name="crossheading" ukl:Name="Pblock" eId="crossheading-treatment-of-claimants"><heading><i>Treatment of claimants</i></heading><section eId="section-8"><num>8</num><heading>Claimant’s credibility</heading><subsection eId="section-8-1"><num>(1)</num><content><p>In determining whether to believe a statement made by or on behalf of a person who makes an asylum claim or a human rights claim, a deciding authority shall take account, as damaging the claimant’s credibility, of any behaviour to which this section applies.</p></content></subsection><subsection eId="section-8-2"><num>(2)</num><intro><p>This section applies to any behaviour by the claimant that the deciding authority thinks—</p></intro><level class="para1" eId="section-8-2-a"><num>(a)</num><content><p>is designed or likely to conceal information,</p></content></level><level class="para1" eId="section-8-2-b"><num>(b)</num><content><p>is designed or likely to mislead, or</p></content></level><level class="para1" eId="section-8-2-c"><num>(c)</num><content><p>is designed or likely to obstruct or delay the handling or resolution of the claim or the taking of a decision in relation to the claimant.</p></content></level></subsection><subsection eId="section-8-3"><num>(3)</num><intro><p>Without prejudice to the generality of subsection (2) the following kinds of behaviour shall be treated as designed or likely to conceal information or to mislead—</p></intro><level class="para1" eId="section-8-3-a"><num>(a)</num><content><p>failure without reasonable explanation to produce <ins class="substitution first last" ukl:ChangeId="key-6c83d1ab3dcb6e2aa5a7aacdcf747e20-1707326359915" ukl:CommentaryRef="key-6c83d1ab3dcb6e2aa5a7aacdcf747e20"><noteRef uk:name="commentary" href="#key-6c83d1ab3dcb6e2aa5a7aacdcf747e20" class="commentary"/>an identity document</ins> on request to an immigration officer or to the Secretary of State,</p></content></level><level class="para1" eId="section-8-3-b"><num>(b)</num><content><p>the production of a document which is not a valid <ins class="substitution first last" ukl:ChangeId="key-a94d8dddaf8224319e26480c010f2c7f-1707326416292" ukl:CommentaryRef="key-a94d8dddaf8224319e26480c010f2c7f"><noteRef uk:name="commentary" href="#key-a94d8dddaf8224319e26480c010f2c7f" class="commentary"/>identity document</ins> as if it were,</p></content></level><level class="para1" eId="section-8-3-c"><num>(c)</num><content><p>the destruction, alteration or disposal, in each case without reasonable explanation, of <ins class="substitution first last" ukl:ChangeId="key-93665312b25e1ee891721f9d01cc2dfe-1707326383853" ukl:CommentaryRef="key-93665312b25e1ee891721f9d01cc2dfe"><noteRef uk:name="commentary" href="#key-93665312b25e1ee891721f9d01cc2dfe" class="commentary"/>an identity document</ins>,</p></content></level><level class="para1" eId="section-8-3-d"><num>(d)</num><content><p>the destruction, alteration or disposal, in each case without reasonable explanation, of a ticket or other document connected with travel, </p></content></level><level class="para1" eId="section-8-3-da"><num><ins class="first" ukl:ChangeId="key-88a3799762732a77932fe418f570c97b-1707326436301" ukl:CommentaryRef="key-88a3799762732a77932fe418f570c97b"><noteRef uk:name="commentary" href="#key-88a3799762732a77932fe418f570c97b" class="commentary"/>(da)</ins></num><intro><p><ins ukl:ChangeId="key-88a3799762732a77932fe418f570c97b-1707326436301" ukl:CommentaryRef="key-88a3799762732a77932fe418f570c97b">failure to provide to an immigration officer or the Secretary of State, on request, any information or anything else required in order to access any information stored in electronic form on a thing in the possession of an immigration officer or the Secretary of State that—</ins></p></intro><level class="para2" eId="section-8-3-da-i"><num><ins ukl:ChangeId="key-88a3799762732a77932fe418f570c97b-1707326436301" ukl:CommentaryRef="key-88a3799762732a77932fe418f570c97b">(i)</ins></num><content><p><ins ukl:ChangeId="key-88a3799762732a77932fe418f570c97b-1707326436301" ukl:CommentaryRef="key-88a3799762732a77932fe418f570c97b">was found on the claimant, or</ins></p></content></level><level class="para2" eId="section-8-3-da-ii"><num><ins ukl:ChangeId="key-88a3799762732a77932fe418f570c97b-1707326436301" ukl:CommentaryRef="key-88a3799762732a77932fe418f570c97b">(ii)</ins></num><content><p><ins class="last" ukl:ChangeId="key-88a3799762732a77932fe418f570c97b-1707326436301" ukl:CommentaryRef="key-88a3799762732a77932fe418f570c97b">appears to an immigration officer or the Secretary of State to have been in the possession of the claimant,</ins> and</p></content></level></level><level class="para1" eId="section-8-3-e"><num>(e)</num><content><p>failure without reasonable explanation to answer a question asked by a deciding authority.</p></content></level></subsection><subsection eId="section-8-4"><num>(4)</num><content><p>This section also applies to failure by the claimant to take advantage of a reasonable opportunity to make an asylum claim or human rights claim while in a safe country.</p></content></subsection><subsection eId="section-8-5"><num>(5)</num><content><p>This section also applies to failure by the claimant to make an asylum claim or human rights claim before being notified of an immigration decision, unless the claim relies wholly on matters arising after the notification.</p></content></subsection><subsection eId="section-8-6"><num>(6)</num><intro><p>This section also applies to failure by the claimant to make an asylum claim or human rights claim before being arrested under an immigration provision, unless—</p></intro><level class="para1" eId="section-8-6-a"><num>(a)</num><content><p>he had no reasonable opportunity to make the claim before the arrest, or</p></content></level><level class="para1" eId="section-8-6-b"><num>(b)</num><content><p>the claim relies wholly on matters arising after the arrest.</p></content></level></subsection><subsection eId="section-8-7"><num>(7)</num><content><p>In this section—</p></content></subsection><hcontainer name="definition"><content><p>“<term refersTo="#term-asylum-claim" eId="term-asylum-claim">asylum claim</term>” has the meaning given by section 113(1) of the Nationality, Immigration and Asylum Act 2002 (c. 41) (subject to subsection (9) below),</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-deciding-authority" eId="term-deciding-authority">deciding authority</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>an immigration officer,</p></content></level><level class="para1"><num>(b)</num><content><p>the Secretary of State,</p></content></level><level class="para1"><num>(c)</num><content><p><ins class="substitution first last" ukl:ChangeId="key-b5598449c5742d8c586d08790e808ab2-1459767639181" ukl:CommentaryRef="key-b5598449c5742d8c586d08790e808ab2"><noteRef uk:name="commentary" href="#key-b5598449c5742d8c586d08790e808ab2" class="commentary"/>the First-tier Tribunal</ins>, or</p></content></level><level class="para1"><num>(d)</num><content><p>the Special Immigration Appeals Commission,</p></content></level></hcontainer><hcontainer name="definition"><content><p> <ins class="first" ukl:ChangeId="key-666cde792c002212cc33bcd9dd43f7de-1707326459280" ukl:CommentaryRef="key-666cde792c002212cc33bcd9dd43f7de"><noteRef uk:name="commentary" href="#key-666cde792c002212cc33bcd9dd43f7de" class="commentary"/>“</ins><term refersTo="#term-document"><ins ukl:ChangeId="key-666cde792c002212cc33bcd9dd43f7de-1707326459280" ukl:CommentaryRef="key-666cde792c002212cc33bcd9dd43f7de">document</ins></term><ins class="last" ukl:ChangeId="key-666cde792c002212cc33bcd9dd43f7de-1707326459280" ukl:CommentaryRef="key-666cde792c002212cc33bcd9dd43f7de">” includes information recorded in any form;</ins> </p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-human-rights-claim" eId="term-human-rights-claim">human rights claim</term>” has the meaning given by section 113(1) of the Nationality, Immigration and Asylum Act 2002 (subject to subsection (9) below),</p></content></hcontainer><hcontainer name="definition"><content><p> <ins class="first" ukl:ChangeId="key-666cde792c002212cc33bcd9dd43f7de-1707326482244" ukl:CommentaryRef="key-666cde792c002212cc33bcd9dd43f7de"><noteRef uk:name="commentary" href="#key-666cde792c002212cc33bcd9dd43f7de" class="commentary"/>“</ins><term refersTo="#term-identity-document"><ins ukl:ChangeId="key-666cde792c002212cc33bcd9dd43f7de-1707326482244" ukl:CommentaryRef="key-666cde792c002212cc33bcd9dd43f7de">identity document</ins></term><ins class="last" ukl:ChangeId="key-666cde792c002212cc33bcd9dd43f7de-1707326482244" ukl:CommentaryRef="key-666cde792c002212cc33bcd9dd43f7de">” means any document that may be used (whether by itself or otherwise and with or without modifications) to establish, or provide evidence of, a person’s identity or address;</ins> </p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-immigration-decision" eId="term-immigration-decision">immigration decision</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>refusal of leave to enter the United Kingdom,</p></content></level><level class="para1"><num>(b)</num><content><p>refusal to vary a person’s leave to enter or remain in the United Kingdom,</p></content></level><level class="para1"><num>(c)</num><content><p>grant of leave to enter or remain in the United Kingdom,</p></content></level><level class="para1"><num>(d)</num><content><p>a decision that a person is to be removed from the United Kingdom by way of directions under section 10<noteRef href="#key-90854efd59e3b5ed23d804a1ac8b79f7" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>... of the Immigration and Asylum Act 1999 (c. 33) (removal of persons unlawfully in United Kingdom),</p></content></level><level class="para1"><num>(e)</num><content><p>a decision that a person is to be removed from the United Kingdom by way of directions under paragraphs 8 to 12 of Schedule 2 to the Immigration Act 1971 (c. 77) (control of entry: removal),</p></content></level><level class="para1"><num>(f)</num><content><p>a decision to make a deportation order under section 5(1) of that Act, and</p></content></level><level class="para1"><num>(g)</num><content><p>a decision to take action in relation to a person in connection with extradition from the United Kingdom,</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-immigration-provision" eId="term-immigration-provision">immigration provision</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>sections 28A, 28AA, 28B, 28C and 28CA of the Immigration Act 1971 (immigration offences: enforcement),</p></content></level><level class="para1"><num>(b)</num><content><p>paragraph 17 of Schedule 2 to that Act (control of entry),</p></content></level><level class="para1"><num>(c)</num><content><p>section 14 of this Act, and</p></content></level><level class="para1"><num>(d)</num><content><p>a provision of the Extradition Act 1989 (c. 33) or 2003 (c. 41),</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-notified" eId="term-notified">notified</term>” means notified in such manner as may be specified by regulations made by the Secretary of State,</p></content></hcontainer><hcontainer name="definition"><content><p><noteRef href="#key-3d39f951b0efb63e13573c0268a209ea" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>...</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-safe-country" eId="term-safe-country">safe country</term>” means a country to which Part 2 of Schedule 3 applies.</p></content></hcontainer><subsection eId="section-8-8"><num>(8)</num><intro><p> <ins class="substitution first last" ukl:ChangeId="key-1b44d6fffccc32c3605ab8f7bb99a913-1707326525487" ukl:CommentaryRef="key-1b44d6fffccc32c3605ab8f7bb99a913"><noteRef uk:name="commentary" href="#key-1b44d6fffccc32c3605ab8f7bb99a913" class="commentary"/>An identity document</ins> produced by or on behalf of a person is valid for the purposes of subsection (3)(b) if it—</p></intro><level class="para1" eId="section-8-8-a"><num>(a)</num><content><p>relates to the person by whom or on whose behalf it is produced,</p></content></level><level class="para1" eId="section-8-8-b"><num>(b)</num><content><p>has not been altered otherwise than by or with the permission of the authority who issued it, and</p></content></level><level class="para1" eId="section-8-8-c"><num>(c)</num><content><p>was not obtained by deception.</p></content></level></subsection><subsection eId="section-8-9"><num>(9)</num><content><p>In subsection (4) a reference to an asylum claim or human rights claim shall be treated as including a reference to a claim of entitlement to remain in a country other than the United Kingdom made by reference to the rights that a person invokes in making an asylum claim or a human rights claim in the United Kingdom.</p></content></subsection><subsection eId="section-8-9A"><num><ins class="first" ukl:ChangeId="key-95394883ba89911637cdfc0f2f628c19-1459767679770" ukl:CommentaryRef="key-95394883ba89911637cdfc0f2f628c19"><noteRef uk:name="commentary" href="#key-95394883ba89911637cdfc0f2f628c19" class="commentary"/>(9A)</ins></num><content><p><ins class="last" ukl:ChangeId="key-95394883ba89911637cdfc0f2f628c19-1459767679770" ukl:CommentaryRef="key-95394883ba89911637cdfc0f2f628c19">In paragraph (c) of the definition of a “deciding authority” in subsection (7) the reference to the First-tier Tribunal includes a reference to the Upper Tribunal when acting under section 12(2)(b)(ii) of the Tribunals, Courts and Enforcement Act 2007.</ins></p></content></subsection><subsection eId="section-8-10"><num>(10)</num><intro><p>Regulations under subsection (7) specifying a manner of notification may, in particular—</p></intro><level class="para1" eId="section-8-10-a"><num>(a)</num><content><p>apply or refer to regulations under section 105 of the Nationality, Immigration and Asylum Act 2002 (c. 41) (notice of immigration decisions);</p></content></level><level class="para1" eId="section-8-10-b"><num>(b)</num><content><p>make provision similar to provision that is or could be made by regulations under that section;</p></content></level><level class="para1" eId="section-8-10-c"><num>(c)</num><content><p>modify a provision of regulations under that section in its effect for the purpose of regulations under this section;</p></content></level><level class="para1" eId="section-8-10-d"><num>(d)</num><content><p>provide for notice to be treated as received at a specified time if sent to a specified class of place in a specified manner.</p></content></level></subsection><subsection eId="section-8-11"><num>(11)</num><intro><p>Regulations under subsection (7) specifying a manner of notification—</p></intro><level class="para1" eId="section-8-11-a"><num>(a)</num><content><p>may make incidental, consequential or transitional provision,</p></content></level><level class="para1" eId="section-8-11-b"><num>(b)</num><content><p>shall be made by statutory instrument, and</p></content></level><level class="para1" eId="section-8-11-c"><num>(c)</num><content><p>shall be subject to annulment in pursuance of a resolution of either House of Parliament.</p></content></level></subsection><subsection eId="section-8-12"><num>(12)</num><content><p>This section shall not prevent a deciding authority from determining not to believe a statement on the grounds of behaviour to which this section does not apply.</p></content></subsection><subsection eId="section-8-13"><num><noteRef href="#key-70191585ae7cf87f4ef77eb549278bdc" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>(13)</num><content><p>. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .</p></content></subsection></section><section eId="section-9"><num>9</num><heading>Failed asylum seekers: withdrawal of support</heading><subsection eId="section-9-1"><num>(1)</num><content><p><mod>In Schedule 3 to the Nationality, Immigration and Asylum Act 2002 (withholding and withdrawal of support) after paragraph 7 insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="schedule" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="schedule" ukl:Format="default"><hcontainer name="crossheading" class="schGroup7"><heading><i>Fifth class of ineligible person: failed asylum-seeker with family</i></heading><paragraph class="schProv1"><num>7A</num><subparagraph><num>(1)</num><intro><p>Paragraph 1 applies to a person if—</p></intro><level class="para1"><num>(a)</num><intro><p>he—</p></intro><level class="para2"><num>(i)</num><content><p>is treated as an asylum-seeker for the purposes of Part VI of the Immigration and Asylum Act 1999 (c. 33) (support) by virtue only of section 94(3A) (failed asylum-seeker with dependent child), or</p></content></level><level class="para2"><num>(ii)</num><content><p>is treated as an asylum-seeker for the purposes of Part 2 of this Act by virtue only of section 18(2),</p></content></level></level><level class="para1"><num>(b)</num><intro><p>the Secretary of State has certified that in his opinion the person has failed without reasonable excuse to take reasonable steps—</p></intro><level class="para2"><num>(i)</num><content><p>to leave the United Kingdom voluntarily, or</p></content></level><level class="para2"><num>(ii)</num><content><p>to place himself in a position in which he is able to leave the United Kingdom voluntarily,</p></content></level></level><level class="para1"><num>(c)</num><content><p>the person has received a copy of the Secretary of State’s certificate, and</p></content></level><level class="para1"><num>(d)</num><content><p>the period of 14 days, beginning with the date on which the person receives the copy of the certificate, has elapsed.</p></content></level></subparagraph><subparagraph><num>(2)</num><content><p>Paragraph 1 also applies to a dependant of a person to whom that paragraph applies by virtue of sub-paragraph (1).</p></content></subparagraph><subparagraph><num>(3)</num><content><p>For the purpose of sub-paragraph (1)(d) if the Secretary of State sends a copy of a certificate by first class post to a person’s last known address, the person shall be treated as receiving the copy on the second day after the day on which it was posted.</p></content></subparagraph><subparagraph><num>(4)</num><content><p>The Secretary of State may by regulations vary the period specified in sub-paragraph (1)(d).</p></content></subparagraph></paragraph></hcontainer></quotedStructure></mod></p></content></subsection><subsection eId="section-9-2"><num>(2)</num><content><p><mod>In paragraph 14(1) and (2) of Schedule 3 to the Nationality, Immigration and Asylum Act 2002 (local authority to notify Secretary of State) for “paragraph 6 or 7” substitute <quotedText>“ paragraph 6, 7 or 7A ”</quotedText>.</mod></p></content></subsection><subsection eId="section-9-3"><num>(3)</num><intro><p>No appeal may be brought under section 103 of the Immigration and Asylum Act 1999 (asylum support appeal) against a decision—</p></intro><level class="para1" eId="section-9-3-a"><num>(a)</num><content><p>that by virtue of a provision of Schedule 3 to the Nationality, Immigration and Asylum Act 2002 (c. 41) other than paragraph 7A a person is not qualified to receive support, or</p></content></level><level class="para1" eId="section-9-3-b"><num>(b)</num><content><p>on the grounds of the application of a provision of that Schedule other than paragraph 7A, to stop providing support to a person.</p></content></level></subsection><subsection eId="section-9-4"><num>(4)</num><intro><p>On an appeal under section 103 of the Immigration and Asylum Act 1999 (c. 33) against a decision made by virtue of paragraph 7A of Schedule 3 to the Nationality, Immigration and Asylum Act 2002 the<ins class="substitution first last" ukl:ChangeId="key-60d03d6c6a5eaabd988b8448c9592dfe-1455902392481" ukl:CommentaryRef="key-60d03d6c6a5eaabd988b8448c9592dfe"><noteRef uk:name="commentary" href="#key-60d03d6c6a5eaabd988b8448c9592dfe" class="commentary"/>First-tier Tribunal</ins> may, in particular—</p></intro><level class="para1" eId="section-9-4-a"><num>(a)</num><content><p>annul a certificate of the Secretary of State issued for the purposes of that paragraph;</p></content></level><level class="para1" eId="section-9-4-b"><num>(b)</num><content><p>require the Secretary of State to reconsider the matters certified.</p></content></level></subsection><subsection eId="section-9-5"><num>(5)</num><content><p>An order under section 48 providing for this section to come into force may, in particular, provide for this section to have effect with specified modifications before the coming into force of a provision of the Nationality, Immigration and Asylum Act 2002.</p></content></subsection></section><section eId="section-10"><num>10</num><heading>Failed asylum seekers: accommodation</heading><subsection eId="section-10-1"><num>(1)</num><content><p><mod>At the end of section 4 of the Immigration and Asylum Act 1999 (provision of accommodation for failed asylum seekers, &amp;c.) add—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection><num>(5)</num><intro><p>The Secretary of State may make regulations specifying criteria to be used in determining—</p></intro><level class="para1"><num>(a)</num><content><p>whether or not to provide accommodation, or arrange for the provision of accommodation, for a person under this section;</p></content></level><level class="para1"><num>(b)</num><content><p>whether or not to continue to provide accommodation, or arrange for the provision of accommodation, for a person under this section.</p></content></level></subsection><subsection><num>(6)</num><intro><p>The regulations may, in particular—</p></intro><level class="para1"><num>(a)</num><content><p>provide for the continuation of the provision of accommodation for a person to be conditional upon his performance of or participation in community activities in accordance with arrangements made by the Secretary of State;</p></content></level><level class="para1"><num>(b)</num><content><p>provide for the continuation of the provision of accommodation to be subject to other conditions;</p></content></level><level class="para1"><num>(c)</num><content><p>provide for the provision of accommodation (or the continuation of the provision of accommodation) to be a matter for the Secretary of State’s discretion to a specified extent or in a specified class of case.</p></content></level></subsection><subsection><num>(7)</num><intro><p>For the purposes of subsection (6)(a)—</p></intro><level class="para1"><num>(a)</num><content><p>“<term refersTo="#term-community-activities">community activities</term>” means activities that appear to the Secretary of State to be beneficial to the public or a section of the public, and</p></content></level><level class="para1"><num>(b)</num><intro><p>the Secretary of State may, in particular—</p></intro><level class="para2"><num>(i)</num><content><p>appoint one person to supervise or manage the performance of or participation in activities by another person;</p></content></level><level class="para2"><num>(ii)</num><content><p>enter into a contract (with a local authority or any other person) for the provision of services by way of making arrangements for community activities in accordance with this section;</p></content></level><level class="para2"><num>(iii)</num><content><p>pay, or arrange for the payment of, allowances to a person performing or participating in community activities in accordance with arrangements under this section.</p></content></level></level></subsection><subsection><num>(8)</num><content><p>Regulations by virtue of subsection (6)(a) may, in particular, provide for a condition requiring the performance of or participation in community activities to apply to a person only if the Secretary of State has made arrangements for community activities in an area that includes the place where accommodation is provided for the person.</p></content></subsection><subsection><num>(9)</num><content><p>A local authority or other person may undertake to manage or participate in arrangements for community activities in accordance with this section.</p></content></subsection></quotedStructure></mod></p></content></subsection><subsection eId="section-10-2"><num>(2)</num><content><p><mod>In section 166(5) of that Act (regulations: affirmative instrument) before paragraph (a) insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><level marriage has been resident in a registration district for the period of seven days immediately before the giving of his or her notice (but the district need not be that in which the notice is given and the parties need not have resided in the same district), and</p></content></level><level class="para1" eId="section-19-2-d"><num>(d)</num><content><p>shall state, in relation to each party, the registration district by reference to which paragraph (c) is satisfied.</p></content></level></subsection><subsection eId="section-19-2A"><num><ins class="first" eId="section-20"><num>20</num><heading>England and Wales: supplemental</heading><subsection eId="section-20-1"><num>(1)</num><intro><p>The Marriage Act 1949 (c. 76) shall have effect in relation to a marriage to which section 19 applies—</p></intro><level class="para1" eId="section-20-1-a"><num>(a)</num><content><p>subject to that section, and</p></content></level><level class="para1" eId="section-20-1-b"><num>(b)</num><content><p>with any necessary consequential modification.</p></content></level></subsection><subsection eId="section-20-2"><num>(2)</num><intro><p>In particular—</p></intro><level class="para1" eId="section-20-2-a"><num>(a)</num><intro><p>section 28(1)(b) of that Act (declaration: residence) shall have effect as if it required a declaration to an application for the issue of a certificate under section 10 of the Nationality, Immigration and Asylum Act 2002 (right of abode: certificate of entitlement) may prescribe an amount which is intended to—</p></intro><level class="para1" eId="section-42-3-a"><num>(a)</num><content><p>exceed the administrative costs of determining the application, and</p></content></level><level class="para1" eId="section-42-3-b"><num>(b)</num><content><p>reflect benefits that in the opinion of Her Majesty in Council are likely to accrue to the applicant if the application is successful.</p></content></level></subsection><subsection eId="section-42-3A"><num><ins class="substitution first" ukl:ChangeId="key-067561f8a8291a088fa14dd9eb2d8628-1479378727980" ukl:CommentaryRef="key-067561f8a8291a088fa14dd9eb2d8628">the determination of applications for transit visas under section 41 of the Immigration and Asylum Act 1999, or</ins></p></content></level><level class="para1" eId="section-42-3B-c"><num><ins class="substitution" ukl:ChangeId="key-067561f8a8291a088fa14dd9eb2d8628-1479378727980" ukl:CommentaryRef="key-067561f8a8291a088fa14dd9eb2d8628">(c)</ins></num><content><p><ins class="substitution last" ukl:ChangeId="key-067561f8a8291a088fa14dd9eb2d8628-1479378727980" ukl:CommentaryRef="key-067561f8a8291a088fa14dd9eb2d8628">the determination of applications for certificates of entitlement to the right of abode in the United Kingdom under section 10 of the Nationality, Immigration and Asylum Act 2002.</ins></p></content></level></subsection><subsection eId="section-42-4"><num>(4)</num><content><p>Where an instrument prescribes a fee in reliance on this section it may include provision for the refund, where an application is unsuccessful or a process is not completed, of that part of the fee which is intended to reflect the matters specified in subsection <noteRef href="#key-65ec222e6c9e90f96fb82bf0f0d33b8c" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>... (3)(b).</p></content></subsection><subsection eId="section-42-5"><num>(5)</num><intro><p>Provision included by virtue of subsection (4)—</p></intro><level class="para1" eId="section-42-5-a"><num>(a)</num><content><p>may determine, or provide for the determination of, the amount to be refunded;</p></content></level><level class="para1" eId="section-42-5-b"><num>(b)</num><content><p>may confer a discretion on the Secretary of State or another person (whether in relation to determining the amount of a refund or in relation to determining whether a refund should be made).</p></content></level></subsection><subsection eId="section-42-6"><num>(6)</num><content><p>An instrument may not be made in reliance on this section unless the Secretary of State has consulted with such persons as appear to him to be appropriate.</p></content></subsection><subsection eId="section-42-7"><num>(7)</num><content><p>An instrument may not be made in reliance on this section unless a draft has been laid before and approved by resolution of each House of Parliament <noteRef href="#key-acff243bb894ee327c06989bb0abe132" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>....</p></content></subsection><subsection eId="section-42-8"><num>(8)</num><content><p> This section is without prejudice to the power to make an order under section 102 of the Finance ( <abbr title="Number">No.</abbr> 2) Act 1987 (c. 51) (government fees and charges) in relation to a power under a provision specified in this section. </p></content></subsection></section><section eId="section-43"><num>43</num><heading>Transfer of leave stamps</heading><subsection eId="section-43-1"><num>(1)</num><content><p>Section 5 of the Immigration and Asylum Act 1999 (c. 33) (charges) shall be amended as follows.</p></content></subsection><subsection eId="section-43-2"><num>(2)</num><content><p><mod>For subsection (1)(c) (transfer of indefinite leave stamp to new document) substitute—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><level class="para1"><num>(c)</num><content><p>the fixing of a limited leave stamp or indefinite leave stamp on a passport or other document issued to the applicant where the stamp was previously fixed on another passport or document issued to the applicant.</p></content></level></quotedStructure></mod></p></content></subsection><subsection eId="section-43-3"><num>(3)</num><content><p><mod>For subsection (5) substitute—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection><num>(5)</num><intro><p>In this section—</p></intro><level class="para1"><num>(a)</num><content><p>“<term refersTo="#term-limited-leave-stamp">limited leave stamp</term>” means a stamp, sticker or other attachment which indicates that a person has been granted limited leave to enter or remain in the United Kingdom, and</p></content></level><level class="para1"><num>(b)</num><content><p>“<term refersTo="#term-indefinite-leave-stamp">indefinite leave stamp</term>” means a stamp, sticker or other attachment which indicates that a person has been granted indefinite leave to enter or remain in the United Kingdom.</p></content></level></subsection></quotedStructure></mod></p></content></subsection></section></hcontainer>

. . .</p></content></section><section eId="section-45"><num>45</num><heading>Interpretation: immigration officer</heading><content><p>In this Act “<term refersTo="#term-immigration-officer" eId="term-immigration-officer">immigration officer</term>” means a person appointed by the Secretary of State as an immigration officer under paragraph 1 of Schedule 2 to the Immigration Act 1971.</p></content></section><section eId="section-46"><num>46</num><heading>Money</heading><intro><p>There shall be paid out of money provided by Parliament—</p></intro><level class="para1" eId="section-46-a"><num>(a)</num><content><p>any expenditure incurred by a Minister of the Crown in connection with this Act, and</p></content></level><level class="para1" eId="section-46-b"><num>(b)</num><content><p>any increase attributable to this Act in the sums payable under any other enactment out of money provided by Parliament.</p></content></level></section><section eId="section-47"><num>47</num><heading>Repeals</heading><content><p>The enactments listed in Schedule 4 are hereby repealed to the extent specified.</p></content></section><section eId="section-48"><num>48</num><heading>Commencement</heading><subsection eId="section-48-1"><num>(1)</num><content><p>Sections 2, 32(2) and 35 shall come into force at the end of the period of two months beginning with the date on which this Act is passed.</p></content></subsection><subsection eId="section-48-2"><num>(2)</num><content><p>Section 32(1) shall have effect in relation to determinations of the Special Immigration Appeals Commission made after the end of the period of two months beginning with the date on which this Act is passed.</p></content></subsection><subsection eId="section-48-3"><num>(3)</num><intro><p>The other preceding provisions of this Act shall come into force in accordance with provision made—</p></intro><level class="para1" eId="section-48-3-a"><num>(a)</num><content><p>in the case of section 26 or Schedule 1 or 2, by order of the Lord Chancellor,</p></content></level><level class="para1" eId="section-48-3-b"><num>(b)</num><content><p>in the case of sections 4 and 5 in so far as they extend to Scotland, by order of the Scottish Ministers, and</p></content></level><level class="para1" eId="section-48-3-c"><num>(c)</num><content><p>in any other case, by order of the Secretary of State.</p></content></level></subsection><subsection eId="section-48-4"><num>(4)</num><intro><p>An order under subsection (3)—</p></intro><level class="para1" eId="section-48-4-a"><num>(a)</num><content><p>may make transitional or incidental provision,</p></content></level><level class="para1" eId="section-48-4-b"><num>(b)</num><content><p>may make different provision for different purposes, and</p></content></level><level class="para1" eId="section-48-4-c"><num>(c)</num><content><p>shall be made by statutory instrument.</p></content></level></subsection><subsection eId="section-48-5"><num>(5)</num><intro><p>Transitional provision under subsection (4)(a) in relation to the commencement of section 26 may, in particular, make provision in relation to proceedings which, immediately before commencement—</p></intro><level class="para1" eId="section-48-5-a"><num>(a)</num><content><p>are awaiting determination by an adjudicator appointed, or treated as if appointed, under section 81 of the Nationality, Immigration and Asylum Act 2002 (c. 41),</p></content></level><level class="para1" eId="section-48-5-b"><num>(b)</num><content><p>are awaiting determination by the Immigration Appeal Tribunal,</p></content></level><level class="para1" eId="section-48-5-c"><num>(c)</num><content><p>having been determined by an adjudicator could be brought before the Immigration Appeal Tribunal,</p></content></level><level class="para1" eId="section-48-5-d"><num>(d)</num><content><p>are awaiting the determination of a further appeal brought in accordance with section 103 of that Act,</p></content></level><level class="para1" eId="section-48-5-e"><num>(e)</num><content><p>having been determined by the Immigration Appeal Tribunal could be brought before another court by way of further appeal under that section,</p></content></level><level class="para1" eId="section-48-5-f"><num>(f)</num><content><p>are or could be made the subject of an application under section 101 of that Act (review of decision on permission to appeal to Tribunal), or</p></content></level><level class="para1" eId="section-48-5-g"><num>(g)</num><content><p>are or could be made the subject of another kind of application to the High Court or the Court of Session.</p></content></level></subsection><subsection eId="section-48-6"><num>(6)</num><intro><p>Provision made under subsection (5) may, in particular—</p></intro><level class="para1" eId="section-48-6-a"><num>(a)</num><content><p>provide for the institution or continuance of an appeal of a kind not generally available after the commencement of section 26,</p></content></level><level class="para1" eId="section-48-6-b"><num>(b)</num><content><p>provide for the termination of proceedings, or</p></content></level><level class="para1" eId="section-48-6-c"><num>(c)</num><content><p>make any other provision that the Lord Chancellor thinks appropriate.</p></content></level></subsection></section><section eId="section-49"><num>49</num><heading>Extent</heading><subsection eId="section-49-1"><num>(1)</num><intro><p>This Act extends (subject to subsection (2)) to—</p></intro><level class="para1" eId="section-49-1-a"><num>(a)</num><content><p>England and Wales,</p></content></level><level class="para1" eId="section-49-1-b"><num>(b)</num><content><p>Scotland, and</p></content></level><level Act has the same extent as the enactment, or as the relevant part of the enactment, amended (ignoring extent by virtue of an Order in Council).</p></content></subsection><subsection eId="section-49-3"><num>(3)</num><intro><p>Her Majesty may by Order in Council direct that a provision of this Act is to extend, with or without modification or adaptation, to—</p></intro><level class="para1" eId="section-49-3-a"><num>(a)</num><content><p>any of the Channel Islands;</p></content></level><level class="para1" eId="section-49-3-b"><num>(b)</num><content><p>the Isle of
