<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-2"><num>2</num><heading> Dishonestly retaining a wrongful credit.</heading><subsection eId="section-2-1"><num>(1)</num><content><p><mod>After section 24 of the Theft Act 1968 insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><section><num>24A</num><heading> Dishonestly retaining a wrongful credit.</heading><subsection><num>(1)</num><intro><p>A person is guilty of an offence if—</p></intro><level class="para1"><num>(a)</num><content><p>a wrongful credit has been made to an account kept by him or in respect of which he has any right or interest;</p></content></level><level class="para1"><num>(b)</num><content><p>he knows or believes that the credit is wrongful; and</p></content></level><level class="para1"><num>(c)</num><content><p>he dishonestly fails to take such steps as are reasonable in the circumstances to secure that the credit is cancelled.</p></content></level></subsection><subsection><num>(2)</num><content><p>References to a credit are to a credit of an amount of money.</p></content></subsection><subsection><num>(3)</num><content><p>A credit to an account is wrongful if it is the credit side of a money transfer obtained contrary to section 15A of this Act.</p></content></subsection><subsection><num>(4)</num><intro><p>A credit to an account is also wrongful to the extent that it derives from—</p></intro><level class="para1"><num>(a)</num><content><p>theft;</p></content></level><level class="para1"><num>(b)</num><content><p>an offence under section 15A of this Act;</p></content></level><level class="para1"><num>(c)</num><content><p>blackmail; or</p></content></level><level class="para1"><num>(d)</num><content><p>stolen goods.</p></content></level></subsection><subsection><num>(5)</num><content><p>In determining whether a credit to an account is wrongful, it is immaterial (in particular) whether the account is overdrawn before or after the credit is made.</p></content></subsection><subsection><num>(6)</num><content><p>A person guilty of an offence under this section shall be liable on conviction on indictment to imprisonment for a term not exceeding ten years.</p></content></subsection><subsection><num>(7)</num><content><p>Subsection (8) below applies for purposes of provisions of this Act relating to stolen goods (including subsection (4) above).</p></content></subsection><subsection><num>(8)</num><content><p>References to stolen goods include money which is dishonestly withdrawn from an account to which a wrongful credit has been made, but only to the extent that the money derives from the credit.</p></content></subsection><subsection><num>(9)</num><content><p>In this section “account” and “money” shall be construed in accordance with section 15B of this Act.</p></content></subsection></section></quotedStructure></mod></p></content></subsection><subsection eId="section-2-2"><num>(2)</num><content><p>This section applies to wrongful credits made on or after the day on which this Act is passed.</p></content></subsection></section>

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-5"><num>5</num><heading> Short title and extent.</heading><subsection eId="section-5-1"><num>(1)</num><content><p>This Act may be cited as the Theft (Amendment) Act 1996.</p></content></subsection><subsection eId="section-5-2"><num>(2)</num><content><p>Subject to subsection (3), this Act extends to England and Wales only.</p></content></subsection><subsection eId="section-5-3"><num>(3)</num><intro><p>An Order in Council under paragraph 1(1)(b) of Schedule 1 to the <noteRef href="#c863049" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Northern Ireland Act 1974 (legislation for Northern Ireland in the interim period) which contains a statement that it is made only for purposes corresponding to the purposes of this Act—</p></intro><level class="para1" eId="section-5-3-a"><num>(a)</num><content><p>shall not be subject to paragraph 1(4) and (5) of that Schedule (affirmative resolution of both Houses of Parliament); but</p></content></level><level class="para1" eId="section-5-3-b"><num>(b)</num><content><p>shall be subject to annulment by resolution of either House.</p></content></level></subsection></section>
