eId="section-1"><num>1</num><heading> Remaining at large after temporary release.</heading><subsection eId="section-1-1"><num>(1)</num><intro><p>Subject to subsection (2) below, a person who has been temporarily released in pursuance of rules made under section 47(5) of the <noteRef href="#c830645" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Prison Act 1952 (rules for temporary release) is guilty of an offence if—</p></intro><level class="para1" eId="section-1-1-a"><num>(a)</num><content><p>without reasonable excuse, he remains unlawfully at large at any time after becoming so at large by virtue of the expiry of the period for which he was temporarily released; or</p></content></level><level class="para1" eId="section-1-1-b"><num>(b)</num><content><p>knowing or believing an order recalling him to have been made and while unlawfully at large by virtue of such an order, he fails, without reasonable excuse, to take all necessary steps for complying as soon as reasonably practicable with that order.</p></content></level></subsection><subsection eId="section-1-1A"><num><noteRef href="#key-86cb7d031265cb394b344dad4436842f" uk:name="commentary" eId="section-1-2"><num>(2)</num><content><p>Subsection (1) above shall not apply in the case of a person temporarily released from a secure training centre <ins class="first last" ukl:ChangeId="key-241d4bc44579f7e5740849407d920422-1453735755528" ukl:CommentaryRef="key-241d4bc44579f7e5740849407d920422"><noteRef uk:name="commentary" href="#key-241d4bc44579f7e5740849407d920422" class="commentary"/> or secure college</ins>.</p></content></subsection><subsection eId="section-1-3"><num><ins class="substitution first" ukl:ChangeId="key-e286b396c6ab2765bde50e448cd804b2-1453735918566" ukl:CommentaryRef="key-e286b396c6ab2765bde50e448cd804b2"><noteRef uk:name="commentary" href="#key-e286b396c6ab2765bde50e448cd804b2" person guilty of an offence under this section is liable—</ins></p></intro><level class="para1" eId="section-1-3-a"><num><ins class="substitution" ukl:CommentaryRef="key-e286b396c6ab2765bde50e448cd804b2">(b)</ins></num><content><p><ins class="substitution" ukl:ChangeId="key-e286b396c6ab2765bde50e448cd804b2-1453735918566" ukl:CommentaryRef="key-e286b396c6ab2765bde50e448cd804b2">on summary conviction to imprisonment for a term not exceeding </ins><ins class="substitution" ukl:ChangeId="key-e286b396c6ab2765bde50e448cd804b2-1453735918566" ukl:CommentaryRef="key-e286b396c6ab2765bde50e448cd804b2"><ins class="substitution first last" ukl:ChangeId="key-5ea5fd8fe9ac7964ebaafdf47ec1a404-1678269357557" ukl:CommentaryRef="key-5ea5fd8fe9ac7964ebaafdf47ec1a404"><noteRef uk:name="commentary" href="#key-5ea5fd8fe9ac7964ebaafdf47ec1a404" class="commentary"/>the general limit in a magistrates’ court</ins></ins><ins class="substitution last" ukl:ChangeId="key-e286b396c6ab2765bde50e448cd804b2-1453735918566" ukl:CommentaryRef="key-e286b396c6ab2765bde50e448cd804b2"> or a fine (or both).</ins></p></content></level></subsection><subsection eId="section-1-4"><num>(4)</num><content><p>An offence under this section shall be taken to be committed at the place where the offender was required to be detained immediately before being temporarily released.</p></content></subsection><subsection eId="section-1-5"><num>(5)</num><content><p>A person shall be deemed for the purposes of this section to be unlawfully at large whenever he is deemed to be so at large for the purposes of section 49 of the <noteRef href="#c830646" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Prison Act 1952 (which confers powers of arrest).</p></content></subsection><subsection eId="section-1-6"><num>(6)</num><content><p>This section shall not apply where the period of temporary release expired, or the order of recall was made, before the commencement of this <section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-2"><num>2</num><heading> Entry to arrest a person unlawfully at large.</heading><hcontainer name="wrapper2"><subsection eId="section-2-1"><num>(1)</num><content><p><mod>In subsection (1) of section 17 of the <noteRef href="#c830647" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Police and Criminal Evidence Act 1984 (entry for the purpose of arrest), after paragraph (c) there shall be inserted the following paragraphs—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><level class="para1"><num>(ca)</num><content><p>of arresting, in pursuance of section 32(1A) of the Children and Young Persons Act 1969, any child or young person who has been remanded or committed to local authority accommodation under section 23(1) of that Act;</p></content></level><level class="para1"><num>(cb)</num><intro><p>of recapturing any person who is, or is deemed for any purpose to be, unlawfully at large while liable to be detained—</p></intro><level class="para2"><num>(i)</num><content><p>in a prison, remand centre, young offender institution or secure training centre, or</p></content></level><level class="para2"><num>(ii)</num><content><p>in pursuance of section 53 of the Children and Young Persons Act 1933 (dealing with children and young persons guilty of grave crimes), in any other place;</p></content></level></level></quotedStructure></mod></p></content></subsection></hcontainer><hcontainer name="wrapper2"><intro><p><mod>and in paragraph (d) of that subsection, for “a person” there shall be substituted <quotedText>“ any person whatever ”</quotedText>.</mod></p></intro><subsection eId="section-2-2"><num><noteRef href="#key-c074776a2442a079029606f9e33c25ae" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>(2)</num><content><p>. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .</p></content></subsection></hcontainer></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3"><num>3</num><heading> Short title, commencement and extent.</heading><subsection eId="section-3-1"><num>(1)</num><content><p>This Act may be cited as the Prisoners (Return to Custody) Act 1995.</p></content></subsection><subsection eId="section-3-2"><num>(2)</num><content><p>This Act shall come into force on such day as the Secretary of State may by order made by statutory instrument appoint, and different days may be appointed under this subsection for different purposes.</p></content></subsection><subsection eId="section-3-3"><num>(3)</num><content><p>This Act extends to England and Wales only.</p></content></subsection></section>
