Provisional agenda (annotated) 1. Opening of the session 1.1 Adoption of the agenda and organization of work
Document FCTC/COP/4/1 Rev.1 contains the provisional agenda prepared by the Convention Secretariat in consultation with the Bureau of the Conference of the Parties, in accordance with Rule 6 of the Rules of Procedure of the Conference of the Parties. The Conference of the Parties is invited to review and consider adopting the provisional agenda. In considering the organization of its work, the Conference of the Parties may wish to establish two Committees, A and B, working in parallel, to consider items 5, 6 and 7 of the provisional agenda. Committee A could be entrusted with work on treaty instruments and technical matters under provisional agenda item 5, as well as provisional agenda items 6.1 and 6.2 on reporting, while Committee B could work on agenda items 6.3 to 6.5 related to implementation assistance and international cooperation and on budgetary and institutional matters under provisional agenda items 7.1 to 7.5. Agenda items 1 to 4 as well as 7.6 and 7.7 would be considered in plenary.
1.2
Credentials of participants
In accordance with Rule 19 of the Rules of Procedure, the Bureau of the Conference of the Parties, with the assistance of the Secretariat, will examine the credentials of the delegates and report to the Conference of the Parties.
2.
Application for observer status to the Conference of the Parties to the WHO Framework Convention on Tobacco control
The Conference of the Parties is informed in document FCTC/COP/4/2 Rev.1 of the applications for observer status to the Conference of the Parties received by the Secretariat from nongovernmental organizations. In accordance with decision FCTC/COP2(6), the Conference of the Parties is invited to review the recommendations of the Bureau of the Conference of the Parties and consider granting observer status in accordance with Rule 31 of the Rules of Procedure.

Invited speaker Report of the Convention Secretariat, followed by a general debate
Document FCTC/COP/4/3 contains the report of the Secretariat on activities under the Convention, in accordance with Article 24.3(d) of the Convention. The Conference is invited to note the report. In consultation with the Bureau of the Conference of the Parties, it is proposed that a special segment be allocated in the general debate to the role of the United Nations Development Assistance Framework in promoting the implementation of the Convention.
5.
Treaty instruments and technical matters 5.1 Protocol to eliminate illicit trade in tobacco products
In accordance with decisions FCTC/COP2(12) and FCTC/COP3(6), the Intergovernmental Negotiating Body on a Protocol on Illicit Trade in Tobacco Products decided1 to recommend to the Conference of the Parties that it consider the text of the draft protocol to eliminate illicit trade in tobacco products contained in document FCTC/COP/4/5. Document FCTC/COP/4/4 contains the report of the Chairperson of the Intergovernmental Negotiating Body outlining the status of negotiations and recommendations to the Conference of the Parties. At the request made at the fourth session of the Intergovernmental Negotiating Body, the Secretariat presents a report contained in document FCTC/COP/4/INF.DOC./1 which provides information to the Conference of the Parties on the financial implications of measures contained in the draft protocol. In addition, document FCTC/COP/4/INF.DOC./3 also provides information to the Conference of the Parties on possible options for further negotiations, outlining the legal and cost implications. The Conference of the Parties is invited to consider the draft protocol submitted by the Intergovernmental Negotiating Body and decide on the process for further negotiations and adoption of the protocol.
5.2
Guidelines for implementation of Articles 9 and 10 of the Convention: “Regulation of the contents of tobacco products” and “Regulation of tobacco product disclosures”
Document FCTC/COP/4/6 contains the text of the draft guidelines for implementation of Articles 9 and 10 of the Convention elaborated by the working group, as requested by the Conference of the Parties.2 The Conference of the Parties is invited to note the report of the working group, to review and consider adopting the guidelines. The Conference of the Parties is also invited to note the report prepared by WHO’s Tobacco Free Initiative on activities related to Articles 9 and 10, contained in document FCTC/COP/4/INF.DOC./2.

Guidelines for implementation of Article 12 of the Convention: “Education, communication, training and public awareness”
Document FCTC/COP/4/7 contains the text of the draft guidelines for implementation of Article 12 of the Convention elaborated by the working group, as requested by the Conference of the Parties.3 The Conference of the Parties is invited to review and consider adopting the guidelines.

Guidelines for implementation of Article 14 of the Convention “Demand reduction measures concerning tobacco dependence and cessation”
Document FCTC/COP/4/8 contains the text of the draft guidelines for implementation of Article 14 of the Convention elaborated by the working group as requested by the Conference of the Parties.1 The Conference of the Parties is invited to review and consider adopting the guidelines.
5.5
Economically sustainable alternatives to tobacco growing (in relation to Articles 17 and 18 of the Convention): progress report of the working group
Document FCTC/COP/4/9 contains the progress report of the working group established by the Conference of the Parties,2 including an outline of proposed policy options and recommendations on economically sustainable alternatives to tobacco growing in relation to Articles 17 and 18 of the Convention. The Conference of the Parties is invited to note the report of the working group and consider the outline of proposed policy options and recommendations.
5.6
Measures that would contribute to the elimination of cross-border advertising, promotion and sponsorship (in relation to recommendations of the former working group on Article 13 of the Convention)
The Conference of the Parties, at its previous sessions, adopted3 guidelines for implementation of Article 13 of the Convention and requested4 the Secretariat to assess the implications of recommendations made by the working group on other measures that would contribute to the elimination of cross-border advertising, promotion and sponsorship and to propose options for further work. The Conference of the Parties is invited to note the report of the Secretariat contained in document FCTC/COP/4/10 and to provide further guidance.
5.7
Technical report on price and tax policies (in relation to Article 6 of the Convention)
As requested by the Conference of the Parties,5 document FCTC/COP/4/11 contains the technical report of the WHO’s Tobacco Free Initiative relating to price and tax policies. The Conference of the Parties is invited to note the report and provide further guidance.
5.8
Control and prevention of smokeless tobacco products and electronic cigarettes
This item was proposed by a Party. The report contained in document FCTC/COP/4/12 provides background information and outlines the work carried out internationally in the areas concerned, to assist Parties in consideration of the item. The Conference of the Parties is invited to note the report and provide further guidance.
5.9
Implementation of Article 19 of the Convention: “Liability”
This item was proposed by a Party. Document FCTC/COP/4/13 contains the experience available in relevant international fora, as outlined in Article 19.5 of the Convention, as well as in the implementation reports of the

6.
Reporting, implementation assistance and international cooperation 6.1 Reports of the Parties and global progress report on implementation of the Convention
The Secretariat’s report on progress in implementing the Convention is contained in document FCTC/COP/4/14. The report has been prepared in accordance with decision FCTC/COP1(14) and is based on the analysis of the two-year and five-year implementation reports submitted by the Parties by 1 July 2010. The list of Parties that submitted reports between 1 July and 1 November 2010 is contained in document FCTC/COP/4/14 Add.1. Reports of the Parties submitted to the Secretariat can be found on the WHO FCTC web site at http://www.who.int/fctc/reporting. The Conference of the Parties is invited to note the report and provide further guidance; the Conference of the Parties may also wish to reflect on the conclusions contained in the report.
6.2
Standardization and harmonization of data and data collection initiatives
As requested by the Conference of the Parties,1 the report contained in document FCTC/COP/4/15 provides an overview of international tobacco-related data collection initiatives as well as recommendations on future steps concerning standardization and harmonization between different initiatives. The Conference of the Parties is invited to note the report and provide further guidance on the conclusions and recommendations contained therein.
6.3
Financial resources and mechanisms of assistance
The report contained in document FCTC/COP/4/16 outlines the activities undertaken by the Secretariat on financial resources and mechanisms of assistance, as requested by the Conference of the Parties.2 It also includes a review of progress made in promoting the transfer of technical and legal expertise and technology, as requested in the 2010–2011 workplan adopted by the Conference of the Parties.3 The Conference of the Parties is invited to note the report and provide guidance for further work.
6.4
Cooperation with international implementation of the Convention
organizations
and
bodies
for
strengthening
The Conference of the Parties, when adopting the budget and workplan for 2010–2011,3 requested the Secretariat to submit a report that would provide information to facilitate cooperation with competent international organizations and bodies, as a means of strengthening implementation of the Convention. The report contained in document FCTC/COP/4/17 focuses on the measures outlined in Article 23.5(g), Article 24.3(e) and Article 25 of the Convention. The Conference of the Parties is invited to note the report and provide guidance for further work.
6.5
Promoting South–South cooperation for implementation of the Convention
The report contained in document FCTC/COP/4/18 responds to the request of the Conference of the Parties reflected in the budget and workplan for 2010–2011, for an assessment of the potential of South–South cooperation to contribute to the implementation of the Convention. The Conference of the Parties is invited to note the report and provide guidance for further work.

Budgetary and institutional matters 7.1 Performance report for the 2008–2009 workplan and budget
The information presented by the Secretariat in documents FCTC/COP/4/19 and FCTC/COP/4/19 Add.1 covers implementation of the workplan and budget for the financial period 2008–2009 adopted by the Conference of the Parties.1 It also includes other activities from the 2010–2011 workplan which started in late 2009 to enable adherence to the timelines established by the Conference of the Parties. Finally, the report contains lessons learnt and observations for consideration by the Conference of the Parties. The Conference of the Parties is invited to note the report.
7.2
Interim performance report for the 2010–2011 workplan and budget
As requested by the Conference of the Parties,2 document FCTC/COP/4/20 provides information on the status of implementation of the first six months of the workplan and budget for the financial period 2010–2011. It should be read in conjunction with document FCTC/COP/4/19, the performance report for the 2008–2009 workplan and budget, as that document contains information on implementation of some activities from the 2010–2011 workplan and budget that it was necessary to begin in late 2009. Document FCTC/COP/4/20 Add. 1 provides an update on financial implementation as at 30 October 2010, while document FCTC/COP/4/20 Add. 2 contains an update on the status of collection of voluntary assessed contributions as at 30 October 2010. In addition, document FCTC/COP/4/INF.DOC./5 provides a consolidated overview of the status of the collection of voluntary assessed contributions over the bienniums 2006–2007, 2008–2009, and 2010–2011, again as at 30 October 2010. The Conference of the Parties is invited to note the report and the additional information submitted and provide guidance on the implementation of the 2010–2011 workplan and budget.
7.3
Proposed workplan and budget for the financial period 2012–2013
In accordance with Article 23 of the Convention, the Conference of the Parties shall adopt, at each ordinary session, a budget for the financial period until the next ordinary session. The proposed workplan and budget for the financial period 2012–2013 contained in document FCTC/COP/4/21 is presented to the Conference of the Parties in accordance with decision FCTC/COP3(19). In consultation with the Bureau of the Conference of the Parties, the structure of the proposed workplan indicates the treaty administration activities and costs that should be funded by the voluntary assessed contributions of Parties and those that are expected to be funded by extrabudgetary sources. More detailed information concerning proposed work and costs is presented in the explanatory note to the workplan and budget (document FCTC/COP/4/INF.DOC./4). The Conference of the Parties is invited to review and consider adopting the proposed workplan and budget for 2012–2013, including the amount and distribution of voluntary assessed contributions as indicated in the options presented in Annex 2.
7.4
Review of accreditation of nongovernmental organizations
The Secretariat conducted a review of accreditation of nongovernmental organizations that have observer status to the Conference of the Parties, as requested by the Conference of the Parties at its third session.2 The review was conducted in line with the criteria set out in Rule 31.2 of the Rules of Procedure and decision FCTC/COP2(6) of the Conference of the Parties, and in consultation with the Bureau of the Conference of the Parties. The Conference of the Parties is invited to note the report contained in document FCTC/COP/4/22 Rev.1 and consider the recommendations contained therein.

Logo of the WHO Framework Convention on Tobacco Control: report of the Secretariat
The Conference of the Parties adopted a logo for the Convention at its third session.1 The Conference of the Parties is invited to note the report of the Secretariat contained in document FCTC/COP/4/23 on the implementation and evaluation of the logo and on the measures taken for its legal protection, as requested by the Conference of the Parties.
7.6
Date and venue of the fifth session of the Conference of the Parties
The Conference of the Parties is expected to decide on the date and venue of its fifth session in accordance with Rules 3 and 4 of its Rules of Procedure. Document FCTC/COP/4/24 also informs the Conference of the Parties of the expression of interest expressed by a Party for hosting the fifth session. The Conference of the Parties is requested to decide on the date and venue of its fifth regular session.
7.7
Election of the President and the five Vice-Presidents of the Conference of the Parties
The election of officers of the Conference of the Parties is governed by Rule 21 of the Rules of Procedure. The Conference of the Parties is expected to elect, before the end of the fourth session, a President and five Vice-Presidents of the Conference of the Parties, from among the representatives of the Parties present at the session. These officers shall constitute the next Bureau of the Conference of the Parties. Each of the WHO Regions shall be represented by one Bureau member.
