Passing through 4 counties of Zhangzhou City,the Zhangzhou- Zhao'an Expressway is located in the economy,technology, industry, resources and intelligence reletively highly concentrated and urbanized area of Fujian Province.Its completion will no doubt play a great role in promoting the socio-economic development, accelerating the circulation of goods and materials and expanding the exchanges between different areas in Fujian Province and even the whole country. This RAP is prepared according to the Land Administration Law of t;ie People's Republic of China,local laws and regulaticus of Fujian Province and China Highway Project tesettlemient -uuol Pllan (draft) of the WB.This RAP in a carefully prepared detailed plan, which aims to approp7iately resettle those affected by the project and have them benefit from the project,improving or at least maintaining their living standards as before the project construction. During the data collection and preparation of the RAP,we get much help from Fujian Provincial Traffic Planning and Design Institute and the traffic bureaus,land administration bureaus and resettlemcnt offices along the expressway.Please let us to express our sincere thanks to them. Objectives of the RAP and the Definition of Resettlement Terminology. This Resettlement Action Plan (RAP) is prepared according to the Laws and Regulations of PRC, and Fujian Province as we!l as the Guidelines of the World Bank (Operational Directive for Involuntary Resettlement OD 4.30). The purpose of this document is to set out an Action plan for the Resettlement and Rehabilitation of the Project Affected Persons (PAPs) to ensure that they will benefit from the project and their standards of living will imnprove or at least be restored after the project impact. Acquisition of land and other assets for the project will adversely affect the livelihood of persons who live, work or earn their living on the land that will be acquired for the project. PAPs are defined as those persons whose income or livelihoods will be adversely affected by land acquisition for the project. PAPs include the following categories: a)persons who have a title, right, interest, in structures (houses, enterprises, shelters, or public buildings), land (including residential, agricultural, and grazing land) or any other asset acquired or possessed, in full or in part, permanently or temporarily; b)persons who use the structures, land or assets described above; or persons whose business, occupation, work, place of residence or habitat adversely affected; or c)persons whose standard of living is adversely affected as a consequence of land acquisition. A definition of PAPs is given below: Definition of the PAPs: "Affected Persons" means persons who on account of the executen' vf ue opiujixt had-orwvvld havt. :ri: a) standard of living adversely affected; or b) right, title or interest in any house, land (including premises, agricultural and grazing land) or any other fixed or movable asset acquired or possessed, temporarily or permanently; or c) business, occupation. work or place of residence or habitat adversely affected, and "affected Person," means individually all those who qualify as "Affected persions." PAPs may be individuals or legal persons such as a company, a public institution. Definition of PAPs is not limited to their legal registration or permission to live or conduct business in the affected location, or their title to property Thus, it includes: a)all those affected by the project regardless of their legal rights or absence thereof to the assets being taken; and b) persons without residential permit to live in a certain area. Therefore, all such persons who are affected will need to considered and recorded as PAPs, regardless of their legal connection to assets land or location. If there are more than one person, family or household using or holding a title to the same land or property that is acquired, they will be compensated and rehabilitated according to the loss they suffer, their rights, and the impact on their living standards. The definition of PAPs is linked directly to the adverse effect of the project, regardless of legal rights title or interest All PAPs are entitled to the improvement or at least restoration of their standards of living, and compensation for the material losses they suffer. Compensation for assets will cover replacement cost. No deductions or discounts will be applied to the compensation amount for depreciation or other reasons. All PAPs deriving an economic benefit from the affected land and property are entitled to receive rehabilitation benefits in addition to the compensation for their assets lost. Those PAPs without title, authorization or legal permission to reside, conduct business, cultivate land or construct structures are eligible for rehabilitation of their livelihoods and compensation for their assets on an equal footing with those with formal legal title, authorization or permissions to the assets. The term RESETTLEMENT includes: a) the relocation of living quarters; b) finding acceptable new employment for those whose jobs are affected; c) restoration (or compensation) of affected productive resources such as land, work- places, trees and infastructure; d) restoration of other adverse effect on PAPs' living standards (quality of life) through land acquisition (such as the adverse effects of pollution); e) mestoration of or compensation for affected private and public enterprises; and f) restoration of adversely affected on cultural or common property. Rehabilitation means. the restoration of the PAPs' resource capacity to continue with productive activities or lifestyles at a level higher or at least eaual to that betore the project. -_ The objective of this RAP is to provide a plan for the resettlement and rehabilitation of the PAPs so that their losses will be compensated and their standards of living will be improved or at least restored to the pre-project levels. To achieve the.e objectives the plan provides for rehabilitationimeasures to that the income earning potential of individuals are restored to sustain their livelihoods. Affected productive resources of businesses (enterprises including shops) and public property. Infiastucture and cultural property will also be improved or at least restored to their pre-project levels. TERMS OF REFERENCE FOR MONITORING RESETTLEMENT ACTIVITIES IN THE SECOND FUJIAN PROVINCIAL HIGHWAYS PROJECT Introduction 1. The Second Fujian Provincial Highways Project will displace or adversely affect standards of living of people living and conducting economic activities on the right of way. To ensure that the project affected persoxis (PAPs) maintain or improve on their current standard of living, Fujian Provincial Expressway Construction Directorate Office (FPECDO) has prepared a Resettlement Action Plan (RAP). The RAP sets the standards on the basis of which PAPs will be rehabilitated by closing the gap between the implemented resettlement policy and the one developed in the RAP to close the difference. The RAP will be implemented by the Resettlement Offices of the affected cities and counties under the direction of the Project Resettlement Office (PRO) of the of FPECDO. The effectiveness and impact of the RAP will be monitored internally by the PRO. FPECDO has also contracted the services of the Fujian Province Academy of Social Sciences (FPASS) as the Independent Monitoring Organization (IMO) to monitor and assist the responsible resettlement organizations in achieving the objectives of the RAP as well as to ensure that the PAPs take an active part in the process of their own rehabilitation. 2. This terms of Reference oudines the resettlement monitoring work to be undertakea by the PRO and the IMO which have already been agreed and reflected in the RAP. Scope of Work: Internal Mon*toring 3. Internal Monitoring of the complete resettlement organizatioL will be undertaken by the PRO to ensure that all the responsible units follow the schedule and comply with the principles of the RAP. The purpose of this monitoring mechanism is to maintain the satisfactory functioning of the resettlement organization during the implementation. 4. PRO will develop an internal monitoring framework to supervise resettlement activities, employing the database of . PAPs and their assets as the basis of the framework. PRO will maintain the data base and monitor the progress in resettlement preparmfion -and implementation through a 100 % monitoring of the activities with the -asistance of City and County Resettlement Offices (CIROs and COROs). S. Relevant sections of the database will be shared with the CIROs and COROs. During the preparation of the RAP the staff of CIROs and COROs will be trained in the use of the data and their offices will be equipped with necessary equipment to process the data. 6. During the implementation, CIROs and COROs will record implementation information on individuals, households and units on formats prepared for monitoring and deliver the record of the current activity (in electronic form) to the PRO. in this way a continuos monitoring of implementation will be maintained. The PRO will conduct periodic supervision of resettlement at the village and township level (and covering all townships) to verify the reported progress on a random basis. 7. Indicators to be monitored: PRO will be responsible to monitor the following indicators. * Payment of Compensation to the PAPs / units. * Allotment of house plots. * Reconstruction of private housing. * Relocation of PAPs. * Land readjustnent for the PAPs losing land. * Provision of employment to surplus labor and the adequacy of employment in terms of security, public health, skill levels and incomes. * Rehabilitation of the vulnerable groups. * Rehabilitation of infrastructure and public buildings. * Restoration of affected enterprises and replacement ofjobs of the surplus labor of those enterprises. - Scheduling of the above. C* onformity of the above with the provisions of the RAP and O.D. 4.30 * Adequacy of participation of (and consultation with) the PAPs during implementation. * Staffing, training, work schedule and effectiveness of local Resettlement Offices ROs. Scope of Work: Independent Monitorig 8. In addition to intemal monitoring, the IMO will undertake the Independent Monitoring of the resettlement component to observe i) the functic.ning of the resetilt-..tt iixiawuI including the PRO,-and, ii) the adjustment of the PAPs to th--- new lifestyles. The IMO will be responsible to conduct evaluation of the implementation process and the measurement of the standards of living of the PAPs. 9. The purpose of independent monitoring is to provide an evaluation of resettlement b- an organiz,ation independent of the administrative branch of the Provincial Government, looking at the overall implementation from a broader, long term point of view. The IMO will follow the resettlement activity to evaluate whether the goals of resettlement are achieved through i) the application of the Laws of PRC pertaining to resettlement; ii) compliance with the principles of the World Bank's Operational Directive O.D. 4.30 on Involuntary Resettlement; and iii) an improvement in the standards of living of the PAP or at least maintaining the pre-project levels of well-being. 10. Responsibilities of the IMO: IMO will act as an independent advisor to the project and the PRO in evaluating the resettlement performance and suggesting alternative courses of action in case problems are anticipatted in the achievement of the-stated goals of the RAP. Specifically the IMO will undertake the following activities listed in this section 11. Standards of Lming Surveys: IMO will develop and conduct base-line Standards of Living Surveys (SLS) on a random sample of PAPs and a control group before the beginning of the resettlement implementation. SLS will be repeated annually (at least twice after the implementation is completed) to measure the change in the standards of living of the PAPs. This activity will be one of several approaches to determine the changes in the living standards of the PAPs. 12. Open ended interviews with the PAPs and observational methods will be utilized to supplement and guide the structured interview format. The IMO should facilitate the participation of the PAPs in the resettlement process during monitoring and through its consultation with the PRO. 13. Public Consultation: IMO will participate in public consultation meetings held at the village and township level on a regular basis. By monitoring these meetings IMO will evaluate the effectiveness of the PAPs participation, and the incorporation of the PAPs' concerns into the RAP and its implementation. IMO will also consult with the PAPs to understand the knowledge, inclination and the wishes of the PAPs in restoring theiI livelihoods and report its findings to the PRO. These activities will continue before during and after the implementation of resettlement 14. Grievance Issues: IMO will regularly *isit affected sites and inquire about the grievance issues by interviewing the local ROs receiving the grievances and also by interviewing the PAPs. Effectiveness of the grievance resolution framework will be constantly monitored, and if necessary, suggestions will be made for po.sible changes in the piocedtures to make the process more effective . 15. Other Responsibilities: IMO will also Advise the PRO during the preparation and Implementation of the RAP, prepwattun of vilkage-evetimplementation plans for the use of land-compensation funds, and monitor the following indicators: * Payment of compensation and its levels. * Land read.justment. * Preparation and adequacy of resettlement sites. * House construction. * Relocation of PAPs * Provision of enterprise employment, its adequacy and income levels. * Training. * Rehabilitation of the vulnerable groups. * Infiastructure relocation. * Enterprise relocation, compensation and its adequacy. * Compensation of lost assets. * Compensation for lost work time. * Transition allowances. * Payment of replacement cost for lost assets. * Scheduling of the above (whenever applicable). Organization of the resettlement network. Staffing 16. The PRO will be staffed with a director responsible only for resettlement issues related to the highway projects. The director should have prior experience in resettlement work and have authority to coordinate among different departments and offices involved in resettlement work. The PRO should employ an adequate number of staff knowledgeable in data processing resettlement and social issues to be able to carTy out its responsibilities. 17. The IMO should be directed by a director who has at least five years of experience in conducting population surveys. The organizations should have experience in participatory methods, data management, statistical analysis as well as experience in qualitative surveys. Reporting 1 8. Internal and Independent Monitoring will be regularly conducted during the project. During the implementation of resettlement FPECDO will report the results of both monitoring activities to the Bank on a semi-anmual basis (or more frequently) starting December 31, 1999. After the completion of implementation, Independent Monitoring on living standards of the PAPs and the Internal Monitoring on remaining resettlement issues will be reported annually (by January 31 of each year). Brief introduction to the Zhangzhou-Zhao'an Expressway project This project is a continuous expressway,the Zhangzhou-Zhao'an Expressway.Preparation of the pre-feasibility study report for the project started in January 1993 and ended in May 1994.The project was established by the State Planning and Development Commission- formerly called the State Planning Commission in March 1998. Preparation of the feasibility study report started in July 1994 and ended in April 1998,which was approved by the Planning and Development Commission in August 1998.The preliminary design started in July 1997 and ended in September 1998.Designn of the construction drawings will start in September 1998 and is expected to end in August 1999.This project is planned to commence in September 1999 and be finished within 4 years. With a total length of 140.459km (The first 8km soft soil section is financed by domestic fund and has commenced and won't be covered by this RAP),the Zhangzhou-Zhao'an Expresswav starts at Beitou in Longhai City,connecting the finished Xiamen-Zhangzhou Zp.es6way and ends at Houling Village in Zhao'&-iCounty,the border between Fujian and Guangdong Provinces,connecting the terminal point of the Shantou-Chaozhou-Fengshuiguang Expressway. The project affected and benefited areas Located within Zhangzhou City,the Zhangzhou-Zhao'an Expressway starts at Beitou in Longhai City and ends at Houling in Zhao'an County,running throng Longhai City,Zhangpu County,Yunxiao County and Zhao'an County and involving 19 towns/farms and 92 administrative villages in the above 4 counties (cities)-- Resettlement for the first 8km of the Expressway is not included in this Action Plan. Along the expressway 4 service zones and 8 interchanges will be constructed and 2 link roads with a total length of 13.0km will be reconstructed,which will very much improve the traffic conditions there and facilitate the development of the industrial and agricultural production and of township enterprises as well as the people's life along the expressway. 3. Socio-economic backgrounds in project-located areas Connecting Xiamen,one national economic special zone in the north,bordering Shantou City of Guangdong Province in the south, close to Longyan City rich in resources in the west and adjacent to the Taiwan Straits with a 682km long coastal line,the project is located in the far south of the coastal economic development zone in southeasten Fujian where a prosperous economic band on the west bank of the Straits will be established as planned by the provincial Party Committee and provincial people's government of Fujian Province as a strategic target.With fertile land,plenty of rainfall and excellent irrigation facilities,Zhangzhou City is well known as the 'Land of Flowers,Fruits,Fishes and Rice'.In 1994, Zhangzhou City was put by the State Council on the list of national-level foreign-oriented agricultural model areas.As approved by the Ministry of Foreign Trade,Ministry of Agriculture and Taiwan Affairs Office in August 1997,a West-Bank-of-the Straits (Zhangzhou) agricultural cooperation experimental zone was established.Zhangzhou City is also one of the famous towns of overseas Chinese in Fujian Province.In the Eighth-Five years a strategic concept to develop the foreign-oriented economy in an extradinary 'Jumping'-style way was established and substantial * 3 achievements have been accomplished.There are advanced traffic conditions here,connecting the Yingtan-Xiamen Railway,Zhangpu- Quanzhou-Xiaocuo Railway,No.324 National Highway,No.319 National Highway,Fuzhou-Xiamen-Zhangzhou Expressway and Zhangzhou-Longyan Expressway under way.In recent years Zhangzhou has achieved rapid growth in its national economy. The survey results show,that in the towns affected by the project the per-capita floor space occupation reaches 35-58m2,the per-capita cultivated land occupation 0.4-1.3 mu and the average per-mu yield of rice in rainy seasons 500-650kg.The towns along the expressway are mainly engaged in agricultural production.The major crops include rice,tuber crops,beans,oil crops and fruit trees,etc.There are also a few township and private enterprises engaged in building materials,building construction,non-metallic products,small-sized machiney and equipment,handicrafts, transportation by land and water,etc. The project passes through the comparatively economically developed area of Fujian Province.In 1996 Zhangzhou City ranks on or above the average in Fujian Province in per-capita GDP, structural proportion among the three industries,economic growth rate and improvemeht-o; people's living standards.The completion of this project will no doubt accelerate the socio-economic development in this area and even the surrounding areas. Measures to minimize resettlement It is unavoidable that highway construction will involve occupation of land,demolitron of houses and removal of infra- structure and other structures,which will influence the production activities,life and employment of the local residents.To minimize the influence and resettlement,during survey and design of the alignment,we have made comparison of different schemes and tried our best to select the alignment with the lowest resettlement. During discussion of the schemes,Fujian Provincial Traffic Planning and Design Institute,resettlement offices and environmental specialists worked closely,making reconnaissance and consulting widely with local governments and public for opinions so as to finally determine the best scheme.iFor this purpose,we haved taken the following three measures: (1) Select the alignment scheme with lowest resettlement For instance,at the stage of feasibility study there are 3 schemes for the section between Beitou and Jiuzhen-the exterior, central and interior alignments.After comparation,the central alignment was selected,which needs lower construction cost and reduces the house deni,lition by -12376m2 and -land acquisition by 855 mu. (2) Comparison of environmental factors between the alignment schemes A. Andou-Xizhang Section The comparison of environmental factors is shown in Table 1-3. The conclusion drawn from the above comparison is as follows: a. The exterior alignment is by the see.A comparatively small service zone is sufficient.It is not so helpful to local economic development; 5. b.As the exterior alignment is by the see,the heavy fog and Typhoon will affect the traveling; c. The exterior alignment runs through hilly and rolling land. Four tunnels are necessary.The engineering difficulty is high. d. The interior alignment occupies 541mu more land and involes 7134m2 more demolition than the exterior alignment.It will also interfere with planning of the Huaqiao (Overseas Chinese) Farm. CONCLUSION:Though the interior alignment occupies 541mu more land and demolishes 7134m2 more buildings than the exterior alignment and interferes with planning of the nearby Huaqiao Farm, the interior alignment is recommended since it has a larger service zone and shorter tunnel,free from Typhoon and heavy fogs. The impact from more land acquisition and demolition can be mitigated by strengthening environmental protection and resettlement measures.The local people have been informed of the above information and support has been obtained from them.In general,the interior alignment scheme is a scheme that will help promote local economic development and improve the people's standard of living. B. Zhongzai-Houling Section The comparison of environmental factors between alternative schemes is shown in Table 1-4.The conclusion from the comparison is as follows: a. The exterior alignment runs through flat land with no tunnel.Its demand for earth and rock is 49500m' less than the interior alignment; ' b. The exterior alignment runs comparatively far from No.324 National Road.This layout is more helpful to the economic development of Zhao'an County. c. The disadvantage of the exterior alignment is that it needs 162mu more land occupation and 3142m9 more demolition than the interior alignment and involves 3.5km soft soil treatment; d. The sensitive point of Gaoshan Village According to the original scheme,the alignment passes through Gaoshan Village with resettlement of 84 households and heavy environmental impact to the villagers.If the alignment is relocated to the north of Ganshan Village,no resettlement is needed here.But,in the engineering view the alignment will be of low standards and cannot comply with the specifications.It also affects the traveling safety.So the Employer thinks the above alignment relocating scheme not feasible.After consultation with the Design Institute,a new scheme is made that the original alignment is moved 50m to the north.In this way demolition can be reduced by 25 households and the inherited house from old generations at the village end can be kept as wished by the villagers.Environmental measures (eg isolation fence) will also be taken.The layout of the alignment in Gaoshan Vil-lage is shown in Figure 5-5.Comparison of environmental factors between the new alignment scheme and the original scheme is shown in Table 5-3-4. After evaluation we find out that the scheme to move the alignment 50m to the north will bring environmental problems to the villagers too.In order to reduce traffic noise,noise barrier (160m*3m and 120m*3m) will be erected on both sides of the road when it passes through Gaoshan Village.At the same time, 34 households will be resettled.An underpass will be constructed to provide a passage to the villagers on both sides of the road. We have passed the above information to the local villagers and won their support.So we recommend the scheme to move the -alignment 50m to the north. As the preliminary design and final design go on,the alignment will be bettered to ensure the best scheme.At the same time,the quantities of land acquisition and resettlement will be reduced to the smallest possible. 5. Technological and economic feasibility study The prefeasibility study report for the Zhangzhou-Zhao'an Expressway project was prepared by Fujian Provincial Traffic Planning-and Design Institute,which started in January 1993 and ended in May 1994.Preparation of the feasibility study report started in July 1994 and ended in April 1998. 6. Preliminary design and construction drawings design .Fujian Provincial Traffic Planning and Design Institute is responsible for the survey and design of the Zhangzhou-Zhao'an Expressway project.The preliminary design started in July 1997 and ended in.September 1999.Design of the construction drawings starts in September mnd is-exrected to end in-August 1999. 7. Employer of the project and its organization 'The Employer for the Zhangzhou-Zhao'an Expressway project is Zhangzhou Municipal Zhangzhou-Zhao'an Expressway Co.,Ltd of Fujian Province.In order tc do the land acquisition and resetlement well, under the leadership of Fujian Provincial Expressway Construction Directorate Office,the Fujian Provincial Resettlement Office was established,which is responsible for the leadership and coordinat- ion of the land acquisition and resettlement activities for the Zhangzhou-Zhao'an Expressway project. In addition,Zhangzhou City and the other 3 counties have established the Zhangzhou Expressway Construction Leading Group,under which the CIRO,CORO,TRO and VRO are set up-Each of them has its own account number-- specially responsible for coordination and execution of the resettlement activities. 8. Social survey (1) Socio-economic survey The socio-economic survey for the Zhangzhou-Zhao'an Expressway project was initiated by Fujian Provincial Traffic Planning and Design Institute.Between May and June 1998 the Fujian Provincial Expressway Resettlement Office,together with Fujian Provincial Traffic Planning and Design Institute and the resettlement office of the various cities,counties and towns,conducted the supplement- ary survey.The supplementary survey last for 24 days and attended by 110 persons,collecting 9800 sheets of information. - Scope and object of the survey Scope:within 80m on both sides of the expressway center line, total length of 132.489km,involving Longhai City,Zhangpu County, Yunxiao County and Zhao'an County,19 towns/farms and . 92 administrative villages. Object:Land,structures,facilities and all the affected people. * Subject of the survey number and classification of the affected collectives and -individuals;state of impact on buildings,land and other properties as well as relevant information about income and living standard; opinions of the affected;comparison information between the affected and unaffected in a same area. Way of survey For the survey,we prepared and distributed the Resettlement and Socio-Economic Survey Form for the Zhangzhou-Zhao'an Express- way project so that the drawings,objects and data in the survey forms are corresponding with each other. Procedure of survey a. Survey training On May 18-19,1998 the provincial resettlement office presided over Zhangzhou-Zhao'an Expressway Resettlement Data Collecting Working Conference in Zhangzhou City with over 90 attendants from the provincial resettlement office,Fujian Provincial Traffic Planning and Design Institute,Zhangzhou Municipal Resettlement Office and the resettlement offices,traffic bureaus and land administration bureaus of the cities/counties along the expressway. 12- Subject of the conference CDdefine the tasks,do the overall mobilization for resettle- ment and distribute the resettlement training textbooks; CDtrain the vocational key members about the subjects in the way required by the WB,having them familiar with the survey requirements and techniques. b. training by levels and survey $DAs required by the provincial resettlement office,the municipal and county-level resettlement offices called on the investigators in counties and towns and the staff of the town- level land administration offices for training.Examples were given in the course; CDAfter the training course for citi*es and counties was over, the professionals from the provincial resettlement office and Fujian Provincial Traffic Planning and Design Institute,together with the county-level resettlement offices,traffic bureaus,land administration bureaus,town-level land administration offices and town/village cadres,jointly conducted the on-the-spot survey and calculation; O)With the support and cooperation of the towns,villages and the affected along the expressway,the survey went on successfully. Complete data and information have been collected. (a) Polls The provincial resettlement office and Fujian Provincial Traffic Planning and Design Institute are responsible for the polls for the project,which were conducted in May 1998.The polling forms are distributed to:all the resettled households and the directly affected (not less than 30 households each town).The survey objects include village committee members,women representatives,representatives from the affected primary and middle schools and the fragile community,responsible persons of industrial 13- enterprises,democratics and VIPs.The survey was conducted with questionnaire.It was finished in June 1998.The results are shown in the following table. Preparatory work for the-RAP Fujian Provincial Resettlement Office is responsible for organizing the preparation of the RAP. The provincial resettlement office entrusted the polling work for the Zhangzhou-Zhao'an Bxpressway project to-Fujian Provincial Traffic Plannning and Design Institute.The provincial resettlement office and the local resettlement offices,traffic bureaus,land administration bureaus of the cities and counties along the expressway and township governments took part.Village committees, the affected people and responsible persons of township enterprises actively cooperated by providing relevant data.The maps for design use,computer softwares and survey data processing were completed independently by Fujian Provincial Traffic Planning and Design Institute.The provincial resettlement finished the training of the computer operators in the municipal and county- level resettlement offices. The provincial resettlement office and Fujian Provincial Traffic Planning and Design Institute jointly completed the preparation of the RAP. 10. Schedule of the preparation and execution of the project Preparation of the RAP for the Zhangzhou-Zhao'an Expressway project started in i997.In December71997,uni3er the direction of FPECDO,Fujian Provincial Zhangzhou-Zhao'an Expressway Project Resettlement Office was established.Then Zhangzhou City and the counties concerned established their project construction leading groups,under which the municipal and county-level resettlement offices were established. May 1998 saw the completion of the survey on resettlement. September 1998 saw the completion of preparation of the RAP for the Zhangzhou-Zhao'an Expressway project. In December 1998 FPECDO plans to sign the Zhangzhou-Zhao'an Expressway Project Resettlement Supervision Contract with the independent supervision organization.Execution of the supervision work will start as of the date of signing the contract and end one year after completion of the whole project. *156 In April 1999 it is planned to start the overall land acquisition and resettlement. In September 1999 construction of the project is starting. In December 2002 the project will be completed and open to traffic. 11. Permission of land occupation,resettlement and construction The Zhangzhou-Zhao'an Expressway project (excluding its first 8km) needs to occupy 15374 mu land and temporarily lease 2968 mu. It is planned to carry out the overall land acquisition and resettlement and provide access to the construction sites between April and August 1999. After the preliminary design is approved by the Ministry of Communications,the municipal and county-level resettlement offices along the expressway should by levels apply to Fujian Provincial People's Government for approval of the land use according to the procedures stipulated in the National Land Administration Law. After obtaining the Construction Land Use Permit,the municipal and county-level resettlement offices should carry out the land acquisition and resettlement according to the RAP and finish it before September 1999.Construction of the project should be started in September 1999. 12. Compensation criteria F-ujian Provincial People's Government and the municipal anu county-level people's governments have not set compensation criteria particularly for this project.All the compensation should follow the national,provincial and municipal unified regulations and the WB's relevant regulations. (1) Indirect Impact by Readjustment of Land In order to provide te resettled households with new land, it is verified that the land in 84 villages (9463 au in total) will be readjusted,which will influence 47180 agricultural households, involving 188741 household members. (2) Other Impacts by the Land Acquisition A. As the survey and design for the project has followed the principle of 'The project runs close to but not through the city', it has no influence on the urban area of the cities. B. It is verified that the income from agricultural production represents 85% of the total income of those households who will lose their agricultural land and need to be resettled. C.
