Regarding the order of work, the Chair announced that consideration of agenda item 6.2 would take place in the afternoon session when the informal working group would provide the Committee with an update on their deliberations Item 6 (continued) Treaty instruments and technical matters Item 6.3 (continued) Progress report on technical matters related to Articles 9 and 10 (Regulation of contents and disclosure of tobacco products, including waterpipe, smokeless tobacco and heated tobacco products): report by WHO The Committee was asked to consider the report by the Secretariat contained in document FCTC/COP/8/8. Comments were invited from the floor on the draft decision as contained in document FCTC/COP/8/A/Conf.Paper No. 1. In accordance with rules 29.2 and 31.4 of the Rules of Procedure, State-Non Parties and Observers were invited to take the floor. The Chair then asked Canada (as sponsor of the draft decision) to take the floor. The Party provided background to the draft decision and responded to issues raised. In the absence of an agreement, the Chair requested Canada to convene informal consultations between interested Parties and other key facilitators of the text. The Committee agreed to suspend consideration of this agenda item pending the outcome of the informal discussions. The Chair asked the committee to consider the draft decision as contained in document FCTC/COP/8/A/Conf.Paper No. 3 as proposed by a Party. The Chair invited the European Union (as sponsor of the draft decision) to introduce the text of the document. The floor was then opened for discussion. The Chairman announced that, due to time constraints, consideration of the draft decision would continue at the next session of the Committee. The meeting was adjourned. Conference of the Parties to the WHO Framework Convention on Tobacco Control • Eighth session – Geneva, Switzerland, 1–6 October 2018 Journal N° 5 • Friday 5 October 2018 • Page 6 Fifth meeting of Committee B In the chair: Dr Nuntavarn Vichit-Vadakan (Thailand) Later: Mrs Maria Brozmanová (Slovakia) Vice-Chair The Chair opened the session and thanked interested Parties in the informal drafting group that reviewed the draft decision for Agenda item 8.2 contained in FCTC/COP/8/B/Conf.Paper No. 2 (Rev.1). The amended draft decision would be circulated to the Committee at a later meeting. The Secretariat, in response to a point of order with regards to the submission of one Party’s credentials, informed the Conference that the online version of Journal no. 4 was amended to reflect the correct status of the Party as having conformed to the requirements of the Rules of Procedures concerning submission of its credentials. Item 8 (continued) Budgetary and institutional matters Item 8.3 Proposed workplan and budget for the financial period 2020–2021 The Chair invited the Committee to consider and adopt the proposed workplan and budget for the financial period 2020–2021, as well as to delegating to the Convention Secretariat (in coordination with the Bureau), the task of informing the Parties the Scale of Assessment of assessed contributions for 2020–2021. Comments were invited from the floor. The Secretariat responded to questions raised. At the invitation of the Chair, the Head of the Secretariat responded to issues raised. The Chair confirmed that the programme budget would be modified, taking into account the Medium-term Strategic Framework, other decisions taken in Committee A and all comments received, and the amended version would be presented to the Parties at a later stage. The agenda item remains open pending presentation to the Committee of a revised draft document. Item 8.1 (continued) Performance and Progress reports The Chair invited the Secretariat to open the discussion of the draft decision as contained in document FCTC/COP/8/14 (Rev. 1). The Secretariat provided some explanatory remarks, then responded to issues raised. Responding to a Party’s request, the Legal Counsel stated that Comptroller views would be sought. Items 8.1 (a) and 8.1 (b) were closed by the Chair, moving the discussion to 8.1 (c). Given that a Party proposed a draft decision under item 8.1 (c), the Committee would revisit this item the following day. The Chair announced that Item 8.1 remained open pending review of the draft decision by the Parties and regions. Item 8.7 (continued) Relationship of the Convention Secretariat with other international entities: observer status The Chair invited Canada to introduce their proposed draft decision. Comments were then invited from the floor. The Legal Counsel responded to a question on wording of the decision. The Head of the Secretariat responded to queries and provided further clarification. The decision was adopted, as amended thus closing the agenda item. The meeting was adjourned. After the presentation of the report on credentials contained in Document FCTC/COP/8/2 at the fourth Plenary session, the Convention Secretariat was happy to announce that all the credentials of the representatives of all Parties listed were found to be in conformity with the Rules of Procedure. The Secretariat announced that a revised version of the document would be uploaded later in the day. Item 6 (continued) Treaty instruments and technical matters Item 6.3 (continued) Progress report on technical matters related to Articles 9 and 10 (Regulation of contents and disclosure of tobacco products, including waterpipe, smokeless tobacco and heated tobacco products): report by WHO The Chair reopened this agenda item and proposed that an informal drafting group be convened to facilitate a discussion for those Parties wishing to make amendments to the proposed draft decision. The Parties agreed to suspend consideration of this item pending the outcome of the informal drafting group. Item 6.2 (continued) Tobacco advertising, promotion and sponsorship: depiction of tobacco in entertainment media: report by the expert group The Chair invited a member of the informal drafting group to report on the progress of their deliberations. The Committee was asked to consider the white paper which had been circulated and for the benefit of interpretation, the Secretariat read out the proposed amendments. At the suggestion of the Chair, the agenda item remained open pending the deliberations of informal discussions. Discussion of the item was suspended, to be resumed later in the session. Item 6.4 (continued) Progress report on technical matters related to Articles 4.2.d (gender issues) 5.3 (tobacco industry interference), 17 and 18 (alternative livelihoods and protection of the environment) and 19 (liability) The Chair reopened the agenda item and invited comments from the floor on the progress report on technical matters related to Article 19. In response to questions from the floor, the Secretariat provided an update on the implementation of decision FCTC/COP7(11). Iran, as a participant of the informal meeting on the draft decision contained in document FCTC/COP/8/A/Conf.Paper No. 2, reported on the deliberations. In response to comments and issues raised, the Chair proposed to postpone deliberations on this agenda item to the next meeting of the Committee. Item 6.2 (continued) Tobacco advertising, promotion and sponsorship: depiction of tobacco in entertainment media: report by the expert group The Chair reopened the agenda item and invited comments from the floor. The draft decision, contained in document FCTC/COP/8/A/Conf.Paper No. 7 was approved as amended thus closing the agenda item. Item 6.5 (continued) Progress report on regulatory and market developments on electronic nicotine delivery systems and electronic non-nicotine delivery system. Sixth meeting of Committee B In the chair: Dr Nuntavarn Vichit-Vadakan (Thailand) Item 8 (continued) Budgetary and institutional matters The Chair opened the meeting and announced the agenda items which remained open: Item 8.2, Item 8.4, Item 8.8 (to be discussed together with Item 8.11) and Item 8.3 Item 8.2 (continued) Maximizing transparency of delegations from Parties and observers to the Conference of the Parties, its subsidiary bodies and other WHO FCTC meetings As announced by the Chair, the draft decision will be considered at a subsequent meeting once a revised version, taking into account the draft decisions contained in FCTC/COP/8/15 and FCTC/COP/8/B/Conf.Paper No. 2 (Rev. 1), is available to Committee members. Item 8.4 (continued) Payment of the assessed contributions and measures to reduce Parties in arrears The Chair reopened this item and the Committee to consider the amended draft decision as contained in document FCTC/COP/8/17. Comments were invited from the floor and the Chair provided some explanatory remarks. It was proposed that discussion of this item be deferred to the next session of the COP. In response to Parties’ request for clarification, the Legal Counsel explained the substance of decision COP/7 (23) and proposed appropriate wording for the text of the decision, which the Chair found satisfactory. In response to the Chair’s query, the Legal Counsel stated that the decision on what constituted “justifiable circumstances” was within the remit of the Conference of the Parties. At the request for clarification of one delegation, the WHO Legal Counsel explained that during Health Assemblies, Member States in arrears would normally lose their voting rights. The agenda item remained open pending discussion of the white paper at the next meeting of the Committee. Item 8.8 Possible amendments to the Rules of Procedure of the Conference of the Parties The Chair introduced the item and reminded the Committee of the documents to be considered in parallel. The Committee was invited to adopt the proposed amendments presented in document FCTC/COP/8/21 (Rev.1). To a Party’s query on whether Item 8.8 and Item 8.11 should be discussed one after the other and if one session should be restricted only to the Parties, the delegation from Panama suggested to discuss item 8.11 first and as a restricted session. In response to queries raied, the Head of the Convention Secretariat provided explanatory remarks on the process of preparing the document on this agenda item. Item 8.8 remained open. Conference of the Parties to the WHO Framework Convention on Tobacco Control • Eighth session – Geneva, Switzerland, 1–6 October 2018 Journal N° 5 • Friday 5 October 2018 • Page 9 Item 8.11 (continued) Procedure for the selection and evaluation of the new Head of the Convention Secretariat (restricted session) All delegations of nongovernmental organizations, intergovernmental organizations and state non-parties were requested to leave the room upon announcement by the WHO FCTC Secretariat’s Senior Legal Officer that discussion of this item would be restricted. The Parties welcomed the presence of the WHO Legal Counsel, considering that the Convention Secretariat is hosted by WHO. The Chair invited comments from the floor on the two documents to be considered under this item. To a query by one Party on whether the selection of the Head of the Convention Secretariat was included in the Rules of Procedures, the Legal Officer confirmed that it was in Article 7 of the Rules of Procedure, and was also included in decisions of four Conference of the Parties (COP) held earlier and that all these were reflected in the draft decision presented in document FCTC/COP/8/27. The Chair suggested to combine main elements of two draft decisions, one proposed by the Convention Secretariat, within the document, and another in a Conference paper proposed by Canada and then invited comments from the floor. Recognizing the complexity of the process of selecting the new Head of the Convention Secretariat, including the formulation of the selection criteria for candidates and the establishment of the post description for the position, the Chair considered the numerous comments and amendments by the Parties to the two draft decisions. On a point of clarification requested by the Chair, the Legal Officer explained that COP8 had the option to recommend to the WHO Director General to abolish the position of the Head of the Convention Secretariat and create a new, higher position as the Executive Secretary of the Convention for increased visibility and empowerment for her or him to perform the required duties. The Parties expressed their views and raised more questions on the issues of selection criteria, abolition and creation of a new position and suggested more changes. The Chair proposed that rather than holding an evening session (without interpretation), a small working group should meet on the various issues raised and welcomed interested Parties. A new combined version of the two draft decisions would be presented at the next meeting of Committee B. The meeting was adjourned. Canada updated the Committee on the progress of the deliberations and requested additional time to facilitate further discussions. Consideration of this agenda item was suspended. Item 6.4 (continued) Progress report on technical matters related to Articles 4.2d (gender issues), 5.3 (tobacco industry interference), 17 and 18 (alternative livelihoods and protection of the environment) and 19 (liability) The Committee was invited to consider the draft decision contained in document FCTC/COP/8/A/Conf.Paper No. 3 concerning Article 5.3. Brazil updated the Committee on the progress of the deliberations and requested additional time to facilitate further discussions. Consideration of this agenda item was suspended. Item 7 (continued) Reporting, implementation assistance and international cooperation Item 7.2 Progress report implementation assistance and international cooperation The agenda item was opened and comments were invited from the floor on the report as contained in document FCTC/COP/8/12. The Committee noted the report. The Chair invited Ecuador, as a co-sponsor of the draft decision, to introduce the text. Comments were then invited from the floor. The Secretariat responded to issues raised and clarified the relation between FCTC and The Convention on the rights of the child. The item will be reconsidered at a subsequent meeting, pending circulation of the amended draft decision to committee members. Item 7.3 Tobacco control in emergency situations (item proposed by a Party) The agenda item was opened and the Committee was invited to consider the report as contained in document FCTC/COP/8/13. Comments were invited from the floor. In reponse to a suggestion to reassign the agenda item from Committee A to Committee B, the Head of the Convention Secretariat clarified the Bureau’s position. Following a lengthy discussion, it was noted that there was interest in keeping the agenda item in Committee A. The Chair proposed that interested Parties convene an informal drafting group. The proposal was accepted by the Committee. The meeting was adjourned. The Bureau of the COP decided to suspend the accreditation of two journalist after some elements were brought to the attention of the Bureau in relation to the veracity of the information provided by the journalists in their « Declaration of Interest » form that they were required to fill when registering to obtain their accreditation to the eighth session of the Conference of the Parties to the WHO Framework Convention on Tobacco Control. The only distribution of documents considered official is the distribution of documents through the documentation desk of the WHO FCTC Secretariat. The WHO FCTC Secretariat regrets that it cannot dispatch documents home on behalf of participants at the conclusion of the session. Payment of per diem (for countries who have not received per diem by bank transaction) Delegates entitled to payment of a per diem in connection with their participation in COP8 (one delegate from each least developed country), and whose travel has been arranged by the WHO FCTC Secretariat, should contact the per diem office no. 222 on the second floor of the Conference Centre. The per diem office will be open between 14:00 and 15:00 each day. On-site facilities Internet cafe: Internet booths are available at the conference centre for Internet, email and word processing. The conference centre is fully equipped with a Wi-Fi system. Post office: There is a Post Office at the conference centre that provides full postal, telegraph and facsimile facilities.
