The preparation of the project is continuing including formulation. implementation and assessment of the land acquisition and resettlement action plan. Sichuan Urban Environmental Project Management Office (SUEPO) is in charge of coordinating the nine projects' land acquisition. compensation and resettlement in the five cities The implementation plan on land acquisition and resettlement of each sub-project wvill be worked out individually. The Southwest Municipal Engineering Design & Research Institute of China (SWNIEDRIC) is responsible for the data collection and the completion of this report. and Nlott Macdonald. consultants to the Department for International Development (DFID). UK, has provided technical guidance. This report shows the whole conditions of land acquisition and resettlement of the Sichuan Urban Environmental Project with each sub-project's action plan of resettlement. The report and the plan has been worked out in accordance with the relevant laws and regulations of the state. pro\ ince and cities and the requirements of the World Bank OD 4.30. The EnLlish version of this report is not a direct translation of the Resettlement Action Plan in Chinese wxhich w%as discussed with the World Bank on 28"" March 1999. SICHL*AN URBAN ENVIRONMENT PROJECT RESETTLEMENT ACTION PLAN 1 PROJECT DESCRIPTION The Sichuan Urban Environment Project has an overall objective of enabling environmentally sustainable growth in Sichuan Province This is to be achieved through the development of environmentally. socially and economically effective schemes to improve water supply, water pollution control and solid waste services for five cities in Sichuan. Of the five cities submitting proposals to the World Bank. Chengdu. Leshan, Deang and Zigong lie in the Min and Tuo river basins. and Luzhou lies along the Jinsha-Yangtze river, at its junction with the Tuojiang. After initial assessment work. nine projects are being prepared for appraisal: four water supply projects. four sewage treatment projects and one refuse landfill project. The following is a description of the sub-components of SUEP. 1.1 Chengdu Chengdu Wastewater: laying of 6.7km of interceptor scers: link sewers and connections. to connect the 14km interceptor for the third drainaize area and construction of a 300.000 cubic metre per day (m/d) wastewater trcatment plant. 1.2 Devang Deyang wastewater. Laying of 6 7 km of interceptor se\ers. link sewers and connections. to collect o% er 75% of wastewater in the urban area and construction of a 100.000 m'/d capacit\ wastewater treatment plant. 1.3 Leshan Leshan Wastewater: laying of 17.3km of interceptor sewers. link sewers and connections and construction of a pumping station with capacity of 250,000 m'/d, preliminary treatment and disposal south of the town to a temporary outfall. Leshan Water Supply: construction of an intake. raw water main, a water treatment plant of 100,000 m/d capacity. transmission mains to two distribution networks. reservoir and strengthening of distribution network. Leshan Solid Waste Nlanagerent: Improvements to solid waste management comprising collection. transfer and landfill. 1.4 Luzhou Luzhou Water Supply: construction of two augmentation schemes totaling 100.000 md: a) Davikou works comprises an intake. a water treatment plant of 50.000 mi/d capacity. transmission mains. reservoirs. and strenuthening of the distribution net\\ork: b) Beijiao \\orks comprises the SICHUAN URBA.N ENVIRONMENT PROJECT RESETTLEMENT ACTION PLAN addition of pumps at an existing intake, a 50,000 m7/d capacity treatment plant: 32km of transmission mains. reservoirs and 30 km of distribution network. 1.5 Zigong Zigong Water Supply: augmentation of 200.000 n'/d through construction of intake. 66km of transmission mains. construction c ýw treatment plant of 120.000 m/d (with 80.000 ni' transferred to the existing treatment plant). dehverv main 8.9 km in length: and strengthening of the distribution network. SICHLAN LRL3AN EN11RONMENT PROJECT RESETTLEMENT ACTION PLAN 2 SOCIO ECONOMIC BACKGROUND 2.1 Overview of Five Cities 2.1.1 Chengdu ChengdlIU is the capital of Sichuan Province. The city is an important administration centre with Jurisdiction over seven districts. four municipalities and eight counties with a total area of 12.390 km- and a population of 9 800 000. Within the urban area there is a population of 1 780 000 in an area of I 10 km- The city is an important educational. cultural and communication centre as well as a major industrial base. Total employment in Chengdu in 1998 was 6.071.100: approximately 44.3% in the primary sector. 308% in secondary and 24.9% in tertiary. 32 2% of the population are classed as non-agricultural. Aierage income per capita in Chengdu is 6549Y. the highest for the cities involved in SLEP. Results from the willingness to pay survey indicate a wider spread of incomes in this city than elsewhere. perhaps indicating an increased potential for private enterprise in this cit\ resulting in greater dctcrences between richer and poorer. The official unemplo\ ment rate for the whole of Sichuan is 6.2% (1997). of this 79.8% arc voune people No figures are available for disaggregated Unemployment rates in the \arious cities involved in this project although estimates made from the willingness to pay surL\CV suggest that unemployment rates are lower in Chengdu than in Sichuan as a wholc. 2.1.2 Devang De\ anat is a relatively Voune city. founded by the Provincial Government in 1989. The total population in 1998 %%as 3.721.000 with the urban area covering 21 km. It is one of the most important industrial cities in Sichuan Province, the main industries being the production of paper and pulp. chemicals. pesticides. mechanical and leather goods and metallurgy equipment. Total employment in Devang in 1998 was 2,360.700 : approximately 52.8% in the primary sector. 26 7 % in secondary and 20.5 % in tertiary. 18.0% of the population are classed as non-agricultural.' The average income per capita in Deyang is 6374Y. 2.1.3 Leshan Leshan is a major cit\ with a 1997 population of 3.433.000. The economy of the city is based on the production of orianic chemicals. machinery. construction materials. foodstuffs. metallurgical products. textiles and other light industries. Efforts are also being made to encourage tourism in the area \ith man\ historic relics from the Han. Tang and Song dynasties sited dow nstream of the city. LLr e icri-urban and surroundine rural districts are included in all the cit population and cinplor ment SICHUAN URBAN ENVIRONMENT PROJECT RESETTLEMENT ACTION PLAN Total employment in Leshan in 1997 was 1.966.500: approximately 61.9% in the primary sector. 21 7 % in secondarv and 16.4 % in tertiary. 22.5% of the populatin are classed as non-agricultural, Average per capita income in Leshan is 5 148Y. 2.1.4 Luzhou Luzhou is an ancient city founded in the first centurv BC. It is an important communication centre \Ith river and road access to Yunan Province and Guizhou Province as well as Chongquin and ChCngdu. The 1997 population was 4,574.000.. The principal industries are the production of chemicals as well as electrical and mechanic:i machinery. In 1997 total employment was 2. 645.700: approximately 66.5'0 in the primary sector. 16.6 % in secondary and 16.9 % in tertiary. Only 14.4% of the population are classed as non-agricultural. Average per capita income is 6261Y per year. 2.1.5 Zigong ZiuonL is a medium-sized flourishing city with jurisdiction over four districts and tMo counties. It has a population of 3.130.000 (1997). the central district of the city covering an area of 8 13 km- The main industrx is salt-production. other industries include the production of chemical and metallurgical products. foodstuffs. construction materials. texlces. electronics. In 1997 total employment was 1.747,000: approximately 61.20o in the primary sector. 22.7 % in secondary and 16. 1 % in tertiary 21.8 % of the populanon are classified as non-agricultural. Average per capita income in Zigong is 5260Y per year. 2.2 Overview of Populations Requiring Resettlement A detailed population investigation must be carried out in everv city implementing Sichuan Urban En\ ironment Projects. The contents of the initial investigations include the number people affected b\ the project. their age structure. occupations. and averace income. This data is presented in table 2- I The notes below\ the table were made by the DFID funded social team on visits to the project sites and pro\ ide more detailed comment on the individual project areas. Of the 3 households interviewed by social team. all male members and some female members of the household of working age had second jobs icliding. xkorking in a medicine plant and a fumiture facton-. Some farmers also rent out buffalo: otliers are eiployers hiring labour for short-tenn (harvest time) work on tle land. Education levels are nixed: tihe older people interviewved had no school education or only priimar: in the youniger generatioin the imajority have junior iniddle school education. a few' have been to senior iiddle school. Deyane Farmers on this site have 0.imu per capita of land. partially on reclai med barren land. M.ost houscholds in the i illage have members with secondarn jobs (carning aronnd 300v per mnonth eg in a paper null. Not all these households need to be completely resetled. some louseholds w ill lose a part of tiheir land only. See table 4-1 for deiils. Wastewater site: This is a city arca whcre a large proponion of the population are now shopkeepers with shops forming part of their homes. All or pari of their houses m ii1 need to be dismantled to make way for 40÷50-the laying of waste water pipes. Leshan. Solid Naste Landfill Site: Fecw farers interviewed by the social team at this site had secondarv jobs outside fanning- one man was involved in temporarv constniction work. Sonie had small enterprises (og imending buckets) with low income. There is only one brick-making enterprise in town which is now elosed. and a small building company. Raising pigs and poultrv in recent years has been unsuccessful, with pollution levels causing tIhe animals to die. Education levels iscre similar to those in Chengdu. N itli vounger generations going to middle or high school. older generations with primar level education. Luzhou. Daxikou Villaoe: Resetlement for this site is underwav. 45 farmers have already been reregistered: selected by raffle. While compensation has already been paid. residents will inoxe to now houses once construction is scheduled. Jobs have been offered to thosc reregistering but they preferred to take compensation since the jobs offered werc in temporary construction work and they fclt they could Fnd better opportunitics alone. LLjzhou. Beijiao Village: Rescitleiment for this site is already concluded. 30 people were reregistered in 1992 and most rcccived jobs in the water plant created by the project or in a transpon company. Others wsere offered jobs but chose to takc compensation money in order to set up their ou\n enterprises. The village has six enterprises a brick factorn- a sweet potato noodle factory: a medical clinic: a transportation team (for building inatenals) and 2 building teais. Zigong - No infornation additional to that shown in the table. is available for this site. SICiU'AN URBAN ENVIRONMENT PROJECT RESETTLEMENT ACTION PLAN 3 LAWS, REGULATIONS AND RESETTLEMIENT POLICIES The People's Republic of China stipulates that any authority engaging in resettlement activities concerning individuals and enterprises must draw a general plan. The provincial government and local ao\ crnment have the right to draw up some preferential polices which detail the national laws. The laws and regulations associated with the Sichuan Urban Environmental Project. together with the principles behind them. are described in the following sections: 3.1 Principles The following principles are outlined in the Operational Directive of the World Bank, 4.30 concerning Involuntary Resettlement. * Involuntary resettlement should be aNoided or minimized \\here feasible * Displaced persons should be compensated for their losses at full replacement cost prior to the actual move. * Displaced persons should be assisted with the move and supported during the transition period in the resettlement site. * Displaced persons should be provided with the means to impro\c their former living standards. income carning capacity. and production levels or at least to restore them. Cash compensation alone is normally inadequate to ensure sustained/improvcd living standards. * Community participation in planning and implementing resettlement should be encouraged. * Preference should be gixcn to land-based resettlement strategies for people dislocated from agricultural settings. * IM oluntary resettlers should be able to choose from a number of acceptable resettlement alternatl es. * Conditions and serices in host communities should improve. or at least not deteriorate. The following principles are adhered to by the People's Republic of China in its formulation of laws and regulations for land acquisition and resettlement: * Resettlement programmes must take into consideration the interests of the state, the collective and the individual. * Involuntary resettlement of cultivated land should be minimized or avoided. * Resettled people's new living standard must equal or exceed their living standard before displacement. * New houses must be built accordina to the original structurc's size arid standard. * People losing land totally can change from agricultural to non-agricultural status. * the resettlement subsidy can be increased if the level calculated on the basis of the regulation does not meet needs. State reculations are therefore in accord x\ ith the World Bank stipulations on compensation and restoration of living standards for displaced persons. SICH1LAN URBAN ENVIRONM\ENT PROJECT RESETTLEMENT ACTION PLAN 3.2 Laws And Regulations Of Land Acquisition And Resettlement 3.2.1 Rel -ant laws which encompass these principles at State Level are * Land Management Law of the PRC (1999) * Agricultural La\\ of the PRC * Water Law of the PRC (1988) * Management Methods on Monitoring and Reporting on Land Used for Construction (1999) * Management lethods of Land Utilization and Annual Planning (1999) 3.2.2 Relevant laws and regulations at Provincial level include: * The Compensation for Standard Highway Properties of Sichuan Province * The Methods for Land Management in Sichuan Province. 3.2.3 Relevant Laws and Regulations at the City Level Each city in Sichuan Urban Environmental Project has a co-ordinating Eroup for implementing resettlement plans to handle resettlement problems in urban or rural areas in accordance with local spcific conditions. The implementing laws and regulations must protect and favour the people who ha% e to relocate for developments in suburban or rural areas and the group has the right to determine ho will be responsible for resettlement at different stages. The la\\s and regulations stipulate the ov.est level and type of compensation suitable for every kind of situation. Flexibility of compensation is encouraged to ensure that those to be relocated are able to at ]cast maintain their current standard of living. Local compensation standards are often higher than those of the state. Local lai\s also stipulate the point at which land allocations to an individual become too small to be a nable li\clhood. and therefore at what point idinciduals can obtain non-agricultural rather than an(ricultural status. (For example in Devang. when per capita arabic land is less than 0A mu for grain growers. and 0.3 mu for ventablc growers then change from agricultural to non-agricultural status of some of the work unit can occur). Compensation and Subsidy Standards for the Land Acquisition for the Nla Zhi ShUi Economic De elopment Zone in Zigong. The laws and regulations cited above stipulate that: * All families to be resettled are provided \ ith new houses of at least the same standard as their former home. * All persons who lose land \ill receive a land compensation fee, * Compensation will be paid for loss of standing crops and for loss of liv clihood * Compensation will be paid for temporary removal and temporar\ accommodation provided it necessary. * Public meetings will be held before removal and should encourage the cooperation and support of the % illage committee * Proper (full-time) jobs will be pro\ ided for resettlers who \ ish to be re-employed * Relatives affected by the construction should be resettled in the same area. * A public notice should be put out clarifYing the plans and the necessity of the resettlement. S 0Cil~AN V RIAN ENVIRONNIENI PROJECT RESETTLEMENT ACTION PLAN 4 PROJECT IIPACTS This section looks both at the overall impact of the Sichuan Urban Environment Project on different stakcholder groups and in detail at the inipact on the resettled populations. 4.1 Project Impacts and Stakeholder Groups Table 4-1 out1nes the beneficial effects of the Sichuan Urban En\ ironniciit Project on various stakeholder groups. Table 4-2 looks at the adverse effects of the projects. As noted in the table above. some farmers to be resettled see the compensation and job opportunities offered as a chance to improve their living standards. In Luzhou, resettlers from the Beijiao site have used their savings to augment compensation received from the project. and have built new houses of considerably higher standard than their previous homes. New lobs ha\ c pro\ ided them \% ith a secure income and social security benefits. Rescttlers in other areas. ho%\c\er. are concerned about the lack of livelihood security to which losing their land \ill lead Such families are used to subsisting from the land rather than paving for all food consumption. Farmers may chose to accept a partial loss of land for all villagers rather than requiring any of the work unit to resettle. Compensation money should allow the village to recover lost income by investing in new enterprises. However, care will have to taken that the money is well in% ested so that the income of these farmers does not fall below previous levcls. Village leaders are likely to need support in order to assess the opportunities available. 4.3 Detail of Populations to be Resettled Table 4-3 - 4-5 provide detailed information on the areas of land. housing and attachments to be acquired. Farmers on the Beijiao site were successfully resettled with new houses and jobs. It is estimated that farmers received compensation at that time of up to 10.0OOY per person. More compensation is available for settlers ,t the present tin]. In order to successfully carry out the rehabilitation of resettlers is necessary to: combine short and long-term planning: optimize resources: guarantee jobs for the resettled: and respect the choices of the resetflers as far as possible. 5.1 Chengdu Waste Water 1. All houscholds to be resettled will received house compensation and a moving allowance. The location of their new house will be decided by the village committee in consultation with the resettlers. 2 Compensation for private property will be given directlv to individuals. 4 1l people (who are of wkorking ac) vill be changed from agricultural to urban status. Based on their wishes they vill receive a Y14000 loss of livelihood allowance and find jobs by themselves. 3. For people over 55 years (male) and over 45 years (female). the resettlement authority will buy an endowment policy for them. Business loss compensation vill also be given to the owners for these establishments. Compensation for businesses affected but not resettled will be decided based on discussion between the client and the owners of these businesses. No person will change from agricUltural to urban status. 5.5 Leshan Solid Waste 1. All households to be resettled \will be received house compensation and a moving allowance. SICHL.-LN URBAN ENVIRONMENT PROJECT RES ETTLEMENT.ACTION PLAN S CONSULTATION MECHANISMS AND PUBLIC INVOLVEMENT Public information campaigns will be carried out through mass media sources such as TV. newspaper. radio and so on, Opinions and sugestions will be sought on how to increase the public's awareness and their participation. The population to be affected by the projects \Nill be told about the policies and laws relating to land reqLisition their rights and means of getting compensation will be disseminated. The help of cadres from groups and villages will be elicited in order to guarantec that the legitimate rights and interests of those to be resettled are met. This will consist of members from the Municipal Project Office, Nunicipal Land Bureau, Real Estate Management Department and other related institutions to solve various problems as they arise. A sample survey of a previous (recent) resettlement programme conducted in Chengdu was commissioned to provide some indication of the perceived quality of the resettlement programme by primary stakeholders. This showed that although 89% of those interviewed (\\ ho had been relocated) knew of the Funanhe resettlement project before hand. the source of this knowledge was not necessarily from the government. This also shows that some individuals (11%) claim not to have know n about the resettlement until they were required to move. Of more concern is the fact that 68% said they \\ould have liked to be asked their opinion about where they should move to and the type of housing they would like. Although the majority are satisfied with the relocation and their new housing. there are some residual problems. These are mostly associated with: children and children's education: transport problems associated \\ith employment; and lack of amenities in the new housing area (shops, hospitals). There is alsoa reported lack of satisfaction by the pre-existing local residents: they think the in-comers ha%c lo% red the tone of the neighbourhood. Tlhis report highlights the need to pay attention to ensuring effectie pubbcity campaigns. and to "iirlg those who are to be relocated some say in their future location and the type of housing they %\ould like. Although there arc limitations on the choices they have (as laid down by the statutes). pro%iding the means to include householders views about relocation is relatively costless but with considerable social benefit. As alreadv noted the numbers involved in relocation is vcry small. This should make discussing options that much easier. The largest group to be moved is that in Chcngdu. The Funanhe resettlement survey provides valuable information to be used to refine the Chengdu RAP SICHUAN URBAN ENVIRONMENT PROjECT RESETTLENIENr .ACTION PLAN 9 GRIEVANCE PROCEDURES AND MECHANISMS FOR APPEAL The existing laws and regulations should guarantec that the legitimate rights and interests of those to be resettled are met- They enjoy all the rights and duties as prescribed by the constitution and by law. If rights and interests are violated. resettled. they have a right to appeal until their riwhts and interests are satisfied. The following appeals mechanisms are in place: i) citizens correspondence and visitation offices are set up by the government at all lcls: these can investigate and handle basic problems; the appeal process proceeds through different levels - township. town. district. city and so on: ii) the resettlement management department will accept appeals concerning relocation: iiI) the municipal construction commission and the public utilities bureau will take responsibility for supervising and .checking the relocation work: they will handle the appeals of the resertlers. or refer them to relevant departments: ix) the resettlement management institutions are responsible for ensUring the implementation of resettlement according to the legal requirements: they have the responsibility to protect the rights and interests of the resettiers: they can accept and report appeals on the behalf of citizens \here rights and interests have been violated: any institution involved in supervision. inspection. discipline and audit can accept the appeals: ) Finally. resettlers can resort to taking their appeal to the people's court where they feel that their appeal has not been adequately met by any of the above (i - v) means. SICHUAN URBAAN ENVIRONMENT PROJECT RESETTLEMENT ACTION PLAN 10 IMPLEA1ENTATION ARRANGE.7 ENTS 10.1 RESETTLEMENT PROGRA.MME The Resettlement Programme will be governed by the pace at which negotiations for the World Bank loan are conducted. The outline design is currently being appraised (March 99) and detailed design will then be completed such that the World Bank and Sichuan Provincial Government are read-. to negotiate the terms of the loan, probably mid 1999 with a view to starting constiction at the end of 1999 This means that through most of 1999 the following activities may be undertaken in Chengdu. Devang. Leshan and Zigong. * complete the detailed estimates for compensation costs. * draw up a comprehensive plan for relocation, rebuilding,. and re-housing in each city. * conduct a public information campaign using the media and official posters to inform citizens what is intended. * contact individual houscholds affected by the works. * agree an action plan for compensating. rehabilitating. re-housing and/or rebuilding homes for each individual family. When this has been completed the actual relocation and removal of families from the construction sites can be carried out at the end of 1999. Monitorinmt of the resettlement can commence at about the time that Individual householders are contacted, although each city will have different procedures in this respect. Table 10. 1 shows the timetable for the overall resettlement plan. Table 10.2 shows how these acti ities blend into the overall project. Monmtoring enables both the project office to check progress and also to ensure that those being relocated or compensated have opportunities to identify and address problem areas arising during the process. 11.2 Internal Monitoring and Evaluation During the period of implementing the resettlement plan, internal monitoring and evaluation will be done by the City Land Bureau. Municipal Project Offices and Client together. The Provincial Project Management Office will undertake the overall responsibility for intemal monitoring and evaluation of resettlement plans and progress. Monitoring \\ill include the enforcement of law and regulations concerning land acquisition and resettlement issued by the state. province and city. It will also :elude monitoring the progress of the work, utilization of funds and the quality of the \\ork of rcsettlement. The main items to be monitored should be noted and progress reports made regularly tor evaluation and record. According to the relevant standards, the Municipal Project Office will make an evaluation and appraisal of the implementation of the resettlement plan. They \vill confirm the achievements. point out the problems and put forward proposals. After the whole work is timshed. written reports must be sent to the municipal government for evaluation and appraisal. An example is that the Big/Medium Sized Project Construction Project Supervision Company of Zigong has been engaged to carry out independent monitoring and evaluation of the work of the water supply project in Zigong. The independent monitoring agency will be required to: Before implementation: * Supervise and examine the formulation of resettlement plans. Subsequently: * Check and accept the finished resettlement x\ork * Monitor the safety and environmental protection of the relocation work * Monitor the conditions of the resettled peopIc before and after relocation: * Monitcr the process of public consultation and litigation procedures * Submit regular reports to the municipal governments At the end of the resettlement: * Submit an evaluation report to the municipal goverment, copied to the Provincial Management Office. 11.4 Monitoring Feedback Arrangements The employment of the external agency shall be by the municipal government in \\hose area the rscttlement is due to be carried out- however reports and feedback information concerning the pro-ress and quality of resettlement arrangements will reach the Provincial P.M0 by means of the t%pical diagram shown below. According to their will, they can get resettlement subsidy and find jobs by themselves. 2. For the farmers who want to change their idea to continue farming during the implementation of the resettlement: a) In the case of Chengdu, the farmers live in a concentrated area, so it is difficult to allocate lands for them in the same place. They are encouraged to move to nearby area to obtain new farmlands.
