Resettlement Action Plan of Panjin Wastewater Treatment Project 1 PROJECT DESCRIPTION 1.1 Brief introduction of the projec Wastewater Management subproject of the city of Panjin, Liaoning Province is one of components under the Liao River Basin Project (LRBP), which will consist of Shenyang, Yingkou, Jinzhou urban wastewater subprojects as well as and Yingkou and Jincheng Paper Mill's industrial wastewater management; The subproject of Panjin will surely improve the local condition of Shuangtaizi river, a tributary of Liao river, and sea-shore beach environment. The scope of the subproject will include to construct a Xinglongtai W.W T.plant and relevant urban interceptor system. Panjin W.W.T. plant is located at Pangxie ditch, 300 meter from west of outer-run road. The capacity of the Plant will be 100,000 t/d in short-term and 220,000 t/d for long-term. It is planned that the 8.2 hectares will be occupied for the construction of the Plant. Proposed engineering works will also include 3 interceptors with 13.5 km long totally, 2 pumping stations in the subproject. 1.2 Areas affected/benefited by the project The area affected by the W.W.T Plant construction is Shangfang Branch, Qianjin Farm of Dawa county under the Panjin city; The area affected by sewer's construction is Xinglongtai District of the Panjin city. The areas benefited from the project cover Xinglongtai District, down stream of Shuangtaizi river, sea-shore beachse. At present, the domestic and industrial wastewater of the Panjin are discharged directly to Pangxie ditch without any treatment. Then the wastewater flow through Shuangtaizi river and finally enter to Liaodong bay which caused the pollution of downstream of Shuangtaizi river and off-shore sea water body of Bohai sea and deteriorated the urban environment of Panjin city and. The construction of Panjin Wastewater Treatment Plant will play a important role on improvement of water quality of river system, relieving and eliminating the environmental pollution and protecting the ecological environment in Panjin city. Generally the construction of the project will produce significant social, economic and environmental benefits because the pollution of Bohai bay resulted from the sewage of Panjin city will be mitigated and ecological environment and people's health on both sides of Shuangtaizi river can be protected. 1.3 Socioeconomic background of project area Panjin city is located in the south west of Liaoning, and down stream of Liao river, facing Bohai sea and locating within the Economic Development Zone Rounding Bohai Sea. Geographically, the city is at east longitude 122021' and north latitude 4101, adjacent with Yingkou city on northeast. The city has a low and flat terrain in urban area. Before entering to Bohai sea the Shuangtaizi river go through the Panjin city and divide it into two districts, Xinglongtai district in south and Shuangtaizi district in north. Jurisdiction of Panjin city covers two districts (Xinglongtai and Shuangtaizi) and two counties (Panshang and 22 Dawa). Total area is 3,750Km , including 167 km2 urban with 450,000 population. Panjin city is approved by the State Council to be as one of the outside opening cities in the Liaodong peninsular. As an important petroleum and chemical industrial base, the city has become a modem garden city with a leading industry of petroleum production, transportation, communication, various and harmonious industrial types. 1.4 Application and approval of the project Liaoning Provincial Development Planning Committee (LPDPC) approved the Proposal of the project in Jan. 1999, in the official document of "Approval for Panjin Wastewater Treatment and Reuse Project" 1.5 Design process of the project * Panjin Construction Committee prepared the Proposal of the project and submitted it to LPDPC for 4 panjin-english Jan 30 01.doc Resettlement Action Plan of Panjin Wastewater Treatment Project approval July 1998. * Panjin Construction Committee invited the Liaoning Environmental Scientific Research Institute to complete the Environmental Impacts Assessment of the project in March 1999, and presented it to Liaoning Provincial EPB for review and approval. * Panjin Construction Committee invited Detection and Design institute of Liao River Petroleum Exploration Bureau to prepare the feasibility study report of the project in May 1999, and the report was approved by LPDPC in July 1999. * Panjin Construction Committee invited Detection and Design institute of Liao River Petroleum Exploration Bureau to prepare the preliminary design of the project in Aug. 1999, and submitted it to the LPDPC for approval. * In December 1999 LPDPC approved the preliminary design by No. [1999] 853 Official Document. 1.6 Project ownership and organization The project belongs to urban infrastructure characters. The Panjin Government is responsible for the whole investment and construction of the project. The construction capital for the project will come from local counterpart funding and the World Bank loan. Total investment will need of 198.1697 million RMB Yuan, including 99.76 million Y local funding and 12 million USD of the loan (equal to 98.4 million RMB Y). The Government also will be responsible for the repayment of the interest and loan. Panjin Wastewater Treatment Project Construction Headquarter will be in charge of the detailed implementation of the project. 5 panjin-english Jan 30 01.doc Resettlement Action Plan of Panjin Wastewater Treatment Project 2 PROJECT IMPACTS 2.1 Engineering impacts The Xinglongtai W.W.T Plant will be located on the south bank of Xiaoling river, where is at down stream of 300 meter from west outer-run road, I km from Panjin Solid Waste Disposal Plant. Phase 1 work of the Plant will occupy 8.2 hectare paddy land owned by Shangfang Branch, Qianjin Farm of Dawa county. The land acquisition for the Plant has been completed in Feb. 2000. Peoposed engineering work of the Plant will include to construct 4 interceptors and pumping stations. Details refer to the Table 2-1; The land, houses and ground to be affected or occupied by the project shows in the Table 2-2. The land involved belongs to the temporary land. About 5.3 km interceptors will involve in the temporary use, which may affect 0.5 hectare paddy of Shangfang Branch and 11.2 hectare flooding land on the south of Pangxie ditch. About 8.2 km interceptors will involve in the house demolition for 315 households, 10 business shops, 6 entities. The affected Shangfang Branch has 630 households totally. The population including 1,100 males (52% ), 1,000 females (48%) may be affected; Average yearly income of each person of the Branch is 3,700 Yuan, among which 2,600 Yuan are from the agricultural activities (70%). The directed, 7 panjin-english Jan 30 01.doc Resettlement Action Plan of Panjin Wastewater Treatment Project affected persons by the project is 60 who works in the Branch, including 34 males and 26 females who are all Han nationality. No any other minorities are involved in the land requisition of this project. As the educational level of those people, there are 10 persons below school age, 36 persons obtained primary school and 14 persons obtained middle school educations. Table 2-3 indicates the impact analysis of the project for above. The interceptor construction of the project will affect temporarily 26.3 hectare of the flooding land, of which is belonged to the State-owned, and now is mainly used by Panjin Hydraulic Facilities Management Bureau. Only 0.5 hectare paddy land of Shangfang Branch will be occupied during the construction. The affected period is about half a year generally. As the construction finished re-cultivation can be restored so the impact is not serious and very small. The W.W.T Plant will occupy the Stated-owned paddy land which being used by Shangfang Branch, Qianjin Farm of Dawa county. Since the Farm set up in 1970s the previous management model for the State-owner land is still adopted until now. Through the economy and society change, the employees of the Farm have signed the renting contract with the Farm management authority and will pay rents and taxes to the Farm according to the contract. The employees who reaches the retired age will gain pensions from the Farm; Land requisition conducted in Nov. 9, 1999 is the time of the land unused in winter, so that no any young crops are affected. In March 2000, Shangfang Branch has made a re-allocation land to the directly affected persons by the project within the whole Branch of the Farm. The principle of the land re-allocation to the directly affected persons is to restore the land owned level as same as that before. The land reallocation to the directly affected persons mainly are land employees who have more than I hectare land. The land has been re-allocated is the reserved land by the Branch of the Farm (5% of the total). The new rent contract will be issued to the employee's before the Aug. 2000. In general, this similarly land re-allocation within the Branch of the Farm occurs every three years. The project may also affect 6 entities and 10 business shops. Person or entities affected by the project should be given sufficient compensation and should be provided the opportunities to benefit from the project. * Compensation should be paid before the implementation of house demolition and displacement. * Land will be re-allocated within the whole Branch Farm to ensure the employees losing land due to the project can re-obtain same quantities of lands with their lost * Entities affected by the project should be given the compensation for production and business interruption, house demolition and ground attachments. And employees should be resettled appropriately to make them to recover their production and business as soon as possible. * Participation of PAPs will be encouraged during the preparation of the RAP and their comments and suggestions on relocation and resettlement issues will be fully respected and considered. * Efforts should be taken to improve PAPs'livelihoods and living to a relative higher level before the project, or at least to restore them, in real terms, to pre-displacement levels. 11 panjin-english Jan 30 01.doc Resettlement Action Plan of Panjin Wastewater Treatment Project 4 SOCIO-ECONOMIC SURVEY 4.1 Socio-economic survey process The socioeconomic survey is conducted with a aim of learning the objectives, quantity and quality affected by the project, and providing the basic information to identify the loss compensation, socio- economic assessment, justification of the project scale, socio-economic impact study in the project area, preparing the resettlement and relocation plan, estimating resettlement cost, managing the resettlement implementation, monitoring and evaluating. The Panjin Wastewater Treatment Project Construction Headquarter (PWTPCH) and some concerned departments investigated the objectives and quantities affected by land requisition and house demolition of the project in May 1999 in order to prepare the Project Feasibility Study. Land requisition scope demarcation, detailed impacts survey and on-site measuring were conducted in Jan.2000. At the same time, the compensation standard was negotiated. The land requisition for the Plant was completed in March 2000. Details of the land requisition is shown as following: * Land requisition scope identified in Oct. 1999; * Compensation agreement of the land requisition signed in Oct. 1999; * Land requisition implemented from Nov. 1999 to Feb. 2000; * Lands re-allocation within the Shangfang Branch id March 2000; The Panjin WTPCH made a survey on houses, lands and ground attachment affected by the project construction from July 2000. On this base, an initial resettlement plan was presented. At the same time, a public opinion survey for total sampled 20 households within affected area was carried out; Before the survey, a special technological training was undertaken. Area of the houses to be dismantled was measured. Number of person, demolition area of the affected shops, entities as well as people affected by demolition were all investigated. Involved people and entities affected by the project are full participated in the process of the survey and agreed the survey results. Before starting the project construction, further surveys and measuring on house demolition will be made as re-identification. 4.2 Shangfang Branch, Qianjin Farm of Dawa County Land occupation scope for the Plant will be in the area of the Shangfang Branch, Qianjin Farm of Dawa County. At present, the Shangfang Branch has 2,100 more employees totally and about 400 hectare paddy land. The Branch as one of 12 subsidiaries of the Qianjin Farm is managed and controlled by the Farm; The Shangfang Branch is divided into three production teams. The land to be occupied by the project belongs to the third team; Agricultural production is a main activity of income source, in addition the Branch has 5 small entities. Net capita income of the Branch in 1999 was 3,700 Yuan. The Branch established Administration Committee in 1998, which comprises of 4 people (including I director and 1 secretary) being voted democratically by the villagers. Any decision made by the director will be discussed and agreed with all the villagers. The comments and suggestions of other employees of the Branch will also be considered. 4.3 Residents affected by the project Each family of the residents affected by the project was investigated. Content of the survey include: name, sex, relationship with householder, age, educational level, nationality, profession, occupation, annual income, distance to working unit, working time, secondary profession/income, employment target/skill, willings of re-location place and resettlement ways. 315 households may be affected by the project, involving 1,354 people, among them 90.6 % from urban and 9.4 % from rural (male 52%, female 48%). Educational level of the affected people are as: prior to school age 4.6%, illiterate people 1.4%, primary school 31%, middle school 48%, university 15%; For the nationalities affected by house demolition, and besides of 1,146 persons Han nationality (84.6 %), 12 panjin-english Jan 30 01.doc Resettlement Action Plan of PanJin Wastewater Treatment Project there are ethnic minorities to be affected as: 83 persons Man nationality (6.13%), 121 persons Korea nationality ( 8.93 %), 4 persons Mongolia nationality, (0.295 %). 4.4 Residential houses affected by the project Residential houses to be dismantled by the project were investigated on the basis of checking House Property Certificate and Land Use Certificate. For the house which is no the House Property Certificate, the actual house area was measured on-site. The detailed content of the survey included house owner, user, house structure, stories, rooms, construction area, facing direction, rented or not, auxiliary facilities. It is surveyed that 30,538.16 m resident housing will be demolished for the project. It is indicated the brick-wood structure of the housing occupies 86.3 %, brick-concrete structure 10.3 %, simple structure 3.4 %. 4.5 Business shops affected by the project The business shops affected by the project were investigated on the basis of checking House Property Certificate, Land Use Certificate and Business License; The following items were recorded: name, location, condition of use, opening time, employee numbers, decoration, affected extent, renting condition, re-settlement willing, etc. 2 The project may totally affect 10 business shops with 5,02.6 m and 25 employees. 4.6 Entities affected by the project The entities affected by the project were investigated on the basis of checking House Property Certificate, Land Use Certificate and Business License; Content of the survey include name, affected employee numbers, average month salary, affected housing area, dismantled housing area, house structures, construction years, use condition, demolition extent, decoration, dismantled equipment, occupied land area, resettlement way and willings; The public infrastructure facililties to be dismantled by the project include: communication, power, water supply, drainage, gas, greening etc.; Investment and operation for the enterprise's business include: annual output / sale / income / profits /taxes, total annual salary, fixed assets and main business etc. There are 6 entities will be affected for temporally land use and demolition by the project. 3,304 m2 housing will be demolished and 157 persons affected; The 6 entities are Xinghaiyongcheng Corporation, Fire Fighting Branch Corporation of Liao River Petroleum Field, Well Drilling Machine Repairing Plant, Zhongye Corporation of Liao River Petroleum Field, No. 2 Branch Team of Liao River Petroleum Field, Panjin Detection and Exploration General Corporation. 4.7 Land occupied by the project The land occupied by the project is identified on a land map and is measured actually under the participation of the affected people. The W.W.T Plant will permanently occupy 8.2 hectare land which are all belonged to the State-owned paddy. There will be 60 persons losing their land. Two new pumping stations will occupy 0.344 hectare State-owned land; For the temporary land occupation, 27.144 hectare will be used temporarily, including 0.5 hectare paddy land of the Shangfang Branch, 26.3 hectare State-owned flooding land of Panjin Hydraulic Bureau, and 5 persons worked at the Shangfang Branch will be affected. 4.8 Ethnic minorities affected by the project Totally, 1,354 persons will be affected by the project, among them there are 214 persons are ethnic minorities, including 83 Man nationality, 121 Korea nationality, 4 Mongolia nationality. Man minority people distribute everywhere on China, mainly on northeast of our country, particularly on Liaoning province. Man nationality has its own language and literature. Since Qing dynasty Man nationality people communicate frequently with Han nationality people adapt gradually the language and literature of Han nationality. At present Man nationality people mostly don't use their own language. After so many years Man nationality sorbed many merits from other nationality people and many their own traditional culture and custom are assimilated in the Chinese nationality. 13 panjin-english Jan 30 O.doc Resettlement Action Plan of Panjin Wastewater Treatment Project Mongolia nationality people mainly distribute in Inner Mongolia Autonomous Region, Xinjiang Autonomous Region, Qinghai, Gansu, Heilongjiang, Jinlin and Liaoning province etc. Mongolia nationality is regarded as a nationality of riding on horse because they are good at horse archer, singing and dancing. Korea nationality people mainly distribute Yanbian Korea Minority Autonomous County of Jinlin Province, and on other places Korea nationality people also can be found such as Heilongjiang, Liaoning, Inner Mongolia Autonomous Region etc. The festival custom of Korea nationality is same mostly with that of Han nationality. In order to learn about the ethnic minority condition of the impact by the project, the Consultant of MW Corp. and counterpart staff of the local Project Construction Headquarter have made the interviews with some of the ethnic minority people affected by the project. The following are the record during the interview: 1 Ms. Wang Xiaoli, Mongolia nationality who is now unemployed. The family has 3 people and moved to Panjin city before 15 years. Her husband is Han nationality and her son is Mongolia nationality who is 11 yeas old and in primary school. Her husband is employed with 500-600 Yuan monthly income, so the family has a good living. She said that now Mongolia nationality people have no special living style, custom and as same as the Han's nationality. There are some preferential policy for ethnic minorities by the Country and we all took part in the democratic voting of the Farm 2 Mr. Yang Xingwei, Man nationality, 42 years old who is employed with 2000-3000 Yuan annual income. In addition the family can get 6,000 Yuan income per year by renting the house. The family has 3 people including one 18 years old child, in high middle school. His wife is Mongolia nationality. He said that they moved to Panjin city in 1975, main considering that Panjin is an oil-field city with quickly development. He also said that living style of Man and Mongolia nationalities are the same and no different and any other particular custom.. 3 Ms. Tong Xiaomin, Korea nationality who works in Panjin Hydraulic Facilities Management Bureau with about 700 Yuan salary per month. The family has 5 people, including her retired parents, one child and husband who is also working in the same Bureau. The family has a good income and better living condition. She said that the living custom of Korea ethnic minority is entirely same as Han nationality now. She can get the same promotion chance in the post with Han nationality staff. She has a good relationship with her colleges and neighborhoods. Through survey and interview with the affected ethnic minority people and some people working in the Government agencies, it can be learnt that the ethnic minority people affected by the project don't have particular custom compared with Han nationality on living custom, language, culture, religious. The ethnic minority people affected by the project have scattered among Han nationality community and they marry with other nationality people freely and can take part in all kinds of politic and economic activities normally. So, there is no problems on resettlement for the ethnic minority people affected by the project. 4.9 Facilities and ground attachment affected by the project All kinds of facilities and ground attachment affected by the project were investigated. Content of the survey include: power supply, water supply and drainage facilities, underground structures, motored wells and other kinds of ground attachments. Through the survey, it is found that about 145 graves will be affected by the project. Project implementation unit has paid more attention to this issue. As the proper compensation paid, the concerned family of each grave will be responsible for moving these graves to the place appointed by the Panjin Government; Local people don't have any special custom on grave moving based on the result of the survey. 14 panjin-english Jan 30 O.doc Resettlement Action Plan of Panjin Wastewater Treatment Project 4.10 Typical interview In order to learn about detailed situation of PAPs and compile a practical resettlement action plan, an extensive interviews and discussions have been taken. Several typical interviews are recorded as following: 4.10.1 Mr. Liu, secretary of the Shangfang Branch, of the Farm The Shangfang Branch has 630 households totally, with about 2,100 people and 400 hectare cultivated land. Average annual income of each person is about 3,700 Yuan. There are 3 teams under the Branch; All staffs in the Branch support the construction of the project because the project can improve surrounding environment, and promote local economic development as well as benefit to country and the local people. We will re-allocate the land area of the employees who will loss their land to restore and reach the same level, according to the losing quantity. The land to be used for the project is the reserved land of the Branch and the surplus land of some employees who have rented the land more than I hectare area. 4.10.2 Mrs. Wangjing, the resettler My family has 3 people. I work in Detection and Exploration Corporation of Liao River Oil Field. The house where I live now is my own property. I am very happy when I heard that I can move to a new house which the area will be not less than the previous one. I can overcome the troubles brought by moving and resettlement. 4.10.3 Mr. Yang, the director of Panjin Land Administration Bureau Panjin Government has paid and will pay more attention to the project and requires various concerned departments to give a strong support because it will improve the local environment of our city largely. The project will occupy 123 Mu paddy land of the Shangfang Branch, Qianjin Farm of Dawa county. No ground attachments will be affected except some irrigation channel which need to be diverted. Our Land Administration Department will identify the land compensation standard according to the concerned stipulation and preferential policy of the Country on Land Use. And we will try our best to complete the project successfully. 15 panjin-english Jan 30 Ol.doc Resettlement Action Plan of Panjin Wastewater Treatment Project 5 LEGAL FRAMEWORK 5.1 5.1 Acquisition right and Compensation characters 5.1.1 Land acquisition right and compensation characters Relevant provisions issued by "Land Administration Law of the PRC" indicate that : When any individual or entities implement construction with the land use involved, they should apply to use the State-owned land according to concerned Laws and Regulations. Article 44: When farm land is used for construction, the following approval procedure should be followed. As for road, pipeline and large scale of infrastructure construction project approved by province, autonomous region or municipality directly controlled under central government or construction projects approved by the State Council, in case farm land is used for construction, land acquisition should be approved by the State Council. Article 45: Requisition of the following type of land should be approved by the State Council: a)Basic farm land; b) more than 35 hectares of cultivated land which don't belong to basic farm land; c) other type of land more than 70 hectares. Article 47: Compensation for the land requisition should be identified according to its original use purpose....... Article 58: If the following event occurs, the use right of the state-owned land can be drawn back (the concerned land administration department submit application to original Government which approved the land use right or to the Government which has the right of approving land use right). a) for the purpose of public utility facilities; b) for old urban area upgrading to implement the City Plan and to adjust land use plan. In addition Land Administration Law of the PRC stipulate: that: the transferring of the land use right means that after the Government above county-level approved and the compensation, resettlement paid by the desired land user, the land use right can be transferred to the new user without any more payment. For the following land use purpose, if it is necessary, the Government above county-level can approve the land transferring: urban infrastructure and public beneficial project, key power, water supply and hydraulic facilities construction project of the Country. 5.1.2 Right of housing demolition and compensation characters Relevant provision stipulated by the "Urban Housing Demolition Administration Regulation of PRC" indicate that: Article 8: when any individual or entities dismantle urban houses, they should bring approval documents and demolition plan to submit the recommendation application to concerned Department of the Government above county-level, which is responsible for the urban houses demolition. After approved and house demolition permission certificate issued, the demolition implementation can be started. If the land use right transferring is involved in the house demolition, the land use right transferring should be completed before the implementation of the house demolition. It is not permitted to implement house demolition beyond the approved scope and time. Article 19: The compensation based on Regulation or Laws concerned shall be paid to the owner and user of the houses or ground attachments to be dismantled . Relevant provision of "Panjin Urban House Demolition Administration Regulation" state that: 16 panjin-english Jan 30 Ol.doc Resettlement Action Plan of Panjin Wastewater Treatment Project Article 20: There are 3 compensation way for house demolition which are a) compensation (cash), b) resettlement (new house), c) combination of previous two ways; The resettlement area shall be calculated on the house area before demolished. For cash payment, the compensation will be identified according to the dismantled house area and replacement cost as well as considering its use period. 5.2 Law and administrative procedure Relevant provisions of "Land Administration Law of the PRC" state that: Article 46: For land requisition by the State, after approval according to legal proccdure, the Government above county-level will issue the public announcement of the land requisition / demolition, and organize the implementation; The owner or the user of the requisitioned land should bring the land ownership certificate to the concerned administration department of local Government for registration within the date limited in public announcement. Relevant provisions of "Urban House Demolition Administration Regulation of PRC" state that: Article 10: When the house demolition permission certificate is issued, the department response for the demolition should disclose the information on demolition implementing people, demolition scope and terms etc. by announcement or bulletin or other ways, and should make better explanation if the displaced people have any questions. Relevant provisions of "Panjin Urban House Demolition Administration Regulation" indicated that: Article 8: Any houses owned by individual or entities, and desired to demolish must submit the following files and make an application to Panjin Urban and Rural Demolition and Resettlement Office (PURDRO) to get the house demolition permission certificate. If the above procedure don't are abided, the land administration department will not handle the formality of land use and the planning department also will not issue the construction planning permission certificate. * Approved document of construction project; * Approved document of land planning; * Approved document of land use; * Cost evaluation document of dismantled house; * Demolition plan and resettlement plan; Article 12: Within the term announced by the demolition and resettlement office, agreement on compensation and resettlement should be signed between the demolition implementing people and the displaced people. The agreement should at least include the compensation way, resettlement house area / location, transition method / period, default duty and other provision considering necessary. The complete of this document shall be submitted to the demolition and resettlement office for file. 5.3 Compensation regulation Relevant provisions of "Land Administration Law of the PRC" indicate that: Article 47: Land requisition shall be compensated for on the basis of the original purpose of use. The compensation for cultivated land acquisition shall include compensation for the land, labor resettlement, ground attachments and young crops on the requisitioned land. Compensation for cultivated land requisition shall be 6 to 10 times of the average annual output value of the requisitioned land in 3 years. Labor resettlement subsidies for cultivated land shall be calculated according to the agricultural population resettled. The agricultural population resettled by the project shall be calculated by requisitioned cultivated land amount divided by per capital land allocation before the requisition. The resettlement subsidies for each agricultural people resettled shall be 4 to 6 times of the average annual output of the requisitioned land in 3 years before such requisition. However, the highest resettlement subsidies for each hectare of the requisitioned cultivated land shall not exceed 15 times of its average annual output value for the 3 years prior to such requisition. 17 panjin-english Jan 30 01.doc Resettlement Action Plan of Panjin Wastewater Treatment Project If land compensation and labor resettlement subsidies identified in accordance with the provisions of the second paragraph of this article are still insufficient to help the resettler to maintain their original living level, the labor resettlement subsidies may be increased but it should be approved by People's Governments of provinces, autonomous regions or municipalities managed directly under the central government. However, the total land compensation and labor resettlement subsidies shall not exceed 30 times of the average annual output value of the requisitioned land for the 3 years preceding such requisition. Relevant provision of "Urban Houses Demolition Administration Regulation of PRC" Article 12: Within the term announced by demolition administration office, agreement on compensation and resettlement should be signed between demolition implementing people and displaced people. The agreement should at least include compensation way, resettlement house area and location, transition way and period, default duty and other provision that is thought to be necessary, and it is submitted to demolition and resettlement office for archive. Article 20 There are 3 compensation way for house demolition which are cash compensation, getting house and combination of above two ways. For getting house way, the new house area will be identified according to the dismantled house area; for cash compensation way compensation will be identified according to the dismantled house area and replacement cost as well as considering its use period. Article 22: When getting house compensation way is available for the demolition of legal houses, for the resettled area equivalent to original house area, the displaced people don't need to pay the structure balance cost. If after being resettled, allocation area of one person is less than the average level of Panjin city the displaced people should pay the cost for the surplus area more than original house area based on basic construction price; If after being resettled allocation area of one person is more than the average level of the whole city the displaced people should pay the cost for the surplus area more than original house area based on market price. When cash compensation is available the compensation will be calculated based on house replacement price as well as considering use period. In addition self-resettlement subsidies will be paid. Article 29: as for demolition of production or business houses owned by state, collective, joint-venture or joint-stock, compensation for transportation, un-installation, installation should be given. In case production or business is interrupted and loss is made temporary resettlement subsides should be paid according to social average salary and affected employees. As for demolition of office house, temporary resettlement subsides should be paid according to dismantled house area. As for demolition of legal business house, business is interrupted due to the demolition, compensation for business loss will be paid according to 60% of average monthly income of half a year prior to the demolition and affected period. Article 30: The demolition implementing people will be responsible for compensation or reconstruction and rehabilitation of dismantled facilities such as power supply, communication, heating, gas transportation, urban infrastructure etc. 5.4 Duty of organization Relevant provisions of "Land Administration Law of the PRC" state that: Article 66: The People's Government land administrative department above county level has a duty of supervise and check the activities violating land administration law and regulation. The supervisor of land administration will know well concerned land administration law and regulations and should enforce the law on his duty. Article 70: Land administrative department of the People's Government above county level shall make disciplinary sanction on the state working staffs who violate the law, and punish them according to concerned laws and regulations; If the department don't have such right, they can submit the proposal of 18 panjin-english Jan 30 Ol.doc Resettlement Action Plan of Panjin Wastewater Treatment Project disciplinary sanction to the same class or higher class disciplinary supervision department which can handle them according to concerned laws and regulations. Article 79: If somebody embezzle and un-properly earmark the land compensation and other concerned charge and commit a crime, he should be given criminal sanction; if don't commit a crime, he should be given a disciplinary sanction. Relevant provision of "Urban House Demolition Administration Regulation of PRC" state that: Article 5: Displaced people should be given compensation and resettlement according to the stipulations of the regulation within the stipulated period. Article 6: Estate administration department of the state council is responsible for the management of house demolition in the whole country. Estate administration department of government above county level or other departments authorized by government is responsible for the management of house demolition in local region. Article 7: The government above county level should strengthen the leading of urban house demolition management. Relevant provision of "Panjin Urban House Demolition Administration Regulation" indicate that Article 5: Displaced people should be given compensation and resettlement according to the stipulations of this regulation within the stipulated period. Article 6: Panjin Urban and Rural House Demolition and Resettlement Management Office is authorized by Panjin People's Government to manage, supervise, coordinate and arbitrate the house demolition activities. Article 7: Various level of government, public security, land, mail, power supply, public beneficial facilities management departments should assist the compensation and resettlement work. The individual or entities who make extraordinary contribution to the work will be praised and rewarded. 5.5 Concerned policy of the World Bank on resettlement The policy objectives of World Bank's Operational Directive 4.30: Objective of the Bank for resettlement is to make sure that the resttlers caused by the project can gain the interest from the project. a) Avoiding or minimizing resettlement where possible. b) Preparation of resettlement plans where displacement is unavoidable. The affected people should be insured that : * Compensation for losses at full replacement cost to all displaced persons should be paid. * Assisting all displaced persons with moving and support during the transition period at the resettlement site. * Improvement of former living standards, income earning capacity and productive levels, or at least restores them and the need of poorest people affected by the project should be paid more attention particularly. c) Encouraging community participation in planning and implementing resettlement. A proper community organization should be set up and social and cultural organization in resettlement area should be supported and made use of as possible. 19 panjin-english Jan 30 Ol.doc Resettlement Action Plan of Panjin Wastewater Treatment Project d) Integrating resettlers into host communities and minimizing adverse impacts on host communities. The PWTPCH is in charge of the organization, coordination, supervision and checking of the land requisition, housing demolition and resettlement works, and also response for the preparation and implementation of resettlement action plan. The Land Administrative Bureau of Dawa County is responsible for the land requisition. Panjin Municipal Land Administrative Bureau is responsible for supervision of land requisition. Detection Design Institute of Liao River Petroleum Detection Bureau is responsible for the design of the project. Panjin Urban and Rural Demolition and Resettlement Office is responsible for house demolition and resettlement of the project. The maximum working staff will be up to 54 in peak time. A smooth information flowing channel is set up which will play an important role in implementation of resettlement action. And resettlement implementation organizations are equipped with good transportation and communication tools. Survey, design and supervision organizations have strong capacity and technology on computer operation. The resettlement implementation and monitoring organizations of the project both have rich experiences on land requisition and house demolition and resettlement. The staffing of concerned resettlement organizations are showed in table 6-1. Ownership and properties of affected infrastructures within the red-line scope will be identified firstly, and then information on land acquisition and demolition will be introduced to the affected individual or entities. 6.6.3 Planning for land requisition and resettlement Panjin Project Construction Headquarter, Panjin LAB and Dawa LAB will jointly prepare the land requisition and resettlement plan and related budgets on the basis of the surveyed results and concerned policies and regulations. When it finished, the plan will be submitted to the higher level authority for review and approval. 6.6.4 Approval of resettlement action plan 6.6.5 Declaration of tree cutting Panjin Project Construction Headquarter shall be responsible for providing number of the trees need to be cut to Park & Garden Division of Panjin Forestry Bureau and City Greening Office, and make an application to the authorities for approval. When it is approved, City Greening Office will be responsible for the implementation of cutting trees. Compensation for trees cutting shall be given based on the investigated number of trees. 6.6.6 Agreement of compensation and resettlement Based on the resettlement policy, regulation and proposed plan, Panjin Project Construction Headquarter will sign a land use agreement with Panjin Land Administration Bureau. 6.6.7 Detailed steps for house demolition and resettlement 1) Panjin Project Construction Headquarter entrusts Panjin Urban and Rural Demolition and Resettlement Office to implement house demolition involved in the project. 2) Panjin Urban and Rural Demolition and Resettlement Office sign a compensation agreement of house demolition with affected individual or entities. 3) Affected individual or entities get compensation or after being paid compensation to implement the reconstruction and rehabilitation. 6.6.8 Detailed schedule of land requisition 1) Under the supervision and coordination of the Project Leading Group, the Panjin Project Construction Headquarter (PPCH) sign a lump sum compensation agreement of the land requisition with the Panjin Land Administration Bureau. 2) The PPCH and Land Administration Bureau of Dawa County jointly investigate and record the affected land and ground attachments within the land requisition scope. 3) Panjin Land Administration Bureau negotiate and sign a compensation agreement with the affected Qianjin Farm. The Land Administrative Bureau of Dawa county will be engaged as supervisor and public notary. 4) The Panjin Land Administration Bureau pay compensation to the affected Qianjin Farm according to the signed agreement. 25 panjin-english Jan 30 01.doc Resettlement Action Plan of Panjin Wastewater Treatment Project 5) The Shangfang Branch will re-allocate the land to the affected employees according to the concerned land policy and to make a sure the restored land equal to the previous level. 6) How to spend the compensation should be agreed and decided by more than 2/3 majority of the employees of the Qianjin Farm. 7) Distribute the compensation or benefit brought by the compensation. 6.6.9 Land use certificate As all necessary information prepared, Panjin LAB will issue an official approval. Then, Dawa LAB will issue temporary or permanent land use license. 6.6.10 Summarization and record-keeping After the land acquisition finished, a report summarizing the work should be prepared and kept in the archives. The land requisition and land reallocation within the affected Shangfang Branch has been completed in March 2000. The employees directly affected by the project have re-obtained a land use contract. 26 panjin-english Jan 30 Ol.doc Resettlement Action Plan of Panjin Wastewater Treatment Project 7 QUALIFICATION AND POLICY OF COMPENSATION 7.1 Compensation recipient qualification All the people affected by the project may will be given the rational compensation and help. * The employees of the Shangfang Branch, Qingjin Farm affected by the land requisition of the project. * People cultivating on the land which will be affected temporarily by the project construction. * Owner of the housing properties which will be dismantled due to the project construction. * Owner of the ground attachment affected temporarily by the project construction. 7.2 Compensation policy 7.2.1 Principle The detailed resettlement policy is made based upon the concerned resettlement policy prescribed by the P.R. China, Liaoning Government, Panjin Municipal Government and the World Bank as following,' * Compensation standard for all assets affected by the project is identified based upon replacement cost. * Compensation will be paid before the properties and land are occupied. * PPCH will negotiate with the owners of the assets affected by the project on compensation and resettlement. * Cash compensation for the house demolition will be calculated according to the construction area of the demolished house and its replacement cost. * For employees of the Shangfang Branch, the losing land will be re-allocated to ensure their living level will not be lower than that before the project. * The affected ground attachment will be compensated entirely according to market price. * Illegal structures are also compensated properly. * Rational compensation will be paid to all persons affected by the project. * Interruption lost compensation and employees salary subsidies will be paid for the affected shops and entities according to the affect period and extension. 7.2.2 Compensation policy for all kinds of PAPs A. Qingjin Farm of Dawa County: * They have right of getting land compensation. B. Employees of the Shangfang Branch, Qingjin Farm of Dawa County * Their income level will be restored to the previous level before the project by using the land compensation and labor resettlement subsidies. * Land will be re-allocated to them. C. Owner of residential house to be dismantled. Three ways: * House resettlement: When getting house, the compensation way is available for the demolition of legal houses. For the resettled area equivalent to dismantled house area, the displaced people don't need to pay the structure balance cost. If, after being resettled, allocation area of one person is less than the average level of Panjin city, the displaced people should pay the cost for the surplus area more than original house area based on basic construction price; If after being resettled allocation area of one person is more than the average level of the whole city, the displaced people should pay the cost for the surplus area more than dismantled house area based on market price. * Cash compensation: When cash compensation is available, it will be calculated based on the house replacement price as well as considering use period. In addition, self-resettlement subsidies will be paid. * Combination of getting house and cash compensation. D. Affected entities or business shops. * In case of production or business are interrupted, the salary compensation will be paid according to the average monthly salary level of existing Panjin ciy. * In case of getting house, the compensation way is available for the demolition of the entities or business shops. Owner of the ground attachment Compensation will be paid to the owner of the ground attachments according to the market price. 28 panjin-english Jan 30 Ol.doc Resettlement Action Plan of Panjin Wastewater Treatment Project 8 COMPENSATION STANDARD 8.1 Land Acquisition of Wastewater Treatment Plant The land compensation standard is determined based on the land benefit estimate according to the Land Administration Law. Table 8-1 presents three years average output value of the affected lands. Note: the output value of by-product = the output value of main product x 30 % According to the Land Administration Law of PRC and related regulation concerning state-owned land transferring of Panjin, the land compensation is determined as ten times as three years average output value. The labor resettlement subsidy is as six times as three years average output value. Altogether it is as sixteen times. Based on the concerned regulation of China and the negotiation between the Construction Headquarters and Dawa County Land Administration Bureau, the land transferring payment identified to be 328,000 Yuan/hectare. According to Implementation Directives of Farmland Occupation Tax of Liaoning Province, the average farmland occupation tax will be determined by the local capita farmland allocation level and economic development level. The farmland occupation tax is 5.5 Yuan/M2 for the project. According to above requirement, the land reclamation cost is 10 Yuan/M2. Young crops compensation is determined based on one- season output value; management fee is 4 % of the land acquisition cost; The land use fee is 28 Yuan/M2. Irrigation channel diversion cost is determined as 22,500 Yuan/hectare. The land re-cultivation cost will be identified based on one time of young crop compensation. The management fee is 4% of land acquisition cost. Table 8-3 presents compensation standard for temporary land use of the project. The affected residents can choose the compensation way depending on its own idea. 8.3.1 Cash Compensation According to the Implementation Directives of Houses Demolition of Panjin and the Notice on Adjusting Houses Compensation Standard issued by Panjin Construction Committee, the cash compensation standard will be identified based on replacement cost. (3) In case resettled house area allocation is more than the average living area of 13m 2/person of Panjin city, cost should be paid for extra area more than dismantled house based on house market price. 8.3.3 The Combination of Cash Compensation and getting house In case cash compensation and getting house are available simultaneously the compensation standard will be carried out based on 8.3.1and 8.3.2. 8.3.4 Other Compensation policy Besides above mentioned compensation policy, the following compensation policy will be applied: * Moving subsidy: 200yuan for each household. * Temporary renting house subsidy: 50 Yuan/person subsides for household which include 3 members or less than 3 members; 20 Yuan subsides for extra members in case of household of more than 3 members. * Working interruption subsidy: I the affected householder doesn't have fixed job, he can get 50yuan subsidy for the household. * Telephone moving subsidy: 600yuan for each telephone * Decoration compensation: It will be identified according to replacement cost as well as considering use period, but it won't beyond 20% of the house price * Compensation for production or business interruption: A. If the affected residential house is also used for business: Compensation for business interruption will be paid based on 60% of net; B. If the affected residential house is also used for production: The compensation for production or business interruption will be identified according to (1) equipment transportation and installation cost (2) affected employees and social average monthly salary. 31 panjin-english Jan 30 Ol.doc Resettlement Action Plan of Panjin Wastewater Treatment Project 8.3.5 For the affected illegal houses, the compensation will be paid based on house replacement price as well as considering the use time of the house 8.4 Compensation and resettlement for business Shops and Entities 8.4.1 Getting house compensation way Structure balance cost should be paid for resettled area equivalent to dismantled house area, see table 8-4 for details; cost for extra area beyond dismantled house area will be calculated based on market price; the smaller area than dismantled house area will be compensated according to above mentioned standard. 8.5 Cash compensation way Compensation will be calculated according to house replacement cost, see table 8-4 for details, except this 380yuan/m2 self-resettlement subside should be paid. 8.5.1 Compensation for production and Business interruption and salary In case production or business is interrupted and loss is made the temporary resettlement subsides should be paid according to Panjin social average salary and affected employees. The lands acquired in this project are state-owned lands, being used by Shangfang Branch Farm of Qianjin Farm in Dawa County. The Branch farm reallocated lands to the directly affected employees and ensured them re-obtain lands at least as big as that before land requisition. The land acquisition was finished in December, 1999 when land was un-used. Land reallocation was completed in March, 2000. The affected employees have signed new land contracts and the production has been rehabilitated. The income of the people affected don't drop down. The table 9-1 presents the detail of the land reallocation. The working staffs visited Mr.Wang Baocai, a employ affected by the project, the following recorded the interview: My family had 8.6 Mu paddy land before land requisition. And this time 4 Mu land were requisitioned by the project. The branch farm reallocated 4 Mu land to my family from Mr.Liu Chaozhuang whose land more than 15 Mu. I think the adjustment is reasonable and acceptable. I have signed a new land contract on August 15, 2000. Through investigation, all the people affected by land requisition have re-obtained lands and their production and living also have been restored. 9.2 Resettlement of Residential Houses to be dismantled There are 3 resettlement ways which are cash compensation, getting houses, and re-built house by owners of dismantled house themselves. Table 9-2 presents the situation of resettlement of residential houses demolition. Panjin city can supply enough houses for resettlement of the porject. Based on investigation, most of these affected shops and entities can be rehabilitated on their original sites. But there is rule that within the scope of 5m and above pipeline, permanent buildings are not permitted to build, so the land area that can be reused has to be decreased. In order to relieve the impacts for business and production efficiency of land use will be increased and sewer construction is phased so some shops or entities can be reconstructed before its demolition. So the shops and entities won't be affected greatly. Affected employees can get their salary from their working unit. If production and business interruption is involved, compensation will be paid, so income of affected employees won't drop down. Table 9-3 presents the resettlement plan of affected shops and table 9-4 presents the resettlement plan of affected entities. The construction of sewers along road will stagger the rush hour as possible. * Measures relieving dust: Air borne dust in dry weather condition due to excavated soil stockpiled on the side of road will affect the surrounding entities and people. In order to relieve the impacts during construction period, water will be sprayed on excavated soil in fine or windy day to avoid dust raising. The waste soil will be disposed appropriately in time and over-loading during delivery to outside will be avoided. The construction site and hauling route will be cleaned up timely. * Noise controlling: Construction noise produced by excavation, vehicle bugle, engine, concrete mixing and road roller will affect the surrounding residence. To relieve these noise impacts construction is forbidden within 200 m distance from residential areas during 11 o'clock at night to 6 o'clock in the morning. In addition equipment with low noise will be adopted as possible. In case of urgent construction at night affecting the surrounding residence noise-relieving measures should be taken and the noise intensity should be controlled within 40-60 dB, at the same time noise isolator around construction site will be installed to ensure the acoustic environment in residential areas. * Solid waste disposal in construction site: The owner and construction unit of the project should contact with the local sanitary department to clean up solid waste timely to ensure the cleaning at construction site. 38 panjin-english Jan 30 Ol.doc Resettlement Action Plan of Panjin Wastewater Treatment Project 11 PUBLIC PARTICIPATION AND CONSULTATION 11.1 Strategy of public participation Public participation and consultation will be paid much more attention in this project. And comments and suggestions of PAPs were collected extensively and considered during the process of resettlement planning and implementation so that appropriate arrangements for resettlement are in place which meet PAP needs and desires wherever possible, and which protects the legal rights of affected entities and individuals. Complaints and grievance of PAP are to be avoided and reduced as possible through implementation of consultation processes. In the feasibility study stage of the project the staffs of project construction headquarter made many surveys on opinions and comments of municipal and each district government, people's congress, political consultation congress, public communities, PAPs for sewers route, location and plan of WWTP and land requisition and resettlement. The survey results are analyzed and put into the report. Table I1-I shows the general information on public participation and consultation of the project. Opinions and comments of employees of Shangfang Branch Farm were enquired and collected during the implementation of land requisition of the project. And the land requisition was completed under widely public participation and consultation. In December 1999 a general conversation and discussion meeting with affected employees, cadre and woman representatives of Shangfang Branch Farm was hold in which project information was introduced and their opinions were collected. In January 2000 land requisition announcement was issued. At the same time concerned policies, regulations, compensation standard, resettlement plan were introduced and explained to affected people. Many interviews and discussions with PAPs were hold during the implementation of land requisition so that their opinions for the project are acquired and learned. In March 2000 under the guidance and help of Administration Committee of Qianjin Farm, Land Administration Bureau of Dawa County, Land Administration Bureau of Panjin, by democratic negotiation, the Shangfang Branch Farm identified the resettlement plan of people affected by land requisition and land reallocation plan. In August 2000 notification on enquiring social opinions and comments to Project Wastewater Treatment Project was advertised in local newspaper. Public participation and consultation will be encouraged and strengthened by using the following ways in the future: (1) PAPs will participate in the process of house demolition and resettlement. Representatives of affected people, shops and entities will participate in the process of survey of houses and ground attachments to be dismantled, identification of compensation standard, and negotiation and implementation of resettlement and compensation agreements to ensure the full consideration of PAP's interests and opinions and to guarantee the fair, reasonable and transparence of demolition and resettlement. (2) The policies concerning land requisition and house demolition will be disclosed and propagated by using public media. (3) Issuing public announcement of house demolition The contents of public announcement will include at least: brief introduction of the project, demolition scope, resettlement policy (including compensation standard), organization being responsible for demolition, demolition and resettlement schedule, rights and obligation of PAPs, complaints and grievance, monitoring and evaluationof the implementation of demolition etc. (4) The resettlement action report reviewed and approved by the World Bank will be kept in Panjin Urban Drainage Management Liability Company to ensure the report is availabe to be read by anyone who is interested in the project. (5) After the resettlement action plan report is approved by the World Bank, Panjin Project Construction Headquarter will summarize a resettlement manual which will be distributed to each PAP. They have the same or similar living and production custom, social and cultural background with people living in other areas of Panjin. After resettlement their social relationships will not be broken so there are no obstacle on integration of resettlers with host communities and populations. 42 panjin-english Jan 30 01.doc Resettlement Action Plan of Panjin Wastewater Treatment Project 13 GRIEVANCES AND APPEALS Special attention will be paid to the participation of individuals and entities affected by the project throughout the process of compilation and implementation of the RAP. Transparent and efficient grievance redressing procedure is established for the project as follows: * Stage I If people or entities affected by the project are dissatisfied with the RAP and implementation of RAP, they can appeal to concerned departments orally or in writing. And concerned department should settle the grievance within 2 weeks. * Stage II If people or entities affected by the project are dissatisfied with the solution of stage I, they can then appeal to Panjin Wastewater Treatment Project Construction Office. And the Project Construction Headquarter should make a decision on complaint within 2 weeks. * Stage III If people, shops or entities affected by the project are still dissatisfied with the solution of stage II, they can appeal to Panjin Urban and Rural House Demolition and Resettlement Office (organization in charge of the implementation, monitoring and arbitration of house demolition) and Panjin Land Administration Bureau (the organization in charge of monitoring and arbitration of land requisition) and submit the dispute for arbitration. The arbitration organization will make arbitration on the complaint within 10 days. * Stage IV If people, shops or entities affected by the project are still dissatisfied with the arbitration, they can appeal to the people's court in accordance with the administration procedure law of PRC after receiving the decision of the arbitration organization. The people, shops or entities affected by the project can make an appeal on any issues of resettlement. The PAPs will be informed of the procedures above mentioned grievance redressing through meetings and other ways to ensure that they are clear about their rights of grievance and appeals and can protect their own rights. 43 panjin-english Jan 30 01.doc Resettlement Action Plan of Panjin Wastewater Treatment Project 14 IMPLEMENTATION SCHEDULE OF RESETTLEMENT ACTIVITIES 14.1 Coordination of resettlement implementation and project construction According to the project construction schedule, the construction of Panjin Xinglongtai Wastewater Treatment Plant will begin to construct in June 2001 and will be completed in October 2003. The schedule of land requisition, house demolition and resettlement should be determined according to project construction schedule. The basic principles to ensure the progress of land requisition, house demolition and resettlement fit to the project construction progress is showed as follows: * The schedule of land use of the project will be determined according to the schedule of sewers construction and treatment plant construction respectively. * Sufficient time should be left for land requisition and resettlement before project construction beginning. * Land requisition shall be completed one month before land use of project. The Joint schedules of project construction and land requisition are showed in table 14-1. Calculated at the price in October 2000, the total cost of land requisition, demolition and resettlement of the project is RMB 54,389,828.61 Yuan. 15.1.1 Basic cost Basic cost include compensation for permanent land requisition, temporary land using, house demolition, business interruption of affected shops or entities, affected ground attachments. 15.1.2 Management fee 3 percent of basic cost should be used as project management fee which will be used for activities relating to land requisition, demolition and resettlement such as equipment procurement, transportation, meeting, communication, trip and handling official business. 15.1.3 Contingencies fee 10% of basic cost will be used as contingency cost which comprise of material contingency and price contingency. The material contingence fee is prepared to pay the additional costs resulted from the changes in project design and affected tangible materials during the implementation of RAP. The price contingence is prepared with mainly considering the inflation and changes in price during the implementation of RAP. The estimation of contingence cost mentioned above is based on the price in October 2000. 15.1.4 Survey and design cost 2% of basic cost is used as cost of survey and design. 15.1.5 Monitoring and evaluation costs 2% of basic cost is spent as monitoring and evaluation costs. Panjin LAB then signed a agreement with Qianjin Farm and implemented the land requisition. Land occupation tax, land reclamation fee, management fee were paid to concerned departments by Panjin Wastewater Treatment Project Construction Headquarter; compensation for ground attachments and green seedling were paid to directly affected employees. 15.3.2 Temporary land use Panjin Wastewater Treatment Project Construction Headquarter will sign a temporary land use agreement on land use quantity, construction time, compensation (including young crop, and land restoration fee) with affected employees or entities and will pay the compensation according to the agreement. 15.3.3 House demolition Panjin Wastewater Treatment Project Construction Headquarter will sign a general implementation contract for house demolition with Panjin Urban and Rural Demolition and Resettlement Office. Panjin Urban and Rural Demolition and Resettlement Office will sign compensation agreement for house demolition with the owner of properties to be dismantled, and pay compensations according to the agreement. 15.3.4 Compensation funds flowing Figure 15-1 shows the compensation funds flowing. There are 2 kinds of monitoring mechanism for resettlement action which are internal monitoring and the external monitoring carried out by a independent institution. The internal monitoring is carried out by LUCRPO, Panjin Project Construction Quarter, Panjin LAB, LAB of Dawa county to ensure that the schedule and principles in the RAP will be followed. The purpose of internal monitoring is to make the resettlement organizations fulfil their duties efficiently during the implementation of the RAP. Independent monitoring organization is responsible for conducting independent monitoring and evaluation on activities of land requisition, demolition and resettlement regularly. Resettler Research Center of Hehai university is invited to undertake the independent monitoring of the project which covers the following contents: * Operational efficiency of resettlement network; * Progress and compensation of land requisition, demolition and rehabilitation and resettlement; * Resettlement and restoration of people and entities to be dismantled; * Investigation and analysis of living level of PAPs; A independent organization is entrusted to monitor and evaluate externally the implementation of RAP from an overall and long-term point of view. Independent monitoring organization will follow the resettlement activities of the project closely to evaluate whether the goals of resettlement are achieved. The evaluation criteria include: * To follow national laws and regulations relevant to land acquisition, demolition and resettlement; * To comply with the principles of operational directive 4.30 on involuntary resettlement of the World Bank; * To help PAPs to improve their living standard or at least to restore it to the level before the project. The independent monitoring organization should provide suggestions about the RAP implementation to concerned institute so as the problems incurred during the implementation of RAP can be resolved without delay. 16.1 Internal monitoring and evaluation Panjin Wastewater Treatment Project Construction Headquarter will develop an internal monitoring system to check the resettlement activities and establish a basic database on resettlement activities which is used to compile the RAP and to monitor and evaluate the affected people and entities. And also the whole course of resettlement preparation and implementation will be monitored and evaluated internally. 16.1.1 Implementation procedure During the implementation of RAP, Panjin project construction office, Panjin Land Administration Bureau, Land Administration Bureau of Dawa county will collect and record the information of people and entities affected by the project according to the samples provided by monitoring organizations. At the same time, they will report the current activities record timely to Project Construction Headquarter so as to ensure a continuous monitoring on implementation. Panjin Project Construction Headquarter will check regularly the implementation of RAP and report the progress to the higher authorities concerned. In the internal monitoring system mentioned above, unified form will be made in order to realize continuous information flowing. Panjin Project Leading Group, Panjin Project Construction Headquarter, Land Administration Bureau, Land Administration Bureau of Dawa County as the important components of internal monitoring system should carry out regular inspection and verification on the implementation of RAP. 49 panjin-english Jan 30 01.doc Resettlement Action Plan of Panjin Wastewater Treatment Project 16.1.2 Tasks of monitoring * Payment of compensation to affected people and entities; * Resettlement of people affected by the project; * The schedule of the above monitored activities; * Conformity with the policy and regulation of RAP; * Community participation and consultation during the implementation of RAP; * Staffing, training, working schedule and working efficiency of resettlement institutions; 16.1.3 Internal monitoring and evaluation report Land Administration Bureau of Dawa county and Panjin Project Construction Heaquarter should prepare and submit the progress report of resettlement implementation to LUCRPO by which the report will be sent to the World Bank for review. 16.2 Independent monitoring system Independent monitoring will be carried out based on the census date provided in the RAP and by resettlement implementation organization. 16.2.1 Independent monitoring organization (IMO) Panjin Project Construction Headquarter invited Resettler Research Center of Hehai university (RRCOHU) to carry out the external monitoring and evaluation of the project. The independent monitoring team comprises of 8 resettlement specialists who has rich experiences on resettlement policy and social evaluation and management etc. 16.2.2 Duties RRCOHU should follow, monitor and evaluate the implementation of RAP. And it should provide advice and suggestions on progress, quality and funds of resettlement and provide external monitoring and evaluation report to project office and the World Bank. 16.2.3 Monitoring and evaluation procedure (1) To compile the outline of independent monitoring and evaluation; (2) To develop monitoring and evaluation information system software; (3) To prepare and compile survey outline and questionnaire and recording card of affected entities; (4) To work out sampling survey plan (5) To carry out baseline survey to get the basic information of people and entities affected by the project; (6) To establish monitoring and evaluation information system; (7) To conduct monitoring and survey with * Socioeconomic survey; * Working capacity and efficiency of resettlement implementation organization; * To monitor sampling PAP households on the compensation and resettlement quality; * Public consultation To take part in the consultation activities during RAP compilation and implementation and to monitor the quality of public consultation; * Appeal and grievance * Re-cultivation of temporarily used land (8) Collection of monitoring information and establishment of database; (9) Comparison and analysis; (10) To prepare monitoring and evaluation report once a year; In November 2001 to complete the baseline survey and the first monitoring and evaluation report; In November 2002 to complete the second monitoring and evaluation report; In November 2003 to complete the third monitoring and evaluation report; In November 2004 to complete the post assessment of resettlement; 16.3 Monitoring index * Socioeconomic index: per capita income, Gross Domestic Product, employment rate; * Institutional index staff, qualification, regulations and rules, equipment, working efficiency; * Entities affected by the project- availability of compensation funds, employment rate, income changing rate, satisfaction degree on resettlement; * Households losing land availability of compensation funds, employment, income changing rate; 50 panjin-english Jan 30 Ol.doc Resettlement Action Plan of Panjin Wastewater Treatment Project 16.4 Post assessment After the project finished post assessment of the project will be conducted based on the monitoring and evaluation to assess the successful experiences and lessons from the project. Panjin Project Construction Headquarter will invite external independent monitoring institute to conduct the post assessment of the project. They will firstly compile an outline of post assessment work and establish a assessment index system, then make a socioeconomic survey and analysis.
