China and Jiangxi Province as well as the Guidelines of the World Bank's Operational Policies ((OP 4.12) on Involuntary Resettlement. The purpose of this document is to set out an Action Plan for the Resettlement and Rehabilitation of project Displaced Persons (DPs) to ensure that they will benefit from the project and their standards of living will improve or at least be restored after the displacement Acquisition of land and other assets for the proj ect will adversely affect the livelihood of persons who live, work or earn their living on the land that will be acquired for the project. Displaced Persons are defined as those persons whose income or livelihoods will be adversely affected by land acquisition for the project. DPs include the following categories: a) persons who have a title, right, interest, in structures (houses, enterprises, shelters, or public buildings), and (including residential, agricultural, and grazing land) or any other asset acquired or possessed, in full or in part, permanently or temporarily; b) persons who use the structures, and or assets described above; or persons whose business, occupation, work, place of residence or habitat adversely affected; or c) persons whose standard of living are adversely affected as a consequence of land acquisition. A definition of DPs is given below: Definition of the DPs: "Displaced Persons" means persons who on account of the execution of the project had or would have their: a) standard of living adversely affected; or b) right, title or interest in any house, land (including premises, agricultural and grazing land) or any other fixed or movable asset acquired or possessed, temporarily or permanently; or c) business, occupation, work or place of residence or habitat adversely affected, and "Displaced Person" means any of the displaced persons. DPs may individuals or legal persons such as a company, a public institution. Definition of DPs is not limited to their legal registration or permission to live or conduct business in the affected location, or their title to property. Thus it includes: a) all those affected by the project regardless of their legal rights or absence thereof to the assets being taken; and b) persons without residential permit to live in a certain area. The Ruijin-Ganzhou Expressway (hereinafer referred as "RGE"), with another name" Ruijin-Ganzhou Section of Xia'rong Expressway, is one section within Jiangxi territory of the planned Xiamen-Chengdu national expressway, which is a part of the national highway network consisting of 18 lines running from the east to the west of China. The RGE is also one part of planned "three verticals and four transverses" of Jiangxi highway network as it will serve as one section of the fourth transverse of the highway network. Starting at Yunshishan Town of Ruijin City of Ganzhou and connecting with Ailing-Ruijing section that will be constructed at the same time as RGE (TOR of RAP for the section refers to attachement 2), the proposed RGE runs across Huichang Couty, Yudu County, Ganxian County and ends at Zhanggong District of Ganzhou City, connecting with the starting point of west Ganzhou section of Xia'rong Expressway at Huangjin Interchange. The RGE has total length of approx. 116.815 Km, 2 service areas, 3 parking lots, 1 maintenance center, 1 monitoring sub-center, 3 management stations, 6 toll stations, and 2 tunnel management stations. All areas The RGE passes are within the jurisdiction of Ganzhou. The construction of RGE will not only improve the national expressway network and the expressway backbones of Jiangxi, but will also facilitate economic development and social progressing of the project imact areas, most of which are relatively less developed in economy. The project area, Ganzhou City, shorted as "Gan'nan "(means "South Jiangxi") is an economically underdeveloped region in the country, mainly due to its mountainous and closed economic pattern which significantly restrained its social and economic development and the backward transportation condition that hindered the flow and turnover of passengers and freights. Presently the Ganzhou City still has 8 national level poor counties (including Huichang, Yudu and Ganxian that are project directly affected areas) and is still relatively lagging in economy in national wide. Ganzhou has 99 kinds of mineral resources and large reserves of tungsten and rare soil, and was dubbed as "World Tungsten Capital" and "Kingdom of Rare Soil". The regioin is also one of the 18 major national forestry areas, and is the new developed fruits production base and the largest producer of navel oranges of the Country. It is also the main area of Jiangxi for producing sugarcane, peanut. tobacco, soybean, lotus and watermelon. Therefore, though economically lag behind and with relatively high number of poor population, the project area is abundant in resources. The construction of RGE will Resettlement Action Plan of Jiangxi 3 Highway Project significantly improve the local traffic condition, expedite exploitation of resources along the project area and speed up the the progress for local people to get out of poverty. The main route of RGE is designed as a fully closed and interchanged expressway with design speed of 100 Km/h. The pavement is designed to be 4 lanes bituminous concrete, with width of 26 m. The whole RGE has 4 extra large brides with total length of 5198 m, 44 large bridges with total length of 12234 m, 25 medium bridges with total length of 1675 m, 7 tunnels with total length of 9548.5 m, 6 interchanges (including 1 interconnecting road of 5.7km), 49 seprate grade crossings with a total length of 2715.5m. The estimated cost is 5.778 million RMB, of which USD 200 million are from World Bank loan. As agreed in the Aide Memoire signed between the World Bank and Jiangxi Communications Department (JPCD) during the Jiangxi 3 highway project preparation mission in May 28-June 13, 2005, 2 local roads with total length of 80 Km (as shown in Table 1-1) were finally selected for improvement under Jiangxi 3 highway project based on repeated analysis and comparison of the initial 6 candidate roads. Ganxuan Cut 1.2 Areas Affected by the Project 1.2.1 Expressway Component The main route of RGE starts at Beixia Village of Yunshishan Town of Ruijin City of Ganzhou, passing through Huichang County, Yudu County, Ganxuan County, and ends at Chetou Village of Hubian Town of Zhanggong District, Ganzhou. The project directly affected areas involves one city (prefecture level) and 5 counties (cities and district), 18 towns and 66 administrative villages. The 2 local roads involve 3 counties, 6 towns and more 400,000 benefited rural populations. The construction of the local roads will play positive role in promoting economic development in rural areas. The Province touchs Yangtze River and links to Wuhan in the north and is close to Nanjing, Shanghai and other southeast coastal areas. The Provicne has advantageous geography and convenient transportation condition, with Beijing-Kowloon railway and Zhejiang-Jiangxi railway runing across the whole province. Presently the Province governs 11 cities of prefecture level, 1O cities of county level, 70 counties, 19 city districts, and has land area of 166,900 square Km and total population of 42.8357 million. The LRIP involved 3 counties, i.e., Ganxuan, An'yuan and Chongyi, are all within the jurisdication of Ganzhou City. 1. Ganzhou City Ganzhou City, lying in south of Jiangxi and the up reaches of Ganjiang River, lengthed 295 Km from north to south and 219 Km from east to west, bordering Fujian in the east, Guangdong in the south, Hunan in the west and connecting with Ji'an and FuzhouCity of the Province in the north, is the central city of south Jiangxi and the so called one of the regions with "most picturesque landscape, abundant resources, most investment opputinities and biggest developing potentials" along the Beijing to Kowloon Railway. The City has land area of 39,380 square kIn, population of 8.312,000. Ruijin City Ruijin City, lying in the southeast border of Jiangxi, the west foot of the southern section of WAuyi Mountain and the up reaches of Gongjiang River, is bordering Changting County of Fujian Province in the east, Huichang County in the south, Yudu County in the west, Ningdu County in the north and Shicheng County in the northeast. The city is the crossing area of three provinces, i.e., Jiangxi, Fujian and Guangdong. 6 Resettlement Action Plan of Jiangxi 3 Highway Project The city now has land area of 2448 square Km, governs 17 towns, 237 villages, and has population of 601,265. In year 2004 the annual GDP of the City was 2594 million RMB, up 11.4% comparing the previous year, and the proportion of the primary, secondary and tertiary industry was 26.2: 27.3: 46.5. In the same year, the annual wages per capita of urban workers was 1,0303 RMB, and annual net income of rural residents per capita was 2,260.78 RMB. 3. Huichang County Huichang County lies in the east of Jiangxi, bordering with Fujian and Guangdong, and is the Province's southeastern portal accessing to developed coastal areas. The length from east to west of the County is 56 km, and that from north to west is 85 km. The total area is 2,722 square kin, of which 80% are hilly and mountainous areas. The County now has cultivated land of 16,40 hektare, population of 430,000 and governs 19 towns. In year 2004, the proportion of the primary, secondary and tertiary industry was 39.8:23.4:36.8, the annual wages per capita of urban workers was 8777RMB and the annual net income per capita of rural residents was 1491.51 RMB. 4.Yudu County Yudu County lies in the south of Jiangxi, east of Ganzhou and the middle reaches of Gongjiang River. The north-south length is 83.25 km, east-west length is 63.33 km. Bordering with Ruijin and Huichang in the east, An'yuan in the south, Ganxuan in the west and Xingguo, Ningdu in the north, the County was well known in the history as an important traffic hub. The County now has land area of 2893 square km, of which 11.4% are culvitated land, 74.1% are mountainous land, 5.4% are water area, 9% are village road. Up to the end of 2003, the totoal population of the County was 902,351, governs 23 towns and 355 villages. In year 2004, the proportion of the primary, secondary and tertiary industry was 31.0: 38.0: 31.0, the annual wages per capita of urban workers was 9,329 RMB, annual net income per capita of rural residents was 1552.83 RMB. 5. Ganxuan County Ganxuan County, lying in the south of Jiangxi and up reaches of Ganjiang River, has a long history of more than 2200 years. The County now governs 19 towns and 5 adminstrative districts, 279 villages and has land area of 2993 square Km and population of 557,000. The County surrounds the political, economic and cultural center of south Jiangxi-the downtown of Ganzhou City, and is called "the first county along the long Ganjiang River" as well as the "hometown of Chinese salted duck". The downtown of the County is designated by the Province as a Civilized County. In year 2004, the GDP of the County reached 1895 million RMB, the proportion of the primary, secondary and Resettlement Action Plan of Jiangxi 3 Highway Project tertiary industry was 39.4: 26.9: 33.7, annual wages per capita of urban workers was 9592RMB with growth rate of 15.93%, and annual net income per capita of rural residents was 1510.20 RMB. 6. Zhanggong District Zhanggong District of Ganzhou City is located in the south of Jiangxi, in the area where the Zhang River and Gong River converge to form the Gangjiang River. Therefore, the District got the name of "the first city along the long Ganjiang River".The District is bordering with Ganxuan County in the east, south and north and connecting with Nankang City in the west. The north-south length of the District is about 34 km, and east-west length about 28 km, with land area of 425.5 square kin, of which 23.3 square km is urban area. It was in December 1998 that the previous City of Ganzhou (County level) was changed to the present Zhanggong District with approval of the State Council. Now the District governs 4 urban district offices and 6 towns. In year 2004 the total population of the District is 455,722, with population density of 1071 persons/per km2. the proportion of primary, secondary and tertiary industry was 4.30: 42.20: 53.50, the annual disposable income per capita of urvan residents was 8576 RMB, and annual net income per capita of rual residents was 3235.52 RMB. 7. An'yuan County Lying in the south of Ganzhou, the County is neighboring Huichang and Xunwu County in the east, Dingnan County in the south, Xingfeng County in the west and connecting in north with Ganxuan and Yudu County. The County now has land area of 2375 square kIm, governs 18 towns, 249 villages and has population of 347000. In year 2004, the GDP of the County amounted to 1098 million RMB, with GDP per capita of 3256 RMB. In the same year, the proportion of the primary, secondary and tertiary industry was 48.0: 15.8: 36.2 and the net income per capita of rural residents was 1488.78 RMB. 8. Chongyi County Lying to the southwest border of Jiangxi, the County is connecting in the east with Nankang City, the south with Dayu County and Renhua County of Guangdong Province, the west with Rucheng County of Hunan Province and the north with Shangyou County. The County has land area of 2211 square km, of Ahich 47.67% are mountainous land, 52.33% are hilly field, and governs 18 towns andl55 villages, and has population of 197,000. In circumstances of unavoidable land acquisition and resettlement, more hilly fields rather than high-quality cultivated land like paddy fileds will be in priority.for occupation, or farmer's houses will be relocated as their wishes to avoild acquisition of cultivated land. The quantities of resettlement will be minimized on the condition that the engineering technical standard is not degraded and that reuirments on enviromnental protection are fully met. The final selection of alignment corridor is based on the below principles:: 9 Resettlement Action Plan of Jiangxi 3 Highway Project 1. Avoiding cities/towns, populous rural areas, schools, hospitals, mining area, large enterprises and the like that need big resettlement; 2. Avoiding senery spots, major protected cultural relics to protect natural, historical and cultural resources; 3. Minimizing occupation of high-quality cultivated land and mining areas and making full use of wasted hills and field and other non-cultivated land for the alignmen; 4. Avoiding towns and villages with low.amount of cultivated land per capita to guarantee the stability of production and living of local people along the expressway.; As entrusted by the JPCD, the Jiangxi Provincial Communications Design Institute (JPCDI) started the prefeasibility study of RGE in April 2004. When selecting alignment of RGE, various factors such as a shorter length of alignment, cost effective as well as low amount of reresettlement were taken into account. From March to June 2005, during the WB's mission in Jiangxi for project indentification and preparation, several comments were proposed for further optimizing the design. The PRO of the PO has carried out the following works based on the principle of an optimized alignment design and minimized social, economic impacts and amount of resettlement:: 1. reducing the initially designed 7 interchanges to 6 interchanges to reduce the amount of land acquisition in significant extent; 2. combining the construction of Huichang north toll station, the management station and maintenance center; combining the construction of Zhonggongshan Tunnel station and Yudu Tunnel station; combining construction of Yudu toll station and Yudu management station; combining the construction of Luo'ao toll station, Xiashan tunnel station and Yudu maintenance center; combining construction of Ganxuan toll station and the management station; combining construction of Ganzhou north toll station, RGE management center and RGE monitoring and communication sub-center, thus a great amount of land were saved. 3. Finally, the Yudu middle scheme and Jiangkou scheme I, which have both less amount of acquired land and relocated houses, were selected on the basis of a comprehensive comparison on project cost, impacts of resettlement as well as envrionnental impacts. 13 Resettlement Action Plan of Jiangxi 3 Highway Proj'ect 1.5 Project Feasibility Study and Design The Resettlement Action Plan is prepared based on the socioeconomic survey and technical feasibility study of the Jiangxi 3 highway project. The Project Economic and Techinical Feasibility Study of RGE was submitted to the Ministry of Communications (MoC) and the National Development and Reform Committee (NDRC) in April 2004, and was cleared by the NDRC in October 2005. It is expected that the JPCDI will complete the prilimary design of the project by September 15, 2005 and design of construction drawing by December 2005. The prilimary design and construction design for 2 local roads to be improved under the Jiangxi 3 project were completed respectively on June 30, 2005 and December 31, 2005. 1.6 Social Assessment of Project Impact The China Cross-cultural Consulting Center (CCCC) of Zhongshan University, as entrusted by the PO, coducted an independent Social Assessment (SA)on the Jiangxi 3 highway project (including both the RGE and the LRIP ) in April 2005. The social assessment selected 8 villages of 4 counties/city, namely Jiaoling village and Ankang village of Jiangkou town in Ganxuan County, Yanba village of Yunshishan town in Ruijin City, Sanbei village of Xiaomi Town of Huichang County, Naokou village of Hefeng Twon in Yudu County, Guizhu village, Yangkang village and E'kang village of Luojiang town in Yudu County for social survey of the main project (RGE) and two villages, i.e., Xiafu village and Jieping village of Hujiang town, Ganxuan County for social survey of the Sub-project (LRIP). Sufficient considerations were given to the economic condition, geography, traffic condition, ethnic relationship and gender of the affected communities in project directly indirectly affected areas when conducting the SA. The purposes of the SA are: 1. to know the social and cultural impacts on the project area, includig impacts on tourism resources of revolutionary relics, caused by the investment on the project; 2.to better know the comments and suggestions on the project of relevant stakholders through discussion and consultation with them; 3. to provide basis for project implementation, monitoring and other evaluations. In May 2005, the CCCC of Zhongshan University submitted the draft Social Assessment Report to the PO and completed the final SA report in July 2005. The PO soon sent the report to the designers, the implementation agency of LRIP and the PRO, and required them to improve the design schemes, guide the preparation works for engineering construction and resettlement in compliance with the comments and suggestions made in the SA Report. 1.7 Ownership of the Project The ownership of the expressway project belongs to the JPCD and that of the local roads 14 Resettlement Action Plan of Jiangxi 3 Highway Project belong to the Communications Bureau of Ganzhou City. 1.8 Schedule for Project Preparation and Implementation The schedule for project preparation and implementation is showAn in Tablel-9. The compensation rates stipulated in the RAP of the project is based on the PRO's careful and in-depth survey, repeat consultation with local resettlement office and the displaced households as well as laws of the country and the local government pursuant to resettlement and the WB's relevant policies. The compensation rates and relevant policies stipulated in the RAP will be implemented after the RAP being accepted by the WB and approved by the Jiangxi Provincial Government. 15 Resettlement Action Plan of Jiangxi 3 Highway Project Chapter 2 Socioeconomic Survey and Preparation of Resettlement Action Plan 2.1 Purpose and Background of Socioeconomic Survey on Resettlement According to the WB's operational policy on involuntary resettlement, social survey with respect to impacts on the affected people must be carried out prior to the official commencement of the project involving involuntary resettlement. The purpose of the survey is to completely collected relevant information and data related to the DPs and resettlement, to know the situation of house relocation and land acquisition so as to provide basic referenced data for further engineering optimization of project, formulation of compensation policies on resettlement and preparation of RAP and to provide background information for resettlement monitoring works to be carried out by external monitoring organization. In addition, the situation of the project implementation and project progress also can be advertised to the DPs through the process of an extensive socioeconomic survey to attain the WB's policy of information disclosure, transparency and protection of DPs. In accordance with the aide memoire signed in February 2005 between the WB mission and the JPCD, the PRO of the PO, with support and cooperation of the Involuntary Rresettlement Research Center of Wuhan University (IRRC), started the socioeconomic survey in May 2005. During the survey, the PRO registered the quantitive data on land acquisition and resettlement of the main route of RGE and completed a draft report of RAP based on these data. Due to design change and optimization, a second complementary survey was conducted from middle of July to end of July 2005 for update and adjustment of data on alignment change of RGE, interchanges, managerial and service areas and local roads.All data related to this RAP are drawn from the two socioeconomic surveys. Generally speaking, the purposes of the two surveys on resettlement are: 1. to fully collect relevant information related to the project affected areas and resettlement of DPs; 2. to provide basic data for preparation of RAP; 3. to provide data for comparison and analysis on alignment optimization, reduction of resettlement quantities and construction cost; 4, to provide basic records for relocation of facilities; 5. to provide background information for resettlement evaluation and monitoring works carried out by internal monitoring organization. 16 Resettlement Action Plan of Jiangxi 3 Highway Project 2.2 Scope of socioeconomic Survey on Resettlement The scope of socioeconomic survey on resettlement is the directly acquired land by the highway as identified by the JPCDI, i.e., the right-of-way (or red line) confirmed on 1: 2000 map (shown in figure 1). The survey teams have registered all cultivated land, houses and land attachments within the survey scope and conducted detailed household interview for project affected families and population, thus provided reliable data for preparation of RAP. As the project presently is still in the stage of preliminary design, some small part of the alignment are yet to be improved by the designer, therefore the collected data may be adjusted and the PRO will timely revise and improve the RAP according to the adjusted data. Meanwhile, any change of project impact will be reported to the WB before they are implemented and the reason for change will be explained. This RAP will be applicable to all the project displaced persons, regardless of the availability of their legal title. Figure 2-1 Sketch on Socioeconomic Survey of Jiangxi 3 Highway Project 17 Resettlement Action Plan of Jiangxi 3 Highway Project 2.3 Contents of Survey The socioeconomic survey of Jiangxi 3 highway project includes the following contents: 1. category, location and quantities of land to be acquired within the survey scope; 2. category, location and quantities of buildings to be relocated within the survey scope;. 3. category, location and quantities of land attachments within the survey scope; 4. category, location and quantities of all power and telecommunications facilities within the survey scope, their owners and measures of treatment; 5. general condition of the enterprises/institutions which have land, buildings and land attachments within the survey scope and the detailed condition of impacts; 6. Condition of demography, property, house, income and expenditure of households which have land, buildings and land attachments within the survey scope; 7. public comments and suggestions of the project area; 8 general condition of affected villages within the survey scope; 9. statistics data, policies, laws and regulations related to resettlement of the local government along the project; 2.4 Organization and Methodology Organizations involved in socioeconomic survey includes:: resettlement organizations of the Client of the project; Jiangix Provincial Communications Design Institute (JPCDI); Involuntary Resettlement Research Center of Wuhuan University (IRRC) Communications Bureau of Ganzhou City (CBGC). Specifically, the main duties of various organizations involved are as below: PRO, leading organization for the survey, was responsible for organizing the whole survey works and coordinating relationship between different departments. JPCDI, main executing organization of the survey, was responsible for assisting the field surveyv providing alignment drawings, arranging surveyors, idenfying the project-affected scope, completing quantitive survey, checking, handing over all data and inputing them to computer. Local resettlement organizations (LROs), coordinating organizations for the survey in 18 Resettlement Action Plan of Jiangxi 3 Highway Project local cities and couties along the project , sent competent personnels to participate the survey and were responsible for collection of socioeconomic background data and literature seaching, providing logistics and supporting services for survey activities, contacting with DPs and coordinating the PRO in carrying out the survey. IRRC of Wuhan University, consultant for the survey, was responsible for designing survey contens and methods, organizing, training surveyors, implementation and inspection of the survey, developing data inputing programs, soring out, checking, analyzing and processing data. CBGC, was responsible for organizing the communications bureaus of counties. districts and citiy to assist the survey and at the same time has organized the resettlement survey for LRIP. During the survey period, an inspection team consisiting of personnels from PRO, JPCDI, IRRC was formed to inspect and guide the survey. Selective examinations were taken before completion of survey works of various survey teams. For one of the teams, the survey questionairs were accepted by checking in contrast with the actual surveyed objects. Before the survey officially started, the IRRC and PRO organized a testing survey prior to the formal socioeoomic survey of the proj ect, aiming to test the integrity and rationality of survey qustionaires, to hear suggestions from local residents, and to modify and improve the questionnaires based on actual conditions encountered during the testing survey. In order to fully achieve and complete various survey indices, the IRRC and PRO prepared a survey manual and used it as a guide for survey activities. The manual prescribed very cearly the requirements for filling questionnaires so as to unify the standard of field survey for all counties/cities along the project. All surveyors have been specially trainied. The detailed work plan for socioeconomic survey of the Jiangxi 3 highway project is shown in the annex. 2.5 Results of Socioeconomic Survey Other than collecting socioeconomic data of the project-affected areas and laws and regulations related to resettlement and land acquisition, the socioeconomic survey of Jiangxi 3 highway project mainly focused on survey on the quantities of acquired land and socioeconomic condition of the affected families through questionnaires. The questionnaires for survey are in 8 types, i.e., A: Questionnaire on condition of family members; B: Questionnaire on public opininions and suggestions;C: Questionnaire on houses and attachments; D: Questionnaire on land acquisition; E: Questionnaire on 19 Resettlement Action Plan of Jiangxi 3 Highway Project affected enterprises and institutions; F: Questionnaire on affected infrastructure facilities;; G: Questionnaire on socioeconomic situation of affected villages;; H: Questionnaire on poverty-stricken households among the DPs. From May to July of 2005, the PO organized and completed the survey on main route of RGE, service areas and interchanges and guided the CBGC to complete the socioeconomic survey on 2 local roads in cooperation with the IRRC. During the survey 2872 questinnaires were collected from main route of RGE, including 497 questionnaire A, 497 questionnaire B, 1510 questionnaire C, 211 questionnaire D, 9 questionnaire E, 49 questionnaire F, 66 questionnaire G,, 33 questionnaire H. Meanwhile, statistics data of socioeconomic development as well as laws and regulations related land acquisition and resettlement were collected. During the complementary survey in July 2005, 213 survey questionnaires were collected, of which 191 were for families, 20 for villages, 2 for infrastructure facilities , and at the same time, the recent statistics data of socioeconomic development of the affected counties and cities along the project as well as laws, policies and local regulations related to land acquisition and house relocation were collected. 2.6 Preparation of Resettlement Action Plan The draft report of the Resettlement Action Plan (RAP) of the project was prepared in June 2005on the basis of the resettlement survey along the project-affected areas carried out by the PO in May 2005, with assistance from the IRRC of Wuhan University. In July 2005, due to alignment changes made by the Designer, the PRO conducted a complementary survey on the project to update the data on land acquisition and resettlement, based on which the revised draft RAP for project pre-appraisal was prepared in September 2005.. The organizations involved in preparation of the RAP and their roles are shown in Table 2.1.
