщtaire Gщnщral du Conseil de l'Europe.

Article 6

1. La prщsente Convention entrera en vigueur le premier jour du mois qui suit l'expiration d'une pщriode d'un mois aprшs la date р laquelle deux Etats membres du Conseil de l'Europe auront exprimщ leur consentement р ъtre liщs par la Convention confor щment aux dispositions de l'articleа 5.

2. Pour tout Etat signataire qui exprimera ultщrieurement son consentement р ъtre liщ par la Convention, celle-ci entrera en vigueur le premier jour du mois qui suit l'expiration d'une pщriode d'un mois aprшs la ate de la signature ou du dщpЇt de l'instrument de ratification, d'acceptation ou d'approbation.

Article 7

1. Aprшs l'entrщe en vigueur de la prщsente Convention, le Comitщ des Ministres du Conseil de l'Europe pourra inviter tout Etat non membre du Conseil ainsi que la Communautщ щconomique europщenne р adhщrer р la prщsente Convention, par une dщcision pr se р la majoritщ prщvue р l'articleа20.d du Statut du Conseil de l'Europe, et р l'unanimitщ des reprщsentants des Etats contractants ayant le droit de siщger au Comitщ.

2. Pour tout Etat adhщrent ou pour la Communautщ щconomique europщenne en cas d'ad щsion, la Convention entrera en vigueur le premier jour du mois qui suit l'expiration d'une pщriode d'un mois aprшs la date de dщpЇt de l'instrument d'adhщsion prшs le Secrщtaire Gщnщral du Conseil de l'Europe.

Article 8

1. Tout Etat peut, au moment de la signature ou au moment du dщpЇt de son instrument de ratification, d'acceptation, d'approbation ou d'adhщsion, dщsigner le ou les territoires auxquels s'appliquera la prщsente Convention.

2. Tout Etat peut, р tout aut e moment par la suite, par une dщclaration adressщe au Secrщtaire Gщnщral du Conseil de l'Europe, щtendre l'application de la prщsente Convention р tout autre territoire dщsignщ dans la dщclaration. La Convention entrera en vigueur р l'щgard de ce te ritoire le premier jour du mois qui suit l'expiration d'une pщriode d'un mois aprшs la date de rщception de la dщclaration par le Secrщtaire Gщnщral.

3. Toute dщclaration faite en vertu des deux paragraphes prщcщdents pourra ъtre retirщe, en ce qui co cerne tout territoire dщsignщ dans cette dщclaration, par notification adressщe au Secrщtaire Gщnщral. Le retrait prendra effet le premier jour du mois qui suit l'expiration d'une pщriode d'un mois aprшs la date de rщception de la notification par le Secrщtaire Gщnщral.

Article 9

1. Toute Partie peut, р tout moment, dщnoncer la prщsente Convention en adressant une notification au Secrщtaire Gщnщral du Conseil de l'Europe.

2. La dщnonciation prendra effet le premier jour du mois qui suit l'expiration d'une pщriode de six mois ap шs la date de rщception de la notification par le Secrщtaire Gщnщral.

Article 10

Le Secrщtaire Gщnщral du Conseil de l'Europe notifiera aux Etats membres du Conseil, aux autres Parties р la Convention culturelle europщenne, р tout Etat ayant adhщrщ р la prщsente Convention et р la Communautщ щconomique europщenne adhщrente: a. toute signature; b. le dщpЇt de tout instrument de ratification, d'acceptation, d'approbation ou d'adhщsion; c. toute date d'entrщe en vigueur de la prщsente Convention conformщment р ses articlesа6 etа7; d. tout autre acte, notification ou communication ayant trait р la prщsente Convention. En foi de quoi, les soussignщs, d_ment autorisщs р cet effet, ont signщ la prщsente Convention. Fait р Rome, le 6 novembre 1990, en franчais et en anglais, les deux textes faisant щgalement foi, en un seul exemplaire qui sera dщposщ dans les archives du Conseil de l'Europe. Le Secrщtaire Gщnщral du Conseil de l'Europe en communiquera copie cert fiщe conforme р chacun des Etats membres du Conseil de l'Europe, aux autres Etats parties р la Convention culturelle europщenne et р tout Etat ou р la Communautщ щconomique europщenne invitщs р adhщrer р la prщsente Convention.
