62464 PROCUREMENT PLAN FOR FIRST 18 MONTHS OF NGRBP I. General 1. Project information Country : India Borrower : Government of India Project Name : National Ganga River Basin Project (NGRBP) of the GOVERNMENT OF INDIA aims that the National Ganga River Basin Authority (NGRBA): builds capacity of its nascent operational-level institutions for managing a comprehensive Ganga clean-up and conservation program; and reduces point- source pollution loads through sustainable interventions at selected locations on the Ganga. The project will have two components relating to institutional development and priority infrastructure investments. The first component would seek to build the institutional capacity to effectively implement the overall NGRBA program, including infrastructure investments funded by the second component. The total project cost is estimated at about US$1.55 billion including counterpart funding from the center and the state governments. Irrespective of this upper limit, the decision to proceed on NCB or ICB terms above the value of $10 Million will be based on: (i) a capacity assessment of the local contracting industry and ability of potential bidders to respond to the tender requirements; and (ii) the scope for reduction of the geographical dispersion of the contracts (whenever possible) through a careful packaging strategy to be applied during the feasibility DPR stage and while finalizing the annual plans and procurement plans. 2. The following conditions shall be met in order for the bidding process under National Competitive Bidding (Open Tender): a) Only the model bidding documents for open tender as agreed in NRLM Manual shall be used for bidding; b) Invitations to bid shall be advertised in at least one widely circulated national daily newspaper or in the official gazette, or on a widely used website or electronic portal with free national and international access, in English, at least 30 days prior to the deadline for the submission of bids; c) No special preference will be accorded to any bidder either for price or for other terms and conditions when competing with foreign bidders, state-owned enterprises, small-scale enterprises or enterprises from any given State; d) There shall be no negotiation of price with the bidders, even with the lowest evaluated bidder; e) Extension of bid validity shall not be allowed without the prior review arrangements for each level (a) for the first request for extension if it is longer than four weeks; and (b) for all subsequent requests for extension irrespective of the period (such concurrence shall be considered by the prior review authority only in cases of Force Majeure and circumstances beyond the control of the Purchaser / Employer); f) Re-bidding shall not be carried out without the agreement of the prior review authority. The system of rejecting bids outside a pre-determined margin or “bracket” of prices shall not be used in the project; g) Rate contracts entered into by Directorate General of Supplies & Disposals will not be acceptable as a substitute for open tender procedures. Such contracts will be acceptable however for any procurement under limited tender or local shopping procedures; h) Two or three envelop system will not be used i) As per 1.1(e) of World Bank Procurement Guidelines, the Association’s right to inspect accounts and records of the bidders, suppliers and contractors will be included in the bidding document of all contracts from eth proceeds of the World Bank support.
