Micronésie

Declaration:

“The Government of the Federated States of Micronesia declares that its ratification of the Agreement shall in no way constitute a renunciation of any of its rights and entitlements under international law, particularly as reflected in the United Nations Convention on the Law of the Sea (“Convention”).
In this connection, recognizing that areas beyond national jurisdiction are the scope of application of the Agreement and acknowledging that the Agreement defines areas beyond national jurisdiction to comprise the high seas and the Area, the Government of the Federated States of Micronesia affirms that the Convention imposes no affirmative obligation to keep baselines and outer limits of maritime zones under review nor to update charts or lists of geographical coordinates once deposited with the Secretary-General of the United Nations; and proclaims that the maritime zones of the Federated States of Micronesia, as established and notified to the Secretary-General of the United Nations in accordance with the Convention, and the rights and entitlements that flow from them, shall continue to apply, without reduction, notwithstanding any physical changes connected to climate change-related sea-level rise.
The identification of areas beyond national jurisdiction for the purposes of interpreting and implementing the Agreement must therefore be fully in accordance with the declarations made above by the Government of the Federated States of Micronesia.”

Declaration:

“The Government of the Federated States of Micronesia declares its understanding that its ratification of the Paris Agreement does not constitute a renunciation of any rights of the Government of the Federated States of Micronesia under international law concerning State responsibility for the adverse effects of climate change, and that no provision in the Paris Agreement can be interpreted as derogating from principles of general international law or any claims or rights concerning compensation and liability due to the adverse effects of climate change; and
The Government of the Federated States of Micronesia further declares that, in light of the best available scientific information and assessments on climate change and its impacts, it considers the emission reduction obligations in the Paris Agreement to be inadequate to prevent a global temperature increase above 1.5 degrees Celsius relative to pre-industrial levels, and as a consequence, such emissions will have severe implications for the national interests of the Government of the Federated States of Micronesia.”

Declaration:

1. The Federated States of Micronesia declares in accordance with the provisions of article 25, paragraph 4 of the Stockholm Convention on Persistent Organic Pollutants, that any amendment to Annex A, B or C shall enter into force only upon the deposit of the Federated States of Micronesia's instrument of ratification, acceptance, approval or accession thereto.
2. The Federated States of Micronesia declares in accordance with Article 18, paragraph 2 of the Stockholm Convention on Persistent Organic Pollutants that it accepts both of the means of dispute settlement mentioned in this paragraph as compulsory in relation to any party accepting an obligation concerning one or both of these means of dispute settlement.

Reservation:

“In accordance with Article 15, paragraph 3, the Federated States of Micronesia declares that it does not consider itself bound by Article 15 paragraph 2 of the Protocol.”

Reservation:

"... with a reservation that the FSM Government shall not consider itself bound by article 35, paragraph 2, of the Convention; ..."

Declaration

“With regards to Article 3, paragraph 2, of the Optional Protocol, the Government of the Federated States of Micronesia declares that it currently has no national armed forces, and thus, a minimum age requirement for recruitment into its national armed forces is not applicable in the case of the Federated States of Micronesia. Similarly, it is not necessary for the Government of the Federated States of Micronesia to describe the safeguards that it has adopted to prevent any coerced recruitment of children into its armed forces.”

Reservations:

"1. The Government of the Federated States of Micronesia advises that it is not at present in a position to take the measures either required by Article 11 (1) (d) of the Convention to enact comparable worth legislation, or by Article 11 (2) (b) to enact maternity leave with pay or with comparable social benefits throughout the nation;
2. The Government of the Federated States of Micronesia, in its capacity as trustee of the heritage of diversity within its States under Article V of its Constitution, reserves the right not to apply the provisions of Articles 2 (f), 5, and 16 to the succession of certain well-established traditional titles, and to marital customs that divide tasks or decision-making in purely voluntary or consensual private conduct; and
3. The Government of the Federated States of Micronesia does not consider itself bound by the provisions of Article 29 (1) of the Convention, and takes the position that any dispute relating to the interpretation or application of the Convention may only be submitted to arbitration or to the International Court of Justice with the agreement of all parties to the dispute."
