<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-1"><num>1</num><heading>Secure 16 to 19 Academies (funding, impact and consultation)</heading><subsection eId="section-1-1"><num>(1)</num><content><p>The Academies Act 2010 is amended as follows.</p></content></subsection><subsection eId="section-1-2"><num>(2)</num><content><p><mod>In section 2 (payments under Academy agreements), after subsection (2) insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(2A)</num><content><p>Subsection (2) applies to an Academy agreement in respect of a secure 16 to 19 Academy as though the references to 7 years were references to 2 years.</p></content></subsection></quotedStructure></mod></p></content></subsection><subsection eId="section-1-3"><num>(3)</num><content><p><mod>In section 9 (impact: new and expanded educational institutions), in subsection (1), after paragraph (b) (and on a new line) insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><p>except where the institution, if the arrangements are entered into, is to be a secure 16 to 19 Academy.</p></quotedStructure></mod></p></content></subsection><subsection eId="section-1-4"><num>(4)</num><intro><p>In section 10 (consultation: new and expanded educational institutions)—</p></intro><level class="para1" eId="section-1-4-a"><num>(a)</num><content><p><mod>after subsection (2) insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection eId="d25e123"><num>(2A)</num><intro><p>But where the educational institution, if the arrangements are entered into, is to be a secure 16 to 19 Academy—</p></intro><level class="para1"><num>(a)</num><content><p>the person is not required to carry out a consultation on that question, and</p></content></level><level class="para1" eId="d25e135"><num>(b)</num><content><p>they must instead carry out a consultation on the question of how they should cooperate with potential local partners in connection with the establishment and carrying on of the Academy.</p></content></level></subsection><subsection><num>(2B)</num><intro><p>“Potential local partners” in subsection <ref href="#d25e123">(2A)</ref><ref href="#d25e135">(b)</ref> means—</p></intro><level class="para1"><num>(a)</num><content><p>persons exercising functions of a public nature, and</p></content></level><level class="para1"><num>(b)</num><content><p>so far as not falling within paragraph (a), proprietors of educational institutions,</p></content></level><wrapUp><p>with whom the person carrying out the consultation thinks it appropriate to cooperate.</p></wrapUp></subsection></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="section-1-4-b"><num>(b)</num><content><p><mod>in subsection (3), for “The consultation” substitute <quotedText>“A consultation under this section”</quotedText>.</mod></p></content></level></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2"><num>2</num><heading>Extent, commencement and short title</heading><subsection eId="section-2-1"><num>(1)</num><content><p>This Act extends to England and Wales.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><content><p>This Act comes into force at the end of the period of two months beginning with the day on which it is passed.</p></content></subsection><subsection eId="section-2-3"><num>(3)</num><content><p>This Act may be cited as the Secure 16 to 19 Academies Act 2026.</p></content></subsection></section>
