It is outside Seventy-nine Embankment and in the tideland of East Sea where the Yangzte River enters. In the north, it is adjacent to Chaoyao Farm. And Dazhi River Mouth is 3.5 KM2 away in the south. All the areas are embanked tideland. SLDWDSP(phase I) was put into operation in 1990 with the burying area of about 1.5 km2. Phase II for expansion was completed at the end of 1993. Phase III has been completed in the early of 2000. Altogether, the burying area for the three phases is 3.2 km2. At present, SLDWDSP has the capacity of 7500 Ship Tonnage/day. According to the testing results of 2001, the conversion coefficient for Ship Tonnage to Actual Tonnage is 0.66, so the average capacity is 4900 actual tonnage/day. Therefore, SLDWDSP (phase III) can only be in operation until the end of 2003. However, according to Shanghai Solid Waste Treatment Development Planning (2001-2010), SLDWDSP, as a part of Shanghai Urban Waste Treatment Technical System, shall be in operation for more than 10 years. Meanwhile, according to Shanghai Nanhui Planning for Expediting Silt, the area extended 2.8 km from the outer embankment (length:4.2 km ) of SLDWDSP is reserved for treatment of waste. A reconnaissance at the end of 2000 shows that the contour line of 3.0-3.1 in the tideland is 800m away from the newest embankment and the embanked area can be utilized. The planned area for SLDWDSP(phase IV) is 336 Ha. The burying depth is 11.0 m( max: 15.0m). It may be in operation for 18 years based on capacity of 4900 tonnage/day. It is recommended that the total investment is RMB 973,389,000 yuan. 1.2 Brief Introduction of Project Area Shanghai is at North Latitude 31 14 and East Longitude 121-29.It is in the frontier of Yangzte River Delta. In the east, it is close to East Sea; in the south, it faces Hangzhou Bay. It is adjacent to Jiangsu and Zhejiang Provinces in the west. It is also where Yangzte Rive enters the sea. Shanghai is in the middle of China shoreline from North to South. It enjoys geographical advantage with convenient transport, large hinterland and a good harbor. Besides few hills and mountains in the southwest, Shanghai is a flat plain with the average height above sea level of 4 m. 2000, the total area of Shanghai is 6340.5 km2, accounting for 0.06% of China. The length from south to north is about 120 km and that from east to west is lOOkm. Of all the area, the urban area is 3924.24 km2, the county area 2416.26 km2, the land area 6219 k1m2, the water area 122 km2. 2 Shanghai has Chongming Island, the third largest one in China with the area of 1041 km2. The population of Shanghai is growing. In 1949, the population of Shanghai is only 5200000. At the end of 2000, the population of registered residents reached 13216300, which was 2.5 times of the population before liberation and made up 1% of the total of China. In 2000, the average density is 2084 persons/km2. The density of the urban area is 2897. According to the fifth universal population survey, its population is 16740000. By the end of 2000, Shanghai has had 7452400 employees. 26.7% of them are in state owned enterprises, 4.2% in collective enterprises, 7.8% in private enterprises, 27.1% in other enterprises and 34.2% engaged in agriculture. In 2000, 427800 persons in urban area are replaced with jobs and registered unemployed workers is 200800. The unemployment rate in towns are 3.5%. Sticking to the principle of giving priority to the third industry, restructuring and optimizing the second industry and stabilizing the first industry, vigorously promoting the development of key industries of finance, commerce and information, great changes have been achieved in adjusting industry structure. In 2000, the output value of the third industy added by 228.26 billion yuan. Based on comparable price, the value is two times of that of 1995. The average annual growth in Ninth-five-year is 15.1%, 3.7% higher than the annual growth of GDP at the same period. 3 The output' of the third industry accounts for more than 50% in GDP for the first time. The percentage of the three industries of 1995 was 2.5:57.3:40.2. In 2000, it is 1.8:48:50.2. Since the open up policies, the economy of Shanghai has been growing faster and comprehensive economy has greatly increased. In 2000, GDP of Shanghai is 455.115 billion yuan, 65.3 times of that of 1952 with average annual growth of 9.1%;. It is 6.5 times of that of 1978 with average annual growth of 9.6%. In 1990s, Shanghai seized the historical opportunity of opening Pudong to deepen reform, expand open up and vigorously renovate. The economy continuously grows very fast. The growth rate of GDP has been more than 10% for nine years. In particular, the rate is 11.4% during "Ninth Five Year". 1.3 Approval of the Project This project is applied by Shanghai Urban Environment Sanitation Administration Bureau to Shanghai Planning Committee for approval. 1.4 Design of the Project In December, 2001, Shanghai Municipal Project Design Institution together with Shanghai Environment Project Design Institution complied Feasibility Study Report for Laogang Daily Waste Disposal Site Project (Phase IV). 4 1.5 Project Ownership and Organization It is a project for public welfare and Shanghai People's Government is responsible for the investment. The total investment is composed of two parts, loan from World Bank and domestic capital. The total investment is RMB 973,389,000 yuan. During the implementation of the project, Shanghai Construction Committee(SCC), Shanghai Planning Committee(SPC), Shanghai Construction Office for Important Project (SCOIP), Shanghai Urban Planning Administration Bureau(SUPAB), Shanghai Housing Land Administration Bureau(SHLAB), Shanghai Urban Environment Sanitation Administration Bureau (SUESAB), Beachland Administration Section of Shanghai Water Bureau(BLASSWB), Shanghai Beach Reclaiming Company Ltd.(SBRCL), Shanghai Waste Disposal Site, Laogang Branch (SWDS,LB) will be in involved. 2 Project Impacts and Aims 2.1 Project Impacts "Affected Persons" means persons who on account of the execution of the Project had or would have their:(a) Standards of living adversely affected; (b)right, title or interest in any house, land (including premises, agricultural and grazing land) or any other fixed or movable asset acquired or possessed, temporarily or permanently; or (c)business, occupation, work or place of residence or habit adversely affected, and "Affected Person" means any of the Affected Persons. Shanghai Laogang Daily Waste Disposal Site is located in Nanhui County, Shanghai, along the shore of East Sea, between the outlet of Changjiang River and Hangzhou Bay. It was constructed by building embankments on growing shallow tide zone. Currently, the area is 4.1 km'. The construction began in 1985. The overall investment of the first, second and third phases is RMB320 million yuan. About 70% of the daily solid waste in Shanghai is treated here. Laogang also gives full consideration in pollution control and ecological environmental protection and has taken effective measures. Through afforestation, Laogang Disposal Site is approaching to an ecological sanitary landfill 6 site without pollution. Three phases for Laogang Dialy Waste Disposal Site Project have been completed and are in use at present. It undertakes the task of treating 70% of waste in Shanghai. Laogang Daily Waste Disposal Site Project (phase IV) is a reserved place (800m*4200m) east of phase III. It occupies 346 ha with the average depth of 11 .Om(max: 1 5.0m) and can be in operation for 18 years. Obtaining the land use right for Langang Daily Waste Disposal Site Project (phase IV) is a part of project. Before getting the land use right, Section for Solid Waste Management, Shanghai Urban Environment Office for Project Aided by World Bank shall pay land assignment fees to Shanghai Beach Reclaiming Company Ltd. 2.2 Aims of Resettlement The aims are: * To optimize the design and keep the project away from area with much population, multi-storey high buildings, to reduce quantity of demolition as much as possible, and to minimize the involuntary resettlement; for multi-storey high-buildings which have to be impacted, pipelines will run under them to reduce the number of people affected; * To carry out involuntary resettlement as a component of the 7 project, to provide adequate funds for PAPs and to ensure that they can benefit from the project; * To pay the PAPs all the compensation fees before they move out; * To give help to PAPs when they move out and to ensure that they can get help in resettlement area; * To ensure PAPs socially and economically integrate with the residents in resettlement area; * To improve the living environment, to well equip the area and make it a sub-district with convenient transportation and beautiful environment; * To minimize the loss of enterprises and institutions caused by land acquisition and demolition. If demolition is inevitable, they will be compensated for the loss of suspense of business and production. What's more, they will be resettled properly and get help to restore the business or production as soon as possible. * To encourage PAPs to take part in compilation of RAP and resettlement. And their opinions will be taken into consideration. * To improve PAPs living standards or at least restore their former living standards. 3 Social and Economic Survey 3.1 The Process of Social and Economic Survey The aim of is to collect data on all the affected materials and quality indexes. Therefore, data can be provided for calculating the requisition, evaluating social and economic impacts, predicting project scale, compiling budget, monitoring and evaluating implementation of resettlement. In November 2001, a group of people from Shanghai Bohong Project Construction Company Ltd carried out social and economic survey in project affected area. In January 2002, the people from Shanghai Bohong Project Construction Company Ltd visited Huang Renhua, the vice Director of Shanghai Daily Waste Disposal Site, Laogang Branch, Zhu Xianwei, the Section Chief of Tideland Management Section, Shanghai Water Bureau, Zhou Jinde, the Senior Engineer of Tideland Management Section, Shanghai Water Bureau, Zhou Yusheng, General Engineer of Shanghai Beach Reclaiming Company. 3.2 Regulations for Land Use Right and Transfer According to People's Republic of China Land Administration Law, 9 tideland belongs to People's Republic of China. Tideland Section of Shanghai Water Bureau administrates the tideland resource on behalf of People's Republic of China. Shanghai Beach Reclaiming Company has legally obtained the right to develop tideland resource. After building, Shanghai Housing Land Administration has issued Land Use Right Certificate. Legal transfer procedures shall be gone through when the land is needed for other purposes. 10 4 Legal Framework 4.1 Relative Articles of Land Administration Laws of People's Republic of China Land of People's Republic of China(PRC) belongs to the public, that is owned by the public and collective. Land owned by public means that State Department on behalf of PRC has the ownership. No one shall invade and occupy, buy/sell any land. Any illegal land transfer is also forbidden. The land use right can be transferred legally. Conforming both the ownership and use right of woodland/grass land, and the right of aquatic breeding and use shall be based on Forest Administration Law of PRC, Grassland Administration Law of PRC and Fishery Administration Law of PRC. Land Administration Law of the People's Republic of China (which has come into force since January 1,1999. Similarly hereinafter) states that all units and individuals that need land for construction purposes shall in accordance with law apply for the use of state owned land. Article 44: Where land for agriculture is to be used for construction purposes, the formalities of examination and approval shall be gone through for the conversion of use. Where land for agriculture is to be converted to land for the construction of road, pipeline or large infrastructure projects, for which approval has been obtained from people's governments of provinces, autonomous regions and municipalities directly under the Central Government, or for the construction of projects, for which approval has been obtained from the State Council, the conversion shall be subject to approval by the State Council. Where land for agriculture is to be converted to land for construction of projects in different periods in order to carry out the overall plan for land utilization within the limits of the amount of land fixed in the plan for the construction of cities, villages or towns, the conversion of use of land shall, in accordance with the annual plan for land utilization, be subject to approval in batches by the organ that originally approved the use of land for construction of specific projects within the limits of the amount of land for agriculture, conversion of the use of which has been approved, may be form people's governments of cities or counties. Article 45 Approval shall be obtained from the State Council for requisition of the following land: (1) capital farm land; (2) cultivated land, not included in capital farm land, that exceeds 35 hectares; and 12 other land that exceeds 70 hectares. Article 47 Land requisitioned shall be compensated for on the basis of its original purpose of use. Compensation for requisitioned cultivated land shall include compensation for land, resettlement subsidies and attachments and young crops on the requisitioned land. Compensation for requisition of cultivated land shall be six to ten times the average annual output value of the requisitioned land for three years preceding such requisition. Resettlement subsidies for requisition of cultivated land shall be calculated according to the agricultural population needing to be resettled. The agricultural population needing to be resettled shall be calculated by dividing the amount of requisitioned cultivated land by the average amount of the original cultivated land per person of the unit the land of which is requisitioned. The standard resettlement subsidies to be divided among members of the agricultural population needing resettlement shall be four to six times the average annual output value of the requisitioned cultivated land for three years preceding such requisition. However, the highest resettlement subsidies for each hectare of the requisitioned cultivated land shall not exceed fifteen times its average annual output value for the three years preceding such requisition. If land compensation and resettlement subsidies paid in accordance 13 with the provisions of the second paragraph of this Article are still insufficient to help the peasants needing resettlement to maintain their original living standards, the resettlement subsidies may be increased upon approval by people's governments of provinces, autonomous regions and municipalities directly under the Central Government. However, the total land compensation and resettlement subsidies shall not exceed 30 times the average annual output value of the requisitioned land for the three years preceding such requisition. Article 58 Under any of the following circumstances, the administration department of the people's government concerned may, with the approval of the people's government that has originally approved the use of land or that possesses the approval authority, take back the right or the use of the State-owned land: (1) The land is needed for the benefits of the publics; (2) The use of the land needs to be readjusted for renovating the old urban area according to urban planning; Article 66 Land Administration department of the people's government at or above the county level shall supervise over and inspect violations of laws and regulations governing land administration. Supervisors over and inspectors of land administration shall be familiar 14 with the laws and regulations governing land administration and they shall be devoted to their duties and enforce laws impartially. Article 70 Where, in the course of supervision and inspection, land administration departments of the people's government at or above the county level find any violations by State functionaries and believe that administrative sanctions need be given to such functionaries, they shall deal with such violation in accordance with law; if they have no right to do so, they shall propose in writing to the administrative supervision departments of the people's governments at the corresponding or a higher level that administrative sanctions be given to the functionaries, and the administrative supervision departments concerned shall deal with the violations in accordance with law. Article 79 Whoever embezzles or misappropriates the compensation or other relevant charges paid to a unit whose land is requisitioned, if the violation constitutes a crime, shall be investigated for criminal responsibility in accordance with law; if the violation is not serious enough to constitute a crime, he shall be given administrative sanctions in accordance with law. 15 4.2 Enforcement Regulations of Land Administration Law of PRC All the following land is owned by the public, that is state-owned land. 1. land in urban area 2. confiscated land, requisitioned land, land requisitioned by purchase in countries and rural areas. 3. Land requisitioned legally by the State. 4. The woodland, grassland, wasteland, tideland and other land that does not legally belong to collective. 4.3 Urban Real Estate Administration Law of PRC Main provisions of P.R.C Urban Estate Administration Laws are as follows: Allocation of land use right means that approved by the government over country level, after the land users have paid compensation, relocation costs etc., they can use the land, or they can get the land use right free of charge. If the land use of the following land for construction is really necessary, it can be approved and allocated by the government over country level: land for urban infrastructure and public utilities, land for energy, transport, water conservancy etc, project which are the state key projects. 16 4.4 Notices from Water Department and State Land Administration on Confirming Land Ownership in Water Conservancy Project New land gained in building reservoir and dredging watercourse belongs to the State. After being used for resettlement, watercourse administration and dredging by people's government above county level, all of the rest land shall be developed and used by people's government above county level. Water departments have priority of using the land. 4.5 Suggestions on Using Tideland After Payment by Shanghai Government 1. going through procedures Any one who makes use of tideland in administrative area for the purposes of production, business and other activities shall apply to Shanghai Water Bureau. After approval and payment, Permit of Developing Tideland(PDT) is to be issued. With the PDT, further procedures for using land may be gone through with Land Administration Bureau in towns/districts. Permit of Land for Construction may also be applied for. Those built tideland shall be inspected by Tideland Administration Department. Persons concerned shall apply to Land Administration Department for Permit of State-owned Land Use Right with Permit of Developing Tideland and Certificate of Inspection. 17 2. Compensation Rate (1) If tideland is enclosed or facilities are built permanently, fees shall be paid in a lump sum. Details of rates are as follows: Compensation Rate s(Yuan/MZ) Project Tideland Connected Tideland In Island With Mainland Tourism, Real Estate, 15-20 10-15 Commerce l___8 Industry, Transportation, 10-14 5-8 And Others l (2) If tideland is not enclosed and production is done on it, annual fees shall be paid. Details of rates are as follows. Item Annual Rate(yuan/m2) Tideland Connected With Mainland 0.50-0.80 Tideland In Island 0.30-0.50 3. Payment (1) If the fees shall be paid in a lump sum, the units concerned shall pay it when they apply for Permit of Developing Tideland. (2) If the fees are paid annually, the units concerned shall pay it to Water Administrative Department of county/district level before the end of November of every year after they get Permit of Developing Tideland. If they don't pay it in time, late fees of 5%o per day shall be paid. If they still have not paid all the fees until 18 the deadline of the next year, Tideland Administration Department may revoke its Permit of Developing Tideland and punish them. At the end of each year, Water Administrative Department in towns/districts shall hand in all the fees to Water Administrative Department at city level. (3) If tideland is enclosed for public benefits, fees may be reduced after approval of Shanghai Water Department. (4) During the development of tideland, if the scope or the purpose is changed, procedures shall be gone through with Tideland Administration Department and rates shall also be changed. 4.6 Sea Embankment Administration Regulations of Shanghai 1. Where the regulations may be applied The regulations applies to embankment construction, annual repair, protection and other actives. Sea embankment is the embankments(including the building stuff) at the Yangzte River Mouth, East Sea, sea coast of Hangzhou Bay, and around island. It also includes protection of tideland and bank, expediting silt. The protection area for embankment with rivers refers to the body, area from the slope foot outside the embankment to the tideland 20m away and from the slope foot inside the embankment to the protection bank at the edge of rivers. Protection area for embankment without rivers refers to the body, the area from slope foot 19 outside the embankment to the tideland 20m away and from slope foot inside to tideland 20m away. The area for protection of tideland and bank, expediting silt is to be decided by approved documents on design. All the area hereafter refers to sea embankment area. 2. Administration Department Shanghai Water Bureau (SWB) is the administrative department, Water Bureau at district/county level is responsible for management of sea embankment in its own administrative area. 3.Management Principle The construction, annual repair and protection of sea embankment is under general management but classified charge. 4. Sea Embankment Planning The planning is compiled by Shanghai Water Department together with other related departments. After inspection of Administrative Department of Planning, it is to be put into General Planning. Then it is to be submitted to People's Government for approval and implementation. 5. Use of Sea Embankments at Public Banks If these embankments are needed, the units concerned shall apply to Water Bureau in their 20 own counties/districts. After inspection, the application is to be submitted to Shanghai Water Bureau for approval. The units shall compensate for the afforestation, crops against wave, road on the top of embankment. Since the date of approval, the public embankment will become a specialized one. The units shall undertake the construction, annual repair and protection. 6. Management of Newly-built Embankment If the embankments newly built by units/individuals outside sea embankments are required to be under general administration of Shanghai, they shall:(1) meet the standards of flood prevention; (2) prevent flood for 3 years continuously. The construction units of the newly built embankments shall apply to Water Bureau in their counties/districts with relevant documents and data. After inspection and approval from Water Bureau and authorization from Shanghai Water Bureau and Headquauters of Flood Prevention, the newly built embankment may be under the general management. Later, the construction units shall file with Water Bureau in their counties/districts the data on design and technology. 7. Confirming the Land Use Right The procedures of the use right of land of embankment along public banks shall be gone through with 21 Water Bureau in counties/districts where the land is in based on regulations of China and Shanghai. 4.7 Shanghai Tideland Management Regulations 1. This regulation may be applied to tideland at the mouth of Yangzte River, East Sea, Hangzhou Bay and around island in the administrative area except harbors which also ready exist and are planned by the State and Shanghai. Development of tideland in this regulation means building, enclosing, utilizing and protecting tideland. 2. Tideland in Shanghai belongs to People's Republic of China. No one can occupy the tideland illegally. 3. Development of tideland shall meet the needs of urban construction and bases on the principles of general planning and rational development. One shall pay for it if he wants to use the tideland. Investors both at home and abroad are encouraged to develop tideland. Those who invests will get benefits. Shanghai Government is to protect the legal interests of those who develop the tideland. 4. The Municipal Government, People's . Government at county/district level along the sea shall make general planning, enhance management and take effective action to promote tideland 22 development. 5. Shanghai Water Bureau is the administrative department and in charge of implementation of the regulation. Shanghai Tideland Administration Department is responsible for the management. Water Administrative Department of each county near sea/Yangzte River are under the leadership of Shanghai Water Bureau and in charge of the management of developing tideland in their own area. The departments of urban planning, housing land, harbor, sea-route, sea supervision, sea, environment protection, finance, price, agriculture, fishery shall be responsible for their own business and make contribution to the implementation of this regulation. 6. The general development planning of tideland is compiled by Shanghai Water Bureau together with other related departments. After inspection by Urban Planning Management Department, the planning is to be put into urban planning and is to be implemented after approval by People's Government. The development of tideland shall go with the planning of sea course, harbors, environment protection, utilization of land and sea development. The planning enclosed line of tideland shall not exceed the planning line of revetment. 7. The implementation of reclaiming tideland shall go with the general planning of developing tideland, control of Yangzte River 23 and Hangzhou Bay. 8. People's Government at city, county and district level shall collect capital for development of tideland in many ways. And the capital mainly comes from: (1) funds for reclamation (2) charges of using tideland (3) finance allocation from the State and Shanghai Government (4) investment both at home and abroad 9. Requirements of developing tideland are as follows: (1) be conform to the general development planning of tideland (2) tideland is stable or the tidal flat zone is growing (3) has no negative impacts on surrounding ecological environment, aquatic product resource, sea course, and flood prevention facilities. 10. Tideland shall be developed with Permit. If the development project area is not more than 80 ha, the concerned unit shall apply to Water Administrative Department of the county/district where the tideland belongs to. If more than 80 ha, the unit shall apply to Tideland Administration Section of Shanghai Water Bureau. In the application, purpose and scope of the project,, in which way to. develop, and its duration shall be stated clearly. 11. After receiving application, the department in charge shall give 24 suggestions on initial examination within 15 days. Shanghai Water Bureau shall give decision of approval within 30 days after it receives the suggestion on initial examination. Before it makes the decision, it shall ask related departments at city level for suggestions. If the project is submitted to Tideland Administration Section for examination, Shanghai Water Bureau shall ask Water Administration Department at county/district level for suggestion before making decisions. Shanghai Water Bureau shall issue Permit of Developing Tideland to those approved development project for confirming its land use right. It shall also explain in written form to units whose application are refused. 12. If the units/individuals with the Permit of Developing Tideland need to change the purpose, scope, its duration and so on, they shall go through procedures of changing which are the same as those of application. If they transfer the land use right, procedures of application shall be gone through again for approval. 13. Enclosed tideland belongs to people's Republic of China. When it is finished and inspected, the unit/individual with the Certificate of Inspection and Permit of Developing Tideland shall apply to Housing Land Administration Bureau at city, county or district level for Land Use Right of State Owned Land. The Housing Land Administration Bureau shall manage based on land administration 25 regulations of the State and Shanghai. 14. The units/individuals with Permit of Developing Tideland have the following rights: (1) After enclosing, they may legally get Land Use Right. During its legal term, the land may be transferred, leased, mortgaged. It may also be used for other legal activities. Their legal rights are protected. (2) If the tideland is enclosed for agricultural production and other construction for supporting facilities, Shanghai Water Bureau together with related departments will give support in financial ways. (3) If the tideland is enclosed for agricultural production, agricultural tax may exempted during certain years according regulations of the State. For example, realignment of roads or reductions in dam height may significantly reduce resettlement needs. 2.Where displacement is unavoidable, resettlement plans should be developed. All involuntary resettlement should be conceived and executed as development programs, with resettlers provided sufficient investment resources and opportunities to share in project benefits. Displaced persons should be (i) compensated for their losses at full replacement cost prior to the actual move; (ii) assisted with the move and supported during the transition period in the resettlement site; and (iii) assisted in their effort to improve their former living standard, income earning capacity, and production levels, or at least to restore them. Particular attention should be paid to the needs of the poorest group to be resettled. 3.Community participation in planning and implementing resettlement should be encouraged. Appropriate patterns of social organization should be established, and existing social and cultural institutions of resettlers and their hosts should be supported and used to the greatest extent possible. 28 4.Resettlers should be integrated socially and economically into host communities so that adverse impacts on host communities are minimized. The best way of achieving this integration is for resettlement to be planed in areas benefiting form the project and through consultation with the future hosts. 5. The absence of legal title to land, structures, or other affected assets should not be a bar to compensation or other formns of assistance. 4.10 Resettlement Policies of the Project All the resettlement policies carried out in this project are under resettlement policies of P.R.C and Shanghai People's Government and of the World Bank. Developing and making proper use of beachland is very important. It can reduce the pressure of lack of land and ensure the continuos and stable development of agricultural production. It will also enhance the agricultural aftereffect, prosper Shanghai market, help the govemment in readjusting industrial structure, promote increase of industrial output, stabilize the situation of Yangzte River Mouth, improve the shipping conditions, optimize ecological environment. All the social, economic and ecological benefits are very obvious. In 1999, Shanghai Beach Reclaiming Company obtained Permit of Developing Beachland in east beach in Nanhui district. The document for approval is Hushuili(1999)269 with the area of 49394 mu(3293 ha). Laogang Daily Waste Disposal Site Project(phase IV) is in it. 35 6.2 Summary of Shanghai Municipal Special Meeting On The Use Of Beachland In The East Of Laogang Daily Waste Disposal Site Project (September,1995) In the morning of February 14,1995, Shanghai People's Government held a special meeting to discuss enclosing beach land outside Laogang Daily Waste Disposal Site for cultivation. Related staff from SCC, SUESAB, SPC, Shanghai Water Bureau, Shanghai Environment Protection Bureau, People's Government of Nanhui District took part in the meeting. After discussion, the following items are decided. * Beach land outside Laogang Daily Waste Disposal Site Project in the east has been planned as waste Disposal Site for expansion. After enclosing, nobody can use it without permission. * Taken the continuity of the project into consideration, Nanhui Government implemented the enclosing of beach land outside Laogang Daily Waste Disposal Site in the east. Nanhui Government and the implementing unit shall enclose the beach land and ensure its quality according to planning standards and construction requirements on waste Disposal Site from Shanghai Urban Environment Sanitation Administration Bureau. * Shanghai Urban Environment Sanitation Administration Bureau compensates the unit implementing enclosing for the land which belongs to Shanghai Waste Disposal Site, Laogang Branch for 36 young crops, cost of enclosing, management fees and the one-year interest for capital invested. 6.3 Obtaining the Land Use Right Laogang Daily Waste Disposal Site Project (phase IV) According to summary of Shanghai municipal special meeting on the use of beach land in the east of Laogang Daily Waste Disposal Site Project (september,1995), the place of Laogang Daily Waste Disposal Site Project (Phase IV) is reserved during urban planning. Shanghai Urban Environment Sanitation Administration Bureau pays Land Assignment fees to Shanghai Beach Reclaiming Company and goes through procedures of land transfer with it. The rate for land assignment fees, according to summary of special meeting includes compensation for young crops, cost of enclosing, management fees and the one-year interest for capital invested. 6.4 Rate of Land Assignment Fees According to surveys, the cost of building beach land (including cost of enclosing, management fees and one-year interest for capital invested) is 30000 yuan/mu(equals 450000 yuan/ha). Compensation rate for young crops (bulrush) is 800 yuan/mu( 12000 yuan/ha). Altogether, the compensation rate is 462000 yuan/ha. The actual compensation rate shall 37 be negotiated by Shanghai Urban Environment Sanitation Administration Bureau and Shanghai Beach Reclaiming Company. The details of compensation rate are in Table 6-1. During the resettlement policy developing, planning compiling and implementation phase of the project, the opinions of PAPs are collected widely. From November 2001 to January 2002, Shanghai Bohong Project Construction Company Ltd. organized 10 workers to conduct property survey within the scope of land acquisition and house demolition. The representatives of PAPs also took part in it. The local government and enterprises were invited to negotiate on the land requisition and compensation rates. Meanwhile, a socioeconomic survey and a psychological investigation were carried out. All the work laid a good foundation for RAP. Later, the following ways will be taken continuously to encourage 39 public participation and negotiation. (1) PAU Representatives Taking Part in Relocation The units which implements the resettlement will solicit opinions and collect rationalization proposals from PAUs. In addition to these, they will regularly exchange views with PAPs. (2)Negotiating with PAPs, Affected Shops, Enterprises, and Institutions about Compensation Ways The affected enterprises and institutions will rebuild their houses after getting the compensation fees. (3) Information and Discussion Meeting Representatives from project affected enterprises and people concerned (women should be more than 30% of all representatives) are organized to take part in discussion meetings six months before land acquisition and demolition. The meeting will inform them about the process and further obtain their opinions and suggestions. 40 (4) Public Gathering Meetings The meetings are held 3 months before land acquisition and demolition, mainly to explain relevant policies, laws and regulations, compensation rates, etc. Thus, PAPs can prepare for the resettlement earlier. (5) Propaganda through media (6) Making a Land Acquisition and House Demolition Announcement The main contents are: brief introduction of the project, the demolition scope, resettlement policies(including compensation rate), organizations responsible for resettlement, scheme of resettlement, rights and obligations of PAPs, grievance and appeals, monitoring and evaluation etc. (7) Placing the RAP reviewed by the World Bank in Shanghai Urban Environment Sanitation Administration Bureau before the World Bank Appraise the Project and propagating the Notice so that PAPs and Non governmental Organizations can look it up. 41 During the transfer of land use right, Shanghai Urban Environment Sanitation Administration Bureau and Shanghai Beach Reclaiming Company will have sufficient negotiations. If there are 44 problems in land transfer between Shanghai Urban Environment Sanitation Administration Bureau and Shanghai Beach Reclaiming Company, they can appeal to Shanghai Housing Land Administration Bureau and ask for arbitration. And Shanghai Housing Land Administration Bureau shall make the decision within 10 days. The project pays special attention to the PAPs participation throughout the planning and implementation process. The procedures are as follows. Stage 1: If any PAP or PAU is aggrieved by any aspect of the resettlement and rehabilitation program, he / she/it can lodge an oral or written grievance with institutions responsible for implementation directly. Those departments shall resolve the issue within two weeks. If there are problems on the nature of use right and land area, Shanghai Urban Planning Department and shanghai Real Estate Administration Department shall solve them according to their own responsibilities within 10 days after receiving the application. Stage 2: If the aggrieved person (unit) is not satisfied with the decision on stage 1, he/ she /it can bring the complaint to the attention Shanghai Urban Environment Sanitation Administration Bureau. After the receipt of the decision on Stage 1. Shanghai Urban Environment Sanitation Administration Bureau will make a decision on the complaint within two weeks. Stage 3: 45 If the aggrieved person (unit) is not satisfied with the decision on stage 2, he/ she /it can appeal to Shanghai Housing Land Resource Administration Bureau for administrative arbitration after he receives the decision on Stage 2. The institution for administrative arbitration will reach a decision on the complaint within 10 days. Stage 4: If the PAP or PAU is still dissatisfied with the decision, he /she /it can appeal to the People's Court in accordance with Civil Procedure Act after receiving the decision of the institution for administrative arbitration. PAP or PAU can make an appeal for any aspect of the resettlement and rehabilitation program. Procedures for redress of grievances and the appeal process in detail are publicized among the PAPs and PAUs during participation meetings and other ways. 46 8 Implementation Schedule According to implementation schedule, the project will be constructed from July 2002 to July 2004 in several stages. Land requisition will go with the project construction plan. It is to start in July 2002 and end in December 2002. 8.1 Resettlement Goes With the Project Construction The principles of connecting the project construction with the land acquisition, and resettlement are as the following: * To finish the work of planning, land acquisition and relocation one month before project begins. The time to start will be decided according to land acquisition, relocation, resettlement and rehabilitation. * To reserve enough time for the land acquisition, relocation, resettlement and rehabilitation before the start of the project construction. 8.2 Implementation Schedule of Resettlement. 8.2.1 The principles for making schedule of acquisition and resettlement * To determine the final scope of land acquisition according to every project design drawing, and to finish the determination before the 47 census and property survey for the land acquisition. * To calculate the result of census and property survey for the land acquisition according to the red line drawings of land acquisition and relocation. It will be done by Shanghai Urban Environment Sanitation Administration Bureau and the owners before the agreements for compensation and resettlement are signed. * To have a mobilization meeting, which should be presided over by Shanghai Urban Environment Sanitation Administration Bureau. It should promulgate the policies and ways of land acquisition, relocation, compensation, and resettlement methods. PAPs and PAUs should attend the mobilization meeting. The meeting will be held before they sign the agreements for compensation and resettlement. And formal announcements of land acquisition and relocation will be released after the mobilization meeting. * To sign the agreements of compensation and resettlement after the census and property survey and the release of the formal announcement of land acquisition and relocation. * To dispense transition funds to residents during their transitional period. And it should be dealt out before they start to move. 8.2.2 Overall Plan of Land Acquisition and Resettlement The overall plan of the project is fixed in light of the schedule of the 48 land acquisition, preparation for and progress of the resettlement, and the project construction. Details are in Table 8-1. According to the schedule, the capital can be divided into two parts: national debt and financial allocated funds. There are two kinds of monitoring and evaluating: internal and exterior. Internal monitoring and evaluating is to be carried out by SCOIP, SUESAB, SWMSSUEPO, SBRCL to ensure land requisition meets the project construction requirements. Every six months, SWMSSUEPO will compile Internal Monitoring And Evaluating Report For Shanghai Laogang Daily Waste Disposal Site Project (Phase IV) and submit it to World Bank. Independent monitoring and evaluating means carrying out regular independent monitoring and evaluating during land transfer. The external independent monitoring and evaluating includes rates for land assignment fee, payment of land assignment fees, land transfer contract, whether land requisition can meet the requirements of project. Suggestions will be given for problems in the monitoring so that all the. problems may be solved. SWMSSUEPO entrusts will entrust a qualified Institution to carry out independent monitoring and evaluating. 52 The independent monitoring and evaluating group will monitor and evaluate the implementation regularly, and trace on land transfer process. Altogether, there are three monitoring with two reports. In January, 2002, the first monitoring and evaluating is to be carried out (baseline survey); December 12, 2002, the second monitoring and evaluating report is to be submitted; In June, 2003, the third monitoring and evaluating report is to be submitted. Internal monitoring is carried out by Shanghai Construction Office of Important Project, Shanghai Urban Environment Sanitation Administration Bureau and SWMSSUEPO to ensure that units follow the schedule and abide by the principles of RAP. The purpose of this internal monitoring is to maintain responsibilities of resettlement implementation institutions during the implementation. Independent Monitoring Organization is mainly responsible for regularly independent monitoring and evaluation on activities of land acquisition, house demolition and resettlement. * The function of resettlement network * The implementation of land acquisition, rehabilitation and compensation * Dispense of fees for land requisition, progress of resettlement * The recovery of PAPs, affected shops, enterprises and institution 53 * Survey on and analysis of the PAPs living standards The purpose of independent monitoring is to provide an evaluation of resettlement by an organization independent to the institutions for the project demolition, and to review the overall implementation from a broader, long-term point of view. Independent monitoring institution follows the resettlement activities to evaluate whether the goals of resettlement are achieved through observing <1> laws of P.R.C. and Shanghai concerned on resettlement; <2> compliance with the principles of the World Bank's Operational Directive O.D. 4.12 on resettlement; and <3>an improvement in the standards of living of the PAPs or at least maintenance of the former living standards. The Independent Monitoring Institution provides suggestions to the units in charge of demolition implementation, so that the problems encountered in the implementation can be resolved in time. 10.2 Internal Monitoring and Supervision Shanghai Urban Environment Sanitation Administration Bureau has developed an internal monitoring framework to supervise the resettlement activities. It establishes relevant databank on land acquisition, house demolition and resettlement. And the databank contributes to compiling 54 the resettlement planning, and carrying out internal monitoring on the whole implementation process. 10.2.1 Implementation Procedures During the implementation, based on monitoring samples provided, Shanghai Urban Environment Sanitation Administration Bureau (SUESAB) and SWMSSUEPO collect and record implementation information of residents, shops, enterprises and institutions affected. Meanwhile, they deliver the record of the current activities in time to SUESAB so as to keep a consistent monitoring on implementation. SUESAB conducts periodic supervision to the project resettlement. In the above monitoring system, there is a continuous flow of information on a regular format from Shanghai Beach Reclaiming Company Ltd to SUESAB. Shanghai Construction Office of Important Project, Shanghai Urban Environment Sanitation Administration Bureau, SWMSSUEPO, Shanghai Housing Land Administration Bureau, Shanghai Urban Planning Bureau, as the important components of internal monitoring and supervision system, will carry out periodic supervision and verifications. 55 10.2.2 Contents * Payment of compensation to PAPs and PAUs * The process of land transfer * Arranging the schedule of the above activities * Conformity with the policies and regulations of RAP * Participation and negotiation of PAPs during implementation * Staffing, training, work schedule and effectiveness of the institutions 10.2.3 Internal Monitoring Reports SUESAB will compile Internal Monitoring Report for Shanghai Laogang Waste Disposal Site (phase IV) every six months and submit to the World Bank. 10.3 External Independent Monitoring and Evaluation 10.3.1 External Independent Monitoring Institution SUESAB plans to entrust a qualified institution to do the independent monitoring and supervision. 10.3.2 Responsibilities Independent Monitoring Institution will periodically monitor and evaluate the implementation of RAP, including the progress, quality of 56 resettlement, utilization of funds. It will give advice and suggestions. After checking quality of resettlement house, PAPs' living standards and production conditions, the Independent Monitoring Institution will submit monitoring and evaluation reports to SUESAB and the World Bank. 10.3.3 Procedures and Contents (1).Compiles outline for monitoring and evaluation (2).Develops resettlement monitoring and evaluation information system (3).Prepares survey outline, table of questionnaire (4). designs Sampling scale (5).Carries out baseline survey A baseline survey is carried out on land acquisition. Ltd. January 20, 2002 RAP for Shanghai Sewage Project Phase III (Minxin) 1. Description of the Project 1.1 Project Background With the deepening of the reform and opening-up, Shanghai is developing very fast on its way to becoming an international economic, financial and trade center in the Far East. To make its economy more sustainable and more competitive, Shanghai is reinforcing its construction. In infrastructure constructions particularly, Shanghai is investing huge amount of money to make the city progress fast every day. In addition to continuously constructing its road system and electricity infrastructures, Shanghai is making great effort in improving its ecological environment. A benign ecological environment is the prerequisite of the healthy development of economy as well as the basic condition for guaranteeing the healthy livelihood of the resident. Shanghai has always adopted high standards and strict requirements in constructing ecological environment in its efforts to improve people's livelihood and living standard and to fundamentally sustain the vitality of Shanghai. In this regard, Shanghai municipal government has gradually increased its investment on the environment projects since mid 1980s. In particular, the government invested hugely on rehabilitating the polluted waters in Shanghai. In recent years, Shanghai has constructed many large-scaled sewage treatment projects, e.g, the Sewage Project Phase I, which was completed in 1993. The project mainly resolved the solutions for the integrated sewages and living sewages in such districts and areas as Putuo, Changning, Jin'an, Zhabei, (part of) Huangpu, (part of) Hongkou, Yangpu and Waigaoqiao of Pudong area. The project serves an area of over 100 squ. km. and a population of over 2 million. Shortly after that, Shanghai completed such major infrastructures as the collective pipes, pre-treatment factory, and drainage mouth in Pudong Area under the Sewage Project Phase II. These facilities mainly provide solutions to the sewages in Xuhui and Luwan of Puxi, and part of the area in Pudong south of Zhaojiagou and north of Chuanyang Creek. These facilities serve an area of 2 million squ.km. and a population of 2.8 million. The above two projects intercept the sewage from many pollution sources along both sides of Suzhou Creek and Huangpu River, and thus improve, to certain degree, the water quality in the upper reaches of the creek and the river. In addition, in 1998, Shanghai municipal government started Suzhou Creek Rehabilitation Project Phase I. A lot of sub-projects under the rehabilitation project are under intense construction in order to change the water pollution status in Suzhou Creek. However, seen from the development of the constructions in Shanghai in recent years, because urbanized area continues to expand, the volume of urban sewage increases, too. The burden for treating sewages is increasingly heavy. Therefore, the environmental treatment is still behind the step of the municipal construction. The RAP for Shanghai Sewage Project Phase III (Minxin) water pollution status in Shanghai has not been fundamentally changed. There is still a large volume of sewage directly drained, without any treatment or pipe interception, into Huangpu River, Suzhou Creek and their tributaries. Water pollution is still one of the most outstanding problems blocking the development of Shanghai in the future. To step up to a higher level, to make the sewage treatment work in Shanghai more coherent, and to further improve the ecological environment in Shanghai, Shanghai municipal government put forward "Shanghai Sewage Project Phase III" according to the municipal plan. Shanghai Sewage Project Phase III (hereinafter "Phase III") is another major municipal construction after Sewage Project Phase I and Phase II. Phase III (hereinafter "Phase I" and "Phase II") is a composite of the overall plan of the municipal government on treating sewage as well as a key strategic measure to protect the water environment in Shanghai. If Phase I and Phase II mainly dispose the pollution of water in the upper reaches of Huangpu River and Suzhou Creek, Phase HI will dispose the pollution in the middle and lower reaches of Huangpu River and Suzhou Creek. Along both sides of the six tributaries (i.e. Pengyuepu, Zhenrugang, Mudugang, Shenjigang, Xinjingang, and Huacaogang) of the middle and lower reaches of Suzhou Creek, enormous sewage directly is drained into the river course without any treatment. The sewage flows into Suzhou Creek from the tributaries and makes these tributaries the biggest sources of pollution for Suzhou Creek. Now, over 2 million m3/d of sewage was collected through the sewage facilities of Phase I and Phase II for pre-treatment before the sewage is drained into Changjiang River, or the sewage may be drained into the waters in Shanghai after it is treated through the sewage treatment factory. However, still over 2 million m3/d of untreated sewage and wastewater were drained into Huangpu River, Suzhou Creek and their tributaries. Phase III mainly disposes the sewage left unsolved by The Tributaries of Suzhou Creek Sewage Interception Project (North Section), the Sewage Interception Project at Hongkougang and Yangpugang of Phase II, and Phase I north of Zhaojiagou in Pudong New Area. In addition, according to the sewage drainage plan, to limit the drainage of sewage at Shidongkou, the sewage south of Yunzaobang, east of the west main line, west of Yixian Road and north of Wenshui Road, which was designed to be drained through the west line, is also included into the service scope of this project. The implementation of Phase III will considerably improve the quality of the water in Huangpu River, and Suzhou Creek, as well as its tributaries Hongkougang and Yangpugang. The implementation of the project will also improve the rehabilitation degrees of the water south of Yunzaobang in Puxi and north of Zhaojiagou in Pudong. According to Phase III, a sewage treatrnent factory --- Minxin Sewage Treatment Factory (temporary name) will be constructed on Minxin Road in Yangpu District. In addition, four intermediary pump stations will be set up. They are Minzhu Pump 2 RAP for Shanghai Sewage Project Phase III (Minxin) Station, Zhangmiao Pump Station, Wenshuilu Intermediate Pump Station and Jiamusi Intermediate Pump Station. Also, some sewage collective pipes will be established (See the following table for details). Phase III was designed with respect to the overall development plan of Shanghai and mainly targeted on the backward status of the sewage colleting system in Baoshan, Hongkou, and Yangpu of Shanghai, including providing solution for the sewage north of Zhaojiagou of Pudong New Area. Through the project construction, the unruly situations of sewage collection in these areas will be greatly improved so as to enhance the production development in these areas and to improve the living environment and livelihood of the residents in these areas. Meanwhile, the project construction complies with the overall requirements specified in "the Professional Plan on the Sewage Drainage System in Shanghai (2020)". In that respect, Shanghai Water & Environment Construction Co. Ltd. entrusted in April 2001 Shanghai Municipal Construction Design Institute and Shanghai Municipal Project Design Research Institute to mutually compile the Feasibility Study Report on Shanghai Sewage Treatment Project Phase III. Because the feasibility study report specified several options for the project, according to the optimization principle, this RAP is compiled according to the design of Option I. The report was appraised in January 2001 by Shanghai Investment Consulting Company. The Municipal Planning Commission replied in January 2002 and approved the construction of Phase III. 1.2 Impact Scope Phase HI will include the construction of a sewage treatment factory, i.e. Minxin Sewage Treatment Factory (temnporary name). The factory is situated north of Minxin Road, south of Nenjiang Road, and east of Jungong Road in Yangpu District. Meanwhile, 4 intermediate pump stations will be built up. Zhangmiao Pump Station is located in the land belonging to Xin'er Village of Songnan Town east of South Jiangyang Road and north of Tongnan Road in Baoshan District. Minzhu Pump Station is located in the land belonging to Jiangyang Village of Gaojing Town in Baoshan District, south of 128 Jinian Road and west of West Sitang. Wenshui Intermediate Pump Station is situated north of Wenshui Road and west of Yuexiu Road in Yangjialou residential area belonging to Yuexiu Neighborhood Committee of Daning Street in Zhabei District. Jiamusi Intermediate Pump Station is located in the land belonging to No. 11 Mobile Team of Yangpu Mobile Transport Company and near some residential housing west of Jungong Road and south of Jiamusi Road. The collective pipes project of Phase III includes: sewage pipes along South Jiangyang Road from Yunzaobang cross Wenshui Road to Guanglinsi Road, the collective pipes along Songhuajiang Road from Shuangyang Road to Jungong Road, the collective pipes along Xiangyin Road from Wujiaochang to Jungong Road, and then along Jungong Road from Dinhaigang Road cross Minxin Road to Minxin Sewage Treatment Factory, and some auxiliary sewage pipes connecting the collective pipes. 3 RAP for Shanghai Sewage Project Phase III (Minxin) In addition, rain and sewage collection systems are going to be constructed in Baoshan and Yangpu Districts of Puxi. In Baoshan District, 4 sewage pump stations and 14 rain pump stations will be newly set up in Baoshan District. Meanwhile, some old pump stations in Yangpu District will be reconstructed to make the sewage drained into the pipes of Phase III. The scope of Puxi collection system includes the collection system in Baoshan District (south of Yunzaobang area), the dry-season sewage interception project in Yangpugang area, and the service area of the five drainage systems east of Yangpugang, i.e. Changbai, Kongjiang, Dadinghai, Zhoujiazui, and Fuxindao. Baoshan District The collection system in Baoshan District mainly serves the area south of Yunzaobang in Baoshan District (including some area in Zhabei District uncovered by Phase I and the Tributaries of Suzhou Creek Sewage Interception Project). The system serves a total population of 551,100 people and an area of 55.56 km2. The service scope is: north to Yunzaobang, east to Tongji Road and Yixian Road, southeast to Songhu branch line of Baoshan District, south to 300 m. south of Changzhong Road, Beichangbang, Echanpu, Hu-Jia highway, and west to the outer ring. The scope does not include the neighborhood of Dachang Airport (south to Changzhong Road, west to Hutai Road, Ximipu, north to Yunzaobang, and east to the protective river of the airport) and the service scope of Sitang Sewage Factory (south to West Changjiang Road, west to Gonghexin Road, north to Yunzaobang, and east to Xisitang). The service scope of the project includes the neighborhoods of Qilian, Nanda Road (including some land of Zhabei District), Zhennan-(north) Dachang, Miaohang, Gongkang, Minzhu, Zhangmiao, Songnan, Wusong Industrial Park (south of Yunzaobang) and the Linfen Garden of Zhabei District. Within the service scope in Baoshan District there is Shidongkou Sewage Drainage System (the west section sewage collective pipe has already been set up, and Shidongkou Sewage Factory is under construction and will be finished in 2003). Some sewage collected by the collection system may first access into the west main line and then be treated by Shidongkou Sewage Treatment Factory. The rest sewage may access into the drainage system of Phase I. The total volume of sewage collected by the system amounts to 246,800 m3/d: Sewage pipes of 124.32 km long will be constructed. The flow-separation mechanism applies to most of the scope of the sewage collection system. In order to avoid repeated earth digging and waste of investment attributable 4 RAP for Shanghai Sewage Project Phase III (Minxin) to separate constructions of the sewage collection system and the rain system, both systems will be constructed at the same time in Baoshan District. Altogether 27 rain systems, 136.45-km-long rain pipe, and 14 rain pump stations will be involved in this area. Hongkou and Yan2pu Districts The collection system in Hongkou and Yangpu Districts mainly collects the sewage unsolved by Hongkougang and Yangpugang interception projects. The service scope of the system covers the area east of Yangpugang. The project serves an area of 11.37 km2 and a population of 307,000 people. The project is designed to dispose more than 200,000 m3/d volume of sewage, which includes the sewage from Changbai, Kongjiang, Dadinghai, Zhoujiazui and Fuxin Island drainage systems. Under the project will be established a collective pipe along Zhengben Road-Guoding Road-Huangxin Road and a pipe on Dunhua Road (Old Dunhua Pump Station-Songhuajiang Road). Pudong New Area In Pudong Area a sewage collection system, ten sewage intermediate pump stations (two of which have already been constructed) will be constructed. The impact scope of the collection system project in Pudong mainly includes the planned added urban area outside the outer ring and some area inside the outer ring. Below is the identified service scope. 1. Outside the outer ring: ship construction base, port area, Caolu area (Caolu, Gulu, Gonglu, the industrial park), Tangzhen Area (Tangzhen, Wangggang, industrial park), Heqin Area (Heqin, Cailu), Huaxia Commercial Area, Jichang Town, and Huanglou. 2. Inside the outer ring: Gaoqiao Industrial Park (Linqiao), Gaodong area (Gaodong, Yangyuan, industrial park), Donggou, Sunqiao (Sunqiao, industrial park), west of Jiyang Road, and Sanlin. The project serves a total area of 52.61 km2 and disposes a total sewage volume of about 240,000m3/d. This volume, plus the already disposed sewage volume of 1.3 million m3/d, amounts to 1.54 million m3/d, which accounts for 92% of the total planned treated sewage volume in Pudong New Area. The service scope of Pudong Collection System Project covers 8 towns: Jichang, Tangzhen, Caolu, Heqin, Gaohang, Gaodong, Sanlin, Sunqiao. The rest of the scope covers the existing towns or land. Except the industrial park, most of the covered area is residential area. The land west of Jiyang Road is a recreational area subjected on large green land. 5 RAP for Shanghai Sewage Project Phase III (Minxin) Construction of Shanghai Sewage Phase III will directly affect 6 districts (Baoshan, Yangpu, Zhabei, Hongkou, Putuo and Pudong New Area), 2 residential districts (Daning, Changbai), 13 towns (Songnan, Gaojin, Dachang, Taopu, Gucun, Gaoqiao, Gaodong, Caolu, Tangzhen, Sunqiao, Chuansha, Jichang, Sanlin), more than 10 villages (Xin'er Village, Xin'san Village, Shanegli Village, Zhangjiazhai Village, Xinhua Village, Huandong Village, Hongyi Village, Jikou Village, Duimian Village, Jielong Village, etc.) and some residents, enterprises, green land and infrastructures, etc.. Please see Appendix 1 for the location of the above projects. 1.3 Socio-Economic Impacts The project affected items mainly include the municipal forestation facilities along the pipes of Phase III, some affected underground pipes, and many buildings that will be dismantled because of the project. Some affected enterprises were newly established and have just started business. When they were informed that they would be relocated because the land was designed to build pump stations, the enterprise managements were rather surprised and embarrassed. Because relocation is a complicated assignment and the business has just started, the relocation will have a significant impact on these enterprises. How to make the enterprise operation unaffected by relocation is the most important task for them. They particularly need to be consulted with in advance and to be adequately compensated and relocated. Due to the extensive scope of impact of the project, many enterprises will be affected. Other affected enterprises have more or less the above relocation problems. However, everything has two faces. According to our experiences in relocation for municipal works in Shanghai, not all project construction would have negative impact on the relocated enterprise. For instance, Zhangmiao Pump Station, which will be constructed for the project, is situated in Xin'er Village of Songnan Town in Baoshan District. The land needed by the pump station happens to be occupied by a village owned enterprise. Now the enterprise is at the edge of stopping production and changing business direction. Besides several guards, there are few people in the factory. The enterprise management is worrying about the solution for the current status. As this site is selected for the project construction, the enterprise becomes hopeful for a new birth from the current embarrassing situations. Because the enterprise will get compensation for relocation, it will get the essential fund for adjusting its operation and thus regain the business vitality and retain the employment. Due to the large scale of the project, it will affect many enterprises. Many enterprises are having similar situations as described above. These enterprises will all have chance to regain their births through relocation. That will help in promoting development of the production in the area as well as in maintaining social stability. 6 RAP for Shanghai Sewage Project Phase 1II (Minxin) In addition, the project implementation will play an active role in collecting rain and sewage in northwest, north, and northeast of Shanghai. The project will make the water quality in these areas considerably improved and will thus improve the living environment and livelihood of the local residents. Meanwhile, the project implementation will greatly improve the quality of the water in the lower reaches of Huangpu River and Suzhou Creek. All these will bring significant benefits to the urban environmental sanitation and people's health in Shanghai. 1.4 Measures Taken to Minimize Negative Impacts To implement the WB principles on minimizing the scope of project affected persons (PAPs), the project host, after several surveys, researches and repeated discussions, decides to take the following measures to minimize the scope of PAPs and to lighten or to eliminate negative impacts. (1) Several schemes were designed. After comparing and evaluating advantages and disadvantages, the design is optimized. It is decided to use jack pipe in the downtown area of dense population in order to avoid large-scaled earth digging and thus to reduce immigration. (2) Before immigration, staffs were organized to visit the spot to see which buildings could be saved or partly relocated. (3) For those buildings to be temporarily occupied by the project, the owner was noticed to empty the buildings before dismantle, or temporary buildings were set up in the owner's scope of land. After the project is completed, the old building owner will rebuild the buildings at the same site. (4) For losses incurred by the resettlement, adequate compensation that is calculated according to the replacement price will be paid to the residents so as to minimize the negative impact of the resettlement. (5) The resettlement area is chosen to be close to the original residential area. By doing so, the residents will keep connection with the old residential area on the one hand and avoid increasing the distance from the resettlement area to the working place of the affected residents. (6) For the affected enterprises, notice will be sent to them in advance for them to arrange relocation place. Their loss will be duly compensated. It is endeavored to shorten the operation interruption period and to arrange employees' work through consultation with the enterprise owners. (7) During the process of resettlement, relevant parties were requested to give help to 7 RAP for Shanghai Sewage Project Phase III (Minxin) the affected residents and enterprises, and to provide convenience for them, in order to enhance the smooth conduct of the resettlement and to lighten their burden and loss. 1.5 Ownership & Organization of the Project Shanghai Water & Environment Construction Co. Ltd. (SWECC) is responsible for the concrete project implementation. The preliminary-stage engineering department of the company is responsible for the resettlement and relevant coordination. Assisted by various levels of administration, the local government will be responsible for the resettlement implementation. During the process of project implementation, a lot of community work on the affected population will need the support of local government. Therefore, the local district government, as well as its subordinate offices, neighborhoods, and village committees are also the associates for the project implementation. 1.6 Schedule of the Project and the Resettlement The whole construction period of the project will be 3 years, starting from March 2003 and ending in March 2006. Accordingly, the period for the resettlement implementation is planed to be from December 2002 to March 2004. See 15.1 for details of the implementation procedures. 1.7 Principles & Objectives for Compiling the RAP This RAP was planned by SWECC. The RAP is prepared in accordance with the various laws and regulations of the country and the locality as well as the World Bank Operative Principles on Involuntary Resettlement (OP4.12). The objective is to seek the best option to ensure that the project affected residents, enterprises, infrastructures, and public facilities will be properly resettled or rebuilt, and to ensure that the livelihood of the PAPs and the business level of the affected enterprises will be maintained or improved. In order to realize the above principles and objectives, we endeavor to follow the following principles while compiling the RAP. 1) To repeatedly revise and perfect the RAP to minimize the scope of the impact, to substitute compulsive resettlement measures with other measures in order to minimize resettlement. 2) Where involuntary resettlement is unavoidable, resettlement activities should be 8 RAP for Shanghai Sewage Project Phase III (Minxin) conceived and executed as sustainable development program, providing sufficient investment resources. It should be guaranteed that all PAPs receive compensation for their total loss and are properly resettled and rehabilitated so that they can share the benefits of the project. Meanwhile, compensation should be paid for their temporary hardships, and affected properties according to replacement price. Resettled people should be assisted in their efforts to improve their livelihoods and be financed in their activities in improving their living environments, or at least to restore them, in real terms, to pre-resettlement levels or to levels prevailing prior to beginning of project implementation, whichever is higher. 3) To perfect the necessary equipment of the new housing, and make the resettlement community equipped with complete facilities, convenient transport, comfortable livelihood and fine environment. 4) To enable the resettled people to get used to the host community in a short period so as to stabilize their life. 5) To provide the vulnerable groups with preferential policies in housing, employment, etc.. 6) To keep the scope and function of the buildings of the affected enterprises, to restore to the original business environment as far as possible, and to compensate for their losses from operation interruption and temporary change of business environment. 7) To properly compensate the collective-owned land for all its loss and to pay the compensation to the community for no other use but developing the collective economy; 8) The implementation of the resettlement will be monitored and evaluated by the external monitor. The representatives of the PAPs will take part in the decision-making of the resettlement; special institutions will receive complaints from the PAPs. 9) During the process of the project implementing, if the RAP has significant change due to change of the design, etc., the RAP will be revised and submitted to the World Bank for approval; significant changes in the number of affected objects, in the compensation policy or in compensation rates will be submitted to the World Bank first and then implemented after approval. Minor changes during implementation of the RAP will be reflected in the internal and the external monitoring report. 9 RAP for Shanghai Sewage Project Phase III (Minxin) 2. Project Impact 2. 1 Scope of the Acquired Land Construction of Phase III will include not only installing pipes of long distance but building large-scaled sewage treatment factory and several intermediary pump stations. Accordingly, some land will be acquired or borrowed. The situations of land acquisition and borrowing are categorized into the following aspects. 1. To acquire Land (1) Sewage treatment factory: Shanghai Minxin Sewage Treatment Factory (temporary name); (2) Intermediary pump stations: Wenshuilu Intermediary Pump Station, Zhangmiao Pump Station, Minzhu Pump Station, Jiamusi Intermediary Pump Station and the rain and sewage pump stations incorporated in the collection system of Puxi and that of Pudong; (3) Pipes installed along: South Jiangyang Road (from West Changjiang Road to Changzhong Road), Guangyue Road (from Changzhong Road by Kuizhao Road cross Yujingpu to Wenshui Road), Wenshui Road (from Gaoping Road to Liangcheng Road), Liangcheng Road (from Wenshui Road to Guanglingsi Road), Xiangying Road (from Wujiaochang to Jungong Road), Songhuajiang Road (from Shuangyang Road to Jungong Road), Jungong Road (from Nenjiang Road by Liping Road to Dinghaigang Road), Zhengben Road (from Guocui Road to North Zhongshan'er Road), Guocui Road (from Zhengben Road to Huangxin Road), Huangxin Road (from Guocui Road to Wujiaochang) and the pipes included in the collection systems of Puxi and Pudong. 2. To borrow Land: the land that will be used during the project construction The total area of land to be acquired for the project is: 371968.52 squ.m., equaling with 557.95 mu (of which 40933.5 squ. m. equaling 61.4 mu is collective arable land, and 331034.98 squ.m. equaling with 496.55 mu is non-arable land); Total borrowed land is: 2297278.2 squ.m. equaling 3445.9 squ.m. (Imu = 666.67 squ.m.) 2.2 Impact of Land Acquisition The resettlement scope of the project will be decided according to the needs of the project construction. The affected buildings are separately located in Daning Residential District of Zhabei District, Changbai Residential District of Yangpu District, Dachang Town and Songnan Town (Wusong) of Baoshan District, and Sunqiao Town, Caolu Town and Tang Town of Pudong New Area. Most of the affected residential houses are one or two storied buildings of brick-wood structure. A few of the affected houses are of brick-concrete structure. Most of these buildings have poor living conditions and auxiliary facilities. They are part of the simple or dangerous buildings to be reconstructed in Shanghai in the future. Because of the disorderly drainage system, draining is often blocked in the community. Passes inside the community are shallow. Some places are low-lying land so that the rainwater will rise to knees inside the house in raining days. These facts, plus the loose management, make the community environment very poor. The residents also hope to be relocated as early as possible in order to improve the existing living conditions. Among the affected enterprises, those that will be wholly relocated will rehabilitate its production and operation by leasing other production or business sites. The employees of these enterprises will receive subsidy for the temporary interruption of employment. After the enterprise is relocated, the employees can go to work again in the old enterprise. So the relocation of these enterprises will not have much impact on their employees. Those enterprises that will be partly relocated will feel the temporary impact of the project. Through adequate compensation and relocation, however, the old production layout of the enterprise will be adjusted, e.g. by compacting production space, adjusting the old production site. So the production and operation of these enterprises will not be impacted by the project. Compared with the employees of the enterprises that will be wholly relocated, the employees of the enterprises to be partly relocated will feel less iinpact from the project and will not be influenced in their engagement with the enterprise. In addition, the project construction needs to acquire some village owned collective land, mainly for the construction of the collection system projects in Puxi and Pudong. For this purpose, 61.4 mu of arable land will be acquired. According to the land acquisition conditions and the land labor rates of the villages, 134 labors need be provided with jobs after the project. With this regard, the project host will pay labor resettlement fee to them. 2.2.5 Affected Infrastructures Project affected infrastructures mainly include road, trees, green land, pavement trees and various underground pipes and lines. The project host will compensate the infrastructure owners before the project construction and pay attention to protecting those public infrastructures that are difficult to be relocated during the project construction. After the project construction, the roads, trees, green land and pavement trees will be rehabilitated. 2.2.6 Impact on Vulnerable Group From the baseline survey, it is known that within the scope of the project construction, 31 RAP for Shanghai Sewage Project Phase III (Minxin) 15 households ale impoverished households whose per capita monthly income is under 280 yuan, and 3 households are either minority, or the senior living alone, or disabled households. 3. Objectives The purposes of this RAP is to enable the PAPs to benefit from the project, to improve or at least restore their livelihood, income capacity and production scope, and to pay attention to the need of the vulnerable groups in particular. Following are the objectives of the RAP. 1. To properly arrange the livelihood and the residence of the PAPs and to guarantee that the income level of the PAPs be improved or at least restored to the prevailing level. 2. To repeatedly revise and perfect the RAP in order to lighten the impact and to minimize the scope of immigration. 3. To guarantee that all PAPs receive compensation for their total loss and are properly relocated and rehabilitated so that they can share the benefits of the project. Meanwhile, compensation should be paid for their temporary hardships and affected properties according to replacement price so that their income level, living standard and the profit-making ability of the affected enterprises will be improved or at least be restored to the pre-resettlement levels. 4. To perfect the necessary equipment of the new housing, and make the resettlement community equipped with complete facilities, convenient transport, comfortable livelihood and fine environment. 5. To enable the resettled people to get used to the host community in a short period so as to stabilize their life. 6. To provide the vulnerable groups with preferential policies in housing, employment, etc.. 7. To keep the scope and function of the buildings of the affected enterprises, to restore to the original business environment as far as possible, and to compensate for their losses from operation interruption and temporary change of business environment. 8. To properly compensate the collective-owned land for all its loss and to pay the compensation to the community for no other use but developing the collective economy; 9. The implementation of the resettlement will be monitored and evaluated by the external monitor. The representatives of the PAPs will take part in the decision-making of the resettlement; special institutions will receive complaints from the PAPs. 10. During the process of the project implementing, if the RAP has significant change due to change of the design, etc., the RAP will be revised and submitted to the 32 RAP for Shanghai Sewage Project Phase III (Minxin) World Bank for approval; significant changes in the number of affected objects, in the compensation policy or in compensation rates will be submitted to the World Bank first and then implemented after approval. Minor changes during implementation of the RAP will be reflected in the internal and the external monitoring report. 11. After Phase III is completed, a new modern city of Shanghai will appear before the people. Both the appearance and the sanitary conditions of the project covered area will be greatly improved, which will play an active role in enhancing the health of the relocated people and those in the neighborhood. The completion of the project will promote the social development of the city and help Shanghai take part in the global competition with the appearance of a modem international cosmopolitan. The project will make contributions to the undertaking of environmental protection for China and the world. 33 RAP for Shanghai Sewage Project Phase III (Minxin) 4. Socio-Economic Impact The project host made a baseline socio-economic survey on the project affected area. Through on-spot investigation, random sampling and written questionnaire, data and materials are collected. Some time after the project is completed, the project host will make another socio-economic survey. The results of the two surveys will be compared and analyzed to show the positive or the negative impacts, as well as the degree of the impacts, of the project implementation on the affected population. The purpose of the comparison is to verify the effectiveness of the project implementation. 4.1 Brief Description of the Project Area The project runs cross 6 districts (Baoshan, Yangpu, Zhabei, Hongkou, Putuo and Putuo New Area), 2 residential districts (Daning and Changbai), 13 towns (Songnan, Gaojin, Dachang, Taopu, Gucun, Gaoqiao, Gaodong, Caolu, Tangzhen, Sunqiao, Chuansha, Jichang, and Sanlin), and more than 10 villages (Xin 2 Village, Xin 3 Village, Shengli Village, Zhangjiazhai Village, Xinhua Village, Huandong Village, Hongyi Village, Jikou Village, Duimnian Village and Jielong Village, etc.) Yangpu District is located northeast of downtown Shanghai and at the lower reaches of Huangpu River, with the east and the south facing the river. The total area of the district is 60.61 squ.km. As the biggest district in downtown Shanghai, it has a registered residential population of 1.24 million. One of the downtown districts of Shanghai, Putuo District is located in the northwest of the city, with 55 squ.km. area and 0.85 million population. It has always been called "the west grand lobby" of Shanghai. Lying east of the north downtown Shanghai, Hongkou District has an area of 23.48 squ.km. and a registered population of 0.86 million. Situated in the north of Shanghai, Baoshan District is one of the key new urban areas that are included in the long strategic plan of Shanghai to be developed in priority. 56 km long from east to west and 23 km long from south to north, the district has a total area of 415 squ.km. and a population of 0.95 million. As an important composite of Shanghai, Pudong New Area is located east of downtown Huangpu River and has an area of 533.44 squ.km and a registered residential population of 1.534 million. On April 18, 1990, Chinese government declared to develop and open up Pudong in Shanghai and decided to take the development and opening-up of Pudong as the dragonhead to further open the coastal cities along Changjiang River. According to the declaration, Shanghai will be built in the shortest period into an international economic, financial and trade cenfer so as to push the new economic flight of the whole Changjiang base. The development and opening-up of Pudong has provided historic opportunity for Shanghai. During the past ten years of development and opening-up, the economy of Pudong has been developing at a very high speed, and the urban appearance has changed significantly. Now, Pudong New Area has become the base for the newly emerging high-tech industries and modem industry in Shanghai, the new economic growth point 34 RAP for Shanghai Sewage Project Phase III (Minxin) of Shanghai, and the focus and symbol of China's refonn and opening-up in the 90s.
