General 1.1 Introduction 1.1.1 Project summarization 1 ) Site selection and nature of the project Guangzhou Solid Waste Disposal Center is a sub-item of Guangzhou Urban Environment Project. According to the layout, this project is to be localized in Liangtian Village of Liangtian Town in the northern of Baiyun District of Guangzhou City, with controlled land area being 500 Mu (with range extending to Jingzhu Freeway in the east, the old Guangcong Highway in the west, Zhongluotan Town of Baiyun District in the north and Qianjiawei Brick Field of Liangtian Town in the south, adjacent to the north foot of Baiyun Mountain). This project is to provide comprehensive facility for the final treatment & disposal of hazardous waste of public institutions of Guangzhou City, so as to, instead of all enterprises and institutions, safely and effectively dispose the various hazardous and harmful waste material that is difficult to utilize or unable to be disposed. 2 ) Construction content and scale of the project (1) Construction content: The construction content of Guangzhou Solid Waste Disposal Center mainly includes: Waste Allocation and Switching Central, Physico-chemical Treatment Workshop, Stabilization/solidification Workshop and Safe Filling Ground, etc. (2) Construction scale: * Scale of land use: The area of affected land for the initial stage of this project is 200,000square meters (300Mu), and the total area of control land within the layout red line is 333,335 square meters (500Mu). * Construction scale: In accordance with the generation amount and predicted amount of the hazardous waste to be land filled in Guangzhou City, the construction scale for the safety landfill of this project is 850,000cubic meters (the capacity of land filled waste substance after being compacted is generally 1.2T/m3 -1.6T/ m), of which: Implernentation Planning of Guangzhou Solid Waste Disposal Center The construction scale for phase I is 150,000 mi3; The construction scale for phase II is300, 000 m3; The construction scale for phase III is 400,000 m3. 3) Schedule of project construction Schedule of project construction Construction Work description Scheduled time period (days) 1. Acceptance of completed project April 20, 2005 April 30, (including planned environment 2005 10 protection items and labor protections) 1.1.2 Overview of the project area 1.1.2.1 A brief description of the project area Guangzhou Solid Waste Disposal Center is located in Baiyun District of Guangzhou City. And Baiyun District is located in the northeastern and western of Guangzhou City, connecting to Zengcheng City in the east and Nanhai City in the west, adjacent to Huadu City and Conghua City in the north and bordering on Liwan District, Yuexiu District, Tianhe District and Huangpu District in the south, with total area being 1042.7km2 of which cultivation land area occupies for 340,00OMu and total population for 858,40. The agricultural resources are rich and natural landscape is beautiful in this district; there are plenty of touristry attractions, such as Baiyun Mountain Beauty Spot, East Paradise and Sanyuanli Englishman Fighting Site, etc, with convenient traffic. 1.1.2.2 Waste substance pollution status in the project area An investigation of annual enterprise waste and its disposition, which was performed by Guangzhou Solid Waste Control Center in 2001, revealed that enterprises and institutions annually Implementation Planning of Guangzhou Solid Waste Disposal Center produce 263,570.97 tons of hazardous waste. However, because of low level of comprehensive utilization and treatment technology as well as small scale, the actually comprehensive utilization amount and treatment capacity are only 121,351.21 tons and 138,221.33 tons respectively; the comprehensive utilization rate and treatment rate are only 46.04% and 52.44% respectively, which has not reached environmental protection requirement. Annual average increase rate of hazardous waste in Guangzhou City Year 2001 2005 2005 2010 2010-2023 Annual average 5 % 3% 100 increase rate A Implementation Planning of Guangzhou Solid Waste Disposal Center 1.2 Analyses of the economic enviromment of the project resettlement 1.2.1 Objective of the analysis of the economic environment of the resettlement (1) From analysis in Paragraph 2.4 of the Involuntary Resettlement Planning for Guangzhou Urban Environment Project-- Resettlement Policy, the social environment in Guangzhou City is very much compatible to the project affected people and is easy to accept those people; the economy in Guangzhou is developing very fast while the space for further development remains considerably prospective, which means more jobs will be available and the capacity for taking the project affected people is very strong; in addition, the social security and job security system in Guangzhou are considerably mature while the infrastructure is well developed too, which provides to the project affected people good space for living and development. Nevertheless, in order to better protect the PAP's interest and keep the integrity of the original living area and social relationship of the PAP's as far as possible, this section intends to analyze the economic environment of the region in which the project is located, thereon to analyze the employment environment of the PAPs and the business environment of enterprises thus extending to the analysis of the recovery capability of the PAP's living under the specific economic environment of the project, so as to set out the points for resettlement work attention in this project. In this way, the resettlement plan and measures that are made in Resettlement Implementation Plan are more directional, and the resettlement goal can be realized as desired. (2) This project will focus on the employment and resettlement of the rural PAPs because the project only involves the land requisition of rural area, and project-affected people are rural residents. 1.2.2 Socioeconomic characteristics of the project area The area in which the project is to be constructed is in Baiyun District of Guangzhou city, and the economic characteristics of this area is follows: 1) Large scale of agricultural enterprises (1) This district attaches its importance to the development of five rising agricultural Implementation Planning of Guangzhou Solid Waste Disposal Center industries such as horticulture. There are over 140 agricultural enterprises whose products account for above 90% of the total agricultural commodities of this district. (2) Its total output of agriculture in 2002 is RMB 24.828 billion Yuan, of which the production output of township and village enterprises is RMB 23.398 billion Yuan, accounting for 94.24% of the total agricultural output. 2) Rapid progress of light industries In 2002 this district established eight industry parks that have attracted total 158 enterprises engaged in product production of dozens of industries such as electronic information and folk food. Just in the first half of the year of 2003 these eight industry parks achieved an accumulative industrial output of RMB 4.571 billion Yuan, accounting for 23.1% of the total of the whole district in the corresponding period. Its rapid progress becomes a major economic growth point of this district. 3) Developed leisure tourism Relying on its geographic advantages such as wide territory and diversified landforms, this district gives a full play to the development of agricultural and ecological tourism industries. It has developed about 20 tourist spots including Baiyun Mountain, a famous mountain in Guangdong. It has abundant tourist products. In 2002 its total income of tourism industry is RMB 1.68 billion Yuan, accounting for 10.37% of the service sector's GDP of this district. 1.2.3 Employment environment of the PAPs with low income in project area The characteristics of regional economic development decide the development direction and potential of trades in this district, and such direction and potential decide the development direction of various posts of every trade and the number of employment opportunities. The data are from Collection of the Second-time Census Data of Fundamental Units of Guangzhou. As census is carried out per five years and the last census was carried out in 2001, so the data in the table were counted at the end of 2001. 3. Some data in the table may be not correct, but they are the most authoritative data available for the Project at present. 8 Implementation Planning of Guangzhou Solid Waste Disposal Center From the analysis on the employment situation of low-income posts in Baiyun District in aforesaid table we can see that: (1) In Baiyun District, there are a large number of employees and posts in agriculture, forestry, animal husbandry and fishery service industries, which rank first among industries in Guangzhou and facilitate the employment resettlement for rural area PAPs. (2) Manufacturing industry has a large demand for labor force (mainly for young ones), while most posts require relevant skills, so such training may be offered for PAPs to help them trans-employed in these trades. (3) Service sectors including wholesale business, retail business, restaurant and beverage industry, hotel business and tourism industry have not superior demand for labor force to that in other districts, while there are many posts for young female labour force and most of them have no special requirements. (4) There are a small number of posts for middle-aged PAPs to whom more attention shall be paid in this district. Implementation Planning of Guangzhou Solid Waste Disposal Center 2. Status of the PAPs and the resettlement, compensation and rehabilitation plans for them 2.1 Status of the PAPs whose land is affected and the resettlement, compensation and rehabilitation plans for them 2.1.1 Type and quantity of affected land The project is to requisition the farmland for 300.4 Mu in Liangtian Village of Baiyun District of Guangzhou, of which: Infield: 42.89 Mu, accounting for 14.28% of the area of affected land Woodland: 113.84 Mu, accounting for 37.90% of the area of affected land Garden land: 139.3Mu, accounting for 46.37% of the area of affected land Pound: 2.0lMu, accounting for 0.67% of the area of affected land Other agricultural land: 2.36Mu, accounting for 0.79% of the area of affected land. 2.1.2 Status of the labor force whose property is affected In the light of China policy, for the rural area where land adjustment is unable to conduct, the agricultural population shall be converted into nonagricultural population. In general condition, the original ratio between agricultural population and infield shall remain unchanged, according to which the per capita infield is 1.2 Mu, affected land is 300.4 Mu, and the affected agricultural population is 253 in Liangtian Village. Since the site of this project has just been determined and the land requisitioning has not been undertaken, and also, Liangtian Village has not determined which farmers or farmer families will be converted into nonagricultural population, the affected farmer families can not be investigated. 2.1.3 Resettlement, compensation and rehabilitation measures 1) The affected rural people shall obtain compensation according to Resettlement Policy, and the compensation fund shall be paid in a time manner. 2) When conducting land requisition, the affected structures shall be restored in a timely manner if they are non-independent structures (which are connected to other structures having not been removed); care shall be taken to reduce the impact on the integral function of buildings. 3) The govemmental expenses of taxation related to the affected land of that year shall be deducted in the expenses of taxation of the next year. 4) During the construction of the solid waste disposal center, if temporary labor force is needed, the young adults from the rural PAPs shall be given priority. 5) After the establishment of the solid waste disposal center, appropriate personnel from the rural PAPs will be arranged to deal with work that requires less technology or the work that can be done after training, such as handling, entrance guard, transportation driver and cleanness keeper, etc. 6) The Project will contact with labor employment training authorities in providing necessary Implementation Planning of Guangzhou Solid Waste Disposal Center psychological assistance and skill training for the rural PAPs, so as to allow them to go over the rehabilitation period and to obtain new skill. 7) The Project shall negotiate with the real property companies of resettlement sites to provide job posts, such as security and house keeper. 8) The Project will contact with the real property companies of resettlement sites and street housekeeping service points to provide job posts, e.g., cleanness keeper and housekeeping service, for the young and middle-aged women of rural PAPs. 9) The Project will retain experts to give counsel for the use and investment of rural compensation fun, for, example, investing in the Liangtian Village Industry Park being built, so as to speed up the construction of industry park and supporting facilities, to increase the attraction to foreign investment, and to allow the investment of compensation fund to gain better earnings ratio, thus promoting the development of local economy. By carrying out such measures, the Project hopes to provide employment opportunities for farmers as well as to benefit from the shares. In this way, a good circulation of economic development is formed, and the living standard of the rural PAPs can be continually improved. 10) The Project will negotiate well with the affected farmers, the chances shall be, as practical as possible, given to the young adults who have certain skill. 2.2 Affected houses and their resettlement, compensation and rehabilitation measures 2.2.1 Quantity of affected houses 2~~~~~~ The affected houses are 1128.4m in total, of which duck shed(shed structure) is 624.3m2 and simple structure is 504. Im2. 2.2.2 Affected people Two families and 13 persons will be affected. These people are non-native residents who rent the land of Liangtian Village for dealing with fish breeding and poultry rising. 2.2.3 Resettlement, compensation and rehabilitation measures 1) Since the layout management for this area is not strict, these houses will be compensated according to replacement price. 2) The affected people will be compensated with house-moving fee. 3) Relevant structures will be compensated as per replacement price. 4) The two families of non-native personnel will be assured to rent basically identical land from Liangtian Village (or neighbor villages) for fish breeding and poultry rising. Implementation Planning of Guangzhou Solid Waste Disposal Center 3. Status of the affected and the resettlement, compensation and rehabilitation plans for them 3.1 Basic situation of the affected Disadvantageous groups is not a really affected kind by project, it is a group of people needed special attention among all affected kinds. According to the scope definition about disadvantageous groups in 4.3.3 of "Resettlement Policy", the general conditions of the sub-item disadvantageous are groups as follow: (The investigation not finished and the contents will be added) 3.2 Resettlement, compensation and rehabilitation plans for the affected The Project will give the following helps to the affecteds besides the resettlement and compensation specified in the Resettlement Policy: 1) After the establishment of the solid waste disposal center, they will be, in a priority manner, arranged to deal with work that requires less technology or the work that can be done after training, such as handling, entrance guard, transportation driver and cleanness keeper, etc. 2) The Project will negotiate with villagers' committee to provide a certain job posts of the constructing industry park to the affected affecteds. 3) At the PAP's willing, the Project will help them to find proper jobs in the resettlement sites of sub-items, and will contact with the social labor authorities to provide appropriate community training, allowing them to deal with housekeeping, cleanness keeping and keeper. 4) The Project will pay attention to the affected(the elder who has no grown-up children to accompany, widow, single-parent family, the handicapped, chronic patient and poverty family), and will periodically pay a return visit to them and provide help for special difficulties after the project has been established. Explanation on preparation of Resettlement and Compensation Standard for Guangzhou Urban Environmental Project 4.1 Compensation standard for land 4.1.1 Compensation standard for land requisition (please see Annexed Table 13.1.1) 1) Reference to compilation of compensation standard Reference to compilation of the standard: * Article 47 in Land Administration Law of the People's Republic of China; * Article 30 in Enforcement Method of Guangdonig Province for Land Administration Law of the People's Republic of China; * Provisional Regulations on Compensation and Resettlement of Peasant Collective-owned Land Affected for Construction Land in Guangzhou (Opinion Requisition Version). 2) Determination of compensation base number According to the above regulations, the compensation base number is the average annual output of the requisition land in the previous three years. Due to the large range of the wastewater project which covers several villages in different districts, and presently, the district statistic bureaus can only provide the statistics data of partial villages, this compensation standard list only shows the compensation base numbers for the villages for which the statistics data have been provided. For the other villages, the base number for the adjacent village will be referred to for the base number determination (criteria has been provided in the list). 3) Land compensation fund * Calculation formula Land compensation fund=compensation base number X compensation times * Determination of compensation times For the reason that the wastewater project belongs to municipal project, the compensation fund may be on the low side. Therefore, for the compensation times in this project, the lower limit in the range of various land compensation times listed in Clause 30 in "Implementation of 'Land Administration Law of the People's Republic of China' in Guangzhou Province " will be referred to. Thus, in this project, the method in "Provisional Regulations on Compensation and Resettlement of Peasant Collective-owned Land Affected for Construction Land in Guangzhou (Exposure Draft )" has been referred to so as to work out the resettlement allowance based on times. In this criteria, the compensation times is determined referring to the related regulation in "Provisional Regulations on Compensation and Resettlement of Peasant Collective-owned Land Affected for Construction Land in Guangzhou (Exposure Draft )" and is adjusted based on the following circumstances. * Resettlement allowance for plowland. Due to the large area, Baiyun District is subdivided. For Songzhoujie near to the urban district, 12-time will be adopted and 5-time for Taihe Town and Renhe Town far away from the urban district. 5-time is given for Liwan District in the original regulation, and 13-time is adopted in this project considering balancing it to that for the other old urban district. The compensation price grades are clearly defined according to these two standards. Due to the obvious difference of house price in different locations in Class 1-3 districts, the price fluctuation is obvious while the price fluctuation is tiny in Class 4-6 districts. (2) Based on the experience, the compensation standard is given considering the frame structure, mixed structure, half-timbered structure, simple structure and shed structure. Therefore, the compensation standard is stipulated in terms of commercial road, common street and alleyway. Commercial road locates in the prosperous central section, which belongs to Class 1-3. The price for ground floor, the first floor and the second floor and the floor above second floor decreases by degree. The compensation for affected above second floor in Class 1-3 district is slightly higher than that for office houses with property right while compensation for affected above second floor in Class 4-6 districts is near to that for office houses with property right. The price of ground floor affected varies much depending on the longitudinal depth; therefore, the price in the compensation standard is decreased by degree in term of the depth of 0-12 m, 12-24m, depth above 24m. in Class 1-3 district, the price fluctuation of the three grades is obvious and that for Class 4-6 fluctuates slightly. Due to the obvious difference of house price in different locations in Class 1-3 districts, the price fluctuation is obvious while the price fluctuation is tiny in Class 4-6 districts, which is near to the price for office houses with property right. (2) As the price of houses built on household plot does not vary much for the reason of the location, the compensation standard is stipulated based on the 1-6 grades defined considering the various factors such as district environment, productive forces cost, traffic, economic development level, population and social environment. (3) Based on the experience, the compensation standard is given considering the frame structure, mixed structure, half-timbered structure, simple structure and shed structure.
