APPROVED by Decision No. 8 of the Supreme Eurasian Economic Council dated May 14, 2018 REGULATION on the Status of an Observer State at the Eurasian Economic Union 1. This Regulation has been developed in consideration of Article 109 of the Treaty on the Eurasian Economic Union dated May 29, 2014 (hereinafter referred to as the Treaty) and determines the procedure for granting States the status of an Observer State at the Eurasian Economic Union (hereinafter referred to as the Union). 2. A State interested in cooperation with the Union shall send through diplomatic channels to the Chairman of the Supreme Eurasian Economic Council (hereinafter referred to as the Supreme Council) a written application requesting to grant it the status of an Observer State at the Union (hereinafter referred to as the Applicant State) and expressing readiness to comply with the provisions of Article 109 of the Treaty. 3. The Union Member State being the chairman of the Supreme Council shall send the received application to the Eurasian Economic Commission (hereinafter referred to as the Commission) which shall immediately inform thereon the other Union Member States (hereinafter referred to as the Member State) through diplomatic channels and send them copies of this application. 4. The Member States shall, within 30 calendar days from the date of receipt of the information referred to in paragraph 3 hereof, submit to the Commission the information on their position on the issue of granting the Applicant State the status of an Observer State at the Union. The Commission shall, upon expiry of the said period, inform the Member States of the received positions within 5 calendar days and prepare in the established procedure the materials for the Supreme Council’s meeting on the issue of granting the Applicant State the status of an Observer State at the Union. 5. The decision on granting the Applicant State the status of an Observer State at the Union shall be taken by the Supreme Council. 6. Following the results of consideration by the Supreme Council of the issue on granting the status of an Observer State at the Union, the Commission shall, within 5 calendar days from the date of entry into force of the relevant decision, inform the Applicant State in writing through diplomatic channels about the decision taken.

The government of the State having obtained the status of an Observer State at the Union (hereinafter referred to as the Observer State) shall send a permanently authorized person to the Commission’s place of location for regular interaction with it and its bodies (hereinafter referred to as the Representative). 8. The powers of the Representative granted by the supreme executive authority of the Observer State shall be presented by the Representative to the Chairman of the Commission’s Board or shall be sent to the Commission through diplomatic channels. 9. The Representative shall facilitate the establishment and maintenance of regular contacts between the relevant executive authorities of the Observer State and the Commission on the issues of development of trade and economic interaction, technical, customs, sanitary and phytosanitary regulation and other issues within the Commission’s competence, and shall contribute to the dialogue and cooperation in the spheres of mutual interest to the Observer State and the Member States. 10. The Representative is entitled to form the Apparatus. The Representative and his Apparatus staff may be accredited in the State of the Commission’s location, including as part of the Observer State’s foreign mission to the State of the Commission’s location. 11. The Representative, his Apparatus staff and other representatives of the Observer State shall be entitled to participate by invitation in meetings of advisory bodies under the auspices of the Commission, as well as in meetings of the Commission’s Board and the Commission’s Council without the right to vote. Invitations shall be sent to the Observer State for all meetings, except for the meetings on the issues which are deemed closed at the request of a Member of the Commission’s Board and (or) a Member State. 12. The Heads of State and Government of the Observer State may attend by invitation the meetings of the Supreme Council and the Eurasian Intergovernmental Council in accordance with the procedures for holding such meetings. 13. The invitation for the Observer State to participate in a meeting of the Supreme Council or the Eurasian Intergovernmental Council shall be normally sent at least 15 calendar days before the date of the meeting. 14. All expenses related to ensuring the activities of the Representative, his Apparatus and other expenses related to sending other Observer State’s representatives to participate in the meetings of the Union governing bodies and advisory bodies under the auspices of the Commission’s Board shall be borne by the Observer State. 15. At the request of the Observer State, the Commission shall provide copies of acts of the Union governing bodies on the issues of interest to the Observer State, except for restricted documents (confidential documents and documents for official use only).

3 16. The Observer State must refrain from any actions that could prejudice the interests of the Union and its Member States, the object and purposes of the Treaty. 17. The Supreme Council may decide to revoke the status of an Observer State in the following cases: а) In case the Observer State has performed actions or made statements aimed against the interests of the Union and (or) its Member States; b) In case an application has been received from the Observer State on its refusal from the status of an Observer State.
