The transfer by virtue of section 21 of a function exercisable by the Secretary of State to the Scottish Ministers (a “transferred function”) does not affect the validity of anything done (or which has effect as if done) by or in relation to the Secretary of State before the commencement of that section.
Anything (including legal proceedings) which, at that commencement, is in the process of being done by or in relation to the Secretary of State may, so far as it relates to a transferred function, be continued by or in relation to the Scottish Ministers.

In Schedule 3—
Part 1 contains further amendments relating to the disapplication of stamp duty land tax to Scotland, and
Part 2 makes provision, in consequence of the disapplication of paragraph 1(1)(b) of Schedule 10 to the Finance Act 2003 (prescribed information in land transaction returns) to transactions relating to land in Scotland, about the supply of information to Her Majesty's Revenue and Customs.
This section has effect in relation to land transactions with an effective date on or after such date as is appointed by the Treasury by order under this subsection.
But this section does not have effect in relation to any transaction—
effected in pursuance of a contract entered into and substantially performed on or before the date on which this Act receives Royal Assent, or
effected in pursuance of a contract entered into on or before that date and not excluded by subsection (6).
A transaction effected in pursuance of a contract entered into on or before the date on which this Act receives Royal Assent is excluded if—
there is any variation of the contract, or assignation of rights under the contract, after that date,
the transaction is effected in consequence of the exercise after that date of any option, right of pre-emption or similar right, or
after that date there is an assignation, subsale or other transaction relating to the whole or part of the subject-matter of the contract as a result of which a person other than the purchaser under the contract becomes entitled to call for a conveyance.
In Part 4A of the 1998 Act (as inserted by section 23), after Chapter 3 (inserted by section 28) insert—
Tax may not be charged in accordance with the provision inserted by this section on a disposal if the disposal is made before the date appointed under section 31(4).
Part 3 of the Finance Act 1996 (landfill tax) is amended as follows.

make reports on the implementation and operation of this Part (see subsection (5)),
lay a copy of each report before each House of Parliament, and
send a copy of each report to the Scottish Ministers, who must lay a copy of it before the Scottish Parliament.
The Scottish Ministers must—
make reports on the implementation and operation of this Part (see subsection (5)),
lay a copy of each report before the Scottish Parliament, and
send a copy of each report to the Secretary of State, who must lay a copy of it before each House of Parliament.
A report must be made under each of subsections (1) and (2)—
before the end of the period of one year beginning with the day on which this Act is passed, and
thereafter, before the end of each subsequent period of one year until the final reports are made under subsection (4).
Final reports must be made on or as soon as practicable after—
1 April 2020, or
if later, the first anniversary of the day on which the last of the provisions of this Part comes into force.
A report on the implementation and operation of this Part must include—
a statement of the steps which have been taken, whether by the maker of the report or by others, since the making of the previous report (or, in the case of the first report, since the passing of this Act) towards the commencement of the provisions of this Part,
a statement of the steps which the maker of the report proposes should be taken, whether by the maker of the report or by others, towards the commencement of the provisions of this Part,
an assessment of the operation of the provisions of this Part which have been commenced,
an assessment of the operation of any other powers to devolve taxes to the Scottish Parliament or to change the powers of the Scottish Ministers to borrow money, and of any other changes affecting the provisions inserted or amended by this Part,
the effect of this Part on the amount of any payments made by the Secretary of State under section 64(2) of the 1998 Act (payments into the Scottish Consolidated Fund), and
any other matters concerning the sources of revenue for the Scottish Administration (within the meaning of section 126(6) of the 1998 Act) which the maker of the report considers should be brought to the attention of the Parliament of the United Kingdom or the Scottish Parliament.

The Secretary of State may by order—

make further provision in relation to any matter dealt with by those sections.
Provision made by order under subsection (4) may—
amend, repeal or revoke an enactment passed or made before the order is made;
confer power on the Secretary of State or the Scottish Ministers to make an order or regulations;
include consequential, transitional or saving provision.
In this section “enactment” includes an enactment contained in subordinate legislation (within the meaning of the Interpretation Act 1978) and an enactment contained in, or in an instrument made under, an Act of the Scottish Parliament.
In making the first order under subsection (4) the Secretary of State must take into account the report made in accordance with subsection (1)(b).
No order under subsection (4) may be made unless the Secretary of State has consulted the Scottish Ministers.
A statutory instrument containing an order under subsection (4) may not be made unless a draft of the instrument has been laid before and approved by a resolution of each House of Parliament.

A statutory instrument containing an order under subsection (1) or (2) which includes provision amending or repealing any provision of an Act or an Act of the Scottish Parliament may not be made unless a draft of the instrument has been laid before and approved by a resolution of each House of Parliament.
Any other statutory instrument containing an order under subsection (1) or (2) is subject to annulment in pursuance of a resolution of either House of Parliament.
A statutory instrument containing an order under subsection (3) which includes provision amending or repealing any provision of an Act may not be made unless a draft of the instrument has been laid before and approved by a resolution of the House of Commons.
Any other statutory instrument containing an order under subsection (3) is subject to annulment in pursuance of a resolution of the House of Commons.
There shall be paid out of money provided by Parliament any increase attributable to this Act in the sums payable under any other Act out of money so provided.
There shall be paid into the Consolidated Fund any sums received by a Minister of the Crown by virtue of this Act which are not payable into the National Loans Fund.
The following come into force on the day on which this Act is passed—
sections 40 to 43;
this section;
section 45.
The following provisions come into force at the end of the period of two months beginning with the day on which this Act is passed—
section 11;
Part 3, except section 25(7) (and Schedule 2) and section 32.
Subsection (2)(b) is subject to the provision made in the following sections as to how those sections have effect—
sections 25(1) to (6) and 26;
sections 28 and 29;
sections 30 and 31.
The following provisions come into force on such day as the Treasury may by order appoint—
section 25(7) and Schedule 2;
section 32.
The other provisions of this Act come into force on such day as the Secretary of State may by order appoint.
The Secretary of State or the Treasury may appoint different days for different purposes.
This Act may be cited as the Scotland Act 2012.
Section 8
Schedule 1 to the 1998 Act (constituencies, regions and regional members) is amended as follows.
“HMRC” means Her Majesty's Revenue and Customs;
For “the Electoral Commission” or “the Boundary Committee” in each place substitute “ the Boundary Commission for Scotland ”. Sub-paragraph (1) is subject to the amendments made by paragraphs 3 to 7.
Omit paragraph 5 and the italic heading preceding it.
Paragraph 7 is amended as follows. For sub-paragraph (2) substitute— Omit sub-paragraphs (5) and (6).
Paragraph 8 is amended as follows. For sub-paragraph (1) substitute— Omit sub-paragraph (3).

In this Part of this Schedule—
“office-holder” means—
a member of the Scottish Government, and
the holder of an office in the Scottish Administration which is not a ministerial office (within the meaning of section 126(8) of the 1998 Act);
“office-holder” means—
“Scottish transaction” means the acquisition of—
an estate, interest, right or power in or over land in Scotland, or
the holder of an office in the Scottish Administration which is not a ministerial office (within the meaning of section 126(8) of the 1998 Act);
“Scottish transaction” means the acquisition of—
an estate, interest, right or power in or over land in Scotland, or
the benefit of an obligation, restriction or condition affecting the value of any such estate, interest, right or power.
An office-holder must provide to HMRC such of the information falling within sub-paragraph (2) as HMRC may require. Information falls within this sub-paragraph if it is relevant information regarding Scottish transactions and is in the possession or under the control of the office-holder. Information is to be provided under sub-paragraph (1) in such form as HMRC may reasonably specify.
Information acquired by HMRC under paragraph 34 is to be treated, for the purposes of the Commissioners for Revenue and Customs Act 2005, as acquired in connection with a function of theirs.
Section 31
The Finance Act 1996 is amended as follows.
Omit section 66(b) (landfill sites in Scotland).
Omit section 67(b) (operators of landfill sites in Scotland).
In section 70 (interpretation)—
