<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1"><num>1</num><heading>Authorisation of approvals given before this Act</heading><subsection eId="section-1-1"><num>(1)</num><content><p>Any person who before the day on which this Act is passed has done anything in the purported exercise of an approval function is to be treated for all purposes as having had the power to do so.</p></content></subsection><subsection eId="section-1-2"><num>(2)</num><intro><p>“<term refersTo="#term-approval-function" eId="term-approval-function">Approval function</term>” means—</p></intro><level class="para1" eId="section-1-2-a"><num>(a)</num><content><p>the function of giving an approval for the purposes of section 12 of the Mental Health Act 1983 (practitioners approved to give medical recommendations), or</p></content></level><level class="para1" eId="section-1-2-b"><num>(b)</num><content><p>the function of approving a person as an approved clinician for the purposes of that Act.</p></content></level></subsection></section>

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2"><num>2</num><heading>Commencement, extent and short title</heading><subsection eId="section-2-1"><num>(1)</num><content><p>This Act comes into force on the day on which it is passed.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><content><p>This Act extends to England and Wales, Scotland and Northern Ireland.</p></content></subsection><subsection eId="section-2-3"><num>(3)</num><content><p>This Act may be cited as the Mental Health (Approval Functions) Act 2012.</p></content></subsection></section>
