We also refer to the request contained in the letter dated January 30, 2003, from Mr. A. A. Maksiuta, State Secretary, Ministry of Finance of the Borrower, to amend the legal documents for the Project so as to adequately introduce changes required as a consequence of the merger of the Kiev Municipal District Heating Company (KMDHC) with Kievenergo.
