66 66 电子尼古丁传送系统和 电子非尼古丁传送系统 世界卫生组织的报告 引言 1. 编写本文件是因为缔约方会议第六届会议(俄罗斯联邦莫斯科,2014 年 10 月 13-18 日) 向公约秘书处提出要求1,请世界卫生组织:(a) 为缔约方会议第七届会议编写一份关于电子尼 古丁传送系统和电子非尼古丁传送系统的报告,更新其对健康影响的证据、其潜在的戒烟作用 和对烟草控制努力的影响;(b) 然后评估用于实现 FCTC/COP6(9) 号决定第 2 段所列各项目标 的政策方案;(c) 并审查对这些产品的成分和释放物进行测量的方法。按照缔约方会议批准的 术语,本报告根据设备以气溶胶形式传送的加热溶液是否含有尼古丁来区分电子尼古丁传送系 统和电子非尼古丁传送系统。 2. 本报告包括 2015 年 12 月世卫组织烟草制品管制研究小组在其第八次会议(巴西里约热内 卢,2015 年 12 月 9-11 日)上提出的对电子尼古丁传送系统/电子非尼古丁传送系统的审议意 见和科学建议2、2016 年 5 月在巴拿马举行的政策方案非正式磋商内容(2016 年 5 月 4-5 日, 巴拿马巴拿马城)以及世卫组织委托编写的四份背景文件3,4,5,6。本报告不审查电子尼古丁传送 系统/电子非尼古丁传送系统成分和释放物的测量方法。可访问世卫组织网站获取本报告的所 有附件i。 电子尼古丁传送系统/电子非尼古丁传送系统产品 3. 所有电子尼古丁传送系统/电子非尼古丁传送系统均加热溶液(电子液体)产生气溶胶,其 中经常包含调味剂,通常溶解于丙二醇和/或甘油中。所有电子尼古丁传送系统(而非电子非 尼古丁传送系统)均含有尼古丁。虽然我们一般认为它们是一类产品,但是这些产品有很多不 同之处,在生产有毒物质和输送尼古丁方面可能有巨大差异。目前市场上有几个类型的装置: 包括第一代设备或称为 cigalike;第二代罐装系统以及更大的第三代或个人汽化器。其他人主 要根据使用者对所用的电子液体、加热电子液体使用的电压和电阻及通气功能的控制程度,将 这些装置分为封闭和开放系统。 4. 电子液体的选择、使用者的抽吸方式以及设备通过调节功率和电阻提高温度以雾化电子液 体的能力,都将决定使用电子尼古丁传送系统/电子非尼古丁传送系统是否能迅速传送足够的 尼古丁来模拟吸烟的感官感受,产生令使用者满意的体验。 电子尼古丁传送系统/电子非尼古丁传送系统对烟草控制的潜在作用 i http://who.int/tobacco/industry/product_regulation/eletronic-cigarettes-report-cop7/en/index.html 世界卫生组织 烟草控制框架公约 缔约方会议 第七届会议 印度德里,2016 年 11 月 7-12 日 临时议程项目 5.5.2 FCTC/COP/7/11 2016 年 8 月 FCTC/COP/7/11 2 5. 如果大部分不能或不愿戒烟的吸烟者能立即转为使用健康风险较低的尼古丁替代来源,并 最终达到停止使用,这将是一项巨大的当代公共卫生成就。只有当尼古丁依赖人口中增加的未 成年人和非吸烟者人数不高于吸烟人口中增加的人数并最终降低到零,才能实现这项成就。电 子尼古丁传送系统/电子非尼古丁传送系统是否能完成这项工作仍然是一个有争议的话题,一 部分人希望在现有证据的基础上,让自己使用此类产品迅速得到鼓励和认可,另一部分人则强 烈要求注意现有的科学不确定性以及不同产品的性能差异和使用者行为的多样性。 电子尼古丁传送系统/电子非尼古丁传送系统的市场规模 6. 估计 2015 年全球电子尼古丁传送系统/电子非尼古丁传送系统的市场规模大约为 100 亿美 元。其中美国约占 56%,英国占 12%。中国、法国、德国、意大利和波兰共占 21%(每个国 家占 3-5%)7。目前尚不清楚电子尼古丁传送系统/电子非尼古丁传送系统的销量是否会继续增 加8。此外,市场情况可能出现变化,因为烟草业已经推出加热但不燃烧烟草的替代尼古丁输 送系统9,10,11并且正在开发或已经使用不需要加热机制的尼古丁吸入技术12, 13,14。 使用电子尼古丁传送系统/电子非尼古丁传送系统特有的健康风险ii 7. 一般使用纯粹的电子尼古丁传送系统/电子非尼古丁传送系统会产生气溶胶,其中通常含有 二元醇、醛类、挥发性有机化合物、多环芳烃、烟草特有亚硝胺、金属、硅酸盐颗粒和其他成 分。二羰基化合物(乙二醛、丙酮醛、二乙酰)和羟基羰基化合物(丙酮醇)也被认为是气溶 胶中的重要化合物。在这些物质中,许多都是有毒物质,其已知的健康影响可能导致一系列显 著的病理变化。 8. 一般使用纯粹电子尼古丁传送系统/电子非尼古丁传送系统产生的已知有毒物质数量和含 量,通常低于或远低于香烟烟雾,但会产生一些电子尼古丁传送系统特有的新的有毒物质,如 乙二醛。然而,不同品牌和同一品牌中不同产品产生的有毒物质含量可能有巨大差异,有时甚 至比烟草烟雾中的含量高15。这可能主要是由于开放系统设备中不断上升的温度增加了电子液 体成分的热分解。iii在正常使用实验条件下,一些电子尼古丁传送系统/电子非尼古丁传送系统 气溶胶中某些金属(包括铅、铬和镍)及甲醛 15,16的浓度等于或高于传统卷烟中的浓度。 9. 电子尼古丁传送系统气溶胶含有尼古丁,它是烟草制品中的成瘾性成分。除了产生依赖 性,尼古丁还会在妊娠期对胎儿的发育产生不良影响,并可能导致心血管疾病。虽然尼古丁本 身不是致癌物质,但它可能起到“肿瘤诱发物”的作用,它似乎参与恶性疾病和神经退行性疾 病的生物学变化17。胎儿和青少年接触尼古丁可能对大脑发育造成长期不良后果,可能导致学 习障碍和焦虑障碍18,19,20。这些证据足以警告儿童和青少年、孕妇和育龄妇女不要使用电子尼古 丁传送系统并远离尼古丁。 10. 目前已报告了近 8000 种电子液体的独特香料21。加热和吸入电子液体中使用的调味剂对健 康产生的影响还没有得到充分研究。22加热和吸入爆米花23,24、肉桂25和樱桃调味剂有潜在危 害,关于这一主题的有限文献表明,大部分调味剂在长期使用的情况下都可能造成明显的健康 风险,特别是甜味调味剂。许多调味剂有刺激性26,27,28,可能加重呼吸道炎症29;有些比未添加 调味剂气溶胶的细胞毒性大,但比烟草烟雾的细胞毒性小30,或者呼吸道细胞直接接触电子液 体后更容易感染病毒31,但是这与接触电子液体(而非气溶胶)的直接作用的相关性尚不 明确32。 ii 参见附件 1 了解要考虑的其他健康风险。 iii 对这种差异其他可能的解释是加热元件和相关部件在加热时释放金属和其他颗粒的可能性,以及使用的一些分析 方法的不可预测性,因为很少为分析电子尼古丁传送系统/电子非尼古丁传送系统对分析方法进行标准化和验证。 FCTC/COP/7/11 3 11. 主要根据医药级成分制成的纯粹电子尼古丁传送系统/电子非尼古丁传送系统的一般使用过 程中产生有毒物质的含量和数量进行分析,电子尼古丁传送系统/电子非尼古丁传送系统的毒 性很可能比卷烟烟雾低。但是,电子尼古丁传送系统/电子非尼古丁传送系统不可能是无害 的,并且长期使用将增加慢性阻塞性肺病和肺癌的风险,还可能增加心血管疾病及一些与吸烟 有关的其他疾病的风险33。这些风险的严重性可能比烟草烟雾小34,35,36,但是没有足够的研究来 量化电子尼古丁传送系统/电子非尼古丁传送系统与可燃产品相比的相对风险。因此,目前无 法提供有任何科学可信性的关于使用这些产品比吸烟“更安全”程度的具体数字。然而现有的 模拟研究表明,以目前的使用率,为了使电子尼古丁传送系统/电子非尼古丁传送系统为广大 人群带来潜在的健康好处,这些产品至少需要比卷烟“更安全”三倍37,38。 12. 目前迫切需要明确使用各种电子尼古丁传送系统/电子非尼古丁传送系统设备和电子液体的 相对风险范围,以及与吸烟和使用其他尼古丁产品相比的使用者行为,认识到: a. 即使有毒物质的浓度较低或非常低,复杂的混合物(例如电子尼古丁传送系统液体和 气溶胶中的混合物)也可能产生毒性效应39; b. 如果没有协调使用化学、体外、临床 39 和流行病学方法得到确凿证据,只根据气溶胶 成分预测这些复杂混合物的不良健康影响可能是无效的;以及 c. 考虑到没有烟雾成分安全耐受限值或其对吸烟导致多种疾病的特定影响的科学依据, 烟草业提倡40,41的将电子尼古丁传送系统/电子非尼古丁传送系统中的有毒物质含量与 烟草烟雾中的高含量进行简单比较基本没有价值。 对接触电子尼古丁传送系统/电子非尼古丁传送系统使用者呼出之气溶胶的旁观者的健康风险 13. 最近一份关于被动接触电子尼古丁传送系统/电子非尼古丁传送系统使用者呼出的气溶胶 (或称二手气溶胶)的系统性综述得出以下结论:“被动接触电子烟蒸气的实际影响可能导致 不良健康影响 42。”世卫组织委托编写的综述 3 发现,虽然这个领域的研究数量有限 43,44,45,46,47,48,49,50,51,52,53,54,55,但仍然可以得出以下结论:二手气溶胶是产生颗粒物质(包括细颗粒 和超细颗粒)、1,2-丙二醇、某些挥发性有机化合物、某些重金属和尼古丁的新的空气污 染源。 14. 电子尼古丁传送系统二手气溶胶中某些金属(如镍和铬)的含量比二手烟高,当然也比本 底空气高。与空气中的本底含量相比,二手气溶胶中 PM 1.0 和 PM 2.5 的含量分别高出 14-40 倍、6-86 倍iv。另外,二手气溶胶中尼古丁的含量比本底空气中的含量高 10-115 倍,乙醛含量 高 2-8 倍,甲醛含量高出约 20%。除了重金属,二手气溶胶中检测到的这些化合物浓度通常比 二手烟低。目前,由于这些化合物和元素的含量比本底含量高所产生之健康风险的严重性尚未 经过实验验证。 15. 虽然有些人认为接触二手气溶胶不太可能造成严重的健康风险56,但他们承认,二手气溶 胶对于有某系呼吸系统问题的旁观者有害57。我们仍然可以合理地假设,二手气溶胶中的有毒 物质浓度超过本底浓度会增加所有旁观者的健康风险58。 电子尼古丁传送系统/电子非尼古丁传送系统辅助吸烟者戒烟的能力 16. 关于电子尼古丁传送系统/电子非尼古丁传送系统作为戒烟辅助品之有效性的科学证据很少 且确定性低,因此很难得出可靠的推论。2014 年的一份综述59根据两个随机临床试验得出结 论:尽管接受分析的电子尼古丁传送系统有相似但很低的戒烟效率,但证据的整体质量较低 60。世卫组织委托编写的综述对随机临床试验证据的质量和戒烟效率也得出类似结论。 iv 然而,二手气溶胶中的颗粒物质在空气中停留的时间通常比二手烟中的颗粒物质短,目前尚不明确会产生健康影 响的是其浓度还是成分(与二手烟中的颗粒物质不同)。 FCTC/COP/7/11 4 17. 纵向研究数量较多,相比于随机临床试验更能体现“真实”的使用条件,但提出了更多方 法论问题。对这些研究的两份综述表明,使用电子尼古丁传送系统可能降低戒烟的可能性61,4。 但是证据的确定性非常低。虽然大部分纵向研究发现使用电子尼古丁传送系统对戒烟没有好处 或削弱了戒烟好处,但有些研究62,63 发现,在特定的使用频率条件下,使用第三代电子尼古丁 传送系统可能对戒烟有好处。在得出任何最终结论之前,需要进行进一步探讨。综上所述,考 虑到科学证据较少且质量较低,尚不能确定电子尼古丁传送系统是否可以帮助大部分吸烟者戒 烟或阻止他们戒烟。 电子尼古丁传送系统/电子非尼古丁传送系统使青少年开始使用尼古丁和吸烟的能力 18. 世卫组织委托编写了关于 20 岁以下人群中电子尼古丁传送系统/电子非尼古丁传送系统使 用流行率和趋势的数据综述 6。综述共确定了 27 项在少数几个国家采用概率抽样方法的研究。 各项研究中受访者的年龄范围有所不同,各司法管辖区报告的电子尼古丁传送系统使用流行率 也不尽相同。2013-2015 年,非吸烟者中目前的使用率约为 2%,但美国佛罗里达州和波兰司法 管辖区的使用率分别为 13% 和 19%。吸烟者中目前的使用率约为 17%,佛罗里达州(11-14 岁 群体的使用率为 44.8%,15-18 岁为 51.7%)和波兰(57.4%)的流行率高出很多v。 19. 只有以下三个国家的年轻人目前使用电子尼古丁传送系统/电子非尼古丁传送系统之趋势数 据的概率抽样调查结果:美国、波兰和意大利。在意大利,吸烟者和非吸烟者目前使用电子尼 古丁传送系统/电子非尼古丁传送系统的比例非常低,且没有上升。英格兰的情况与其类似, 但现有的趋势数据不是基于概率抽样方法统计的。美国和波兰目前的电子尼古丁传送系统/电 子非尼古丁传送系统使用率都迅速上升。美国佛罗里达州和波兰非吸烟年轻人的使用率在三年 内分别增长了五倍和八倍,这些司法管辖区的流行率达到 6.9% 和 13%。 20. 趋势数据显示有两类国家。一类国家的电子尼古丁传送系统/电子非尼古丁传送系统使用率 很低并且没有大幅上升;另一类国家(包括全世界最大的市场(美国))的流行率迅速上升。 关于在这些国家年轻的非吸烟者中电子尼古丁传送系统/电子非尼古丁传送系统使用率上升是 不是吸烟的先兆,目前存在很大的争论。现有的纵向研究64,65,66,67 表明,从未吸烟的未成年人使 用电子尼古丁传送系统/电子非尼古丁传送系统,会使其开始吸烟的可能性增加至少一倍。目 前尚不清楚使用电子尼古丁传送系统/电子非尼古丁传送系统和吸烟的关联是因为使用传送系 统导致吸烟,还是因为年轻的传送系统使用者和吸烟者有相似的社交和行为特征,因此他们容 易受到使用尼古丁的影响。 电子尼古丁传送系统/电子非尼古丁传送系统的市场营销 21. 促销:关于电子尼古丁传送系统/电子非尼古丁传送系统制造商如何在主要国家市场上促销 其产品以及促销达到何种程度,目前缺少足够的研究或监测68。现有数据显示,自 2012 年以 来,电子尼古丁传送系统/电子非尼古丁传送系统的广告支出有所增加69,70;市场营销使用不同 的渠道(销售点71、视听和纸质大众传媒以及网上渠道)72;促销方式根据制造商的类型而有 所不同73。使用欺骗性健康宣传信息的广告数量无法确定,这些广告的目标群体包括年轻人 74,75,76,77,78,并煽动反对无烟政策79。还有人担心一些公司正在利用或可能利用电子尼古丁传送 系统/电子非尼古丁传送系统广告,有意或无意地促进吸烟80,81 ,82。 22. 价格:关于这个主题的有限的实证研究显示: a. 电子尼古丁传送系统/电子非尼古丁传送系统的销量和价格有很强的负相关关系83; v 附件 2 中有更多详细信息。 FCTC/COP/7/11 5 b. 电子尼古丁传送系统/电子非尼古丁传送系统和卷烟互为替代品,卷烟价格升高与电子 尼古丁传送系统/电子非尼古丁传送系统销量增加相关84。因此,根据产品类型制定不 同的税收政策,可能使不同类型的电子尼古丁传送系统/电子非尼古丁传送系统之间以 及电子尼古丁传送系统/电子非尼古丁传送系统和卷烟之间出现替代情况85; c. 充电式电子尼古丁传送系统/电子非尼古丁传送系统设备现有的初始费用和一次性电子 尼古丁传送系统/电子非尼古丁传送系统的费用,通常比卷烟的费用高86。 23. 产品特点:香料是影响人们愿意尝试电子尼古丁传送系统的几个重要的产品吸引力因素之 一。某些口味(例如水果和糖果的香味)吸引儿童、从不吸烟者的青少年和刚开始使用电子尼 古丁传送系统/电子非尼古丁传送系统的年轻人87,88,89,90,因此,可能激励他们尝试使用。2009 年,一家公司宣布他们将停止销售含有香料的产品,以阻止未成年人使用91,但几年后他们推 翻了这项决定。香料似乎还有助于使成人和经验丰富的电子尼古丁传送系统/电子非尼古丁传 送系统使用者从使用烟草转为使用传送系统92。因此,加香电子尼古丁传送系统/电子非尼古丁 传送系统可能是吸引口味偏好、同时表现出一定的安全性和建立使用者形象的几个产品特点之 一。 24. 产品布局:网上销售(而非零售店销售)占 2014 年全球市场销量的三分之一。在亚太、 澳大利亚和拉丁美洲这三个地区,网上销售占最大的市场份额(分别为 70%、85% 和 94%)。 商业利益 25. 最初,电子尼古丁传送系统/电子非尼古丁传送系统市场的增长是由与传统跨国烟草公司无 关的公司推动。然而,跨国烟草公司正在迅速增加他们在目前普遍不受管制的市场中的份额。 有些人93,94认为,美国和欧盟(就规模而言是电子尼古丁传送系统/电子非尼古丁传送系统的主 要市场)最近批准的法规将增加受监管设备推向市场的成本,使市场集中度更高,这将使跨国 烟草公司提高其市场主导地位。 26. 跨国烟草公司参与电子尼古丁传送系统/电子非尼古丁传送系统的营销是对烟草控制的一项 主要威胁。有人担心跨国烟草公司推销电子尼古丁传送系统/电子非尼古丁传送系统是为了: a. 通过宣传电子尼古丁传送系统是对烟草的补充而非替代品,来减少其对烟草销售的威 胁,或控制技术创新以防止其作为戒烟辅助品的效率得到改善; b. 通过电子尼古丁传送系统/电子非尼古丁传送系统广告促进吸烟,并向成人和儿童 促销; c. 宣传电子尼古丁传送系统/电子非尼古丁传送系统的潜在好处,并在不久的将来宣传尼 古丁吸入器技术的好处,以此为理由与烟草控制方面的政策制定者、科学家和倡导者 沟通并施加影响,以破坏世卫组织烟草控制框架公约,同时在企业社会责任倡议中建 设信誉。 27. 人们越来越关注的问题是关于这个主题的研究与电子尼古丁传送系统/电子非尼古丁传送系 统行业(包括烟草业及其盟友)的商业利益及其他既得利益的联系达到何种程度。一份综述 5 总结了 105 项分析液体和释放物的研究,其中 30% 的文献作者接受了电子尼古丁传送系统/电 子非尼古丁传送系统利益相关者的资金(包括烟草业)vi。 监管方案 vi 参见附件 3 FCTC/COP/7/11 6 28. 以下是各缔约方可根据本国法律考虑的不完全方案清单,以实现缔约方会议第六届会议有 关电子尼古丁传送系统/电子非尼古丁传送系统的决定中提出的相关目标。 29. 目标:防止非吸烟者和青少年开始使用电子尼古丁传送系统/电子非尼古丁传送系统,其中 应特别重视脆弱人群。虽然关于使用电子尼古丁传送系统/电子非尼古丁传送系统是否会导致 吸烟的争论仍未得到解决,但要防止这种可能性需要尽量增加开始吸烟和持续吸烟的困难程 度。没有禁止进口、销售和分发电子尼古丁传送系统/电子非尼古丁传送系统的缔约方可以考 虑以下方案: a. 禁止向未成年人销售和分发电子尼古丁传送系统/电子非尼古丁传送系统; b. 禁止未成年人持有电子尼古丁传送系统/电子非尼古丁传送系统; c. 禁止或限制电子尼古丁传送系统/电子非尼古丁传送系统的广告、促销和赞助(参见 FCTC/COP/6/10 Rev.1); d. 对电子尼古丁传送系统/电子非尼古丁传送系统征税,使未成年人无法负担此类设备和 电子液体,从而阻止这个年龄段的人使用vii。同时,可燃烟草产品的税金应高于电子 尼古丁传送系统/电子非尼古丁传送系统,以阻止人们开始吸烟并减少复吸; e. 禁止或限制使用吸引未成年人的香料; f. 监管销售场所、密度和渠道; g. 采取措施打击电子尼古丁传送系统/电子非尼古丁传送系统非法贸易。 30. 目标:尽量减少对电子尼古丁传送系统/电子非尼古丁传送系统的使用者潜在的健康风险, 并防止非使用者接触其释放物。 a. 没有禁止进口、销售和分发电子尼古丁传送系统/电子非尼古丁传送系统的缔约方可以 考虑以下方案以尽量减少对使用者的健康风险: i. 检测电子液体中使用的加热和吸入调味剂的安全性,禁止或限制有严重毒性问题 的调味剂的使用量,例如二乙酰、乙酰丙酰、肉桂醛或苯甲醛; ii. 要求使用的成分没有健康风险,并在允许的情况下使用最高纯度; iii. 监管电子尼古丁传送系统/电子非尼古丁传送系统设备的用电和防火安全标准; iv. 监管制造商向政府披露产品成分的需要; v. 监管设备和电子液体使用适当的标签; vi. 要求制造商监测并报告不良影响;以及 vii. 规定注销不遵守法规的产品。 b. 没有禁止进口、销售和分发电子尼古丁传送系统/电子非尼古丁传送系统的缔约方可以 考虑以下方案以最大化减少对非使用者的健康风险: i. 法律禁止在室内空间使用电子尼古丁传送系统/电子非尼古丁传送系统,或至少在 不允许吸烟的地方禁止使用电子尼古丁传送系统/电子非尼古丁传送系统viii; vii 如果将电子尼古丁传送系统/电子非尼古丁传送系统作为处方医药产品进行监管,并且法规执行得力,则应实行目 前针对此类产品的税收政策。 viii 参见附件 4.
