Report of meetings on Friday 17 October 2014 Seventh meeting of Committee A
In the chair: Professor Nuntavarn Vichit-Vadakan (Thailand) Item 4 continued Treaty instruments and technical matters The programme of work was amended so that item 4.6 “Further development of the partial guidelines for implementation of Articles 9 and 10 of the WHO FCTC: “Regulation of the contents of tobacco products” and “Regulation of tobacco product disclosures”: report by the working group”, could be taken up at the beginning of the meeting. Item 4.6 Further development of the partial guidelines for implementation of Articles 9 and 10 of the WHO FCTC: “Regulation of the contents of tobacco products” and “Regulation of tobacco product disclosures”: report by the working group Under this agenda item, the Chair invited a member of the working group to introduce document FCTC/COP/6/13 on behalf of the key facilitators. The Committee was invited to note the report of the working group. The Chair further invited Professor Ghazi Zaatari to present, on behalf of WHO, two related documents prepared by the WHO: FCTC/COP/6/14 and FCTC/COP6/14 Add.1. Professor Zaatari informed the Committee of the work in progress in relation to Articles 9 and 10 of the WHO FCTC, as noted in the document FCTC/COP/6/14. The Chair invited the Committee to consider the draft decision as contained in document FCTC/COP/6/A/Conf.Paper No.9 and the floor was opened for discussion. The Head of the Convention Secretariat responded to issues raised and made a general comment concerning budgetary arrangements. Professor Ghazi Zaatari and the Office of the Legal Counsel responded to multiple questions and issues raised by delegations. The Chair read out the numerous proposed amendments and the draft decision as amended was approved by consensus. Item 4.3 continued Implementation of Article 19 of the WHO FCTC: “Liability”: report by the expert group The Chair of the informal drafting group established by Committee A presented the draft decision contained in document FCTC/COP/6/A/Conf.Paper No.4 Rev.2. Comments were invited from the floor and the Office of the Legal Counsel responded to issues raised regarding the nomination of members for expert parties. Following a discussion, the draft decision was approved as amended and the item closed. Item 4.7 continued Impact assessment of the WHO FCTC The Committee was asked to consider the draft decision contained in document FCTC/COP/6/A/Conf.Paper No.6 Rev.1 and the item was opened for discussion. Following a debate, the draft decision as amended was approved by consensus and the item closed.

Following a question from the floor the Office of the Legal Counsel clarified that should the draft decision be adopted the proposed changes would only apply to future appointments. The Chair suspended the item to allow time for delegates to consult with the Office of the Legal Counsel to ensure correct wording of the draft decision. The item remains open. Item 6.6 continued Review of accreditation of nongovernmental organizations as observers to the Conference of the Parties The Chair asked delegates if they were ready to approve the draft decision contained in document FCTC/COP/6/B/Conf.Paper No.8. The Committee approved the draft decision without amendment. The item is now closed. Consensus on the wording of the draft decision could not be agreed on so the Chair asked the Convention Secretariat to make arrangements for a drafting group to meet during the lunch break. The Chair of the working group on sustainable measures made some final remarks on the process leading to the draft decision which had just been approved. The item is closed.

The Chair asked the Committee if they were ready to approve the draft decision contained in document FCTC/COP/6/B/Conf.Paper No.5 Rev.3. The Committee approved the draft decision, as amended. The Chair then suspended this item and indicated that the Committee would consider the draft decision contained in document FCTC/COP/6/B/Conf.Paper No.3 Rev.2 after the lunch break. The Chair of the informal drafting group reported on the discussions held by the group and reported that they could not reach consensus on the title of the draft decision, but had reached consensus on most of the text. Discussion of this item was suspended while a small informal group met with the view to reaching consensus on the title. Implementation of Article 5.3 of the WHO FCTC: evolving issues related to the interference of the tobacco industry (item proposed by a Party) A member of the informal group announced that no consensus had been reached regarding the footnotes. The Office of the Legal Counsel responded to an issue raised concerning the Vienna Convention on Diplomatic Relations. After further discussions the draft decision was approved as amended and the item closed.

Electronic nicotine delivery systems, including electronic cigarettes A member of the bilateral meeting presented the agreed upon text. Following a brief discussion, the draft decision was approved as amended.

Economically sustainable alternatives to tobacco growing (in relation to Articles 17 and 18 of the WHO FCTC): report by the working group The Chair of the informal drafting group provided a summary of the discussions that took place during the group’s meetings with interested Parties and key facilitators regarding changes made to the policy options and recommendations and its annexes. As the document FCTC/COP/6/A/Conf.Paper No.10 was only available in English, the Chair announced that she would read through each amendment page by page for the Committee’s consideration. Comments were invited from the floor. The draft decision was approved as amended and the agenda item closed. The meeting was adjourned.

The Chair invited comments from the floor before asking if the Committee was ready to approve the draft decision. After much discussion it was clear that the Committee would not be able to reach a consensus on this draft decision as presented in document FCTC/COP/6/B/Conf.Paper No.3 Rev.2. The Chair suspended the discussion to allow time to take advice from the Convention Secretariat and the Office of the Legal Counsel on how to proceed. The item remains open. The Chair invited the Head of the Convention Secretariat to address some questions which had been posed in an earlier discussion on this item. Based on discussions, the Chair asked the Convention Secretariat to prepare a draft decision for later consideration. The item remains open.

Voluntary assessed contributions The Chair reopened this item and invited comments from the floor. The representative of the European Union presented verbally a draft decision on this item to be considered by the Committee. The Chair invited further comments on the document FCTC/COP/6/23 and the proposed draft decision read out by the European Union representative. Given that the delegates had no time to read the draft decision the Chair suspended the discussion to allow time for the text to be distributed and reviewed.

Reporting, implementation assistance and international cooperation Reporting arrangements under the WHO FCTC The Chair invited the Chair of the informal drafting group which met during the lunch break to provide feedback on the group’s discussions on the draft decision contained in document FCTC/COP/6/B/Conf.Paper No.2 Rev.1. The Chair asked the Committee if they were prepared to approve the draft decision as amended during the informal drafting group meeting. The Committee debated the text presented and further proposals for amendments were proposed with no consensus being found. The Chair asked concerned delegations to please go back to the informal drafting group and to attempt to find a consensus which could be brought back to the Committee. The item remains open.

The Chair invited the delegate from Dibouti to provide some feedback on the informal drafting group on the draft decision contained in document FCTC/COP/6/B/Conf.Paper No.10. Proposed workplan and budget for the financial period 2016-2017 The Chair reopened this item and reminded the Committee that a proposed workplan and budget for the financial period 2016–2017 should be agreed in this Committee to be submitted to plenary. Both secretaries of Committees A and B were invited to make remarks on the outcomes of the work of their respective Committees before the Chair invited comments from the floor, including any questions to the Convention Secretariat. Many items were raised, and responded to by the Head of the Convention Secretariat, and a new draft decision on travel support was tabled by Palau. The Chair suspended discussion on this item to move to the next agenda item.
