The purpose of this document is to set out an Action plan for the Resettlement and Rehabilitation of the Project Affected Persons(RAPs) to ensure that they will benefit from the project and the standard of living will improve or at least be restored after the Project Impact. Acquisition of land and other assets for the project will adversely affect the livelihood of persons, whose life, work or earn their living on the land that will be acquired for the project PAPs are defined as those persons whose income or livelihoods will be adversely affected by land acquisition for the project PAPs include the following categories: persons who have a title, right, interest , in structures(houses, enterprises, shelters, or public buildings), land(including residential, agricultural, and grazing land) or any other asset acquired or processed, in full or in part, permanently or temporarily. .Persons who use the structures, land or assets described above, or persons whose business, occupation, work, place of residence or habitat adversely affected, or Persons whose standard of living is adversely affected as a consequence of land acquisition. A definition of PAPs is given as below: Affected persons means persons who on account of the execution of the project had or would have there: 1). Standard of living adversely affected;2). Right, title, or interest in any house, land (including premises, agricultural and grazing land) or any other fixed or moveable asset acquired or processed, temporarily, or 3). Business, occupation, work or place of residence or habitat adversely affected, and "affected persons" means individually all those who qualify as "affected persons". PAPs may be individuals or legal persons such as a company, a public institution. Definition of PAPs is not limited to their legal registration or permission to live or conduct business in the affected location, or their title to property. Thus, it includes: a). All those affected by the project regardless of their legal rights or absence thereof to the assets being taken; and b). Persons without residential to live in a certain area. Therefore all such persons who are affected will need to considered and recorded as PAPs, regardless of their legal connection to assets land or location. If there are more than one person, family or household using or holding a title to the same land or property that is acquired, they will be compensated and rehabilitated according to the loss they suffer, their rights, and the impact on their living standards. The definition of the PAPs is linked directly to the adverse effect of the project, regardless of legal rights title or Hubei Province Hydropower Project Zhushan Countv Songshuling Hydropower Station Resettlement Action Plan interest. All PAPs entitled to the improvement or at least restoration of their standards of living, and compensation for the material losses they suffer. Compensation for assets will cover replacement cost. No deductions or discounts will be applied to the compensation amount for depreciation or other reasons. All PAPs deriving an economic benefit from the affected land and property are entitled to receive rehabilitation benefits in addition to the compensation for their assets lost. Those PAPs without title, authorization or legal permission to reside, conduct business, cultivate land or contract structures are eligible for rehabilitation of their livelihoods and compensation for their assets on an equal footing with those with formal legal title, authorization or permission to the assets. The term RESETTLEMENT includes: a). The relocation of living quarters; b). Finding acceptable new employment for those whose jobs is affected;3). Restoration (or compensation) of affected production resources such as land, workplace, trees, and infrastructures;4). Restoration of other adverse effect on PAP's living standards (quality of life) through land acquisition (such as the adverse effects of pollution);5). Restoration of or compensation for affected private and public enterprises; and 6). Restoration of adversely affected on cultural or common property. Rehabilitation means: the restoration of the PAPs' resource capacity to continue with productive activities or lifestyles at a level higher or at least equal to that before the project. The objective of this PAP is to provide a plan for the resettlement and rehabilitation of the PAPs so that their losses will be compensated and their standard of living will be improved or at least restored to the pre-project levels. To achieve these objects the plan provides for rehabilitation measures so that the income earning potential of individuals are restored to sustain their livelihoods. Affected productive resources of business (enterprises including shops) and public property Infrastructure and cultural property will also be improved or at least restored to their pre-project levels. 2. Hubei Province Hydropower Project Zhushan Countv Songshuling Hydropower Station Resettlement Action Plan 1. General 1.1. Project Background Songshuling Power Station sites in Zhushan County, in the west of Hubei Province, Borden with Shanxi Province on the west and facing Chongqing City on the north, with a total population of 450974 in the end of 1998, and a total land area of 3586.15km2. In recent years, along with the constant improving of living level, the need for power increases quickly. In the year of 1999, the total power using is 960 million kw.h, with a highest day load of 13000 kw. The Zhushan Power net has been connected with Hubei Provincial Power net, in the county, the power source is mainly provided by the small power station inside. The total installed capacity of the small power stations in Zhushan County is 35140kw, but the scale is very small(with a installed capacity of 100O0kw for the biggest power station), and the adjustment ability of the reservoirs is bad, so especially in the dry years, the contradiction between the needing and providing of power is more obvious, and the local production and living was affected, as well as the development of the economy was limited. The switch was usually pulled off, so the dependable power providing was urgently needed to satisfy their living. The installed capacity of Songshuling Power station is 50000kw, which will be the biggest power station in the county after its completion. 1.2. Project General Songshuling Power Station lies at the middle of the Guandu River, which is in Guandu Town in Zhushan County, the dam lies lkm upper the combining site of the Guansu River and its branch, Yangyugou, 40.7km to the combining site of the Guandu River and Duhe River at the lower point, 74km to the county district. The power station is mainly for power producing, as well as for piping, irrigating, aquatic production, shipping, etc.. The drainage area upper the dam of Songshuling power station is 2447km2, the mean runoff of years is 1826 million m3, the normal water retaining is 394m, the total storage capacity is 57.48m3 the backwater length is 19km, with an area of 2.74km, and the storage capacity is 48.2 million m3 under normal water retaining, the coefficient of storage capacity is 1.23%, a reservoir of season regulation. The installed capacity of the power station is 50 MW, the regulate annual eletricenergy production is 153.9 million kw.h, and the annual using time is 3078h, and 19km shipping line will be improved. After being put into operation, it will not only provide electricity for Zhushan County. but also will transmit electricity power to the provincial net. The project was mainly composed by the dam,piping tunnel, power station site, switchyard. The dam is built by concrete, of the type of gravity. The top of the dam is 399.5m, 65.5m for the biggest dam, and 128m for the length of the top. The project requisition involves Guandu, Liulin, Liangjia, three towns, and, Yangpo, Puxi, Taoyuan, Jiazhu, Tianchiya, Liuhe, Daping, Laozhu, 9 administrative villages, 52 households will be relocated, with a population of 216, and the relocating house area is 9889m2, 316.1mu cultivated land and 378.5mu forest land will be acquisition, 5.1km roads, a small hydropower station will be affected 3 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan 1.3. The scope of project impact and service Land acquisition for Songshuling Power Station involves Guandu, Liulin, Liangjia, three towns, and Sangping, Yangpo, Puxi, Taoyuan, Jiazhu, Tianchiya, Liuhe, Daping, Laozhu, 9 administrative villages and 18 village groups. The Power Station is for season coordination, with a loading capacity of 50000kw for the machine. After completion, besides meet the needs of power in the local area, power menage will be transmitted to the provincial net. For decreasing the contradiction between the providing and needing of power in the local area, as well as improving the living level, industrial and agricultural production, and stimulating the economical development, the construction of the Power Station plays an important role. 1.4. measures to reducing the project impact Obviously, the project construction is relevant with the land acquisition, house demolishing, the resettlement, and will impact the living condition of the local inhabitant. In order to reduce the number of land requisition, and house demolishing, the design institute has adopted many measures, including the water level choice, permanent structure planning, temporary land acquisition of constructor choice, as could as possible to avoid residential area and cultivated land. To decrease the local impact by construction, following measures will be adopted: Enhance basic data acquisition procedures, analyses on local socio-economic status, and formulate practicable action plans with due consideration of actual situation, thus ensuring that the living standard of the resettlers will not be decreased. According to the actual condition of Kuwei dock, protecting measures will be adopted after survey and discussion, so as to reduce the impact to the interest of the inhabitant possibly. Strengthen internal and external independent monitoring activities, establish high efficient and smooth channel for information feedback, reduce informnation processing period, thus ensuring that problems can be resolved timely. During construction, priority will be given to use local materials such as bricks, sand and gravel, etc., as well as local transportation means and labor force, thus resettlers can obtain benefits from the project. 1.5. Project design and review The project item belongs to the World Bank Loading Item, according to the requirement of the World Bank, the project unit will provide practicable RAP plan for the World Bank to review. 1.6. Progress Schedule 1.6.1. Project Implementation Schedule For the project, the preparation work will be implemented in the second half of this year, and will be implemented at the beginning of next year, the whole work will be completed in 2005, and will be put into operation. The total construction time is four years. For the first installation, the power producing period is three and a half years. 4 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan 1.6.2. Implementation Plan for Resettlement According to the implementation progress of the main projects, 52 households, with 116 persons will be resettled. The work is now planned to be done in two groups, for the first group of 35 households with 70 persons, the work will be finished by the end of 2001, and for the second group of 17 households with 46 persons, they will move into the houses ahead the end of 2002. 1.7. Preparation for Resettlement and Monitoring 1.7.1. Survey for material index The surveying work for the material index affected by permanent land acquisition and submerged by the reservior, was field explored and surveyed in the whole affected scope by a "surveying group for land requisition and relocating material index of Songshuling hydropower station project", which was composed by Zhushan County Government, Zhushan County Water and Electricity Developing Company, the County Resettlement Bureau, and was guided by the special oppionter of ECIDI. 1.7.2. Social Economy Survey 1.8. Basis of RAP Land Administrative Law of the PRC Specifications for Planning and Design of Reservior Inundation of hydropower Projects (DL/T.5046-1 996) Rules for compensation of Land Acquisition and Resettlement of Middle and Large Water Resource and Hydropower Projects Land Administrative Regulations of Hubei Province Woodland Administrative Law of Hubei Province Operational Directive OD.4.30, "Involuntary Resettlement" Relative Regulations for Land Acquisition and Relocating in Hubei Province Relative Regulations of Zhushan County Government The Feasibility Study Report for Songshuling Power Station in Zhushan County, Hubei Province The RAP Report for the Project The Contract and Documents entrusted by the Project owners Souci-economy Investigation 5 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan To analyze the affection on the local economy and prepare practicable RAP, the relative organizations were organized by Zhushan government and ECIDI to make socio-economic analysis for the impacted county and town(ship)s. At one side, to survey the affected households, family members, knowledge level, employment and land owning, family income resource of expenditure, and the resettlement means. The investigation group also talked with the local cadres, farmers, househoids, publicized the relative things about land requisition, housing relocation, resettlement and the construction to the local economy development. 6 Hubei Province Hydropower Project Zhushan Countv Songshuling Hydropower Station Resettlement Action Plan 2. Socio-economic Conditions in Project Affected Area 2.1. National and Socio-economic Conditions in Zhushan County Zhushan County lies at the northwest of Hubei Province. By the end of 1998, it has 10 towns, 15 townships, 486 administrative villages, 3213 village groups, and 8 residential committee, with a population of 450974, 398894 for agriculture, accounting 88.45% of the total. The birthrate of the county is 8.4%%, 5.2%% for nature. The labor force in country is 186811 persons, with a population density of 126 person/km3. The total land area of the county is 526155mu, the mean cultivate land is 1.32mu per capita. The average product of grains is 397kg/mu, the mean income of the farmer is 1471 yuan every year. The GNP of the county is 1395.5552 million yuan, 596.14 million yuan for agriculture, accounting for 42.7% of the total, and 746.25 million yuan for industry, accounting for 53.5% of the total, 46.22million yuan for construction, accounting for 3.3% of the total, 6.01 million yuan for post work, accounting for 0.43%, and 935200 yuan for other assets, accounting for 0.01% of the total income. The county is at the northwest of Hubei Province, belongs semitropical and monsoon area, with warm weather and enough rainfall. The average annual rainfall is 836.3mm, and the average annual temperature is 15.5C, and the average annual wind speed is 0.8m/s. In the whole county, the mountains are continuos and the higher ones are sticking out, thus form lines of hills and valleys, and makes advantage water resource for the local place; the land resource in the county is also abundant, but hilly land takes a main part, and during 1960 to 1980, trees cutting was serious, so that series of soil erosion was made. After many years' protecting, some places are still not restored. But the plant covering is good and suitable for the growing of plants, rice, wheat and corn are popular in the local place, two times a year. Souci-economic condition for the place submerged and for resettling Sonfshuling Power Station locusts in Jiazhu Village, in Guandu ToWn, the reservoir feedback is 19km, with an area of 2.74km2. Continuos hills surrounded along the two sides of the reservoir, and the riverbed appears like V. The rock system along the river is complete, with high intensity and high ability against efflorescence as well as cliff shape. The slope aside the reservoir bank is basically stable, at the front of the bank, the rocks are sticking out. In the whole reservoir area, the hills are continuos, rising and falling and crossing each other, and the altitude of them are above 700m, along the two sides, the vegetation is developed, generally, the villages local more than 400m altitude; on the right bank, the fourth level road crosses the reservoir along the river, upper the dam site, Liangjia Township road connects with the other bank; in the early 40-50, shipping in the river is possible, but since years' silting up on the riverbed, shipping is basically not smooth at present. However, connecting with the other side of the river, there are three ferries, a chain bridge and a bridge on Liangjia road, so the transportation is convenient in a whole. According to the feasibility design report and knowledge from relative departments, no valuable minerals was submerged by the reservoir; and no developed dissolving tunnel or concealed river was found, the mountains are solid, so generally, no seepage will happen after the project completion. Moreover, no valuable cultural relics or historic site was found. In the 8 villages submerged by Songshuling Power Station, the cultivate land per capita is 7 Hubei Province Hydropower Project Zhushan Countv Songshuling Hydropower Station Resettlement Action Plan 2.02mu, and 11.25mu for woodland per capita. The land resource is abundant overall, and the hilly land is wide, however, the dry land accounts for 89.8% of the total, the grain land per capita in 1999 is 359kg. The basic economic condition in 8 villages of Guandu, Liulin and Liangjia Town is detailed in Table 2-1, 2-2, 2-3, and 2-4. The agricultural land per capita is 31% higher than that of the whole county, and net income per capita is 4. 1% lower than that of the whole county, so the overall level is a little lower than the whole county. Foresting income accounts for 11.9%; (3). The other income accounts for 40.1 %. According to the material index survey, of the 8 administrative villages, land acquisition affect Sangping, Yangpo, Puxi, Taoyuan, Tianchiya, five villages, for the other villages, only involves resettlement and housing relocating. Of the 5 villages affected by land acquisition, by the end of 1999, the cultivate land per capita is 1.94muz woodland per capita is 15.47mu, net income of the villagers is 1365 yuan. Of the total economic income, planting accounts for 45.1%,foresting accounts for 10.8%, industry accounts for 28.9%, transportation accounts for 2.7%, business and service accounts for 2.1 %, and 10.4% for the other items. 2.3. Basic product and living condition of the households affected by land requisition and relocating Land requisition of Songshuling Power Station involves three towns or townships, including 8 administrative villages and 17 village groups. From the main affected households, 51 sample households have been selected for survey, with 227 persons(14 from non-agricultural resident), who were from all of the affected villages and groups. From the survey: Employment status: of the 51 households, laborforce 145 persons(including 64 women), 68 for agricultural product, accounting for 47% of the total, of who 33 persons have gone out for working, accounting for 22%, 21 persons for business and service, accounting for 14% of the total. Land contracting status: the total land contracted of the 51 households is 968.36mu, of which 325.96mu for cultivate land, 4.27mu land per capita, and 1.436mu cultivate land per capita, the mean grain per capita is 376kg. House area: according to survey from sample households, the house area per capita is 46.2m3, of which civil and wood structure accounts for 37.9%, brick and wood structure accounts for 28.5%, stone and wood structure accounts for 15.5%, brick fixed structure accounts for 10.1 %, grass and wood structure accounts for 3.1 %. The house land per capita is large, mainly due to the large house land per capita at the dock of Liulin Township, tail of the reservoir, with a house land per capita of 59m2. The economy there is relatively developed, the shops there stand in great numbers, and many people passing there. Moreover, it has convent traffic, just a transporting stop for entering and outgoing. The house land per capita in other town(ship)s is 36m2 about. Income: for the 51 sample households, the total income in 1999 is 1.148 million yuan, of which (I) agriculture,269000 yuan, accounts for 23.4%;55000 yuan for industry, accounts for 4.7%, (3). 92000 yuan for traffic, accounts for 8%; (4). 355000 yuan for business and service, accounts for 30.9%;(5). For outgoing work,257000 yuan, accounts for 22.4%;(6) 112000 yuan for other income, accounts for 8.9%. The net income is 2989 yuan. infrastructures and others: In every administrative village, there are primary school, hospital, shops and auxiliaries. At present, 90% of the villagers have got power, and 50% of them have used running water(which is drawn down from the mountain, but there are still two villages without roads. Project Impact 3.1. Reservoir inundated scope The normal water level of Songshuling Hydropower Station is 394km(as Huanghai sign), from the dam to the end of the feedback water the length is 19km; and the area of the reservoir is 2.74km2. According to "Design Standard for Reservoir Inundation" and the "Prospecting Table for Water Feedback of Songshuling Power Station", which was provided by Hubei Province Water and Electricity Design and Institute on April 24, 2000, and combining with the actual condition of the reservoir area, the designed flood standard of reservoir submerge is as following: A.For the country residential district, enterprises or department, roads, bridges, power frastructures, telegram frastructures, the flood feedback line will be deternined according to once twenty years(p=5%); B. For cultivate land garden land, it will be ascertained according to once five years(p=20%); C. For woodland, it will be disposed as normal water level; D.To ascertain the tail of the reservoir, the crossing cut down scale, which has the same frequency and lower within 0.3m at the water level, will be defined as horizontal intending place. At the front of the dam, considering the impact of wave and wind, the survey level of p=5% section will be added Im, and 0.5m will be added to p=20% section, so as to ensure the safety. The feedback water survey result of Songshuling Hydropower Station area is detailed in Table 3-1. The land occupied above all belongs to Jiazhu Village, in Guandu Town. By the end of 1999, the village has 212 households, with a total population of 880 persons(all agricultural residence), 1142mu for cultivate land(196mu for paddy land, 946mu for dry land), cultivate land per capita is 1.3mu, generally no cultivate land was impacted by the project. And there are 2100mu woodland in the village, with 2.4mu per capita. After land requisition, the woodland per capita is 2.3mu, only 0.1mu less than that before land requisition. And during the construction period of four years, the village can take advantage of its special geography part, develop some service business, and make out advantage condition for the economy development, so the project construction has little impact to the village. In 1999, the net income of Jiazhu Village is 1349 yuan. 3.2. Project Impact Survey In the first ten days of April, 2000, the inventory index survey work was carried out by a "Inventory Index Survey Group Impacted by Songshuling Project", under the leading of Zhushan County Government which was composed by Zhushan Water and Electricity Development Cop.Ltd.. Zhushan Resettlement Bureau, ECIDI, and with the support of the survey members of the project group, in Zhushan Hydropower Bureau. The survey group surveyed the affected inventory data and the local national economy materials, developing scale. And the survey group entered the inundated area, project occupied land and temporary land for construction to make survey house by house. With the support of the cadres in relative town(ship) or village cadres, the survey work lasted half a month, and the survey result have been ensured by the relative town(ship)s, the main contents and means is as followings: Population Investigation: Based on the actual population in 1999. and make an administrative village or group as an unit, investigate the population in the affected area house to house according to agricultural and non-agricultural ones. Land investigation: according to the actual conducted height, measured the land by different villages, groups, and households and by different categories (cultivate land. garden land. woodland and house site). House investigation: taking an administrative village or a group as a unit, measured the house affected or inundated by households and structures(fixed brick, brick and wood, stone and wood, soil and wood, grass and wood, simple house), the land area was also calculated. Specific frastructures investigation: investigated and measured and remarked the roads, bridges, power lines, telegram lines, docks, etc, affected by the project. Collected the economy calculation yearly report and the local development schedule of the relative town(ship)s, villages, and groups in 1997,1998,1999. 15 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan 3.3. Project affected inventory indexes The affection of land requisition for the project involved 3 town(ship)s, 9 administrative villages, 18 village groups, 52 households with 214 persons, 9889m2 for houses relocated; 316.1mu for cultivate land was requisitioned, 378.5mu for woodland was requisitioned, 22.74mu for house site was requisitioned; 397 scattered trees and 1891 other trees were cut down; submerge affected roads 5.lkm, tractor roads 0.85km, power lines 4.4km, ray cable line 6.26km, two bridges, a small hydropower station. Socio-economy analysis on impaction of the inundated area Affection of inundation involved Sangping, Yangpo, Taoyuan, Puxi, four administrative villages in Guandu Town, Liuhe, Daping, Laozhu, three administrative villages in Liulin Township, and Tianchiya, an administrative village in Liangjia Township, totaling 17 village groups were affected. The 8 administrative villages has a population of 4678, 216 of them would be involved in relocation, accounting for 4.6%, and production resettlement population is 176 persons, accounting for 3.7%. The number variation of cultivates land and woodland after land requisition of the villages is shown in Table 3-5. The land requisition is shown in Table 5-1. In another word, after project construction, part of the land was acquisition, but the basic grain ration can be ensured. Overall, project land requisition had little impact on the 8 administrative villages. The loss of project cultivate land requisition will be analyzed in Table 3-6 by proportion of the yearly total income. (take 1999 as an example). Resettlement Policy Framework 4.1. Policy Basis Main legal and policy bases for requisition and resettlement of the project: A. Main relative specifications of"Land Administration Law of the People's Republic of China" Chapter O Ownership of Land and Right to the Use of Land Article 8 Land in the urban areas of cities shall be owned by the State. Land in rural and suburban areas shall be owned by peasant collectives, except for those portions which belong to the State as provided for by law; house sites and private plots of cropland and hilly land shall also be owned by peasant collectives. 25 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan Article 10 Land owned by peasant collectives that belongs lawfully to peasant collectives of a village shall be operated and managed by collective economic organizations of the village or by villagers' committees; land already owned by different peasant collectives that belong to two or more different collective economic organizations in the village shall be operated and managed by the rural collective economic organizations in the village or by villagers' teams; land already owned by peasant collectives of a township (town) shall be operated and managed by rural collective economic organizations of the township (town). Article 11 Land owned by peasant collectives shall by registered and recorded by people's governnents at the county level, which shall, upon verification, issue certificates to confirm the ownership of such land. Land owned by peasant collectives to be lawfully used for non-agricultural construction shall be registered and recorded by people's govermnents at the county level, which shall, upon verification, issue certificates to confirm the right to the use of the land for such construction. State-owned land to be lawfully used by units or individuals shall be registered and recorded by people's governments at or above the county level, which shall, upon verification, issue certificates to confirm their right to the use of such land. The specific organs for registration and issue of certificates for State-owned land to be used by central State organs shall be determined by the State Council. Ownership or the right to the use of forest land or grassland and the right to the use of water surfaces or tidal flats for aquaculture shall be confirned respectively in accordance with the relevant provisions of the Forestry Law, the Grassland Law and the Fisheries Law of the people's Republic of China. Article 12 Any change to be lawfully made in land ownership, in the right to the use of land or in the purpose of use of land shall be registered. Article 13 The lawfully registered ownership of land and right to the use of land shall be protected by law and may not be infringed upon by any units or individuals. Article 14 Land owned by peasant collectives shall be operated under a contract by members of the economic organizations of the peasant collectives for crop cultivation, forestry, animal husbandry of fishery. The duration of such contract in 30 years. The party that gives out a contract and the party that undertakes it shall sign a contract in which to stipulate the rights and obligations of both parties. A peasant who undertakes to operate a piece of land under a contract shall have the obligation to protect the land and rationally use it in conformity with the purposes of use provided for in the contract. The right of a peasant to operate land under a contract shall be protected by law. Within the duration of the contract for operation of land, any appropriate readjustment of the land between individual contractors shall be made with the agreement of at least two-thirds of the members of the villagers assembly or of the representatives of villagers and submitted to the township (town) people's government and the agriculture administration department of the people's government of the county for approval. Chapter 0 Overall Plans for Land Utilization Article 19 Overall plans for land utilization shall be drawn up in accordance with the 26 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan following principles: (1) to strictly protect the capital farm land and keep land for agriculture under control lest in should be occupied and used for non-agricultural construction; (2) to increase the land utilization ratio; (3) to make overall planning for the use of land for different purpose and in different areas; (4) to protect and improve ecological environment and guarantee the sustainable use of land; and (5) to maintain balance between the amount of cultivated land used for other purpose and the amount of land developed and reclaimed. Article 22 The amount of land to be used for urban construction shall conform to the norm set by State regulations. Attention shall be paid to making full use of the existing land for construction and using little or no land for agriculture. The overall plans of cities and the plans of villages and towns shall be dovetailed with the overall plan for land utilization, and the amounted of land to be used for construction fixed in the former shall not exceed the amount fixed in the latter for the cities, villages and towns. In the areas covered by the plans of cities, villages and towns, the amount of land to be used for construction shall conform to the amount as is fixed in such plans. Article 24 People's governments at all levels shall exercise close supervision over the plans for land utilization and keep control over the total amount of land used for construction. Article 26 Any revision of an approved overall plan for land utilization shall be subject to approval by the organ that originally approval the plan; without such approval, no change may be made in the purposes of land use as prescribed in the overall plan for land utilization. Where a change needs to be made in an overall plan for land utilization to meet the demand of land for the construction of such large infrastructure projects as energy, communications or water conservancy projects that have been approval by the State Council, it shall be made in accordance with the document of approval issued by the State Council. Where a change needs to be made in an overall plan for land utilization to meet the demand of land for the construction of such infrastructure projects as energy, communications or water conservancy projects that have been approved by people's governments of provinces, autonomous regions or municipalities directly under the Central Government and the plan is under the approval authority of a people's government at the provincial level, the change shall be made in accordance with the document of approval issued by such government. Chapter O Protection of Cultivated Land Article 31 The State protects cultivated land and strictly controls conversion of cultivated land to non-cultivated land. The State applies the system of compensation for use of cultivated land for other purposes. The principle of "reclaiming the same amount of land as is used" shall be applied to any unit 27 Hubei Province Hydropower Project Zhushan County Songshuling Hvdropower Station Resettlement Action Plan that, with approval, uses cultivated land for construction of non-agriculture projects, that is, the unit shall be responsible for reclaiming the same amount and quality of the cultivated land it uses. If conditions for such reclamation do not exist or if the reclaimed land fails to meet the requirements, the unit shall pay expenses for reclamation in accordance with the regulations set by people's governments of provinces, autonomous regions and municipalities directly under the Central Government and the money shall exclusively be used for reclamation. People's governments of provinces, autonomous regions and municipalities directly under the Central Government shall formulate plans for land reclamation, see that the unit that uses cultivated land reclaims land according to plan or arrange reclamation according to plan, and conduct inspection before acceptance. Article 32 Local people's governments at or above the county level may require the units that wish to use cultivated land to remove the arable layer of cultivated land to the reclaimed land or to land of inferior quality, or to other cultivated land for improving soil. Article 33 People's governments of provinces, autonomous regions and municipalities directly under the Central Government shall strictly implement the overall plans and annual plans for land utilization and take measures to ensure that the total amount of cultivated land within their administrative areas remains unreduced, where the total amount of cultivated land is reduced, the State Council shall order the government concerned to reclaim land of the same quality and amount as is reduced within a time limit, and the land administration department together with the agriculture administration department under the State Council shall inspect the land reclaimed before acceptance, where individual governments of provinces or municipalities directly under the Central Government, for lack of land reserves, cannot reclaim enough land to make up for the cultivated land they used for additional construction projects, they shall apply to the State Council for approval of their reclaiming less or no land within their own administrative areas but of their reclaiming land in other areas. Article 36 In non-agricultural construction, attention shall be paid to economizing on the use of land. Where wasteland can be used, no cultivated land may be used; where land of interior quality can be used, no land of superior quality may be used. Article 41 The State encourages land revitalization. County and township (town) people's governments shall make arrangements for rural collective economic organizations to conduct, in accordance with overall plans for land utilization, all-round improvement of the fields, water conservancy, roads and forests and development of the villages in order to improve the quality of the cultivated land, increase the efficient area of cultivated land and better the conditions of agricultural production and the ecological environment. Local people's governments at all levels shall take measures to transform the medium- and low-yield fields and improve idle and waste land. Article 42 Land users that cause damage to land as a result of digging, subsiding or crumbling under heavy weight shall be responsible for re-cultivating the land in accordance with the relevant regulations of the State. Where conditions do not permit such re-cultivation or the land re-cultivated does not meet the requirements, the user shall pay charges for re- cultivation, which shall exclusively be used for the purpose, The land re-cultivated shall first be used for agriculture. 28 Hubei Province Hydropower Project Zhushan Countv Songshuling Hydropower Station Resettlement Action Plan Chapter E: Land to be Used for Construction Article 43 All units and individuals that need land for construction purposes shall, in accordance with law, apply for the use of State-owned land, with the exception of the ones that have lawfully obtained approval of using the land owned by peasant collectives of their own collective economic organizations to build township or town enterprises or to build houses for villagers and the ones that have lawfully obtained approval of using the land owned by peasant collectives to build public utilities or public welfare undertakings of a township (town) or village. "The State-owned land" mentioned in the preceding paragraph includes land owned by the State and land originally owned by peasant collectives but requisitioned by the State. Article 44 Where land for agriculture in to be used for construction purpose, the fornalities of examination and approval shall be gone through for the conversion of use. Where land for agriculture is to be converted to land for the construction of road, pipeline or large infrastructure projects, for which approval has been obtained from people's governments of provinces, autonomous regions and municipalities directly under the Central Government, or for the construction of project, for which approval has been obtained from the State Council, the conversion shall be subject to approval by the State Council. Where land for agriculture is to be converted to land for construction of projects in different periods in order to carry out the overall plan for land utilization within the limits of the amount of land fixed in the plan for the construction of cities, villages or towns, the conversion of use of land shall, in accordance with the annual plan for land utilization, be subject to approval in batches by the organ that originally approved the overall plan for land utilization. Approval for the use of land for construction of specific projects within the limits of the amount of land for agriculture, conversion of the use of which has been approved, may be obtained from people's governments of cities or counties. Where land for agriculture is to be converted to land for construction projects other than what is provided for in the second and third paragraphs of this Article, the conversion shall be subject to approval by people's governments of provinces, autonomous regions and municipalities directly under the Central Government. Article 45 Approval shall be obtained from the State Council for requisition of the following land: (1) capital farm land; (2) cultivated land, not included in capital farm land, that exceeds 35 hectares; and (3) other land that exceeds 70 hectares. Requisition of land other than that provided for in the preceding paragraph shall be subject to approval of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and be submitted to the State Council for the record. Land for agriculture shall be requisitioned after conversion of use of the land is examined and approved in accordance with the provinces of Article 44 of this Law. Where conversion of use 29 Hubei Province Hydropower Project Zhushan Countv Songshuling Hydropower Station Resettlement Action Plan of such land is subject to approval by the State Council, requisition of the land shall be examined and approved at the same time, and there is no need to go through the formalities of examination and approval for the requisition separately. Where conversion of use of land is subject to approval by people's governments of provinces, autonomous regions and municipalities directly under the Central Government within the limits of their approval authority over the requisition of land, requisition of the land shall be exarnined and approved at the same time, and there is no need to go through the formalities of examination and approval for the requisition separately; if the land to be requisitioned is beyond the limits of their approval authority, it shall be examined and approved separately in accordance with the provisions of the first paragraph of this Article. Article 46 Where land is to be requisitioned by the State, the requisition shall, after approval is obtained through legal procedure, be announced by people's governments at or above the county level, which shall help execute the requisition. Units and individuals that own or have the right to the use of the land under requisition shall, within the time limit fixed in the announcement, register for compensation with the land administration department of the local people's government by presenting their certificates of land ownership or land-use right. Article 47 Land requisitioned shall be compensated for on the basis of its original purpose of use. Compensation for requisitioned cultivated land shall include compensation for land, resettlement subsidies and attachments and young crops on the requisitioned land. Compensation for requisition of cultivated land shall be six to ten times the average annual output value of the requisitioned land for three years preceding such requisition. Resettlement subsidies for requisition of cultivated land shall be calculated according to the agricultural population needing to be resettled. The agricultural population needing to be resettled shall be calculated by dividing the amount of requisitioned cultivated land by the average amount of the original cultivated land per person of the unit the land of which is requisitioned. The standard resettlement subsidies to be divided among members of the agricultural population needing resettlement shall be four to six times the average annual output value of the requisitioned cultivated land for three years preceding such requisition. However, the highest resettlement subsidies for each hectare of the requisitioned cultivated land shall not exceed fifteen time its average annual output value for the three years preceding such requisition. Standards of land compensation and resettlement subsidies for requisition of other types of land shall be prescribed by provinces, autonomous regions and municipalities directly under the Central Government with reference to the standards of compensation and resettlement subsidies for requisition of cultivated land. Standards for compensation for attachments and young crops on the requisitioned land shall be prescribed by provinces, autonomous regions and municipalities directly under the Central Government. For requisition of vegetable plots in city suburbs, the land users shall pay towards a development and construction fund for new vegetable plots in accordance with the relevant regulations of the State. If land compensation and resettlement subsidies paid in accordance with the provisions of the 30 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan second paragraph of the Article are still insufficient to help the peasants needing resettlement to maintain their original living standards, the resettlement subsidies may be increased upon approval by people's governments of provinces, autonomous regions and municipalities directly under the Central Government. However, the total land compensation and resettlement subsidies shall not exceed 30 times the average annual output value of the requisitioned land for the three years preceding such requisition. The State Council may, in light of the level of social and economic development and under special circumstances, raise the standards of land compensation and resettlement subsidies for requisition of cultivated land. Article 48 Once a plan for compensation and resettlement subsidies for requisition land is decided on, the local people's government concerned shall make is known to the general public and solicit comments and suggestions from the collective economic organizations, the land of which is requisitioned, and the peasants. Article 49 The rural collective economic organization, the land of which is requisitioned, shall accept supervision by making known to its members the income and expenses of the compensation received for land requisition. The compensation and other charges paid to the unit for its land requisitioned is forbidden to be embezzled or misappropriated. Article 50 Local people's governments at all levels shall support the rural collective economic organizations, the land of which is requisitioned, and the peasants in their efforts to engage in development or business operation or to start enterprises. Article 51 The standard of compensation for requisition of land to build large or medium- sized water conservancy or hydroelectric projects and the measures for resettling relocated people shall be prescribed separately by the State Council. Article 52 During the feasibility study of a construction project, land administration department may, in accordance with the overall plan for land utilization, the annual plan for land utilization and the standard amount of land for the use of construction, examine the matters related to lane for construction and offer its comments and suggestions. Article 53 Where a construction unit needs to use State-owned land for construction of its approved projects, it shall apply to the land administration department of the people's government at or above the county level that has the approval authority by presenting the relevant documents as required by laws and regulations, The said department shall examine the application before submitting it to the people's government at the corresponding level for approval. Article 54 A construction unit that to use State-owned land shall get it by such means of compensation as assignrment. However, land to be used for the following purposes may be allocated with the approval of a people's government at or above the county level: (1) FOR State organs or military purposes; (2) For urban infrastructure projects or public welfare undertakings; 31 Hubei Province Hydropower Project Zhushan Countv Songshuling Hydropower Station Resettlement Action Plan (3) For major energy, communications, water conservancy and other infrastructure projects supported by the State; and (4) Other purposes as provided for by laws or administrative regulations. Article 55 A construction unit that obtains right to the use of State-owned land by such means of compensation as assignment shall, in keeping with the standards and measures prescribed by the State Council, pay among other charges compensation for use of land such as charges for the assignment of land-use right, before if can use the land. As of the date of implementation of this Law, 30 percent of the compensation paid for the use of additional land for construction shall go to the Central Government and 70 percent to the local people's govenunents concerned, both of which shall exclusively be use for developing cultivated land. Article 56 A construction unit that uses State-owned land shall use the land in agreement with the stipulations of the contract governing compensation for the use of land such as the assignment of the land-use right or the provisions in the documents of approval for allocation of the land-use right. Where it is definitely necessary to change the purposes of construction on this land, the matter shall be subject to agreement by the land administration department of the people's government that originally approved the use of lane. Where the land the purposes of use of which need to be changed is located in the area under urban planning, the matter shall be subject to agreement by the urban planning administration department concerned before it is submitted for approval. Article 57 Where land owned by the State or by peasant collectives need to be used temporarily for construction of projects or for geologic prospecting, the matter shall be subject to approval by the land administration departments of people's governments at or above the county level. However, if the land to be temporarily used in located in the area covered by urban planning, the matter shall be subject to agreement by the urban planning administration department concerned before it is submitted for approval. The land user shall, depending on who owns the land and who has the land-use right, enter into a contract for the temporary use of the land with the land administration department concerned, or the rural collective economic organization, or the villagers committee and pay compensation for it in accordance with the provisions of the contract. The temporary land user shall use the land for purposes stipulated in the contract for temporary use of the land and may not build permanent structures on it. Generally, the period for temporary use of land shall not exceed two years. Article 58 Under any of the following circumstances, the land administration department of the people's government concerned may, with the approval of the people's government that has originally approved the use of land or that possesses the approval authority, take back the right to the use of the State-owned land: (1) The land is needed for the benefits of the public; (2) The use of the land needs to be readjusted for renovating the old urban area according to urban planning; 32 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan (3) At the expiration of the period stipulated in the contract for use of the land by such means of compensation as land assignment, the land user has not applied for extending the period or, if he has applied for such extension, the application is not approved; (4) The use of the originally allocated State-owned land is terminated because, among other things, the unit that uses the land is dissolved or moved away; or (5) The highways, railways, airports or ore fields are abandoned with approval. The user granted with the land-use right shall be compensated appropriately when its right to the use of State-owned land is taken back according to the provisions of sub-paragraph (1) and (2) in the preceding paragraph. Article 61 Where land to be used for the construction of township (town) or village public utilities or public welfare undertakings, the matter shall be subject to examination and verification by the township (town) people's government, which shall submit an application to the land administration department of the local people's government at or above the county level for approval by the said people's government within the limits of approval authority as defined by the province, autonomous region and municipality directly under the Central Government. However, if land for agriculture is to be used for the purpose, the matter shall be subject to examination and approval in accordance with the provisions of Article 44 of this Law. Article 62 For villagers, one household shall have only one house site, the area of which may not exceed the standard set by provinces, autonomous regions and municipalities directly under the Central Government. Villagers shall build residences in keeping with the township (town) overall plan for land utilization and shall be encouraged to use their original house sites or idle lots in the village. Land to be used by villagers to build residences shall be subject to examination and verification by the township (town) people's government. However, if land for agriculture is to be used for the purpose, the matter shall be subject to examination and approval in accordance with the provision of Article 44 of this Law. Approval for other house sites shall not be granted to villagers who have sold or leased their houses. Article 63 No right to the use of land owned by peasant collectives may be assigned, transferred or leased for non-agricultural construction, with the exception of enterprises that have lawfully obtained land for construction in conformity with the overall plan for land utilization but have to transfer, according to law, their land-use right because of bankruptcy of merging or for other reasons. Article 64 No building or structure built before the overall plan for land utilization is drawn up and at variance with the purposes defined in such a plan may be rebuilt or expanded. Article 65 Under any of the following circumstance, a rural collective economic organization may, with the approval of the people's government that originally approved the use of land, take back the land-use right: 33 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan (1) The land is needed for constructing township (town) or village public utilities of public welfare undertakings; (2) The land is used at variance with the approved purposes; or (3) The use of land is terminated because, among other things, the unit concerned is dissolved or moved away. The user granted with the land-use right shall be compensated appropriately when the land owned by the peasant collective is taken back according to the provisions of subparagraph (1) of the preceding paragraph of this Article. 4.2.2. Specifications of Rules for Compensation of Land Acquisition and Resettlement for Middle and Large Water Resources and Hydropower Projects Section 1. General Article 4: The following principles shall be performed for compensation of land acquisition and resettlement of water resources and hydropower projects: (1) The relation between the state, collective and individual shall be correctly treated. The resettlement area and host area shall obey the national interest. (2) The resettlement and construction of reservoir area shall combine with local economy and natural resources to raise gradually or over the original living standard of resettlers. (3) The resettlement shall consider local condition, and resources of reservoir area shall be reasonably used under full planning. Resettlers shall settle down in original place or a higher place nearby. If no available condition, the ways for reclamation of flood plain, reallocating land and relocating outside, etc. shall be adopted. All these actions shall follow the relative rules of law and regulations. Section II. Compensation for land acquisition Article 5: For land acquisition of middle and large water resources and hydropower projects, the construction unit shall pay following land compensation fee and resettlement subsidy: (I) The compensation standard of land acquisition will be 3 to 4 times of the annual output value per mu for three years before land acquisition. The resettlement subsidy standard for each farmer will be 2 to 3 times of the annual output value per mu for three years before land acquisition. (2) The resettlement subsidy standard for the other type of land acquisition shall be specified by each province, autonomous region, and municipality referring item (I) herein. Article 6: If the land compensation and resettlement subsidies are paid on the base of Art. 5, the resettlement subsidies can be increased in case that the living standard of the resettler can not keep the original level. But total amount of the land compensation and resettlernent subsidies shall not exceed the following times of the average output value per mu for 3 years before the land acquisition. 34 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan (1) above lmu cultivated land per capita in reservoir area (including damsite) not exceed 8 times (2) 0.5-lmu cultivated land per capita in reservoir area (including damsite) not exceed 12 times (3) under 0.5mu cultivated land per capita in reservoir area (including damsite) not exceed 20 times Section III. Resettlement Article 12: The resettlers from water resources and hydropower project shall settle down within village and county area. If it is not available, they shall be settled down in the beneficial zone of the project. And if it is still not possible, they shall be moved to other area based on the reasonable conditions. The surplus labor caused by land acquisition of water resources and hydropower project shall be arranged by relative department organized by the local government to develop agriculture, sideline production and village-owned enterprises. Article 13: For those resettlers who move voluntarily to their relatives' family or friend's family, the governments of native place and host place shall sign agreement with resettlers. The corresponding subsidies for land acquisition and resettlement shall be paid by native government to host area government for unified arrangement of production and living. Article 15: According to the resettlement planing, resettlers shall be not allowed to be delay and reject the relocation. And, resettlers shall be not allowed to return at will when they settle down. 4.2.4. Pertinent Regulations of Enforcement Approach of Land Management Hubei Province Chapter 4 Arable Land Protection Article 16 Protection system of basic farmland should be enforced. The people's governments at all levels should, in accordance with the protection objective of basic farmland, plan protection zones of basic farmland. The protection and management of basic farmland should be enforced in the light of related laws and regulations. Article 17 Compensation system of requisitioned field land should be enforced. Non- agricultural construction which requisitions field land under approval should, in accordance with the principle of "How much is requisitioned, How much should be reclaimed", take responsibility to reclaim the farmland in the same size and quality as the requisitioned land. If reclaiming conditions are unavailable or the reclaimed land does not meet the requirements, field land reclamation fees should be paid in accordance with the following standards: (1) If basic farmland is requisitioned, the payment is from 1.5 times to 2 times of land compensation. (2) If field land other than basic farmland is requisitioned, the payment is from 1 time to 1.5 times of land compensation. 35 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan Arable land reclamation fees should be included in gross investment of construction project. Specific management approaches of collection and use of field land reclamation fees will be formulated separately by the provincial government. Chapter 5 Construction Land Article 26 As for requisition, land compensation, resettlement allowance and compensation for ground attachment and young crops: (1) Land compensation is from 6 times to 10 times of the annual output value of the requisitioned field land over the previous three years. As for other land, land compensation is from 5 to 6 times of the annual output value of the nearby field-land over the previous three years. As for young crops, compensation should be offered according to their output value. If their output value can not be figured out, rational compensation should be offered. As for buildings and other ground attachment, rational compensation should be offered according to their market prices. As for rush planting and rush construction, which is conducted after the publication of requisition plan, compensation is prohibited. (2) As for resettled agricultural population, resettlement allowance is from 4 to 6 times of the annual output value of the requisitioned land over the previous three years. As for requisitioned field land per acre, resettlement allowance will not exceed 15 times of the annual output value of the land over the previous three years. As for other land bringing profits, resettlement allowance is from 4 times to 6 times of the nearby field land over the previous three years. As for land without profits, there is no resettlement allowance. (3) If land compensation and resettlement allowance issued in accordance with item (1) and (2) cannot keep up the former living standard of resettled peasants, resettlement allowance will be increased under approval of the provincial government. But the total sum of land compensation and resettlement allowance should not exceed 30 times of the annual output value of the requisitioned land over the previous three years. Article 33 As for residential land, peasant should file a land use application to village committee, examined by town (township) government and approved by county government. If farmland is requisitioned, Article 24 of this enforcement approach will be applied. As for the total homestead area of house construction and reconstruction including accessories, the area of farmland used per household should not exceed 140 square meters, the area of unused land (construction land) per household should not exceed 200 square meters. Within the above-mentioned limit, municipal and county governments can determine residential land standard in their administrative region according to local per capita farmland status. 4.3. Policy and Principle of Inhabitant Resettlement 4.3.1. Policy The resettlement policy for the resettlement work of YPSPP is: The resettlement work shall be conducted with due respect and consideration to the local tradition and habit in production and living, with full consideration of the willing of the resettlers. Based on that the original production and living mode will not be changed, the effort will be mainly made in resettlement procedures to develop planting production by using the local 36 Hubei Province Hydropower Project Zhushan County Songshuling Hvdropower Station Resettlement Action Plan land resource and exploitable natural resource in the original town (ship) and villages, and concurrently to develop the secondary and tertiary industries in local area. The inhabitant resettlement shall first be based on guaranteeing the basic substance and provide possibility for long-term development. The local land resource shall be fully utilized for development through resettlement, so as to reach the target of long-term prosperity. 4.3.2. Principles A. Resettlement planning should be based on the property indexes and compensation standards to improve, or at least to restore the original production and living conditions of the resettlers. B. The resettlement of the project shall be combined with the regional construction, resource development, economic development and environment protection. Considering the actual local conditions, practical and feasible measure shall be worked out for restoring and developing the production and living of the resettlers case by case, meanwhile, some necessary conditions shall be created for self-development of the resettlers. C. Planning should be based on the principle "Beneficial to the production and make the life convenient". D. Construction scale and standards of the resettlement project should be guided by the original scale and standards. Investment should be based on the quota planning. Investment for enlarging the scale, improving standards and future planning should be treated by the local government and relative departments. E. All factors should be taken into consideration. Benefits between the stateLIcollectives and individuals should be dealt with properly. F. By adopting the method of paying compensation and granting subsidies in pre-stage and production support in post-stage, and fully using the local natural resources, efforts shall be made to guarantee the resettlers production and living level to reach or exceed the original level before resettlement. 37 Hubei Province Hydropower Project Zhushan Countv Songshuling Hvdropower Station Resettlement Action Plan 5. Plan for Resettlement and Restoration Under the leadership of Zhushan County Government, directed by ECIDI, and based on Songshuling Hydropower Station Feasibility Design in Zhushan County, Hubei Province, the planning work of resettlement for Songshuling project(including those for the reservoir inundated area, areas for permanent construction and temporary use) was drawn up according to the present policies, laws and the request of the World Bank. 5.1. Target and Task 5.1.1. Determination of the level year According to the whole progress of the project planning, the project will be commenced in 2001 and put into operation in 2005, with a total construction period of 4 years. In order to cooperate with the construction, the resettlement work will be completed in two periods, 70% of the work will be completed by the end of 2001, the rest will be completed in 2002, so 2001 was determined as the resettlement level year. 5.1.2. Task of Resettlement Calculated according to the impacted population of the project from the survey result in 2000, and the nature increasing rate by 5.2%%, in 2001, 276 persons will be resettled in the reservoir area(including removal and production resettlement), among 14 persons of non- agriculture residence. The resettlement number of the villages is shown in Table 5-1. Resettlement Objects Due to the inundation, the previous production and living system was damaged, so was the habit and net formed in a long period, but at the same time, a chance for house rebuilding, 38 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan improving their production and living level and developing the economy was provided. So the survey and study work must be done carefully, after analysis and contrast again and again, requiring the opinions of the people widely, the practicable resettlement plan will be formulated, thus wonderful outer condition and environment will be created and the resettlers can find their way out on production and living, and every labor force will be arranged reasonably, at last the production and living level will be improved. According to the present economic status on the resettlement area, and contrast with the Zhushan County "Ninth Five" and "Tenth Five" developing plan, the economic developing target of project resettlement was ascertained: Grain per capita is 660kg; Net income per capita of the resettlers is 1600 yuan; 2. Housing area per capita is 46m ; Public infrastructures, social welfare level, traffic, post and communication, medical treatment and hygiene, going to school of the children will be better than that before removal. 5.2. Environmental Capacity Evaluation The project inundation involved Sangping. Yangpo, Puxi, Taoyuan, Tianchiya, Liuhe, Laozhu, Daping, 8 administrative villages, but of them Liuhe, Laozhu, Daping are at the end of the reservoir area, the cultivate land and woodland was affected basically. According to the geography position and the business feature of the resetters, most of who are going for trading and service, after full investigation and choice of the designations, measures of building a new dam against flood for protection will be adopted, so that the previous living environment will not be affected basically, and to keep their production and living means unchanged. Now the production and living enviromnent of the resettlers in Sangping, Yangpo, Puxi, Taoyuan, Tianchiya will be mainly analyzed. According to site survey, the living condition of the resettlers is bad, most of the houses were built during 70s, and they were far from the village committee seat. The residence pots were scattered, and most of their houses were by the river, so sometimes flood will come to the threshold. Only one to two and four to five for most lived together, and their collective living was poor, and with bad traffic condition. Through the project land requisition and resettlement, opportunity for improving living environment will be brought to the resettlers. The cultivate land per capita is 1.82mu, 0.8 1mu for the least and 3.8 mu for the most, only one group, with 83 persons, 3.3% of the total, got a land per capita lower than lmu,6 groups, with 847 persons, 33.8% of the total. Of the 8 administrative villages, impact is only for houses but not for cultivate land for three villages. Now according to the important position, after consultation and study, protection measure will be adopted for the affected houses, so the project has little impact on the 41 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan production and living of the three villages. The other administrative villages, have 11 village groups, with 379 households, 1708 persons, cultivate land 271 lmu, with 1.59mu per capita, 0.84mu for the least and 2.86mu for the most, not the same. The village group with a cultivate land per capita lower than lmu has 126 persons, accounting for 7.3% of the totaling; three of them have a cultivate land per capita more than 2mu, with 357 persons, accounting for 20.9% of the total. For the project construction, 52 households, with 116 persons will be relocated, and 315.1mu cultivate land will be requisitioned. All these are detailed in Table 5-4. Two village groups had got cultivate land per capita lower than I mu, with 224 persons, accounting for 16.5% of the total, and two village groups had got a cultivate land per capita of higher than 2mu, with 229 persons, accounting for 16.9% of the total. From the analysis above, after land requisition, the land resource in local place is abundant, 0.84mu for the least, which can ensure the basic grain ration. Every village had enough places 42 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan for resettlement, although the numbers of resettlers are small to the total population. At the same time, the compensation was put into the production and construction. Then under the premise of ensuring that the grain can be self-provided to the villagers, through woodland management, aquatic, bamboo and wood processing, tourist traffic, etc., the development of No.2 and No.3 industry, the production and living level will be soon restored, moreover, condition will be created for the resettlers to reach or pass the previous living level. After land requisition, the local production and living was impacted at a certain degree, so the present land resource will be used plainly and will be treated. At the same time, the resettlers will be taught of specific knowledge for scientific farming. According to the planning of the affected villages, the rest cultivate land after requisition of Puxi, Sangping, Yangpo will be adjusted in the whole village, for Taoyuan and Tianchiya, and it will be done in the very group. Through the project resettlement, the condition of improving the production and living stable will be created for the resettlers. 5.3. Overall Plan for Resettlement 5.3.1. Selecting of the scheme According to the numbers of the resettlers, combining with the present status of abundant land resource and local economic developing potentiality, after comprehensive analysis and compression, all-round consideration, it is determined that the resettlers will be resettled within the own town(ship) at the back. Paying attention to the practice, and seeing from the angle of the future, the resettlement scheme was selected and leeway was left for the later development of the resettlers. 5.3.2. Resettlement Means For the resettlers of Sangping, Yangpo, Puxi, Taoyuan and Tianchiya, the five administrative villages affected by inundation, they were most agricultural resettled. Although the mean cultivate land is less than that before land requisition in the five villages, it is still more than that of the county level. At the same time, through hilly changing into ladder shape, dry land changing into paddy land, and adding irrigation frastructure. etc.. The auxiliaries, so as to improve the quality of the cultivate land and the production of grain. then under the premise of ensuring the grain self-providing, tourist, processing. trading. etc. The second and third industries will be carried out to increase their economy income and to ensure the object that they can remove and can also get rich; for the resettlers in Liuhe. Daping, Laozhu, measures of protection will be adopted to ensure they can go in for their previous jobs and their production, living will not be impacted. At the same time, they can grasp the chance of the putting into operation of the power station, make out new way of business and production, more business ways and more production means. Thus they can create better outer environment for stable increasing their economy income. 5.4. Protecting Plan for Reservoir Area The inundation in reservoir area involved 3 administrative villages of Liulin, with 6 village groups, 22 households, 100 persons, 10 of them for non-agricultural residence. In the three villages, only 4.5mu cultivate land without registration is affected by inundation. They lived at the old dock, with convenient traffic of water and land, and the trading, service business, industry transportation, repairing shops stood with a great number, the merchants coming and going stayed there like cloud, so it has long been a place the merchant scrambled badlv 43 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan According to our record household by household, the total income of the 22 household in 1999 was 607840 yuan, with 6078.40 per capita, among it 6008.40 yuan was from the catering and service trade. From the data above, the main economic income was from trade, service, catering. Therefore, to protect this piece of fertilized land, after compression once again, according to the villagers' opinions, project protection was adopted. According to the actual shape and surface of the land, it is designed by the County Water Resource and Power Design Group as below: A dam against flood of 432.8m will be built prospectively, with the top height of 404.5m, the wall is 13.529m in height, the bottom is 4.8m wide, the cutting down face is detailed in Appendix 3: The project quantity: 75# stone laying with liquid 15809.5m3, 150# concrete 1171 .1m3, clearing the base 12226.6m3. Project building price: 75# laying stone with water 15809.5m3...134.28 yuan/m2=2122900 yuan; 150# laying stone with liquid 1171.1 m3x279.28 yuan/m3=327000 yuan; clearing base 12226.6m3x6yuan/m3=73400 yuan; Water drawing facilities: pump house 120000 yuan, equipment 280000 yuan, totaling 400000 yuan. The investigation is totaling 2923400 yuan. 5.5. Resettlement Plan 5.5.1. Production Resettlement Plan After inundation, in Snapping, Yangpo, Puxi, Taoyuan, Tianchiya, the cultivate land and woodland is still plenty, with 1.77mu per capita for cultivate land and 15.47mu for woodland. According to our survey and visit to the cadres and farmers in the villages or groups, they still tend to and used to agricultural production. It is prospectively to resettle 20 persons: Tourist business: take advantage of the specific view and fascinating scene of Lutou Valley in the area, open tourist, traffic affairs. It is prospectively to resettle 10 persons; Aquatic: after retaining water by the hydropower station, take use of the broaden water surface resource, support the net aquatic, go on the way of rich the reservoir and the people. It is prospectively to resettle 8 persons; Enterprise resettlement: take full use of the advantage of the abundant resource of bamboo and wood in the area, support to develop the village opened and household opened processing enterprise of middle and small type, go on the way of deep processing and intricate processing, broaden the selling channels constantly, so that the products can enter market and the income of the resettlers will increase. It is prospectively to resettle 15 persons. 5.5.2. Plan for Skill Training Training for Resettlement cadres 45 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan In March,2000, the officers, sent by Zhushan County Resettlement Office, were trained by the resettlement professioners of ICIDI in Hangzhou. During the training period, to integrate theory with practice, they visited the domestic item- the resettlement of Tongbo Water Pumping Power Station, Shanxi Water Pivotal Project, drawn up the success experience and learned a lesson, and benefited much, from that they made wonderful foundation for the project resettlement. And later in April in the same year, during the social economy survey, determination of inventory indexes, resettlement-planning period, ECIDI sent some persons there to give site direction for the workers. To meet the need of the planting household, it is feasibly determined to have a training on potato planting in the first half of 2001, and a training of cregrette planting in the first of 2002; b). For the households going in for aquatic, organize them to visit and study in the other place; c). For the households going in for tourist, training of service will be given, and the materials for the local scene will be collected, at the same time the propagation work should be well done. C. Later Support for Resettlers According to Regulations for Land Compensation and Resettlement of Big and Middle Style Water and Power Project, it is suggested to set up subsidy fund in the reservoir area so as to keep and support the resettlers' production developing, and to restore and improve their production and living as quickly as possible. Drawing out from the generated enerage on the standard of 200yuan/person, together ten years of that will be drawn out. The fund will be for estimation, but for the cost of power enerage. 5.5.3. Planning for Resettlement Site Layout of Resettlement site (1). Principles Except the resettlement plan, it will based on the following principles: the original residences are willing and welcome to receive the resettlers; the resettlement site environment capacity is enough and the land resource is ascertained. With convenient traffic, perfect infrastructures and social service net; It is convenient for the resettlers' production, generally, the working site is no more than 2km away; Safety; The new sites are in light of the local conditions, more than 3 to 5 households for every resetting site. (2). The resettlement site distribution design 46 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan According to the principles above, the resettling sites are selected back the level belt, and near to the villages with collective population, thus to make it is convenient for them to join in the collective life, treat the neighborhood. The resettlers are totaling 116 persons, the resettlement site of the villages is as followings: 13 households with 49 persons in Snapping Village, will be resettled at the level belt near the primary school; one household with 4 persons of Taoyuan Village, will be resettled at the level belt near the village committee by the road; 9 households with 38 persons of Puxi Village, will be resettled near the previous primary school or rebuilt a resettlement village; 3 households with 16 persons of Yangpo Village, arranged in the same group, at the level belt back; In Tianchiya village, 4 households were involved, but only one household with 7 persons needed to be resettled(for the other three households, only houses were affected, which would be compensated but not be rebuilt), it is arranged in the same village, near the Liangiiahe cement plant. Construction Land Planning According to the investigation, According to the investigation, the mean house site area is 43.5m2, based on the standard to plan, the number for construction land of the villages is as following a). For Snapping village, 13 households with 49 persons, needs land of 2131.5m2; b). For Taoyuan village, one household with 4 persons, needs land of 174m2; c). For Puxi village, 9 households with 38 persons, needs land of 1653m2; d). For Yangpo village, 3 households with 16 persons, needs land of 692m2; e). For Tianchiya village, one household with 4 persons, needs land of 1 74m2. For the above, it is totaling 4828.5m2(7.3mu). Public Project Facilitates Planning Of the resettlers in the reservoir area, 90% have been electricity-fitted; 50% of them used running water(from the mountains). After removal, electricity has been fitted for every household and they can use running water. Roads and Communication At present, along the left side of the riverside of Guandu river, there is Zhuxiang road to the riverside, so the traffic is convenient. But in Puxi and Yangpo village, the road is not smooth, and the villagers can only carry with boarders to buy and sell things, so much inconvenience is for their production and living. After removal, it is needed to build up three docks, and to build a new village road of 1.5km(connect with Zhuxiang road, at the Puxi management part) to solve the shopping problem. Deployment of social service facilities The administrative villages affected by inundation have got the auxiliaries of primary school, medical treatment house, business net pots, no rebuilding is necessary. 47 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan 5.6. Plan for Relocation of Specific Facilities The relative departments provide the plan. The specific for the project is mainly as following: Zhuxiang road, tractor road, power lines, ray chain line, bridges, Mayuhe Power Station, Government's door, docks, etc,. According to the actual project and local conditions, combining with the design requirement of the very period, the plan for the specifics is as follows: 5.6.1. Road Rebuilding Combining with the actual condition of the reservoir area, ensuring to restore the traffic, according to the requirement of the "Feasibility Study Report for Rebuilding Songshuling Power Station Project Affected Road", which was designed by Zhushan County Traffic Bureau in Sep. 1997, fourth level road three periods totaling 8.288km will be built in the area, 6.414km for two periods of Zhuxiang road, 1.874km for the period of Liangjia cement road; 3 bridges will be built, crossing 60m, totaling 136m, a new tunnel will be built with length of 280m; the rebuilt road is 8.5m wide for the base and 6m wide for the road. According to the project reconstruction design plan: the project will be designed at a time and completed in two periods, for the first period, two periods of Zhuxiang road will be completed; for the second period, after the compeltion of dam, use the darn to take instead of bridge to cross the Duhe river, and then rebuild Liangjia road. 5.6.2. Tractor Road Rebuilding The two periods of tractor road to Snapping village group one and Lutou valley float starting pot is totaling 0.85km. It will be carried out together with resettlement removal, and the road will be built to the new residence; in Puxi village, a tractor road of 1.5km will be built to the dock. 5.6.3. Bridges Above Liangjiahe river, a stone-arched bridge with pure crossing of 60m. 95m for length. 6m for wide will be built, and it has been brought into the reconstruction design and requirement which was provided by the county Traffic Bureau: in Puxi village, a chain bridge with 90m of length and 2m for wide will be built, since after reservoir retaining water, the surface will be broaden and it will be difficult to rebuild, so now it is determined to add ships and docks prospectively. 5.6.4. Power lines Restore low voltage line of 220v of 4.4 pole km. 5.6.5. Post ray cable line Restore post ray cable line of 6.25 pole km(from dam 74km broad to 79km broad) 5.6.6. Government's door Restore the government's door of Liangjia Township(4.5x8)m. 48 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan 5.6.7. Docks Restore one for each of Liulin, Guandu, Taoyuan village group 6, Yangpo village group 1. 5.6.8. Mayuhe Power Station The power station is beside Liangjia township road; the altitude of the station house surface is 370m, built in 1990. Because there is no suitable condition for power station building, it will be compensated, and the workers there will be transferred to Songshuling Power Station. 5.7. Plan for Clearing the Reservoir Bottom The surface of reservoir is 2.74m2, and the extinct water line is 384m, 116 persons live below the line signing for inundation once twenty years, and the area of the houses is 3984m2. To clear all the concealed peril before the operation of the power station, the bottom must be cleared before water retaining, inclosing clearing construction, hygienic, tomb and woodland. Clearing for constructor and structure All the houses and auxiliaries within the clearing scope must be relocated, the walls(except soil) should be leveled down, and the old and waste materials that easy to float wall are burnt stilly. All the auxiliaries including lines, telegram, broadcast within the scope that interring the safe operation of reservoir will be cleared, and the equipment, materials must be carried away After clearing, the rest height of the big building should be no more than 0.5m above the ground surface. The well, cellar within the area will be blocked, covered. Sanitation and antiepidemic plan The manure pit, sties, toilets, rubbish in the reservoir area will be cleared with sanitation and antiepidemic, carry them out or put them under the sun to be shone so that to sterilize. For every square meter, lkg lime will be used to sterilize, the sewage pit will be filled with soil. Tomb clearing plan The tombs that have been buried within 15 years will be moved out or be treated at the very place, lkg bleaching powder will be used for every pit. Whether the tombs buried before 15 years should be moved is based on the local custom. For the tombs bury land for those died of inflection disease, specific treatment will be taken. Clearing Planning for Woodland Before reservoir retaining water, gardens, woodland, timberland and scattered fruit trees should be fell down along the land level, and be transported out. The tree stakes will be no more than 0.3m, the firewood will also be transported out. The remaining branches, whither wood which easy to float on the water, should be burnt or bleached. 49 Hubei Province Hydropower Project Zhushan Countv Songshuling Hydropower Station Resettlement Action Plan 5.8. Reservoir Developing Plan There is no industry pollution upper the reservoir area, and the residence is scattered, so the water and land resource was well kept, and the water quality is very good, fish and shrimps grows quickly; after completion of reservoir, the tail and bend can be used for aquatic, net fishing and other ways to find out the road to rich. In the reservoir area, especially at the front, the government take advantage of the special nature resource of the jagged rocks of grotesque shapes to develop Lutou Valley Floating tourist line, for this, publication was made through broadcast, TV and newspapers to attract more tourists. After the completion of reservoir, the surface of it will be more wide, the scene will be more grand, then with some auxiliaries and service facilities, more tourists will be attracted, but the local government shall strengthen the management, train the relative workers and provide favorable policies for the resettlers so that to create ways to rich. 5.9. Forecast of the resettlement production and living level After resettlement: The reservoir inundation involved Liuhe, Daping,Laozhu in Liulin township, generally, land resource was not affected. Measures of protecting was taken for their environment and infrastructures, their production and living condition did not change, and so did their employment, at the same time, they can share relative preferential policies, so their ways of production will be broaden and their living level will be improved little by little. The inundation involved cultivate land, woodland, houses of five villages, after inundation, they still got cultivate land per capita of 1.77mu, woodland 15.47mu, according to the grain production of 362kg per mu, they can get 640kg everyone. So the problem of eating can be ensured. Under the premise that there are grain remained, they can go in for trading, eating and drinking service, tourist, aquatic, set up self-opened or cooperate enterprise, so to make market brisk, strengthen people managed economic activities, and stimulate the continuos development of rural economy. Corns, wheat and rice are mainly planted in the reservoir area. 6.3.1. The local grain production, according to the proportion of rice, corn, wheat, etc., calculate by Zhushan County Price Bureau(1999) No.35 and (1999) No.18, the grain price is 1.06yuan/kg, and the side-products, calculate as 75% of the grain production, the price is 0.20yuan/kg. Then the price of grain is 1.24yuan/kg. By calculation, the mean year production is 455.5yuan/mu of the five villages three years before land requisition. Compensation for land requisition is 8 times the mean production value three years before land requisition. Resettlement subsidy is caulked according to the number of persons needed to be resettled, calculated by using the land requisitioned to decide the mean cultivate land occupation number. The subsidy criteria for every one who needed to be resettled is 5 times of the mean production value of the cultivate land three years before. After calculation, the sum of the compensation and the resettlement subsidy in the five villages in the reservoir area is 4665yuan/mu, no resettlement subsidy for the land without registration (3446yuan/mu). Compensation for woodland and wood are as below: 2000yuan/mu for timberland; 2500yuanlmu for economic forestland; 1500 yuan for shrub. For the project occupied land and the land for construction, since the construction period is 4 years, and the occupied land is basically shrub, it is determined to be compensated as the criteria of land requisitioned. C Compensation for scattered trees For the scattered fruit trees, 20 yuan every plant will be compensated, and 15yuan/plant for the fixed trees. D Compensation for host site The same with the compensation criteria for cultivate land, 3446yuan/mu will be compensated for host site, and no resettlement subsidy. E Compensation for house and auxiliaries i.Compensation for house According to the survey to Zhushan County Real Estate Bureau, combining with the actual house structure, after analysis on the materials, the house replacement cost in the reservoir area is determined as follows: brick fixture 290 yuan/mi2, brick and wood 250yuan/m2, stone and wood 176yuanlm 2, soil and wood 176yuan/m2, grass and wood 104yuan/m2, and 80yuan/m2 for simple structure. The main house compensation price is analyzed in Table 6- 2(according to the actual condition, generally the living area of the resettlers is 200m2 or so, now it is calculated based on 200m for every household. Compensation for reconstruction of specific facilities Electricity facilities(low voltage lines) There was a small hydropower station in the reservoir area, with installation of 1000kw, the compensation was 4.5 million-yuan, and the lines were compensated by I 0000-yuan/pole km. Telegram and cable line 80000-yuan/pole km for ray cable lines, 30 yuan/household for cable TV set. 56 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan Restoration of traffic around the reservoir area The traffic around includes Zhuxiang road, Liangjia road, which will be compensated by 300000 yuan/km; the village or group tractor by 30000 yuan/lkm; Liangjiahe bridge by 50000 yuan/m; chain bridge by 1500 yuan/m; docks by 30000 yuan for each. Other facilities The governrnent's door by 20000 yuan for each. 6.3.3. Fees for project protection According to the design of the county project group of Water and Electricity Bureau for the protecting dam, 2923400 yuan will be invested. 6.3.4. Fees for clearing the basin of the reservoir For the clearing of the reservoir bottom, the buildings and structures, toilets, bars in the reservoir scope of 2.74km2 will be cleared in hygiene, the tombs will be removed and sterilized, and the woodland will be cleared. This project is totaling 142.1 thousand-yuan. 6.3.5. Other fees A. Fees for skill training It is based on 0.5% of the resettlement fees, which is used for improving the production skill, artistic appreciation of the resettlers and for the improvement of the resettlement cadres' management level. B. Fees for implementation of management It is calculated by 3% of the resettlement fees and 1% of the sum of reconstruction fees for specific facilities, project protection, reservoir bottom clearing, and it is mainly used for the house of resettlement organizations, purchasing of equipment, wage, office work, official business. C. Management fees for land requisitioned It is calculated by 3.6% of land compensation and resettlement subsidy, and it is used for the activities of land requisition and approval. D. Fees for monitoring It is calculated by 1% of the sum of the resettlement fees, specific facilities reconstruction fees, project protection fees, reservoir bottom clearing fees, and it is used for the removal of the resettlers, reconstruction of the specific facilities, the progress of production developing item, quality and using of funds. E. Fees for investigation and design It is calculated by 2% of the sum of the resettlement fees, reconstruction of the specific facilities, project protection fees, reservoir bottom clearing fees, it is generally used for the 57 Hubei Province Hydropower Project Zhushan Countv Songshuling Hydropower Station Resettlement Action Plan design unit, during the possibility study and inviting bids. F. Fees for monitoring and estimation It is calculated by 1.0% of the fees mentioned above, and used for resettlers' removal, reconstruction of specific facilities, implementation progress of production item, checking, and for the activities of submitting the resettlement independent monitoring report to the World Bank through project owner. 6.3.6. Fees for preparation Fees for basic preparation is calculated by 10% of the fees of rural resettlement, reconstruction of specific facilities, project protection, clearing reservoir bottom. 6.3.7. Loan interest of the construction period The project construction needs four years, the year interest rate is 6.21%, the loan interest is totaling 1728 thousand yuan. 6.3.8. Tax According to the present relative policies and regulations: Implementation Method of Cultivate Land Occupation Tax in Hubei Province, Fund Requisition and Management Method for Cultivate Land Developing in Hubei Province, Notice for the Requisition, Using, Management Method for Forest Restoration Fees in Hubei Province, the fees is determined as follows: A. Tax for cultivate land occupation 3000 yuan per mu, the cultivate land area is 315.1 mu, totaling 945.3 thousand yuan; B.f. for reclaiming cultivate land 3000 yuan per mu, cultivate land area 315.1 mu totaling 945.3 thousand yuan; C. Fees for restarting forest: 2000 yuan per mu, woodland area 378.5mu. totaling 757 thousand yuan; the total of the three items above is 2647.6 thousand yuan. 6.3.9. Overall Estimation of Resettlement Resettlement investment for Songshuling Power Station is 18881.9 thousand yuan(calculate by 18880 thousand yuan, not including tactics). In which, static investigation is 17153.9 thousand yuan, the categories is detailed in Table 6-3, and the items is shown in Table 6-4. Equilibrium analysis for fund using and resettlement fees The project resettlement planning investment is based on the present policies and regulations, according to the market price, the resettlement design that was complied after investigation, study and analysis, then get out the budget of the fees needed for the project implementation. And based on the affected inventory indexes, the resettlement designation, and under the premise of which, the budget is higher than or equal to the resettlement planning total investment, the design budget was made out, so that the resettlement plan will surely be implemented smoothly. The resettlement in the reservoir area is mainly agricultural resettlement backward, and the relocating households were all resettled in their own village, especially at the tail of the reservoir, measures of protection was taken to protect the present advantage of position. The resettlement fees was all used for the development of local collective production and the construction of village infrastructures, the rest is for the welfare for most of the villagers. After land requisition, land was adjusted within the scope of the whole village; for the project protection fees and the fees for restoration of specific project, the -fund must be used for its special purpose only. Resettlement Implementation Plan 7.1. Implementation procedures Land requisition and compensation It will be completed by relative organizations in a coordinate way. The detailed procedure is as follows: a). The modem maps defining the scope and area of the land to be requisitioned will be provided by Hubei Province Water and Power Design and Investigation Institute. b). The project owners apply for permission to the land management departments; c). Apply for official approval; d). The resettlement offices negotiate on the land compensation with county land management departments, sign the compensation agreement and go through the formalities foreland use; e). County land management bureau signs together with the relative town(ship)s determines, on site, scope, and quantity of land requisition; f). County land management bureau signs "land Requisition Agreement" with relative town(ship)s; g). Allocate the compensation h). Go through legal formalities; i). Implementation of land requisition. In addition, the use of fees for land requisition(compensation and subsidy): most of the fees is used for the improvement of the land, and the rest is for the collective production and the improvement of the village infrastructures of the whole village; the fees for resettlement in the same village will be used to develop the collective production and improve the village infrastructures of the whole village, and land will be adjusted in the scope of the whole village. Generally, in addition to develop land resource and construct infrastructures, the rest fund will be in the village mainly for welfare, which can be shared by most of the villagers. If someone wants to get loan to open small enterprise(e.g.open a small shop), he must get the approval of the village representatives committee, then he can get loan from the rest of the land requisition fees, or the villager must get loan from the local bank. Production Restoration The village committee will implement the production rehabilitation. The procedure is as follows: a). Publicize the schedule of land adjustment and production restoration; collect comments and suggestions from the villagers; c). Implement land adjustment; d). Cultivation and planting Housing removal and rebuilding The procedure is as follows: a). Hubei Provincial Water and Electricity Investigation and Design Institute provide the scope of housing removal; b). The county, town(ship) investigate into the quantity and quality of the houses; c). The county and town(ship) negotiate with villages on the compensation criteria of houses and ancillaries, and sign housing removal agreements; d). The county and town(ship) sign agreement on housing removal compensation with villages; e). Town(ship) resettlement group public the quantity, compensation criteria and the time schedule for removing and rebuilding houses, and inquire for comments from the PAPs; f). Town(ship)s resettlement group and village sign the agreement on the housing removal and rebuilding; g). Allocating of host site; h). PAPs receive the compensation fees; i). PAPs build their new houses and move into the new houses; j). PAPs demolish their old house. Reconstruction of specific items a). The project design unit provides the affection scope; b). Project resettlement office and the charge department of the specific items investigate into the quantity and level of the items; c). The project resettlement office entrusts the specific departments to prepare the reconstruction plan according to the resettlement plan; d). The project resettlement office and the specific item departments define the compensation criteria, and sign agreement on compensation of reconstruction of specific items e). The project resettlement office entrusts the specific departments to implement the reconstruction of the specific items; 64 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan f). The specific items being put into operation. 7.2. Progress schedule The project construction period is four years. To ensure its completion in time for water retaining and power producing, we will implement resettlers' removal together with the power station construction prospectively, so as to ensure the completion of water retaining, housing removal, and construction of protecting dam. It has been determined to implement the resettlement work in two periods for the reservoir area(except protecting resettlement), 60% for the first period, with 70 persons, completed by the end of 2001; the rest 46 persons were for the second period, completed by the end of 2002, the year next to the project starting year. The progress of inhabitant resettlement will be based on the following principle: Housing removal will be completed before water retaining; Housing removal date will be informed to the resettlers at least 7 months ahead of the date, in which 3 months for preparation (prepare the materials and workers), 4 months for new house building. Besides, the PAPs can stay in their old houses until completion of the new one. The duration of house rebuilding will be duly negotiated with the resettlers, and can be extended if necessary; Land requisition will be completed before construction commencement of the transmission project; Land adjustment will be completed during cropping intervals; Infrastructures will be completed before the completion of removal; The reconstruction of specific project will be completed before construction commencement, so to ensure the smooth traffic and post of the local place; The completion time will connect with the project water retaining time. Fund Allocation 7.3.1. Principles All the fees relative with land requisition will be counted in the budget of the project, the compensation for land requisition and other fees will be paid to the relative units or individuals through the county or township resettlement office by the proprietor. Compensation for housing relocation will be paid to the resettlers before they start to build their new houses; Compensation for land requisition and other facilities will be paid to the resettlers 3 months ahead of land requisition; In order to ensure a smooth implementation of the resettlement, the PRO will set up supervisory mechanism in the resettlement offices at all levels, so as to guarantee all the 66 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan money to be paid to the PAPs as specified. 7.3.2. Mechanism Responsible for Resettlement Finaciance The organizations responsible for compensation of land requisition are project office, county resettlement office, county Land Bureau, town(ship) government and village committee. The organization responsible for the compensation of housing relocation are project office, county resettlement office, town(ship) resettlement office, town(ship) government and village committee. In order to guarantee compensation fees to be timely transferred and be proper used, the resettlement compensation fees shall be transferred from higher level to lower level, correspondingly, each department shall implement the strictly stipulations in finance accounting and audit system. The ultilication and transferring status of compensation fees shall be periodically checked and reported, thus can submitted the adjustment plan and remedial measures for unexpected event. 7.3.3. Fund Flow according to the compensation policies and criteria set in the RAP, the PRO will sign an Agreement of Housing Relocation with the county resettlement office, and will sign an Agreement of Land Requisition with the county Land Administration Bureau. The county resettlement office will sign the agreements with the resettlers and the relative town(ship)s. According to the compensation content, quantity and time regulated in the relocating agreement, the compensation fund will paid to the county resettlement office through bank, then to the town(ship) resettlement working group, and later to the resettlers directly in periods. Based on the policies, the land compensation and subsidy will be paid to the county resettlement office, which will be used for river treatment, land cultivation and land resource developing. Institutional Organization 8.1. Establishing of Organization In order to implement the RAP in a smooth manner, a resettlement organizational network will be established by the PRO, zhushan county Resettlement Bureau and Zhushan county Government, which will be vested with the responsibility for planning, coordination and monitoring of resettlement activities. Responsibilities 8.2.1. Project leading group for resettlement The Project Leading Group is member by Hubei Provincial Planning Committee, Zhushan county Water and Electricity Development Cop.Ltd., and the purpose is to ensure the resettlement to be carried out smoothly. The Leading Group is mainly responsible for strength the leadership over the project, formulating project resettlement policy, coordinating the activities of land requisition and inhabitant resettlement between resettlement organizations at different levels. Project Resettlement Office is subordinate to the Leading Group, do with the everyday affairs. The (PRO) is in the Zhushan County Water and Electricity Developing Cop.Ltd.. 8.2.2. Project Resettlement Office The PRO is member by Hubei Provincial Planning Committee, Zhushan county Water and Electricity Developing Cop. Ltd.and the workers in the resettlement organizations at different levels. The main responsibilities are as follows: entrust the design units to define the project affected scope, and entrust the local prefecture resettlement offices to conduct socio-economic survey and statistics and to file up the datas; assume responsibility for training of workers of the resettlement organizations at different 69 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan levels Organize and coordinate preparation and implementation of the RAP Organize public consultation and popularize resettlement policies Assume responsibility for managing and monitoring payment of resettlement compensation and its use Instruct, coordinate and monitor the resettlement implementation progress performed by prefecture resettlement offices Take charge of internal monitoring activities, prepare internal monitoring report Assist in the external monitoring activities Prepare reports of the project progress 8.2.3. Zhushan County Resettlement Leading Group Zhushan County Leading Group for Resettlement, headed by the responsible leader of local county government, is member by representatives from the county Water and Electricity Developing Cop.Ltd., the county resettlement Bureau, the county Planning Committee, the County Land Administration Bureau, the County Agriculture Bureau, the County Construction Bureau, the County Environment Protecting Bureau, the County Traffic Bureau, the County Telegram Bureau, totally 18 departments. The main responsibility is to strengthen the leadership over actual implementation of resettlement in the county, coordinate among the resettlement organizations involved and take care of relationship between the state, collective and individual, so as to ensure a smooth land requisition and inhabitant resettlement within the county. 8.2.4. Zhushan County Resettlement Office Zhushan County Resettlement Office is member by the Water and Electricity Developing Cop.Ltd., the county Resettlement Bureau, and the specific cadres of town(ship)s for resettlement. The main responsibility is: Entrust the design units to define the project affected scope, assist to conduct survey, statistics on social economy and file up the data; Assist to prepare the RAP and monitor its implementation; Organize public constellation and popularize the resettlement policies; Go through relevant formalities for land requisition and resettlement; Assume responsibility for management of resettlement compensation, monitoring the allocation and using; Be responsible for training of personnel involved in resettlement in affected town(ship)s, instruct and supervise resettlement work in the town; 70 Hubei Province Hydropower Project Zhushan Countv Songshuling Hydropower Station Resettlement Action Plan Solve problems in a coordinate way during implementation; Assist to complete the internal monitoring and external independent monitoring; Prepare the progress report and submit it to PRO; 8.2.5. Direction house for project of dam building The Direction House is member by Zhushan County Water and Electricity Cop.Ltd. And the skilled Cadres County Water Conservancy Bureau, the main responsibility is: Solve problems in a coordinate way during implementation; Assume the responsibility of dam building project for the resettlement; Organize public consultation and popularize the resettlement policies; Prepare the progress report and submit it to PRO. 8.2.6. Town(ship) Resettlement Group It is led by the relevant responsible leaders in the affected town(ship), and composed of the staff from local electric management station, land management office and police station as well as cadres of village administration. The main responsibility is: Participate in the project investigation and organize public consultation and popularize the resettlement policies; Execute, inspect, monitor and record the resettlement activities within the town(ship); Go through the fornalities for housing relocation; Sign housing removal agreement with the resettlers, supervise the land requisition, removal and construction of houses and auxiliaries; Be responsible for payment and management of compensation fund: Solve problems during RAP implementation in a coordinate way, Report to county land administration bureau and resettlement office the progress of land requisition, housing removal and inhabitant resettlement. 8.2.7. Village Committee and Villager Group The resettlement work group of village committee and villager group is composed of the main cadres of the village and villager group. The main responsibility is: Participate in investigation on social economy and project impact; Organize public consultation and popularize the resettlement policies; Help vulnerable households in resettlement; 71 Hubei Province Hydropower Project Zhushan Count' Songshuling Hvdropower Station Resettlement Action Plan Execute land adjustment, organize activities for production development; Be responsible for funds management and allocation; Report to the higher authorities comments and proposals from the resettlers; Report the resettlement progress implementation. 8.2.8. External Independent Monitoring Institutions The external independent monitoring institution for the project is ECIDI, and its main responsibility is: Observe every aspect of resettlement schedule and implementation, and furnish the resettlement monitoring evaluation report to the project owner and the World Bank. This responsibility will be described in detail in a separate section of the RAP herein dealing with external independent monitoring and evaluation. Assist the project owner to prepare the RAP; Provide technical advice to project owner and the relevant departments on survey and data processing. 8.3. Staffing In order to ensure a smooth implementation of land requisition and resettlement, the project and Zhushan county government arranged all necessary resources for the work. To cooperate with the work of the early days, notice on "Establishing Resettlement Leading Group for Songshuling Power Station Project" was announced on April, 7,2000 by Zhushan County government. The county standing committee and organization minister take in charge of the leader, the county resettlement bureau leader, Yuxianqing, and manager of the county water and electricity developing Cop.Ltd., Zhuze take in charge of the vice leader of the group. The leaders of the county Planning Committee. Finaciance Bureau, Construction Bureau, Traffic Bureau, Land Administration Bureau, Agriculture Bureau and Forestry Bureau were the members. At the same time, in the relative town(ship)s, the corresponding leading groups and organizations were set up to get the resettlement and removal work well done. Measures for Enchanting Capacity of Organization The resettlement units at all levels will be manned with administrative and professional personnel who are qualified with professional skill and management ability. Organize the key personnel of the units at all levels to participate in training, so that they have a better understanding of the national resettlement policies and relative requirement of the World Bank, and to enhance their professional skill and capability of solving problems; Guarantee fully on funds and facilities for management; Establish database and ensure the information flow from and to the units at all levels, major 75 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan problems will be solved and decided by the Leading Group; Strengthen reporting and internal monitoring system, and solve problems timely; Develop mechanism of external monitoring and evaluation, and set up predicting and alarm system. 76 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan 9. Public Participation and Appeal During formulating resettlement policy, drawing up the RAP and resettlement implementation, the relevant authorities have paid and will pay special attention to the participation and consultation of the PAPs, and solicit pinions and proposals for several times on resettlement work and transmission line routes from the government, people's congress, People's Political Consultative Conference, social bodies, representatives of the mass of prefectures(cities), counties(cities), relevant town(ship). In preparation of the RAP, the PRO has once again solicited the opinions from local governments at all levels and the resettlers' representatives on the resettlement and compensation. With cooperation of local governments at all levels, this RAP is complied. In the implementation stage, the resettlement offices at all levels will further encourage the public participation in the resettlement and rehabilitation. 9.1. Public Participation 9.1.1. Participation in Resettlement Preparation The office has consulted extensively with local government at all levels and relevant authorities responsible for power, planning, land administration and telecommunication on the project locations, site cooperation and confirmation of local governments. The local governnents held meetings participated by the residents and cadres from towns, villages and villager groups, on land requisition and resettlement. At the meetings, the necessity of construction of the project and resettlement policies was made known to all involved. 9.1.2. Participation in RAP Preparation For land requisition and relocation of Songshuling Power Station project, the inventory indexes survey was carried out in the end of 1999. In April,2000, Zhushan County Government organized relevant departments, together with the workers sent by ECIDI, implemented the inventory indexes survey in a whole scope, and prepared the "Hubei Zhushan County Songshuling Power Station Resettlement Planning Report". While investigating into the resettlers, administrative villages. town(ship)and relative units, the sense and importance of the project construction were popularized. They also organized meetings at different levels, consulted on the means on the resettlement in the reservoir area, collected their suggestions and ideas. During the preparation of the RAP, the local governments at all levels and resettlers participated in the following activities: level of county and town: from 1999 to May,2000, carried out resettlement work 10 times, with 60 persons involved; level of village and group: from March to May in 2000, carried out resettlement work 10 times, with 198 persons involved. The objects were mainly of village cadres and resetters representatives;e.g.: On March, 18, Zhushan county government held a mobilization meeting on inventory indexes and social survey, participated by the representatives from Resettlement Bureau, Water and 77 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan Electricity Developing Cop.Ltd., Planning Committee, Traffic Bureau, Forestry Bureau, Construction Committee, Post Office, governments of town(ship)s and village resettlers. On the meeting, the county Resettlement Office introduced the resettlement policies and arranged the survey the investigation work, and required the village resettler representatives to popularize the the resettlement work. On April 3, a meeting held by the Water and Electricity Development Cop.Ltd., and participated by the county resettlement bureau, the Cop.Ltd., ECIDI, and the consulting topic was "Songshuling Power Station Land Requisition and the RAP". On April 10, Guandu town government held a meeting participated by Resettlement Survey Group, Resettlement work Group, town(ship) cadres, village representatives of the resettlers' village, consulted the village representatives' opinions on feasibility design of resettlement, and request them to collect the villagers' suggestions and appeal it to the resettlement organizations for further modification. C During the process of survey of project land requisition and relocation, the survey group also conducted a wide-range socio-economic survey to solicit opinions from the the town(ship)s and villages. They conducted the opinions or suggestions on project construction and resettlement activities from 42 households to be relocated and relative villages or villager groups. Before allocate land compensation to the county resettlement office, the volumes will be delivered to all the resettled households. The volume includes the following content: main content of RAP; resettlement compensation and resettlement policies; resettlers' right; channels for responding to grievance and appeal. -----Hold meetings It is mainly arranged ahead of the implementation of land requisition and relocation, made continuos and further lecture on relative policies, regulations, compensation criteria, so that the villagers can know and arrange early. 9.1.3. Participation in Implementation of RAP The resettlers will participate in the whole process of the PAP. A Participation in House Reconstruction (1). Housing compensation criteria The compensation criteria for housing will directly affect the interest of the Resettlers. Before the houses relocated, the relevant resettlement authority will consult and sign an agreement with the resettlers on the compensation criteria for the houses. The consulting results will be declared publicly before the agreement signed, so as to put the resettlement under public supervision. (2). Resettlement host sites and house relocation At the RAP preparation stage, the relevant authority carried out survey on the resettlement host sites and the way of house reconstruction. (see Table 9-1). According to the survey, most of them are willing to have their houses relocated in their own groups and by themselves. The local governments at all levels will give a helping hand at different stages for house relocation. (3) Disposal of Old Houses All the old houses to be relocated will be compensated at resettlement cost. Within a specified time period, resettlers can, on their will, demolish their old houses first and then rebuild the new houses or vice-versa. Resettlers themselves without deduction from compensation can use the salvageable material from the old houses. B Participation in Production Rehabilitation All the resettlers must participate in the land readjustment and allocation. 81 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan C Participation in Land Compensation Using and Management The land compensation will be paid to the village, and the government above the county level will arrange the using, and any unit or individual will not use it. D Participation in Project Construction The project construction will cause certain impact on the local community. In order to ensure the PAPs to get benefit from the project construction, the local people will be encouraged to take part in the construction, and favorable conditions will be created to use local materials and local labor force. 9.2. Responding to Grievance and Appeal The public participation is always encouraged in the process of compiling and implementing of the RAP. There will be some unforeseeable problems occurring in the process. In order to solve problems effectively and ensure the project construction and land requisition to be carried out successfully, a transparent and effective appeal channel has been set up respectively for rural resettlement. The procedures are described as follows: Stage 1. If any resettler is aggrieved by any respect of the resettlement, he can appeal to the village committee and the town(ship) resettlement office in oral or in written form. If an oral appeal is made, the village will record it on paper and process it. Village committee or town(ship) resettlement office will make decision on or resolve it in two weeks. Stage 2. If the aggrieved resettler is not satisfied with the decision of stage 1. He can appeal to the county resettlement office after receiving the decision; the county resettlement office will make decision in two weeks. Stage 3. If the resettler is still dissatisfied with the decision of the resettlement office, he can will appeal to the civil division of a people's court according to the civil procedural law after receiving the decision of the PRO. The resettlers can appeal on any respect of the resettlement, including compensation criteria. The organizations accept the appeals and grievance of the PAPs free of charge, and the PRO under project contingency will pay the expense incurred therefore. The resettlers will know their right of lodging appeal during participation in the public meetings and by other ways. At the same time, the appeal process will be publicized among the PAPs through media. The relative authorities will sort out the opinions and proposals of the PAPs and the resettlement offices at all levels will process the information in a timely and effective manner. 82 Hubei Province Hydropower Project Zhushan Countv Songshuling Hydropower Station Resettlement Action Plan 10. Monitoring and Evaluation In order to guarantee that the RAP can be smoothly implemented and the resettlement target suitably realized the follow-up fact-finding and monitoring will be carried out in whole process. Monitoring on the resettlement will be divided into two parts, i.e, internal monitoring(by the resettlement office) and external independent monitoring. 10.1. Internal Monitoring and Report 10.1.1. Target and Task The target of internal monitoring is to maintain responsibility of the resettlement organs as specified in RAP during implementation, and ensure that the project can be constructed smoothly and the resettlers' legal rights will not be impaired. The auditing department of the government above the county level will independently exercise the auditing monitoring function over conceming units under its jurisdiction in accordance with the laws and regulations. The superior units assume the responsibilities for monitoring their subordinates so that the RAP principal and schedule can be followed. 10.1.2. Institution and Staff The routine work of internal monitoring will be organized by the PRO of the project owner, and be performed by the county resettlement office, the county Land Administrative Bureau, town resettlement work group and villages. To ensure an effective internal monitoring, one to two full-time professionals have been signed for each resettlement offices. All of them have participated or will participate in preparation and implementation of the RAP, they will also carry out internal monitoring and control of the resettlement progress. Monitoring Procedures Develop an internal monitoring framework to supervise the resettlement activities. The project owner establish a database for the land requisition, housing relocation, and resettlement, and will monitor the whole process of preparation and implementation. The county resettlement office will establish relevant database, and renew them along with the resettlement progress for planning the resettlement work, and monitor the whole process of the resettlement. During the implementation stage, the county resettlement office will record the resettlement massages submitted by the township resettlement groups and based on the formats prepared by monitoring institutions. They will also timely transfer the on-going activity records to the county resettlement office so that a continuous monitoring can be realized. The county resettlement office will practice periodic inspections to affected villages and towns and report the implementation progress. In the above internal monitoring system, a set of formats of information lists have been drawn up so as to realize the continuous massage flows from the village to the PRO. The county resettlement office, the town resettlement work group are important chains in the internal monitoring system, and their work will be periodically checked and inspected. 10.1.5. Reporting Internal monitoring report A. Reporting circle After starting of the resettlement implementation, working reports will be submitted at least once three months from the town resettlement work group to the county resettlement office, and the similar reports be submitted from the county resettlement office to the county resettlement leading group or the project owner. And special events will be reported without any delay. The resettlement offices are required to prepare a work report summarizing the work of each implementation stage. B. Format of Report 84 Hubei Province Hydropower Project Zhushan Countv Songshuling Hydropower Station Resettlement Action Plan The format of the working report of the PRO will be prepared to meet the requirements of the World Bank, and distributed to the institutions at all levels who will periodically fill and submit the completed report. The format of the report usually comprises of two parts: a). the context describing in detail the resettlement progress and payment and use of compensation, the progress, problems and difficulties met in the implementation, and the corresponding resolution and measures; b). Forms and lists mainly showing statistical data of previous three months, which reflect the progress by comparison of the actual and planned land requisition, house removal/reconstruction and use of compensation. The formats refer to the Attached Table 1 and 2. The report will be submitted once a year. 85 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan Format of Report According to the requirements of the World Bank, the report usually comprises two parts: a). main context summarizing the resettlement progress and payment of compensation, the situations, problems and difficulties met in the implementation process, and the corresponding resolution method and measures, b). Forms and lists in the format provided by the World Bank, mainly containing statistical data of previous six months, which reflected the comparison between the actual and planned land requisition, resettlement progress and payment of compensation to the date. 10.2. External Independent Monitoring Evaluation and Reporting 10.2.1. Target and Tasks The external monitoring and evaluation by institution independent to the resettlement execution institutions is to monitor and evaluate whether the target of the land requisition, resettlement and relocation activities are realized, by which evaluation opinions and proposals will be put forward on the resettlement, housing relocation and restoration of the resettler's living standards, and to provide predicting alarm system to the project management, and reflecting channel to the resettlers. The external independent monitoring institution will be the consultant both for the Project Leading Group for Resettlement and the PRO, it will conduct follow-up investigation, monitoring and evaluation of the resettlement activities according to the RAP and provide advice for decision-making. 10.2.2. Institution and Staff The PRO has appointed ECIDI as independent institution responsible for overall monitoring and evaluation of the project resettlement. ECIDI will provide technical assistance to the PRO and conduct a survey of resettlement and living standards of the PAPs as well as all basic monitoring work. ECIDI will also assist the PRO to prepare annual and semi-annual report. ECIDI is a subordinate directly under the State Power Corporation of PRC. In 1993, ECIDI was appraised by the Chinese government as one of the 1 00 top design institutes with comprehensive capacity. In Dec. 1996, ECIDI has been qualified through verification according to GB/T19000 equivalent to ISO 9000. ECIDI has accumulated abundant experience through implementation of land requisition and resettlement for more than twenty large-and-medium-sized hydropower projects in China. Since 1990, ECIDI has undertaken resettlement monitoring and evaluation based on the Operational Directives OD4.30 of the World Bank. ECIDI has undertaken, among the others, the resettlement monitoring and evaluation work for the Shuikou Hydropower Project in Fujian Province, the Electric Power Development Project in Zhejiang Province, and assist the Electric Power Development Company to prepare RAP for the 500kv Transmission Project in Jiangsu Province in the past 10 years; that for the Shuikou Hydroelectric Power Project has been lasted five years and highly praised by the World Bank. ECIDI has a number of experts and entering and technical personnel who have participated the resettlement monitoring and evaluation work for the projects financed by the World Bank. Four of them have successively participated in the resettlement monitoring and evaluation seminars held by the World Bank and got the certificates after 86 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resettlement Action Plan completing the training courses; two of them have been invited to join in the World Bank. In ECIDI, a working group has been established particularly for the resettlement monitoring and evaluation work of Tongbo Pumping and Installation Power Station Project, the key members of are shown in Table 10-2, the member of the group member will be increased at the working peak as needed. Development in community: local economy in resettlement host sites, environrment development, neighborhood relation, and public opinions after resettlement. 10.2.4. Monitoring and Evaluation Measures Monitoring and evaluation will be performed on the basis of the survey data provided by the survey design institution and resettlement implementation institution. With an overall understanding of the situation, the evaluation will be performed by sampling survey and quick evaluation. Typical samples (resettled households/units) which has the representatives will be selected to establish evaluation index system for different types of PAPs. Experienced experts will be invited to decide in a back-to-back way the weights of different indexes. Referring to the updated research output on living quality both in China and abroad, the indexes will be non-dimensionally treated, and the survey results are analyzed and the computation results are evaluated and compared. ECIDI will also carry out the following work: Survey of resettlers' living standards The base-line survey will be conducted for this project, the selected samples of the base-line living standards of the resettlers will be collected.(The preliminary samples will be randomly collected). The living standard will be investigated once or twice a year to monitor the variation in the resettlers' living standards. The necessary data can be obtained by periodically survey, random interview and site visit, based on which statistical analysis and evaluation are performed. The survey comprises of various indicators of judging the living standards. One indicator will be used for weighing the dynamic variation of living standards before and after land requisition and resettlement. The selected indicators will be checked to see whether they are reasonable in reflecting the actual production and living levels in the base-line survey and are subject to modification according to the actual conditions so as to guarantee the message obtained to reflect the quality and quantity of the real situation. B. Public Consultation ECIDI will participate in the public consultation conferences held by the village and township. By this method, the institution can evaluate the effectiveness the public participation and the cooperation altitude of the resettlers towards the RAP. Such activities will be conducted and after the resettlement implementation. C. Resettlers' Opinions ECIDI will often interview the resettlement offices at county and township level to know the opinions collected from the resettlers and interviews the resettlers who have aggrievance. The institution will timely transfer the opinions and requests to the PRO from individuals and enterprises affected by the project, and provide advice for improvement, so that the resettlement implementation can be more smooth and effective. 89 Hubei Province Hydropower Project Zhushan Countv Songshuling Hydropower Station Resettlement Action Plan D. Other Responsibilities ECIDI has provided advice to the PRO in preparation of the RAP, and will monitor the following activities in the process of implementation. Selection of resettlement site; House construction; Production arrangement and rehabilitation; Support to invulnerable group; Infrastructures restoration and reconstruction Payment and amount of the compensation; Resettlers' transfer; Employment of labor force; Training; Scheduling of the items above mentioned; Use of compensation of the collective-owned land and resettlers' income, and Employment of the surplus labors and income increase of them. 10.2.5. Preparation Plan for Report 11.1. Resettlement Propre The RAP Report preparation work began in March 2000, and planned to be completed in the middle of July and then submitted to the World Bank to be evaluated. 11.2. Resettlement Progress Report 11.2.1. Periodicity Prior to every July3 1, the project owner will submit a report to the World Bank indicating the resettlement progress. The report will be submitted once a year. 11.2.2. Format of Report According to the requirements of the World Bank, the report usually comprises of two parts: a). Main context summarizing the resettlement progress and payment of compensation, the situations, problems and difficulties met in the implementation process, and the corresponding resolution method and measures, b). Forms and lists in the format provided by the World Bank, mainly containing statistical data of previous 6 months, which reflected the comparison between the actual and planned land requisition, resettlement progress and payment of compensation to the date. 11.3. Reporting ECIDI will report on the work that they undertake within one month after completion of the work. PRO will submit the resettlement progress report to the World Bank annually, with the reports received from ECIDI attached, 11.3.1. Periodicity In accordance with the World Bank requirements, after commencement of the resettlement, the monitoring and evaluation survey will be carried out once a year, starting in April every year. Prior to July.3 1, a resettlement monitoring and evaluation report will be submitted. The work for land requisition, housing relocation and resettlement of the project will be completed by Dec,2000. The work for independent monitoring and evaluation will be conducted for four times respectively in 2001,2002, 2003. 11.3.2. Entitlement Matrix The entire project affected units and resettlers will share the right and benefit in Table 12-1. All relocated housing will be compensated with replacement house and households value of the salvageable materials. Salvageable materials of the auxiliaries old houses belong to the PAPs, they can use them to build their new housing. Com ensation criteria for the major housing: brick fixture:290yuan/m, brick and wood 250yuanIm2, stone and wood 176yuan/m2, soil and wood 176yuan/m2, grass and wood 104yuan/m2, simple structure 80yuan/m2; compensation criteria for auxiliaries: fence lOyuan/m2, kitchen range 200yuan/m2, soil sunny ground 1Oyuan/m2, cement sunny ground 1Syuan/m2, pig and cow bar 150 yuan for each, well 350yuan for each, toilet 250yuan/each, cellar 200yuan for each, pond lOOyuan for each. 2.The resettlement organizations will provide host site with complete auxiliaries, and ensure that the host site area for each resettler will not be less than 35m2. The PAPs will build houses 3.According to the willing of most of the resettlers, as they wish. PAPs can use the salvageable materials of their old houses. The PAPs will stay in their old houses until the new houses are completed, and should not be forced to move out before the specified relocation deadline. 4. The PAPs will receive 3 months notice before starting housing construction, and will have at least 4 months for housing construction. Time frame will be discussed with the PAPs. Cropping intervals will be chosen for construction so far as possible. PAPs will receive compensation for housing removal by 350yuan/person. 5. Effective measures will be adopted to help vulnerable PAPs. For them, the town(ship) RO and village committee will help them to build new housing and to move in the new house after consulting with them. 6. Housing compensation will be paid to the PAPs before construction of their new houses. In case installment is adopted, the last installment will be paid before completion of the new houses. 7. The PAPs can lodge appeals or grievance free of charge on lany aspects relating to the resettlement including compensation. 94 Hubei Province Hydropower Project Zhushan County Songshuling Hydropower Station Resenlement Action Plan Pernanen Back 1. Most of the compensation for land requisition and subsidy t land resettlement will be used for the land coutivating in the new resettlement requisitio area, with no less than one mu for a resettler correspondingly. n 2. Compensation criteria for garden, woodland and the land lost are described as 3 and 4 below. 3. The land compensation and resettlement subsidy will be paid to the villages. The criteria for land compensation and resettlement subsidy are 8 times and 5 times the average production value of the three years before land compensation. 4. Criteria for land compensation: 4665yuan/mu for cultivate land, and 3447yuanlmu for the land without registerance; woodland(2500yuan/mu for economic woodland, 1500yuan/mu for shrub, 2000yuan/mu for timberland). 5. Compensation for auxiliaries on the land: all the scattered trees will be compensated in cash, the criteria for fruit trees are 20yuan each, for fixture 1Syuan each. All the tombs to be removed will be compensated by 500yuan each. 6. The land compensation will be paid to the relocated units 3 months before acquisition. Temporar Contractor The project construction period is four years, and the land for y construction is generally along the riverside, most of, which is occupied beach, only parts with scattered trees. According to the land compensation criteria, 1500yuan/mu will compensate the land.
